During the coronavirus pandemic, communities have faced shortages of important healthcare resources such as COVID-19 vaccines, medical staff, ICU beds and ventilators. Public health officials in the U.S. have had to make decisions about two major issues: which infected patients should be treated first (triage), and which people who are at risk of infection should be inoculated first (vaccine distribution). Following Beauchamp and Childress’s principlism, adopted guidelines have tended to value both whole lives (survival to discharge) and life-years (survival for (...) years past discharge). This process of collective moral reasoning has revealed our common commitment to both Kantian and utilitarian principles. For Kant, respecting people’s rights entails that we ought to value whole lives equally. Therefore we ought to allocate resources so as to maximise the number of patients who survive to discharge. By contrast, the principle of utility has us maximise life-years so that people can satisfy more of their considered preferences. Although people are treated impartially in the utilitarian calculus, it does not recognise their equal worth. Subjecting Kantian ethics and utilitarianism to the process of reflective equilibrium lends support to the idea that we need a pluralistic approach that would accommodate our moral intuitions regarding both the equal value of whole lives and the additive value of life-years. In accordance with Leo Strauss’s ingenious suggestion, the Athenian Stranger of Plato’s Laws is best understood as an alternative ‘Socrates’, fleeing from the hemlock to Crete. Situated between Crito and Phaedo, Laws effectively tests the reader’s loyalty to the real Socrates who obeys Athenian law and dies cheerfully in Athens. Having separated Plato from the Stranger, a nuanced defence of Karl Popper’s suspicions about Laws confronts the apologetic readings of both Strauss and Christopher Bobonich. As hinted by his preference for (...) wine, the antidote for hemlock, the Athenian Stranger repeatedly proves himself the opposite of Socrates, particularly with respect to piety. Once the Stranger is recognized as ‘an unreliable narrator’, this apparently ponderous product of Plato’s senility becomes the taut thriller of an innovative teacher at the peak of his powers. In celebration of Newton da Costa’s place in the history of paraconsistency, this paper considers the use and abuse of deliberate self-contradiction. Beginning with Parmenides, developed by Plato, and continued by Cicero, an ancient philosophical tradition used deliberately paraconsistent discourses to reveal the truth. Literature, in particular philosophical literature, proves to be particularly challenging when read in isolation from the philosophy it comes from. Reading Sarte’s Nausea through Kierkegaard illuminates important themes of language, music, the ethical and aesthetic, and immediacy in both Nausea and Kierkegaard’s various pseudonymous works. The comparison here is extremely fruitful given the poetic and literary form of Kierkegaard’s work, especially against this particular work from Sartre. The themes in Nausea that are examined are interestingly not present in his other (...) works and are necessary in some regard to be brought forth in a novel rather than a philosophical treatise. This dissertation examines Fichte's critical idealism in an effort to formulate a compelling model of how we can be said to be free, despite our subjection to both rational and nonrational constraints. ;Fichte grounds idealism in a "drive to freedom" that involves two disparate strands of thought: the standpoint of idealism is said to be both the result of an absolutely free adoption of the principle of self-determination and conditioned by reason, to which the finite I is necessarily subject. However, (...) if there is no reason prior to the choice of a first principle, the choice of idealism over dogmatism cannot be motivated, and so is not attributable to a responsible subject. And if there is a prior basis for the election of idealism, the constraints of reason already necessitate the I's attempt to consider itself to be independent and are, therefore, not self-legislated. Fichte's argument strategy thus yields the following question: How can there be an absolute election of the philosophical principle of one's life, when the adoption of such a standpoint is already a manifestation of who one is? Fichte confronts this issue by conceiving of the I as necessarily subject to an original limit and by radically subjectivizing the world in terms of the I's ethical and conceptual demands. ;By locating the tension between these positions, this dissertation reveals how philosophers indebted to Fichte as well as interpreters of the Wissenschaftslehre have mischaracterized Fichte's treatment of rational self-constraint. Fichte's synthesis of freedom and necessity constitutes a model of subjectivity according to which the normatively constrained structure of experience is impossible without my relating that experience to my practical activity, and the ways in which I am able to characterize that experience are answerable to what is practically required of me by that experience. Fichte shows the interdetermination of the givenness of the given and the autonomy of the I by qualifying each in terms of the other. As a description of this interdetermination, Fichte's striving doctrine establishes the tension involved in this mutually constitutive relation as a positive conception of human freedom. (shrink)

One of the most prominent ethical concerns regarding emerging neurotechnologies is mental privacy. This is the idea that we should have control over access to our neural data and to the information about our mental processes and states that can be obtained by analyzing it. A key issue is whether this information needs more stringent protection than other kinds of personal information. I will articulate and support the view, underlying recent regulatory frameworks, that mental privacy requires a special treatment because (...) of its relation to relevant aspects of personal identity. It has been suggested that this approach could be supported by the idea that mental privacy constitutes a fundamental psychological dimension of privacy. The connection between this psychological view of privacy and identity can be traced back to Irwin Altman’s idea that privacy is an interpersonal boundary regulation process. However, it is not clear whether this notion of privacy can be associated with a conception of identity that is relevant in contemporary neuroethics. I will suggest that the narrative and relational approach to identity, a prominent view in recent ethical discussions of neurotechnology, lines up with key aspects of Altman’s proposal. I suggest that if mental privacy is an essential component of identity, the latter could be affected by technological mind-reading. (shrink)

Political theorists have long criticized policies that deny voting rights to convicted felons. However, some have recently turned to democratic theory to defend this practice, arguing that democratic self-determination justifies, or even requires, disenfranchising felons. I review these new arguments, acknowledge their force against existing criticism, and then offer a new critique of disenfranchisement that engages them on their own terms. Using democratic theory’s “all-subjected principle,” I argue that liberal democracies undermine their own legitimacy when they deny the vote to (...) felons and prisoners. I then show how this argument overcomes obstacles that cause problems for other critiques of disenfranchisement. (shrink)

Questo non è un libro perfetto, ma è unico, e se scorri le prime 400 pagine o giù di lì, le ultime 300 (circa 700) sono un buon tentativo di applicare ciò che è noto sul comportamento ai cambiamenti sociali nella violenza e nelle maniere nel tempo. Egli manca anche (come quasi tutti) manca di un quadro chiaro per descrivere la struttura logica della razionalità (termine preferito di John Searle) che preferisco chiamare la Psicologia descrittiva del Pensiero dell'Ordine Superiore (DPHOT). Avrebbe dovuto dire qualcosa sui molti altri modi di abusare e sfruttare le persone e il pianeta, dal momento che questi sono ora molto più gravi da rendere quasi irrilevanti altre forme di violenza. Se la società continua a mantenerei diritti umani come primari, ai loro discendenti si può dire con fiducia "WTHOE". Il n’a pas non plus (comme presque tout le monde) un cadre clair pour décrire la structure logique de la rationalité (LSR—terme préféré de John Searle) que je préfère appeler la psychologie descriptive de la pensée de haut ordre (DPHOT). Il aurait dû dire quelque chose sur les nombreuses autres façons d’abuser et d’exploiter les gens et la planète, car ceux-ci sont maintenant beaucoup plus graves que de rendre d’autres formes de violence presque hors de propos. Étendre le concept de violence pour inclure les-conséquences mondiales à long terme de la réplication des gènes de quelqu’un, et avoir une compréhension de la nature de la façon dont fonctionne l’évolution (c.-à-d., la sélection des parents) fournira une perspective très différente sur l’histoire, les événements actuels, et comment les choses sont susceptibles d’aller dans les quelques centaines d’années. On peut considérer que les gens et leur progéniture méritent richement toute la misère vient leur chemin et (à de rares exceptions près) les riches et les célèbres sont les pires délinquants. Meryl Streep ou Bill Gates ou J.K Rowling et chacun de leurs enfants peuvent détruire 50 tonnes de terre d’o re plus chaque année pendant des générations dans l’avenir, tandis qu’un fermier indien et son peut détruire 1 tonne. Er hätte etwas über die vielen anderen Arten des Missbrauchs und der Ausbeutung von Menschen und dem Planeten sagen sollen, da diese jetzt so viel schwerwiegender sind, dass andere Formen der Gewalt fast irrelevant werden. Die Ausweitung des Konzepts der Gewalt auf die globalen langfristigen-Folgen der Replikationvon Genen von jemandem und ein Verständnis dafür, wie Evolution funktioniert (d. h. die Auswahl von Verwandten), wird eine ganz andere Perspektive auf die Geschichte, die aktuellen Ereignisse und die Wahrscheinlichkeit bieten, wie die Dinge in den nächsten paar hundert Jahren ablaufen werden. This is not a perfect book, but it is unique, and if you skim the first 400 or so pages, the last 300 (of some 700) are a pretty good attempt to apply what's known about behavior to social changes in violence and manners over time. The basic topic is: how does our genetics control and limit social change? Surprisingly he fails to describe the nature of kin selection (inclusive fitness) which explains much of animal and human social life. He (...) also (like nearly everyone) lacks a clear framework for describing the logical structure of rationality (LSR—John Searle’s preferred term) which I prefer to call the Descriptive Psychology of Higher Order Thought (DPHOT). He should have said something about the many other ways of abusing and exploiting people and the planet, since these are now so much more severe as to render other forms of violence nearly irrelevant. Extending the concept of violence to include the global long-term consequences of replication of someone’s genes, and having a grasp of the nature of how evolution works (i.e., kin selection) will provide a very different perspective on history, current events, and how things are likely to go in the next few hundred years. One might start by noting that the decrease in physical violence over history has been matched (and made possible) by the constantly increasing merciless rape of the planet (i.e., by people's destruction of their own descendant’s future). Pinker (like most people most of the time) is often distracted by the superficialities of culture when it’s biology that matters. What really matters is the violence done to the earth by the relentless increase in population and resource destruction (due to medicine and technology and conflict suppression by police and military). About 200,000 more people a day (another Las Vegas every 10 days, another Los Angeles every month), the 6 tons or so of topsoil going into the sea/person/year –about 1% of the world’s total disappearing yearly, etc. mean that unless some miracle happens the biosphere and civilization will largely collapse during next two centuries, and there will be starvation, misery and violence of every kind on a staggering scale. People's manners, opinions and tendencies to commit violent acts are of no relevance unless they can do something to avoid this catastrophe, and I don't see how that is going to happen. There is no space for arguments, and no point either (yes I'm a fatalist), so I'll just make a few comments as though they were facts. Don't imagine I have a personal stake in promoting one group at the expense of others. I am 78, have no descendants and no close relatives and do not identify with any political, national or religious group and regard the ones I belong to by default as just as repulsive as all the rest. -/- Parents are the worst Enemies of Life on Earth and, taking the broad view of things, women are as violent as men when one considers the fact that women's violence (like most of that done by men) is largely done in slow motion, at a distance in time and space and mostly carried out by proxy -by their descendants and by men. Increasingly, women bear children regardless of whether they have a mate and the effect of stopping one woman from breeding is on average much greater than stopping one man, since they are the reproductive bottleneck. One can take the view that people and their offspring richly deserve whatever misery comes their way and (with rare exceptions) the rich and famous are the worst offenders. Meryl Streep or Bill Gates or J.K Rowling and each of their kids may destroy 50 tons of topsoil each per year for generations into the future, while an Indian farmer and his may destroy 1 ton. If someone denies it that's fine, and to their descendants I say "Welcome to Hell on Earth"(WTHOE). -/- The emphasis nowadays is always on Human Rights, but it is clear that if civilization is to stand a chance, Human Responsibilities must replace Human Rights. Nobody gets rights without being a responsible citizen and the first thing this means is minimal environmental destruction. The most basic responsibility is no children unless your society asks you to produce them. A society or a world that lets people breed at random will always be exploited by selfish genes until it collapses (or reaches a point where life is so horrific it's not worth living).
