This paper considers how counterfactuals should be evaluated on the assumption that determinism is true. I argue against Lewis's influential view that the actual laws of nature would have been false if something had happened that never actually happened, and in favour of the competing view that history would have been different all the way back. I argue that we can do adequate justice to our ordinary practice of relying on a wide range of historical truths in evaluating counterfactuals by (...) saying that, in typical cases, history would have been only *very slightly* different until shortly before the relevant time. The paper also draws some connections between the puzzle about counterfactuals under determinism and the debate about whether determinism entails that no-one can ever do otherwise than they in fact do. I argue against the poss-ability principle by developing a novel class of counterexamples. From the early reception of Thomas Aquinas up to the present, many have interpreted his theory of liberum arbitrium to imply intellectual determinism: we do not control our choices, because we do not control the practical judgments that cause our choices. In this paper we argue instead that he rejects determinism in general and intellectual determinism in particular, which would effectively destroy liberum arbitrium as he conceives of it. We clarify that for Aquinas moral responsibility presupposes liberum arbitrium and thus (...) the ability to do otherwise, although the ability to do otherwise applies differently to praise and blame. His argument against intellectual determinism is not straightforward, but we construct it by analogy to his arguments against other deterministic threats. The non-determinism of the intellect’s causality with respect to the will results from his claims that practical reasoning is defeasible and that the reasons for actions are not contrastive reasons. Suppose that time t is just a few moments from now. And suppose that the proposition that Jones sits at t was true a thousand years ago. Does the thousand-years-ago truth of that proposition imply that Jones's upcoming sitting at t will not be free? This article argues that it does not. It also argues that Jones even now has a choice about the thousand-years-ago truth of that Jones sits at t . Those arguments do not require the complex machinery (...) of Ockhamism, with its distinction between hard facts and soft facts; indeed, those arguments do not require any complex machinery at all. Instead, those arguments are built on an uncontroversial understanding of the idea that truth depends on the world. In the final section of the article, those arguments are extended to show that foreknowledge of an action does not threaten that action's freedom. (shrink)

When a person performs or fails to perform a morally significant action, we sometimes think that a particular kind of response is warranted. Praise and blame are perhaps the most obvious forms this reaction might take. For example, one who encounters a car accident may be regarded as worthy of praise for having saved a child from inside the burning car, or alternatively, one may be regarded as worthy of blame for not having used one's mobile phone to call for (...) help. To regard such agents as worthy of one of these reactions is to ascribe moral responsibility to them on the basis of what they have done or left undone. (These are examples of other-directed ascriptions of responsibility. The reaction might also be self-directed, e.g., one can recognize oneself to be blameworthy). There is a new objection to the Consequence Argument for incompatibilism. I argue that the objection is more wide-ranging than originally thought. In particular: if it tells against the Consequence Argument, it tells against other arguments for incompatibilism too. I survey a few ways of dealing with this objection and show the costs of each. I then present an argument for incompatibilism that is immune to the objection and that enjoys other advantages.

Determinism is a claim about the laws of nature: very roughly, it is the claim that everything that happens is determined by antecedent conditions together with the natural laws. Incompatibilism is a philosophical thesis about the relevance of determinism to free will: that the truth of determinism rules out the existence of free will. The incompatibilist believes that if determinism turned out to be true, it would also be true that we don't have, and have never had, free will. The (...) compatibilist denies that determinism has the consequences the incompatibilist thinks it has. According to the compatibilist, the truth of determinism does not preclude the existence of free will. (Even if we learned tomorrow that determinism is true, it might still be true that we have free will.) The philosophical problem of free will and determinism is the problem of understanding, how, if at all, the truth of determinism might be compatible with the truth of our belief that we have free will. The Consequence Argument has elicited various responses, ranging from acceptance as obviously right to rejection as obviously problematic in one way or another. Here we wish to focus on one specific response, according to which the Consequence Argument begs the question. This is a serious accusation that has not yet been adequately rebutted, and we aim to remedy that in what follows. We begin by giving a formulation of the Consequence Argument. We also offer some tentative proposals about the nature (...) of begging the question. Although the charge of begging the question is frequently made in philosophy, it is surprisingly difficult to pin down the precise nature of this dialectical infelicity (or family of such infelicities). Thus we offer some new proposals about the nature of begging the question with an eye to understanding what is going on in central cases in which the charge is legitimately made. We then defend the Consequence Argument against the charge that it begs the question, so construed. We contend that, whatever the other liabilities of the argument may be, it does not beg the question against the compatibilist. (shrink)

According to the Principle of the Fixity of the Past (FP), no one can now do anything that would require the past to have unfolded differently than it actually did, for the past is fixed, over and done with. Why might doing something in the future require the past to be different? Because if determinism is true—if the laws of nature and the initial conditions of the Big Bang determined a unique future for our universe—then doing anything other than what (...) you are determined to do would require one of two things: either a miracle, a violation of the actual laws of nature, or a different past, all the way back to the Big Bang or beyond. Which would it be? Those who reject miracles accept a Backtracking Principle (BT), according to which the past would (have to) be different. If this is correct, then it follows by (FP) that you cannot now do anything other than what you are determined to do. The conclusion of this much-discussed argument is that the freedom to do otherwise is incompatible with determinism. In order to break a stalemate between incompatibilists and compatibilists in the debate over (FP), this article presents a new Action-Type Argument for (FP). The aim is to refute Backtracking Compatibilism, the view that (BT) is true and yet the freedom to do otherwise is compatible with determinism. The form of the Action-Type Argument for (FP) also leads to a Simple Argument for incompatibilism, which does not assume (BT). What the Simple Argument does assume is a “governing” view of laws of nature, a view of laws as more than mere regularities that turn out to be exceptionless over all time. Incompatibilism follows. I draw upon Helen Steward's concept of agential settling to argue that freedom requires an ability to change the truth‐value of tenseless future contingents over time from false to true and that this ability requires a metaphysically open future.

Peter van Inwagen contends that nonresponsibility transfers across deterministic relations. Suppose it does. If the facts of the past and the laws of nature entail every truth about what one does, and no one is even in part morally responsible for the past and the laws, then no one is even in part morally responsible for what one does. This argument, the Direct Argument, has drawn various critics, who have attempted to produce counterexamples to its core inference principle. This article (...) considers two notable efforts, one by John Martin Fischer and Mark Ravizza and another by David Widerker. It shows that neither is sufficient to reject the Direct Argument. The article then proceeds to challenge the argument in a novel fashion. Van Inwagen has not given us good reason to think that the principle in question has an adequate anchor in our inferential practices, especially in light of the dialectical context with the compatibilist. Hence, it is not the compatibilists' burden to produce counterexamples to it. Rather, it is van Inwagen's burden to produce relevant confirming instances of it. (shrink)

In this paper I develop a sketch of an overall theology that dispenses with “alternative-possibilities” freedom in favor of “actual-sequence” freedom. I hold that acting freely does not require freedom to do otherwise, and that acting freely is the freedom component of moral responsibility. Employing this analytical apparatus, I show how we can offer various important elements of a theology that employs only the notion of acting freely. I distinguish my approach from the important development of Open Theism by William (...) Hasker. My view about God’s foreknowledge is in-between comprehensive foreknowledge and no foreknowledge. No contemporary compatibilist account of free will can be complete unless it engages with the consequence argument. I will argue that Wilfrid Sellars offered an ingenious version of compatibilism that can be used to refute the consequence argument. Unfortunately, owing to the opacity of Sellars’s writings on free will, his solution has been neglected. I will reconstruct his view here, demonstrating how it represents a powerful challenge to the consequence argument and tying it to some recent developments in the compatibilist (...) literature. The compatibility of determinism and the ability to do otherwise has been implicitly assumed by many to be irrelevant to the viability of compatibilist responses to the manipulation argument for incompatibilism. I argue that this assumption is mistaken. The manipulation argument may be unsound. But even so, the manipulation argument, at the very least, undermines classical compatibilism, the view that free will requires the ability to do otherwise, and having that ability is compatible with determinism. This is because classical compatibilism, (...) in conjunction with any type of reply to the manipulation argument, has counterintuitive implications. In order to avoid such implications, we need not hold that determinism is incompatible with moral responsibility. But we must hold that determinism is incompatible with the ability to do otherwise. Many philosophers and non-philosophers who reflect on the causal antecedents of human action get the impression that no agent can have morally relevant freedom. Call this the ‘non-existence impression.’ The paper aims to understand the (often implicit) reasoning underlying this impression. On the most popular reconstructions, the reasoning relies on the assumption that either an action is the outcome of a chance process, or it is determined by factors that are beyond the agent’s control or which she did not bring (...) about. I argue that arguments based on this premise fail to apply to some possible agents for whom the non-existence impression arises. On the alternative reconstruction I offer, the impression rests on the assumption that free will requires being involved in the ultimate explanation of one’s actions in a novel sense in which nothing can be involved in the ultimate explanation of anything. Kadri Vihvelin has recently argued that between compatibilists and incompatibilists, the incompatibilists have a greater dialectical burden than compatibilists. According to her, both must show that free will is possible, but beyond this the incompatibilists must also show that no deterministic worlds are free will worlds. Thus, according to Vihvelin, so long as it is established that free will is possible, all the compatibilist must do is show that the incompatibilists' arguments are ineffective. I resist Vihvelin's assessment of the dialectical (...) burdens of compatibilists and incompatibilists, as well as her assessment of the best arguments for incompatibilism. (shrink)

A style of argument that calls into question our freedom (in the sense that involves freedom to do otherwise) has been around for millennia; it can be traced back to Origen. The argument-form makes use of the crucial idea that the past is over-and-done-with and thus fixed; we cannot now do anything about the distant past (or, for that matter, the recent past)—it is now too late. Peter van Inwagen has presented this argument (what he calls the Consequence Argument) in (...) perhaps its clearest and most forceful way, but debate over the argument has arguably reached a stalemate. -/- Recently, however, Wes Holliday has attempted to break this seeming stalemate by presenting a new argument for the Principle of the Fixity of the Past. Holliday’s argument is subtle and ingenious, and worthy of serious consideration, especially given the promise it holds for genuinely advancing this old debate. In what follows, however, we argue that despite its considerable ingenuity, Holliday’s argument fails to convince, and the stalemate appears to remain. (shrink)

In this paper, I present an argument that shows that the belief in libertarian freedom is inconsistent with two assumptions widely accepted by those who are physicalists with regard to the relation between the mental and the physical - that mental properties are distinct from physical properties, and that mental properties supervene on physical properties. After presenting the argument, I trace its implications for the question of the compatibility of libertarian free will and physicalism in general.

A sourcebook/textbook on the problem of free will and determinism. Contains a history of the free will problem, a taxonomy of current free will positions, the standard argument against free will, the physics, biology, and neuroscience of free will, the most plausible and practical solution of the problem, and reviews of the work of the leading determinist Ted Honderich, the leading libertarian Robert Kane, the well-known compatibilist Daniel Dennett, and the determinism-agnostic Alfred Mele.

Our concept of choice is integral to the way we understand others and ourselves, especially when considering ourselves as free and responsible agents. Despite the importance of this concept, there has been little empirical work on it. In this paper we report four experiments that provide evidence for two concepts of choice—namely, a concept of choice that is operative in the phrase having a choice and another that is operative in the phrase making a choice. The experiments indicate that the (...) two concepts of choice can be differentiated from each other on the basis of the kind of alternatives to which each is sensitive. The results indicate that the folk concept of choice is more nuanced than has been assumed. This new, empirically informed understanding of the folk concept of choice has important implications for debates concerning free will, responsibility, and other debates spanning psychology and philosophy. -/- Specifically, 'having a choice' appears to require genuinely open alternatives, or alternative possibilities that are actually realizable, while 'making a choice' appears to only require psychological open alternatives, or the ability to consider alternatives independent of whether these alternatives are actually realizable. We argue that these findings are relevant to the free will debate because choice is central to the folk concept of free will and many philosophical analysis of free will. The kinds of alternatives required for having a choice appear to be incompatibilist in nature, while the kinds of alternatives required for making a choice appear to be compatibilist in nature. If free will requires having choices, then this is perhaps evidence against compatibilism. If free will requires making choices, then this is perhaps evidence in favor of--or at least consistent with--compatibilism. (shrink)

Many moral theories incorporate the idea that when an action is wrong, it is wrong because that there was something else that the agent could and should have done instead. Most notable among these are consequentialist theories. According to consequentialism an action A is wrong if and only if there was another action B that the agent could have performed such that, if the agent had performed B instead of A, the consequences would have been better. Relatively little attention has (...) been given to the question of how to understand the meaning of ‘could have’ in this specific context. However, without an answer to this question, consequentialist theories fail to yield determinate verdicts about the deontic status of actions in real scenarios. It is here argued that the following conditional analysis provides the required answer and gives us the most plausible version of consequentialism: the agent could have done B instead of A if and only if, there is a decision such that had the agent made this decision, then she would have done B, and not A. Such a conditional analysis has been universally rejected as an analysis of the general meaning of ‘could have’, but we show that in the specific context of specifying the meaning of ‘could have’ in a consequentialist criterion of right and wrong action, all the standard objections to it fail. Razmatra se pojam kauzalnog determinizma, a potom se ispituju izazovi koje argument konzekvenci postavlja pred slobodu volje shvaćenu kao mogućnost da se učini drugačije. Cilj je rada (...) pokazati da su u osnovi svakodnevne upotrebe pojma moralne odgovornosti slabiji uvjeti od slobode shvaćene kao mogućnosti da se učini drugačije. I’ve been told that in the good old days of the 1970s, when Quine’s desert landscapes were regarded as ideal real estate and David Lewis and John Rawls had not yet left a legion of influential students rewriting the terrain of metaphysics and ethics respectively, compatibilism was still compatibilism about free will. And, of course, incompatibilism was still incompatibilism about free will. That is, compatibilism was the view that free will was compatible with determinism. Incompatibilism was the view that free (...) will was incompatible with determinism.1 What philosophers argued about was whether free will was compatible with determinism. Mostly, this was an argument about how to understand claims that one could do otherwise. You needn’t have bothered to talk about moral responsibility, because it was just obvious that you couldn’t have moral responsibility without free will. The literature was a temple of clarity. Then, somehow, things began to go horribly wrong. To be sure, there had been some activity in the 1960s that would have struck some observers as ominous. Still, it was not until the 1980s that those initial warning signs gave way to real trouble. The meanings of terms twisted. (shrink)

This paper aims to defend deliberation-compatibilism against several objections, including a recent counterexample by Yishai Cohen that involves a deliberator who believes that whichever action she performs will be the result of deterministic manipulation. It begins by offering a Moorean-style proof of deliberation-compatibilism. It then turns to the leading argument for deliberation-incompatibilism, which is based on the presumed incompatibility of causal determinism and the ‘openness’ required for rational deliberation. The paper explains why this argument fails and develops a coherent account (...) of how one can rationally deliberate and believe in causal determinism without inconsistency. The second half of the paper then takes up Cohen's proposed counterexample and his Four-Case Deliberation Argument against deliberation-compatibilism, which is meant to mirror Derk Pereboom's famous Four-Case Manipulation Argument. In response, the author defends a hard-line reply to FCDA but also argues that the notion of ‘sourcehood’ relevant to rational deliberation differs from that involved in free will. (shrink)

Free will is difficult to classify with respect to determinism or indeterminism, and its phenomenology in consciousness often shows both aspects. Initially, it is felt as unlimited and indeterminate will power, with the potentiality of multiple choices. Thereafter, reductive deliberation is led by determinism to the final decision, which realises only one of the potential choices. The reductive deliberation phase tries to find out the best alternative and simultaneously satisfying vague motivations, contextual conditions and personal preferences. The essential sense of (...) free will is the introduction of personal preferences, which allows a higher diversity of reactions to vague motivations. With an oversimplified model of determinism as a chain of events, incompatibilists define “free” as “undetermined” so that determinism becomes incompatible with any free choice between alternatives. In consciousness, free will requires a more complex model of network determinism as well as the consideration of unconsciousness as a causal factor. When “free” defined as “undetermined” is applied to the context of consciousness, it should be reinterpreted as “unconscious of being determined” or not aware of underlying determinism. Lacking information on determinism generates a feeling of “free” in consciousness and, therefore, gives the impression of indeterminism. Lacking information may be induced by an uncertain future without determined events—an unconscious past with biological reactions suddenly emerging from the unconsciousness or an unknown present unable to distinguish determinism of complex events. Therefore, at the level of human consciousness, the experience of free will is associated with apparent indeterminism although it is based on unconscious determinism. The concepts of compatibilism and incompatibilism are only two different aspects of the same phenomenon and correspond to consciousness and unconsciousness. Nevertheless, they can be considered together with a free will concept based on relativity depending on two different reference frames—the first person’s experience frame or the Laplace’s demon frame with knowledge on every molecule of the universe. Only relativity of the free will concept avoids the contradiction between “free” and “unfree” for the same phenomenon and could be a compromise for considering compatibilism and incompatibilism equally. I argue that if the claims Buddhist philosophy makes about meditation virtuosos are plausible, then Buddhism may rebut most of the strongest arguments for free will skepticism found in Western analytic philosophy, including the hard incompatiblist's argument (which combines the arguments for hard determinism, such as the consequence argument, with those for hard indeterminism, such as the randomness argument), Pereboom's manipulation argument, and Galen Strawson's impossibility argument. The main idea is that the meditation virtuoso can cultivate a level of mind (...) control that is impervious to the causal origins of her mental states, on the basis of which ability an account of free will may be erected, consistent with the claim that Buddhist enlightenment consists in some sort of radical conception of the ultimately impersonal nature of the agent. Sometimes you make a choice. Whether or not you made it was up to you. The choice was free. But how can this be? A scientific view of the world may leave no room for free choice. Free will literature continually explodes. Yet experts still focus on control or on a power to do otherwise. Libertarians like Robert Kane believe that indeterminism is necessaryfor free will. They think this in part because they hold both (1) thatmy being the ultimate cause of at least part of myself is necessary forfree will and (2) that indeterminism is necessary for this ``ultimateself-causation''. But seductive and intuitive as this ``USCLibertarianism'' may sound, it is untenable. In the end, nometaphysically coherent (not to mention empirically valid) conception ofultimate self-causation is available. This is the introduction to a volume of new essays in the metaphysics of moral responsibility by John Martin Fischer, Carl Ginet, Ishtiyaque Haji, Alfred R. Mele, Derk Pereboom, Paul Russell, and Peter van Inwagen. I provide some background for the essays, cover the main debates in the metaphysics of moral responsibility, and emphasize some of the authors' contributions to this area of philosophy.

Laws, Mind, and Free Will is a highly valuable book for anyone interested in philosophy of science, philosophy of mind, or in the problem of free will and moral responsibility. The book has three distinct but related parts. The first presents an anti-empiricist position on the laws of nature, according to which the point of the laws is not primarily to predict kinematic outcomes, but rather to characterize dynamics. One upshot of the account is that the laws have an attenuated (...) role in determining and prediction of actual motion, and this has an important consequence for the relevance of the laws to the prospects for libertarian free will. This consequence is developed in detail in the second part of the book. A further feature of the account is that proposed laws and the theories in which they are embedded are models in a sense that reflects our interests and involves idealization. The concept of “moral responsibility” has almost always been defined in relation to a certain idea of metaphysical freedom and to a conception of the physical world. So, classically, for indeterminist thinkers, human beings are free and therefore responsible, if their choices are not defined by a previous state of the world but derive from an autonomous selection among a set of alternatives. Differently, for the majority of determinist philosophers , the only form of freedom we need has to be (...) identified with freedom of the conduct, considered as opposite to any form of coercion. Some argue that, given the truth of determinism and the related suppression of concepts such as “guilt” and “praise”, or “merit” and “demerit”, morality could survive just as a utilitarian tool, even though this seems to be in conflict with our deepest feelings and practices. Considering some revisionist approaches of moral responsibility in connection with classical positions , I will reconstruct some of the attempts to release responsibility from the thematisation of freedom, exploring the possibility of redefining it as an independent concept. My conclusion is that the focus on the choice-action process and on the characteristics of the “self”, avoiding reference to alternative scenarios, could be a good starting point for elaborating a conception of what really counts for our moral life – even though, in the end, this could entail the abandonment of the traditional concept of responsibility itself. With recent advancements in technology and computer science, we have reached a point where we can clearly state that thinking is no longer the exclusive privilege of living minds. Artificial intelligence can gather and process information in a manner fairly similar or even superior to our thinking process. AI can use this processed information in a reasoning process to make decisions and execute them. However, what makes our mind distinct from AI is the addition of “I,” that is, an entity (...) composed of two mental processes of awareness-based choice selection and discretionary selection of information for attention that are the fundamental core function of decision making and awareness processes, respectively. ABCS allows the coexistence of free will alongside—but unrestrained by—the chain of causality in the decision-making process with the help of awareness. “I” also allows for DSIA, which is a key step in the awareness process. This intertwined process is crucial for our consciousness. Similar to AI, the mind is devoid of any form of self-recognition without awareness. Self-awareness is a collaborative function of “I” and the mind. “I” is instrumental in the sense of self-awareness, but on its own, it is selfless. Additionally, “I” is the heart of the decision-making process. Therefore, AI is missing “I,” a selfless master of the mind. (shrink)

The author presents a model of moral responsibility based on the actual sequence and the notion of reason-responsiveness, and draws an analogy between this model and Robert Nozick’s model of knowledge based on the actual sequence. In addition, the concept of semicompatibilism is introduced and explained.

The principle of alternate possibilities says that you are morally praiseworthy or blameworthy for something you do only if you could have done otherwise. Frankfurt examples are putative counterexamples to PAP. These examples feature a failsafe mechanism that ensures that some agent cannot refrain from doing what she does without intervening in how she conducts herself, thereby supposedly sustaining the upshot that she is responsible for her behavior despite not being able to do otherwise. I introduce a Frankfurt example in (...) which the agent who could not have done otherwise is God. Paying attention to the freedom requirements of moral obligation, the example is commissioned, first, to assess whether various statesof affairs that are unavoidable for God can be obligatory for God and for whichGod can be praiseworthy. The example is, next, used to unearth problems with conventional Frankfurt examples that feature human agents. I argue that conceptual connections between responsibility and obligation cast suspicion on these examples. Pertinent lessons that the divine Frankfurt example helps to reveal motivate the view that divine foreknowledge and determinism, assuming that both preclude freedom to do otherwise, may well imperil obligation and responsibility. In a recent and highly engaging paper, Reid Blackman argues against the principle that if determinism is true, then it is not the case that one can do otherwise. He says that the combination of determinism, CAN, and plausible principles, such as the ‘ought’ implies ‘can’ principle, entails false conclusions about the normative, including the propositions that people never fail to do what they ought to have done and one never has any reason to do anything but what one does. (...) If CAN is, indeed, false compatibilists ought to be motivated to defend a reading of ‘can’ such that one can do otherwise even if determinism is true. In this paper I argue against Blackman’s dismissal of CAN on the basis that his relevant arguments are insufficiently sensitive to strong and weak readings of ‘can.’. (shrink)

In his recent book Willensfreiheit Geert Keil defends a version of libertarianism. Yet he criticizes a flagship argument for incompatibilism. Van Inwagen's consequence argument, Keil thinks, relies on an irrelevant premise when it claims that agents have no choice about the remote past. I argue that Keil's charge rests on a misunderstanding. I then sketch why discussions of the consequence argument should focus on the question whether or not a certain version of rule Beta is valid.

[From introduction:] A theory of moral responsibility sets out the conditions under which we believe that an individual is a rational candidate for praise and blame on account of his behaviour. Such a theory needs to be supplemented by a further moral theory that specifies which morally responsible agents ought to be praised or blamed for their actions. We will focus here on the first sort of theory only. The theory present here will be similar to theories held by others.

Can nonhuman animals and artificial intelligence (AI) entities be attributed moral agency? The general assumption in the philosophical literature is that moral agency applies exclusively to humans since they alone possess free will or capacities required for deliberate reflection. Consequently, only humans have been taken to be eligible for ascriptions of moral responsibility in terms of, for instance, blame or praise, moral criticism, or attributions of vice and virtue. Animals and machines may cause harm, but they cannot be appropriately ascribed (...) moral responsibility for their behavior. This thesis challenges the conventional paradigm by proposing an alternative approach where moral agency is conceived as the competence to participate in moral responsibility practices. By shifting focus from intra-individual to contextual and socially situated features, this practice-focused approach appears to make the attribution of moral agency to nonhuman animals and AI entities more plausible than commonly assumed. Moreover, considering the current and potential future prevalence of nonhuman animals and AI entities in everyday settings and social contexts, a potential extension of moral agency to such entities could very well transform our social, moral, and legal practices. Hence, this thesis proposes that the attribution or withholding of moral agency to different entities should be carefully evaluated, considering the potential normative implications. (shrink)
