Kant: War and Peace

A filosofia do direito internacional de Hegel tem recebido certa atenção nos últimos anos. As pesquisas mais recentes têm buscado apresentar uma visão diferente daquela, apresentada no século XIX e primeira metade do século XX, que retratava Hegel como um entusiasta do estado de guerra. Com efeito, também se passou a reavaliar a relação de Hegel com Kant no que diz respeito às questões do direito internacional, sobretudo, a possibilidade da paz. Meu objetivo nesse artigo é, primeiramente, apresentar os aspectos (...) gerais da filosofia do direito internacional de Hegel, enfatizando seu diálogo com Kant. Tento mostrar como Hegel está, em sua discussão, em referência a importantes aspectos do texto kantiano sobre a paz perpétua. Em segunda instância, partindo desse diálogo, argumento que, embora Hegel seja certamente muito mais um crítico do projeto kantiano do que um simpatizante, as implicações últimas de seu pensamento mostram-se, em alguma medida, alinhadas com as da filosofia de Kant. É possível constatar, mesmo em uma leitura superficial, que Kant tem o propósito de empreender em seu opúsculo de 1795, À Paz Perpétua, uma defesa dos princípios normativos do direito em todas as esferas da vida pública. Isso se evidencia na tentativa de desenvolver uma teoria da paz erigida sobre uma teoria tríplice do direito público, dividida nos âmbitos do direito estatal, das gentes e cosmopolita. Mas, se a questão é, por um lado, adequar os princípios puros da doutrina do (...) direito à teoria da paz, por outro, o problema com o qual Kant tem de lidar é essencialmente histórico. Não se trata apenas de justificar, em um contexto abrangente, a normatividade dos princípios do direito, mas também de demonstrar a sua aplicabilidade. Por conseguinte, em seu empreendimento, Kant encontra-se diante do desafio de demonstrar a inconsistência da “expressão corrente”, com a qual teve que lidar antes, que diz que “isto pode ser correto na teoria, mas nada vale na prática”. Tal preocupação pode ser observada direta e indiretamente, em várias passagens, no decorrer do texto, explicitando-se ,sobretudo, na discussão apresentada no Suplemento Primeiro no qual a questão suscitada pelo problema da teoria e prática, acerca das condições de possibilidade de realização do ideal da paz, é discutida no contexto de sua filosofia da história e também no Apêndice I, no qual, através de uma reflexão sobre o consenso entre moral e política, o que se põe em questão é a possibilidade da concordância entre teoria e prática no contexto da filosofia e da prática política. Ocupar-me-ei nesse texto apenas em tratar da questão sob esse segundo aspecto, tentando destacar que a estratégia kantiana para superar o problema da teoria e prática, no âmbito da filosofia política, depende do desenvolvimento de uma “renovada” doutrina da prudência. Como observa Castillo1, “[p]ara provar que a teoria jurídica da paz se aplica na teoria e na prática ao mesmo tempo”, Kant “deve fazer um exame crítico do conceito de prudência do Estado”2 . Esta análise deve nos permitir concluir, em primeiro lugar, que, bem diferente da visão antes difundida de que a filosofia política de Kant é expressão de um moralismo “que é certamente sincero, mas basicamente ingênuo”3, o objetivo de Kant, na verdade, nunca foi o de se afastar da realidade concreta da política em nome de um ideal abstrato de virtude política. According to an oft-repeated narrative, while Kant maintained racist views through the 1780s, he changed his mind in the 1790s. Pauline Kleingeld introduced this narrative based on passages from Kant’s Metaphysics of Morals and “Toward Perpetual Peace”. On her reading, Kant categorically condemned chattel slavery in those texts, which meant that he became more racially egalitarian. But the passages involving slavery, once contextualized, either do not concern modern, race-based chattel slavery or at best suggest that Kant mentioned it as a (...) cautionary tale for labor practices in Europe. Overall, Kant never explicitly considered chattel slavery as a moral problem to be addressed on its own. Rather, he treated it primarily in terms of its function in human history. If he ended up expressing some qualms about its practices, it was likely because they threatened to deepen intra-European conflicts and undermine the prospect of perpetual peace. The humanity of the enslaved “Negroes” was never part of the reasoning. This was not a casual oversight on Kant’s part. It reflects the complexity of his philosophical system: everything he did or did not say about chattel slavery begins to make sense once we connect his philosophy of history and his depiction of “Negroes” as natural slaves. World peace was a common theoretical consideration among philosophers during Europe’s Enlightenment period. The first robust essay on peace was written by Charles Irénée Castel de Saint- Pierre, which sparked an intellectual debate among prominent philosophers like Jean- Jacques Rousseau and Jeremy Bentham, who offered their own treatises on the concept of peace. Perhaps the most influential of all such writings comes from Immanuel Kant, who argues that world peace is no “high- flown or exaggerated notion” but rather a natural (...) result of the rational progression of the human species. U.S. President Woodrow Wilson, the mastermind behind the formation of the League of Nations in 1920 that provided the scaffolding to today’s United Nations, read Kant’s philosophy while he was a student at the College of New Jersey (now Princeton University). Some have argued that it is no coincidence that the per-son responsible for embarking upon the first serious political pursuit of world peace on a global scale was familiar with Kant. Indeed, William Galston claims that “Woodrow Wilson’s Fourteen Points [for world peace] were a faithful transcription of both the letter and spirit of Kant’s Perpetual Peace.”3 Historical connections aside, the question remains as to whether Kant’s philosophy is a viable conception of peace in a contemporary context. Using the conceptual distinction of positive and negative peace provided by Johan Galtung, I argue that Kant’s philosophy does provide the scaffolding for a viable conception of peace. In particular, I provide particular examples as to what social rights must be included in a Kantian model of peace. (shrink)

Em 1795, a maneira sarcástica com a qual Kant inaugura um de seus textos mais influentes referindo-se ao letreiro de uma pousada holandesa sobre o qual está pintado um cemitério cujo lema é a “paz perpétua”, diz muito sobre a situação permanente de guerra em que se encontrava não só os países europeus daquele tempo, mas também, de um modo geral, os povos na história da humanidade. Com o objetivo de colocar um fim definitivo em todas as guerras, Kant propõe (...) os fundamentos de uma teoria integral do direito público tripartida nos âmbitos do 1) direito do Estado, 2) do direito das gentes e 3) do direito cosmopolita. Exige-se, na primeira esfera, a instituição da constituição republicana, o que deve tornar os Estados sistemas políticos representativos. Em relação à segunda esfera, os Estados republicanos devem se reunir em uma liga livre de povos contrária à guerra E, na última, os seres humanos devem ser reconhecidos como cidadãos do mundo, o que lhes garante um direito à hospitalidade. Não é de se surpreender, levando em conta estas inovações, que o opúsculo kantiano “À paz Perpétua” tenha se tornado tão rapidamente popular e que a sua influência tenha se estendido para o contexto jurídico-político do século XX, materializando-se no aparecimento de organizações internacionais como a Liga das Nações (1919) e a Organização das Nações Unidas (1945). The ideal of the United Nations was first put forward by Immanuel Kant in his 1795 essay Perpetual Peace. Kant, in the tradition of Locke and Rousseau is a liberal who believes that relations between individuals can either be based upon law and consent or upon force and violence. One way that such the ideal of world peace could be achieved would be through the creation of a single world state, of which every human being was a citizen. Such an (...) ideal was advocated by a number of eighteenth century liberals. Kant, however, rejects this ideal and instead argues that the universal rule of law can be achieved through the establishment a federation of independent states. I examine the relevance of Kant’s arguments today, focusing on two questions: Firstly, as advocates of the rule of law, why advocate a federation of independent nations rather than a single world state. Secondly, is this ideal realizable? Is Kant right to think that republics are natural and are likely to live peacefully with one another? Kant’s arguments on this issue have been taken up again in recent decades by defenders of the theory of the “democratic peace”, the theory that democracies are more likely to live at peace with one another. Kant’s non-voluntarist conception of political obligation has led some philosophers to argue that he would reject self-government rights for indigenous peoples. Some recent scholarship suggests, however, that Kant’s critique of colonialism provides an argument in favor of granting self-government rights. Here I argue for a stronger conclusion: Kantian political theory not only can but must include sovereignty for indigenous peoples. Normally these rights are considered redress for historic injustice. On a Kantian view, however, I argue that they are not remedial. (...) Sovereignty rights are a necessary part of establishing perpetual peace. By failing to acknowledge the sovereignty of native groups, states once guilty of imperialism leave open the in principle possibility for future violence, even though no current conflict exists. Only in recognizing self-government rights can states truly commit to the cosmopolitan ideal. (shrink)

Recent interpretations of Kant’s international political philosophy have argued that the formation of a coercive world-state (Völkerstaat) is morally required. While these interpretations highlight the importance of a strong world government, they ignore Kant’s alternative to a Völkerstaat, a world-federation (Völkerbund). For both theoretical and practical reasons, the Völkerbund plays a crucial role in cosmopolitan right, and Kant can only justifiably reject the formation of the Völkerstaat because of the structure of the Völkerbund. This article explains the constitution and functions (...) of the Völkerbund, and thereby shows why Kant was not ultimately committed to supporting a coercive world-state. (shrink)
