Unquestionably, Restorative Justice (hereafter RJ) has finally gathered some real momentum. It has become a sine qua non topic in many national and international policy and statutory agendas. However, as the restorative practice expands to deal with crimes, ages and situations it has never addressed before (at least in its contemporary version), and as its application starts to make sense not only to national but also to regional and international bodies and fora, new theoretical problems are posed. In the fast-growing (...) literature many theories and Schools have been evoked to support RJ's claims. This paper will take the discussion a step back by looking at questions of meta-theoretical character. In particular, the paper will ask: Does RJ have a place in the “world of theories,” and if it does, then what kind of theory is it, and on what level should it be placed? Second, does RJ theory need a philosophy, and why? Finally, how can restorative practices be morally justified? (shrink)

Although community cohesion and human rights are currently two of the most discussed political discourses in the UK, their links for policy are underplayed. This article presents the findings of a nine-month research project that included interviews with a selected expert sample, and which aimed to explore whether human rights values and legislation can be used as tools for community cohesion. Available levers within human rights and the 1998 Human Rights Act are identified, and evidence-based policy recommendations are posited. The purpose of this article is to continue the discussion on Europe’s converging criminal justice systems. In particular, I test a hypothesis that has recently appeared in the literature, which sees the jurisprudence of the European Court of Human Rights as one of the most significant factors that encourage a harmonization process between the adversarial and inquisitorial criminal justice systems of Europe. This claim is supported by examining the Court’s jurisprudence to identify decisions that led to legislative and policy amendments (...) in the domestic legal orders of the 46 member states of the Council of Europe. This account shows how an interplay currently taking place between judicial, policy, and statutory powers is marking the end of the adversarial-inquisitorial era. Finally, the conclusion identifies the three most important impediments that are likely to hamper this harmonization process. (shrink)

Restorative justice (RJ) in the secure estate is widespread internationally, although piecemeal and inconsistent in its application. It exists in the form of many practices such as mediation, conferencing, circles, and panels. As the interest in RJ continues to grow, this research takes a step back to ask how reconcilable RJ is with incapacitation. Through a combination of normative thinking, literature review, and primary research that applied qualitative methodologies over a 3-year period, the article examines where the two notions meet (...) in their intentions and expected outcomes. ‘Justice’ is spoken of in two ways: the lawful and the fair. The law is a human construct that is devoted to the advantage of all, or to the advantage of the best, or to the advantage of those in power or to the advantage of those representing it – let it be the politician, the media, the TV presenter, the filmmaker. Thus, the law serves the production or the preservation of happiness within politics and business. The law commands us (...) to act according to the mean. A well-written law follows the mean well and a poorly written law does not. On the other hand, fairness is a principle sometimes materialised through the law and the given justice system. Fairness is the ultimate value pursued by both the common law and civil law traditions. However, its distribution through the law and the representation of this delivery varies. Does this mean that a different kind of justice is distributed? Through the teachings of Aristotle, this essay aims to deconstruct the notion of justice, by breaking down its two ingredients, the lawful and the fair, and by analysing the effect of their representation in modern European society. The relativity attached to the notion of justice is not a modern phenomenon, but a philosophical matter that can be analysed and indeed explained through the teachings of Aristotle and its contemporary students. The analysis will be developed in the context of convergent Europe, focusing on the role of the media and courts especially in relation to criminal justice. (shrink)

Although the fast-growing literature on restorative justice is extensive, and in some regards repetitive, there is still no consensus as to the nature and extent of applicability of the restorative notion. This article claims that the restorative movement is experiencing a tension between normative abolitionist and pragmatic visions of restorative justice. It proceeds to identify six conceptual fault-lines that characterize this tension. These do not only refer to various definitional positions, but also disagreements that negatively affect both the theoretical and (...) practical development of restorative justice. These tensions also encourage a power-interest battle between different stakeholders within the restorative movement including practitioners, theoreticians, researchers and policy makers. To approach these controversies, there needs to be an acknowledgment of the multidimensional nature of the conceptual problem of restorative justice and the impact it has on its application. The chapter revisits the relationship between restorative justice and punishment through the eyes of Classical Greek philosophy and tragedy, the School of Collectivists, and contemporary thinkers. The author considers that the Penal Sciences face a wide range of human pathogenic issues, ranging from terrorism and human trafficking to corruption and the use of substances and are, thus, the ideal discipline for investigating the various scientific issues and the implementation of the scientific findings arising from such investigations. He also believes that the Penal Sciences, being inextricably linked to human values and constitutional rights, are, by their nature, beneficial towards the promotion and consolidation of values, such as (...) freedom, solidarity and, especially, Social Justice. The latter concept is perceived by the author not only as a form of justice, which provides everyone with their due of proportion to their value, according to the famous saying of Ulpian “suum cuique tribuere”, but rather as a form of restitution from social injustices and as a treatment for social needs, particularly for our fellow human beings who are marginalized by society in conditions of poverty and degradation. It is interesting, at this point, to emphasize that the United Nations, in an important report from 2006 entitled “Social Justice in an Open World. The Role of the United Nations”, defines Social Justice as the fair and compassionate distribution of the fruits of economic growth (“Social Justice in an Open World. The Role of the United Nations”, edited by the International Forum for Social Development, New York: United Nations, 2006, p. 7, available online). The vision, therefore, of a society focused on goals such as combating socio-economic disparities and providing effective assistance for the weaker members of society signifies, especially in this period of Crisis, is a primary objective worthy, according to the author, of captivating us. Perhaps, indeed, the new target for Criminal Policy, following that of Restorative Justice, should now be that of Social Justice and, in fact, with a double project and aim: first for a fairer distribution of social goods and, also, for greater solidarity towards the weaker members of society. Indeed, it is a known fact to those involved with the Penal Sciences, that a dominant contemporaneous trend is that of Restorative Justice, in the sense that Criminal Law and Criminology finally have to address the needs of the victim of a criminal act and to advocate for relevant methods for extrajudicial settlements and for the conciliation of the offender and the victim. Restorative Justice is, hence, based on the triptych of the perpetrator assuming responsibilities for their actions, of restoring, as far as possible, the effects of the injurious actions against the victim and, also, of actively expressing the desire for conciliation with the victim. Certainly it would be greatly desirable if these ideas were to be consolidated within Greek legislation, albeit within the, always progressive, Greek Law for Minors there is a provision for the reformatory conciliation measure, pursuant to article 122 case e of the Greek Penal Code. However, the author believes that in this period of time, a time of profound crisis at all levels, there is need for more than simple offender-victim conciliation. There is a need for this spirit of reconciliation and solidarity to be extended to benefit all those who are experiencing hard times and may, therefore, in their deprivation and frustration, are led to committing crime. The author, at this point, refers to all the socially weak and often marginalized groups of people, who are scientifically characterized as "weak" or "vulnerable" and who try, with great courage, to survive without breaching the threshold of breaking the law. It is apparent here, according to the author, that if Criminal Policy actually aims to provide solutions to the problems of crime, it should not solely be limited to repairing the damage and conciliating the victim and perpetrator, but it should strike against the causative factors of crime and the primarily socio-economic inequalities and other forms of injustice which cause, according to Aristotle in his "Politics" (V. 1301b27, 1301a32 et seq., 1266b40), social reactions, attitudes and – Ι would add - a sequence of serious criminal acts. In other words, another kind of Justice is required in addition to Restorative, so that it may become the mission of our Criminal Policy to eliminate the injustices and inequalities that lead to crime. After reporting in detail Aristotle’s texts and comments on the well-known motion paradoxes Arrow, Dichotomy, Achilles and Stadium, tracking back to the 5th century BCE and credited by Aristotle to Zeno of Elea, we next explain and dis-cuss traditional continuous solutions of the paradoxes, based on Cauchy’s limit concept. Afterward, the heated philosophical debate on supertasks and infinity machines is reported before the paradoxes are examined within the context of modern quantum theory. Already in 1905, Einstein concluded that matter could (...) not be a continuous thing. Classical continuous spacetime is replaced by ‘granular’ spacetime, and the concept of distance in granular spacetime is discussed. This is followed by a detailed presentation of modern discrete solutions in granular spacetime, several of which are published here for the first time. Finally, a procedure is presented to determine when traditional continuous methods suffice instead of discrete methods, and the handling of discrete versus continuous in physics is briefly reported. Exploring online criticisms of the ‘take the knee’ protest during ‘Euro 2020’, this article examines how alt- and far-right conspiracies were both constructed and communicated via the social media platform, Twitter. By providing a novel exploration of alt-right conspiracies during an international football tournament, a qualitative thematic analysis of 1,388 original tweets relating to Euro 2020 was undertaken. The findings reveal how, in criticisms levelled at both ‘wokeism’ and the Black Lives Matter movement, antiwhite criticisms of the ‘take the knee’ (...) protest were embroiled in alt-right conspiracies that exposed an assumed Cultural Marxist, ‘woke agenda’ in the tournament’s organization and mainstream media coverage. In conclusion, it is argued that conspiratorial discourses, associated with the alt-right, provided a framework through which the protest could be understood. This emphasises how the significance of conspiracy functions to promote the wider dissemination of alt-right ideology across popular cultural contexts, such as sport. (shrink)

This text proposes an analysis of the phenomenon of faith in the tradition and spirituality of the Eastern Church. Starting from the relationship between phenomenology and theology, the article uses a theo-phenomenological method to depict the phenomenon of faith both theologically and phenomenologically. This article also argues that non-religious faith—either natural or philosophical—is the foundation of religious faith. According to Orthodox spirituality, faith is not reduced to a set of theoretical teachings and dogmas; they constitute only the first type (...) of faith, “simple faith”. At the same time, faith is also a form of experience, which has ascetical, ethical, and mystical dimensions; they characterize the second type of faith, faith as contemplative sight and knowledge. Historical Cognitive Science I am lucky to strike three reviewers who extract so clearly my book's spirit as well as its substance. They all both accept and act on my central methodological assumption; that detailed historical research, and consideration of difficult contemporary questions about cognition and culture, can be mutually illuminating. It's gratifying to find many themes which recur in different contexts throughout _Philosophy and Memory_ _Traces_ so well articulated here. The reviews catch my desires to interweave discussion of cognitive (...) theories of memory with moral questions of psychological control and self-mastery, to evoke the virtues and the pleasures of strange, baroque beliefs about fickle 'animal spirits' coursing through the nerves and the brain, to demonstrate that mechanistic explanation (even in its blunt old Cartesian form) can acknowledge complexity, and to develop scientific conceptions of dynamic memory traces and representations which can survive uncharitable philosophical criticism. The book's insistent interdisciplinarity is just an inchoate quest to acknowledge the daunting variety of the phenomena: remembering is both natural and cultural, and is studied by narrative theorists as well as neurobiologists, by physicists as well as psychologists. By fusing the rangy detail of a history of early modern neurophysiology with the committed, even gullible fervor of a defence of 'new connectionist' cognitive science, I wanted to pull out the carpet from all those who are happy to let 'scientific' and 'cultural' approaches to the mind run along independently. Once this general project is given space, as it is by all three reviewers, we can get down to specifics. (shrink)

This article aims to serve as an accessible introduction to the idea of "ontotheology" and to the so-called "ontotheological critique of Western metaphysics" for which the twentieth-century German philosopher Martin Heidegger is especially well known. I begin by distinguishing two uses of "ontotheology" employed respectively by Kant and Heidegger, and go on to develop the Heideggerian interpretation and critique of ontotheology under three main headings: The Onto-theo-logical Constitution of Western Metaphysics; Ontotheology's Problematic Legacy: Anxiety, Calculation, Oblivion; and Ontotheology and (...) God. The article concludes with an annotated bibliography of helpful resources for learning more about ontotheology, the critique of ontotheology, and directions the critique has taken after Heidegger. Nghiên cứu này sử dụng bộ dữ liệu từ 81 doanh nghiệp niêm yết và đang giao dịch trên thị trường chứng khoán Việt Nam trong giai đoạn 2018-2023 và sử dụng phương pháp hồi quy dữ liệu bảng theo các mô hình POOLED OLS, FEM, REM, FGLS để khắc (...) phục khuyết tật của mô hình. Kết quả chỉ ra rằng, cả 3 biến độc lập đại diện cho Tỷ suất sinh lời gồm: Tỷ suất sinh lời của tài sản (ROA); Tỷ suất sinh lời của vốn chủ sở hữu (ROE); Tỷ suất sinh lời của doanh thu (ROS) đều có tác động tích cực đến Tỷ lệ nắm giữ tiền ở các doanh nghiệp logistics trong thời gian nghiên cứu. Reshaping the neo-Aristotelian doctrines about the human soul was Descartes’s most spectacular enterprise, which gave birth to some of the sharpest debates in the Republic of Letters. Neverthe- less, it was certainly Descartes’s intention, as already expressed in the Discours de la méthode, to show that his new metaphysics could be supplemented with experimental research in the field of medicine and the conservation of life. It is no surprise then that several natural philosophers and doctors, such as Henricus Regius from (...) Utrecht, who had studied in Padua with William Harvey, rallied in support, in order to gain a more substantial theoretical basis for their research. Taking as his ground some general metaphysical assumptions, such as the existence of God, the immortality of the soul, and perhaps the separability of the pure understanding, Regius intended to secure a new philosophy of man, which was able to reflect his medical interests and complement his account of human nature. This is the story that is now gaining currency, and it is surely accurate, at least in part. Desmond Clarke has recently defended the same view1, based on the remarkable studies of the Utrecht scholars Theo Verbeek and Erik-Jan Bos. Here I would like to challenge some aspects of this view and ask how Regius, who was perceived as the philosopher most closely associated with Descartes, became a betrayer of his mentor. (shrink)

The relationship between ethics and science has been discussed within the framework of continuity versus discontinuity theories, each of which can take several forms. Continuity theorists claim that ethics is a science or at least that it has deep similarities with the modus operandi of science. Discontinuity theorists reject such equivalency, while at the same time many of them claim that ethics does deal with objective truths and universalizable statements, just not in the same sense as science does. I propose (...) here a third view of quasi-continuity (or, equivalently, quasi-discontinuity) that integrates ethics and science as equal partners toward the uncovering of new knowledge. In this third way, a program envisioned by William James but made practicable only by contemporary scientific advancement, science can and must inform ethics at a deep level, and ethical theory— while going beyond science—cannot do without it. In particular, I identify four areas of ethics-science collaboration: neurobiological research into the basis of moral judgment, comparative anthropol- ogy, comparative evolutionary biology of primates, and game-theo- retical modeling. I provide examples within each of these fields to show how they link to ethical theories (including prescriptive work) and questions. The essay concludes with a brief discussion of the light that a scientifically informed ethics can shed on some classical problems in moral theory, such as the relationships between rational- ity and selfishness, egoism and altruism, as well as the concept of social contract. A joint research program involving both philosophers and scientists is called for if we wish to move ethical theory into the twenty-first century. (shrink)

In the fourteenth plateau of A Thousand Plateaus, Deleuze and Guattari develop a dichotomy between two kinds of space – the smooth and the striated. What I want to focus on in this chapter is the status of these two conceptions of space. As Deleuze and Guattari note, these two forms of space are only discovered in a mixed form, yet are capable of being analysed de jure through their separation. In this sense, the plateau on the smooth and striated (...) can be seen as something like a transcendental deduction of their ontology of spaces. I will explore what Deleuze and Guattari mean when they say that they want to construct a theo-noology of smooth and striated spaces. I want to look at the ethical implications of this distinction, before looking at some alternative approaches to the issue of space. It should be noted that the question of the striation of space is one that is shared by Bergson, Heidegger, Merleau-Ponty and Sartre among others. The novelty of Deleuze and Guattari’s account is in their formulation of the notion of smooth space as a response. I will begin by looking at the notion of striated space itself, and in particular will explore the degree to which we should see it as a structure or as a method, and the interrelation between these two characterisations. It is part of an old folklore that logic should not have existential theo- rems or existential validities. One should not prove in pure logic the existence of anything whatsoever; nothing could be proved by means of logic alone to necessarily exist. Whatever exists might not exist. This standpoint has been expressed by several philosophers from different traditions, such as Hume, Kant, Orenstein and Quine. We now set the stage by examining some issues. Our main question is: “Do we (...) actually have existential theorems in logic?” Two possible attitudes towards this question are as follows. A desideratum: logic should not have any existential theorems. A fact: logic does not have any existential theorems. (shrink)

Thông qua kết quả khảo sát 254 sinh viên (SV) Trường Đại học Nguyễn Tất Thành có ý định du học bán phần, nghiên cứu nhằm xác định các yếu tố ảnh hưởng đến ý định du học bán phần của SV Trường Đại học Nguyễn Tất Thành. Kết quả nghiên cứu cho thấy, có 2 yếu tố có ảnh hưởng cùng chiều đến Ý định du học bán phần, được sắp xếp theo mức độ ảnh hưởng giảm dần (...) là: Chuẩn chủ quan; Nhận thức về kiểm soát hành vi. Riêng yếu tố Nhận thức rủi ro có ảnh hưởng trái chiều đến Ý định du học bán phần của SV Trường Đại học Nguyễn Tất Thành. (shrink)

Nghiên cứu khảo sát bằng bảng hỏi được thiết kế theo thang đo Likert 5 mức độ gửi tới 380 khách hàng nữ trong độ tuổi 18-35 tham gia mua sắm mỹ phẩm thông qua livestream trên nền tảng TikTok nhằm phân tích tác động của chương trình khuyến mãi và nỗi sợ bị bỏ lỡ đến quyết định mua sắm bốc đồng của phụ nữ trẻ khi xem livestream mỹ phẩm trên TikTok. Số mẫu thu về hợp lệ (...) là 242 mẫu, dữ liệu sau khi thu thập được phân tích bằng phần mềm SmartPLS 4. Kết quả nghiên cứu cho thấy, nhân tố Chương trình khuyến mãi và Sự tham gia vào phiên livestream có tác động đáng kể đến Ý định và Quyết định mua sắm bốc đồng của phụ nữ trẻ. Trong khi đó, nhân tố Nỗi sợ bị bỏ lỡ không có ý nghĩa thống kê đối với Ý định mua sắm, nhưng vẫn ảnh hưởng đến Quyết định mua sắm. (shrink)
