The burgeoning science of ethics has produced a trend toward pessimism. Ordinary moral thought and action, we’re told, are profoundly influenced by arbitrary factors and ultimately driven by unreasoned feelings. This book counters the current orthodoxy on its own terms by carefully engaging with the empirical literature. The resulting view, optimistic rationalism, shows the pervasive role played by reason, and ultimately defuses sweeping debunking arguments in ethics. The science does suggest that moral knowledge and virtue don’t come easily. However, despite (...) the heavy influence of automatic and unconscious processes that have been shaped by evolutionary pressures, we needn’t reject ordinary moral psychology as fundamentally flawed or in need of serious repair. Reason can be corrupted in ethics just as in other domains, but a special pessimism about morality in particular is unwarranted. In this crisply written book, Hanno Sauer offers the first book-length treatment of debunking arguments in ethics, developing an empirically informed and philosophically sophisticated account of genealogical arguments and their significance for the reliability of moral cognition. He breaks new ground by introducing a series of novel distinctions into the current debate, which allows him to develop a framework for assessing the prospects of debunking or vindicating our moral intuitions. He also challenges the justification of some of our moral judgments (...) by showing that they are based on epistemically defective processes. His book is an original, cutting-edge contribution to the burgeoning field of empirically informed metaethics, and will interest philosophers, psychologists, and anyone interested in how - and whether - moral judgment works. We can infer moral conclusions from nonmoral evidence using a three-step procedure. First, we distinguish the processes generating belief so that their reliability in generating true belief is statistically predictable. Second, we assess the processes’ reliability, perhaps by observing how frequently they generate true nonmoral belief or logically inconsistent beliefs. Third, we adjust our credence in moral propositions in light of the truth ratios of the processes generating beliefs in them. This inferential route involves empirically discovering truths of the form (...) “Process P, which generates belief in moral proposition M, has truth ratio T", and using them to discover probabilities for moral propositions. Arguments attempting to debunk moral beliefs, by showing they are unjustified, have tended to be global, targeting all moral beliefs or a large set of them. Popular debunking arguments point to various factors purportedly influencing moral beliefs, from evolutionary pressures, to automatic and emotionally-driven processes, to framing effects. We show that these sweeping arguments face a debunker’s dilemma: either the relevant factor is not a main basis for belief or it does not render the relevant beliefs unjustified. Empirical debunking arguments (...) in ethics can avoid this predicament, but only if they are refocused on highly selective classes of moral belief. Experimental data can combine with familiar consistency reasoning to reveal that like cases are not being treated alike. Selective debunking arguments are unlikely to yield sweeping sceptical conclusions, but they can lead to rational moral change. (shrink)

Various studies show moral intuitions to be susceptible to framing effects. Many have argued that this susceptibility is a sign of unreliability and that this poses a methodological challenge for moral philosophy. Recently, doubt has been cast on this idea. It has been argued that extant evidence of framing effects does not show that moral intuitions have an unreliability problem. I argue that, even if the extant evidence suggests that moral intuitions are fairly stable with respect to what intuitions we (...) have, the effect of framing on the strength of those intuitions still needs to be taken into account. I argue that this by itself poses a methodological challenge for moral philosophy. (shrink)

Several philosophers and psychologists have argued that evidence of moral framing effects shows that many of our moral judgments are unreliable. However, all previous empirical work on moral framing effects has used between-subject experimental designs. We argue that between-subject designs alone do not allow us to accurately estimate the extent of moral framing effects or to properly evaluate the case from framing effects against the reliability of our moral judgments. To do better, we report results of our new within-subject study (...) on four types of moral framing effects, and we discuss the implications of our findings for the reliability of moral judgments. Various studies have reported that moral intuitions about the permissibility of acts are subject to framing effects. This paper reports the results of a series of experiments which further examine the susceptibility of moral intuitions to framing effects. The main aim was to test recent speculation that intuitions about the moral relevance of certain properties of cases might be relatively resistent to framing effects. If correct, this would provide a certain type of moral intuitionist with the resources to resist challenges (...) to the reliability of moral intuitions based on such framing effects. And, fortunately for such intuitionists, although the results can’t be used to mount a strident defence of intuitionism, the results do serve to shift the burden of proof onto those who would claim that intuitions about moral relevance are problematically sensitive to framing effects. The question of what makes someone the same person through time and change has long been a preoccupation of philosophers. In recent years, the question of what makes ordinary or lay people judge that someone is—or isn’t—the same person has caught the interest of experimental psychologists. These latter, empirically oriented researchers have sought to understand the cognitive processes and eliciting factors that shape ordinary people’s judgments about personal identity and the self. Still more recently, practitioners within an emerging discipline, experimental (...) philosophical bioethics or “bioxphi”—the focus of this chapter—have adopted a similar aim and employed similar methodologies, but with two distinctive features: (a) a special concern for enhanced ecological validity in the examples and populations studied; and (b) an interest in contributing to substantive normative debates within the wider field of bioethics. Our aim in this chapter is to sample illustrative work on personal identity in bioxphi, explore how it relates to studies in psychology covering similar terrain, and draw out the implications of this work for matters of bioethical concern. In pursuing these issues, we highlight recent work in bioxphi that includes the perceived validity of advance directives following neurodegeneration, the right of psychologically altered study participants to withdraw from research, how drug addiction may cause one to be regarded by others as “a completely different person,” the effect of deep-brain stimulation on perceptions of the self, and the potential influence of moral enhancement interventions on intuitive impressions of a person’s character. This article surveys the latest research on risky-choice framing effects, focusing on the implications for rational decision-making. An influential program of psychological research suggests that people's judgements and decisions depend on the way in which information is presented, or ‘framed’. In a central choice paradigm, decision-makers seem to adopt different preferences, and different attitudes to risk, depending on whether the options specify the number of people who will be saved or the corresponding number who will die. It is standardly assumed (...) that such responses violate a foundational tenet of rational decision-making, known as the principle of description invariance. We discuss recent theoretical and empirical research that challenges the dominant ‘irrationalist’ narrative. These approaches typically pay close attention to how decision-makers represent decision problems (including their interpretation of numerical quantifiers or predicate choice) and they highlight the need for a more robust characterization of the description invariance principle. We conclude by indicating avenues for future research that could bring us closer to a complete—and potentially rationalizing—explanation of framing effects. (shrink)

We examine a prominent naturalistic line on the method of cases, exemplified by Timothy Williamson and Edouard Machery: MoC is given a fallibilist and non-exceptionalist treatment, accommodating moderate modal skepticism. But Gettier cases are in dispute: Williamson takes them to induce substantive philosophical knowledge; Machery claims that the ambitious use of MoC should be abandoned entirely. We defend an intermediate position. We offer an internal critique of Macherian pessimism about Gettier cases. Most crucially, we argue that Gettier cases needn’t exhibit (...) ‘disturbing characteristics’ that Machery posits to explain why philosophical cases induce dubious judgments. It follows, we show, that Machery’s central argument for the effective abandonment of MoC is undermined. Nevertheless, we engineer a restricted variant of the argument—in harmony with Williamsonian ideology–that survives our critique, potentially limiting philosophy’s scope for establishing especially ambitious modal theses, despite traditional MoC’s utility being partially preserved. En primer lugar, es preciso explicar con precisión cómo contribuye la formación filosófica a la creación de intuiciones filosóficas (Contribución); en segundo lugar, debe explicarse cómo la formación filosófica inmuniza a las intuiciones filosóficas frente a factores distorsionadores (Inmunidad). Disagreement is a hot topic right now in epistemology, where there is spirited debate between epistemologists who argue that we should be moved by the fact that we disagree and those who argue that we need not. Both sides to this debate often use what is commonly called “the method of cases,” designing hypothetical cases involving peer disagreement and using what we think about those cases as evidence that specific normative theories are true or false, and as reasons for believing (...) as such. With so much weight being given in the epistemology of disagreement to what people think about cases of peer disagreement, our goal in this paper is to examine what kinds of things might shape how people think about these kinds of cases. We will show that two different kinds of framing effect shape how people think about cases of peer disagreement, and examine both what this means for how the method of cases is used in the epistemology of disagreement and what this might tell us about the role that motivated cognition is playing in debates about which normative positions about peer disagreement are right and wrong. Recent empirical studies of philosophers by Eric Schwitzgebel and others have seriously called into question whether professional ethicists have any useful expertise with thought experiments, given that their intuitions appear to be no more reliable than those of lay subjects. Drawing on such results, sceptics like Edouard Machery argue that normative ethics as it is currently practiced is deeply problematic. In this paper, I present two main arguments in defense of the standard methodology of normative ethics. First, there is strong (...) reason to believe that expertise with thought experiments requires considering scenarios in their proper theoretical context and in parallel with other pertinent situations, so that we should not expect philosophers to be better than lay folk at responding to decontextualized cases. Second, skeptical views underestimate the epistemic benefits of the actual practices of post-processing initial verdicts both at individual and social levels. Contrary to a mythical conception of ‘the method of cases’, philosophers are frequently sensitive to the quality of intuitive evidence, reject and revise their verdicts on the basis of independently supported principles or interpersonal criticism, and defer to recognized specialists. Reflective equilibrium has been criticized for various reasons ever since the publication of Rawls’ A Theory of Justice. Recent empirical research into moral decision-making poses new challenges to RE because it questions the reliability of moral intuitions. This research might discredit moral intuitionism in general and RE in particular insofar as it ascribes epistemic value to moral intuitions. These findings suggest, for instance, that moral intuitions vary with cultural background, gender or framing. If it could be shown that all or (...) certain kinds of moral intuitions are unreliable, this would diminish the plausibility of the claim that they provide good reasons to believe in the truth of their content, especially given the growing evidence that professional philosophers are just as biased and susceptible to distorting factors as lay people. In this paper I critically discuss three recent defenses of RE against this unreliable intuitions objection. Two of these defenses argue that the UIO misses its target, because RE does not depend on intuitions, or because the relevant considered judgments in RE are not intuitions. The third defense grants that RE depends on intuitions and that some Rawlsian considered judgments are intuitions. But it argues that the notion of considered judgments can be revised, and that wide reflective equilibrium has the means to adopt the criticism because it can use information about unreliable intuitions and exclude those from further consideration. I argue that the first two defenses do not succeed. The third defense is the most promising one. However, I argue that this defense also fails. In this defense, RE is not a distinctive moral epistemic theory: different versions of RE would be conceivable, all of which are deeply problematic. I conclude with a discussion of the broader philosophical implications of the UIO, specifically whether or not accepting the UIO would warrant skepticism regarding moral knowledge. (shrink)

This paper aims to defend the Expertise Defense by addressing the problem of disanalogy, which represents one of the two main critiques against this argument. The Expertise Defense is an argument which defends the notion that philosophers’ judgments are more reliable than those of novices by making analogies between philosophy and other fields in which experts’ judgments are given a privileged position. Conventionally, this line of argumentation has aimed to demonstrate that philosophers' intuitions about thought experiments or metaphysical questions are (...) not as susceptible to being distorted by unrelated factors as those of novices. However, this paper reinterprets the Expertise Defense, proposing that it claims that philosophers' intuitions are considerably more reliable than novices, even if they are still susceptible to distorting factors. By adopting this interpretation, the current paper effectively counters the empirical objection that philosophers' intuitions are subject to distortion. Furthermore, I respond to the disanalogy problem, which contends that there is no meaningful analogy between philosophy and other domains because philosophical experience does not contribute significantly to philosophical intuitions. In response to this, I present a new model of philosophical expertise. According to this model, philosophical training plays a vital role in shaping philosophical intuitions by enabling expert philosophers to comprehend philosophical problems accurately and form well-grounded intuitions about them. Additionally, I provide empirical evidence supporting this model, particularly in the context of the debates about free-will. While the extent to which this model can be generalized remains an empirical question, it seems reasonable to think that it could plausibly be extended to other debates. (shrink)

Regard for Reason in the Moral Mind argues that a careful examination of the scientific literature reveals a foundational role for reasoning in moral thought and action. Grounding moral psychology in reason then paves the way for a defense of moral knowledge and virtue against a variety of empirical challenges, such as debunking arguments and situationist critiques. The book attempts to provide a corrective to current trends in moral psychology, which celebrate emotion over reason and generate pessimism about the psychological (...) mechanisms underlying commonsense morality. Sacrificial dilemmas such as the trolley problem play an important role in experimental philosophy (x-phi). But it is increasingly argued that, since we are not likely to encounter runaway trolleys in our daily life, the usefulness of such thought experiments for understanding moral judgments in more ecologically valid contexts may be limited. However, similar sacrificial dilemmas are experienced in real life by animal research decision makers. As part of their job, they must make decisions about the suffering, and often the (...) death, of many non-human animals. For this reason, a context-specific investigation of so-called “3R dilemmas” (i.e., dilemmas where there is a conflict between the principles of replacement, reduction, and refinement of the use of animals in research) is essential to improve the situation of both non-human animals and human stakeholders. An approach well suited for such investigation is experimental philosophical bioethics (“bioxphi”), which draws on methods similar to x-phi to probe more realistic, practical scenarios with an eye to informing normative debates and ethical policy. In this article, we argue for a need to investigate 3R dilemmas among professional decision-makers using the tools of bioxphi. In a first step, we define 3R dilemmas and discuss previous investigations of professionals’ attitudes in such cases. In a second step, we show how bioxphi is a promising method to investigate the whys and hows of professional decision-making in 3R dilemmas. In a last step, we provide a bioxphi template for 3R dilemmas, give recommendations on its use, explore the normative relevance of data collected by such means, and discuss important limitations. This paper aims to vindicate the expertise defense in light of the experimental philosophy of free will. My central argument is that the analogy strategy between philosophy and other domains is defensible, at least in the free will debate, because philosophical training contributes to the formation of philosophical intuition by enabling expert philosophers to understand philosophical issues correctly and to have philosophical intuitions about them. This paper will begin by deriving two requirements on the expertise defense from major criticisms of (...) it. First, precisely how philosophical training contributes to the formation of philosophical intuitions requires explanation (Contribution); second, it must be explained how philosophical training immunizes philosophical intuitions from distorting factors (Immunity). I shall argue that the Contribution requirement is crucial for the expertise defense and that this requirement can be satisfied at least in the domain of free will: recent research shows that most novices are unable to understand determinism correctly, suggesting that having intuitions about determinism requires philosophical expertise. I then discuss how this proposal can be applied to other philosophical disciplines. (shrink)

This entry summarizes an emerging subdiscipline of both empirical bioethics and experimental philosophy (“x-phi”) which has variously been referred to as experimental philosophical bioethics, experimental bioethics, or simply “bioxphi”. Like empirical bioethics, bioxphi uses data-driven research methods to capture what various stakeholders think (feel, judge, etc.) about moral issues of relevance to bioethics. However, like its other parent discipline of x-phi, bioxphi tends to favor experiment-based designs drawn from the cognitive sciences – including psychology, neuroscience, and behavioral economics – to (...) tease out why and how stakeholders think as they do. Confabulation is typically understood to be dysfunctional. But this understanding neglects the phenomenon’s potential benefits. In fact, we think that the benefits of non-clinical confabulation provide a better foundation for a general account of confabulation. In this paper, we start from these benefits to develop a social teleological account of confabulation. Central to our account is the idea that confabulation manifests a kind of willful ignorance. By understanding confabulation in this way, we can provide principled explanations for the difference between (...) clinical and non-clinical cases of confabulation and the extent to which confabulation is rational. A debunking argument contends that some target moral judgments were produced by unreliable processes and concludes that such judgments are unjustified. Debunking arguments face a regress challenge: to show that a process is unreliable at tracking the moral truth, we need to rely on other moral judgments. But we must show that these relied-upon judgments are also reliable, which requires yet a further set of judgments, whose reliability needs to be confirmed too, and so on. Some argue that the debunker (...) faces an insurmountable regress, which disables the debunking conclusion. In this paper, I explore and defuse this regress challenge. (shrink)

This paper discusses “impartiality thought experiments”, i.e., thought experiments that attempt to generate intuitions which are unaffected by personal characteristics such as age, gender or race. We focus on the most prominent impartiality thought experiment, the Veil of Ignorance (VOI), and show that both in its original Rawlsian version and in a more generic version, empirical investigations can be normatively relevant in two ways: First, on the assumption that the VOI is effective and robust, if subjects dominantly favor a certain (...) normative judgment behind the VOI this provides evidence in favor of that judgment; if, on the other hand, they do not dominantly favor a judgment this reduces our justification for it. Second, empirical investigations can also contribute to assessing the effectiveness and robustness of the VOI in the first place, thereby supporting or undermining its applications across the board. Yet this article shows how processes of literature search and review are likely to be affected by widespread and systematic biases. A solution to this problem is offered here. Whilst the tradition of systematic reviews of literature from scientific disciplines has been neglected in philosophy, systematic reviews are important tools that minimize bias in literature search and review and allow for greater reproducibility and (...) transparency. If naturalistic philosophers wish to reduce bias in their research, they should then supplement their traditional tools for literature search and review by including systematic methodologies. Foundationalism in moral epistemology is a core tenet of ethical intuitionism. According to foundationalism, some moral beliefs can be known without inferential justification; instead, all that is required is a proper understanding of the beliefs in question. In an influential criticism against this view, Walter Sinnott-Armstrong has argued that certain psychological facts undermine the reliability of moral intuitions. He claims that foundationalists would have to show that non-inferentially justified beliefs are not subject to those defeaters, but this would already constitute (...) a form of inference and hence undermine the possibility of noninferential justification. The goal of my paper is to defend foundationalism against Sinnott-Armstrong’s criticism. After presenting his challenge, I first argue that the most promising objection to it fails. This objection makes the case that defeater-defeaters are not part of the justification, but merely preserve the justification which the original claim provides. I object to this argument by distinguishing between weak and robust defeaters; only weak defeaters, I argue, fall outside the scope of justification, and it is an open question whether Sinnott-Armstrong’s defeaters fall into that category. This leads the way to my own criticism of Sinnott-Armstrong’s challenge: foundationalists in moral epistemology are entitled to the use of defeater-defeaters as part of the justification for moral beliefs as long as those defeater-defeaters themselves do not entail moral claims. Therefore, Sinnott-Armstrong’s challenge does not undermine foundationalism. (shrink)

In response, I elaborate on my conception of moral reasoning, as well as clarify the structure of debunking arguments and how my cautious optimism is only of the “glass half full” sort. I also explain how rationalism can capture insights purportedly only explained by sentimentalist and Humean views. The reply concludes by clarifying and admitting some limits of the book's scope.

A recent empirical study has argued that experts in the ethics or the law of war cannot reach reasonable convergence on dilemmas regarding the number of civilian casualties who may be killed as a side effect of attacks on legitimate military targets. This article explores the philosophical implications of that study. We argue that the wide disagreement between experts on what in bello proportionality means in practice casts serious doubt on their ability to provide practical real-life guidance. One rather common way of doing philosophy involves what is called “the method of cases,” where philosophers design hypothetical cases and use what we think about those cases—our “philosophical intuitions”—as evidence that certain philosophical theories are true or false, and as reasons for believing that those theories are true or false. This way of doing philosophy has been challenged in recent years on the basis of both general epistemological considerations and more specific methodological concerns. These methodological concerns have focused not (...) on whether philosophical intuitions can be a good source of evidence, but rather on whether they can be used in the ways that they currently are used in actual philosophical practice given how little we know about them and some of the worrisome things that we have learned about them in recent years. My goal here is to provide you with a short introduction to this way of challenging to how philosophers use the method of cases, and to walk you through some of the more popular ways of responding to this kind of methodological challenge and some of their shortcomings. This dissertation is a contribution to the field of empirically informed metaethics, which combines the rigorous conceptual clarity of traditional metaethics with a careful review of empirical evidence. More specifically, this work stands at the intersection of moral psychology, moral epistemology, and philosophy of action. The study comprises six chapters on three distinct (although related) topics. Each chapter is structured as an independent paper and addresses a specific open question in the literature. The first part concerns the psychological features and (...) cognitive function of moral intuition. Chapter 1 (“Moral intuition, strength, and metacognition”) is focused on the concept of intuitive strength, which is one of the defining features of moral intuition. I provide a metacognitive account of intuitive strength and show why such a view is preferable to emotional or quasi-perceptual accounts. Then, in Chapter 2 (“Dual process reflective equilibrium”), I will discuss the interplay between intuition and reflection in moral reasoning. I will contend that the influential “default-interventionist” model of reasoning, theorized by Greene, is insufficiently supported by the evidence. In light of some recent studies, I outline an account of moral reasoning in which intuition and reflection are not in conflict but cooperate to reach a reflective goal. I call this model dual process reflective equilibrium. The aim of the first part is descriptive, i.e., it argues for an accurate understanding of moral intuition and reasoning in light of the available empirical evidence. In contrast, the second part addresses a normative question: is a subject epistemically justified in forming a belief on the basis of a moral intuition? Skeptics of moral intuition argue that accepting moral intuitions should be the exception rather than the rule to the extent that epistemically defective processes determine the content of moral intuitions. Chapter 3 (“Moral intuitionism and the reliability challenge”) introduces the recent empirical challenges to the reliability of moral intuitions and elaborates a promising strategy for defending intuitionism. In short, I consider whether subjects can track the reliability of their intuitions with their confidence. In Chapter 4 (“The argument from limited cognitive resources”), I evaluate a different strategy to defend moral intuitionism. Specifically, I develop an argument according to which accepting moral intuitions is legitimate because it is the most rational option that a subject has, given her limited resources. The third and final part of the dissertation concerns the role of moral intuitions in action. The influence of automatic processes on moral conduct raises different challenges to moral philosophy. The first challenge is to explain how a subject can be motivated by certain values without the mental effort of deliberation. Chapter 5 (“Caring, moral motivation, and automatic conduct”) tackles this issue. Chapter 6 (“Moral sensitivity as skillful automaticity”) aims to explain how moral agents can be sensitive to good reasons through automatic mental processes. (shrink)

Doris argues that our choices are heavily influenced by forces that we wouldn’t count as genuine reasons. This unsettling conclusion is motivated by a debunking argument so wide-ranging that it isn’t foisted upon us by the sciences. Doris sometimes seems to lower his ambitions when offering instead a skeptical hypothesis argument, but that conflicts with his aims in the book.
