This paper aims at combining different theoretical and methodological approaches for the analysis of discourse, focusing in particular on argumentative structures. At a first level an attempt is made to include argumentation in critical discourse analysis in order to extend the analysis of interaction between “structures of discourse” and “structures of ideologies” (T. A. van Dijk, R. Wodak and M. Meyer (eds.), Methods of Critical Discourse Analysis. Sage, London, 1995) to higher levels of language description. At a second level the (...) study will integrate the qualitative approaches of critical discourse analysis and argumentation theory with the quantitative tools of corpus linguistics, so that the analysis can be carried out on a representative amount of texts and in a more systematic way. Even though corpus linguistics tends to be focused on meanings localized at the level of words, while argumentative structures stretch out through longer units of text, an integration can be attempted by circumscribing the enquiry to those aspects of argumentation which are signalled by indicators, and are therefore electronically retrievable. In particular, this paper investigates the use of dissociation and presupposition in a corpus of newspaper articles published in the run up to the war on Iraq. Both structures respond to retrievability criteria while being powerful instruments to convey ideologically oriented messages. (shrink)

Perelman's work has been very influential in various disciplines, among them philosophy, rhetoric and law. Especially the typology of argumentative schemes which he developed together with L. Olbrechts-Tyteca has been considered as an excellent classification of arguments in natural language. There are, however, some weaknesses of this typology which make its application to empirical research quite difficult, namely, the lack of explicitness and the absence of clear criteria of demarcation. Still, the typology is highly relevant for empirical research, if these (...) weaknesses are removed. This is illustrated with an example: the scheme called ‘the division of the whole into its parts’ by Perelman/Olbrechts-Tyteca is described explicitly and then applied to the analysis of a sample of everyday arguments (mostly taken from newspapers). Negotiation research primarily focuses on negotiators? interests in order to understand negotiation and offer advice about the prospective outcome. Win-win outcomes, i.e., outcomes that serve the interests of all negotiating parties, have been established and promoted as the ultimate goal for any negotiation situation. We offer a perspective that draws on Aristotle's philosophical program and discuss how the outcome is not defined by the parties? interests, but by the intersubjective validity of claims, which can essentially be treated as representative of (...) the ?truth.? Academic debates are so frequent and omnipresent in most disciplines, particularly the social sciences and humanities, it seems obvious that disagreements are bound to occur. The aim of this paper is to show that whereas the agent who perceives his/her contribution as being misunderstood locates the origin of the communication problem on the side of the receiver who "misinterprets" the text, the emitter is in fact also contributing to the possibility of this misunderstanding through the very manner in which his/her (...) text is written. In other words, I propose a symmetric approach to understanding misunderstandings: taking simultaneously into account the position of the reader in the scientific field and the structure of the texts of the writers. The paper thus proposes to complement the sociological analysis of controversies in a scientific field with the close reading of texts, a practice usually found in studies of argumentation, in order to explain the occurrence of misunderstandings. The debate surrounding the charge of "relativism" among sociologists of scientific knowledge provides us with a case study to analyse in detail the argumentative context of misunderstanding. This article synthesizes the results of several interviews with argumentation scholars from across the American continents to address three questions regarding the connections in argumentation studies between North and South/Central America: “What motivated the study of argumentation in the Americas?” “What commonalities, if any, exist in argumentation studies across the Americas?” and “What should the future of argumentation studies in the Americas look like?” Using these interviews in combination with existing textual sources, the article also provides motivated suggestions for directions (...) for the future of the community in the field. This paper considers the cause for canonization of Gianna Beretta Molla, a pediatrician who died in 1962 because during her pregnancy she refused medical treatment that would have caused her to abort. The acts of Gianna’s cause contribute to the creation of a specific example mirroring and sustaining the position adopted by the Church in the 1960s and 1970s in matters of abortion, motherhood, family, and right to life. These issues were particularly delicate in those years, when the Catholic Church (...) was facing the rise of liberal and radical positions that contrasted with its doctrine; in particular, law n. 194 of 22 May 1978 constituted the first act of abortion legalization in Italy. In this context, the sanctification of Gianna had strategic importance for the Church as a way of presenting the faithful with the Catholic ideal of motherhood through a concrete example to follow. In this paper, I argue that the way in which the figure of Gianna is represented in the acts of her cause for canonization can be read as the figurativization of the axiology laid out in more abstract terms in Church texts with a normative value, such as the constitutions it issued during the Second Vatican Council and other official documents expressing the pontifical magisterium. The article develops and justifies, on the basis of the epistemological argumentation theory, two central pieces of the theory of evaluative argumentation interpretation: 1. criteria for recognizing argument types and 2. rules for adding reasons to create ideal arguments. Ad 1: The criteria for identifying argument types are a selection of essential elements from the definitions of the respective argument types. Ad 2: After presenting the general principles for adding reasons (benevolence, authenticity, immanence, optimization), heuristics are proposed for finding missing (...) reasons, for deductive arguments, e.g., semantic tableaux are suggested. In this paper, we will explore two initiatives that focus on the importance of employing logical theories in educating people how to think and reason properly, one in Poland: The Lvov-Warsaw School; the other in North America: The Informal Logic Initiative. These two movements differ in the logical means and skills that they focus on. However, we believe that they share a common purpose: to educate students in logic and reasoning (logical education conceived as a process) so that they may (...) be able to apply their skills to analyze the issues in their society (logical culture as a result of logical education). This paper focuses on the inferential configuration of arguments, generally referred to as argument scheme. After outlining our approach, denominated Argumentum Model of Topics (AMT, see Rigotti and Greco Morasso 2006, 2009; Rigotti 2006, 2008, 2009), we compare it to other modern and contemporary approaches, to eventually illustrate some advantages offered by it. In spite of the evident connection with the tradition of topics, emerging also from AMT’s denomination, its involvement in the contemporary dialogue on argument schemes should not be (...) overlooked. The model builds in particular on the theoretical and methodological perspective of pragma-dialectics in its extended version, reconciling dialectic and rhetoric; nevertheless, it also takes into account numerous other contributions to the study of argument schemes. Aiming at a representation of argument schemes able to monitor the inferential cohesion and completeness of arguments, AMT focuses on two components of argument scheme that could be distinguished, readapting pragma-dialectical terms, as procedural and material respectively. The procedural component is based on the semantic-ontological structure, which generates the inferential connection from which the logical form of the argument is derived. The material component integrates into the argument scheme the implicit and explicit premises bound to the contextual common ground (Rigotti 2006). In this paper, the comparison of the AMT to other approaches focuses on the inferential configuration of arguments and not on the typologies of argument schemes and on the principles they are based on, which the authors intend to tackle in a further paper. This paper presents what we call with Plantin an argumentative cell as an unit which is inspired by Toulmin’s layout of arguments, in order to analyse two major effects of pseudo-objectivity in argumentation. Four problems of Toulmin's layout will be tackled: Data are only described as facts, the definition of Backing is blurred, but it may be linked with sources of information and extended to Data, the dialectical component of the Rebuttal needs to be extended to concessions, and dealing with (...) complex argumentation within such a model is quite difficult. Treating these problems will highlight the rhetorical possibility of a "bias of objectivity": numerous arguments that use starting points which may appear to be objective or shared in order to impose a standpoint to the addressee. This bias can be seen in at least two rhetorical strategies: the first one is using facts as arguments without signs of evidentiality in grounds for the argument. The second one is delivering opinions as apparently collectively shared. (shrink)

Some conspicuous characteristics of argumentation as we all know this phenomenon from our shared everyday experiences are in my view vital to its theoretical treatment because they should have methodological consequences for the way in which argumentation research is conducted. To start with, argumentation is in the first place a communicative act complex, which is realized by making functional verbal communicative moves.

The aim of this article is to show the argumentative component in the discourse of teachers. This is done on the basis of an analysis of the argumentative strategies used by teachers during the first class of a university course in order to increase their discourse efficiency. The analysis of the corpus studied shows that in such a session teachers use argumentative strategies in order to control the social distance which separates them from students. In doing so, they make a (...) double movement, one of distancing and one of approximation, with the aim of achieving a balance which permits them to consolidate their authority in the eyes of the students and, at the same time, present an accessible and well-disposed image to them. Negotiation is mainly treated as a process through which counterparts try to satisfy their conflicting interests. This traditional, subjective approach focuses on the interests-based relation between subjects and the resources which are on the bargaining table; negotiation is viewed as a series of joint decisions regarding the relation of each subject to the negotiated resources. In this paper, we will attempt to outline an intersubjective perspective that focuses on the communication-based relation among subjects, a relation that is founded upon communicative (...) rationality mechanisms which are inherent in social activity. Much in contrast to the concept of interests which describe the relationship of each subject alone to the resources, we will use the concept of ?claim-rights? which are properly formed and validated only vis-à-vis negotiating partners and on the basis of the communication that develops among them. We will offer a step-by-step account of the creation of claim-rights and argue that their validation does not necessarily lie in the parties? interests, but in the communication mechanisms that induce consensus and result in mutually acceptable outcomes. . Legal theory has so far focused exclusively on judicial activity, not on legislation. This is due to the specific legal framework of reasoning, upon which it is essential to act upon rules, wherever they come from. This form of legalism is criticized and replaced by weak legalism. Weak legalism makes it possible to detect the principles of legislation that underly the activity of the legislator. Legisprudence is the theory of these principles.

In this paper a unified theory of models and thought experiments is proposed by considering them as fictions, la Vaihinger. In order to reach this aim, the Hertzian and Botzmannian interpretation of theories as Bilder is reconsidered.

In this article we take the use of examples as a means to explore the processes of persuasion and consensus-construction involved in the legitimation of popular management knowledge. Examples, as concrete instances or events used to substantiate a wider argument, have been variedly regarded in different research traditions. Classical logic and rhetoric have considered them an inferior form of argument, useful for pedagogic or public debate but inadequate for higher forms of thought. This spirit still permeates much psychological research on (...) communication, where the great persuasive import of examples has been contrasted with more scientific and formal resources for argumentation. Considered in this light, the contingent and episodic nature of examples seems to make them cognitively inferior to explicit statements of general rules. However, various strands of research on the nature of scientific knowledge have shown that implicit forms of knowledge are an integral part of scientific expertise. Examples may thus be more central to disciplinary thought than the conventional normative view seems to allow. In this spirit, we explore the use of examples in a hotly contested field, that of popular discourse on business and management. The profusion of examples in this kind of writing has been often noted, and almost as often criticized. We seek to explore more fully how these examples are deployed, examining the discursive devices that mark examples within the development of the text, their function as rhetorical moves, and their role in presenting arguments that are never otherwise made explicit. Persuasion is a fact of social life, one upon which positive and negative views can be taken. Argumentative rhetoric is often functionally defined as aiming to persuade. Different views on persuasion are taken in argumentative studies, and many other disciplines focus on persuasion. This article takes an “inter-discursive” view of argumentation, and, following the “Hamblin’s trend”, suggests a possible replacement for the concept of persuasion by the inter-discursive concept of alignment.

How do Dutch people let each other know that they disagree? What do they say when they want to resolve their difference of opinion by way of an argumentative discussion? In what way do they convey that they are convinced by each other’s argumentation? How do they criticize each other’s argumentative moves? Which words and expressions do they use in these endeavors? By answering these questions this short essay provides a brief inventory of the language of argumentation in Dutch.

One of the most crucial questions in the philosophy of law deals with the very nature of legal reasoning. Does this reasoning belong to logic or to rhetoric? This debate, increasingly centered on rhetoric, is not merely a question of language use; it covers and indicates a more basic choice between formal legalism — focusing on rational deduction from the law — and pragmatic judiciarism — focusing on reasonable debate in the court.Today, it is necessary to circumscribe the respective fields (...) of logic and rhetoric in the language of law, while showing how they are sometimes complementary in the resolution of legal problems.But, even when we have acknowledged the need for a rhetoric accompanied by logic, we have to define that rhetoric cautiously. I confront a narrow rhetoric, often called argumentation, with a wider one of interrogative nature. There are two conceptions of rationality at stake. Their comparison enables us to raise the question of the foundation of law, as a locus to use arguments, as well as to solve social problems. (shrink)

We propose in this paper DIAL, a framework for inter-agents dialogue, which formalize a collective decision-making process to compose divergent interests and perspectives. This framework bounds a dialectics system in which argumentative agents play and arbitrate to reach an agreement. For this purpose, we propose an argumentation-based reasoning to manage the conflicts between arguments having different strengths for different agents. Moreover, we propose a model of argumentative agents which justify the hypothesis to which they commit and take into account the (...) commitments of their interlocutors according to their reputations. In the scope of our dialectics system, a third agent is responsible of the final decision outcome which is taken by resolving the conflict between two players according to their competences and the advanced arguments. We shall investigate the similarities and dissimilarities between old and new dialectic. For the ‘old dialectic’, we base our survey mainly on Aristotle’s Topics and Sophistical Refutations, whereas for the ‘new dialectic’, we turn to contemporary views on dialogical interaction, such as can, for the greater part, be found in Walton’s The New Dialectic. Three issues are taken up: types of dialogue, fallacies, and strategies. Though one should not belittle the differences in scope and outlook that obtain between the old (...) and the new dialectic, the paper will show that in many respects the old dialectic foreshadows the new dialectic. Post-war argumentation theorists have tended to regard argumentation as one thing and mathematical proof as another. Perelman (1958, 1969), for example, defined the word ‘argumentation’ stipulatively as a contrast term to ‘demonstration’: whereas mathematical reasoning as theorized by modern formal logic, he writes, is a matter of deducing theorems from axioms in accordance with stipulated rules of transformation, argumentation aims at gaining the adherence of minds (Perelman 1969, pp. 1–2). Toulmin (1958) contrasted his “jurisprudential model” of argument, according to which (...) the validity of an argument is a matter of its following proper procedure, with a “geometrical model” according to which validity is a matter of its having a proper shape comparable to the shape of a triangle (Toulmin 1958, p. 95). The article deals with an interpretation of the work of Ch. Perelman. The author tries to determine the meaning of reasonableness in a hermeneutical and anthropological perspective. He then places the work of Perelman in the light of the theory of symbolic interactionism of G.H. Mead.

Whorf and Wittgenstein are perhaps the most famous names in linguistics and philosophy associated with the assumption that language plays a decisive role in shaping our view of reality. After a critical discussion of Whorf's linguistic relativity principle I conclude that it is not language as a system, but the use of language according to the rules of language games which connects language thought and world view, especially if some particular usage becomes the commonly accepted norm. This traditional norm also (...) enters argumentative discourse in the form of background assumptions occuring in the premises of arguments. Thus, traditional points of view and prevailing ideologies in a society, even if challenged in discussions, can become reinforced and stabilized. This is illustrated with a critical analysis of the role and function of tautological utterances in argumentative discourse, which only apparently are compelling means of argumentation. (shrink)

This paper presents a theorisation of collaborative activity that was developed in the research field known as “collaborative learning”, in order to understand the processes of co-elaboration of meaning and knowledge. Collaboration, as distinguished from cooperation, coordination and collective activity, is defined as a continued and conjoined effort towards elaborating a “joint problem space” of shared representations of the problem to be solved. An approach to analysing the processes of co-construction of a joint problem space is outlined, in terms of (...) inter-discursive operations, together with approaches to defining different forms of cooperative activity. In conclusion, the specificity of this approach to defining collaboration is discussed in relation to other fields of research. (shrink)

.The article deals with the difference between some forms of legal positivism. It is argued that, even in continental legal systems which are typically “rule bound,” there is some space left for principles in the legal system. The author tries to explain how this space can be filled and what methods should be used by a judge to do so.
