What is the connection between action that is caused by inauthentic antecedent springs of action, such as surreptitiously engineered-in desires and beliefs, and moral obligation? If, for example, an agent performs an action that derives from such antecedent springs can it be that the agent is not obligated to perform this action owing to the inauthenticity of its causal antecedents? I defend an affirmative response, assuming that we morally ought to bring about the states of affairs that occur in the (...) intrinsically best worlds accessible to us and that a version of attitudinal hedonism is the axiology for ranking worlds. In a recent article in this journal, Rolf Ahlzén treats a moral problem related to physician-assisted suicide and the notion of authenticity. The problem is whether considerations of a patient’s “true self” should be included in judgments of PAS. In this short commentary, it is argued that Ahlzén neglects to attend to central contributions to the philosophy of authenticity, provides an internally inconsistent theory thereof, and conflates crucial distinctions in the debate.

La ambigüedad de esta expresión ha hecho que algunos autores argumenten que Kant no deduce la ley moral satisfactoriamente ni aclara cómo llegamos a ser conscientes de ella. Sin embargo estos críticos olvidan en sus análisis un aspecto relevante de la filosofía moral kantiana y que (...) es de gran relevancia en los estudios contemporáneos de la filosofía de la acción: el carácter autoconstitutivo del yo o del sujeto racional y su papel en la fundamentación de la moralidad. Sostengo que el Faktum de la razón debe entenderse fundamentalmente como un acto autoconstitutivo.In § 7 of the Critique of Practical Reason Kant presents his first definition of the universal law of morality - called the Categorical Imperative. In the same place, he affirms that being conscious of the law of morality is a Faktum of reason. The ambiguity of this statement has prompted some authors to argue that Kant does not deduce the moral law satisfactorily nor does he clarify how we become conscious of it. Nevertheless, they all forget in their analysis a relevant aspect of Kantian moral philosophy that turns out to be of great importance in contemporary studies of the philosophy of action - the self-constituting character of the rational subject and the role it plays within the foundation of morality. It has been argued that all compatibilist accounts of free action and moral responsibility succumb to the manipulation problem: evil neurologists or their like may manipulate an agent, in the absence of the agent's awareness of being so manipulated, so that when the agent performs an action, requirements of the compatibilist contender at issue are satisfied. But intuitively, the agent is not responsible for the action. We propose that the manipulation problem be construed as a problem of deviance. In troubling (...) cases of manipulation, psychological elements such as desires and beliefs, among other things, are acquired via causal routes that are deviant relative to causal routes deemed normal or baseline. We develop and defend rudiments of a baseline that is acceptable independently of whether one has compatibilist or incompatibilist leanings. (shrink)

Ernest Sosa’s Judgment and Agency marks an important change from his earlier work in epistemology. While belief was at the center of his earlier approach to epistemological issues, a far more sophisticated mental state, judgment, plays the central role here. This paper examines the significance of this change in focus, and argues that there is reason to favor the earlier belief-centered approach over this new judgment-centered account.

The extent to which English law remedies injury to autonomy as a stand-alone actionable damage in negligence is disputed. In this article I argue that the remedy available is not only partial and inconsistent but also gendered and discriminatory against women. I first situate the argument within the broader feminist critique of tort law as failing to appropriately remedy gendered harms, and of law more broadly as undervaluing women’s interest in reproductive autonomy. I then show by reference to English remedies (...) law’s first principles how imposed motherhood cases—Rees v Darlington and its predecessor McFarlane v Tayside Health Board—result in gender injustice when compared with other autonomy cases such as Chester v Afshar and Yearworth v North Bristol NHS Trust: A minor gender-neutral ITA is better remedied than the significant gendered harm of imposing motherhood on the claimant; men’s reproductive autonomy is protected to a greater extent than women’s; women’s reproductive autonomy is protected by an exceptional, derisory award. Worst of all, courts refuse to recognise imposed motherhood as detriment; and the deemed, mansplained, nonpecuniary joys of motherhood are used to offset pecuniary upkeep costs, forcing the claimant into a position she sought to avoid and thus further undermining her autonomy. The recent Singaporean case ACB v Thomson Medical Pte Ltd, awarding compensation for undermining the claimant’s genetic affinity in an IVF wrong-sperm-mix-up demonstrates some improvement in comparison to English law, and some shared gender injustices in the context of reproductive autonomy. ACB’s analysis is oblivious to the nature of reproductive autonomy harm as gendered; and prioritises the father’s interest in having genetic affinity with the baby over a woman’s interest in not having motherhood imposed upon her. ABSTRACT Choice theorists such as George Ainslie and Gene Heyman argue that the drug-seeking behaviour of addicts is best understood in the same terms that explain everyday choices. Everyday choices, they claim, aim to maximise the reward from available incentives. Continuing drug-use is, therefore, what addicts most want given the incentives they are aware of but they will change their behaviour if and when better incentives become available. This model might explain many typical cases of addiction, but there are hard (...) cases that pose a problem. In these hard cases the addicted individual does not cease using drugs in the face of consequences that are so adverse it is implausible that they are unaware of more rewarding paths of action. These cases force the choice theorist into a dilemma: either these addicts? drug use does not count as action and so is best described by a neurobiological model, or reference to ?reward? in these cases means merely ?motivated? and so provides no explanatory power. We propose a different model of motivation that takes self-conception into account. We show how that can better explain the hard cases of addiction and also inform our understanding of recovery and self-control. (shrink)

The article develops the thesis that spiritual objectivity constitutes an independent class of phenomena besides the physical and the mental. The concept of spiritual objectivity presents a solution for the mediation between the bodily and the conscious by further developing the insight of critical monism that individual action can neither be subsumed under the phenomena of the bodily outer world nor under the phenomena of the mental inner world. Referring to Gottlob Frege's thesis that what distinguishes a thought from other (...) phenomena is its capability of being true, the article develops the argument that the thought in its spiritual objectivity should be distinguished from the psychic inner world of ideas as well as from the physical exterior world of material objects. The possibility of rational recognition is dependent upon this genuinely spiritual mediation of inner and outer world, and its objective truth must be distinguished from the constitutive subjectivity of psychic phenomena. This specified concept of the spiritual is not intended to enlarge the substance dualism between the bodily and the mental once again but makes it possible to determine the in itself differentiated unity of the bodily and the mental, namely as spiritual unity of body and mind. ABSTRACTThis article explores how Charles Taylor’s account of moral personhood and Luc Boltanski and Laurent Thévenot’s account of justificatory regimes can add breadth, depth, and specificity to discussions of ethical dilemmas in public relations. These frameworks are analyzed for their potential to make the following contributions to public relations ethics. First, they convey that there is more to ethics than choosing the right duties and actions. Second, they reveal the diversity of goods that people consider to be ethically worthy and (...) admirable, as well as the complex personal issues involved in ranking these goods. Third, they emphasize that these different goods often need to be articulated and evaluated in different ways. Last, they can either point toward new ways of resolving ethical dilemmas or show why such resolutions are not possible. (shrink)

In this review article I refer to some of the most relevant recent publications in the field of practical rationality, mainly drawing on two new anthologies by Wallace and Millgram that contain the principal arguments in the current debate, and on new books and articles by Bittner, Dancy, Nida-Rümelin and Raz. The purpose of the article is to offer an overview of the relevant positions in the current debate, to clarify the main arguments against the belief-desire model, and to situate (...) some of the problems - e.g. what counts as a reason - within the wider field of practical rationality as a whole - e.g. how to argue about practical reasoning from the point of view of our self-understanding as autonomous agents. Moral responsibility is centered on the idea that, given some conditions, people deserve blame or credit, punishment or reward. At least according to traditional readings, moral responsibility presupposes free will, understood as the ability to choose independently of previous events. The achievements of neuroscience in recent decades make a very good case for the hypothesis that the mind is a material entity, a subset of the electrochemical activity of the brain. However, if the mind is a material entity, then it (...) is subject to physical laws. According to some interpretations, this entails the affirmation of determinism and the denial of free will and moral responsibility. This article reviews some of those achievements and their likely impact on the attributions of moral responsibility. The first section presents evidence from lesion studies, imaging techniques and direct electrical stimulation of the brain and argues that the convergence of results from these methods supports the hypothesis that the mind is the activity of the brain. The next section concentrates on studies that are usually taken as directly threatening free will–Libet’s experiments and the apparent mental causation theory. The third section turns to the implications of these findings for moral responsibility, explaining determinism, epiphenomenalism, libertarianism, hard determinism and compatibilism. Finally, the last section defends that the requirement of free will as a precondition for moral responsibility should be replaced by the requirement of more naturalistic properties, such as behavioral flexibility, self-control and natural autonomy. The pair-bond model of human origin proposed by Lovejoy in his “Reexamining Human Origins in Light of Ardipithecus ramidus” combines fossil records with the unique sexual behavior of modern humans. This construct, however, seems to lack an emotionally important element. By connecting ovulatory crypsis with frontal copulation and face-to-face contact, the transition to the complexity and subtlety of human emotional life becomes more evident. Reproductive success and emotional representation are considered as two interacting levels in the phylogenetic scale. Thus, the (...) behavioral frame of sociobiology is extended to psychobiological phenomena and a bridge is built between natural sciences and philosophy. The paper considers the claim that quantum theories with a deterministic dynamics of objects in ordinary space-time, such as Bohmian mechanics, contradict the assumption that the measurement settings can be freely chosen in the EPR experiment. That assumption is one of the premises of Bell’s theorem. I first argue that only a premise to the effect that what determines the choice of the measurement settings is independent of what determines the past state of the measured system is needed for the (...) derivation of Bell’s theorem. Determinism as such does not undermine that independence . Only entanglement could do so. However, generic entanglement without collapse on the level of the universal wave-function can go together with effective wave-functions for subsystems of the universe, as in Bohmian mechanics. The paper argues that such effective wave-functions are sufficient for the mentioned independence premise to hold. (shrink)

If indeterminism is to be necessary for moral responsibility, we must show that it doesn’t preclude responsibility (the Luck Problem) and that it might enhance it (the Enhancement Problem). A ‘strong luck claim’ motivates the Luck Problem: if an agent’s choice is undetermined, then her mental life will be causally irrelevant to her choice, whichever way she decides. A ‘weak luck claim’ motivates the Enhancement Problem: if an agent’s choice is undetermined, then even if her mental life is causally relevant (...) to her choice, whichever way she decides, we cannot explain how she _settles_ her choice. Only the weak luck claim is plausible. However, its plausibility depends on our accepting that we could only settle our choices if they are settled by additional exercises of agency. If we instead understand the process of settling decisions in procedural terms, we can begin to sketch a solution to the Enhancement Problem. (shrink)

Proponents of modern Frankfurt-Style Counterexamples generally accept that we cannot construct successful FSCs in which there are no alternative possibilities present. But they maintain that we can construct successful FSCs in which there are no morally significant alternatives present and that such examples succeed in breaking any conceptual link between alternative possibilities and free will. I argue that it is not possible to construct an FSC that succeeds even in this weaker sense. In cases where any alternatives are clearly insignificant, (...) it does not appear at all obvious that the agent can be held responsible. Present popular FSCs include alternatives that are ambiguous in their significance, and when the examples are sharpened to remove this ambiguity, they lose their force. Moreover, the proponent of such examples faces a problem: We can easily construct scenarios in which any alternatives are obviously insignificant, and in such scenarios, we are not intuitively inclined to suppose the agent is responsible. The proponent of new FSCs must therefore distinguish any alternatives she includes from the sorts included in these scenarios. The difference must now be such that this helps to make it seem intuitively likely that the agent is responsible where the agent otherwise would not appear responsible, and these alternatives are irrelevant to any judgment about whether the agent is responsible. ZusammenfassungDie gegenwärtige Debatte um die normativen Grundlagen kritischer Gesellschaftstheorie weist eine große Bandbreite ethischer Positionen auf: vom ethischen Negativismus, der gänzlich auf einen positiven Kritik-Maßstab verzichtet, über Entfremdungs- und Resonanztheorien, die zumindest eine grobe Vorstellung des guten Lebens vermitteln wollen, bis hin zu deontologischen Ansätzen, die Gesellschaftskritik in intelligibler Freiheit begründet sehen. Der folgende Beitrag zeigt, dass diese drei Grundpositionen sich mit Problemen konfrontiert sehen, die der hegelsche Freiheitsbegriff zu lösen vermag.

Behavioural variant frontotemporal dementia (bvFTD) is characterized by an absence of obvious cognitive impairment and presence of symptoms such as disinhibition, social inappropriateness, personality changes, hyper-sexuality, and hyper-orality. Affected individuals do not feel concerned enough about their actions to be deterred from violating social norms, and their antisocial behaviours are most likely caused by the neurodegenerative processes in the frontal and anterior temporal lobes. BvFTD patients present a challenge for the traditional notion of autonomy and the medical and criminal justice (...) systems. Antisocial behaviour is often the earliest recognized manifestation of bvFTD. Given that the symptoms are not specific and that atrophy of the frontal lobes is only observable with structural neuroimaging in the later stages of the disease, it is hard to ascertain their autonomy. Recently proposed re-conceptualizations of autonomy (Dworkin’s, Jaworska’s, and Dubljević’s) can, however, be sufficiently redefined to provide explicit rules and offer nuanced guidance in such cases. A combination of notions of autonomy gives the most nuanced guidance with three modifications: 1) including socio-moral judgement in the notion of “normal cognitive competence,” 2) excluding in-principle un-endorsable ideals from the notion of “capacity to value,” and 3) redefining ideal-typical degrees of compulsion (mild, severe, and total). This paper develops three points in response to Habermas's ?The Language Game of Responsible Agency and the Problem of Free Will.? First, while Habermas nicely characterizes the appearance of freedom, he misconstrues its connections to deliberate agency, responsibility, and our justificatory practice. Second, Habermas's discussion largely overlooks grave conceptual challenges to our idea of freedom, challenges more fundamental than those posed by naturalism. Finally, a physicalist view of ourselves may be able to save as much of the appearance of freedom (...) as can the anti-physicalist naturalism that Habermas recommends. (shrink)

ABSTRACT This paper focuses on the issue of aborting abnormal fetuses from the standpoint of the prerogatives and obligations of parents. First, two intuitively‐based models of parenthood are developed. In the Trustee Model, parental authority is grounded in the obligation of parents to promote the interests of children, while the Artisan Model locates parental authority in the intrinsic value of parenthood as a mode of parental self‐expression. Reasons are given for believing that neither of these models, taken individually, contains a (...) complete or adequate picture of parenthood and that both have counterintuitive implications. Under the assumption that there is little hope of developing a master model for parenthood to supplant the two inadequate models, five principles are developed for determining how the two models should be applied in making moral decisions. These principles are then applied to five categories of abnormal fetuses. The conclusion is that abortions are justified in the first three categories (involving severe abnormalities), but not in the fifth category (involving only slight deformities). The fourth category requires parental discretion. Finally, a check on these conclusions is provided by comparing them with a parental action that would generally be considered impermissible, namely the decision of a Jehovah's Witness not to permit a blood transfusion for his or her child in a life‐threatening situation. Al examinar solo este aspecto, se omiten ciertos problemas secundarios, como la legitimidad de interpretar de manera actitudinal una doctrina asentada en el atomismo. ABSTRACT The paper offers a critical review of a recent interpretation of Epicurean hedonism, (...) according to which the latter could be understood as an attitudinal hedonism. Such reading implies certain internal tensions and neglects the fundamental meaning of Epicureanism as a theory of prudential well-being. By focusing exclusively on one aspect, that reading omits certain secondary issues, such as the legitimacy of an attitudinal interpretation of a doctrine grounded in atomism. (shrink)

An analysis of Mark Bevir's account of the role of language and tradition on the one hand, and the individual on the other in the generation of ideas, and proposal of an alternative account It endorses Bevir's project of finding a middle way between individualism and collectivism, but finds that Bevir exaggerates the role of the individual. It argues that human selves always remains dependent on language even to articulate their own intentions to themselves. Whilst they have a capacity to (...) create new linguistic expressions, this is always limited to the exploration of possibilities already latent in the language. However, no one is a mere recipient and conduit of a given language: everyone hands it on transformed by their unique appropriation of it. The antifoundationalist analyses of Wittgenstein, Newman Collingwood, and Neurath are invoked to argue that this state of affairs also applies to the individual's relation to the beliefs and values inherited traditionally: there is no possibility of a wholesale rejection of what is received; no individual can reject all received traditions, and erect an entire belief structure from scratch, but can only modify it on a piecemeal basis, so that received tradition always remains constitutive of the individual mind. It is also argued that human self-consciousness is always socially formed, and no person ever completely integrated, and stabilized. No one is ever therefore in a state of complete self-possession. One therefore must reject Bevir's claim that the historian of ideas must initially presume that individuals are sincere, conscious and rational in their expressed beliefs: ‘sincere’ self-consciousness is an ideal never fully achieved, and beliefs as to what constitutes ‘rationality’ are so varied that specific presumptions cannot be made. Article 12 of the UN Convention on the Rights of Persons with Disabilities guarantees persons with disabilities ‘the right to legal capacity on an equal basis with others in all aspects of life.’ In its General Comment on Article 12, the Committee on the Rights of Persons with Disabilities claims that this guarantee necessitates the abolition of the world's dominant approach to mental capacity law. According to this approach, when a person lacks the mental capacity to make a particular legal (...) decision at the material time, the state authorises a third-party to make it on her behalf. The Committee declares such substituted decision-making a violation of the Convention's guarantee of legal capacity on an equal basis, and therefore demands it be replaced by an allegedly non-discriminatory alternative called supported decision-making. This article argues that we should reject the Committee's demand in its current form, because the most influential version of the new approach to supported decision-making suffers from serious conceptual flaws that make it inferior to the mental capacity approach. However, I then argue that the Committee's demand stems from a legitimate ethical concern with respect and equality that ought to inform the CRPD's implementation process. (shrink)

The paper addresses the problem of authenticity from a point of view that diverges from the more usual social, political, or moral approaches, by focusing very explicitly on the internal psychological make-up of human agents in an attempt to identify the conditions that would enable us to use the colloquial phrase 'being true to ourselves' in a way that is philosophically tenable. First, it is argued that the most important and problematic condition is the requirement that agents can be the (...) source of normative constraints which they themselves should attempt to respect. In the main part of the paper an argument is developed against a more or less Humean interpretation of this crucial requirement, according to which agents can be the source of normative constraints because they have desires , and a more or less Kantian interpretation, according to which agents can be the source of normative constraints because they have the capacity to judge . The Humean account is unsatisfactory, because it fails to make sense of the normativity of the content of desires, and because it cannot account on its own for what makes a person's desires her own . The Kantian account is also unsatisfactory, because, although it can account for the difference between being true to someone else and being true to certain principles, it is unable to account for the difference between being true to oneself and being true to principles. In the final part I shall suggest a way out of this impasse by claiming that the intelligibility of the phenomenon of being true to oneself crucially depends on the, yet to be explored, possibility of developing an account of self-respect that involves both de se attitudes and the idea of ourselves being valuable entities. In recent years, several studies have advocated the need to expand the concept of patient autonomy beyond the capacity to deliberate and make decisions regarding a specific medical intervention or treatment (decision-making or decisional autonomy). Arguing along the same lines, this paper proposes a multidimensional concept of patient autonomy (decisional, executive, functional, informative and narrative) and argues that determining the specific aspect of autonomy affected is the first step towards protecting or promoting (and respecting) patient autonomy. These different manifestations of (...) autonomy are not mutually dependent; there may be patients who have problems in one dimension, while at the same time being fully autonomous in others. Nevertheless, a close interaction has been observed between the various dimensions and indeed, a phenomenological analysis shows that damage to or a reduction in one aspect of people’s capacity for self-government generally affects other aspects of their autonomy, which in turn disrupts their identity and the way in which they see themselves and are seen by others. In this paper, I shall examine some of these interactions and show how they may lie at the heart of the problem of poor treatment adherence (where adherence is defined as being the extent to which a patient’s behavior over time coincides with the recommendations made by and agreed with their health professional). One example given is that of psoriasis, a chronic skin disease with a very poor adherence record. In Spain, it is calculated that 85% of patients diagnosed with mild to moderate psoriasis fail to comply properly with their treatment, and figures from other parts of the world are similar. Although there are many possible causes for non-adherence among psoriasis patients, assessing their decisional, executive and narrative capacities and taking appropriate action based on the results may help increase adherence rates. Since conflicts of human rights can be translated into conflicts of values, this article looks into the sources and extension of value pluralism for a better understanding of the sort of conflicts of human rights that women face in multicultural contexts. Furthermore, a proper understanding of personal autonomy as a founding value underlying individual rights can contribute to an interpretation of women's human rights that takes account of both their untouchable core as well as their contextual meaning. As conflicts of (...) fundamental rights most often take place in a scenario of strong pluralism, the article considers cases of conflicts of rights in multicultural societies focusing on the overlapping values to be balanced. Religious freedom, education, neutrality, equality or toleration are some of the issues to be addressed: all of these are important and should be evaluated considering their further implications for women as well as for the other individuals involved. According to the dominant tradition in Christianity and many other religions, human beings are both knowers and actors: beings with conscious beliefs about the world who sometimes act intentionally guided by these beliefs. According to philosopher of mind Robert Cummins the “received view” among philosophers of mind is epiphenomenalism, according to which mental causation does not exist: neural events are the underlying causes of both behavior and belief which explains the correlation (not causation) between belief and behavior. Beliefs do not, (...) in virtue of their semantic content, enter the causal chain leading to action, beliefs are always the endpoint of a causal chain. If that is true the theological anthropology of many religious traditions is false. JP Moreland draws attention to two different ways of doing metaphysics: serious metaphysics and shopping-list metaphysics. The difference is that the former involves not only the attempt to describe the phenomena one encounter, it also involves the attempt of locating them, that is explaining how the phenomena is possible and came to be given the constraints of a certain worldview. For a physicalist these constraints include the atomic theory of matter and the theories of physical, chemical and biological evolution. Mental properties are challenging phenomena to locate within a physicalist worldview, and some physicalists involved in “serious metaphysics” have therefore eliminated them from their worldview. Most however accept them, advocating “non-reductive physicalism” according to which mental properties supervene on physical processes. Even if one allow mental properties to supervene on physical processes, the problem of mental causation remains. If mental properties are irreducible to and therefore distinct from physical properties, as the non-reductive physicalists claim, they cannot exert causal powers if one accepts the causal closure of the physical domain – which one must, if one is a “serious physicalist” according to physicalist philosopher of mind Jaegwon Kim. Alvin Plantinga, in his Evolutionary Argument against Naturalism, shows that if mental properties, such as the propositional content of beliefs, are causally inefficacious, then evolution has not been selecting cognitive faculties that are reliable, in the sense of being conducive to true beliefs. If the content of our beliefs does not affect our behavior, the content of our belief is irrelevant from an evolutionary standpoint, and so the content-producing part of our cognitive faculties are irrelevant from an evolutionary standpoint. The “reliability” – truth-conduciveness – of our cognitive faculties can therefore not be explained by evolution, and therefore not located within the physicalist worldview. The only way in which the reliability of our cognitive faculties can be located is if propositional content is relevant for behavior. If we however eliminate or deny the reliability of our cognitive faculties, then we have abandoned any chance of making a rational case for our position, as that would presuppose the reliability that we are denying. But if propositional content is causally efficacious, then that either – if we are non-reductive physicalists and mental properties are taken to be irreducible to physical properties – implies that the causal closure of the physical domain is false or - if we are reductive physicalists and not eliminativists regarding mental properties - it shows that matter qua matter can govern itself by rational argumentation, in which we have a pan-/localpsychistic view of matter. Either way, we have essentially abandoned physicalism in the process of locating the reliability of our cognitive faculties within a physicalist worldview. We have also affirmed the theological anthropology of Christianity, in so far as the capacity for knowledge and rational action is concerned. In his early work, Frankfurt conceives of the will as a set of hierarchically organized desires. I argue that the hierarchical model fails to provide an adequate account of free will because it does not render the will determinate. In Frankfurt’s later work, he contends that love establishes the boundaries of the will by giving rise to a volitional necessity. I take this to suggest that the notion of love is introduced, in part, to eliminate the problematic indeterminacy implied by (...) the hierarchical model. However, I argue that the necessities of love may be understood in two importantly different ways, and on either interpretation of Frankfurt’s considered view, love does not provide the resources to account for the phenomenon of betrayal of love. I conclude that the introduction of love does not render the will determinate, and therefore fails to resolve a problem that beset the hierarchical model of the will. (shrink)

Ključna pretpostavka našeg rada jest da je umjetna inteligencija načelno moguća i da se realizira na računalnim arhitekturama u bitnome nalik današnjim. Uz taj je uvjet moguće dati definiciju slobode koja je pomirljiva s determiniranim izračunom, uz pomoć načelne nedokučivosti inteligentnog procesa. Ovo se temeljem funkcionalizma može translatirati u filozofiju uma. Pitanje je li moguće naš argument adaptirati za drugačije teorije filozofije uma ostavljamo otvorenim.

This thesis focuses on what I call the question of exclusion. This question, I argue, is one that poses serious challenges to social contract approaches to justice and political legitimacy. In an intuitive way, the exclusion of some individuals seems to be a corollary of the social contractualist approach, which ascribes justice or legitimacy to a social arrangement insofar as it can be regarded as the product of the (actual – expressed or tacit – or hypothetical) consent of specified parties. (...) Consequently, this approach excludes those whose consent is not required in order to view an arrangement as legitimate or just. Given the enormous and continuing influence of John Rawls’s social contract theory, I take the Rawlsian view as my primary focus, concentrating on the way in which the question of exclusion raises challenges for Rawlsian contractualism. According to Rawls’s theory, those who participate in the hypothetical contract and to whom political power ought to be justifiable are reasonable and rational. They are reasonable in the sense that they understand and are willing to comply with the requirements of justice and they are rational in that they have the capacity to form, revise, and pursue a conception of the good. This gives rise to two categories of exclusion. In the first part of the thesis, I examine the exclusion of those who will develop the two moral powers sufficiently only if those who are represented in the social contract act (or refrain from acting) in certain ways. This category includes children, foetuses, and unreasonable citizens. Intuitively, justice issues in requirements in at least some of these cases, but it is hard to make sense of this on the Rawlsian approach. In the second part of the thesis, I address the question of exclusion regarding those who will never develop the two moral powers to the requisite degree, such as individuals with severe cognitive disabilities and non-human animals. Again, intuitively, justice issues in requirements here, but their justification is not clear on the contractualist approach. My conclusion is threefold. First, I argue that the problems the question of exclusion poses cannot be addressed by a single solution. Second, I safeguard Rawlsian contractualism by showing how each problem can be resolved. Third, I offer policy-prescriptions on a number of issues, such as education, abortion, and the criminal justice system. (shrink)

Part I of the dissertation examines the cognitive aspects of autonomy. The central question concerns what kind of cognitive capacity autonomy is. It will be argued that the concept of autonomy is best understood in terms of a metacognitive capacity of the individual. It is argued that metacognition has two components: procedural reflexivity and metarepresentation. Metarepresentation in turn can be divided into inferential reflexivity and other-attributiveness. These two components are essential for autonomy. Particular emphasis is put on procedural reflexivity. Further, (...) since the essential function of metacognition is control, it is argued that the concept of autonomy, understood as a metacognitive capacity, can be interpreted in terms of control. Issues arising from empirical data from neuroscience on functional, as well as impaired, metacognition, and on undermined autonomy, are dealt with. It is argued that autonomy cannot be determined with respect to subjective conditions. Neurological impairments, like Anton’s Syndrome, dementia, and thought insertion in schizophrenia, are put forward in support of this claim. To determine autonomy we require external conditions. In order to determine whether an individual is autonomous, both the metacognitive status of the individual and the external setting must be considered, since they are in interplay and consequently influence each other. In Part II, the analysis put forward in Part I is applied to Swedish healthcare. It is argued that the distinction between autonomy as a right and as a capacity must be explicit in order to understand what autonomy means and to deal with it effectively in healthcare practice. A discussion about whether or not the patient’s right to autonomy sometimes tends to be over-emphasized in healthcare is put forward. Special emphasis is placed on psychitaric issues such as deinstitutionalization and participation. Following the closure of the mental hospitals, deinstitutionalization and community-based care have become central topics in psychiatry. At the same time, the implementation of such care can be demanding for patients suffering from a persistent mental disorder. In part II it is also suggested that the metacognitive account of the concept of autonomy might help clarify the criteria governing coercive care. Finally, some suggestions concerning developments and improvements in Swedish healthcare, especially in psychiatry, where the concept of autonomy is important but problematic, are put forward. There is an apparent disagreement between recent commentators who find in Nietzsche both a constructive philosophy and a compatibilist account of freedom, and Brian Leiter’s reading that rejects both. The reason for this disagreement, I argue, is that Leiter’s “illiberal” view is limited in scope to Nietzsche’s critical philosophy, while Nietzsche also has a constructive philosophy aimed at select readers. I read Nietzsche’s critical philosophy as targeting the metaphysical entities that underpin asceticism and herd values, not the mental states and (...) processes with which these entities are associated. The “no such entity” reading preserves the resources needed to read Nietzsche as offering a replacement for the ascetic ideal—and an alternative source for life’s meaning. Although few of his readers will have been born with the drives needed to throw off herd values and enjoy compatibilist freedom, these readers are the intended audience for Nietzsche’s constructive philosophy. Mi problema es como reconciliar una fundamentación racional de instituciones democráticas, que en nuestras sociedades tienden a ser de índole liberal, con la creciente complejidad demográfica de las sociedades contemporáneas. Mi punto de vista es que esta fundamentación debería ser deliberativa y discursiva, es decir, debería garantizar una participación reflexiva de todos los ciudadanos en el diseño y sostenimiento de sus instituciones públicas. Ahora bien, ¿cómo alcanzar este ideal en sociedades cuyas complejidades dificultan la coordinación de intereses y la participación (...) discursiva, lo que vuelve a sus ciudadanos dispuestos a sacrificar sus libertades para rendirlas a un poder político despótico y totalitario? The constitution of democratic citizenship and the problem of the foundation of knowledge in complex societiesMy problem is how to reconcile a rational foundation of democratic institutions, which in our societies tend to be of a liberal nature, with the increasing demographic complexity of contemporary societies. My contention is that this rational and liberal foundation ought to be deliberative and discursive, that is to say, it must guarantee a reflective participation of all citizens in the design and maintenance of their public institutions. However, how could this ideal be achieved within societies with such complexities that make coordination of interests and discursive participation difficult, thus making their citizens willing to sacrifice their liberties, in order to surrender them to a despotic or totalitarian political power?
