Not every speech act can be a lie. A good definition of lying should be able to draw the right distinctions between speech acts that can be lies and speech acts that under no circumstances are lies. This paper shows that no extant account of lying is able to draw the required distinctions. It argues that a definition of lying based on the notion of ‘assertoric commitment’ can succeed where other accounts have failed. Assertoric commitment is analysed in terms of (...) two normative components: ‘accountability’ and ‘discursive responsibility’. The resulting definition of lying draws all the desired distinctions, providing an intensionally adequate analysis of the concept of lying. (shrink)

A new definition of lying is gaining traction, according to which you lie only if you say what you know to be false. Drawing inspiration from “New Evil Demon” scenarios, I present a battery of counterexamples against this “Knowledge Account” of lying. Along the way, I comment upon the methodology of conceptual analysis, the moral implications of the Knowledge Account, and its ties with knowledge-first epistemology.

In a recent article, Krauss (2017) raises some fundamental questions concerning (i) what the desiderata of a definition of lying are, and (ii) how definitions of lying can account for partial beliefs. This paper aims to provide an adequate answer to both questions. Regarding (i), it shows that there can be a tension between two desiderata for a definition of lying: 'descriptive accuracy' (meeting intuitions about our ordinary concept of lying), and 'moral import' (meeting intuitions about what is wrong with (...) lying), vindicating the primacy of the former desideratum. Regarding (ii), it shows that Krauss' proposed 'worse-off requirement' meets neither of these desiderata, whereas the 'comparative insincerity condition' (Marsili 2014) can meet both. The conclusion is that lies are assertions that the speaker takes to be more likely to be false than true, and their distinctive blameworthiness is a function of the extent to which they violate a sincerity norm. This paper defends the simple view that in asserting that p, one lies iff one knows that p is false. Along the way it draws some morals about deception, knowledge, Gettier cases, belief, assertion, and the relationship between first- and higher-order norms.

Almost all philosophers agree that a necessary condition on lying is that one says what one believes to be false. But, philosophers haven’t considered the possibility that the true requirement on lying concerns, rather, one’s degree-of-belief. Liars impose a risk on their audience. The greater the liar’s confidence that what she asserts is false, the greater the risk she’ll think she’s imposing on the dupe, and, therefore, the greater her blameworthiness. From this, I arrive at a dilemma: either the belief (...) requirement is wrong, or lying isn’t interesting. I suggest an alternative necessary condition for lying on a degree-of-belief framework. In a recent book (_Lying and insincerity_, Oxford University Press, 2018), Andreas Stokke argues that one lies iff one says something one believes to be false, thereby proposing that it becomes common ground. This paper shows that Stokke’s proposal is unable to draw the right distinctions about insincere performative utterances. The objection also has repercussions on theories of assertion, because it poses a novel challenge to any attempt to define assertion as a proposal to update the common ground.

What is the relationship between lying, belief, and knowledge? Prominent accounts of lying define it in terms of belief, namely telling someone something one believes to be false, often with the intent to deceive. This paper develops a novel account of lying by deriving evaluative dimensions of responsibility from the knowledge norm of assertion. Lies are best understood as special cases of vicious assertion; lying is the anti-paradigm of proper assertion. In the philosophical literature on the definition of lying, the analysis is generally restricted to cases of flat-out belief. This chapter considers the complex phenomenon of lies involving partial beliefs – beliefs ranging from mere uncertainty to absolute certainty. The first section analyses lies uttered while holding a graded belief in the falsity of the assertion, and presents a revised insincerity condition, requiring that the liar believes the assertion to be more likely to be false than true. The second section (...) analyses assertions that express graded beliefs, exploring how mitigation and reinforcement can alter the insincerity conditions for lying. The last section considers the case of lies that attack certainty (knowledge-lies), understood as attempt to alter the hearer's graded beliefs. (shrink)

Traditional definitions of lying require that a speaker believe that what she asserts is false. Sam Fox Krauss seeks to jettison the traditional belief requirement in favour of a necessary condition given in a credence-accuracy framework, on which the liar expects to impose the risk of increased inaccuracy on the hearer. He argues that this necessary condition importantly captures nearby cases as lies which the traditional view neglects. I argue, however, that Krauss's own account suffers from an identical drawback of (...) being unable to explain nearby cases; and even worse, that account fails to distinguish cases of telling lies from cases of telling the truth. This paper offers a systematic classification and characterization of speech acts and their norms. Recently, the normative approach has been applied to various speech acts, most notably to constatives. I start by showing how the work on the norms of assertion has influenced various approaches to the norms of other speech acts. I focus on the fact that various norms of assertion have different extensions, i.e., they denote different clusters of illocutions as belonging to an assertion. I argue that this (...) has consequences for theorising about norms of other speech acts and generates certain arbitrary divisions. In the central part, I analyse two groups of speech acts. Firstly, ordinary speech acts, like predictions or retractions. Secondly, I indicate how the normative view can be extended to so-called ancillary speech acts, like presuppositions or implicatures. I end with a discussion of possible extensions of the normative approach, focusing on the debate on lying. (shrink)

Epistemologists focus primarily on cases of knowledge, belief, or credence where the evidence which one possesses, or on which one is relying, plays a fundamental role in the epistemic or normative status of one's doxastic state. Recent work in epistemology goes beyond the evidence one possesses to consider the relevance for such statuses of evidence which one does not possess, particularly when there is a sense in which one should have had some evidence. I focus here on Sanford Goldberg's approach (...) ("Should Have Known," Synthese, forthcoming; and "On the Epistemic Significance of Evidence You Should Have Had," Episteme 2016, this issue); but the discussion will interest anyone working on epistemic defeat. Can fictions lie? According to a classic conception, works of fiction can never contain lies, since their content is not presented as true, nor is it meant to deceive us. But this classic view can be challenged. Sometimes fictions appear to make claims about the actual world, and these claims can be designed to convey falsehoods, historical misconceptions, and even pernicious stereotypes. Should we conclude that some fictional statements are lies? This article introduces two views that support a positive answer, (...) and two that support a negative one. After examining various ways in which fictions can deceive, it concludes in favour of the view that fictional statements can mislead, but never lie. (shrink)

Partial lying denotes the cases where we partially believe something to be false but nevertheless assert it with the intent to deceive the addressee. We investigate how the severity of partial lying may be determined and how partial lies can be classified. We also study how much epistemic damage an agent suffers depending on the level of trust that she invests in the liar and the severity of the lies she is told. Our analysis is based on the results from (...) exploratory computer simulations of an arguably rational Bayesian agent who is trying to determine how biased a coin is while observing the coin tosses and listening to a liar’s misleading predictions about the outcomes. Our results provide an interesting testable hypothesis at the intersection of epistemology and ethics, namely that in the longer term partial lies lead to more epistemic damage than outright lies. This thesis addresses philosophical problems concerning improper assertions. The first part considers the issue of defining lying: here, against a standard view, I argue that a lie need not intend to deceive the hearer. I define lying as an insincere assertion, and then resort to speech act theory to develop a detailed account of what an assertion is, and what can make it insincere. Even a sincere assertion, however, can be improper (e.g., it can be false, or unwarranted): in the (...) second part of the thesis, I consider these kinds of impropriety. An influential hypothesis maintains that proper assertions must meet a precise epistemic standard, and several philosophers have tried to identify this standard. After reviewing some difficulties for this approach, I provide an innovative solution to some known puzzles concerning the permissibility of false assertions. In my view, assertions purport to aim at truth, but they are not subject to a norm that requires speakers to assert a proposition only if it is true. (shrink)

Moorean constructions are famously odd: it is infelicitous to deny that you believe what you claim to be true. But what about claiming that p, only to immediately put into question your evidence in support of p? In this paper, we identify and analyse a class of quasi-Moorean constructions, which we label counterevidentials. Although odd, counterevidentials can be accommodated as felicitous attempts to mitigate one’s claim right after making it. We explore how counterevidentials differ from lexicalised mitigation operators, parentheticals, and (...) anaphoric mitigation devices, and consider some cognate non-assertoric constructions. We conclude by exploring the implications of our analysis for theorising about linguistic responsibility, assertion, and lying. (shrink)

Proponents of semiotic arguments against the commodification of certain goods face the following challenge: formulate your argument such that it does not appeal to immoral consequences, nor is really an argument showing that we ought to reform the meaning we give to commodification. I here attempt to meet this challenge via appeal to the notion of what I call proto-on-a-par value. Under this construal, the semiotic argument yields that the commodification of certain goods necessarily signals value choice, where value choice (...) ought not to be signaled. (shrink)

This paper introduces and argues for the hypothesis that judgments of testimonial worth are central to our practice of normatively appraising speech. It is argued that judgments of testimonial worth are central both to the judgement that an agent has lied, and to the acceptance of testimony. The hypothesis that, in lying, an agent necessarily displays poor testimonial worth, is shown to resolve a new puzzle about lying, and the recalcitrant problem raised by the existence of bald faced lies, and (...) selfless assertions. It is then shown that the notion of testimonial worth allows us to capture the distinction between taking a speaker at their word, and treating them as a mere indicator of the truth in a way other theories fail to do. This paper discusses a novel kind of argument for assessing the moral significance of acts of lying and misleading. It is based on considerations about valuable social norms that might be eroded by these actions, because these actions function as signals. Given that social norms can play an important role in supporting morality, individuals have a responsibility to preserve such norms and to prevent ‘cultural slopes’ that erode them. Depending on whether there are norms against lying, misleading, or both, and (...) how likely it is that they might be eroded, these actions can thus have different moral significance. In cases in which the rule ‘do not lie’, as a relatively simple rule, functions as a ‘focal point’, acts of misleading are often morally preferable. In other words, in such cases the possibility of ‘cultural slopes’ can ground a context-dependent slippery slope argument for a moral difference between lying and misleading. (shrink)

This paper offers a brief survey of the philosophical literature on assertion, presenting each contribution to the RIFL special issue "Assertion and its social significance" within the context of the contemporary debate in which it intervenes. The discussion is organised into three thematic sections. The first one concerns the nature of assertion and its relation with assertoric commitment – the distinctive responsibility that the speaker undertakes in virtue of making a statement. The second section considers the epistemic significance of assertion, (...) exploring the role that assertion plays in the transmission of knowledge, the epistemic constraints that regulate it, and its relation with truth.
