“Free Will” is a philosophical term of art for a particular sort of capacity of rational agents to choose a course of action from among various alternatives. Which sort is the free will sort is what all the fuss is about. (And what a fuss it has been: philosophers have debated this question for over two millenia, and just about every major philosopher has had something to say about it.) Most philosophers suppose that the concept of free will is very (...) closely connected to the concept of moral responsibility. Acting with free will, on such views, is just to satisfy the metaphysical requirement on being responsible for one's action. (Clearly, there will also be epistemic conditions on responsibility as well, such as being aware—or failing that, being culpably unaware—of relevant alternatives to one's action and of the alternatives' moral significance.) But the significance of free will is not exhausted by its connection to moral responsibility. Free will also appears to be a condition on desert for one's accomplishments (why sustained effort and creative work are praiseworthy); on the autonomy and dignity of persons; and on the value we accord to love and friendship. In this paper I seek to defend libertarianism about free will and moral responsibility against two well-known arguments: the luck argument and the Mind argument. Both of these arguments purport to show that indeterminism is incompatible with the degree of control necessary for free will and moral responsibility. I begin the discussion by elaborating these arguments, clarifying important features of my preferred version of libertarianism—features that will be central to an adequate response to the arguments—and showing why a strategy of (...) reconciliation (often referred to as “deliberative libertarianism”) will not work. I then consider four formulations of the luck argument and find them all wanting. This discussion will place us in a favorable position to understand why the Mind argument also fails. (shrink)

This paper explores the prospects for dispositional accounts of abilities. According to so-called new dispositionalists, an agent has the ability to Φ iff they have a disposition to Φ when trying to Φ. We show that the new dispositionalism is beset by some problems that also beset its predecessor, the conditional analysis of abilities, and bring up some further problems. We then turn to a different approach, which links abilities not to motivational states but to the notion of success, and (...) consider ways of implementing that approach. Our results suggest that there are principled disanalogies between abilities and disposition which prevent any dispositional account of abilities from succeeding. (shrink)

In conclusion, then, the situationist literature provides a rich area of exploration for those interested in freedom and responsibility. Interestingly, it does not do so primarily because it is situationist in the sense of supporting the substantive thesis about the role of character traits. Rather it is because it makes us wonder whether we really do act on a regular basis with the particular normative, epistemic,and reactive capacities that are central to our identity as free and responsible agents.

There is a new objection to the Consequence Argument for incompatibilism. I argue that the objection is more wide-ranging than originally thought. In particular: if it tells against the Consequence Argument, it tells against other arguments for incompatibilism too. I survey a few ways of dealing with this objection and show the costs of each. I then present an argument for incompatibilism that is immune to the objection and that enjoys other advantages.

A crucial question for libertarians about free will and moral responsibility concerns how their accounts secure more control than compatibilism. This problem is particularly exasperating for event-causal libertarianism, as it seems that the only difference between these accounts and compatibilism is that the former require indeterminism. But how can indeterminism, a mere negative condition, enhance control? This worry has led many to conclude that the only viable form of libertarianism is agent-causal libertarianism. In this paper I show that this conclusion (...) is premature. I explain how event-causal libertarianism secures more control than compatibilism by offering a novel argument for incompatibilism. Part of the reason my solution has gone unnoticed is that it is often mistakenly assumed that an agent's control is wholly exhausted by the agent's powers and abilities. I argue, however, that control is constituted not just by what we have the ability to do, but also by what we have the opportunity to do. And it is by furnishing agents with new opportunities that event-causal libertarianism secures enhanced control. In order to defend this claim, I provide an analysis of opportunities and construct a novel incompatibilist argument to show that the opportunity to do otherwise is incompatible with determinism. I highlight three features of P.F. Strawson’s later, neglected work on freedom and responsibility. First, in response to a criticism by Rajendra Prasad, Strawson explicitly rejects an argument put forward in ‘Freedom and Resentment’ against the relevance of determinism to moral responsibility. Second, his remarkable acceptance of Prasad’s criticism motivates him to take the ‘straight path’, that is, to be straightforward about the relation between determinism, freedom, the ability to do otherwise and the conditions of responsibility. He claims that the (...) ability to do otherwise is a necessary condition of responsibility and provides a list of additional conditions, including a knowledge condition. Third, he clarifies the relation between responsibility, quality of will and the reactive attitudes. The latter do not figure essentially in his answer to the question, ‘What are the conditions of responsibility?’, but they do play an essential role in his answer to the question, ‘Why do we have the concept of responsibility?’ We have it, Strawson suggests, because of our natural concern about the quality of will with which people act, a concern expressed in our reactive attitudes. I argue that, although Strawson’s later work definitely involves a shift of emphasis when compared to ‘Freedom and Resentment’, his overall account of freedom and responsibility is coherent. The later work helps to better understand the nature and significance of Strawson’s contribution, and to identify problems with common interpretations of and objections to ‘Freedom and Resentment’. The Consequence Argument has elicited various responses, ranging from acceptance as obviously right to rejection as obviously problematic in one way or another. Here we wish to focus on one specific response, according to which the Consequence Argument begs the question. This is a serious accusation that has not yet been adequately rebutted, and we aim to remedy that in what follows. We begin by giving a formulation of the Consequence Argument. We also offer some tentative proposals about the nature (...) of begging the question. Although the charge of begging the question is frequently made in philosophy, it is surprisingly difficult to pin down the precise nature of this dialectical infelicity (or family of such infelicities). Thus we offer some new proposals about the nature of begging the question with an eye to understanding what is going on in central cases in which the charge is legitimately made. We then defend the Consequence Argument against the charge that it begs the question, so construed. We contend that, whatever the other liabilities of the argument may be, it does not beg the question against the compatibilist. (shrink)

Negligence is a problematic basis for being morally blamed and punished for having caused some harm, because in such cases there is no choice to cause or allow—or risk causing or allowing—such harm to occur. The standard theories as to why inadvertent risk creation can be blameworthy despite the lack of culpable choice are that in such cases there is blame for: (1) an unexercised capacity to have adverted to the risk; (2) a defect in character explaining why one did (...) not advert to the risk; (3) culpably acquiring or failing to rid oneself of these defects of character at some earlier time; (4) flawed use of those practical reasoning capacities that make one the person one is; or (5) chosen violation of per se rules about known precautions. Although each of these five theories can justify blame in some cases of negligence, none can justify blame in all cases intuitively thought to be cases of negligence, nor can any of these five theories show why inadvertent creation of an unreasonable risk, pure and simple, can be blameworthy. A selection function based semantics is offered for the 'can' of ability based on the idea that 'John can run a four minute mile' is true iff John would do so under the right conditions, meaning that he would do so under at least one appropriately chosen test condition. Completeness is proved for an axiom system and semantics based on this idea, and the logic turns out to be interestingly different from any standard system of modal logic.

Perszyk has argued that Molinists cannot consistently endorse the consequence argument because of a structurally similar argument for the incompatibility of true Molinist counterfactuals of freedom and the ability to do otherwise. Wierenga has argued that on the proper understanding of CCFs, there is a relevant difference between the consequence argument and the anti-Molinist argument. I argue that, even on Wierenga’s understanding of CCFs, there is in fact no relevant difference between the two arguments. Moreover, I strengthen Perszyk’s challenge by (...) highlighting further relevant similarities between CCFs and facts about the laws. (shrink)

Christopher Franklin argues that, despite appearances, everyone thinks that the ability to do otherwise is required for free will and moral responsibility. Moreover, he says that the way to decide which ability to do otherwise is required will involve settling the nature of moral responsibility. In this paper I highlight one point on which those usually called leeway theorists - i.e. those who accept the need for alternatives - agree, in contradistinction to those who deny that the ability to do (...) otherwise is needed for free will. And I explain why it falsifies both of Franklin’s claims. (shrink)

Local miracle compatibilists claim that we are sometimes able to do otherwise than we actually do, even if causal determinism obtains. When we can do otherwise, it will often be true that if we were to do otherwise, then an actual law of nature would not have been a law of nature. Nevertheless, it is a compatibilist principle that we cannot do anything that would be or cause an event that violates the laws of nature. Carl Ginet challenges this nomological (...) principle, arguing that it is not always capable of explaining our inability to do otherwise. In response to this challenge, I point out that this principle is part of a defense against the charge that local miracle compatibilists are committed to outlandish claims. Thus it is not surprising that the principle, by itself, will often fail to explain our inability to do otherwise. I then suggest that in many situations in which we are unable to do otherwise, this can be explained by the compatibilist’s analysis of ability, or his criteria for the truth of ability claims. Thus, the failure of his nomological principle to explain the falsity of certain ability claims is no strike against local miracle compatibilism. (shrink)

The consequence argument for the incompatibility of free action and determinism has long been under attack, but two important objections have only recently emerged: Warfield’s modal fallacy objection and Campbell’s no past objection. In this paper, I explain the significance of these objections and defend the consequence argument against them. First, I present a novel formulation of the argument that withstands their force. Next, I argue for the one controversial claim on which this formulation relies: the trans-temporality thesis. This thesis (...) implies that an agent acts freely only if there is one time at which she is able to perform an action and a distinct time at which she actually performs it. I then point out that determinism, too, is a thesis about trans-temporal relations. I conclude that it is precisely because my formulation of the consequence argument emphasizes trans-temporality that it prevails against the modal fallacy and no past objections. (shrink)

This paper revisits a well-known rebuttal of Peter van Inwagen’s consequence argument. This CS-rebuttal, as I shall call it, focuses on the counterfactual structure of alternative possibilities. It shows that the ability to do otherwise is such that if the agent had exercised it, the distant past and/or the laws of nature would have been different. On the counterfactual scenario, there is, therefore, no need for the agent to exercise an ability to change the past or the laws of nature. (...) I first present van Inwagen’s original version of the consequence argument. After exposing some difficulties with Lewis’ famous version of the CS-rebuttal, I proceed by explaining and defending an older and, in my view, superior version. I subsequently discuss a traditional incompatibilist rejoinder, which insists that the past and the laws of nature are fixed. Although this rejoinder delivers a valid argument against the existence of alternative possibilities, it relies on premises the compatibilist explicitly rejects. The outcome of the debate is therefore properly characterized as a genuine dialectical stalemate between compatibilists and incompatibilists. In the final sections of the paper, I demonstrate that attempts by Fischer, Holliday and Fischer and Pendergraft to move beyond the stalemate in favor of the incompatibilist position all fail. I thereby show that the debate is marred by a misunderstanding of the semantics underlying the backtracking conditionals sometimes associated with the compatibilist position. In view of my arguments, the dialectical stalemate between compatibilists and incompatibilists regarding the counterfactual structure of the ability to do otherwise remains fully intact. (shrink)

The compatibility of determinism and the ability to do otherwise has been implicitly assumed by many to be irrelevant to the viability of compatibilist responses to the manipulation argument for incompatibilism. I argue that this assumption is mistaken. The manipulation argument may be unsound. But even so, the manipulation argument, at the very least, undermines classical compatibilism, the view that free will requires the ability to do otherwise, and having that ability is compatible with determinism. This is because classical compatibilism, (...) in conjunction with any type of reply to the manipulation argument, has counterintuitive implications. In order to avoid such implications, we need not hold that determinism is incompatible with moral responsibility. But we must hold that determinism is incompatible with the ability to do otherwise. In this paper I seek to identify different sorts of freedom putatively linked to moral responsibility; I then explore the relationship between such notions of freedom and the Consequence Argument, on the one hand, and the Frankfurt-examples, on the other. I focus (in part) on a dilemma: if a compatibilist adopts a broadly speaking "conditional" understanding of freedom in reply to the Consequence Argument, such a theorist becomes vulnerable in a salient way to the Frankfurt-examples.

The objection to R-S accounts that was raised by the possibility of external agents requires the acceptance of two premises, viz., that all R-S accounts allow for puppeteers and that puppeteers necessarily make us unfree. The Metaphilosophical reply shows that to the extent that puppeteers are more problematic than determinism per se, pup-peteers may be explicitly excluded since they violate our paradigm of free will. The Metaphilosophical reply also suggests that we should not expect our mature R-S account to supply (...) logically necessary and sufficient conditions for free will, but rather give us answers that agree with our intuitions regarding paradigms of free and unfree decisions. The Irrelevancy reply completed our reply to incompatibilists who continue to object that determinism per se destroys the R-S program. It may be debated whether my autonomy variable account is a satisfactory way to spell out the Irrelevancy reply, but I think that this type of approach suggests the way to vindicating the R-S view from an important type of objection. Some compatibilists have responded to the manipulation argument for incompatibilism by proposing an historical theory of moral responsibility which, according to one version, requires that agents be morally responsible for having their pro-attitudes if they are to be morally responsible for acting on them. This proposal, however, leads obviously to an infinite regress problem. I consider a proposal by Haji and Cuypers that addresses this problem and argue that it is unsatisfactory. I then go on to propose a new solution (...) inspired by the libertarian theory of Robert Kane. (shrink)

It is widely held that for an action to be free it must be the case that the agent can do otherwise. Compatibilists and incompatibilists disagree over what this ability amounts to. Two recent articles offer novel perspectives on the debate by employing Angelika Kratzer’s semantics of ‘can’. Alex Grzankowski proposes that Kratzer’s semantics favour incompatibilism because they make valid a version of the Consequence Argument. Christian List argues that Kratzer’s semantics favour a novel form of compatibilism. I argue that (...) List’s compatibilist application of Kratzer’s semantics faces problems not faced by Grzankowski’s incompatibilist employment of them. On the other hand I argue that Kratzer’s semantics make Grzankowski’s version of the Consequence Argument valid only at the cost of rendering it dialectically useless. Contrary to both views Kratzer’s semantics do not appear to add substantial weight to either side of the compatibilism/incompatibilism dispute. (shrink)

The problem of luck is advanced and defended against libertarian theories of responsibility-enabling ability. An outline of an account of ability is articulated to explore some features of the sort of ability moral responsibility requires. The account vindicates the luck objection and suggests a novel puzzle: Libertarianism is structurally barred from answering the problem of luck because responsibility requires, but inherently lacks, an explanation from reason states to actions that preserves reliability of connection between responsibility-grounding reasons-sensitivity and action.

Međutim, s ciljem da se ispita perspektiva za moralnu odgovornost, pretpostavlja se da je kauzalni determinizam potkrijepljen znanošću. Razmatra se pojam kauzalnog determinizma, a potom se ispituju izazovi koje argument konzekvenci postavlja pred slobodu volje shvaćenu kao mogućnost da se učini drugačije. Cilj je rada (...) pokazati da su u osnovi svakodnevne upotrebe pojma moralne odgovornosti slabiji uvjeti od slobode shvaćene kao mogućnosti da se učini drugačije. We propose a new analysis of ability modals. After briefly criticizing extant approaches, we turn our attention to the venerable but vexed conditional analysis of ability ascriptions. We give an account that builds on the conditional analysis, but avoids its weaknesses by incorporating a layer of quantification over a contextually supplied set of actions.

In several writings, John Martin Fischer has argued that those who deny a principle about abilities that he calls ‘the Fixity of the Past’ are committed to absurd conclusions concerning practical reasoning. I argue that Fischer’s ‘practical rationality’ argument does not succeed. First, Fischer’s argument may be vulnerable to the charge that it relies on an equivocation concerning the notion of an ‘accessible’ possible world. Secondly, even if Fischer’s argument can be absolved of that charge, I maintain that it can (...) be defeated by appeal to an independently plausible principle about practical reasoning that I call ‘the Knowledge Principle’. In addition, I point out that Fischer’s own presentation of his argument is flawed by the fact that the principle that he labels ‘the Fixity of the Past’ does not, in fact, succeed in representing the intuitive idea that it is intended to capture. Instead, the debate should be recast in terms of a different principle, which I call ‘the Principle of Past-Limited Abilities’. The principal contribution of my paper is thus twofold: to clarify the terms of the debate about the fixity of the past, and to undermine Fischer’s ‘practical rationality’ argument for the fixity of the past. According to the Dilemma Defense, it is question-begging against the incompatibilist defender of the principle of alternative possibilities (PAP) to assume that the agent in a deterministic Frankfurt-style case (FSC) cannot do otherwise in light of causal determinism, but is nevertheless morally responsible. As a result, Fischer (Philos Rev 119:315–336, 2010; Analysis 73:489–496, 2013) attempts to undermine PAP in a different manner via a deterministic FSC. More specifically, Fischer attempts to show that if causal determinism rules out an agent’s moral (...) responsibility, it is not in virtue of its eliminating the agent’s alternative possibilities. I contend that, once we focus upon the distinction between entailment and explanation, the incompatibilist defender of PAP can successfully rebut Fischer’s argument. I argue for this claim while granting Fischer a number of assumptions that only render a defense of PAP more difficult. Additionally, I cast doubt upon Palmer’s (Synthese 191:3847–3864, 2014) critique of Fischer’s argument, which in turn renders my defense of PAP all the more critical. (shrink)

Manipulation arguments for incompatibilism all build upon some example or other in which an agent is covertly manipulated into acquiring a psychic structure on the basis of which she performs an action. The featured agent, it is alleged, is manipulated into satisfying conditions compatibilists would take to be sufficient for acting freely. Such an example used in the context of an argument for incompatibilism is meant to elicit the intuition that, due to the pervasiveness of the manipulation, the agent does (...) not act freely and is not morally responsible for what she does. It is then claimed that any agent's coming to be in the same psychic state through a deterministic process is no different in any relevant respect from the pertinent manner of manipulation. Hence, it is concluded that compatibilists' proposed sufficient conditions for free will and moral responsibility are inadequate, and that free will and moral responsibility are incompatible with determinism. One way for compatibilists to resist certain manipulation arguments is by appealing to historical requirements that, they contend, relevant manipulated agents lack. While a growing number of compatibilists advance an historical thesis, in this paper, I redouble my efforts to show, in defense of nonhistorical compatibilists like Harry Frankfurt, that there is still life left in a nonhistorical view. The historical compatibilists, I contend, have fallen shy of discrediting their nonhistorical compatibilist rivals. (shrink)

Some philosophers hold that objective consequentialism is false because it is incompatible with the principle that “ought” implies “can”. Roughly speaking, objective consequentialism is the doctrine that you always ought to do what will in fact have the best consequences. According to the principle that “ought” implies “can”, you have a moral obligation to do something only if you can do that thing. Frances Howard-Snyder has used an innovative thought experiment to argue that sometimes you cannot do what will in (...) fact have the best consequences because you do not know what will in fact have the best consequences. Erik Carlson has raised two objections against Howard-Snyder’s argument. This paper examines Howard-Snyder’s argument as well as Carlson’s objections, arguing that Carlson’s objections do not go through but Howard-Snyder’s argument fails nonetheless. Moreover, this paper attempts to show that objective consequentialism and other objectivist moral theories are compatible with the principle that “ought” implies “can”. Finally, this paper analyses a special kind of inability: ignorance-induced inability. (shrink)

This thesis is an investigation into the nature of those abilities that are relevant to free will when the latter is understood as requiring the ability to do otherwise. I assume from the outset the traditional and intuitive picture that being able to do otherwise bestows a significant kind of control on an agent and I ask what kinds of ability are implicated in such control. In chapter 1 I assess the simple conditional analysis of the sense of ‘can’ relevant (...) to free will, and I agree with the consensus that this analysis fails. In chapter 2 I consider Kadri Vihvelin’s contemporary version of the conditional account, which is cast in terms of dispositions. I develop, via engagement with Vihvelin’s view, an account of how modal properties such as dispositions and abilities should be individuated. In chapter 3 I use this account to show why Vihvelin’s account of free will is unsatisfactory. I also show how it helps us to better understand a distinction that is often made in the free will literature, namely, that between some notion of ‘general’ ability on the one hand and a notion of ‘specific’ or ‘particular’ abilities on the other. I argue that there are two important distinctions, both of which are relevant to free will. In chapter 4 I consider Keith Lehrer’s analysis of ‘can’ and conclude that while it fails to achieve Lehrer’s stated aim – namely, that of demonstrating that free will is compatible with determinism – it does contain some useful insights about the kinds of ability relevant to free will. In the fifth and final chapter I switch gears somewhat; I argue that various conditions typically treated under the banner of ‘the epistemic criteria on moral responsibility’ should instead be treated as conditions on an agent’s being able to do otherwise. It has been argued that a successful counterexample to the principle of alternative possibilities must rule out any possibility of the agent making an alternative decision right up to the moment of choice. This paper challenges that assumption. Distinguishing between an ability and an opportunity, this paper presents a Frankfurt-style case in which there is an alternative possibility, but one it is highly improbable that the agent will access. In such a case the agent has only the opportunity, not the (...) ability to do otherwise. (shrink)

In a critical study of some recent action theory Professor James Tomberlin [7] makes some insightful and suggestive remarks concerning the by now well known problem of "Smith and the airplane" formulated by Keith Lehrer and Richard Taylor [3]. While these remarks do significantly advance our knowledge of the nature of the problem, I would like to try to show why the strategy they indicate does not lead to a solution that represents any improvement on the one developed in [1], (...) [8] and [2].The problem of Smith and the airplane is posed by the following apparent inconsistency. Suppose it is now shortly before 3:30 and Smith is at a country airport. The 3:30 plane is the only possible means whereby Smith can arrive at the city at 4:00. There is nothing to prevent Smith from leaving on the 3:30 plane, but he in fact does not do so: Then each of the following statements are true. (shrink)
