    In my paper I discuss the argument that the absence of the legal possibility to contract same-sex marriages is discriminatory. I argue that there is no analogy between the legal situation of same-sex couples and African-Americans, women or disabled persons in the nineteenth century.     [PERSONHOOD IN AFRICAN PHILOSOPHY]. W artykule została omówiona i poddana analizie debata między dwoma współczesnymi afrykańskimi filozofami Ifeanyim A. Menkitim z Nigerii oraz Kwame Gyekyem z Ghany. Debata ta dotyczy typowych dla niektórych afrykańskich kultur sposobów myślenia o istocie człowieczeństwa, tj. o byciu człowiekiem (osobą, person).     Klasyczne teorie ekspresji, identyfikując treści uczuciowe dzieła sztuki z przeżyciami twórcy czy też odbiorcy, zdawały się wyprowadzać je poza dzieło. W konsekwencji formalizm treści takie – jako wobec dzieła zewnętrzne – uznawał za obojętne dla jego wartości i istoty.
