According to a naïve view sometimes apparent in the writings of moral philosophers, ‘ought’ often expresses a relation between agents and actions – the relation that obtains between an agent and an action when that action is what that agent ought to do. It is not part of this naïve view that ‘ought’ always expresses this relation – on the contrary, adherents of the naïve view are happy to allow that ‘ought’ also has an epistemic sense, on which it means, (...) roughly, that some proposition is likely to be the case, and adherents of the naïve view are also typically happy to allow that ‘ought’ also has an evaluative sense, on which it means, roughly, that were things ideal, some proposition would be the case.1 What is important to the naïve view is not that these other senses of ‘ought’ do not exist, but rather that they are not exhaustive – for what they leave out, is the important deliberative sense of ‘ought’, which is the central subject of moral inquiry about what we ought to do and why – and it is this deliberative sense of ‘ought’ which the naïve view understands to express a relation between agents and actions.2 In contrast, logically and linguistically sophisticated philosophers – with a few notable exceptions3 – have rejected this naïve view. Can quite different values be rationally weighed against one another? Can the value of one thing always be ranked as greater than, equal to, or less than the value of something else? If the answer to these questions is no, then in what areas do we find commensurability and comparability unavailable? And what are the implications for moral and legal decision making? This book struggles with these questions, and arrives at distinctly different answers.".

Intentions matter. They have some kind of normative impact on our agency. Something goes wrong when an agent intends some end and fails to carry out the means she believes to be necessary for it, and something goes right when, intending the end, she adopts the means she thinks are required. This has even been claimed to be one of the only uncontroversial truths in ethical theory. But not only is there widespread disagreement about why this is so, there is (...) widespread disagreement about in what sense it is so. In this paper I explore an underdeveloped answer to the question of in what sense it is so, and argue that resolving an apparent difficulty with this view leads to an attractive picture about why it is so. Allow me to rehearse a familiar scenario. We all know that which ends you have has something to do with what you ought to do. If Ronnie is keen on dancing but Bradley can’t stand it, then the fact that there will be dancing at the party tonight affects what Ronnie and Bradley ought to do in different ways. In short, (HI) you ought, if you have the end, to take the means. But now trouble looms: what if you have (...) dreadful, murderous ends? Ought you to take the means to them? Seemingly not. But fortunately, an assumption made by deontic logics1 comes to the rescue. Since ‘‘ought’’, according to this assumption, is a sentential operator, HI must really be ambiguous. It could be read either as (Narrow) You have the end ! O(you take the means) or as (Wide) O(you have the end ! you take the means). Now if Narrow is true, then you really ought to take the means to your murderous ends. But this doesn’t follow from Wide. All that follows from Wide is that you ought to either take the means to these ends or else give them up. Conclusions: (1) Since HI is on some reading true, but Narrow isn’t, Wide is true. (2) Wide accounts for the relationship between your ends and what you ought to do. This elegant scenario repeats itself in many other domains in which it seems like something can have a bearing on what some particular agent ought to do. Does what you know affect what you ought to do? Do your beliefs about what you ought to do affect what you ought to do? Do your promises affect what you ought to do? Do your beliefs affect what you ought to believe? On each of these counts, the intuitive answer is ‘‘yes’’. And so each of these questions leaves something for the moral philosopher or the epistemologist to investigate. On each count, it seems that what we all know, is that (Account) you ought, if p, to do A. But on each count, the Narrow-scope reading of the ‘‘ought’’ in this claim yields unintuitive consequences. This entry is composed of three sections. In §1, we survey debates about what structural rationality is, including the emergence of the concept in the contemporary literature, its key characteristics, its relationship to substantive rationality, its paradigm instances, and the questions of whether these instances are unified and, if so, how. In §2, we turn to the debate about structural requirements of rationality – including controversies about whether they are “wide-scope” or “narrow-scope”, synchronic or diachronic, and whether they govern processes (...) or states; as well as examining various forms of skepticism about structural requirements of rationality. In §3, we turn to the debate about the normative significance of structural rationality, surveying central challenges for the view that structural rationality is normatively significant and the theoretical options that arise in light of these challenges. Argues for a "cognitivist" account of the instrumental principle, on which it is the application of theoretical reason to the beliefs that figure in our intentions. This doctrine is put to work in solving a puzzle about instrumental reason that plagues alternative views.

It is a truism that we ought to be rational. Despite this, it has become popular to think that it is not the case that we ought to be rational. In this paper I argue for a view about rationality—the view that what one is rationally required to do is determined by the normative reasons one possesses—by showing that it can vindicate that one ought to be rational. I do this by showing that it is independently very plausible that what (...) one ought to do is determined by the normative reasons one possesses. This article gives an overview of some recent debates about the relationship between reasons and rational requirements of coherence - e.g. the requirements to be consistent in our beliefs and intentions, and to intend what we take to be the necessary means to our ends.

This paper advances a reductive semantics for ‘ought’ and a naturalistic theory of normativity. It gives a unified analysis of predictive, instrumental, and categorical uses of ‘ought’: the predictive ‘ought’ is basic, and is interpreted in terms of probability. Instrumental ‘oughts’ are analyzed as predictive ‘oughts’ occurring under an ‘in order that’ modifer (the end-relational theory). The theory is then extended to categorical uses of ‘ought’: it is argued that they are special rhetorical uses of the instrumental ‘ought’. Plausible conversational (...) principles explain how this end-relational ‘ought’ can perform the expressive functions of the moral ‘ought’. The notion of an ‘ought-simpliciter’ is also discussed. This article is an introduction to the recent debate about whether rationality is normative – that is, very roughly, about whether we should have attitudes which fit together in a coherent way. I begin by explaining an initial problem – the “detaching problem” – that arises on the assumption that we should have coherent attitudes. I then explain the prominent “wide-scope” solution to this problem, and some of the central objections to it. I end by considering the options that arise (...) if we reject the wide-scope solution. The Wide-Scope view of instrumental reason holds that you should not intend an end without also intending what you believe to be the necessary means. This, the Wide-Scoper claims, provides the best account of why failing to intend the believed means to your end is a rational failing. But Wide-Scopers have struggled to meet a simple Explanatory Challenge: why shouldn't you intend an end without intending the necessary means? What reason is there not to do so? In the first half (...) of this paper, I argue that the Wide-Scope view struggles to meet this challenge because it takes the principles of instrumental reason to have unlimited application—to apply to all agents, in all circumstances. I then go on to offer a new account of these principles. The new account is very much in the spirit of the Wide-Scope view, and shares its central advantages, but lacks its unlimited application. This view should, therefore, find the Explanatory Challenge more tractable. In the second half of the paper, I argue that this prediction is confirmed. If the requirements of instrumental reason apply only when a means is, or is believed to be, necessary for your end, then plausible independent claims, about reasons, rationality, and intentions, explain why failing to intend the necessary means to your ends is a rational failing. According to the objection from positive duties, Kant's Formula of Universal Law is flawed because it cannot be used to derive any affirmative moral requirements. This paper offers a response to that objection and proposes a novel way to derive positive duties from Kant's formula. The Formula of Universal Law yields positive duties to adopt our own perfection and others’ happiness as ends because we could not rationally fail to will those ends as universal ends.

Offers a conciliatory solution to one of the central contemporary debates in the theory of rationality, the debate about the proper formulation of rational requirements. Introduces a novel conception of the “symmetry problem” for wide scope rational requirements, and sketches a theory of rational commitment as a response.

This paper considers the formulation of the moral requirement against hypocrisy, paying particular attention to the logical scope of ‘requires’ in that formulation. The paper argues (i) that we should prefer a wide-scope formulation to a narrow-scope formulation, and (ii) this result has some advantages for our normative theorizing about hypocrisy – in particular, it allows us to resist several of Daniela Dover’s (2019) recent arguments against the anti-hypocrisy requirement.

Some arguments include imperative clauses. For example: ‘Buy me a drink; you can’t buy me that drink unless you go to the bar; so, go to the bar!’ How should we build a logic that predicts which of these arguments are good? Because imperatives aren’t truth apt and so don’t stand in relations of truth preservation, this technical question gives rise to a foundational one: What would be the subject matter of this logic? I argue that declaratives are used to (...) produce beliefs, imperatives are used to produce intentions, and beliefs and intentions are subject to rational requirements. An argument will strike us as valid when anyone whose mental state satisfies the premises is rationally required to satisfy the conclusion. For example, the above argument reflects the principle that it is irrational not to intend what one takes to be the necessary means to one’s intended ends. I argue that all intuitively good patterns of imperative inference can be explained using off-the-shelf formulations of our rational requirements. I then develop a formal-semantic theory embodying this view that predicts a range of data, including free-choice effects and Ross’s paradox. The resulting theory shows one way that our aspirations to rational agency can be discerned in the patterns of our speech, and is a case study in how the philosophy of language and the philosophy of action can be mutually illuminating. According to the standard view, Kant held that hypothetical imperatives are universally binding edicts with disjunctive objects: take-the-means-or-don't-have-the-end. But Kant thought otherwise. He held that they are edicts binding only on some - those who have an end.

Some intuitive normative principles raise vexing 'detaching problems' by their failure to license modus ponens. I examine three such principles (a self-reliance principle and two different instrumental principles) and recent stategies employed to resolve their detaching problems. I show that solving these problems necessitates postulating an indefinitely large number of senses for 'ought'. The semantics for 'ought' that is standard in linguistics offers a unifying strategy for solving these problems, but I argue that an alternative approach combining an end-relational theory (...) of normativity with a comparative probabilistic semantics for 'ought' provides a more satisfactory solution. Instrumental rationality prohibits one from being in the following state: intending to pass a test, not intending to study, and believing one must intend to study if one is to pass. One could escape from this incoherent state in three ways: by intending to study, by not intending to pass, or by giving up one’s instrumental belief. However, not all of these ways of proceeding seem equally rational: giving up one’s instrumental belief seems less rational than giving up an end, (...) which itself seems less rational than intending the means. I consider whether, as some philosophers allege, these “asymmetries” pose a problem for the wide-scope formulation of instrumental rationality. I argue that they do not. I also present an argument in favor of the wide-scope formulation. The arguments employed here in defense of the wide-scope formulation of instrumental rationality can also be employed in defense of the wide-scope formulations of other rational requirements. If there is pragmatic encroachment in epistemology, whether a person knows that p can vary with normative facts about her actions—including facts that do not bear on the truth or likelihood of p. This paper raises an underappreciated question for defenders of pragmatic encroachment: which of the many norms on action are distinctively connected to knowledge? To the extent that contemporary defenders of pragmatic encroachment address this question, they do so by citing norms of ‘practical rationality.’ I show that this (...) approach can only be made to work on the assumption that all immorality involves some form of incoherence. I then suggest a pluralist strategy for pragmatic encroachers who seek to answer my question without making this heavyweight metaethical assumption: they should agree that multiple distinct norms on action play a difference-making role in epistemology. I close the paper by sketching three ways in which pragmatic encroachers might pursue this strategy. (shrink)

Many philosophers think that requirements of rationality are “wide-scope”. That is to say: they are requirements to satisfy some material conditional, such that one counts as satisfying the requirement iff one either makes the conditional’s antecedent false or makes its consequent true. These contrast with narrow-scope requirements, where the requirement takes scope only over the consequent of the conditional. Many of the philosophers who have preferred wide-scope requirements to narrow-scope requirements have also endorsed a corresponding semantic claim, namely that ordinary (...) talk about rationality, despite appearances to the contrary, expresses wide-scope claims. In doing so, they seek to avoid attributing massive error to ordinary speakers. However, it is becoming increasingly clear that the wide-scope semantics inadequately captures the meaning of ordinary talk about rationality. It seems, then, that we are left with a dilemma: either give up the view that requirements of rationality are wide-scope, or accept an implausible semantics for ordinary talk about rationality, or attribute massive error to speakers. In this paper, I argue that this dilemma is only apparent, since we can appeal to a standard kind of contextualist semantics for modals to explain why narrow-scope talk comes out true in virtue of the wide-scope requirements. My view, then, combines wide-scoping about the explanatorily fundamental requirements of rationality with a contextualist variant of a narrow-scope semantics. I argue that this view gives us the best of both worlds, as well as solving related puzzles and challenges for the extant views in the literature. (shrink)

Can we employ the property of rationality in establishing what rationality requires? According to a central and formal thesis of John Broome’s work on rational requirements, the answer is ‘no’ – at least if we expect a precise answer. In particular, Broome argues that (i) the property of full rationality (i.e. whether or not you are fully rational) is independent of whether we formulate conditional requirements of rationality as having a wide or a narrow logical scope. That is, (ii) by (...) replacing a wide-scope requirement with a corresponding narrow-scope requirement (or vice versa), we do not alter the situations in which a person is fully rational. As a consequence, (iii) the property of full rationality is unable to guide us in determining whether a rational requirement has a wide or a narrow logical scope. We cannot resolve the wide/narrow scope debate by appealing to a theory of fully rational attitudes. This paper argues that (i), (ii) and (iii) are incorrect. Replacing a wide- with a corresponding narrow-scope requirement (or vice versa) can alter the set of circumstances in which a person is fully rational. The property of full rationality is therefore not independent of whether we formulate conditional requirements of rationality as having a wide or a narrow logical scope. As a consequence, the property of full rationality can guide us in determining what rationality requires – even in cases where we expect a precise answer. (shrink)

Should you reduce your energy consumption? Tragically enough, it may be better for you, and for everyone involved, to refrain from doing so even if you care about the climate. Given this tragedy, why cooperate? This paper defends the view that not cooperating is morally problematic because it is not universalizable (in a Kantian sense). That is, I will argue that we have universalizability-based reasons to cooperate as long as we have a preference for ‘collective success’ (e.g. a sustainable planet). (...) The problem is that defectors let others fix the problem for them, and in this way make an unfair exception of themselves. Moreover, even when selected agents might not share this preference, they still have to cooperate for the sake of others. (shrink)

Some of the opponents of desire-based views of normativity seek to undermine them by arguing that even the existence of instrumental normativity (reasons to pursue the means to your ends) entails the existence of a desire-independent rational norm, the instrumental norm. Once we grant the existence of one such norm, there seems to be no principled reason for not allowing others. I clarify this alleged norm, identifying two criteria that any satisfactory candidate must meet: reasonable expectation and possible violation. Some (...) interpretations meet the first criterion and others meet the second, but there are no interpretations that meet both. After surveying the interpretations of Sidgwick, Hampton, and Korsgaard, I suggest that there is no instrumental norm of reason. The final section offers an alternative, desire-based account of instrumental normativity, on which individual normative requirements to pursue means derives from each individual desire for an end. Abstract:Recently, the idea that every hypothetical imperative must somehow be ‘backed up’ by a prior categorical imperative has gained a certain influence among Kant interpreters and ethicists influenced by Kant. Since instrumentalism is the position that holds that hypothetical imperatives can by themselves and without the aid of categorical imperatives explain all valid forms of practical reasoning, the influential idea amounts to a rejection of instrumentalism as internally incoherent. This paper argues against this prevailing view both as an interpretation of (...) Kant and as philosophical understanding of practical reason. In particular, it will be argued that many of the arguments that claim to show that hypothetical imperatives must be backed up by categorical imperatives mistakenly assume that the form of practical reasoning must itself occur as a premise within the reasoning. An alternative to this assumption will be offered. I will conclude that while instrumentalism may well be false, there is no reason to believe it is incoherent. (shrink)

:A good deal of contemporary moral nonconsequentialism assumes that agents have perfect knowledge about the various features and consequences of their options. This assumption is unrealistic. More often than not, moral agents can only assess with a certain degree of probability the factual circumstances that are morally relevant for their decision making. My aim in this essay is to discuss the problem of moral decisions under risk from the point of view of nonconsequentialism. Basically, I analyze how objective moral principles (...) can be transformed into subjective, decisional prescriptions, and argue that the standard nonconsequentialist approach to moral decision making, which focuses on probability thresholds, is wrong. In accordance with the fundamental postulates of nonconsequentialism, I seek to solve the problem of risk in moral choice by proposing a theory about the marginal moral value of various options. Actions can vary along various dimensions, and each of these dimensions can offer a different moral value function. Nonconsequentialist marginalism can level the playing field with consequentialism. Whereas consequentialism can simply borrow the notion of expected utility from economics, nonconsequentialism must introduce the notion of expectational obligation to formulate a general principle of moral choice under risk. I finally suggest that further empirical work is needed to delineate the shape of various moral value functions that are critical for applying the general principle of moral decision making under risk to well-known cases. Many commentators hold that in addition to the categorical imperative of morality, Kant also posits an objective law of non-moral practical rationality, 'the' Hypothetical Imperative. On this view, the appeal to the Hypothetical Imperative increases the dialectical options that Kantians have vis-a-vis Humean skepticism about the authority of reason, and it allows for a systematic explanation of the possibility of non-moral weakness of will. I argue that despite its appeal, this interpretation cannot be sustained: for Kant the only objective, universally (...) valid a priori principle of practical reason that governs transcendentally free agents is the moral law. All non-moral practical rules are mere “precepts” that lack genuine objectivity, certainty, and intersubjective validity. I suggest that for Kant the rejection of the possibility of non-moral practical laws plays an important part in his argument for the supreme rational authority of moral norms over prudential precepts of happiness. Recently, Christine Bratu and Mortiz Dittmeyer have argued that Christine Korsgaard’s constitutive project fails to establish the normativity of practical principles because it fails to show why a principle’s being constitutive of a practice shows that one ought to conform to that principle. They argue that in many cases a principle’s being constitutive of a practice has no bearing on whether one ought to conform to it. In this paper I argue that Bratu and Dittmeyer’s argument fails in three important (...) respects. First, they fail to recognize the ways in which Korsgaard’s neo-Kantian view departs from more orthodox Kantian views. Second, they fail to recognize the respect in which Korsgaard’s view is a version of moral rationalism. Third, they overlook an important scope ambiguity in an important premise of their argument. A sensible way of resolving this ambiguity gives the constitutivist a reasonable response. (shrink)

In this paper, I will develop a set of boulesic-doxastic tableau systems and prove that they are sound and complete. Boulesic-doxastic logic consists of two main parts: a boulesic part and a doxastic part. By ‘boulesic logic’ I mean ‘the logic of the will’, and by ‘doxastic logic’ I mean ‘the logic of belief’. The first part deals with ‘boulesic’ concepts, expressions, sentences, arguments and theorems. I will concentrate on two types of boulesic expression: ‘individual x wants it to be (...) the case that’ and ‘individual x accepts that it is the case that’. The second part deals with ‘doxastic’ concepts, expressions, sentences, arguments and theorems. I will concentrate on two types of doxastic expression: ‘individual x believes that’ and ‘it is imaginable to individual x that’. Boulesic-doxastic logic investigates how these concepts are related to each other. Boulesic logic is a new kind of logic. Doxastic logic has been around for a while, but the approach to this branch of logic in this paper is new. Each system is combined with modal logic with two kinds of modal operators for historical and absolute necessity and predicate logic with necessary identity and ‘possibilist’ quantifiers. I use a kind of possible world semantics to describe the systems semantically. I also sketch out how our basic language can be extended with propositional quantifiers. This chapter examines an evidentialist ethics of belief, and W. K. Clifford’s proposal in particular. It argues that regardless of how one understands the notion of evidence, it is implausible that we could have a moral obligation to refrain from believing something whenever we lack sufficient evidence. Alternatively, this chapter argues that there are wide-scope conditional requirements on beliefs but that these requirements can be met without having sufficient evidence for the belief in question. It then argues that we are (...) epistemically, though not morally, required to form epistemically valuable beliefs. However, these beliefs, too, need not be beliefs for which we have sufficient evidence—epistemically good beliefs need not be based on sufficient evidence. (shrink)

This discussion adjudicates a dispute between Larry Laudan and Gerald Doppelt over the nature of methodological rules. Laudan holds that all methodological rules are hypothetical imperatives, while Doppelt argues that a subset of those rules, basic methodological standards, are not hypothetical imperatives. I argue that neither writer offers a satisfactory account of methodological rules and that their reliance on the hypothetical/nonhypothetical distinction does not advance our understanding of methodological rules. Die Analogie zwischen evidenzbasierter Medizin und „evidenzbasierter Ethik“ soll in diesem Beitrag kritisch diskutiert und dabei gezeigt werden, dass der Ausdruck „evidenzbasierte Ethik“ irreführend ist. Zentraler Ausgangspunkt der Kritik ist die unterschiedliche Bedeutung, die empirische Informationen für das medizinisch-klinische Urteil zum einen und das ethische Urteil in der Medizin zum anderen haben. Im medizinisch-klinischen Urteil können mit (...) Hilfe empirischer Informationen hypothetische Handlungsnormen generiert werden, welche auf den der Medizin inhärenten Zwecksetzungen basieren. Bei Fragen der Ethik in der Medizin hingegen sind die Handlungsziele selbst Gegenstand des Urteils; diese aber können allein aus empirischem Wissen heraus nicht zureichend bestimmt werden. ZusammenfassungIm Zuge des „empirical turn“ der Medizin- und Bioethik ist von verschiedenen Autoren in den vergangenen Jahren die Idee einer „evidenzbasierten Ethik“ diskutiert worden. Die Analogie zwischen evidenzbasierter Medizin und „evidenzbasierter Ethik“ soll in diesem Beitrag kritisch diskutiert und dabei gezeigt werden, dass der Ausdruck „evidenzbasierte Ethik“ irreführend ist. Zentraler Ausgangspunkt der Kritik ist die unterschiedliche Bedeutung, die empirische Informationen für das medizinisch-klinische Urteil zum einen und das ethische Urteil in der Medizin zum anderen haben. Im medizinisch-klinischen Urteil können mit (...) Hilfe empirischer Informationen hypothetische Handlungsnormen generiert werden, welche auf den der Medizin inhärenten Zwecksetzungen basieren. Bei Fragen der Ethik in der Medizin hingegen sind die Handlungsziele selbst Gegenstand des Urteils; diese aber können allein aus empirischem Wissen heraus nicht zureichend bestimmt werden. The claim that epistemic oughts stem from the “role” of believer is widely discussed in the epistemological discourse. This claim seems to stem from the common view that, in some sense, epistemic norms derive from what it is to be a believer. Against this view, I argue that there is no such thing as a “role” of believer. But there is a role of knower, and this is the role to which some epistemic norms—epistemic role oughts—are attached. Once we conceive (...) of epistemic role oughts as attaching to the role of knower (and not the “role” of believer) we can better understand the nature of epistemic obligation and doxastic control. In advancing a new epistemic role ought approach that recognizes knowers as the subjects of epistemic role oughts, I explain why many epistemic oughts—epistemic role oughts—have normative force and presuppose voluntary control. Normative concepts have a special taste, which many consider to be proof that they cannot be reductively analyzed into entirely nonnormative components. This paper demonstrates that at least some intuitively normative concepts can be reductively analyzed. I focus on so-called ‘hypothetical imperatives’ or ‘anankastic conditionals’, and show that the availability of normative readings of conditionals is determined by features of grammar, specifically features of tense. Properly interpreted, these grammatical features suggest that these deontic modals are analyzable in terms of conditional (...) necessity with a certain temporal structure. (shrink)

Kant clearly endorses some version of the ‘old formula of the schools’, according to which all volition is sub ratione boni. There has been a debate whether he holds this only for morally good actions. I argue that a closer look at the distinction between the good and the agreeable does not support this conclusion. Considering Kant’s account of the detrimental and the correct use of this thesis, I argue that rational beings always will sub ratione boni, even when they (...) act immorally, because they act on principles. I argue that Kant’s accounts of self-love and self-conceit support this view. (shrink)

I defend the claim that Kant held a wide-scope view of hypothetical imperatives, against objections raised by Mark Schroeder [2005]. There is an important objection, now commonly known as the ‘bootstrapping’ problem, to the alternative, narrow-scope, view which Schroeder attributes to Kant. Schroeder argues that Kant has sufficient resources to reply to the bootstrapping problem, and claims that this leaves us with no good reason to attribute to Kant the wide-scope view. I show that Schroeder's Kantian reply to the bootstrapping (...) problem cannot fully answer it. Schroeder also offers three main textual arguments for attributing to Kant the narrow-scope view: from Kant's claim that the moral imperative is unique in virtue of its categoricity, from Kant's distinction between ‘problematic’ and ‘assertoric’ hypothetical imperatives, and from Kant's conception of analyticity together with his claim that hypothetical imperatives are analytic. The categorical imperative inherent in Kant’s ethics has had indubitable historical influence on societies worldwide whether in the form of laws, democracy or public deliberation. The Toronto Van Attack of 2018 and its subsequent legal trial is a case example that shows how the categorical imperative can be applied to assist in understanding the reasoning for the case’s guilty verdict. This paper will convey the applicability of the categorical imperative for examining criminal case studies by closing the gap between ethical (...) theory and practice. Such closure will be shown to assist in understanding why a perpetrator of a crime can be found guilty of following a hypothetical imperative to base their actions. The rationale for the verdict in this case will be shown to be based on the perpetrator’s responsibility in the form of maintaining autonomy despite having an autism diagnosis. The perpetrator will be shown to have acted on an irrational will and yet was treated in the legal sense as a rational individual. Such rationality was maintained despite complications with their autonomy in the form of relativism and ethical solipsism. (shrink)

In this paper, I analyze the least discussed of Kant’s four examples of duty in the first section of his Groundwork to the Metaphysics of Morals: the gout sufferer who is no longer motivated by natural interest in his long-term wellbeing, and is thus in a unique position to secure his own happiness from duty. This example has long been wrongly interpreted as a failure of prudential rationality, as recently illustrated by Allen Wood’s reading of that example. -/- I argue (...) that the gout sufferer example is meant to illustrate a violation of a duty to the self and should not be confused with mere prudential failure. The example also helps us understand the line between prudential reason and duties to the self. I show that given Kant’s conception of happiness as an indeterminate concept and his hedonistic account of non-moral ends, it can sometimes be more rational from the perspective of empirical practical reason to choose short term over long-term wellbeing when long term wellbeing seems uncertain in regard to expected pleasure. In other words: Kant’s account of empirical practical reason does not rule out as irrational choosing short term pleasure at the expense of long-term wellbeing. However, this is precisely why the gout sufferer’s long-term happiness can be directly morally required and so becomes the content of a duty to the self. To explain how there can be a direct duty to promote our own happiness under certain circumstances I also elucidate Kant’s distinction between direct and indirect duties. (shrink)

Since Aristotle it has been common among philosophers to distinguish between two fundamental types of reasoning, theoretical and practical. We do not only want to work out what is the case but also what we ought to do. This article offers a logical analysis of instrumental reasoning, which is the paradigm of practical reasoning. In the first section I discuss the major types of instrumental reasoning and show why the accounts of most authors are defective. On the basis of this (...) discussion, I demonstrate in the second section that different types of normative conclusions are derivable from instrumental arguments and I show that it is an argument’s logical structure that determines what type of conclusion this is. I argue that rationalists need not adopt Kant’s method for determining what one has reason to do, where by “Kant’s method” I mean the view that normative guidance comes only from directives imposed on the agent by the agent’s own will. I focus on Kant’s argument for “imperatives of skill,” one sort of hypothetical imperative. I argue, against Korsgaard, that Kant’s argument is neither better nor significantly different than the sort of argument non-Kantian rationalists offer. I close by arguing that (...) Korsgaard is wrong to think that her question “why should I care about performing the means to my ends?” is a serious worry. (shrink)

Kant hat mit seiner universalistischen, formalistischen und kognitivistischen Konzeption moralisch-praktischer Gründe in Gegenüberstellung zu seiner instrumentalistischen Konzeption nicht-moralisch-praktischer Gründe eine Begrifflichkeit geschaffen, die es erlaubt, handlungsleitende Überzeugungen hinsichtlich ihres Geltungsanspruchs und ihrer Verbindlichkeit zu differenzieren. Von einem ‚Sollen‘ spricht Kant in beiden Fällen. Nicht nur der kategorische Imperativ, der unbedingt gebietet, „ich soll niemals anders verfahren als so, daß ich auch wollen könne, meine Maxime solle ein allgemeines Gesetz werden“ , sondern auch hypothetische Imperative, die bedingt gebieten, „ich soll (...) etwas thun, darum weil ich etwas anderes will“, nehmen bei Kant die normative Form eines ‚Sollens‘ an. In beiden Fällen ergehen also Forderungen an die Vernunft, doch es ist alles andere als klar, in welcher Beziehung diese Sollensformen zueinander stehen. Bestünde gar keine solche Beziehung, so träte praktische Vernunft im Plural auf – wohlgemerkt in einer einzigen Person, welcher sich der Sinn beider Imperativformen erschlossen hat. Da eine solche Form von Schizophrenie der Willensbestimmung nicht der Kantischen Vorstellung von praktischer Vernunft entspricht, stellt sich die Frage nach der Einheit von bedingtem und unbedingtem Sollen. Are moral judgements objective? This is a question of great complexity, and in what follows I shall try to cast some light on what it means, and on how it might be answered.

Kant famously distinguishes between the categorical imperative (CI) and hypothetical imperatives (HIs), which are instrumental norms. On the standard reading, Kant subscribes to the of HIs, which takes HIs to be consistency requirements that bind agents in exactly the same way whether or not agents are subject to CI and whether or not they conform their choices to CI. I argue that this reading cannot be squared with Kant's account of an agent's disposition, in particular his claim that cognition of (...) CI is a necessary condition of willing a maxim. I further argue that Kant could not accept an account of HIs as consistency requirements. Finally, I outline Kant's conception of HIs as non-disjunctive requirements that arise when and only when agents will permissible ends. This account can help recapture Kant's conception of the unity of rational norms. (shrink)

Although Kant's attempts in the Groundwork of the Metaphysics of Morals to derive statements of specific duties from the categorical imperative have received much attention, there is still disagreement over the strategies of particular derivations, the status of the auxiliary assumptions employed therein, and the principles at work in the derivations generally. Yet an understanding of these matters is indispensable for a proper understanding of the Groundwork and bears on a much wider class of ethical theories as well. My aim (...) here is to provide an account of the derivations and their auxiliary premises that explains both the strategy behind the derivations generally and the details of Kant's specific examples. In particular, I shall argue that the widespread view that the premises of the derivations are empirical is mistaken and that their conclusions are thus more general than is often supposed. (shrink)
