The Rachels–Temkin spectrum arguments against the transitivity of better than involve good or bad experiences, lives, or outcomes that vary along multiple dimensions—e.g., duration and intensity of pleasure or pain. This paper presents variations on these arguments involving combinations of good and bad experiences, which have even more radical implications than the violation of transitivity. These variations force opponents of transitivity to conclude that something good is worse than something that isn’t good, on pain of rejecting the good altogether. It is notoriously difficult to find an intuitively satisfactory rule for evaluating populations based on the welfare of the people in them. Standard examples, like total utilitarianism, either entail the Repugnant Conclusion or in some other way contradict common intuitions about the relative value of populations. Several philosophers have presented formal arguments that seem to show that this happens of necessity: our core intuitions stand in contradiction. This paper assesses the state of play, focusing on the most powerful of these (...) ‘impossibility theorems’, as developed by Gustaf Arrhenius. I highlight two ways in which these theorems fall short of their goal: some appeal to a supposedly egalitarian condition which, however, does not properly reflect egalitarian intuitions; the others rely on a background assumption about the structure of welfare which cannot be taken for granted. Nonetheless, the theorems remain important: they give insight into the difficulty, if not perhaps the impossibility, of constructing a satisfactory population axiology. We should aim for reflective equilibrium between intuitions and more theoretical considerations. I conclude by highlighting one possible ingredient in this equilibrium, which, I argue, leaves open a still wider range of acceptable theories: the possibility of vague or otherwise indeterminate value relations. Larry Temkin famously argues that what he calls spectrum arguments yield strong reason to reject Transitivity, according to which the ‘all-things-considered better than’ relation is transitive. Spectrum arguments do reveal that the conjunctions of independently plausible claims are inconsistent with Transitivity. But I argue that there is very strong independent reason to reject such conjunctions of claims, and thus that the fact that they are inconsistent with Transitivity does not yield strong reason to reject Transitivity.

In 'Rethinking the Good', Larry Temkin makes two core claims. First, the goodness of a distribution is sometimes ‘essentially comparative’ – it sometimes depends on which alternative distribution(s) it is compared to. Second, such cases threaten the transitivity of ‘all things considered better than’. I argue that the goodness of a distribution may indeed depend on what other distributions are feasible. But contrary to Temkin, I also argue that transitivity holds even when the goodness of a distribution depends on the (...) feasible set of which it is a member. (shrink)

Ethics in the tradition of Derek Parfit’s Reasons and Persons is riddled with sorites-like arguments, which lead us by what seem innocent steps to seemingly false conclusions. Take, for example, spectrum arguments for the Repugnant Conclusion that appeal to slight differences in quality of life. Several authors have taken the view that, since spectrum arguments are structurally analogous to sorites arguments, the correct response to spectrum arguments is structurally analogous to the correct response to sorites arguments. This sorites analogy is (...) here argued against. There are potential structural disanalogies between spectrum arguments and sorites arguments. But even if these arguments are relevantly structurally analogous, they differ in their content in ways that show the sorites analogy to be implausible. Two content-based disanalogies are here explored—one is inspired by Parfit’s work on reductionism, and the other involves hypersensitivity. The chapter concludes with a methodological lesson. In Rabinowicz (2008), I considered how value relations can best be analysed in terms of fitting pro-attitudes. In the formal model of that paper, fitting pro-attitudes are represented by the class of permissible preference orderings on a domain of items that are being compared. As it turns out, this approach opens up for a multiplicity of different types of value relationships, along with the standard relations of ‘better’, ‘worse’, ‘equally as good as’ and ‘incomparable in value’. Unfortunately, the approach is (...) vulnerable to a number of objections. I believe these objections can be avoided if one re-interprets the underlying notion of preference: instead of treating preference as a ‘dyadic’ attitude directed towards a pair of items, we can think of it as a difference of degree between ‘monadic’ attitudes of favouring. Each such monadic attitude has just one item as its object. Given this re-interpretation, permissible preferences can be modelled by the class of permissible assignments of degrees of favouring to items in the domain. From this construction, we can then recover the old modelling in terms of the class of permissible preference orderings, but the previous objections to that model no longer apply. (shrink)

Lexical views in population axiology can avoid the Repugnant Conclusion without violating Transitivity or Separability. However, they imply a dilemma: either some good life is better than any number of slightly worse lives, or else the ‘at least as good as’ relation on populations is radically incomplete. In this paper, I argue that Archimedean views face an analogous dilemma. I thus conclude that the lexical dilemma gives us little reason to prefer Archimedean views. ABSTRACT I consider paradoxical spectrum arguments involving transitive relations like ‘better than’. I argue that, despite being formally different from sorites arguments, at least some spectrum arguments arise from vagueness, and that vagueness might often be the most natural diagnosis.

If A is better than B and B is better than C, then A is better than C, right? Larry Temkin and Stuart Rachels say: No! Betterness is nontransitive, they claim. In this paper, I discuss the central type of argument advanced by Temkin and Rachels for this radical idea, and argue that, given this view very likely has sceptical implications for practical reason, we would do well to identify alternative responses. I propose one such response, which employs the idea (...) that rational agents might regard some options as incommensurate in value, and will reasonably employ a heuristic of status quo maintenance to avoid suboptimal choices from incommensurate goods. The spectrum argument purports to show that the better-than relation is not transitive, and consequently that orthodox value theory is built on dubious foundations. The argument works by constructing a sequence of increasingly less painful but more drawn-out experiences, such that each experience in the spectrum is worse than the previous one, yet the final experience is better than the experience with which the spectrum began. Hence the betterness relation admits cycles, threatening either transitivity or asymmetry of the relation. This (...) paper examines recent attempts to block the spectrum argument, using the idea that it is a mistake to affirm that every experience in the spectrum is worse than its predecessor: an alternative hypothesis is that adjacent experiences may be incommensurable in value, or that due to vagueness in the underlying concepts, it is indeterminate which is better. While these attempts formally succeed as responses to the spectrum argument, they have additional, as yet unacknowledged costs that are significant. In order to effectively block the argument in its most typical form, in which the first element is radically inferior to the last, it is necessary to suppose that the incommensurability is particularly acute: what might be called radical incommensurability. We explain these costs, and draw some general lessons about the plausibility of the available options for those who wish to save orthodox axiology from the spectrum argument. (shrink)

The essentially comparative conception of value entails that the value of a state of affairs does not depend solely upon features intrinsic to the state of affairs, but also upon extrinsic features, such as the set of feasible alternatives. It has been argued that this conception of value gives us reason to abandon the transitivity of the better than relation. This paper shows that the support for intransitivity derived from this conception of value is very limited. On its most plausible (...) interpretations, it merely provides a necessary, but not sufficient, condition for intransitivity. It is further argued that the essentially comparative conception of value appears to support a disjunctive conclusion: there is incommensurability of value or betterness is not transitive. Of these two alternatives, incommensurability is preferable, because it is far less threatening to our other axiological commitments. (shrink)

This thesis consists of several independent papers in population ethics. I begin in Chapter 1 by critiquing some well-known 'impossibility theorems', which purport to show there can be no intuitively satisfactory population axiology. I identify axiological vagueness as a promising way to escape or at least mitigate the effects of these theorems. In particular, in Chapter 2, I argue that certain of the impossibility theorems have little more dialectical force than sorites arguments do. From these negative arguments I move to (...) positive ones. In Chapter 3, I justify the use of a 'veil of ignorance', starting from three more basic normative principles. This leads to positive arguments for various kinds of utilitarianism - the best such arguments I know. But in general the implications of the veil depend on how one answers what I call 'the risky existential question': what is the value to an individual of a chance of non-existence? I chart out the main options, and raise some puzzles for non-comparativism, the view that life is incomparable to non-existence. Finally, in Chapter 4, I consider the consequences for population ethics of the idea that what is normatively relevant is not personal identity, but a degreed relation of psychological connectedness. In particular, I pursue a strategy based in population ethics for understanding the controversial 'time-relative interests' account of the badness of death. (shrink)

This article argues that the decision problem in the original position should be characterized as a decision problem under uncertainty even when it is assumed that the denizens of the original position know that they have an equal chance of ending up in any given individual’s place. It supports this claim by arguing that (a) the continuity axiom of decision theory does not hold between all of the outcomes the denizens of the original position face and that (b) neither us (...) nor the denizens of the original position can know the exact point at which discontinuity sets in, because the language we employ in comparing different outcomes is ineradicably vague. It is also argued that the account underlying (b) can help proponents of superiority in value theory defend their view against arguments offered by Norcross and Griffin. (shrink)

Some find it plausible that a sufficiently long duration of torture is worse than any duration of mild headaches. Similarly, it has been claimed that a million humans living great lives is better than any number of worm-like creatures feeling a few seconds of pleasure each. Some have related bad things to good things along the same lines. For example, one may hold that a future in which a sufficient number of beings experience a lifetime of torture is bad, regardless (...) of what else that future contains, while minor bad things, such as slight unpleasantness, can always be counterbalanced by enough good things. Among the most common objections to such ideas are sequence arguments. But sequence arguments are usually formulated in classical logic. One might therefore wonder if they work if we instead adopt many-valued logic. I show that, in a common many-valued logical framework, the answer depends on which versions of transitivity are used as premises. We get valid sequence arguments if we grant any of several strong forms of transitivity of 'is at least as bad as' and a notion of completeness. Other, weaker forms of transitivity lead to invalid sequence arguments. The plausibility of the premises is largely set aside here, but I tentatively note that almost all of the forms of transitivity that lead to valid sequence arguments seem intuitively problematic. Still, a few moderately strong forms of transitivity that might be acceptable lead to valid sequence arguments, although weaker statements of the initial value claims avoid these arguments at least to some extent. According to a widely held view, rationality demands that the preferences of a person be transitive. The transitivity assumption is an axiom in standard theories of rational choice. It is also prima facie very plausible. I argue here that transitivity is not a necessary condition of rationality; it is a constraint only in some cases. The argument presented here is based on the non-linearity of differential utility functions. This paper has four parts. First, I present an argument against the transitivity (...) assumption (I, II). Second, I discuss some objections; this will also bring out some features of the view defended here, like the essentially comparative nature of choice (III). Then, I discuss certain proposals that promise to avoid my conclusion (IV). Finally, I go into some implications concerning the nature of rational decision making (V). To accept some intransitivities as rational does not make our life easier; it can even lead to hard choices. However, it does not lead to skepticism about rational choice. (shrink)

How can we resist the repugnant conclusion? James Griffin has plausibly suggested that part way through the sequence we may reach a world—let us call it “J”—in which the lives are lexically superior to those that follow. If it would be preferable to live a single life in J than through any number of lives in the next one, then it would be strange to judge K the better world. Instead, we may reasonably “suspend addition” and judge J superior, as (...) if aggregating the lives in the larger world intrapersonally. I argue that the addition of new people with separate preferences renders this inference illicit when comparing J+ and K. When one pairwise comparison suspends addition and the other does not, the result is an intransitive value judgement: J < J+ < K < J, producing the mere addition paradox. (shrink)

Ruth Chang and Joseph Raz have both drawn far-reaching consequences for agency from the phenomenon of incommensurability. After criticizing their arguments, I outline an alternative view: if incommensurability is vagueness, then there are no substantial implications for agency, except perhaps a limited form of naturalistic voluntarism if our reasons are provided by desires.

This thesis consists of a series of papers in population ethics: a subfield of normative ethics concerned with the distinctive issues that arise in cases where our actions can affect the identities or number of people of who ever exist. Each paper can be read independently of the others. In Chapter 1, I present a dilemma for Archimedean views in population axiology: roughly, those views on which adding enough good lives to a population can make that population better than any (...) other. In Chapter 2, I extend Gustaf Arrhenius’s famous impossibility theorems in population axiology into the domain of choices under risk. My risky impossibility theorems dispense with the assumption that welfare levels are finitely fine-grained, and so tell against lexical views in population axiology. In Chapter 3, I present objections to critical-level and critical-range views in population axiology. I then sketch out what I call the ‘Imprecise Exchange Rates View’ and argue that it is an attractive alternative. In Chapter 4, I address critical-level and critical-range views again. This time, I note that they are vulnerable to objections from biographical identity: identity between lives. I suggest that these objections give us reason to reject critical-level and critical-range views and embrace the Total View. In Chapter 5, I argue that objections of the same form – objections from personal identity – tell against person-affecting views in population ethics. In Chapter 6, I draw out some counterintuitive implications of two recent complaints-based theories of the procreation asymmetry. (shrink)

Parfit’s Repugnant Conclusion argues, against intuition, that for any world A, another world Z with higher population and minimal well-being is better. That intuition is incorrect because the argument has not considered resources that support well-being. Z must have many more resources supporting well-being than A does. Z is repugnant because it spreads those resources among too many people; another world with Z’s resources and fewer people, if available, would be far superior. But Z is still better than A; it (...) is worth accepting its very large population to get the resources needed to support their well-being. (shrink)

This thesis defends John Rawls’s constructivist theory of justice against three distinct challenges. -/- Part one addresses G. A. Cohen’s claim that Rawls’s constructivism is committed to a mistaken thesis about the relationship between facts and principles. It argues that Rawls’s constructivist procedure embodies substantial moral commitments, and offers an intra-normative reduction rather than a metaethical account. Rawls’s claims about the role of facts in moral theorizing in A Theory of Justice should be interpreted as suggesting that some of our (...) moral beliefs, which we are inclined to hold without reference to facts, are, in fact, true, because certain facts obtain. This thesis and the acknowledgement of the moral assumptions of Rawls’s constructivism help to show that Rawls does not, and does not need to, deny Cohen’s thesis. -/- Part two defends the characterization of the decision problem in Rawls’s original position as a decision problem under uncertainty. Rawls stipulates that the denizens of the original position lack information that they could use to arrive at estimates of the likelihood of ending up in any given social position. It has been argued that Rawls does not have good grounds for this stipulation. I argue that given the nature of the value function we should attribute to the denizens of the original position and our cognitive limitations, which also apply to the denizens of the original position, their decision problem can be characterized as one under uncertainty even if we stipulate that they know that they have an equal chance of being in any individual’s place. -/- Part three assesses the claim that a true commitment to Rawls’s difference principle requires a further commitment to an egalitarian ethos. This egalitarian ethos is offered as a means to bring about equality and Pareto-optimality. Accordingly, I try to undermine the case for an egalitarian ethos by challenging the desirability of the ends it is supposed to further or by showing that it is redundant. I argue that if primary goods are the metric of justice, then Pareto optimality in the space of the metric of justice is undesirable. I then argue that if the metric of justice is welfare, depending on the theory of welfare we adopt, an egalitarian ethos will either be redundant or will have objectionably paternalistic consequences. At first sight, if A is all-things-considered better than B and B is all-things-considered better than C, the judgment that A is all-things-considered better than C seems to follow. This should be a straight-forward consequence of the transitivity of the \all-things-considered better than" relation. However, if we deny that transitivity is a logical axiom of those relations involving comparatives, then it might turn out that betterness is not transitive. Following Temkin's terminology, a relation R will be de ned as nontransitive (...) i either it is intransitive (i.e. aRb and bRc yet :(aRc)) or if transitivity cannot be applied, for there is no single relation R that holds between all the alternatives. More spefici cally, this could happen in a case where the obtaining of the better-than relation depends on different factors according to the nature of the relata. As a result, there are two main strategies available to question the axiom of transitivity: the rst is by providing an effective counterexample displaying cRa as well as (aRb ^ bRc), hence yielding a cycle. The second, more general way, is to show that all-things-considered betterness is a relation that conceptually involves comparison-dependent betterness relations, so that it is likely that transitivity fails to apply across different alternatives. The aim of this paper is to investigate part of the recent attack on the transitivity of better than, to conclude that there seems to be no cogent reason why this would not be a transitive relation.
