Negotiation is mainly treated as a process through which counterparts try to satisfy their conflicting interests. This traditional, subjective approach focuses on the interests-based relation between subjects and the resources which are on the bargaining table; negotiation is viewed as a series of joint decisions regarding the relation of each subject to the negotiated resources. In this paper, we will attempt to outline an intersubjective perspective that focuses on the communication-based relation among subjects, a relation that is founded upon communicative (...) rationality mechanisms which are inherent in social activity. Much in contrast to the concept of interests which describe the relationship of each subject alone to the resources, we will use the concept of ?claim-rights? which are properly formed and validated only vis-à-vis negotiating partners and on the basis of the communication that develops among them. We will offer a step-by-step account of the creation of claim-rights and argue that their validation does not necessarily lie in the parties? interests, but in the communication mechanisms that induce consensus and result in mutually acceptable outcomes. The sacred has survived where religion has not. The sacred is acknowledged by prominent atheists and agnostics. They emphatically agree that the person is sacred and less clearly that nature is as well. Closer examination of their remarks shows that today the sacred comes in two versions, the rightful sacred, best known under the heading of human rights, and the graceful sacred of concrete reality?things and practices of nature and art particularly. The division of the sacred into its rightful and (...) graceful versions (a division that is mirrored in the distinction philosophers make between the right and the good) is the crucial cultural event of the modern era. The two are distinct at least and sometimes thought to be incompatible. Yet they can and must be reconciled and seen as complementary?a general requirement of human well-being. And for a Christian like me they find their perfect union in the truly sacred person?God. (shrink)

In this article we briefly summarize how converging technologies challenge elements of the existing symbolic order, as shown in the contributions to this special issue. We then identify the vision of ‘life as a do it yourself kit’ as a common denominator in the various forms of convergence and proceed to show how this vision provokes unrest and debate about existing moral frameworks and taboos. We conclude that, just as the problems of the industrial revolution sparked off the now broadly (...) established ideal of sustainability the converging technologies should be governed by the ideal of ‘human sustainability’. The essence of this ideal is formed by the ongoing discussion about the extent to which we may, or should want to, ‘make’ our environment and ourselves, and when it is better to simply accept what is given and what happens to us. In recent literature, it has been suggested that Lange’s social and political philosophy is separate from his neo-Kantian program. Prima facie, this interpretation makes sense given that Lange argues for an account of social norms that builds on Darwin and Smith rather than on Kant. Still, this paper argues that elements of psychophysiological transcendentalism can be found in Lange’s social and political philosophy. A detailed examination of the second edition of the History of Materialism, Schiller’s Poems, and the second edition (...) of The Worker’s Question reveals that Lange sought to develop a systematic foundation of psychophysiological transcendentalism that is presupposed in his social and political philosophy. This allows for a more detailed understanding of Lange’s practical philosophy and assures him a position in the tradition of neo-Kantian socialism. (shrink)

Post-mortem reproduction is a complex and contested matter attracting attention from a diverse group of scholars and resulting in various responses from a range of countries. Vietnam has been reluctant to deal directly with this matter and has, accordingly, permitted post-mortem reproduction implicitly. First, by analysing Vietnam’s post-mortem reproduction cases, this paper reflects on the manner in which Vietnamese authorities have handled each case in the context of the contemporary legal framework, and it reveals the moral questions arising therefrom. The (...) article then offers an account of Vietnamese social norms as an explanation for the tendency to conduct post-mortem reproduction. In arguing that a deeper and more thorough examination of the moral and ethical reasoning is required, the paper advocates in favour of supportive post-mortem reproduction regulation. In doing so, the paper seeks to reconcile the Vietnamese legal framework and post-mortem reproduction experiences of other countries. The article concludes that Vietnam and countries sharing the similar cultural traits should permit post-mortem reproduction explicitly. This would require full engagement with the ethical and legal issues arising, and careful promulgation of regulations and guidelines based on comparative experiences of a range of countries in handling this matter. Im diesem Aufsatz nehme ich die Popularität des Verantwortungsbegriffs in der Alltagssprache zum Anlass, um seinem Verhältnis zum Pflichtbegriff auf den Grund zu gehen. Dabei unterziehe ich den Verantwortungsbegriff zunächst einer allgemeinen Analyse. Anschließend diskutiere ich in Gestalt von Indeterminismus, Amoralismus und Interaktionismus drei Modi der missbräuchlichen Verwendung dieses Begriffs. Dabei handelt es sich jedoch bei genauerer Betrachtung um allgemeine rhetorische Verschleierungsstrategien, die nicht an die Verwendung des Verantwortungsbegriffs gebunden sind, sondern in der kommunikativen Bezugnahme auf moralische Forderungen generell auftreten (...) können. Dies verdeutlicht auch die anschließende Analyse des Pflichtbegriffs, der einige grundlegende Ähnlichkeiten zum Verantwortungsbegriff aufweist. Ex negativo zeigt sich so jedoch, wie ein nicht missbräuchlicher Rekurs auf beide philosophischen Grundbegriffe möglich ist. Darüber hinaus werden auch die Unterschiede dieser Termini deutlich. Der Pflichtbegriff ist trotz einiger wesentlicher Gemeinsamkeiten weniger vielseitig als der Verantwortungsbegriff und daher zumindest in der Auseinandersetzung mit einigen Themen der praktischen Philosophie weniger gut als Grundbegriff geeignet. Gleichwohl zeigt sich, dass die Frage „Verantwortung oder Pflicht?“ uns vor eine falsche Alternative stellt, wenn sie im ausschließenden Sinn verstanden wird. (shrink)

Logic is usually thought to concern itself only with features that sentences and arguments possess in virtue of their logical structures or forms. The logical form of a sentence or argument is determined by its syntactic or semantic structure and by the placement of certain expressions called “logical constants.”[1] Thus, for example, the sentences Every boy loves some girl. and Some boy loves every girl. are thought to differ in logical form, even though they share a common syntactic and semantic (...) structure, because they differ in the placement of the logical constants “every” and “some”. By contrast, the sentences Every girl loves some boy. and Every boy loves some girl. are thought to have the same logical form, because “girl” and “boy” are not logical constants. Thus, in order to settle questions about logical form, and ultimately about which arguments are logically valid and which sentences logically true, we must distinguish the “logical constants” of a language from its nonlogical expressions. There might not be a specific nano-ethics, but there definitely is an ethics of new & emerging science and technology (NEST), with characteristic tropes and patterns of moral argumentation. Ethical discussion in and around nanoscience and technology reflects such NEST-ethics. We offer an inventory of the arguments, and show patterns in their evolution, in arenas full of proponents and opponents. We also show that there are some nano-specific issues: in how size matters, and when agency is delegated to smart devices. (...) Our overall approach is a pragmatist ethics, and we conclude that struggle (and learning) might be more productive than models emphasizing consensus. (shrink)

Hans-Georg Gadamer é reconhecido como um dos mais importantes filósofos do famoso linguistic turn. Malgrado a aparente recepção de seus debates filosóficos no campo da hermenêutica jurídica e, mais recentemente, da ética do direito, o seu conceito de direito ou, mais precisamente, os fundamentos de uma possível filosofia do direito gadameriana nunca foram submetidos a uma investigação jusfilosófica mais detalhada. Em parte porque a maioria dos comentadores da obra de Gadamer continua a ler seus escritos com uma forte referência às (...) categorias ontológicas da sua obra magna, Verdade e Método. Neste ensaio, entretanto, propõe-se o estudo de alguns conceitos fundamentais da obra de Gadamer, em especial, os desenvolvidos em seus escritos posteriores, a fim de proporcionar uma visão mais adequada acerca dos fins, estrutura e fundamentos da sua ideia de direito. A tese principal deste estudo consiste em apresentar uma das possíveis interpretações do conceito aristotélico de phronesis como a principal fonte da contribuição de Gadamer para a filosofia prática e, por conseguinte, para o direito. Como consequência, será possível esclarecer, de forma não ontológica, os pontos básicos do projeto ético proposto por Gadamer e a fricção praxis-theoria presente no seu conceito de direito. (shrink)

The ethics of bioculture deals with moral questions raised by the cultivation and farming of living things. P. W. Taylor believes that they have an inherent worth just like animals and wild plants. Therefore, judgment about how they should be treated cannot be limited to the principle of greater efficiency for the benefit of humans. Taylor developed a comprehensive theory that is founded on the symmetry between human and environmental ethics. He believes that every living thing is teleologically oriented and (...) a member of the earth's biotic community. A systemic and hologrammatic approach is the alternative to Taylor's ethics of bioculture. Each component of an ecosystem characterised by contingency, plays a role in co-evolution. Therefore, as moral agents, we must take historical responsibility for domesticating and employing other living things, and we should reconsider the emerging model of economic development and define criteria of ethical sustainability for bioculture companies. Such an ethics of bioculture can contribute to oriented decision-making to ensure that an increase in well-being for all living things is an economically and environmentally sustainable and political perspective. According to many criteria, agency, intentionality, responsibility and freedom of decision, require conscious decisions. Freud already assumed that many of our decisions are influenced by dynamically unconscious motives or that we even perform unconscious actions based on completely unconscious considerations. Such actions might not be intentional, and perhaps not even actions in the narrow sense, we would not be responsible for them and freedom of decision would be missing. Recent psychological and neurophysiological research has added to this a number of (...) phenomena (the "new unconscious") in which behavior is completely unconscious or in which the decision or its execution is influenced by unconscious factors: priming, automatic behavior, habitualized behavior, actions based on plain unconscious deliberations, intrusion of information from the dorsal pathway, etc. However, since this makes up the largest part of the behavior which is generally regarded as action, intentionality, yet agency, responsibility and even compatibilist freedom of decision for the largest part of our behavior may be threatened. Such considerations have led to a lively debate, which, however, suffers from generalizations that lump all these unconscious phenomena together. In contrast, the aim of this article is to discuss individual unconscious influences on our behavior separately with respect to what extent they require changes in traditional conceptualizations. The first part (2-4) of the article outlines the "traditions" and their elaborations: the intentional causalist concept of action, an associated empirical theory of action and standard concepts of responsibility and compatibilist freedom of decision, as well as the challenges for them. In the second part (5-9), the aforementioned unconscious influences on our actions (except for automated and habitualized actions, which I discuss elsewhere) are examined: 1. unconscious priming, 2. dynamically unconscious motives, 3. dorsal pathway information influencing conscious decisions, 4. unconsciously altered execution of conscious intentions, 5. unconscious deliberations and decisions. To what extent do these phenomena C1. require a change in the concept of action, C2. curtail intentionality or agency, C3. responsibility and C4. freedom? The result is: The curtailments prove to be far less dramatic than they initially appear; they require more watchfulness but no conceptual change. (shrink)

Many traditional conceptions of ethics use categories and arguments that have been developed under conditions of pre-modern societies and are not useful in the age of globalisation anymore. I argue that we need an economic ethics which employs economics as a key theoretical resource and which focuses on institutions for implementing moral norms. This conception is then elaborated further in the area of business ethics. It is illustrated in the case for banning child labour.

Artículo centrado en el significado, medida y promoción de las competencias o capacidades democráticas. Tal como lo demuestran muchas Constituciones, declaraciones internacionales y encuestas, la mayoría de la población mundial valora los ideales morales democráticos. Sin embargo, en la vida cotidiana, rara vez nos comportamos a la altura de esos ideales. Para superar esa brecha, necesitamos cultivar las competencias democráticas a través de la educación, enseñando a los estudiantes a expresarse y escuchar a otros ―sobre todo a aquellos con puntos (...) de vista opuestos―. Pero en la mayoría de las escuelas, la educación para la democracia se limita a transmitir el conocimiento declarativo de los libros de texto, en vez de promover el conocimiento tácito o procedimental necesario para resolver conflictos sociales a través de la deliberación no-violenta. Así, el artículo: a) presenta un modelo conceptual del comportamiento democrático; b) explica brevemente las características metodológicas de un instrumento para la medición de una competencia democrática fundamental, el Test del Juicio Moral; y c) discute los principios pedagógicos del Método Konstanz de Discusión de Dilemas, un método que según se ha comprobado representa una mejora respecto al método pionero de Blatt y Kohlberg. In diesen Hinsichten werden sowohl fatalistische als auch naiv-optimistische Positionen zurückgewiesen, insofern sie der Erfahrung nicht angemessen Rechnung tragen, wie wir der Gewalt auf der Suche nach einem lebbaren Leben ausgesetzt sind.

Managers of multinational companies often favour an aggressive tax avoidance strategy that pushes the legal limits onto the advantage of shareholders and the disadvantage of the spirit of democratically legitimized tax laws. The public and media debate whether such aggressive behaviour is immoral. Aggressive tax avoidance is a subset of the aggressive legal interpretations potentially observable in all fields which places little weight on the will of a democratically legitimized legislation. A thorough ethical analysis based on the deontological approach of (...) Kant demonstrates that aggressive tax avoidance as a special case of operating on the edge of legal boundaries is potentially immoral. Applying the Kantian “contradiction of conception or will” test shows that this maxim might not be conceived or willed as a general law of nature. If all natural or legal persons aggressively interpret laws on all subjects and in every imaginable situation, then central principles of the system of law we all rely upon would be severely compromised. Therefore, aggressive tax avoidance by managers of multinational companies may violate the managers’ moral duty to obey not only the letter but also the intention or spirit of the law. The validity of the argumentation depends critically on the formulation and interpretation of the respective maxims and on assumptions about the legal system. Preserving central elements of Kantian philosophy, the article demonstrates the complexity of a philosophical argumentation which tries to justify the moral intuitions that underpin the common negative evaluation of aggressive legal strategies in business. Laura Valentini’s novel theory, the Agency-Respect View, says that we have a fundamental moral duty to honor other people’s convictions, at least pro tanto and under certain conditions. I raise doubts that such a duty exists indeed and that informative conditions have been specified. The questions that Valentini faces here have a parallel in Kant’s moral philosophy, viz. the question of why one has a duty to value the other’s humanity and the question of how to specify the maxim of (...) one’s action. On the currently dominant reading of the Groundwork, Kant’s derivation of ‘imperatives of duty’ exemplifies a decision procedure for the derivation of concrete duties in moral deliberation. However, Kant’s response to an often-misidentified criticism of the Groundwork by G. A. Tittel suggests that Kant was remarkably unconcerned with arguing for the practicality of the categorical imperative as a decision procedure. Instead, I argue that the main aim of Kant’s derivation of imperatives of duty was to show how his analysis of (...) the form of moral judgement is indeed presupposed in the four types of moral imperative that philosophers of his time recognized. There is a gap between self-interest and morality that is caused not only by individual shortcomings but also by the interdependence of the outcome of individual action with the actions of others. If the others can be expected to be ethical this uncertainty about the others’ behaviour is reduced but not eliminated. Failure of economic motivation will be followed by failure of ethical motivation. Christianity or monotheistic religion in general comes into the picture to assure ethical behaviour of being advantageous (...) in the long run. This paper deals with the question of how norms are to be conceived of in order to understand their role as guidelines for human action within various normative orders, particularly in the context of law on the one hand and conventional morality on the other. After some brief remarks on the history of the term “norm,” the author outlines the most significant general features of actually existing social norms, including legal and conventional norms, from which he arrives at two basic (...) requirements on an appropriate conception of such norms: the actuality and the normativity requirements. On this basis, he enters into a critical discussion of Kelsen's highly influential view of norms, arguing that this view is doomed to failure. In the last part of the paper, the author scrutinizes the more promising “practice theory of norms” by H.L.A. Hart, which, in his view, also suffers from some shortcomings, but may be modified in a way that leads to a conception of social norms providing us with a plausible explication of their actual existence and their normative force. Eine der frühesten Schriften des jungen Karl Marx — die Dissertationsschrift „Differenz der demokritischen und epikureischen Naturphilosophie“ — legt wichtige Fundamente für das gesamte Marx’sche Denken. In der Dissertationsschrift versucht Marx anhand des Vergleichs der antiken Naturphilosophien Demokrits und Epikurs grundlegende Erkenntnisse der theoretischen und praktischen Philosophie in einem komplexen, von Hegel inspirierten ontologischen System zu verbinden. Aus dieser kritischen Synthese antiker Naturphilosophien entsteht so eine auf Hegelschen Begriffen basierende, aber gleichzeitig reformierte Idee der Praxis. Auf diesen Grundlagen sowie mit (...) Hilfe des über die Kritik an Epikur und Hegel gewonnenen Begriffs der Entfremdung entwickelt Marx den dialektischen Materialismus der Naturphilosophie. Dem inhaltlichen Aufbau der Dissertationsschrift folgend wird in dem Aufsatz die Marx’sche Naturphilosophie diskutiert. Dabei werden die wichtigsten Begriffe des Marx‘schen Denkens, wie etwa Materialismus, Dialektik, Entfremdung oder Einheit von Theorie und Praxis in der Dissertationsschrift von Karl Marx ausgearbeitet. Die Sekundärnutzung klinischer Daten für Forschungs- und Lernaktivitäten hat das Potenzial, medizinisches Wissen und klinische Versorgung erheblich zu verbessern. Zur Realisierung dieses Potenzials bedarf es einer ethischen und rechtlichen Grundlage für die Datennutzung, vorzugsweise in Form der Einwilligung von Patient*innen. Damit stellt sich die grundsätzliche Frage: Haben Patient*innen eine moralische Pflicht, ihre klinischen Daten für Forschungs- und Lernaktivitäten zur Verfügung zu stellen?Auf Basis eines ethischen Ansatzes, der als „sorgender Liberalismus“ bezeichnet werden kann, werden folgende Argumente zur Begründung einer Pflicht von (...) Patient*innen zur Bereitstellung ihrer klinischen Daten für Forschungs- und Lernaktivitäten auf Plausibilität und moralisches Gewicht untersucht: die allgemeine Hilfspflicht; Solidarität; die Pflicht zu gemeinwohlförderlichem Handeln; das Trittbrettfahrerargument; transgenerationale Gerechtigkeit; das Prinzip des Zurückgebens; das Prinzip des Nicht-Schädigens; die Forschungsfreiheit und der Wert der Wissenschaft.Die allgemeine Hilfspflicht und die Pflicht zu gemeinwohlförderlichem Handeln sind gewichtige Gründe für eine moralische Pflicht von Patient*innen zur Bereitstellung ihrer klinischen Daten für Forschungs- und Lernaktivitäten. Das Argument der transgenerationalen Gerechtigkeit und das Prinzip des Zurückgebens sind ethisch schwache Gründe für eine solche Pflicht, können jedoch eine motivationale Rolle spielen. Die anderen Gründe sind nicht geeignet, eine Pflicht zu begründen. Das Ergebnis ist in mehrfacher Hinsicht relevant: für Patient*innen, die um die Einwilligung in die Sekundärnutzung ihrer klinischen Daten gebeten werden; für die ethische Diskussion der Frage, ob und inwieweit Abstriche von der klassischen spezifischen Einwilligung unter bestimmten Bedingungen ethisch akzeptabel sind; für die rechtwissenschaftliche Diskussion der Bedingungen für eine juristisch verhältnismäßige Sekundärnutzung klinischer Daten für Forschungs- und Lernaktivitäten. Research question The secondary use of clinical data for research and learning activities has the potential to significantly improve medical knowledge and clinical care. To realize this potential, an ethical and legal basis for data use is needed, preferably in the form of patient consent. This raises the question: Do patients have a moral duty to provide their clinical data for research and learning activities? Methods On the basis of an ethical approach that we call “caring liberalism,” we evaluate plausibility (...) and moral weight of the following arguments in favor of a duty on patients to provide their clinical data for research and learning activities: the general duty to help; solidarity; the duty to act in the public interest; the free-rider argument; transgenerational justice; the principle of giving back; the do-not-harm principle; freedom of research and the value of science. Results The general duty to help and the duty to act in the public interest are strong reasons for a moral duty of patients to provide their clinical data for research and learning activities. Transgenerational justice and the principle of giving back are ethically weak reasons for such a duty but might be motivational factors. The other reasons are not appropriate to justify a duty. The results are relevant in several respects: for patients who are asked to consent to the secondary use of their clinical data; for the ethical discussion of the question whether and to what extent deviations from the classical specific consent are ethically justifiable under certain conditions; for the legal discussion of the conditions for a proportionate secondary use of clinical data for research and learning activities. In this article, we focus on the attribution of moral responsibility for the actions of autonomous weapons systems (AWS). To do so, we suggest that the responsibility gap can be closed if human agents can take meaningful moral responsibility for the actions of AWS. This is a moral responsibility attributed to individuals in a justified and fair way and which is accepted by individuals as an assessment of their own moral character. We argue that, given the unpredictability of AWS, meaningful (...) moral responsibly can only be discharged by human agents who are willing to take a moral gambit: they decide to design/develop/deploy AWS despite the uncertainty about the effects an AWS may produce, hoping that unintended and unwanted or unforeseen outcomes may never occurs, but also accepting to be held responsible if such outcomes will occur. We argue that, while a moral gambit is permissible for the use of non-lethal AWS, this is not the case for the actions of lethal autonomous weapon systems. (shrink)

Im interkulturellen medizinethischen Diskurs kursiert seit den 1990er Jahren die These, dass das Konzept der Patientenautonomie mit der so genannten ostasiatischen, familienorientierten Ethik nicht vereinbar sei. Dieser kulturessentialistischen These liegt ein ‘kulturalistischer Fehlschluss’ zugrunde, der die innerkulturellen moralischen Differenzen und die Veränderbarkeit der kulturellen Selbstverständnisse ignoriert. Die familienorientierte medizinische Entscheidung ist aber häufig durch außermoralische Faktoren motiviert und daher selbst in asiatischen Ländern, zum Beispiel in Südkorea, umstritten. Die Anerkennung des individuellen Selbstbestimmungsrechts ist demgegenüber eine historische Errungenschaft und bildet die (...) Grundlage der Patientenverfügung in liberalen und demokratischen Gesellschaften im Osten wie im Westen. Schließlich erfordert das Gelingen eines kulturübergreifenden medizinethischen Diskurses die vorurteilsfreie Kenntnisnahme von ethischen Problemen im konkreten soziokulturellen Kontext. Dabei ist die Deskription kultureller Faktoren, welche für das Verständnis der moralischen Konflikte und deren Analyse wichtig ist, von normativen Prinzipien der modernen Ethik zu unterscheiden, die den individuellen Menschenrechten und der Moralfähigkeit des einzelnen Menschen als Träger jeder Kultur gerecht werden. Dies soll am Beispiel der aktuellen südkoreanischen Diskussion über die Patientenverfügung respektive über den selbstbestimmten, „würdigen Tod“ expliziert werden. (shrink)

In this article, I argue that the relationship between patients and their health care providers need not be construed as a contract between moral strangers. Contrary to the (American) legal presumption that health care providers are not obligated to assist others in need unless the latter are already contracted patients of record, I submit that the presence of a suffering human being constitutes an immediate moral commandment to try to relieve such suffering. This thesis is developed in reference to the (...) French philosopher Levinas and the Dutch theologian Schillebeeckx. An expanded version of the biblical parable of the Good Samaritan serves as test case. (shrink)

In the age of artificial intelligence, the common interest in human autonomy is experiencing a revival. Autonomy has formerly and mostly been investigated from a theoretical scientific perspective, in which scholars from various disciplines have linked autonomy with the concepts of dignity, independence from others, morality, self-awareness, and unconventionality. In a series of three semi-qualitative, preregistered online studies, we investigated laypersons' understanding of autonomy with a bottom-up procedure to find out how far lay intuition is consistent with scientific theory. First, (...) in Study 1, participants provided us with at least three and up to 10 examples of autonomous behaviors, for a total of 807 meaningful examples. With the help of blinded research assistants, we sorted the obtained examples into categories, from which we generated 34 representative items for the following studies. Next, in Study 2, we asked a new sample of participants to rate the degree of autonomy reflected in each of these 34 items. Last, we presented the five highest-rated and the five lowest-rated items to the participants of Study 3, whom we asked to evaluate how strongly they represented the components of autonomy: dignity, independence from others, morality, self-awareness, and unconventionality. We identified that dignity, independence from others, morality, and self-awareness significantly distinguished between high- and low-autonomy items, implying that high autonomy items were rated higher on dignity, independence from others, morality, and self-awareness than low autonomy items, but unconventionality did not. Our findings contribute to both our understanding of autonomous behaviors and connecting lay intuition with scientific theory. (shrink)

Haji argues that determinism threatens deontic morality, not via a threat to moral responsibility, but directly, because of the principle that ‘ought’ implies ‘can’. Haji’s argument requires not only that we embrace an ‘ought’ implies ‘can’ principle, but also that we adopt the principle that ‘ought’ implies ‘able not to’. I argue that we have little reason to adopt the latter principle, and examine whether deontic morality might be destroyed on the basis of the more commonly embraced ‘ought’ implies ‘can’ (...) principle alone. I argue that despite what look like initially compelling reasons why we might suppose that this weaker conclusion is similarly destructive to deontic morality, we actually have good reason to doubt that it has any practical relevance for moral deliberation at all. H. L. A. Hart in his Law, Liberty, and Morality (1963) defended the view that legal paternalism and legal moralism can be clearly distinguished from each other. Hart also stated that while legal moralism is always unacceptable, paternalistic laws are often justifiable. In this paper it is argued that Hart held the right view for the wrong reasons. Hart defended legal paternalism by claiming, against J. S. Mill, that for various psychological reasons individuals do not know their own interests best. (...) It will be shown in the paper that if this view is taken, it is impossible to reject legal moralism. The fact that paternalism is sometimes justifiable while moralism is not can be more firmly founded on a distinction made by C. L. Ten (1971). Ten's point is that in matters which concern only the individuals themselves, their actions cannot be legitimately restricted by appeals to the consequences of their action alone. Paternalistic control can be justified only if the decision-making abilities of the controlled individual are temporarily diminished. (shrink)

Traditionelle Personenbegriffe der abendländischen Philosophie rekurrieren oft auf rationale Fähigkeiten wie Vernunft- bzw. Moralfähigkeit oder reflexives Selbstbewusstsein als Grundlage von individuellem moralischem Status bzw. der korrelierenden moralischen Verpflichtung. Dem steht die Erfahrung besonderer moralischer Verpflichtungen etwa gegenüber Kindern, Menschen mit besonderen Bedürfnissen oder Tieren entgegen, die durch ratiozentristische Engführungen aus dem Blick zu geraten drohen. Die gegenwärtigen Diskurse um die Begriffe der Vulnerabilität und Anerkennung sind deshalb eine wichtige Ergänzung, um einerseits die Selektivität klassischer moralphilosophischer Konzeptionen zu mindern, indem sie (...) auf eine universal geteilte Bedürftigkeit statt auf Kompetenzen als Anker der Moralität hinweisen, sowie andererseits auch positive Fürsorgepflichten für angewiesene Wesen zu begründen. Allerdings bedarf diese Ergänzung, wie argumentiert wird, ihrerseits einer Erweiterung, weil sie erstens von der kontingenten Anerkennung der Vulnerabilität in einem jeweiligen Ethos abhängt, ohne selbst hinreichende normative Kriterien an die Hand zu geben, zweitens von geteilten, jedoch nicht singulären Ansprüchen und Bedürfnissen ausgeht und drittens den Motivationsgrund der Verpflichtung nicht klärt, weil sie von Allokationsstrukturen und nicht von konkreten Begegnungen ausgeht. Eine Korrektur von der Phänomenologie der Leiblichkeit her, deren Implikationen für moraltheoretische Fragestellungen in den folgenden Ausführungen skizziert werden, scheint daher angezeigt. Can the theory of conceptual spaces developed by Peter Gärdenfors and others be applied to moral issues? Martin Peterson argues that several moral principles can be construed as regions in a shared similarity space, but Kristin Shrader-Frechette and Gert-Jan Lokhorst question Peterson’s claim. They argue that the moral similarity judgments used to construct the space are underspecified and subjective. In this paper, we present new data indicating that moral principles can indeed be construed as regions in a multidimensional conceptual space (...) on the basis of moral similarity judgments. Four hundred and seventy-five students taking a course in engineering ethics completed a survey in which they were presented with ten cases featuring ethical issues related to technology and engineering. Participants were asked to judge the moral similarity of each pair of cases and to select which moral principle they believed should be applied for resolving the case. We used interval multidimensional scaling as well as individual differences scaling for analyzing the moral similarity judgments. Despite noteworthy individual variations in the judgments, the five moral principles included in the study were discernable in the aggregate multidimensional spaces, even for participants with no previous exposure to the principles. Participants tended to apply the same moral principles to cases rated as morally similar. Our overall conclusion is that moral similarity judgments, and their representation in multidimensional spaces, can help us identify moral principles that are relevant for assessing difficult moral choice situations. In ‘Human Fallibility and the Need for Forgiveness’, Claudia Blöser has proposed a Kantian account of our reasons to forgive that situates our moral fallibility as their ultimate ground. Blöser argues that Kant’s duty to be forgiving is grounded on the need to be relieved from the burden of our moral failure, a need that we all have in virtue of our moral fallible nature, regardless of whether or not we have repented. Blöser claims that Kant’s proposal yields a plausible (...) account of the normative status of forgiveness. Kant classifies the duty to be forgiving as a wide duty of virtue, and according to Blöser, this means that Kantian forgiveness is elective in the sense that forgiveness is good in general but without being obligatory in each particular case. In the course of presenting her own reconstruction of Kant’s account, Blöser also objects to some aspects of an interpretation of Kant’s theory of forgiveness which I had previously defended in my paper ‘Forgiveness and Moral Development’. Although there are a lot of points of agreement between our interpretations, the aim of this article is to highlight four key points of disagreement. These issues are worth discussing because they have implications not only for a plausible interpretation of a recognisable Kantian account of forgiveness but also for wider debates in the contemporary literature on forgiveness. First, I show that Kant is not committed to a form of weak situationism as suggested by Blöser and that Kant’s grounding of the duty to be forgiving does not appeal to moral luck. Second, I argue that although Kant’s duty to be forgiving is elective in one sense of the term, it is not elective in another important sense of the term, and that it is in fact better not to interpret Kantian imperfect duties as being elective. Third, I show that awareness of moral fallibility per se does not provide a morally appropriate ground for forgiveness and offer an alternative reconstruction of Kant’s account- in which fallibility plays a role, but it is not the main reason to forgive. Finally, I argue that Blöser’s account of the need to be forgiven is not recognisable Kantian because, from a Kantian perspective, repentance is a necessary condition for the desirability and, in fact, the very possibility of ameliorating our own guilt. In diesem Aufsatz wird die bislang kaum beachtete frühe Moralphilosophie von Max Horkheimer aus den 1930er Jahren in ein produktives Spannungsverhältnis zu den Grundannahmen des ethischen Naturalismus gesetzt. Horkheimer versteht die Moral als ein normatives Instrument, mit dem die menschliche Gattung ihr gesellschaftliches Leben zu organisieren versucht. Die natürliche Normativität der menschlichen Lebensform ist für Horkheimer selbst historisch bestimmt, als die menschliche Lebensform sich notwendig nur historisch realisieren kann. In der bürgerlichen Gesellschaft ist diese Normativität nach Horkheimer widersprüchlich verfasst: Einerseits (...) sollen die Menschen moralischen Normen und nicht allein ihren eigenen Interessen folgen, andererseits erfordert die bürgerliche Gesellschaft gerade das rücksichtslose Verfolgen eigener Interessen, da sonst die Selbsterhaltung der Menschen gefährdet würde. Die Auswirkungen dieser Widersprüchlichkeit werden hier anhand von drei Aspekten untersucht: die Opazität und Naturhaftigkeit der bürgerlichen Gesellschaft, das Leiden der menschlichen Natur, Geschichte als Anpassungsprozess der menschlichen Natur. Abschließend wird Horkheimers Ansatz hinsichtlich seiner theoretischen Reichweite in den moralphilosophischen Diskussionen der gegenwärtigen Kritischen Theorie verortet. (shrink)

We investigate how social comparison processes in leader treatment quality impact group members’ self-worth, affect, and behavior. Evidences from the field and the laboratory suggest that employees who are treated kinder and more considerate than their fellow group members experience more self-worth and positive affect. Moreover, the greater positive self-implications of preferentially treated group members motivate them more strongly to comply with norms and to engage in tasks that benefit the group. These findings suggest that leaders face an ethical trade-off (...) between satisfying the moral standard of treating everybody equally well and satisfying individual group members’ desire to be treated better than others. Seit der Einführung der G‑DRGs als Instrument zur Vergütung von Krankenhausleistungen steht das Gesundheitswesen als System unter Kritik. Denn die Ausrichtung der Krankenhäuser auf wirtschaftlichen Erfolg relativiert den Anspruch aller Bürgerinnen und Bürger auf gute medizinische Versorgung. Der Artikel geht der Frage nach, von welchem Akteur im System welche Aktivität erzwungen, erwartet, oder verlangt werden kann, dem entgegenzuwirken. Die genannten alltagsmoralischen Urteile werden unter Rückgriff auf Kants Moralphilosophie validiert und auf die wichtigsten Akteure angewandt. Ergebnis: Der Kern des Ökonomisierungs‑/Kommerzialisierungs-Problems besteht (...) in der Entwertung der Professionalität der patientennahen Berufe. Die Neujustierung des Systems kann vom Gesetzgeber nur dann verlangt werden, wenn die verfasste Ärzteschaft sich dazu bekennt, mit den ihr zu Gebote stehenden Mitteln gegen professionswidrige Handlungsanreize vorzugehen. I argue that Kant took from Moses Mendelssohn the idea of a distinction between geometry of morals and a practical ethic. He was drastically misunderstood by his followers precisely on this point. He had learned from the sceptics and the Jansenists the lesson that men are prompted to act by deceptive ends, and he was aware that human actions are also empirical phenomena, where laws like the laws of Nature may be detected. His practical ethics made room for judgment as (...) a holistic procedure for assessing the salience of relevant moral qualities in one given situation; this procedure yields the same results as the geometry of morals does for abstract cases, but does so immediately and without balancing conflicting duties with each other, since what makes for the salient quality of a situation is perceived from the very beginning. The well-known Kantian passage on misology in the Foundations of the Metaphysics of Morals starts making fuller sense when located within the framework of Kant writings on philosophy of history where he contrasts civilization with moralization as two different phases in the growth of humankind. In this context, the growth of commerce and manufactures plays a distinctive role, namely that of means of fostering civilization, while pursuing a deceptive goal, namely happiness. Deception plays a basic role in the growth of (...) mankind, in so far as it allows for a hidden twofold teleology in human action. Men, while following the dictates of self-love, are systematically mistaken about the results they actually contribute in bringing about. Commerce brings different peoples into mutual relationship and thus paves the way to a cosmopolitan society. The growth of the arts and sciences provides preconditions for the growth of learned institutions, a free press, and a public opinion that are the basis on which reason may start being used in its critical capacities. This, that is Enlightenment, is a preliminary step to moralization, that is the jump of individuals from a state of minority to a state where they are masters of themselves. The twofold teleology of human action makes room for a system of "pragmatic" ends, and of laws connected to the former, that may be studied rationally in themselves and yet are connected to the higher ends established by reason in its "practical" capacities. There is a fundamental incompatibility between a developmental orientation to education and instrumental and scientistic conceptions of rationality that dominate educational inquiry. An expanded conception of rationality is provided in the critical theory of Jurgen Habermas. This study draws on Habermas' work to present a theory of inquiry that is consistent with a developmental perspective. I distinguish three interdependent realms of experience--the objective world of nature, the intersubjective world of society and the subjective world of each individual. Then, I argue (...) that current conceptions of rationality tend to reduce personal and interpersonal experience to the objective material realm. Under prevailing conceptions, human action is rational when it pursues valued ends guided by knowledge about the world and effective means-ends relationships. Both theories of knowledge and theories of value in these conceptions are inadequate for a developmental orientation. -/- First, knowledge is defined as justified true belief. Theories of truth are based on the correspondence of beliefs with an external world; theories of justification are based on perceptual certainty. These conceptions objectify experience by making experience an object of natural science and instrumental action separate from and external to the person. Such conceptions reduce experience to the objective material dimension and cannot adequately account for the personal and interpersonal dimensions of human experience and understanding. -/- Second, because value claims are not capable of justification by these standards, they are considered ultimately irrational and treated as subjectively held empirical properties of individuals. The only standard of rationality is efficiency and economy in the selection of means. Ethics is reduced to empirical science. But the removal of practical questions from public discourse divests action of ethical significance. With its strict separation of descriptive and normative domains, empirical-analytic inquiry can neither acknowledge its standard of instrumental efficiency nor reach into the practical arena to guide the selection of values and ends that orient and gude human action. Practical questions that cannot be framed in terms of technical problems cannot be taken seriously. -/- Whereas these conceptions of rationality are generally derived from theories of experienced based on individual consciousness, Habermas looks to language for a more adequate account of the intersubjective nature of experience. This account provides an expanded conception of rationality with theories for justifying beliefs and actions that incorporate the personal and interpersonal dimensions of experience so critical to a developmental perspective. Through an analysis of the universal pragmatic structure of language directed to the resolution of problematic truth claims and moral claims, this study presents a consensus theory of truth (for a more adequate theory of knowledge) and a communicative theory of ethics (based on a more adequate theory of human values). -/- The concept of truth refers to a universal pragmatic convention of the unforced agreement of an ideal community of inquirers. Ethical conduct is guided by norms that reflect a rational general will and that regulate genuine human needs. Problematic truth claims and moral claims are discursively justified by the force of the better argument under the conditions of an anticipated "ideal speech situation" inherent in the very structure of communication. Furthermore, a theory of inquiry is developed in which inquiry processes are represented as historically evolved extensions of developmental process in the three realms of experience. Three interrelated forms of inquiry are derived--empirical-analytic, hermeneutic and critical. I derive each from its respective experiential realm, and indicate the logic of inquiry, object domain, and kind of knowledge gained from each. -/- An exploration of the relationship between inquiry and development provides a foundation for a developmental orientation to education. Finally, the theory is contrasted with prevailing inquiry approaches in education and illustrated with an application to a particular educational problem. (shrink)

Das Wiskott-Aldrich-Syndrom (WAS), ein genetisch bedingter Immundefekt mit klinischer Manifestation im Kleinkindalter, wird voraussichtlich in näherer Zukunft erstmals versuchsweise durch eine somatische Gentherapie behandelt werden. Im vor- liegenden Beitrag werden die wichtigsten medizinisch-naturwissenschaftlichen Fakten dieses Krankheitsbildes sowie die bisherigen Erfahrungen mit somatischen Gentherapien bei anderen Immunmangelsyndromen ausführlich dargestellt. Sodann erfolgt eine ethische Analyse eines möglichen gentherapeutischen Eingriffs bei WAS-Patienten, bei der die spezifischen Aspekte des Wiskott-Aldrich-Syndroms – insbesondere die fast ausschließliche Betroffenheit von Kindern sowie die unterschiedlich aussichtsreiche Alter- nativoption einer (...) allogenen Knochenmarktransplantation–wesentliche Aspekte der Beurteilung sind. Im Ergebnis zeigt sich, dass ein gentherapeutischer Eingriff im vorliegenden Fall nicht im Rahmen einer Forschungsstudie, d.h. als Humanexperiment, gerechtfertigt werden kann, sondern allein als individueller Heilversuch. Gleichwohl las- sen die besonderen Risiken und die Innovativität eines solchen Eingriffs es notwendig erscheinen, diesen Heilversuch – anders als andere Heilbehandlungen mit bislang unerprobten Mitteln – in streng kontrollierter Form durchzuführen. Der neuartige Gedanke eines kontrollierten individuellen Heilversuchs zeichnet sich daher für den vorliegenden Fall, und womöglich auch für vergleichbare risikoreiche Behandlungsansätze namentlich im Bereich der Gentherapie, als geeignetes Instrument der Konzeption und Beurteilung ab. This article discusses the notion that the invisibility of the animalness of the animal constitutes a fundamental obstacle to change within current production systems. It is discussed whether housing animals in environments that resemble natural habitats could lead to a re-animalization of the animals, a higher appreciation of their moral significance, and thereby higher standards of animal welfare. The basic claim is that experiencing the animals in their evolutionary and environmental context would make it harder to objectify animals as mere (...) bioreactors and production systems. It is argued that the historic objectification of animals within intensive animal production can only be reversed if animals are given the chance to express themselves as they are and not as we see them through the tunnel visions of economy and quantifiable welfare assessment parameters. The industrialisation of agriculture has led to considerable alterations at both the technological and economical levels of animal farming. Several animal welfare issues of modern animal agriculture – e.g. stress and stereotypical behaviour – can be traced back to the industrialised intensification of housing and numbers of animals in production. Although these welfare issues dictate ethical criticism, it is the claim of this article that such direct welfare issues are only the forefront of a greater systemic ethical problem inherent to (...) industrialisation. Consequently, this article provides an analysis of the foundational ethical problems in animal agriculture which derive from overly positivistic science and free-market ideology. It will be argued that both these ways of thinking allow for a systematic reification and commodification of animals and that this contributes to language and attitudes which cannot encompass ethical consideration of animals. The question of whether AI systems such as robots can or should be afforded moral agency or patiency is not one amenable either to discovery or simple reasoning, because we as societies constantly reconstruct our artefacts, including our ethical systems. Consequently, the place of AI systems in society is a matter of normative, not descriptive ethics. Here I start from a functionalist assumption, that ethics is the set of behaviour that maintains a society. This assumption allows me to exploit the (...) theoretical biology of sociality and autonomy to explain our moral intuitions. From this grounding I extend to consider possible ethics for maintaining either human- or of artefact-centred societies. I conclude that while constructing AI systems as either moral agents or patients is possible, neither is desirable. In particular, I argue that we are unlikely to construct a coherent ethics in which it it is ethical to afford AI moral subjectivity. We are therefore obliged not to build AI we are obliged to. The double subjectivity of conscience and the need to test conscientious objections -/- Abstract In spite of the collapse of the traditional objective concept of conscience and the subsequent subjectivation of conscience, conscientious objections are still often considered as a valid ground for exemption from legal and professional obligations. Conscientious objections are seen as more serious than ordinary moral objections. It is not evident why this is so. I argue, with Niklas Luhmann, that the function of conscience is to protect (...) the moral core of a person’s identity. Overruling conscientious objections threatens this core. Claims of conscience are usually founded on the right of freedom of conscience. This right is not absolute. I discuss the view of Richard Arneson who rejects the right of freedom of conscience and defends the right against conscience. I agree with Arneson that, at the one hand, conscientious objectors may constitute a threat to the social and legal order when their objections are not recognised and, at the other hand, too easy giving in to conscientious objections may also threaten the viability of social and legal order. That is why it is needed to determine when conscientious objections cannot be taken at face value, but should be subjected to a series of tests. The aim of these tests is to contain the number of objectors. I discuss 6 criteria for determining whether conscientious objections ground an exemption to legal and professional obligations. At the end of the article I discuss the conscientious objections of medical doctors. (shrink)

This article sets in with the question whether current or foreseeable transformer-based large language models (LLMs), such as the ones powering OpenAI’s ChatGPT, could be language users in a way comparable to humans. It answers the question negatively, presenting the following argument. Apart from niche uses, to use language means to act. But LLMs are unable to act because they lack intentions. This, in turn, is because they are the wrong kind of being: agents with intentions need to be autonomous (...) organisms while LLMs are heteronomous mechanisms. To conclude, the article argues, based on structural aspects of transformer-based LLMs, that these LLMs have taken a first step away from mechanistic artificiality to autonomous self-constitution, which means that these models are (slowly) moving into a direction that someday might result in non-human, but equally non-artificial agents, thus subverting the time-honored Kantian distinction between organism and mechanism. In this article, I develop a loosely Wittgensteinian conception of what it takes for a being, including an AI system, to understand language, and I suggest that current state of the art systems are closer to fulfilling these requirements than one might think. Developing and defending this claim has both empirical and conceptual aspects. The conceptual aspects concern the criteria that are reasonably applied when judging whether some being understands language; the empirical aspects concern the question whether a given being (...) fulfills these criteria. On the conceptual side, the article builds on Glock’s concept of intelligence, Taylor’s conception of intrinsic rightness as well as Wittgenstein’s rule-following considerations. On the empirical side, it is argued that current transformer-based NNLP models, such as BERT and GPT-3 come close to fulfilling these criteria. (shrink)
