The standard view in social science and philosophy is that lying does not require the liar’s assertion to be false, only that the liar believes it to be false. We conducted three experiments to test whether lying requires falsity. Overall, the results suggest that it does. We discuss some implications for social scientists working on social judgments, research on lie detection, and public moral discourse.

The global community faces ecological problems with the natural environment and cultural impediments to solving them. Natural systems are constantly changing and so are cultural practices. Humans need to address both: the interaction between those dynamic systems, the natural and cultural, because what happens in one system changes things in the other. The changes to the ecosystems are rapid and sometimes irreversible while dealing with them has been inadequate. Environmental movements, including deep ecology, have been at the forefront of the (...) efforts to engage the public, various groups, politicians, and world governments to address environmental problems on a coordinated large scale, but their efforts have not produced substantive results. Cultural, ideological, and other reasons provide some insights into the reasons why this has happened. They show that the ecological crisis is now at the point at which deep ecological principles offer a way out of the crisis more clearly, given that it offers a new, ecological worldview for humans to adopt. This worldview suggests there is inherent unity between the human and natural worlds based on the concept of interdependence. This paper attempts to show that such inherent unity exists and that humans need to use precaution because the risks are too great to ignore. (shrink)

ABSTRACT Amongst the Italian exiles who arrived at the Canton of Ticino following repression perpetrated by the Di Rudinì and Pelloux administrations – after the popular uprisings of 1898 – are Enrico Bignami, Giuseppe Rensi and Arcangelo Ghisleri, who, in Lugano, created a sort of secular symposium for fostering spiritual values. This gave birth to Coenobium, the ‘international journal of independent studies’, which remained in operation between 1906 and 1919. This periodical distinguished itself due to the diversity of the issues (...) addressed: from science to law, from history to philosophy, from literature to spiritualism, philosophy and psychology. With the beginning of the First World War, however, Coenobium’s focus was on the spiral of violence triggered by the war; hence a series of denunciations entrusted to the column ‘War to war!’, which marked a dramatic change in the editorial policy of the magazine edited by Bignami, who was determined to turn it into a strong instrument of pacifist propaganda. Several prestigious figures in Europe’s cultural and political milieus participated in this venture, notably Norman Angell, Romain Rolland, Angelo Crespi, Raffaele Ottolenghi, Claudio Treves, Filippo Turati, Henri La Fontaine, Nicholas Murray Butler and Enrico Bignami. From the end of the twelfth century until the middle of the eighteenth century, the concept of a right of necessity –i.e. the moral prerogative of an agent, given certain conditions, to use or take someone else’s property in order to get out of his plight– was common among moral and political philosophers, who took it to be a valid exception to the standard moral and legal rules. In this essay, I analyze Samuel Pufendorf’s account of such a right, founded (...) on the basic instinct of self-preservation and on the notion that, in civil society, we have certain minimal duties of humanity towards each other. I review Pufendorf’s secularized account of natural law, his conception of the civil state, and the function of private property. I then turn to his criticism of Grotius’s understanding of the right of necessity as a retreat to the pre-civil right of common use, and defend his account against some recent criticisms. Finally, I examine the conditions deemed necessary and jointly sufficient for this right to be claimable, and conclude by pointing to the main strengths of this account. Contrary to what has been alleged, the moral equivalence of combatants (MEC) is not a doctrine that was expressly developed by the traditional theorists of just war. Working from the axiom that just cause is unilateral, they did not embrace a conception of public war that included MEC. Indeed, MEC was introduced in the early fifteenth century as a challenge to the then reigning just war paradigm. It does not follow, however, that the distinction between private and public war had (...) no place in the traditional teaching. Thomas Aquinas and his successors did not analyse just war by extrapolation from the related idea of self-defense. Rather, they likened just war to a legal proceeding that could solely be undertaken by persons possessed of legitimate authority. For this reason, just war was first and foremost public war. Private war was deemed ?war? only in a secondary and reduced sense of the term. It was accordingly understood that public war should be waged and its morality judged by reference to a set of norms that are not directly reducible to those governing private self (and other)-defense. Why should members of societies engaging in humanitarian intervention support the costs of that project? It is sometimes argued that only a theory of natural duty can require their support and that contractualist theories fail because they are exclusionary. This article argues that, on the contrary, natural duty is inadequate as a basis and that contractualism provides a basis for placing support for (justified) interventions among the duties of citizenship. The duty to support intervention is not, therefore, a competitor (of (...) indeterminate weight) to our duties to compatriots, since it rests on the same basis. That is because exclusive citizenship can be justified only if social contracts can be iterated elsewhere and successful societies therefore owe assistance to societies that are immobilized by state abuse or state failure. Conventionalists about promising believe that it is wrong to break a promise because the promisor takes advantage of a useful social convention only to fail to do his part in maintaining it. Anti-conventionalists claim that the wrong of breaking a promise has nothing essentially to do with a social convention. Anti-conventionalists are right that the social convention is not necessary to explain the wrong of breaking most promises. But conventionalists are right that the convention plays an essential role in any (...) satisfactory account of promising. A new conventionalism can explain this by appealing to special features of social conventions. Two of these special features have important implications for any moral requirements they mediate, such as the requirement to keep one's promises and the moral requirements attached to social or occupational roles. First, these requirements will not depend on features of a situation that are inaccessible to typical participants in the convention. Second, these requirements often cannot be tailored to fit the overly unusual circumstances of participants. (shrink)

Given the conceptual gap in the global justice debate today (where most of the talk is about the duties of the rich, but little is said about what the poor may do for themselves), in this article I reintroduce the idea of a right of necessity. I first delineate a normative framework for such a right, inspired by these historical accounts. I then offer a contemporary case where the exercise of the right of necessity would be morally legitimate according to (...) that framework – even though illegal and probably condemned by the standard moral norms. The case is that of a small group of Paraguayan campesinos (small farmers) suffering from the effects of a severe drought. In the third part, I introduce the concept of noncivil disobedience: I call an act of noncivil disobedience a conscientious, public, illegal and forcible act whose performance, while not necessarily intended directly as a means to bring about social and/or political change, may help to trigger these changes indirectly. In the fourth part, I suggest that certain instances where the right of necessity is overtly exercised – as in the case of the famine-struck Paraguayan campesinos – may also be interpreted in terms of noncivil disobedience, insofar as they serve a double function: as a means of satisfying immediate need, and as a marker of discontent in a society where the equal rights of individuals are a nominal ideal which remains unfulfilled in practice. I then address two objections that may be raised against resurrecting the idea of a right of necessity and identifying it in certain instances with noncivil disobedience. I conclude by suggesting that, at the point of convergence between the two, a basic right like the right of necessity recovers its value as an active, (rather than passive) entitlement of its holders, while the use of force enters the picture as a legitimate means that – at least under certain circumstances – may be resorted to within the limits of civil society. This paper synthesizes convergent lines of evidence to evaluate the hypothesis that objective falsity is essential to lying. Objective accounts of lying affirm this hypothesis; subjective accounts deny it. Evidence from history, logic, social observation, popular culture, lexicography, developmental psychology, inference, spontaneous description, and behavioral experimentation strongly supports the hypothesis. Studies show that the only apparent evidence against the hypothesis is due to task substitution, i.e. ethical concerns or perspective-taking interfering with performance on categorization tasks. One of the most oft-cited parts of Francis Hutcheson’s Illustrations upon the Moral Sense (1728) is his discussion of “exciting reasons.” In this paper I address the question: What is the function of that discussion? In particular, what is its relation to Hutcheson’s attempt to show that the rationalists’ normative thesis ultimately implies, contrary to their moral epistemology, that moral ideas spring from a sense? Despite first appearances, Hutcheson’s discussion of exciting reasons is not part of that attempt. In the article, I examine the relevance of Just War Doctrine to contemporary conflicts. Just War Doctrine, which grew out of Western Christian thinking, presupposes that evil might be confronted with force, if there is no alternative way to restore a just order. But modern trends call into question the certainty and universality of this doctrine. On the one hand, ideas of moral relativism and comparative justice have become more widespread, potentially undermining the use of the notions “just” and “justified” (...) in relation to military conflicts. On the other hand, the nature of war is changing, as warfare is no longer only kinetic in character. I offer examples of how the evolving character of warfare challenges the traditional understanding of Just War Doctrine. For example, there is the growing threat of cyber warfare, but the ethical criteria for its use are not defined. In relation to Just War Doctrine, questions of whether and when pre-emptive cyber attack is permissible arise, what should constitute legitimate targets of cyber warfare and to what degree collateral damage could be acceptable. Another challenge to the traditional understanding of Just of War Doctrine was the putative doctrine of humanitarian intervention.Prima facie,humanitarian interventions do not comply withius ad bellumcriteria of Just War Doctrine, because of the absence of a direct military threat to the intervening state. The justification of humanitarian intervention is based on the assertion of an intolerable violation of accepted values. The weakness of such approach, as discussed in the article, is that it implicitly assumes that one protagonist’s values are superior to others. A further example of emerging challenges to Just War Doctrine is the phenomenon of hybrid war, a term used to describe a type of conflict that is multi-faceted and in which kinetic warfare is not dominant. The orchestration of several strands of conflict, each designed to be below the threshold to provoke a military response, exploits the absence of legal and ethical norms regulating such activity. I conclude the article by suggesting that, firstly, for Just War Doctrine to remain relevant, it should be expanded to include harms caused by non-kinetic actions, and, secondly, the distinctions between the states of war and peace should be redefined to reflect the changing character of war more accurately. The open borders view is frequently dismissed for making infeasible demands. This is a potent strategy. Unlike normative arguments regarding open borders, which tend to be relatively intractable, the charge of infeasibility is supposed to operate as what we call a "normative argument-stopper." Nonetheless, we argue that the strategy fails. Bringing about open borders is perfectly feasible on the most plausible account of feasibility. We consider and reject what we take to be the only three credible ways to save the (...) charge of infeasibility: by proposing an alternative account of feasibility; by proposing an alternative, more circumscribed interpretation of the subject-matter of feasibility claims; and by proposing a more expansive account of the addressees of the demand for open borders. The first fails to vindicate the claim that infeasibility is a normative argument-stopper. The second does not provide an argument against open borders at all. The third underestimates the power of at least some non-state actors. We conclude by drawing some lessons for the open borders view and the use of feasibility in politics more generally. (shrink)

This article examines the British colonial theft of Indigenous sovereignty and the particular obstacles that it presents to establishing just social relations between the colonizer and the colonized in settler states. In the first half, I argue that the particular nature of the crime of sovereign theft makes apologies and reparations unsuitable policy tools for reconciliation because Settler societies owe their very existence to the abrogation of Indigenous sovereignties. Instead, Settler states ought to return sovereignty to the land’s Indigenous peoples. (...) In the second half of this paper, I take up some of the practical questions of how this might be done and anticipate a number of objections. Giving up sovereignty would not mean dispossessing the millions of colonists who currently reside in these countries of their homes and property – but it does mean rethinking the constitutional makeup of a country and how that serves to benefit the different peoples who make their homes there. Constitutional liberal practices are capable of being normatively grounded by a number of different metaphysical positions. Kant provides one such grounding, in terms of the autonomously derived moral law. I argue that the work of Edmund Burke provides a resource for an alternative construal of constitutional liberalism, compatible with, and illumined by, a broadly Thomistic natural law worldview. I contrast Burke's treatment of the relationship between truth and cognition, prudence and rights, with that of his contemporary, Kant. We find that (...) in each case where Kant's system is constructed from the first principle of autonomy, Burke's thought is oriented toward an end that is not of our making. Readings of Burke as a natural law thinker are currently out of fashion among Burke commentators; without relying, for the main thesis, on historical claims about Burke's "Thomism," I nonetheless explore and challenge some of the assumptions that underlie the current orthodoxy. Válka byla po staletí opakovaně podrobována etické a filozofické reflexi a za tu dobu se nahromadilo množství hmatatelných dopadů, které to mělo na její charakter (mj. zákaz některých zbraní a způsobů boje či přijetí dalších limitujících opatření inspirovaných učením o spravedlivé válce). Ne úplně často řešenou otázkou ale zůstává, zdali dlouhodobé vzájemné působení války a filozofie zpětně neovlivnilo i samotnou „vědu o moudrosti“. Patrně neexistuje oblast lidské činnosti, do níž by fenomén války významně nepromluvil, a výjimkou by proto neměla být (...) ani filozofie. Především v oboru politické filozofie (a podoboru známého pod označením spravedlivá válka) lze identifikovat hmatatelný otisk válečného dění v obsahu vůbec těch nejdůležitějších a nejvlivnějších děl této disciplíny od antiky až do současnosti. Cílem příspěvku je upozornit na značně formativní vliv válečných událostí na některé stěžejní myšlenky politické filozofie a v několika konkrétních příkladech prezentovat rozsah vzájemné interakce. My essay “Responsibility to Protect and Militarized Humanitarian Intervention: When and Why the Churches Failed to Discern Moral Hazard” (JRE 40.2) called for more questioning engagement with R2P than the broadly uncritical welcome given by the churches to the doctrine between September 2003 and September 2008. In response to Luke Glanville's reply, this essay identifies further reasons for caution before accepting R2P and so-called humanitarian wars alongside defensive wars as paradigmatically justified. It is structured with reference to the tests in (...) A More Secure World: Our Shared Responsibility, the Report by the Secretary-General's High-level Panel on Threats, Challenges and Change, as recommended to the General Assembly when considering whether to authorize or apply military force: seriousness of risk, intention, last resort, proportional means, balance of consequences. In the paper it is argued that bridging the digital divide may cause a new ethical and social dilemma. Using Hardin's Tragedy of the Commons, we show that an improper opening and enlargement of the digital environment (Infosphere) is likely to produce a Tragedy of the Digital Commons (TDC). In the course of the analysis, we explain why Adar and Huberman's previous use of Hardin's Tragedy to interpret certain recent phenomena in the Infosphere (especially peer-to-peer communication) may not be entirely (...) satisfactory. We then seek to provide an improved version of the TDC that avoids the possible shortcomings of their model. Next, we analyse some problems encountered by the application of classical ethics in the resolution of the TDC. In the conclusion, we outline the kind of work that will be required to develop an ethical approach that may bridge the digital divide but avoid the TDC. (shrink)

This article redescribes early modern European defenses of private property in terms of a theoretical project of seeking to establish the true or essential nature of property. Most of the scholarly literature has focused on the historical and normative issues relating to the various accounts of original acquisition around which these defenses were organized. However, in my redescription, these so-called “original acquisition stories” appear as methodological devices for an analytic reduction and resolution of property into its fundamental elements and axioms. (...) Through these stories, property is “created” in the form of the classical liberal paradigm of presumptively exclusive, private ownership of material things. The problem is that this project of “creation” is also a project which arbitrarily excludes or marginalizes other forms and systems of property, and especially usufructuary forms of common property. After critically explicating this early modern project of creation, I go on to argue that the classical liberal paradigm and its problems continue to inform property theory and discourse in the late modern era. The desire to defend a state against attacks by a non-state actor requires thinking about counter-attacking without violating the sovereign equality of the territorial state because targeting a non-state actor on the territory of that state may violate its sovereignty. This paper evaluates the main views on self-defense by states against non-state actors by studying the Just War Theory and argues that self-defense against a non-state actor is allowed if the counter-attack complies with the principle of sovereign equality. Sovereign equality (...) is the prohibition of states from dominion over other states because states are equal to one another. This principle can be respected by allowing self-defense against non-state actors to occur only if the state consented to the use of force on its territory or if that state is incapable of controlling or unwilling to control the non-state actor. Darwin’s (1871/1981) observation that evolution has produced in us certain emotions responding to right and wrong conduct that lack any obvious basis in individual utility is a useful springboard from which to clarify the role of emotion in moral judgment. The problem is whether a certain class of moral judgment is “constituted” or “driven by” emotion (Greene, 2008, p. 108) or merely correlated with emotion while being generated by unconscious computations (e.g., Huebner, Dwyer, & Hauser, 2008). With one exception, all (...) of the “personal” vignettes devised by Greene and colleagues (2001, 2004) and subsequently used by other researchers (e.g., Koenigs et al., 2007), in their fMRI and behavioral studies of emotional engagement in moral judgment, involve violent crimes or torts. These studies thus do much more than highlight the role of emotion in moral judgment; they also support the classical rationalist thesis that moral rules are engraved in the mind. (shrink)

Bioethics has increasingly become a standard part of medical school education and the training of healthcare professionals more generally. This is a promising development, as it has the potential to help future practitioners become more attentive to moral concerns and, perhaps, better moral reasoners. At the same time, there is growing recognition within bioethics that nonideal theory can play an important role in formulating normative recommendations. In this chapter we discuss what this shift toward nonideal theory means for ethical curricula (...) within healthcare education. In particular, we contend that more attention to the particularities of historical and social context needs to be incorporated into bioethics training. To make this argument, we focus on two examples: teaching units on race and medicine and those that focus on stigma and coercion in mental health. For both, we show how a pedagogical approach in which educators focus on social injustice could influence how practitioners engage in ethics in the clinic. This chapter, then, demonstrates what a commitment to nonideal theory can mean practically when it comes to bioethics education. (shrink)

Only in an open society can hypotheses or models be falsified. His principle of falsification applies not only to scientific argument but also to social science beliefs and political propaganda. Thus, democracy nourishes an open society seeking the truth. Actually, democracy is the sole political re- gime that promotes the truth in an open (...) society. The articles reviews the problem of humanitarian terrorism that is a terrorism of self-proclaimed humanitarian goals and self-inflicted constraints. This type of terrorism justifies itself by lofty aspirations and claims that its actions are targeted killings of guilty individuals only. This terrorism is the product of the Enlightenment, it emerged by the end of the 18th century and passed three stages in its development. The first stage is the classical terror of the Jacobins 1793–1794. The second one is Russian revolutionary (...) terror of the end of the 19th – early 20th centuries. The third stage is the contemporary American warfare waged by the unmanned aerial vehicles, called drones. From the perspective of the contemporary just war theory, this terrorism is not only morally superior to the ordinary primitive terrorism of straightforward attacks on civilians (this terrorism may be no less fair in terms of self-imposed goals, but is doubtful in terms of means), but even contemporary war. Terrorists of this type kill the few but teach a lesson to many. But it must be clearly born in mind that humanitarian terrorism is not only the summit of just war but also the summit of absolute war. It is founded in personal and individual enmity, which makes the core of absolute enmity. Absolute enmity may at times be inevitable and even justified, but it blocks the road to peace. Revengeful spite, stemming from absolute enmity, is capable of creating its own phantoms of justice, propelling the war. The author concludes that the vicious circle is thus completed. The logic of just war drags in the direction humanitarian terrorism, humanitarian terrorism drags in the mire of absolute enmity. Absolute enmity proclaims just war. (shrink)

Deception always has played, and continues to play, a significant role in military operations at all levels. Nevertheless, its significance does not override the reality that deception, like so many other phenomena of war, is subject to limitations imposed by the demands of morality. Those demands include the imperative that military professionals act in good faith even with those who are their adversaries. Military leaders sensitive to this reality are far better equipped to use deceptive measures in a way that (...) minimizes their long-term negative effects than are those who ignore the moral dimension of deception. This article explores the extent to which the decision to invade Iraq in 2003 coheres with the normative precepts of liberalism as an international political theory. Beginning with a Lockean liberal theory of the state, this article first examines the evolution of international liberalism in order to identify the fundamental normative postulates of liberal theory as it pertains to international relations, especially regarding the use of military force. The article then advances two interrelated arguments: First, that the underpinnings of the (...) decision to invade Iraq embodied in the Bush Doctrine draw heavily from the liberal tradition, though still depart from it in important ways. Second, that the Bush Doctrine as manifested in the Iraq war reflects in many ways the liberal thinking that prevailed during the interwar years and is therefore susceptible to a similar charge of ‘utopianism’ that was leveled against interwar liberalism by E. Informal justice often is castigated as rough justice, procedurally unauthorized and substantively unrationalized and prone to error. Yet those same features are present, to some extent, in formal justice as well: they do not form the basis for any sharp categorical contrast between formal and informal justice. Furthermore, some roughness in justice may be no bad thing. Certain of those elements of roughness in formal justice are inextricably bound up with other features of formal justice that are rightly deemed morally (...) important. The International Committee of the Red Cross (ICRC) offers a dilemma for international political theory. ICRC's success as a humanitarian actor in international conflict is credited to its neutral stance. However, ICRC neutrality is vulnerable to serious challenges regarding its supposed avoidance of the political. ICRC neutrality is commonly dismissed as either illusory or impossible. The problem is not grounded in the principle of neutrality itself, though, but rather in the lack of critical engagement with what it means to be (...) neutral on a humanitarian register. ICRC misreads the demands of neutrality in such ways as to permit both partiality and irresponsibility to its mission. Drawing from Roland Barthes' address of the neutral, I argue that international humanitarianism is possible as a neutral movement but that this neutrality can only be such through vigorous and fundamentally political movement responsible to the goals of human well-being and dignity as questions. There has been a recent revival of interest in the medieval just war theory. But what is the virtue of justice needed to make war just? War is a complex and protracted activity. It is argued that a variety of virtues of justice, as well as a variety of virtues are required to guide the application of the use of force. Although it is mistaken to regard war as punishment, punitive justice—bringing to account those guilty of initiating an unjust war (...) or of war crimes in its conduct— has an important role to play after conflict to restore the wrongs of war and help establish a just peace. Justice as fairness is needed to guide the distribution of resources and so reduce the grounds for war. Protective justice—protecting a community or innocents from harmful attack—helps define what constitutes a just cause for war and so constrains the occasions for war. The just principles set out the criteria to be met if war is to be morally permissible. In practice, this challenging demand requires that political leaders and military at all levels learn and exercise the virtues, particularly the cardinal virtues of justice, courage, self-control and practical wisdom. If we are to make war just and to make only just war, we need justice understood in its broadest sense. Such justice, as Aristotle noted, “is not a part but the whole of virtue.”. (shrink)

Citizens require independent reporting more than ever in the news coverage of conflict in the 21st century. The traditional role of national governments has been compromised both by terrorism and by technology that makes hard borders porous. It is unlikely that citizens or policymakers will cope with those changes unless they are reminded how the world has changed. That is an essential role for journalism, and provides a distinction between the terms nationalistic press and patriotic press. Abstract In this paper I set the debate between Kant and Schiller in terms of the role that an ideal of life can play within an autonomist ethic. I begin by examining the critical role Schiller gives to emotions in tackling specific motivational concerns in Kant's ethics. In the Kantian response I offer to these criticisms, I emphasise the role of metaphysics for a proper understanding of Kant's position whilst allowing that with respect to moral psychology, Kant and Schiller are (...) in agreement about the importance of emotions in our moral lives. I conclude by returning to the themes broached in the introduction to consider the extent to which the teleological concerns that motivate Schiller can be addressed within Kant's autonomist ethics. Although my position is in basic agreement with the notion that war and militarism are feminist issues, I argue that approaches to the ethics of war and peace which do not consider "peacetime" military violence are inadequate for feminist and environmentalist concerns. Because much of the military violence done to women and ecosystems happens outside the boundaries of declared wars, feminist and environmental philosophers ought to emphasize the significance of everyday military violence.

This paper examines the conceptual development of the philosophical justifications for tyrannicide. It posits that the political philosophy of tyrannicide can be categorised into three distinct periods or models, the classical, medieval, and liberal, respectively. It argues that each model contained unique themes and principles that justified tyrannicide in that period; the classical, through the importance attached to public life and the functional role of leadership; the medieval, through natural law doctrine; and the liberal, through the postulates of social contract (...) theory. Subsequent analysis of these different models however, reveals that these historical models are unable to provide a sufficient philosophical basis for a contemporary justification of tyrannicide. In Part II, it will be contended that a reinvigorated conception of self-defence, a theme common to all three models, when coupled with the modern notion of universal human rights, may provide the foundation for a contemporary theory of tyrannicide. This paper aims to reconstruct Francis Hutcheson's thinking about liberty. Since he does not offer a detailed treatment of philosophical questions concerning liberty in his mature philosophical writings I turn to a textbook on metaphysics. We can assume that he prepared the textbook during the 1720s in Dublin. This textbook deserves more attention. First, it sheds light on Hutcheson's role as a teacher in Ireland and Scotland. Second, Hutcheson's contributions to metaphysical disputes are more original than sometimes assumed. To appreciate (...) his independent thinking, I argue, it is helpful to take the intellectual debates in Ireland into consideration, including William King's defence of free will and discussions of Shaftesbury's views in Robert Molesworth's intellectual circle. Rather than taking a stance on the philosophical disputes about liberty, I argue that Hutcheson aims to shift the focus of the debates towards practical questions concerning control of desire, cultivation of habits, and character development. This paper takes a new look at Francis Hutcheson's moral sense theory and examines it in light of the views of his rationalist critics and opponents who claim that there has to be an antecedent moral standard prior to any sense or affections. I examine how Gilbert Burnet, Samuel Clarke, and Catharine Trotter Cockburn each argue for the priority of reason over a moral sense and how Hutcheson responds or could respond to their views. Furthermore, I consider the proposal that (...) rather than regarding Hutcheson's moral sense theory as fundamentally opposed to moral rationalism, Hutcheson and Clarke endorse a shared moral metaphysics, as argued by Patricia Sheridan. Although I consider this proposal as too broad and believe it overlooks relevant metaphysical differences between Clarke and Hutcheson, I argue that the dispute between Hutcheson and his critics and opponents will not be settled without taking their underlying moral metaphysics into consideration. Recently it has been proposed that humans possess an innate, domain-specific moral faculty, and that this faculty might be fruitfully understood by drawing a close analogy with nativist theories in linguistics. This Linguistic Analogy hypothesizes that humans share a universal moral grammar. In this paper I argue that this conception is deeply flawed. After profiling a recent and appealing account of universal moral grammar, I suggest that recent empirical findings reveal a significant flaw, which takes the form of a dilemma: (...) either there is something wrong with the moral grammar model because we do not actually possess the innate contents it says we have, or the moral grammar model is simply the wrong model of moral cognition. In light of this dilemma, I conclude we ought to be skeptical that the Linguistic Analogy can adequately serve as a general account of moral cognition. (shrink)

The overall moral status of an option—whether it is required, permissible, forbidden, or something we really should do—is explained by competition between the contributory reasons bearing on that option and the alternatives. A familiar challenge for accounts of this competition is to explain the existence of latitude: there are usually multiple permissible options, rather than a single required option. One strategy is to appeal to distinctions between reasons that compete in different ways. Philosophers have introduced various kinds of non-requiring reasons (...) that do not generate requirements, even if they win the competition. This paper rejects two familiar versions of this strategy, one appealing to merely justifying reasons and one appealing to merely commendatory reasons. It offers a new account of how reasons compete that instead appeals to a sharp distinction between the reasons against an option and the reasons for the alternatives to that option. (shrink)
