The role that need plays in dealing with problems of distributive justice is examined in a series of vignette studies. Among other things, it becomes clear that impartial observers make gradual assessments of justice that depend on the extent to which the observed individuals are endowed with a good. If it is known how high their need for that good is, the assessments are made relative to this reference point. In addition, impartial decision-makers make hypothetical distribution decisions that take into (...) account need, productivity, and accountability. The need of individuals is partially compensated even if they have contributed less to the available amount than they themselves require. However, the willingness to do so decreases if they are accountable for needing more than others or for having contributed less than others. Lastly, both impartial observers and impartial decision-makers distinguish between different types of needs, the fulfillment of which is given different levels of importance. (shrink)

Der Beitrag will dazu ermutigen, für die Entwicklung einer Ethik der Polizei starker als bislang auch Einsichten aus der Geschichte der Philosophie miteinzubeziehen. In einem ersten Schritt soll plausibel werden, dass die Polizei durch ihre Arbeit an den Grenzen und Grenzsituationen unseres Lebens eine ursprüngliche Nähe und Offenheit zur Philosophie hat (Kap.1). Deren unverzichtbare Verwiesenheit auf die Geschichte („Weisheit der Alten“) (Kap.2) wird – einem Hinweis Werner Schieweks folgend – auf dem Hintergrund der politischen Philosophie für die Ethik der Polizei (...) und ihrer Ausbildung schrittweise entfaltet (Kap.3): Persönliche Letztverantwortung des Menschen, ein sozialer und solidarischer Begriff von Freiheit, die schlechterdings zentrale Bedeutung vor allem der „musisch-literarischen“, gewaltreduzierenden Ausbildung der künftigen „Wächter“, ihre Vorbereitung auf die Maßlosigkeit des Menschen oder die Kultivierung ihrer Affekte etwa in einer Atmosphäre des „Schönen“ sind mögliche Aspekte, an die eine Ethik der Polizei vielleicht bei Platon anknüpfen kann. Das gilt vor allem für ein Verständnis der polizeilichen Kardinaltugend: der Tapferkeit. Als feste Überzeugung über das, was für den Staat gefährlich ist, zeichnet sich die Tapferkeit durch eine besondere Furcht aus: Durch die Furcht der Wächter vor sich selbst und ihrer eigenen Ambivalenz. Die Einübung in diese Furcht kann im Rahmen der Ausbildung u.a. in einer Auseinandersetzung mit der radikalen Moralkritik bestehen, wie sie Platon anhand unterschiedlicher sophistischer Positionen diskutiert. Abschließend gibt der Beitrag noch einen Ausblick auf weitere Perspektiven für die Polizeiethik, die sich aus der Geschichte der Philosophie ergeben: Zum einen im Anschluss an Kant die mögliche Relevanz von Hoffnung für moralisches Handeln auch in der Polizei; zum anderen die Möglichkeit einer philosophischen „Therapie“ von starken Emotionen wie etwa Angst oder Zorn. W. V. Quine’s criterion of ontological commitment is commonly presented as the slogan: “to be is to be the value of a variable”. More specifically, to be is to be in the domain of values of a bound variable attached to a existential quantifier in the body of a theory. If a sentence of our best available theory quantifies over bachelors, so we conclude that, according to it, there are bachelors. Simplicity and the use of logical apparatus for determining this (...) criterion are responsible for many philosophers to adhere to this standpoint within analytical metaphysics. I will argue that despite this strong influence of the Quinean criterion of ontological commitment in many debates, we find at least three interlinked problems in its original formulation: (1) The criterion depends of a clear definition of theory for the determination of the quantifications counting as entailers of ontological commitments. However, Quine does not present such clear concept of what would be a theory and of how to formalize it. Quine develops this notion under just the metaphor of the knowledge fabric, in which we have a group of sentences, which does not suffice for the required account of ontological commitment. (2) There are distinct possibilities of quantifying over given sentences, which leaves room for different ontological commitments associated with the same statement. In that sense, someone could argue that the Quinean solution would be to endorse just the first order predicate logic. Nonetheless, the Quinean should explain why we ought to be restricted to this logic. (3) The previous problems lead to a possible explosion of the Quinean criterion of ontological commitment, making it trivial, because it permits the quantification over any supposed entities and, hence, that anything can exist. Thus, I will discuss Quine’s criterion of ontological commitment in the light of the abovementioned problems, showing that, unless the Quinean presents a more specific definition of theory beyond just a group of sentences, he leads to an explosion of commitments with different entities. I will conclude that, if you understand ‘theory’ as Alonzo Church’s concept of ‘formalized language’, this knot can be undone. However, Church’s concept is much more akin to Carnap’s linguistic framework than to a notion of knowledge fabric “without borders” as the one proposed by Quine. (shrink)

The idea that there is a distinctively practical use of reason, and correspondingly a distinctively practical form of knowledge, unites many otherwise diverse voices in the history of practical philosophy: from Aristotle to Kant, from Rousseau to Marx, from Hegel to G.E.M. Anscombe, and many others. This article develops an objection to Kant’s proof of freedom from the Critique of Practical Reason. In his proof — the fact of reason argument — Kant deduces the reality of freedom, understood as the ability to act independently of all inclinations, from our consciousness of the unconditional validity of morality. He calls this consciousness the "fact of reason". After a systematic reconstruction of the argument, I develop an objection that relies on three points: (i) the cultural embeddedness of human (...) beings ("fact of culture"), (ii) an "external" perspective on human deliberative processes, and (iii) an alternative interpretation of the unconditional validity of morality that appears in practical deliberation. Contrary to Kant’s claims, I argue that the reality of freedom cannot be deductively derived from the fact of reason. I then discuss two objections to my argument. The first objection claims that my considerations regarding the "external" perspective misunderstand Kant's methodology. The second objection states that, based on my considerations, the fact of reason ultimately turns out to be an illusion. I discuss both objections and refute them. My ultimate conclusion is that Kant's fact of reason argument is not convincing. (shrink)

Kant maintains that the only thing that is good in itself, and therefore good without limitation or qualification, is a good will. This is an objectionable claim in support of a controversial position. The problem is not just that the good will is not the only thing that is good in itself, which indeed it is not, but more importantly, that the good will is not so much a thing that is good in itself as it is the good kind (...) of a thing that is otherwise neither good nor bad in itself. The goodness of a good will is no more intrinsic than the goodness of a good act, good outcome, good attitude, good character, or good person. Nor is it even any more so than something as commonplace as a good laugh or a good cup of coffee. A good will, whatever else it may be, is a will that is good, much like how a good act is an act that is good, a good outcome is an outcome that is good, and so on with the other examples, not one of which is good for any reason other than the goodness predicated of the corresponding subject. This paper thus challenges Kant’s position on ontological grounds. It questions the validity of claiming intrinsic goodness for a complex construct whose goodness is, in fact, extrinsic to its substance. The objection is not that the good will might not turn out to be good after all, which is impossible by definition, designation, or stipulation, but that its goodness is axiomatic and derivative rather than intrinsic or fundamental. El concepto de dignidad humana ha sido considerado o demasiado denso o demasiado delgado. Sin embargo, desde el punto de vista del no-positivismo, la normatividad jurídica de la dignidad humana puede ser justificada y reforzada por medio de su corrección moral. Desde una perspectiva individual, la comprensión de Mencio sobre la dignidad humana como un valor intrínseco y el imperativo categórico de Kant (el ser humano como un fin en sí mismo) podrían ser adecuadamente comprendidos con base en la diferencia (...) (así como la conexión) entre el principium diiudicationis y el principium executionis, entre voluntad y “elección”; así como entre homo phaenomenon y homo noumenon (es decir, humanidad en la persona de los seres humanos). Desde una perspectiva social, las dimensiones del individuo y la persona social son construcciones ficticias; inclusive Radbruch -alguna vez defensor del derecho social- no remplazó el concepto de “persona jurídica” y, en el periodo de posguerra, reconoció la dignidad humana individual como el criterio para aplicar su famosa “fórmula de Radbruch". Por una parte, la dignidad humana muestra cuando menos un carácter normativo débil, el cual requiere, primero, ponderar entre el ejercicio de los poderes estatales y el control de constitucionalidad bajo la guía de la dimensión dual del ser humano y, segundo, la optimización del principio de la dignidad humana en casos particulares. The dream of achieving artificial intelligence and, in particular, artificial consciousness, is reflected in mythologies and popular culture as utopia and dystopia. This article discusses its conceptual possibility. It first relates the desire to realise strong AI to a self-perception of humanity as opposed to nature, metaphorically represented as gods or God. The realisation of strong AI is perceived as an ultimate victory on nature or God because it represents the crown of creation or evolution: conscious intelligence. The paper proceeds (...) to summarise two debates relevant to AI: one educational and one technological. The technological debate, almost invariably presupposing a materialist framework, is related to the mind–body problem of philosophy; the educational one to understanding the concept of intelligence. By proposing a definition of intelligence linked to an idealist conception of reality, postulating mind as participation in Absolute Mind, I attempt a convergence of these debates, rejecting the possibility of strong AI. This chapter considers the encounter of skepticism with the Kantian and post-Kantian philosophical enterprise and focuses on the intriguing feature whereby it is assimilated into this enterprise. In this period, skepticism becomes interchangeable with its other, which helps understand the proliferation of many kinds of views under its name and which forms the background for transforming skepticism into an anonymous, routine practice of raising objections and counter-objections to one’s own view. German philosophers of this era counterpose skepticism to dogmatism and (...) criticism, ancient to modern skepticism, and, importantly, conceptualize the transitions from one form to another, which forms the conceptual matrix in which new disciplinary forms, such as psychology, anthropology, and historicism contend for cultural-intellectual standing beside philosophy. I present this assimilationist trajectory by reviewing three well-known moments of this encounter of skepticism and idealism: (1) Kant’s idealization of skepticism as a floating position amidst various philosophical positions through the dialectic, polemics, systematics, and history of pure reason; (2) Fichte’s schematic conception of skepticism as a dispute of systems in the early Wissenschaftslehre following his review of the skeptic G. E. Schulze’s attacks on Critical philosophy; (3) Hegel’s historicizing conception of skepticism in the context of differences between subjective idealism and speculative thought and his early Jena review of another work by the same skeptic Schulze. This volume collects selected papers delivered at the 15th Conference of the International Society for Utilitarian Studies, which was held at Karlsruhe Institute of Technology in July 2018. It includes papers dealing with the past, present, and future of utilitarianism – the theory that human happiness is the fundamental moral value – as well as on its applications to animal ethics, population ethics, and the future of humanity, among other topics.

The present text deals with the question of the meaning of life in theexistentialist theory oft heNorwegian philosopher Peter Wessel Zapffe(1899–1990). In his book On the Tragic (1941), Zapffe sketched a theory of the human condition where the meaning of life plays a decisive role together with the human need for justice. This paper aims to reconstruct the central elements of Zapffe’s analysis and to discuss them critically by focusing on his claim that human beings need a fundamental meaning of (...) life as a whole that transcends meaning in life. I pay particular attention to Zapffe’s claim that life is meaningless, since the meaning of life is fundamentallylacking.I conclude that Zapffe’s analysis is problematic for reasons both internal and external to his theory. Die strittige ‚Faktizität des Todes‘ eröffnet die Frage, wie man sich zu ihr stellen soll. Der Beitrag bietet ein Panorama beispielhafter Ex-plikationen von Haltungen gegenüber dem Tod. Hierbei wird aufgewiesen, dass die bloße Bejahung des Todes unzureichend ist, wenn nicht zugleich die abträglichen und abgründigen Aspekte von Sterben und Tod wahrgenommen werden. Eine Abwägung der Effekte ist allerdings kaum durchführbar und das verbreitete Argument drohender Langeweile problematisch. Mit dem Hinweis auf Aristoteles und Kant werden Lektüremöglichkeiten aufgezeigt, die vertraute Topoi einer (...) In ‘Human Fallibility and the Need for Forgiveness’, Claudia Blöser has proposed a Kantian account of our reasons to forgive that situates our moral fallibility as their ultimate ground. Blöser argues that Kant’s duty to be forgiving is grounded on the need to be relieved from the burden of our moral failure, a need that we all have in virtue of our moral fallible nature, regardless of whether or not we have repented. Blöser claims that Kant’s proposal yields a plausible (...) account of the normative status of forgiveness. Kant classifies the duty to be forgiving as a wide duty of virtue, and according to Blöser, this means that Kantian forgiveness is elective in the sense that forgiveness is good in general but without being obligatory in each particular case. In the course of presenting her own reconstruction of Kant’s account, Blöser also objects to some aspects of an interpretation of Kant’s theory of forgiveness which I had previously defended in my paper ‘Forgiveness and Moral Development’. Although there are a lot of points of agreement between our interpretations, the aim of this article is to highlight four key points of disagreement. These issues are worth discussing because they have implications not only for a plausible interpretation of a recognisable Kantian account of forgiveness but also for wider debates in the contemporary literature on forgiveness. First, I show that Kant is not committed to a form of weak situationism as suggested by Blöser and that Kant’s grounding of the duty to be forgiving does not appeal to moral luck. Second, I argue that although Kant’s duty to be forgiving is elective in one sense of the term, it is not elective in another important sense of the term, and that it is in fact better not to interpret Kantian imperfect duties as being elective. Third, I show that awareness of moral fallibility per se does not provide a morally appropriate ground for forgiveness and offer an alternative reconstruction of Kant’s account- in which fallibility plays a role, but it is not the main reason to forgive. Finally, I argue that Blöser’s account of the need to be forgiven is not recognisable Kantian because, from a Kantian perspective, repentance is a necessary condition for the desirability and, in fact, the very possibility of ameliorating our own guilt. Current advances in research, development and application of artificial intelligence systems have yielded a far-reaching discourse on AI ethics. In consequence, a number of ethics guidelines have been released in recent years. These guidelines comprise normative principles and recommendations aimed to harness the “disruptive” potentials of new AI technologies. Designed as a semi-systematic evaluation, this paper analyzes and compares 22 guidelines, highlighting overlaps but also omissions. As a result, I give a detailed overview of the field of AI ethics. Finally, (...) I also examine to what extent the respective ethical principles and values are implemented in the practice of research, development and application of AI systems—and how the effectiveness in the demands of AI ethics can be improved. The well-known Kantian passage on misology in the Foundations of the Metaphysics of Morals starts making fuller sense when located within the framework of Kant writings on philosophy of history where he contrasts civilization with moralization as two different phases in the growth of humankind. In this context, the growth of commerce and manufactures plays a distinctive role, namely that of means of fostering civilization, while pursuing a deceptive goal, namely happiness. Deception plays a basic role in the growth of (...) mankind, in so far as it allows for a hidden twofold teleology in human action. Men, while following the dictates of self-love, are systematically mistaken about the results they actually contribute in bringing about. Commerce brings different peoples into mutual relationship and thus paves the way to a cosmopolitan society. The growth of the arts and sciences provides preconditions for the growth of learned institutions, a free press, and a public opinion that are the basis on which reason may start being used in its critical capacities. This, that is Enlightenment, is a preliminary step to moralization, that is the jump of individuals from a state of minority to a state where they are masters of themselves. The twofold teleology of human action makes room for a system of "pragmatic" ends, and of laws connected to the former, that may be studied rationally in themselves and yet are connected to the higher ends established by reason in its "practical" capacities. Some skeptics question the very possibility of moral bioenhancement by arguing that if we lack a widely acceptable notion of morality, we will not be able to accept the use of a biotechnological technique as a tool for moral bioenhancement. I will examine this skepticism and argue that the assessment of moral bioenhancement does not require such a notion of morality. In particular, I will demonstrate that this skepticism can be neutralized in the case of recent neurofeedback techniques. This goal (...) will be accomplished in four steps. First, I will draw an outline of the skepticism against the possibility of moral bioenhancement and point out that a long-lasting dispute among moral philosophers nourishes this skepticism. Second, I will survey recent neurofeedback techniques and outline their three features: the variety of the target human faculties, such as emotion, cognition, and behavior; the flexibility or personalizability of the target brain state; and the nonclinical application of neurofeedback techniques. Third, I will argue that, by virtue of these three unique features, neurofeedback techniques can be a tool for moral bioenhancement without adopting any specific notion of morality. Fourth, I will examine the advantages and threats that neurofeedback-based moral enhancement may have. Finally, I will conclude that neurofeedback-based moral enhancement can become a new and promising tool for moral bioenhancement and requires further ethical investigations on its unique features. At the beginning of 20th century, there was a problem of establishing which version of the association of Kant’s and Marx’s ideas is correct. If some Legal Marxists more or less combined Kant and Marx, most Russian Social Democrats, especially Bolsheviks, were against such an association. Under the influence of G. V. Plekhanov, Russian Marxists announced a sharply critical attitude toward Kant’s philosophy. This position was reinforced by Russian philosophers, poets, and slavophiles who accused Kant of being militarist. During the (...) World War I, both tendencies faced each other. Plekhanov’s desperate appeal to „the simple laws or morals and justice” and Kant’s “Critique of Practical Reason”, which was supported by L. I. Axelrod, failed. It was rejected by the majority of Marxists both during the World War I and after the triumph of the 1917 October Revolution. (shrink)

This paper offers some comments on some metaphysical and epistemological claims of theological realism from the perspective of continental philosophy of religion, thereby taking the work of Soskice and Hick as paradigmatic for this kind of philosophical theology. The first comment regards the fact that theological realism considers religious and theological propositions as ways to depict or represent reality, and hence aims to bring them as much as possible in line with scientific ones. Some contemporary French philosophers criticize such a (...) representing, depicting knowledge of God, because it encapsulates the divine reality in mundane, specifically scientific categories. eventually, theological realism runs the risk of annihilating God’s radical transcendence and reducing religion to an alternative scientific theory. The second comment tries to explore whether one can affirm God’s reality from a practical perspective, as a postulate of reason, and whether such an approach could serve as a common ground for religious and secular ways of life in times of radical pluralism. This comment begins by investigating the regulative character of Kant’s idea of God as the highest idea of reason, which not only orientates our theoretical enquiries, but also our moral actions. Although this idea is only a heuristic fiction for theoretical reason, God’s existence has to be affirmed on practical grounds, as a symbolic reality that gives orientation to people’s lives. One of the most important features of contemporary Western societies is the rise of pluralism. Whereas theism used to serve as a common ground to discuss the truth-claims of religion, this approach seems to have lost much of its plausibility. What I want to argue in this article is that philosophy of religion as a critical intellectual activity still cannot do without the notion of religious truth, but also that it needs to redefine this truth in an existential way, i.e. (...) by interpreting religions as concrete ways of life. In this paper I develop this idea of religious truth by interpreting religions as traditions of wisdom, being a kind of truth that is able to orientate humans’ lives without being swayed by the issues of the day. In order to substantiate my interpretation I discuss three fundamental aspects of wisdom, viz. the fact that it rests on a broadened idea of reason, the way in which it discovers the universal in the particular, and the insight that all life-orientations are based on a principle that is subjectively adequate, but objectively inadequate. Based on the dispute between Protagoras and Socrates on the origin of ethics, one can ask the question of whether the principle of ethics is reason orfeeling/emotion, or whether ethics is grounded on reason or feeling/emotion. The development of Kant’s thoughts on ethics shows the tension between reason and feeling/emotion. In Kant’s final critical ethics, he held to a principle of “rational a priori.” On the one hand, this is presented as the rational a priori principle being the binding principle (...) of judgment. On the other hand, it is presented as the doctrine of “rational fact” as the ultimate argument of his ethics. Husserl believed that Kant’s doctrine of a rational a priori totally disregarded the a priori essential laws of feeling. Like Husserl, Scheler criticized Kant’s doctrine of a rational a priori, and therefore developed his own theory of an “emotional a priori”. Both of them focused their critiques on the grounding level of ethics. Scheler, however, did not follow Husserl all the way, but criticized him and reflected on his thoughts. At last, he revealed the primary status of a phenomenological material ethics of value. (shrink)

The paper analyzes Quentin Meillassoux’s conception of the fideistic approach to religious faith intrinsic to the “strong correlationism” that he considers pervasive in contemporary thought. Backman presents the basic elements of Meillassoux’s speculative materialism and especially the thesis according to which strong correlationism involves a “fideistic” approach to religiosity. In doing so, Backman critically examines Meillassoux’s notions of post-metaphysical faith, religious absolutes, and contemporary fanaticism, especially against the background of Heidegger’s philosophy. According to Backman, Meillassoux’s logical and conceptual critique of (...) strong correlationism is innovative, and it may remain legitimate if its presuppositions are accepted. And yet, Backman argues that Meillassoux’s allegations of fideism seem to rely on the questionable application of Enlightenment conceptions to the contemporary situation. (shrink)

Forgiveness is clearly an important aspect of our moral lives, yet surprisingly Kant, one of the most important authors in the history of Western ethics, seems to have very little to say about it. Some authors explain this omission by noting that forgiveness sits uncomfortably in Kant’s moral thought: forgiveness seems to have an ineluctably ‘elective’ aspect which makes it to a certain extent arbitrary; thus it stands in tension with Kant’s claim that agents are autonomous beings, capable of determining (...) their own moral status through rational reflection and choice. Other authors recognise that forgiveness plays a role in Kant’s philosophy but fail to appreciate the nature of this duty and misrepresent the Kantian argument in support of it. This paper argues that there is space in Kant’s philosophy for a genuine theory of forgiveness and hopes to lay the grounds for a correct interpretation of this theory. I argue that from a Kantian perspective, forgiveness is not ‘elective’ but, at least in some cases, morally required. I claim that, for Kant, we have an imperfect duty of virtue to forgive repentant wrongdoers that have embarked on a project of self-reflection and self-reform. I develop a novel argument in support of this duty by drawing on Kant’s theory of rational agency, the thesis of radical evil, Kant’s theory of moral development, and the formula of humanity. However, it must be noted that this is a conditional duty and Kant’s position also entails that absence of repentance on the part of the wrongdoer should be taken as evidence of a lack of commitment to a project of self-reflection and self-reform. In such cases, Kant claims, we have a perfect duty to ourselves not to forgive unrepentant wrongdoers. I argue that this duty should be understood as one of the duties of self-esteem, which involves the duty to respect and recognise our own dignity as rational beings. (shrink)

In his essay against Eberhard, Kant denies that there are innate concepts. Several scholars take Kant’s statement at face value. They claim that Kant did not endorse concept innatism, that the categories are not innate concepts, and that Kant’s views on innateness are significantly different from Leibniz’s. This paper takes issue with those claims. It argues that Kant’s views on the origin of the intellectual concepts are remarkably similar to Leibniz’s. Given two widespread notions of innateness, the dispositional notion and (...) the input/output notion, intellectual concepts are innate for Kant no less than for Leibniz. (shrink)

A team of thirty-eight of the world's leading philosophers present original essays on various aspects of how philosophy should be and is done. The first part is devoted to broad traditions and approaches to philosophical methodology. The entries in the second part address topics in philosophical methodology, such as intuitions, conceptual analysis, and transcendental arguments. This dissertation provides a theory of the nature of aesthetic experiences on the basis of a theory of aesthetic values. It results in the formulation of the following necessary conditions for an experience to be aesthetic: it must consist of a representation of an object and an accompanying feeling; the representation must instantiate an intrinsic value; and the feeling must be the recognition of that value and bestow it on the object. Since representations are of intrinsic value for different reasons, (...) there are different kinds of aesthetic experiences . By means of certain conceptual links, it is possible to extend this account to other aesthetic entities thus enabling the formulation of a general theory of the aesthetic in non-aesthetic terms. In particular, aesthetic values are identical with subjective dispositions to elicit aesthetic experiences under normal conditions. Accordingly, I endorse anti-realism about aesthetic values: their existence, nature and exemplification are mind-dependent, while their ascriptions to objects have genuine truth-values. I back up this account by arguing against the alternative positions that either take aesthetic values to be objective or deny the truth-aptness of their attributions. Furthermore, I put forward a relativist variant of anti-realism according to which ascriptions of different aesthetic values to a particular object are all correct, given that the aesthetic experiences involved are made under normal conditions and concern the same aesthetically nonevaluative features of that object. For there is no specifically aesthetic norm by means of which one of the faultless aesthetic experiences can be picked out as the only appropriate one. That aesthetic values nevertheless show a normative dimension is ensured by their conformity to a general account of values as capacities to satisfy, or dissatisfy, rational desires. (shrink)

One of the most important elements of Hegel’s philosophical anthropology is his moral psychology. In particular, his understanding of the relation between motivations and reason plays a crucial intermediate role in connecting his anthropological meditations on the complete nature of the human being with his political theory of actualized freedom. Whereas recent important work on Hegel’s moral psychology has detected a Kantian distinction between natural desires and the rational perspective, the activity of practical reason actually takes place within motivations themselves (...) on Hegel’s view. The exercise of the free, rational will is best understood in terms of its role in shaping the experience of malleable, indeterminate motivations. Rather than stepping back, the free agent on Hegel’s account delves further into the motivation, acting on it in the dual sense of being guided by and transforming it. This is what it means for Hegel to conceive of agency as self-expression while maintaining the centrality of reason for Free Will. Hegel says that when we go further into the motivations in this way, we should stop speaking of motivation in terms of drives and instead begin speaking of character. (shrink)

The aim of this paper is to clarify the relationship of three thinkers, Hume, Bentham, and Mill in the context of utilitarianism. Through discussion, we shall figure out how and why utilitarianism is trustworthy.

H. L. A. Hart in his Law, Liberty, and Morality (1963) defended the view that legal paternalism and legal moralism can be clearly distinguished from each other. Hart also stated that while legal moralism is always unacceptable, paternalistic laws are often justifiable. In this paper it is argued that Hart held the right view for the wrong reasons. Hart defended legal paternalism by claiming, against J. S. Mill, that for various psychological reasons individuals do not know their own interests best. (...) It will be shown in the paper that if this view is taken, it is impossible to reject legal moralism. The fact that paternalism is sometimes justifiable while moralism is not can be more firmly founded on a distinction made by C. L. Ten (1971). Ten's point is that in matters which concern only the individuals themselves, their actions cannot be legitimately restricted by appeals to the consequences of their action alone. Paternalistic control can be justified only if the decision-making abilities of the controlled individual are temporarily diminished. (shrink)

. Gustav Radbruch is one of the most important German-speaking philosophers of law of the twentieth century. This paper raises the question of how to classify Radbruch's theories in the international context of legal philosophy and philosophy in general. Radbruch's work was mainly influenced by the southwest German school of Neo-Kantianism, represented by Windelband, Rickert, and Lask. Their theories of culture and value show an affirmative-holistic understanding of philosophy as a source of wisdom and meaningfulness. Kant, on the other hand, (...) belongs more to a fundamentally different, critical camp of philosophy. Although Radbruch has incorporated Kantian Elements into his theory, he is rather a member of the affirmative-holistic camp. In the end the question will be raised as to what ought to be preserved of his philosophy. (shrink)

How does the brain generate our experience of being in control over our actions and their effects? Here, we argue that the perception of events as self-caused emerges from a comparison between anticipated and actual action-effects: if the representation of an event that follows an action is activated before the action, the event is experienced as caused by one’s own action, whereas in the case of a mismatch it will be attributed to an external cause rather than to the self. (...) In a subliminal priming paradigm we show that participants overestimated how much control they had over objectively uncontrollable stimuli, which appeared after free- or forced-choice actions, when a masked prime activated a representation of the stimuli immediately before each action. This prime-induced control-illusion was independent from whether primes were consciously perceived. Results indicate that the conscious experience of control is modulated by unconscious anticipations of action-effects. (shrink)

This chapter deals with Thomas Browne’s most famous work, Religio Medici, and especially with his account of Charity. The first paragraph focuses on Browne’s specific account of the relationship between natural and supernatural. This view is inspired by Bacon, Sebunde, and Montaigne, and is crucial to understand the background of Browne’s view about the virtue of Charity. The second paragraph is about Browne’s specific understanding of Charity, which seems to be a middle stage between the traditional, Scholastic doctrine, and the (...) Kantian idea of moral law, independent from the practical law and the desire of the subject. The third paragraph deals with Religio Medici’s reversal of the traditional “order” of Charity, as well as Browne’s accounts of abnegation and friendship as an effective way for a charity to the self which meets many aspects of Foucault’s ἑπιμέλεια έαuτου. The fourth paragraph is about Browne’s analogical understanding of medicine and morality, as well as his use of the meditatio mortis. (shrink)

The transhumanist movement is much more than a simple utopia, a new school of thought or a fashionable ideology; as a matter of fact, it is a scientific and philosophical project that is already underway, and defends the use of the most advanced emerging new technologies —from biogenetics to computing, from nanotechnology to cognitive sciences, to robotics and Artificial Intelligence— with the clear goal to exponentially increase the physical, cognitive, sensory, moral and emotional capabilities of human beings. Transhumanism entails a (...) change in the anthropocentric paradigm defended by humanism, and aims to break through the limits of nature, which until recently we deemed insurmountable, in order to create a new species that is more evolved than the Homo sapiens: the Homo excelsior, a posthuman species which is superior to ours, composed by exceptionally gifted beings that have been genetically selected, designed and improved and which —according to the transhumanist imaginary— will dominate the posthuman future and will be happier, more virtuous, long-lived and intelligent than us. In this article, we propose technological humanism as an intermediate formula in the doctrinal debate between bioprogressive and bioconservative legal philosophers, so as to make possible the development of scientific research and the advancement of new technologies, although without ever having to sacrifice dignity and liberty, which are inherent qualities of the human being (who has to be viewed, in Kantian terms, as an end in itself). This paper treats of Husserl’s phenomenology of happiness or eudaimonia in five parts. In the first part, we argue that phenomenology of happiness is an important albeit relatively neglected area of research, and we show that Husserl engages in it. In the second part, we examine the relationship between phenomenological ethics and virtue ethics. In the third part, we identify and clarify essential aspects of Husserl’s phenomenology of happiness, namely, the nature of the question concerning happiness and the possibility of (...) a phenomenological answer, the power of the will, the role of vocation, the place of obligation, the significance of habituation, the necessity of selfreflection and self-criticism, the importance of sociability and solidarity, the impact of chance and destiny, and the specter of regret. In the fourth part, we establish the inextricable linkage between Husserl’s metaethics and his metaphysics. In the fi ft h part, we provide a provisional exploration of his conception of the connection between happiness and blessedness. We acknowledge that there is an extensive literature on Husserl’s phenomenological ethics, and our study has benefitted greatly from it, but we also suggest that our holistic approach critically clarifies his description of happiness, virtue, and blessedness by fully recognizing that his phenomenological metaethics is embedded in his phenomenological metaphysics. The claim of the freedom of the will (understood as an individual who is transcendent to Nature) in the name of XXth century scientific knowledge, against the perspective of XVIIIth-XIXth century scientific materialism, is analysed and refuted in the present paper. The hypothesis of reductionism finds no obstacle within contemporary natural sciences. Determinism in classical physics is irrefutable, unless classical physics is itself refuted. From quantum mechanics, some authors argue that free will is possible because there is an ontological indeterminism (...) in the natural laws, and that the mind is responsible for the wave function collapse of matter, which leads to a choice among the different possibilities for the body. However, here I defend the opposite thesis because indeterminism does not imply free will, and because the considerations about an autonomous mind sending orders to the body is against neuroscience or evolutionary theories about human beings. The quantum theory of measurement can be interpreted without the intervention of human minds, but other fields of science cannot contemplate the mentalist scenario. A fatalistic or materialist view, which denies the possibility of a free will, makes much more sense in scientific terms. (shrink)

The authors undertake a thought experiment the purpose of which is to explore possibilities for understanding moral principles in analogy with cosmic order. The experiment is based on three proposals, which are described in detail: an ontological, a neurological, and a moral proposal. The ontological proposal accepts from the phenomena of quantum physics that there is a nonempirical domain of physical reality that consists not of material things but of what is philosophically conceptualized as a realm of nonmaterial forms. This (...) realm of forms is the realm of potentiality in physical reality that quantum physics posits as an indivisible Wholeness—the One. It is the ultimate reality because everything empirical is the actualization of its forms. The neurological proposal is the hypothesis that the brain is sensitive to the potentiality waves in the cosmic field, as ordinary measuring instruments in physics are sensitive to potentiality waves at the quantum level, so that the cosmic field can communicate with the human brain. The third proposal assumes that the communication with the cosmic field can translate into moral ideas and actions. Even though the three proposals underlying the thought experiment are highly speculative, they lead to definite implications that make sense in their own right and can be applied in a useful way. From the order of reality some simple rules of conduct follow that are identical with traditional moral rules but have the character of rules of well-ness, leading to new aspects of Aristotle's concept of eudaimonia and Kant's concept of the highest good. In analogy with the structure of physical reality, where all empirical phenomena are actualizations of nonempirical forms, it is suggested that the structure of morality, too, is that of a tacit, nonempirical form that actualizes in explicit principles and moral acts through our consciousness. The tacit form is thought to exist in the realm of cosmic potentiality, together with all the other forms that the empirical world actualizes. It can appear spontaneously in our consciousness when needed, offering its guidance to our judgment and free will. Because it does not appear in the form of commandments accompanied by threats, the actions of the tacit moral form define a higher level of morality, similar to that offered by some aspects of the Christian teaching, where one acts not out of fear but on the desire to do things right. Hegel’s Philosophy of Law deals in theLaw section of the categories: person, property and contract. Research critically reconstructs this theory from a Marxist perspective. In the concept of person, first of all, the singular will is reduced to a solipsist will unrelated to intersubjectivity. Then, the concept of Hegelian property bases the private appropriation of property as the externalization of the singular will. This legal property guarantees the maintenance and reproduction of private property, that is, it will guarantee the private (...) accumulation of capital, Marx will say. Anyway, the theory of the contract would link the autonomy of the contracting wills, however, it is a mere appearance, because, in fact, the owners’ wills are under the domination of the capitalist market, as it is explained in Marx’s Capital. The theoretical deficit of Hegel’s Philosophy of Law in general is that the legal concepts of person and property correspond to the abstract will. Hegel describes the juridical description of the legal system of the modern state as the development of free will that legitimizes the asymmetry of civil society in its socioeconomic inequalities. Abstract“What we call meaning is bound to vanish”: Under this heading, an interview with Max Horkheimer was published in Der Spiegel (Jan 5, 1970). Revisiting this interview, the article focuses on Horkheimer’s thesis that human beings share the “longing that the injustice which characterizes the world must not be the final word”. It examines the extent to which Horkheimer’s notion of the “desire for the totally other” may be inspired by Kant’s claim that religion is grounded in the “need of (...) practical reason”. A further topic of discussion is Horkheimer’s critical assessment concerning current tendencies toward a “total administration of the world” that may ultimately “reduce thinking to the level of industrial processes”. Relating this critique to Kant’s reflections on the “unbelief of reason (Vernunftunglaube)”, which is based on “the maxim of reason’s independence of its own need”, the article raises the question of Horkheimer’s significance today: What relevance does Horkheimer’s method of casting doubt on any “politics that is not based on theology, metaphysics and, of course, morality” have for today’s discourse on such matters? In this context a brief glance is cast at Jürgen Habermas’s post-metaphysical reading of Horkheimer’s “negative theology”.
