Drawing on a close reading of Pierre Bourdieu’s works, I offer five lessons for a science of crime and punishment: always historicize; dissect symbolic categories; produce embodied accounts; avoid state thought; and embrace commitment. I offer illustrative examples and demonstrate the practical implications of Bourdieu’s ideas, and I apply the lessons to a critique of orthodox criminology.

Non-naturalists about normativity hold that there are instantiable normative properties which are metaphysically discontinuous with natural properties. One of the central challenges to non-naturalism is how to reconcile this discontinuity with the supervenience of the normative on the natural. Drawing on J. L. Mackie’s seminal but highly compressed discussion in Ethics: Inventing Right and Wrong, this paper argues that the supervenience challenge as usually conceived is merely a symptom of a more fundamental challenge in the vicinity.

J. L. Mackie famously argued that a commitment to non-existent objective values permeates ordinary moral thought and discourse. According to a standard interpretation, Mackie construed this commitment as a universal and indeed essential feature of moral judgments. In this paper I argue that we should rather ascribe to Mackie a form of semantic pluralism, according to which not all moral judgments involve the commitment to objective values. This interpretation not only makes better sense of what Mackie actually says, but also (...) renders his error theory immune to a powerful objection. (shrink)

Cet article cherche à approfondir la conclusion de Hume selon laquelle l’induction, malgré son importance comme méthode inférentielle, est injustifiable. J’argumente en particulier que l’induction devrait être comprise comme un processus psychologique fondamental. Mon plan est le suivant : après un résumé du problème de l’induction humien, j’offre une rapide argumentation en faveur de la conceptualisation de l’induction comme une inférence à la meilleure explication (IME). Ensuite, je propose un argument original visant à montrer que l’IME est un processus psychologique (...) fondamental. Cet argument s’appuie sur une analyse du concept d’explication prouvant qu’une explication nécessite toujours l’existence d’un agent épistémique. J’utilise ce résultat afin de montrer que l’IME est un processus psychologique fondamental. Si l’induction est bel et bien une forme d’IME, l’induction est donc elle aussi un processus psychologique fondamental. (shrink)

Or, les institutions publiques savent que leurs recommandations seront souvent ignorées en partie par le décideur. Cette situation de « conformité partielle » aux recommandations soulève plusieurs problèmes de nature philosophique pour les institutions. En nous appuyant sur une analyse de 570 recommandations tirées de 40 documents et rapports du secteur public québécois, nous identifions deux enjeux entourant la structure des recommandations issues (...) du secteur public. In The Birthright Lottery, Ayelet Shachar subjects the institution of birthright citizenship to close scrutiny by applying to citizenship the historical and philosophical critique of hereditary ownership built up over four centuries of liberal and democratic theory, and proposing compelling alternatives drawn from the theory of private law to the usual modes of conveyance of membership. Nonetheless, there are some difficulties with this critique. First, the analogy between entailed property and birthright citizenship is not as illustrative as Shachar intends it (...) to be; second, the mechanism of the birthright privilege levy is insufficient for addressing structural impediments to growth; and third, the principle of ius nexi, while an important corrective to currently dominant principles of nationality, will likely have effects both unnecessary and insufficient to correct the injustices that Shachar identifies. In the end, the most significant improvements in the lives of the neediest persons on the planet are more likely advanced through conventional arguments for the lowering of barriers to the circulation of goods, labor, and capital. Dans cet article, je propose de défendre le monisme russellien, une théorie posant l’existence de quiddités phénoménologiques au fondement de la réalité. Je propose en particulier de montrer que le monisme russellien échappe aux objections qui en font une version inadéquate du physicalisme. Pour ce faire, j’identifie les trois raisons qui motivent le physicalisme, c’est-à-dire la parcimonie, le naturalisme et l’argument de la clôture causale, et j’argumente qu’il faut considérer que le monisme russellien satisfait ces trois motivations. Contemporary theorists critical of the current vogue for compassion might like to turn to Friedrich Nietzsche as an obvious ally in their opposition to the sentiment. Yet this essay argues that Nietzsche’s critique of compassion is not entirely critical, and that the endorsement of one’s sympathetic feelings is actually a natural outgrowth of Nietzsche’s immoralist ethics. Nietzsche understands the tendency to share in the suffering of their inferiors as a distinctive vulnerability of the spiritually strong and healthy. Their compassion, however, (...) is an essential element of the imaginative creativity that Nietzsche holds to be the goal of human existence. Although shared suffering may prove debilitating for some, great individuals must come to affirm their compassion as necessary in achieving accurate knowledge of the human condition. (shrink)

Empirical research has distinguished moral judgments that focus on an act and the actor’s intention or mental states, and those that focus on results of an action and then seek a causal actor. Studies indicate these two types of judgments may result from a “dual-process system” of moral judgment (Cushman 2008, Kneer and Machery 2019). Results-oriented judgements may be subject to the problem of resultant moral luck because different results can arise from the same action and intention. While some argue (...) luck should not bear on persons’ culpability, Victor Kumar has argued that the tendency to hold unlucky agents responsible for harm is justified by consequentialist aims of punishment (Kumar 2019). In contrast, judgments that focus on acts and intentions may be primarily retributive. Kumar claims that judgments focused on results track external, public harm because this increases the reliability of punishment and better achieves instrumental aims, including deterrent effect. In this chapter I examine rape cases using Kumar’s theory of punishment. Rape involves outcomes that are not publicly available. If judgments of punishment depend on outcomes, then we would expect such judgments to be less stable for those instances of wrongdoing that lack public outcomes such as rape, because such judgments would rely instead on often biased and unreliable inferential processes to establish the presence of mental states, which are essentially private. In this way Kumar’s theory actually predicts the way in which we see criminal justice institutions fail with regard to arrest, prosecution, and punishment related to rape; and we might expect similar failures for other crimes that lack publicly available results. In sum, a fundamental problem with institutionalized punishment centered upon results may be that some crimes sit within a moral blindspot. (shrink)

Historically, laws and policies to criminalize drug use or possession were rooted in explicit racism, and they continue to wreak havoc on certain racialized communities. We are a group of bioethicists, drug experts, legal scholars, criminal justice researchers, sociologists, psychologists, and other allied professionals who have come together in support of a policy proposal that is evidence-based and ethically recommended. We call for the immediate decriminalization of all so-called recreational drugs and, ultimately, for their timely and appropriate legal regulation. We (...) also call for criminal convictions for nonviolent offenses pertaining to the use or possession of small quantities of such drugs to be expunged, and for those currently serving time for these offenses to be released. In effect, we call for an end to the “war on drugs.”. (shrink)

Michael Slote’s Moral Sentimentalism is a wonderful model of a particular, under-appreciated philosophical method. It demonstrates that exciting, original work can be created by putting old ideas to new uses, proving once again that the classics of moral and political philosophy offer too rich an array of intellectual resources to leave to historians alone. Whenever one is reclaiming old ideas, however, the most important decision is which ideas to reclaim, and which to leave in the dustbin of history. Slote makes (...) use of many ideas drawn from history’s greatest moral sentimentalist, David Hume, but he rejects many others. The work of Hume’s closest friend and greatest sentimentalist ally, Adam Smith, is rejected without adequate explanation. Smith is mentioned, but quickly dismissed. Yet even though Smith makes little contribution to Slote’s own version of sentimentalism, I think he deserved greater discussion in this book. Smith and Slote address many of the same subjects, using the same basic sentimentalist approach, but they come to very different conclusions. It is thus possible to construct a fruitful debate between them—a debate in which, since he can no longer speak on his own behalf, I will be taking Smith’s side. (shrink)

The study investigated the awareness and utilization of e-learning technologies among vocational and technical education (VTE) students. A descriptive survey research design was used for this study, and the population consisted of 551 VTE students. A simple random sample of 62 VTE students was selected. The data collection instrument was a questionnaire. The reliability of the questionnaire was assessed using Cronbach's alpha analysis, and the reliability index was found to be within the acceptable limit of 0.70. An online survey using (...) Google Forms was used to collect the data. The study tested two null hypotheses using binary logistic regression models based on age, department level of study, and devices owned. The data was analyzed using frequency, percentages, and mean. The major findings from the data analysis indicated that VTE students had an awareness and utilization rate of 84.8% for the e-learning website, 75.6% for Google Classroom, and 60.6% for smart boards and video conferencing. However, 24.4% of the students were still unaware of the Moodle Learning Management System and the Canvas e-learning platform at the University of Nigeria Nsukka. Based on these findings, it is recommended that VTE students receive proper training to effectively utilize the e-learning technologies available to them, which would aid in fostering creativity and innovation. This study investigated the influence of mothers' occupation on children's upbringing in the Udenu Local Government Area in Enugu State. Specifically, the study aimed to determine the feeding, clothing, academic, and health practices adopted by mothers in Enugu State. The study utilized a survey research design, focusing on the Udenu Local Government Area. A sample of three hundred respondents was used, and data was collected through questionnaires. The instrument was face validated by experts from the Department of Home Economics and (...) Hospitality Management Education at the University of Nigeria Nsukka. To ensure reliability, a trial testing was conducted, resulting in a Cronbach alpha reliability estimate of 0.87. Data analysis involved frequency count and percentages. The findings revealed limited mother care in terms of children's feeding, clothing, health, and academic upbringing, which was attributed to the negative influence of the mothers' occupation. Recommendations were made to enhance children's upbringing, including an increase in maternity leave to allow mothers to spend quality time with their children. (shrink)

Las lecciones inaugurales son una clásica tradición en la Universidad Antonio Ruiz de Montoya, con ellas se da inicio al año académico. Para estas ocasiones, el Consejo Universitario designa a un profesor del claustro que tendrá el honor de pronunciar la lección inaugural. Allí, el catedrático ofrece una clase magistral en la que da cuenta de una investigación reciente, o vuelve sobre el trabajo académico al que ha dedicado años, o reflexiona sobre asuntos de importancia, ya sea del ámbito universitario (...) o de la actualidad nacional. Al cumplirse veinte años de nuestra universidad, y en un momento de crecimiento y consolidación, es importante mantener el vínculo con los tiempos fundacionales para observar el camino recorrido y preparar la senda para todo lo que viene. De l'entre-deux-guerres jusqu'à la fin de la Seconde Guerre mondiale, la Roumanie s'est trouvée dans une sorte de labyrinthe géopolitique, dans lequel elle semblait avoir de multiples possibilités, mais elles allaient toutes dans le même sens : l'alliance avec l'Allemagne au début de la Seconde Guerre mondiale, l'acte du 23 août 1944 tel qu'il se présentait et le statut établi par la suite par le traité de Paris. Tout au long de cette période, l'armée roumaine a joué un rôle majeur (...) à travers ses dirigeants et le sacrifice des soldats roumains, et l'acte du 23 août 1944 a été un acte légitime et légal, dans lequel le roi Mihai I et l'armée ont été les principaux décideurs. During the first quarter of the twentieth century, the French philosopher Henri Bergson became an international celebrity, profoundly influencing contemporary intellectual and artistic currents. While Bergsonism was fashionable, L. Susan Stebbing, Bertrand Russell, Moritz Schlick, and Rudolf Carnap launched different critical attacks against some of Bergson’s views. This book examines this series of critical responses to Bergsonism early in the history of analytic philosophy. Analytic criticisms of Bergsonism were influenced by William James, who saw Bergson as an ‘anti-intellectualist’ ally of (...) American Pragmatism, and Max Scheler, who saw him as a prophet of Lebensphilosophie. Some of the main analytic objections to Bergson are answered in the work of Karin Costelloe-Stephen. Analytic anti-Bergsonism accompanied the earlier refutations of idealism by Russell and Moore, and later influenced the Vienna Circle’s critique of metaphysics. It eventually contributed to the formation of the view that ‘analytic’ philosophy is divided from its ‘continental’ counterpart. (shrink)

Le présent ouvrage traite d'un épisode de la traduction du roumain vers le français par l'écrivain roumain Constantin Negruzzi. Nous nous intéressons à la traduction de deux traductions de Victor Hugo, en analysant les procédés et les résultats du transfert linguistique.

Hippocrate a contribué à l’évolution de la médecine grecque de son temps par ses observations détaillées sur les maladies et leurs effets, en insistant sur l’importance du régime et de l’environnement en ce qui concerne la santé des patients. Il s’est interrogé sur la moralité du praticien, son comportement et son attitude avec son patient afin de produire des normes éthiques solides pour départager sa médecine des conceptions magico-religieuses, des pratiques qu’il estimait douteuses, trompeuses. Certains aspects des textes du Corpus (...) Hippocratique ont été largement considérés pertinents par la médecine moderne, tout particulièrement en ce qui concerne les rapports médecin-patient. Dans l’article qui suit, nous nous intéressons au rôle de la confiance dans la relation médecin-patient au sein du Corpus Hippocratique : comment le corps des médecins hippocratiques joue-t-il un rôle dans la construction de la confiance avec le patient ? Nous soutenons que le corps du médecin agit comme élément essentiel dans l’établissement de la confiance et comme support de sa réputation. Or, si la relation de confiance médecin-patient est une condition fondamentale pour la pratique de l’art médical, la confiance est un facteur important et s’inscrit dans une approche où le malade est l’allié du médecin afin de combattre la maladie. Plus le patient a confiance en son médecin, plus le médecin hippocratique est apte à pratiquer son art médical et prêt à aider le patient dans son combat contre la maladie. Ainsi, pour répondre à la question posée, nous présenterons, en premier lieu, le contexte dans lequel le médecin hippocratique pratique son art. Cette présentation nous aidera à comprendre l’importance de la confiance, notamment en ce qui concerne son impact dans la relation médecin-patient, ainsi que de la quantité de données indispensables transmises par le patient au médecin. Nous serons alors en mesure, en deuxième lieu, de démontrer que le corps du médecin et le corps du patient sont des éléments fondamentaux dans l’élaboration de la confiance : corps comme vecteur de l’image du médecin et corps comme instrument. Tout le film est toujours une microphysique du pouvoir, en potence, d’être étudier. Aujourd’hui l'augmentation des productions d'horreur et son public ont fait le film d'horreur une «contreculture» dominante, mais toujours sous l'effet négatif du pouvoir et du savoir qui disqualifient les discours, matérialisée dans ces films, ce qui les rend illégitime et exiler en soi espace filmique, transformée en un lieu adapté pour interdite et marquée par certaines pratiques discursives avec certains dispositifs d'exclusion. Paradoxalement, les types marginaux qui apparaissent (...) dans l'ordre de ces productions occupent les positions de sujets à exercer le pouvoir dans l'horreur et dans le même temps le renforcement de leur marginalité et de son objectivation. Ces aspects et les spécificités qui caractérisent les productions d'une part, nous ont amenés à identifier les pratiques de l'objectivation qui transforment corps dans les sujets dans l'horreur; d'autre part, de démontrer que ces films constituent une nouvelle technologie de contrôle social des corps, mais l'objectif principal de cette étude est d'analyser les relations de pouvoir à travers l'antagonisme des stratégies dans ce discours, qui est, pour savoir ce que cela signifie d'avoir un corps libre, nous examinons ce qui se passe sur le corps subjugué dans les films d'horreur, prenant l'archeogenealogie de Foucault comme base théorique. Cette questionhypothèse aurait un autre groupe: d'où pourrait faire une telle histoire? Nous supposons que dans les moments de crise, les films d'horreur ont beaucoup à prouver, donc nous avons opté pour un très similaire à celui qui Foucault a été invité par les experts de la revue Cahiers du cinéma pour discuter des conditions pour les productions cinématographiques comme Le Chagrin et la Pitié (1969), Portier de nuit (1974) et Lacombe Lucien (1974), quand on a regardé le déclin du gaullisme et l’ascention de Valéry Giscard d'Estaing , le vainqueur de la présidentielle de 1974, avec le soutien de l'ancien droit Tardieu et petainistes, anciens alliés de l'occupation du Führer Hitler de la France, entre 1940 à 1943. Maintenant, les conditions de production sont ceux qui marquent la fin des gouvernements socialistes de Mitterrand et Chirac, et le retour au pouvoir de la droite, à l'ascension politique de Nicolas Sarkozy. Au milieu de la crise économique de l'Union Européenne, flotte dans l'air la peur terrifiante de risque que l'arrivée de l'extrême droite au pouvoir. La présence croissante d'immigrants est aussi dans l'ordre d'une nouvelle crise de l'identité française. Ce sont les conditions de production de À l'intérieur, Frontière (s),Martyrs, Ils, La Meute, Captifs et Derrière les murs et, des films qui font partie de notre corpus. À la methodologie, nous développons les trois concepts opérationnels: le dispositif filmique de la mémoire, de la vérité et de l'objectivité pour traiter la mémoire populaire, recodé dans ces films et soi-disant perçu par nous comme l'un des principaux modes de contrôle des corps d’horreur; la notion d’intericonicité est encore utilisée pour indiquer des images qui renvoient à d'autres, mais tout en réalisant que chaque image a dans sa juxtaposition afin de utopies des hétérotopies. Donc, nous avons décidé de donner une nouvelle forme à cette notion, y compris l'utopique juxtaposés à des espaces hétérotopiques, sous l'influence de la discussion faite par Foucault dans le Corps utopique et Les hétérotopies. La communication politique peut être entendue comme action sémiologique collective qui se réalise dans le contexte de l’acte de gouverner une société et aussi bien comme acte d’exercice du pouvoir politique en ne faisant recours qu’aux signes. Actuellement la communication politique apparaît surtout sous la forme spécialisée du marketing politique et elle est centrée sur le but de gagner les élections. La “nouvelle” communication politique soulève quelques questions épineuses: (a) la carrière de l’homme politique dépend dans une trop grande mesure (...) de son équipe de consultants; (b) les médias exercent une influence déterminante sur la vie politique; (c) l’activité politique este devenue extrêmement coûteuse; (d) l’image politique est plus importante que l’homme politique réel; (e) les électeurs sont devenus versatiles et sujets à des goûts changeants; (f) presque tous les hommes politiques pratiquent la démagogie. Quelle que soit l’idéologie professé, les politiciens composent et transmettent des messages qui laissent voir une pensée partisane, collective, dissimulée, rationnelle et mise en service du pouvoir. Ces cinq traits dominants peuvent être reconnus aussi dans le cas des messages d’auto-présentation (nom, logo, statut et programme politique), que dans le cas des messages persuasifs (audience accordée à la population, discours prononcé aux réunions du parti, discours électoral, slogan, affiche politique, réclame politique, communiqué politique, interview, conférence de presse et débat télévisé). En faisant usage des messages politiques en tant qu’instruments pour gagner et gérer le pouvoir, les participants à la communication politique accomplissent, dans une mesure plus ou moins large, les actions suivantes: (a) la connaissance du contexte politique (qui contient les règles du jeu politique, les adversaires et les alliés actuels et potentiels, l’état de l’électorat ‒ surtout l’électorat-cible ‒ et les canaux de transmission virtuelle des propres messages politiques), (b) l’octroi d’une image politique convenable (qui réunisse au moins trois qualités majeures: la crédibilité, l’attractivité et la puissance), (c) la sélection des thèmes et des catégories de messages capables de les incarner), (d) la “modalisation” de la campagne de communication (“de notoriété” versus “persuasive”), (e) la transmission des messages politiques (visant le niveau le plus haut des standards d’adéquation et d’efficience) et (f) le monitorage des résultats de la communication politique. Dans la mesure où toutes ces actions sémiologiques sont accomplies à un niveau satisfaisant, la communication politique (qui les englobe) mène à une compétition au pouvoir bienfaisante pour la société toute entière. Une telle compétition ne divise pas la classe politique en vainqueurs et vaincus, mais en rivaux, chacun apportant sa pierre à la construction et la sauvegarde du bien commun. (shrink)

C’est un rêve seulement pour la petite minorité (peut-être quelques dizaines à quelques centaines) qui gouvernent la Chine et un cauchemar pour tout le monde (y compris 1,4 milliard de Chinois). Les 10 milliards de dollars par an leur permettent, à eux ou à leurs marionnettes, de posséder ou de contrôler des journaux, des magazines, des chaînes de télévision et de radio et de placer des fausses nouvelles dans la plupart des grands médias partout dans le monde chaque jour. En outre, ils ont une armée (peut-être des millions de personnes) qui troll tous les médias de placer plus de propagande et de noyer des commentaires légitimes (l’armée de 50 centimes). En plus de dépouiller le monde des ressources de 3rd, une poussée majeure de l’initiative de des centaines de milliards de dollars Belt and Road est la construction de bases militaires dans le monde entier. Ils forment le monde libre dans une course aux armements massive de haute technologie qui fait la guerre froide avec l’Union soviétique ressembler à un pique-nique. Bien que le SSSSK, et le reste de l’armée mondiale, dépensent des sommes énormes sur le matériel avancé, il est très probable que WW3 (ou les petits engagements qui l’ont précédé) sera dominé par les logiciels. Il n’est pas hors de question que le SSSSK, avec probablement plus de pirates (codeurs) travaillant pour eux, puis tout le reste du monde combiné, va gagner de futures guerres avec un minimum de conflit physique, juste en paralysant leurs ennemis via le net. Pas de satellites, pas de téléphones, pas de communications, pas de transactions financières, pas de réseau électrique, pas d’Internet, pas d’armes de pointe, pas de véhicules, de trains, de navires ou d’avions. Il n’y a que deux voies principales pour enlever le PCC, libérer 1,4 milliard de prisonniers chinois, et mettre fin à la marche lunatique à la Seconde Guerre mondiale. Le pacifique est de lancer une guerre commerciale tous avare pour dévaster l’économie chinoise jusqu’à ce que l’armée en ait marre et démarre le PCC. Une alternative à la fermeture de l’économie chinoise est une guerre limitée, comme une frappe ciblée par dire 50 drones thermobares sur le 20e Congrès du PCC, lorsque tous les membres supérieurs sont en un seul endroit, mais qui n’aura pas lieu avant 2022 afin que l’on puisse frapper la réunion plénière annuelle. Les Chinois seraient informés, au fur et à mesure de l’attaque, qu’ils devaient déposer les armes et se préparer à organiser des élections démocratiques ou à être regroupés dans l’âge de pierre. L’autre alternative est une attaque nucléaire tous anch, une attaque nucléaire. La confrontation militaire est inévitable compte tenu de la voie actuelle du PCC. Il se produira probablement sur les îles de la mer de Chine méridionale ou Taiwan dans quelques décennies, mais comme ils établissent des bases militaires dans le monde entier, il pourrait se produire n’importe où (voir Tigre accroupi, etc.). Les conflits futurs auront des aspects difficiles et souples avec les objectifs déclarés du PCC de mettre l’accent sur la cyberguerre par le piratage et le paralysage des systèmes de contrôle de toutes les communications militaires et industrielles, l’équipement, les centrales électriques, les satellites, Internet, les banques, et tout appareil ou véhicule connecté au net. Les SS sont lentement sur le terrain d’un éventail mondial de sous-marins ou de drones sous-marins habités et autonomes capables de lancer des armes conventionnelles ou nucléaires qui peuvent rester dormants en attendant un signal de la Chine ou même à la recherche de la signature de navires ou d’avions américains. Tout en détruisant nos satellites, éliminant ainsi la communication entre les États-Unis et nos forces dans le monde entier, ils utiliseront les leurs, en conjonction avec des drones pour cibler et détruire nos forces navales actuellement supérieures. Bien sûr, tout cela se fait de plus en plus automatiquement par l’IA. De loin le plus grand allié du PCC est le parti démocrate des États-Unis. Le choix est d’arrêter le PCC maintenant ou regarder comme ils prolongent la prison chinoise sur le monde entier. Achieving space domain awareness requires the identification, characterization, and tracking of space objects. Storing and leveraging associated space object data for purposes such as hostile threat assessment, object identification, and collision prediction and avoidance present further challenges. Space objects are characterized according to a variety of parameters including their identifiers, design specifications, components, subsystems, capabilities, vulnerabilities, origins, missions, orbital elements, patterns of life, processes, operational statuses, and associated persons, organizations, or nations. The Space Object Ontology provides a consensus-based realist framework (...) for formulating such characterizations in a computable fashion. Space object data are aligned with classes and relations in the Space Object Ontology and stored in a dynamically updated Resource Description Framework triple store, which can be queried to support space domain awareness and the needs of spacecraft operators. This paper presents the core of the Space Object Ontology, discusses its advantages over other approaches to space object classification, and demonstrates its ability to combine diverse sets of data from multiple sources within an expandable framework. Finally, we show how the ontology provides benefits for enhancing and maintaining longterm space domain awareness. (shrink)

In this article I give a unified account of three phenomena: bullshit, pseudoscience and pseudophilosophy. My aims are partly conceptual, partly evaluative. Drawing on Harry Frankfurt's seminal analysis of bullshit, I give an account of the three phenomena and of how they are related, and I use this account to explain what is bad about all three. More specifically, I argue that what is defective about pseudoscience and pseudophilosophy is precisely that they are special cases of bullshit. Apart from raising (...) interesting philosophical issues, gaining a clearer understanding of these phenomena is also of practical importance, in that it bears on how best to tackle the threat that they pose. Arguments attempting to debunk moral beliefs, by showing they are unjustified, have tended to be global, targeting all moral beliefs or a large set of them. Popular debunking arguments point to various factors purportedly influencing moral beliefs, from evolutionary pressures, to automatic and emotionally-driven processes, to framing effects. We show that these sweeping arguments face a debunker’s dilemma: either the relevant factor is not a main basis for belief or it does not render the relevant beliefs unjustified. Empirical debunking arguments (...) in ethics can avoid this predicament, but only if they are refocused on highly selective classes of moral belief. Experimental data can combine with familiar consistency reasoning to reveal that like cases are not being treated alike. Selective debunking arguments are unlikely to yield sweeping sceptical conclusions, but they can lead to rational moral change. (shrink)

A core tenet of metanormative non-naturalism is that genuine or robust normativity—i.e., the kind of normativity that is characteristic of moral requirements, and perhaps also of prudential, epistemic and even aesthetic requirements—is metaphysically special in a way that rules out naturalist analyses or reductions; on the non-naturalist view, the normative is sui generis and metaphysically discontinuous with the natural. Non-naturalists agree, however, that the normative is modally as well as explanatorily dependent on the natural. These two commitments—discontinuity and dependence—at least (...) initially pull in opposite directions, and one of the central challenges to non-naturalism is how to reconcile them. In this paper I spell out the most pressing version of this discontinuity problem, as I propose to call it, and I go on to offer a novel solution. Drawing on the ideology of reasons-firstism, I formulate an account of normative explanation which reconciles the two commitments, and I argue that competing accounts either do not solve the problem or are implausible on independent grounds. The issue of how to incorporate the individual's first‐hand experience of illness into broader medical understanding is a major question in medical theory and practice. In a philosophical context, phenomenology, with its emphasis on the subject's perception of phenomena as the basis for knowledge and its questioning of naturalism, seems an obvious candidate for addressing these issues. This is a review of current phenomenological approaches to medicine, looking at what has motivated this philosophical approach, the main problems it faces and (...) suggesting how it might become a useful philosophical tool within medicine, with its own individual, but interrelated, contribution to make to current medical debates. After the general background, there is a brief summary of phenomenological ideas and their current usage in a medical context. Next is a critique of four key claims within current phenomenological medical works, concerning both the role phenomenology plays and the supposedly clear divide between phenomenology and other approaches. There are significant problems within these claims, largely because they overlook the complexity of the questions they consider. Finally, there is some more in‐depth examination of phenomenology itself and the true complexity of phenomenological debate concerning subjectivity. The aim is to show that it will be both more productive and truer to phenomenology itself, if we use phenomenology as a philosophical method for explicating and gaining deeper understanding of complex and fundamental problems, which are central to medicine, rather than as providing simple, but flawed solutions. What considerations place genuine constraints on an adequate semantics for normative and evaluative expressions? Linguists recognize facts about ordinary uses of such expressions and competent speakers’ judgments about which uses are appropriate. The contemporary literature reflects the widespread assumption that linguists don’t rely upon an additional source of data—competent speakers’ judgments about possible disagreement with hypothetical speech communities. We have several good reasons to think that such judgments are not probative for semantic theorizing. Therefore, we should accord these judgments no (...) probative value for the development of a semantics for our moral terms. Such judgments can no longer be presumed to put pressure on theories according to which our moral expressions share a semantics with ordinary, descriptive terms. Many rivals to pure, Descriptivist theories count among their advantages the ability to accommodate these judgments. If these judgments have no probative value, such theories lose an important source of support. (shrink)

Can reasoning improve moral judgments and lead to moral progress? Pessimistic answers to this question are often based on caricatures of reasoning, weak scientific evidence, and flawed interpretations of solid evidence. In support of optimism, we discuss three forms of moral reasoning (principle reasoning, consistency reasoning, and social proof) that can spur progressive changes in attitudes and behavior on a variety of issues, such as charitable giving, gay rights, and meat consumption. We conclude that moral reasoning, particularly when embedded in (...) social networks with mutual trust and respect, is integral to moral progress. (shrink)

Increasing evidence from psychology and neuroscience suggests that emotion plays an important and sometimes critical role in moral judgment and moral behavior. At the same time, there is increasing psychological and neuroscientific evidence that brain regions critical in emotional and moral capacity are impaired in psychopaths. We ask how the criminal law should accommodate these two streams of research, in light of a new normative and legal account of the criminal responsibility of psychopaths.

The distinction between the body schema and the body image has become the stock in trade of much recent work in cognitive neuroscience and philosophy. Yet little is known about the interactions between these two types of body representations. We need to account not only for their dissociations in rare cases, but also for their convergence most of the time. Indeed in our everyday life the body we perceive does not conflict with the body we act with. Are the body (...) image and the body schema then somehow reshaping each other or are they relatively independent and do they only happen to be congruent? On the basis of the study of bodily hallucinations, we consider which model can best account for the body schema/body image interactions. (shrink)

I argue that people are sometimes justified in participating in unjust wars. I consider a range of reasons why war might be unjust, including the cause which it is fought for, whether it is proportionate, and whether it wrongly uses resources that could help others in dire need. These considerations sometimes make fighting in the war unjust, but sometimes not. In developing these claims, I focus especially on the 2003 Iraq war.

This paper will defend the claim that, under certain circumstances, the material vehicles responsible for an agent’s conscious experience can be partly constituted by processes outside the agent’s body. In other words, the consciousness of the agent can extend. This claim will be supported by the Extended Mind Thesis (EMT) example of the artist and their sketchpad (Clark 2001, 2003). It will be argued that if this example is one of EMT, then this example also supports an argument for consciousness (...) extension. Clark (2009) rejects claims of consciousness extension. This paper will challenge Clark and argue that he fails to show that the material vehicles responsible for consciousness must be internal to the agent. (shrink)

Robert Kraut has proposed an analogy between valuing a loved one as irreplaceable and the sort of “rigid” attachment that (according to Saul Kripke’s account) occurs with the reference of proper names. We wanted to see if individuals with Kripkean intuitions were indeed more likely to value loved ones (and other persons and things) as irreplaceable. In this empirical study, 162 participants completed an online questionnaire asking them to consider how appropriate it would be to feel the same way about (...) a perfect replica of a loved one, as well as other questions about replaceability. Participants who previously had endorsed Kripkean reference (n = 96) rated loved ones as less replaceable on two different measures than participants who had previously endorsed Descriptivist reference (n = 66, t(160)> 2.27, p <.02, eta2> .03). Additional results suggest that this difference extends to other targets as well and is at least partially dependent on sentimental attachment. (shrink)

This paper explores the metaethical ramifications of a coarse-grained criterion of property identity, sometimes referred to as Hume's dictum. According to Hume's dictum, properties are identical if and only if they are necessarily co-extensive. Assuming the supervenience of the normative on the natural, this criterion threatens the non-naturalist view that there are instantiable normative properties which are distinct from natural properties. In response, non-naturalists typically point to various counterintuitive implications of Hume's dictum. The paper clarifies this strategy and defends it (...) against objections by Bart Streumer and Ralf Bader. In addition, it is argued that proponents of naturalist and supernaturalist views, along with proponents of a certain kind of nihilism, should also reject Hume's dictum. This shows that non-naturalists can also attack the criterion indirectly, by pointing to partners in guilt. Also, it shows that not just any opponent of non-naturalism can appeal to Hume's dictum. WikiSilo is a tool for theorizing across interdisciplinary fields such as Cognitive Science, and provides a vocabulary for talking about the problems of doing so. It can be used to demonstrate that a particular cognitive theory is complete and coherent at multiple levels of discourse, and commensurable with and relevant to a wider domain of cognition. WikiSilo is also a minimalist theory and methodology for effectively doing science. WikiSilo is simultaneously similar to and distinct, as well as integrated and separated (...) from Wikipedia™. Since the publication of Clark and Chalmers' Extended Mind paper, the central claims of that paper, viz. the thesis that cognitive processes and cognitive or mental states extend beyond the brain and body, have been vigorously debated within philosophy of mind and philosophy of cognitive science. Both defenders and detractors of these claims have since marshalled an impressive battery of arguments for and against “active externalism.” However, despite the amount of philosophical energy expended, this debate remains far from settled. We (...) argue that this debate can be understood as answering two metaphysical questions. Yet prominent voices within the debate have assumed that there is a tight relationship between these two questions such that one question can be answered via the other. We defend an alternative ‘wide’ view, whereby mentality is understood as constituted by wide social and cultural factors. Our wide view entails that the two metaphysical questions are separate and should be kept distinct. This suggests that active externalism as understood by prominent voices within that debate requires dissolution, rather than solution. However, if the debate were instead understood as only focusing on the second of the two questions, then there could be a possible future for this debate. (shrink)
