This dissertation seeks to examine the validity of the justification commonly offered for a coercive (1) psychiatric intervention, namely that the intervention was in the ‘best interests’ of the subject and/or that the subject posed a danger to others. As a first step,it was decided to analyse justifications based on ‘best interests’ [the ‘Stage 1’ argument] separately from those based on dangerousness [the ‘Stage 2’ argument]. Justifications based on both were the focus of the ‘Stage 3’ argument. Legal and philosophical (...) analyses of coercive psychiatric interventions generally regard such interventions as embodying a benign paternalism occasioning slight, if any, ethical concern. Whilst there are some dissenting voices even at the very heart of academic and professional psychiatry, the majority of psychiatrists also appear to share such views. The aim of this dissertation is to show that such a perspective is mistaken and that such interventions raise philosophical and ethical questions of the profoundest importance.(2) The philosophical well-spring of the Stage 1 dissertation argument lay in an observation made by Philippa Foot (3) that the “… right to be let free from unwanted interference” is one of the most fundamental and distinctive rights of persons, a right which takes precedence over any “… action we would dearly like to take for his sake.” This – in conjunction with the recognition that some coercive psychiatric interventions are of a gravity as to result in the personhood of the subject being severely damaged if not destroyed – suggested that the concept of personhood play a central role in the formulation of the dissertation argument. For ease of analysis it was presumed that the term ‘person’ could be defined by a set of necessary and sufficient conditions of which ‘minimum levels of rationality’ and ‘ability to communicate’ were the only conditions relevant to the formulation of justifications for coercive psychiatric interventions. This presumption was explicated into a number of postulates which enabled the construction of a rigorous foundation on which to develop the dissertation argument. This argument then sought to determine whether psychiatric assessments of irrationality were accurate and reliable. In furtherance of this analysis it was necessary to examine the reliability of psychiatric determinations in other areas of claimed expertise namely diagnosis, treatment and assessment of dangerousness. This ‘crossing of the disciplinary threshold’ brought to light the dearth of studies on psychiatric misdiagnosis and iatrogenic harm. A variant of the Precautionary Principle was developed to enable the extent of such harms to be estimated. The literature on ethical decision-making is rooted in a cognitive perspective that emphasizes the role of moral judgment. Recent research in interpersonal dynamics, however, has suggested that ethics revolves around an individual’s perceptions and views of others. We draw from both literatures to propose and empirically examine a contingent model. We theorize that whether the individual relies on cognitions about the ethical issue or perceptions of others depends on the level of social consensus surrounding the issue. We test our hypotheses (...) in three studies. Results suggest that not only does social consensus determine whether an individual relies on ethical cognitions about the issue or perceptions of others, but also that an individual’s view of self is an important moderator in these relationships. The thesis adapts Bourdieu’s theory of hexis as a method for approaching the Baillie (Hegel/Baillie, 1910/1931) and Pinkard (Hegel/Pinkard, 2008) translations of Hegel’s Die Phänomenologie des Geistes (Hegel, 1807/1970) as embodiments of a translatorial practice informed by social and philosophical contextual factors. The theoretical concept of a translatorial hexis is analogous to Bourdieu’s habitus but differs in that the translatorial hexis embodies a specifically dominant, honour-seeking stance of the translator with regard to the micro-dynamics of the surrounding sub-fields; the translatorial (...) hexis is also embodied primarily in the detail of the text and in the peritexts to the translations. Chapters 3 and 4, which focus on the Baillie and Pinkard translations, are each divided into three sections: an analysis of the historical background to the translation in terms of interrelated Bourdieusian fields defined by rival positions vying for academic reputation; an analysis of lexical patterning identified in TT corpora with reference to the translations of two ‘dialectically ambiguous’ terms Geist [mind/spirit] and aufheben [cancel/preserve/sublate]; an analysis of peritexts to the two translations. Starting with a discussion of Hegel’s ‘dialectical ambiguity’ in chapter 1 and an elaboration of the Bourdieusian theoretical framework in chapter 2, the thesis attempts to explain the lexical findings with reference to the concept of translatorial hexis in a manner which takes philosophical and sociological factors into consideration as determinants of the translators’ strategies. The analysis focuses on the positioning of Sir James Black Baillie with regard to Absolutist and Personalist versions of British Idealism and Terry Pinkard with regard to the non-metaphysical readings of Hegel and the development of communitarian ideologies.The publication of new translations of Hegel’s works and new critical works on German Idealism suggest that a Hegel revival is in full progress. Given the centrality of translation to this phenomenon, it is appropriate that translation studies should contribute to the discussion, especially to demonstrate the value of a self-reflexive, multi-disciplinary approach which brings linguistic analysis and sociological contextualisation to bear on some of the philosophical issues at stake. Self-discovery leads to the development of the ethics of self-mastery. Many ethical systems prescribe how the individual could attain self-mastery by means of critical self-examination or self-analysis. Once such critical self-examination or self-analysis is successfully carried out, the individual begins to use himself, his personal preferences, as the standard of what is right or wrong. This is the background to the Confucian, Kantian and Existentialist ethics of categorical imperatives. Even in religious ethical systems that attribute the source of the moral (...) law to divine authority, the individual still has to take a leap of faith to discover God's purpose for his existence, which he then internalizes. In the final analysis, any ethics that truly works must issue forth from the self. Hence self-mastery is the absolutely fundamental premise upon which to erect a sound moral character. (shrink)

The Chinese room argument has presented a persistent headache in the search for Artificial Intelligence. Since it first appeared in the literature, various interpretations have been made, attempting to understand the problems posed by this thought experiment. Throughout all this time, some researchers in the Artificial Intelligence community have seen Symbol Grounding as proposed by Harnad as a solution to the Chinese room argument. The main thesis in this paper is that although related, these two issues present different problems in (...) the framework presented by Harnad himself. The work presented here attempts to shed some light on the relationship between John Searle’s intentionality notion and Harnad’s Symbol Grounding Problem. (shrink)

Amartya Sen argues that for the advancement of justice identification of ‘perfect’ justice is neither necessary nor sufficient. He replaces ‘perfect’ justice with comparative justice. Comparative justice limits itself to comparing social states with respect to degrees of justice. Sen’s central thesis is that identifying ‘perfect’ justice and comparing imperfect social states are ‘analytically disjoined’. This essay refutes Sen’s thesis by demonstrating that to be able to make adequate comparisons we need to identify and integrate criteria of comparison. This is (...) precisely the aim of a theory of justice (such as John Rawls’s theory): identifying, integrating and ordering relevant principles of justice. The same integrated criteria that determine ‘perfect’ justice are needed to be able to adequately compare imperfect social states. Sen’s alternative approach, which is based on social choice theory, is incapable of avoiding contrary, indeterminate or incoherent directives where plural principles of justice conflict. (shrink)

With the publication of A Theory of Justice in 1971, John Rawls not only rejuvenated contemporary political philosophy but also defended a Kantian form of Enlightenment liberalism called “justice as fairness.” Enlightenment liberalism stresses the development and exercise of our capacity for autonomy, while Reformation liberalism emphasizes diversity and the toleration that encourages it. These two strands of liberalism are often mutually supporting, but they conflict in a surprising number of cases, whether over the accommodation of group difference, the design (...) of civic education, or the promotion of liberal values internationally. During the 1980’s, however, Rawls began to jettison key Kantian characteristics of his theory, a process culminating in the 1993 release of Political Liberalism and completing the transformation of justice as fairness into a Reformation liberalism. -/- Reconstructing Rawls argues that this transformation was a tragic mistake because it jeopardized the most important features of his theory, viz. the lexical priorities of right, liberty, and fair equality of opportunity as well as the difference principle. Controversially, this book contends that Rawls’s so-called “political turn,” motivated by a newfound interest in diversity and the accommodation of difference, has been unhealthy for autonomy-based liberalism and has pushed liberalism more broadly towards cultural relativism, be it in the guise of liberal multiculturalism or critiques of cosmopolitan distributive-justice theories. The book then demonstrates that the central elements of justice as fairness can only be defended within the context of a Kantian Enlightenment liberalism and that Rawls’s hope for a more pluralistic grounding for his theory, endorsed by a wide variety of belief systems present in modern democratic societies, is illusory. -/- Reconstructing Rawls is the first book to systematically compare Rawls’s and Kant’s theories and the first to offer an internal critique and reconstruction of justice as fairness, reconceiving it as a comprehensive, universalistic Kantian liberalism. By doing so, it gives us both the vision of a liberal world order—“a republicanism of all states, together and separately,” as Kant put it—and a mode of justification addressed to all men and women, not as members of particular nations, races, and faiths, but as human beings, as citizens of the world. There is considerable debate in comparative psychology and philosophy over whether nonhuman animals can attribute beliefs. The empirical studies that suggest that they can are shown to be inconclusive, and the main philosophical and empirical arguments that purport to show they cannot are shown to be invalid or weak. What is needed to move the debate and the field forward, it is argued, is a fundamentally new experimental protocol for testing belief attribution in animals, one capable of distinguishing genuine belief-attributing (...) subjects from their perceptual-state attributing and behavior-reading counterparts. Such a protocol is outlined and defended. The rest, it is argued, is in the hands of experimentalists. (shrink)

John McDowell’s original motivation of disjunctivism occurs in the context of a problem regarding other minds. Recent commentators have insisted that McDowell’s disjunctivism should be classed as an epistemological disjunctivism about epistemic warrant, and distinguished from the perceptual disjunctivism of Hinton, Snowdon and others. In this paper I investigate the relation between the problem of other minds and disjunctivism, and raise some questions for this interpretation of McDowell.

. Gustav Radbruch is one of the most important German-speaking philosophers of law of the twentieth century. This paper raises the question of how to classify Radbruch's theories in the international context of legal philosophy and philosophy in general. Radbruch's work was mainly influenced by the southwest German school of Neo-Kantianism, represented by Windelband, Rickert, and Lask. Their theories of culture and value show an affirmative-holistic understanding of philosophy as a source of wisdom and meaningfulness. Kant, on the other hand, (...) belongs more to a fundamentally different, critical camp of philosophy. Although Radbruch has incorporated Kantian Elements into his theory, he is rather a member of the affirmative-holistic camp. In the end the question will be raised as to what ought to be preserved of his philosophy. (shrink)

Psychological theory and research in ethical decision making and ethical professional practice are presently hampered by a failure to take appropriate account of an extensive background in moral philosophy. As a result, attempts to develop models of ethical decision making are left vulnerable to a number of criticisms: that they neglect the problems of meta-ethics and the variety of meta-ethical perspectives; that they fail clearly and consistently to differentiate between descriptive and prescriptive accounts; that they leave unexplicated the theoretical assumptions (...) derived from the underlying moral theories; and that they fail to accommodate the complexity and comprehensiveness of the processes involved in the making and implementing of ethical decisions. Many of these problems also have implications for the methodological domain. This paper offers an analysis of the difficulties, and makes a number of recommendations for future theory, research and practical applications, including: the need for training in moral philosophy; clarification of the status of Professional Codes in decisional models; the development of theoretically comprehensive prescriptive models; and the testing of these models in ways that do justice to their dimensional scope and theoretical complexity. The terms immanence and transcendence have played a significant role in philosophical thought since its inception. Implicit in the notions of immanence and transcendence, as typified within the history of ideas, is often a separation and division between the human and the godly. This division has served to generate ontologies of isolation and set up epistemologies that can be both binary and divided. The terms immanence and transcendence thus sit at the heart of contemporary onto-epistemic accounts of the world. As (...) such, in seeking to examine the nature of what is, this paper traces a line through the history of ideas in an attempt to clarify the connections and dissonances in the notions of immanence and transcendence. Among the civilization challenges, recognizing the human freedom and drawing its constraints have continuously been contestable. Hence, the recognition, definition, pledge and delineation of the boundaries of freedom have a special position in the declaration of rights. In the meantime, considering the historical intersection of jurisprudential foundations with the modernist thoughts, defining the concept of freedom and delineating its boundaries will be crucial. This definition provides a groundwork for elucidating and interpreting other Articles via identifying their positions in creating solutions (...) to the problems of public administration. The current study is an effort to recognize the concept of freedom and its boundaries in the constitutional system of the Islamic Republic of Iran via employing a descriptive-analytical method. Our findings indicate that the perception of freedom in the Constitution of the Islamic Republic of Iran is convoluted and interpretable. Because of the existing ambiguities in balancing among the historical concerns, the boundaries of freedom can be redefined based on the temporal and historical circumstances by the pressure of social forces. This article concerns the ways in which authors from various fields conceptualise the ethical issues arising in the conduct of research. We reviewed critically and systematically the literature concerning the ethics of conducting research in order to engage in a reflection about the vocabulary and conceptual categories used in the publications reviewed. To understand better how the ethical issues involved in conducting research are conceptualised in the publications reviewed, we 1) established an inventory of the conceptualisations reviewed, and 2) we (...) critically assessed them. We found that the publications reviewed mostly showed examples of descriptive ethics, in that most authors describe ethical issues without reflecting much on them, which could be explained both by 1) a lack of ethical education in research contexts, and 2) by the fact that we do not know what researchers know (or do not) about ethical issues. Additionally, the definitions identified in the publications are scarce and at times imprecise, but this seems more to point out the ethical vocabulary’s difficulties in certain contexts. Further, very few authors offer proper conceptualisations of the ethical issues arising in conducting research. When dealing with vast arrays of ethical issues to conceptualise, perhaps one ought to remember that some typologies already exist that could guide further reflection and help understand other realities for which the current ethical vocabulary may be lacking. We believe that combining the reviewed typologies, both with other well-developed typologies and critical reflection, could help support better ethical practice in conducting research. (shrink)

Human beings are by nature enshrined in an inescapable world - hood web called language. As a symbolic construction and human agenda setting in semantic space, language ensures the application of social meaning, control, culture and social knowledge. As a re sult of the place that language occupies in the integration, interpretation and internalization of convention for the state of affairs of sociality, it is not surprising that it has always been an attractive area and a fascinating topic for philosophers. (...) T he history of philosophical thinking about language is almost impossible to separate from the history of logic and indeed the entire history of philosophy. This piece argued that human beings do not live in the world without the agency of language which be comes the medium of expression within particular societies. It is based on this understanding (that the real world of a people is based on their language habits) that this paper employed Igwebuike as an ontological toolbox that forms the trajectory system of the Igbo - African world. Within the context of Igbo - African philosophy of language, this piece argued for the necessity of the use of the word “Igwebuike” as it captures and communicates the Igbo - African world. Igwebuike is the form (and symbolic) of the Igbo - African mental being, and thus, the gateway to Igbo - African philosophy. Beyond the literal understanding of Igwebuike (Igwe - number; bu - is; ike - strength) as ‘there is strength in number’, it captures the Igbo philosophy of relationality, complementar ity and interconnectedness of reality. The objective of this work is to discover the centrality of language within philosophy and thus give correct bearing to philosophy. For the purpose of this piece, the Igwebuike holistic approach will be employed. (shrink)

Sometimes you make a choice. Whether or not you made it was up to you. The choice was free. But how can this be? A scientific view of the world may leave no room for free choice. Free will literature continually explodes. Yet experts still focus on control or on a power to do otherwise. Sadly, they neglect another intuitive feature of free will: being an underived source or ultimate originator. When acting freely, one is a self-determined, self-directed, sole author (...) of change. Surprisingly, though the literature is replete with this pre-theoretic feature of free will, virtually no one makes rigorous use of it when constructing arguments. Equipped with fresh research, this book contends that agent-causation—currently an unpopular theory—deserves serious reconsideration. Only agent-causation accounts for ultimate origination, and popular objections fail under rigorous scrutiny. This book is tightly argued. It challenges and deepens recent advances in free will scholarship made by Peter van Inwagen, Robert Kane, Carl Ginet, Randy Clarke, Stewart Goetz, Tim O’Connor, and others. (shrink)

In this essay we provide (1) an argument for why ethics should be naturalized, (2) an analysis of why it is not yet naturalized, (3) a defense of ethical naturalism against two fallacies—Hume’s and Moore’s—that ethical naturalism allegedly commits, and (4) a proposal that normative ethics is best conceived as part of human ecology committed to pluralistic relativism. We explain why naturalizing ethics both entails relativism and also constrains it, and why nihilism about value is not an especially worrisome for (...) ethical naturalists. This article claims that events, facts and states of affairs need to be differentiated. It takes as a starting point Chisholm’s claim that only his ontology of states of affairs explains effectively thirteen sentences related to propositions and events. He does this by reducing propositions and events to states of affairs. We argue that our ontology also solves those problems. We defend a hierarchized Platonist ontology that has concrete entities and abstract entities. The distinctions we propose allow us to explain (...) the pre-analytic data analyzed by Chisholm without reducing entities. We claim that our ontology provides a different way of explaining that data, and is, thus, promissory. (shrink)

The representative theory of perception is one of the realist theories of perception which maintains we do not have direct access to the objects of perception; our ideas represent some objective objects in the world. In this paper, I will address the question about the representative nature of mental ideas from a Thomistic perspective. I will explore if some Thomists are entitled to claim that Aquinas’ theory of knowledge based on his metaphysics can provide a basis for resolving this issue. (...) I will argue that this question is wrong-headed and it should be replaced with the following question: If we assume the existence of a real world and that we are not under the influence of hallucination, how we can know that our ideas truly represent the world? This paper explores early Australasian philosophy in some detail. Two approaches have dominated Western philosophy in Australia: idealism and materialism. Idealism was prevalent between the 1880s and the 1930s, but dissipated thereafter. Idealism in Australia often reflected Kantian themes, but it also reflected the revival of interest in Hegel through the work of ‘absolute idealists’ such as T. H. Green, F. H. Bradley, and Henry Jones. A number of the early New Zealand philosophers were also educated in the idealist tradition (...) and were influential in their communities, but produced relatively little. In Australia, materialism gained prominence through the work of John Anderson, who arrived in Australia in 1927, and continues to be influential. John Anderson had been a student of Henry Jones, who might therefore be said to have influenced both main strands of Australian philosophical thought. (shrink)

This paper is prompted by the charge that the prevailing Western paradigm of medical knowledge is essentially Cartesian. Hence, illness, disease, disability, etc. are said to be conceived of in Cartesian terms. The paper attempts to make use of the critique of Cartesianism in medicine developed by certain commentators, notably Leder (1992), in order to expose Cartesian commitments in conceptions of disability. The paper also attempts to sketch an alternative conception of disability — one partly inspired by the work of (...) Merleau-Ponty. In particular, three key Cartesian claims are identified and subjected to criticism. These are as follows: (a) The claim that the body is an object, (b) what is termed here ‘the modularity thesis’, and (c) the claim that the body cannot be constitutive of the self (i.e. since the soul/mind/brain is). In opposition to these claims, it is argued that the body is properly viewed as a subject; that there are neither purely mental, nor purely physical disabilities; and that selves are constituted, at least in part, by their bodies. This article discusses Heidegger’s interpretation of Parmenides given in his last public lecture ‘The Principle of Identity’ in 1957. The aim of the piece is to illustrate just how original and significant Heidegger’s reading of Parmenides and the principle of identity is, within the history of Philosophy. Thus the article will examine the traditional metaphysical interpretation of Parmenides and consider G.W.F. Hegel and William James’ account of the principle of identity in light of this. It will then consider Heidegger’s contribution, (...) his return to and re-interpretation of Parmenides in his last lecture. Heidegger will, through the Parmenidean claim that ‘Thinking and Being are one’ deconstruct the traditional metaphysical understanding of the principle of identity, and in its place offer a radically different conception of how our relationship, our ‘belonging together’ with Being can be understood. This paper shows how the universals of category theory in mathematics provide a model (in the Platonic Heaven of mathematics) for the self-predicative strand of Plato's Theory of Forms as well as for the idea of a "concrete universal" in Hegel and similar ideas of paradigmatic exemplars in ordinary thought. The paper also shows how the always-self-predicative universals of category theory provide the "opposite bookend" to the never-self-predicative universals of iterative set theory and thus that the paradoxes arose from having (...) one theory (e.g., Frege's Paradise) where universals could be either self-predicative or non-self-predicative (instead of being always one or always the other). The article looks at critical thinking in philosophical counselling and the concepts upon which it is based. In conceptions that place critical thinking as the basis of philosophical counselling, an important role is played by the Socratic approach to philosophising. The Socratic method in thinking allocates a fundamental role to conversation, and thus to intersubjectivity, and is therefore an alternative to individual ways of thinking. Conversation as philosophical reflection corresponds to the Socratic intersubjective understanding of truth. The author adopts the (...) view of German philosopher H. Schnädelbach who distinguishes between dialogic and doctrinal approaches. The dialogic approach is found in the Socratic-Platonic tradition, while the doctrinal approach is found in Aristotelean approaches. Doctrinal philosophising is premised in the ideal of intersubjectivity which can be achieved by anyone. Philosophical thought as reflection is always implicitly dialogic at the very least. The article considers definitions of critical thinking and provides examples of critical thinking based philosophical counselling from the thinking of Tim LeBon and Elliot D. Cohen, which link both philosophical and psychological approaches. In conclusion it is critical of an excessive focus on rationality in counselling. (shrink)

Aesthetics is a vexed topic in philosophy, with a long history. For my purposes, an aesthetic experience is a foundational affective response to an object, to which terms such as “ugly”, “beautiful”, “pretty” or “harmonious” are applied. These terms are derived from a Discourse of aesthetics; some remain constant, others change from generation to generation. Aesthetics and ethics have been linked in Western thought since the days of Plato and Aristotle. This essay examines what is happening to that link in (...) contemporary experience. It emphasises the ways in which the popular media exploit aesthetic appeal to penetrate their market, and to exploit and frame intuitive responses to current and past events. Production values, the artfulness of editors and the financial interests of producers and directors thus do much to determine contemporary aesthetic and ethical judgements. That which is beautifully presented invites the ethical involvement of the audience. Events whose images are beautifully presented constitute “hyperevidence”, a pre-judged, reinforced and amplified illusion of reality and participation. Understanding how aesthetic excellence draws audiences into ethical relationship with what is presented becomes an important part of education in ethics, including bioethics. (shrink)

In medicine, knowledge is connected to pain and suffering and beauty to health. The production of knowledge is directed towards doing good by avoiding bad. At the same time, medicine is also governed by aesthetics. A range of challenges follow from the connection between the three spheres, but if we are attentive to the interconnectedness medicine becomes a fascinating and fruitful rendezvous of truth, goodness, and beauty. _Keywords_: Evidence, ethics, aesthetics, truth, goodness, beauty. This is an instructor’s manual with student exercises for the Analytic Philosophy and Philosophy of Language course. It is intended to assist the instructor in teaching the subject to students for whom English is a second language. -/- This manual begins with a chapter that describes the types of learning activities during this course. Next are topic chapters, each of which has four sections: a synopsis of the lecture on the topic; a lecture lesson worksheet with tasks; a seminar lesson (...) worksheet with tasks; and assignments for essay writing. The Buddha, unlike the Upaniṣadic or Brahmanical way, has avoided the concept of the self, and it seems to be left with limited conceptual possibilities for free will and moral responsibility. Now, the question is, if the self is crucial for free will, then how can free will be conceptualized in the Buddhist ‘no-self’ (anattā) doctrine. Nevertheless, the Buddha accepts a dynamic notion of cetanā (intention/volition), and it explicitly implies that he rejects the ultimate or absolute freedom of the will, (...) but not the minimal power of free will. It seems that the Buddha’s view shifts from agent causation (independent ownership) to a causal sequence of impersonal processes (psychophysical factors). This paper claims to shed clarity on ‘whether free will is viable in the context of the anattāvāda in Buddhism.’ It mainly studies the secondary sources (even though it has also discussed the primary sources) and their interpretations of freedom of the will and how it further does argue for a compatibility approach of free will in Buddhist thought. El escepticismo moral sostiene que las proposiciones morales no son verdaderas ni falsas de acuerdo al criterio de verdad por correspondencia, y que el criterio de verdad por coherencia no es aplicable en moral. Para refutarlo, habría que mostrar la existencia de hechos morales, o demostrar que la coherencia es suficiente para una buena teoría moral. El artículo sostiene que esto no puede hacerse. Moral skepticism maintains that moral propositions are no true, nor false, according with the correspondence theory of (...) truth, and the coherence theory of truth is not applicable in morality. To refute it, somebody has to prove the existence of moral facts, or demostrate that coherence is a sufficient condition for a good moral theory. According the paper, this cannot be done. (shrink)

The reconstruction of meaning in the aftermath of sudden infant death syndrome (SIDS) is part of the grieving process but has to date been poorly understood. Earlier theorists including Freud, Bowlby and Kübler‐Ross provided a foundation for what occurs during this time using stage theories. More recent researchers, often using qualitative techniques, have provided a more complex and expanded view that enhances our knowledge of meaning reconstruction following infant loss. This overview of representative contemporary authors compares and contrasts them with (...) the longstanding models that are being supplanted within the emerging field of thanatology. Understanding parental reactions within this new framework can help healthcare professionals in dealing with those affected by SIDS and provide a more empathic and sensitive approach to individual differences. Parents’ own accounts of their post‐SIDS experience are consistent with these newer theories. Comprehending how parents cope and reconstruct their lives is an important element in providing appropriate psychological support services. (shrink)

Nicholas Rescher embraces a more objectivist, realist, analytic pragmatism than the pragmatism which has been in vogue in the last two decades. He rejects any pragmatism for which there is no truth, reality, or objectivity but only conversations or solidarity within this or that vocabulary. Rescher has argued that pragmatism, far from being anti-realist, provides the only good argument for realism and for our ability to operate the causal model of inquiry about the real world. I examine this kind of (...) pragmatist argument, point out its pitfalls, and argue that Rescher avoids them. (shrink)

Judgements concerning proper or appropriate educational endeavour, methods of investigation and philosophising about education necessarily implicate perspectives, values, assumptions and beliefs. In recent years ideas from the complexity sciences have been utilised in many domains including psychology, economics, architecture, social science and education. This paper addresses questions concerning the appropriateness of utilising complexity science in educational research as well as issues relating to the ways in which complexity might be engaged. I suggest that, just like all human endeavour, approaches to (...) research emerge out of discursive communities and can be understood as self‐organising, dynamic and emergent over time. In this formulation, complexity represents one such newly emergent approach. I argue that it is important that researchers partake in critical and reflective discourse about the nature of education and conceptual frameworks, as well as about impacts and legacies of utilising complexity, so as to participate in and influence the ongoing emergence of educational endeavour. I conclude by suggesting a series of caveats for researchers considering using complexity in educational research. (shrink)

On the assumption that theistic religious commitment takes place in the face of evidential ambiguity, the question arises under what conditions it is permissible to make a doxastic venture beyond one’s evidence in favour of a religious proposition. In this paper I explore the implications for orthodox theistic commitment of adopting, in answer to that question, a modest, moral coherentist, fideism. This extended Jamesian fideism crucially requires positive ethical evaluation of both the motivation and content of religious doxastic ventures. I (...) suggest that, even though the existence of horrendous evil does not resolve evidential ambiguity in favour of atheism, there are reasonable value commitments that would preclude those who hold them from satisfying extended Jamesian fideist conditions for committing themselves to classical theism. I then begin a discussion of a possible revisionary theistic alternative (in the Christian tradition) which – one might hope – may meet those conditions. During the past few decades, a radical shift has occurred in how philosophers conceive of the relation between science and philosophy. A great number of analytic philosophers have adopted what is commonly called a ‘naturalistic’ approach, arguing that their inquiries ought to be in some sense continuous with science. Where early analytic philosophers often relied on a sharp distinction between science and philosophy—the former an empirical discipline concerned with fact, the latter an a priori discipline concerned with meaning—philosophers today largely (...) follow Willard Van Orman Quine (1908-2000) in his seminal rejection of this distinction. -/- This book offers a comprehensive study of Quine’s naturalism. Building on Quine’s published corpus as well as thousands of unpublished letters, notes, lectures, papers, proposals, and annotations from the Quine archives, this book aims to reconstruct both the nature (chapters 2-4) and the development (chapter 5-7) of his naturalism. As such, this book aims to contribute to the rapidly developing historiography of analytic philosophy, and to provide a better, historically informed, understanding of what is philosophically at stake in the contemporary naturalistic turn. The United Nation’s mandate to engineer international peacecraft is correlated with the promotion of universal human rights. Universal human rights are held to apply consistently to everyone everywhere without conceivable exception. There is some debate as to whether universal human rights possibly exist. This debate centers around two difficulties: 1) the task of identifying a single trait or capability that all human beings necessarily share, and 2) the task of relating human rights to this trait or capability. Conventional epistemic justifications (...) defending the existence of universal human rights attempt to address both difficulties. However, they have become the focus of numerous criticisms. By conducting systematizing and critically reviewing text analyses, I will conclude that conventional epistemic justifications are unable to refute standard criticisms satisfactorily. In their place, I will introduce an epistemic justification from the philosophy of mind. I will attempt to demonstrate that this justification is capable of 1) identifying a single trait that all human beings necessarily share, 2) relating human rights to this trait, and 3) satisfactorily refuting the standard criticisms raised against conventional epistemic theories. I have produced this paper in the hope of further legitimizing the UN’s mandate to engineer international peacecraft by providing a more philosophically optimal justification of claims affirming the existence of universal human rights. Since the rise of modern natural science there has been deep tension between the conceptual and the natural. Wittgenstein's discussion of how we learn a sensation-language contains important resources that can help us relieve this tension. The key here, I propose, is to focus our attention on animal nature, conceived as partially re-enchanted. To see how nature, so conceived, helps us relieve the tension in question, it is crucial to gain a firm and detailed appreciation of how the primitive-instinctive, a (...) central part of animal nature, actually serves the conceptual. I offer such an appreciation by closely examining §244 of the Philosophical Investigations and Peter Winch's discussion of it. The general aim is to bring out a certain kind of Wittgensteinian “naturalism”, a “naturalism” that is fully alive to the rootedness of conceptuality in nature. A concomitant aim is to illustrate the truth of Wittgenstein's saying that in philosophy one often has to pay close attention to details. (shrink)

The grounds for critique offered by Roy Bhaskar have developed over the course of his work, but two claims have remained central: ethical naturalism and moral realism. I argue that neither of these is compatible with a scientific realist understanding of values: a scientific realist approach commits one to treating values as socially produced and historically contingent. This does not, however, prevent us from reasoning about values, nor from developing critiques by combining ethical reasoning with a theoretical understanding of the (...) social world and its possibilities. In particular, we can draw on a variety of Habermas's discourse ethics to offer provisional justifications for value-claims that support a critical stance. Thus we can develop grounds for critique that are both ontologically credible and anti-foundational, but also judgementally rational. (shrink)

Bu tanımın temel hareket noktası, modern hukuk kavrayışındaki hakim pozitivist bakış açısının eleştirisine dayanır. Bu eleştiri, hem sivil itaatsizliğin tanımına hem de onun adli anlamda yargılanmasına yeni bir bakış açısı getirmiştir. Bu çalışma, Ronald Dworkin’in sivil itaatsizliğe yönelik yeni bakış açısını incelerken, aynı zamanda sivil itaatsizliği, modern hukukun pozitivist yapısının liberal bir eleştirisi olarak okumanın imkanını arayacaktır.
