How does pornography subordinate on the basis of gender? I provide part of an answer in this paper by framing subordination as something that works through everyday classification. Under certain material and social conditions, pornography classifies people through labeling them in ways that connect to structures of oppression. I hope to show two things. First, pornographic content is not the major driving force behind pornography’s subordination of women. Second, pornography, when repurposed in new ways, carries the potential to counter the (...) ill effects of other kinds of pornography, as feminist pornographers have attempted to show through their words and actions. The business of a sentence is not only to describe some state of affairs but also to perform other kinds of speech acts like ordering, suggesting, asking, etc. Understanding the kind of action performed by a speaker who utters a sentence is a multimodal process which involves the computing of verbal and non-verbal information. This work aims at investigating if the understanding of a speech act is affected by the gender of the actor that produces the utterance in combination with (...) a certain facial expression. Experimental data collected show that, as compared to men, women are less likely to be perceived as performers of orders and are more likely to be perceived as performers of questions. This result reveals a gender bias which reflects a process of women’s subordination according to which women are hardly considered as holding the hierarchical social position required for the correct execution of an order. In this paper I propose a partition semantics for sentences containing objective predicates that takes into account the phenomenon of occasion-sensitivity associated with so-called Travis cases. The key idea is that the set of worlds in which a sentence is true has a more complex structure as a result of different ways in which it is made true. Different ways may have different capacities to support the attainment of a contextually salient domain goal. I suggest that goal-conduciveness decides whether some (...) utterance of a sentence is accepted as true on a particular occasion at a given world. The utterance will not be accepted as true at a world which belongs to a truth-maker which is less conducive to a contextually salient goal than other truth-makers. Finally, the proposed occasion-sensitive semantics is applied to some cases of disagreement and cancellability. (shrink)

We describe how Intuitionistic Linear Logic can be used to provide a unified logical account for agents to find and execute plans. This account supports the modelling of agent interaction, including dialogue; allows agents to be robust to unexpected events and failures; and supports significant reuse of agent specifications. The framework has been implemented and several case studies have been considered. Further applications include human–computer interfaces as well as agent interaction in the semantic web.

Phenomenological, process-based and post-Marxist approaches have stressed the immanent nature of the ontogenesis of our world. The concept of performativity epitomizes these temporal, spatial and material views. Reality is always in movement itself: it is constantly materially and socially ‘performed’. Other views lead to a pre-defined world that would be mostly revealed through sensations. These transcendental stances assume that a subject, although pre-existing experience, is the absolute condition of possibility of it. In this paper, we develop another view of performativity, (...) one that re-introduces transcendence in the analysis but sees in it something dialogical to the process itself. We draw from the notions of visibility-invisibility and continuity-discontinuity in order to show how everyday activity both performs and makes visible the world. From that perspective, modes of visibility appear as conditions of possibility of performativity itself. We draw some implications for the conceptualization of management practices. (shrink)

Le problème métaphysique central en philosophie de l’esprit concerne la relation entre l’esprit et le corps des agents. Quand on tente d’expliquer, par exemple, le rapport entre les pensées et les actions humaines, on est alors immédiatement confronté avec la difficulté, apparemment insurmontable, d’expliquer la causalité mentale. On doit répondre à la question : nos états de pensée causent-ils effectivement ce que l’on fait? Bien sûr, nos croyances, nos intentions et nos désirs sont à la base de notre comportement, dira (...) le sens commun et une longue tradition philosophique. Cependant, certains philosophes ont récemment manifesté des doutes à propos du rôle réel de nos pensées sur nos actions. Pour contrer ce scepticisme, il nous faut expliquer comment des états de pensée peuvent exercer leur rôle causal dans un monde fondamentalement physique. Je vais donner ici les raisons pour lesquelles je crois que les états de pensée sont indispensables à l’explication complète de nos actions. Pour ce faire, je procéderai à une analyse approfondie de la relation entre la causalité mentale ou intentionnelle et la causalité physique. Je mettrai en perspective deux approches importantes sur la causalité mentale : celle de John Searle, qui défend la réalité des états mentaux et semble résister au réductionnisme, et celle de Jaegwon Kim, qui montre le péril auquel l’approche de Searle est exposée : la surdétermination causale! Selon Searle, le mental est un trait du monde physique . Aux yeux de Kim cette stratification en niveaux n’apporte aucune solution au problème de la causalité mentale. Kim a-t-il raison? (shrink)

The distinctly contemporary proliferation of pornography and hate speech poses a challenge to liberalism's traditional ideal of a 'marketplace of ideas' facilitated by state neutrality about the content of speech. This new study argues that the liberal state ought to depart from neutrality to meet this challenge.

We are pleased to release this edition of Ralph Johnson’s The Rise of Informal Logic as Volume 2 in the series Windsor Studies in Argumentation. This edition is a reprint of the previous Vale Press edition with some typographical errors and other minor mistakes corrected. The prime motive for gathering Ralph H. Johnson’s essays under one cover is their clear articulation of the goals, concerns and problems of the discipline of informal logic. To my knowledge all of the published articles, (...) even of the 1980s, are still in print. But some are obtainable only by special request of a journal back issue. Their availability, even their existence, is not nearly widely enough known, and this volume is dedicated to remedying that disservice to those currently working in the field of informal logic, critical thinking, argumentation, and practical reasoning. Three of these sixteen pieces appear here in print for the first time. The previously published pieces have appeared from 1980 to 1992 as chapters in collective works or as articles in journals, and these in turn published in Canada, USA, The Netherlands and Belgium. It is hoped that gathering this hitherto scattered material under one cover will contribute to a greater understanding of what informal logic is, and to an enhanced sense of the impact of Johnson’s ideas. A discipline of informal logic might exist today without the writings of Johnson and his frequent co-author, J. Anthony Blair. But it would almost certainly be quite different from what it actually is. (shrink)

This paper will outline a novel semantics of verbs of saying and of quotation based on Austin’s (1962) distinction among levels of linguistic acts (illocutionary, locutionary, rhetic, phatic, and phonetic acts). It will propose a way of understanding the notion of a rhetic act and argue that it is well-reflected in the semantics of natural language. The paper will furthermore outline a novel, unified and compositional semantics of quotation which is guided by two ideas. First, quotations convey properties related to (...) lower-level (phonetic or phatic) linguistic acts; second, such meanings of quotations are strictly based on syntactic structure, namely a lower-level (phonetic, phonological or morpho-syntactic) structure as part of the syntactic structure that is input to semantic interpretation. Such lower-level linguistic structures will contribute properties of utterances, to the semantic composition of the sentence, in one way or another. (shrink)

This paper deals with the normative dimension of the states of affairs produced by the performance of speech acts (i.e., states of affairs such as commitments, obligations, rights, licenses), and has a twofold aim. First, it points out the inadequacy of Searle’s conventionalist account of both the performance of speech acts and the normativity associated with it, and advocates as an alternative an inferentialist approach along with Bach and Harnish. Second, it suggests that we can account for the normative dimension (...) engendered by speech acts within the inferentialist framework by making the presumption about the interlocutor’s rationality (a notion derived from Grice’s work) fully explicit, and by attending to the set of expectations and constraints that result from it. Metaethical non-naturalists maintain that normative or evaluative properties cannot be reduced to, or otherwise explained in terms of, natural properties. They thus have difficulty explaining what these irreducibly normative properties are supposed to be, other than by saying what they are not. I offer a partial, positive characterization of irreducible normativity in naturalistic terms. At a first pass, it is this: that to attribute a normative property to something is necessarily to commend or condemn that thing, due to the nature (...) of the property attributed. This theory characterizes normativity in terms of the natural phenomenon of performing certain familiar speech acts. The hypothesis does other explanatory work as well: it provides for an account of the "queerness" of normative properties, one superior to other accounts; it explains why metaethical reductionism is bound to fail, in a way friendly to non-naturalism (as opposed to non-cognitivism); and it can help deflect arguments against non-naturalism from the "essential practicality" of normativity. Autorka szczególnie uwzględnia rolę partykuł modalnych jako elementów modyfikujących wypowiedzi realizowane przez czynności illokucyjne w tekstach opiniotwórczych. Partykuły modalne pozwalają nadawcy testu określić swój stosunek do referowanych w konstatacjach treści, dzięki czemu pośrednio wpływają na zmianę opinii odbiorcy.

In comparison to other epistemic sources (perception, memory and reason) testimony is the only one dealing with the social aspects of gaining and justifying knowledge. One main problem of the current discussion about knowledge by testimony is the concept of testimony itself. It is quite unclear what the correct notion of testimony is supposed to be. In this essay I present a proposal to define the concept of testimony in making a distinction between the conditions which hold in the speaker’s (...) context and the ones necessary and sufficient for the hearer. Furthermore, I will briefly defend the thesis that there is not one general concept of testimony, but that there are different ones connected via a kind of specialisation relation. (shrink)

It is a matter of philosophical debate whether Jonathan Israel’s assessment of Spinoza’s notion of ‘state religion’ can be interpreted as an atheistic and Marxist reading of Spinoza. Contrary to the widely accepted view, Spinoza has a peculiar understanding of religion; and thus, his views cannot, simply, be equated with atheism. By relying on this fact, in this article, I am going to shed light on the issue and try to show to what extent Israel’s interpretation goes beyond what Spinoza (...) himself claims and whether or not Spinoza’s views can make him an atheist. Another concern of the text will be elucidating Marx’s critique of Bruno Bauer’s argument for the abolition of religion and laying bare if there is any continuity between Marx and Spinoza on the problem of religion. After Israel’s interpretation is restated, both Spinozistic view of religion, as he puts forward in the Theological-Political Treatise [Tractatus Theologico- Politicus, 1670] and Political Treatise [Tractatus Politicus, 1676] and Marx’s arguments on the same issue in “On the Jewish Question” [in Deutsch-Franzosische Jahrbucher, 1844] will be examined in detail. Depending on these investigations, it will be argued that what Israel defends in his text Radical Enlightenment [2001] does not make Spinoza an atheist; on the contrary, although Spinoza is not an advocate of the commonsensical view of religion, he defends his own understanding of religion—which causes him to be regarded, prejudicedly, as an atheist. Furthermore, it will be pointed out that Israel’s interpretation cannot be a Marxist interpretation either because Marx’s critique of religion is generally misunderstood and mistaken with that of Bruno Bauer. Neither Spinoza’s views on religion nor that of Marx are completely compatible with what Israel defends in Radical Enlightenment; nevertheless, this does not mean that Israel tries to make an atheist or Marxist out of Spinoza through his appropriation of the philosopher. In response to Stephen Neale (2016), I argue that aphonic expressions, such as PRO, are intentionally uttered by normal speakers of natural language, either by acts of omitting to say something explicitly, or by acts of giving phonetic realization to aphonics. I argue, also, that Gricean intention-based semantics should seek divorce from Cartesian assumptions of transparent access to propositional attitudes and, consequently, that Stephen Schiffer's so-called meaning-intention problem is not powerful enough to banish alleged cases of over-intellectualization in contemporary philosophy (...) of language and mind. The Realist that investigates questions of ontology by appeal to the quantificational structure of language assumes that the semantics for the privileged language of ontology is externalist. I argue that such a language cannot be (some variant of) a natural language, as some Realists propose. The flexibility exhibited by natural language expressions noted by Chomsky and others cannot obviously be characterized by the rigid models available to the externalist. If natural languages are hostile to externalist treatments, then the meanings of (...) natural language expressions serve as poor guides for ontological investigation, insofar as their meanings will fail to determine the referents of their constituents. This undermines the Realist’s use of natural languages to settle disputes in metaphysics. (shrink)

The present thesis surveys different philosophical approaches to the nature of delusions: specifically, their ontology. However, since none of the various theories of the nature of delusions succeeds, I argue that there must be something problematic about the form of the analyses commonly offered. My general conclusion is that one cannot characterize delusions without taking away what it is distinctive about them.

This research is about altruism. In our first chapter, our quest to find whether we are essentially altruistic starts with questioning particular ways of inquiry and proposes a philosophy of unbracketing. In our second chapter, we realise that our proposal starts with an imperative – a prescription. We begin by meditating on the phenomenon of prescription which seems to precede all ways of inquiry. Our analysis of prescription reveals that altruism is to prescribe oneself towards an Other. This type of (...) prescription is to promise a future for an Other. To promise is to give one’s word and to undertake to realising it. In our third chapter, we explore the act of “giving one’s word.” To give one’s word is beyond a speech act. In fact, it is to give one’s logos. An altruistic attempt is carried out in this chapter to liberate ‘logos’ from particular conceptions and allow for its universal meaning to emerge. Logos is traced back to its inceptual conception as existence or will to power – a will to future. This philosophical excavation leads us to our fourth chapter where we re-encounter our original paradox. That is, while human reality starts with a promise of helping someone to make sense – to understand – we have been trying to understand understanding, or how we make sense, by removing the Other and by focusing only on subjective conditions. In this chapter, we reveal how to understand an Other is an altruistic act. In our final chapter, we carefully observe that human existence is a gift from the Other. We describe this gift as a metaphysical passage from being to existence – an altruistic act. A passage which is created by an Other who promises to give us the means to be able to create meaning, that is to say, to exist. (shrink)

This research is concerned with the innate predispositions underlying human intentional communication. Human communication is currently defined as a circular and overt attempt to modify a partner's mental states. This requires each party involved to posse ss the ability to represent and understand the other's mental states, a capability which is commonly referred to as mindreading, or theory of mind (ToM). The relevant experimental literature agrees that no such capability is to be found in the human speci es at least (...) during the first year of life, and possibly later. This paper aims at advancing a solution to this theoretical problem. We propose to consider sharedness as the basis for intentional communication in the infant and to view it as a primitive, i nnate component of her cognitive architecture. Communication can then build upon the mental grounds that the infant takes as shared with her caregivers. We view this capability as a theory of mind in a weak sense.›. (shrink)

Cognitive pragmatics is concerned with the mental processes involved in intentional communication. I discuss a few issues that may help clarify the relationship between this area and the broader cognitive science and the contribution that they give, or might give, to each other. Rather than dwelling on the many technicalities of the various theories of communication that have been advanced, I focus on the different conceptions of the nature and the architecture of the mind/brain that underlie them. My aims are, (...) first, to introduce and defend mentalist views of communication in general; second, to defend one such view, namely that communication is a cognitive competence, that is, a faculty, and the underlying idea that the architecture of the mind/brain is domain-specific; and, third, to review the (scarce) neuropsychological evidence that bears on these issues. From a cognitive perspective, intentional communication may be viewed as an agent's activity overtly aimed at modifying a partner's mental states. According to standard Gricean definitions, this requires each party to be able to ascribe mental states to the other, i.e., to entertain a so-called theory of mind. According to the relevant experimental literature, however, such capability does not appear before the third or fourth birthday; it would follow that children under that age should not be viewed as communicating agents. In order to solve the resulting dilemma, we propose that certain specific components of an agent's cognitive architecture (namely, a peculiar version of sharedness and communicative intention), are necessary and sufficient to explain infant communication in a mentalist framework. This paper offers both exegetical and systematic reconsiderations of Donald Davidson’s view on metaphor. In his essay What Metaphors Mean, Davidson argued against the idea that metaphors have any kind of propositional content beyond the literal meaning of the relevant sentence. Apart from this negative claim, Davidson also made a constructive proposal by suggesting that metaphor’s distinctive effect is to prompt a mental state of seeing-as. These two points seem connected insofar as Davidson makes the following assumptions. First, metaphors cause (...) their distinctive effects in an a-rational way. Second, seeing-as is a nonpropositional mental state. If we side with Davidson in thinking of meaning as rational and propositional, then it follows that metaphors’ distinctive effects cannot be an instance of meaning. They have the wrong format and are brought about in the wrong way. Against this background, I distinguish a strong reading and a modest reading of Davidson’s wrong-kind objection to metaphorical meaning. By taking into account some of Davidson’s later pronouncements on the matter, this paper aims to show that Davidson did not hold on to the strong version of the wrong-kind objection. This would open up the way to conceiving of metaphorical meaning in terms of speaker’s meaning, were it not for the fact that Davidson sticks to the wrong-way objection. The two concluding sections examine the cogency of the wrong-way objection as applied to metaphorical speaker’s meaning, and offer a model for thinking about the a-rational mental causation Davidson thought metaphors exhibit. In the last forty years, significant developments in neuroscience, psychology, and robotic technology have been cause for major trend changes in the philosophy of mind. One such shift has been the reallocation of focus from entirely brain-centered theories of mind to more embodied, embedded, and even extended answers to the questions, what are cognitive processes and where do we find such phenomena? Given that hypotheses such as Clark and Chalmers‘ (1998) Extended Mind or Hutto‘s (2006) Radical Enactivism, systematically undermine the (...) organism-bound, internal, and static pictures of minds and allow instead for the distribution of cognitive processes among brains, bodies, and worlds, a worry that arises is that the very subject of cognitive science, the ‗cognizer‘ will be hopelessly opaque, its mind leaking out into the world all over the place, thereby making it impossible to rein in and properly study. A seemingly unrelated and yet parallel trend has also taken place in feminist theorizing about the body over the last forty years. Whereas feminism of the 1970s and early 1980s tended to view ‗the body‘ as the site and matter of biological sex, while gender was a more fluid and socially constituted mode of existence, more recent feminist theory has questioned the givenness of bodies themselves. In other words, rather than seeing gender categories as manifestations of the already given sexed body, thinkers such as Butler (2000) and Lorber (1992) argue that the very notion of a body is often a product of scientific inquiry, which is itself a product of the power structures aiming to maintain a rigid binary between feminine and masculine gender roles. If the world at large plays such a constitutive role in determining who we are, then this implies that the tools we use, the language we speak, and the power relationships in which we are enmeshed are components of what it means to be embodied in any genuine sense. For thinkers like Haraway (1988) the image of the cyborg is most fitting for this new understanding of embodied subjects, as the cyborg is a coupling of machine and human. Gender and even biological sex will always be a technologically hybridized ‗monster‘ consisting of matter, machine, and mind. The overall aim of my project is thus to bring the two concurrent developments in theorizing about embodied subjects into discourse. As the cyborg features largely in recent feminist thought about embodiment, so too has it been a prominent metaphor in philosophy of mind, ever since Clark (2003) claimed that we ought to think of our ‗selves‘ more appropriately as Natural-Born Cyborgs. I therefore focus on this imagery as I go on to make the argument that this distributed account of cognition as well as of sexual identity is more fruitful for making progress in understanding ‗the human‘ more generally. Likewise, I argue that bringing the discussion of sex and gender into the arena of an otherwise asexual philosophy of mind, will shed light on some important facets of embodiment that have been overlooked but that ought to be addressed if we are to have an adequate account of ‗the proper subject of cognitive science.‘ My chapters include 1) a survey of the discourse between science and philosophy of mind leading to these embodied and extended approaches, 2) a first attempt at defending the extended mind thesis, 3) a discussion of how even the supposed resolution to the objections raised against extended cognition fails to properly take into account just how problematic subjectivity is, regardless of its being defined entirely organismic or not, as organisms themselves are highly malleable and socially constituted, 4) an explanation concerning how the same problematization of embodied subjectivity is ongoing in feminist theory, especially considering the phenomenology of transgendered embodiment, intersex, and technologically mediated bodies, 5) further elaboration on technologically enhanced bodies, exposing what I see as a continuum between bodies modified by ‗hard‘ technologies, such as implants, prostheses or surgeries, and those modified by ‗soft‘ technologies, such as gender norms, the social gaze, and technologically mediated metacognition, and last, 6) an argument for the image of the cyborg to replace ‗organism‘ in cognitive science, along with the corollary argument that cyborgs ought to represent not just embodied minds, but should also be the metaphor in attempting to understand ‗embodiment‘ more generally, which must, at its roots, be underpinned by gender and sexual identity. I argue that the imagery is fitting for the proper study of cognitive subjects as well as sexed and gendered bodies, but moreover, that just as the cyborg suggests a blending and hybridizing of seemingly unrelated elements, so too should the two areas of inquiry, philosophy of mind and feminist theory, pay heed to one another‘s use of this imagery and themselves begin to be more integrative in their approaches. The present work deals with the quality issue in social ontology: the fact that social entities not only can exist or not exist, but can also be more or less achieved and be subject to degrees of existence, and the fact that social entities can be bearers of varieties of ways of existence, that is, there are several ways in which a social entity of a certain type can be realized. In accordance with phenomenological eidetics, I show that modifications of (...) essential connections involve lacks or variations of essential parts of entities, which, respectively, imply degrees of existence and varieties of ways of existence which “enhance” the existence of social entities, and I argue that the modification issue hits the core of the quality of existence issue. Lastly, I focus on the essential connection of tendency as another case in which eidetics provides meaningful insights into the existential quality issue in social ontology. (shrink)

This dissertation addresses the following questions: How should epistemologists conceptualize testimony? What do people use testimony to do? And why does ‘what people do’ with testimony matter epistemically? In response to these questions I both define and characterize testimony. While doing so I argue for the following answers, given here very briefly: What do people do when they testify? They tell each other things and avow that those things are true, offering their statements to others as reasons to believe. More (...) importantly, they interact with each other in order to negotiate about significance. Why do these activities matter epistemically? Because by engaging in them people generate understanding, as well as knowledge, that no one involved may have had prior to negotiation. Not only that, but they generate collective hermeneutic resources—conceptual tools with which to interpret and understand. In so doing, they not only learn, they create significance and (re)construct social worlds, living together as epistemic, moral, and political agents. So, how should epistemologists conceptualize testimony? They should treat it as a particular speech act that most often occurs as part of a testimonial exchange—an interactive, interpretive, dialogical activity that people use in order to negotiate about significance and generate understanding. This characterization of testimony is an important contribution because it: reveals some of the distinctively social aspects of testimonial knowledge and understanding; suggests better answers to epistemic questions about testimony than those based on typical characterizations in the literature; leads discussion on the topic in a number of new directions; and it lays a foundation for an ethics of testimony that cannot be separated from epistemic concerns. Neither can those concerns be separated from social, moral, and political considerations. The position thus pushes epistemologists to investigate the intertwining of epistemic, moral, and political agency. (shrink)

This thesis is a contribution toward an integral cognitive theory of memory and technology. It, furthermore, develops a theory and prototype for technologically extending mind (memory and thinking).

The philosopher Martin Heidegger argued that the truthful life was at risk of being lost in Western technological culture in the name of increasing control, efficiency, and agility. As the risk is actualised, so the human essence as truth maker is obscured and life itself feels poorer. This thesis draws on Heideggerian philosophy to demonstrate the loss in two dominant styles of contemporary strategic management: the world-picturing and, more recent, agile style. It builds a theory of post-agile strategic practice, which (...) I call adaptive, to address this loss. Consistent with Heideggerian philosophy, I utilise a transformative disclosure methodology and a literary, paradigmatic case reading method to address the questions: Why is agile strategic management so unsatisfying? How do Heideggerian scholars shed light on this dissatisfaction? How do Heideggerians understand the emerging style and what strategic management practices can I propose for the future? After introducing agile strategic management and the impoverishment of life that it fosters, I set out how Heidegger’s philosophy of truth, thinking, and the sacred both sheds light on the problem and suggests a remedy for it. I closely read paradigmatic texts of the world-picturing and agile strategic management styles to demonstrate how business strategy theorisation lines up with extraordinary closeness to Heidegger’s philosophical assessment. I then analyse three Heideggerian prototypes for an adaptive style of strategy practice, concentrating on one paradigmatic text to identify their principal weakness: the omission of the sacred. I illustrate and contrast paradigmatic cases of both the agile and adaptive styles drawn from the beer industry and draw on the adaptive case to construct a theory of adaptive strategy practice, which addresses the problem of the loss of truth, suggesting pedagogical and strategic management practices. I conclude by summarising its findings and contributions, noting some limitations and connections to other studies and suggesting further lines of research. (shrink)

The special issue Doing Memory, Doing Identity: Politics of the Everyday in Contemporary Global Communities draws on anthropological theory, performance studies, feminism, post-colonial studies and other theoretical traditions for an insightful examination of the everyday practices of doing memory. A series of ethnographies and qualitative studies from locations as diverse as Italy, Norway, Greece, France, Brazil and China complement profound theoretical analyses to investigate the multiple links between individual and collective pasts, futures and identities, especially focusing on emotions, embodiment, the (...) senses, difference and power relations. Taking a critical stance in regard to current social-scientific and socio-political debates, this special issue reflects on the political and ethical aspects of day-to-day memory practices and examines issues related to identity, imagination and otherness. Drawing on positioning theory this study investigates how Somali diaspora mothers actively struggle to be recognized by teachers in Danish public schools as equitable partners in their children’s education. The study takes into account the historically and politically constituted conditions for positioning work and argues that these mothers navigate skillfully in these conditions explicitly positioning themselves as both ‘supportive assistants’ and ‘responsible parents’. However, the analysis shows that these mothers have narratives of unjust treatment of both themselves and their children (...) in schools, but the struggle to be recognized as equitable partners inhibits their possibilities of taking up the position of ‘advocate for their child’. They are thereby drawn into a position of ‘passive complacency’. Additionally the article argues for a more encompassing understanding of positioning theory that takes into account the constituted conditions as well as embodied and material aspects of constitutive here-and-now negotiations. En este trabajo examinamos el tópico de la responsabilidad en el derecho penal internacional a la luz de la filosofía de John Searle, y del fallo dictado por la Corte Penal Internacional en el caso de Thomas Lubanga. En el primer acápite analizamos la declaración de responsabilidad penal en función de la teoría de actos de habla de Austin y de Searle, tratándola como un acto ilocucionario cuyo significado es dependiente de un marco institucional específico. Luego, en el segundo acápite, (...) mostramos de qué forma tal marco puede reconstruirse como un ejemplo paradigmático de la realidad social construida descrita por Searle, especialmente en virtud del nexo entre mente, lenguaje y sociedad. A nuestro juicio, los conceptos de intencionalidad colectiva, atribución de funciones de estatus y poderes deónticos son fundamentales para entender tal nexo. En efecto, tal como argumentamos en la tercera sección, los sistemas de poderes deónticos asociados al derecho internacional no solo explican la aparición de Tribunales penales internacionales, como la Corte Penal Internacional, sino además el carácter imprescriptible de los crímenes de lesa humanidad. Los acuerdos internacionales que promueven y protegen los derechos humanos, y que tratan la imprescriptibilidad de aquellos crímenes, son objeto de análisis en la sección final, en donde exponemos algunas reflexiones finales a partir del caso Lubanga. The following thesis discusses a range of central aspects in Timothy Williamson’s so-called «knowledge-first» epistemology. In particular, it adresses whether this kind of epistemological framework is apt to answer the challenges of scepticism.

It is shown that at least part of the terminology of the theory of speech acts can be methodically introduced within the constructive ortholanguage-programm. There is evidence that a methodical constraint leads the reconstruction of the basic speech-act-types from requests via statements to questions. Moreover there is evidence that requests and questions don't involve "propositional acts".

The Linda paradox is a key topic in current debates on the rationality of human reasoning and its limitations. We present a novel analysis of this paradox, based on the notion of verisimilitude as studied in the philosophy of science. The comparison with an alternative analysis based on probabilistic confirmation suggests how to overcome some problems of our account by introducing an adequately defined notion of verisimilitudinarian confirmation.
