It is common to explain agreement and disagreement in terms of relations among mental states. The main purpose of the present discussion is to present an alternative way of thinking about the relationship between mental states and agreement and disagreement. The idea is to connect agreement and disagreement with the individuation of mental states. More specifically, for at least some mental states, standing in the same relations of agreement and disagreement is both necessary and sufficient for identity. This provides us (...) with a framework for discussing issues related to agreement and disagreement. It is for instance well-known that de se beliefs raise questions about agreement and disagreement. The present framework allows us to discuss such beliefs while relying on assumptions that are interestingly different from the standard assumptions in the literature. While most of the discussion focuses on beliefs, there are other mental states, such as desires, that can seemingly also stand in relations of agreement and disagreement. On the traditional approach to metaethics, theories are expected to be faithful to ordinary normative discourse—or at worst (if we think the ordinary discourse is metaphysically unsound) to deviate from it as little as possible. This paper develops an alternative, “conceptual engineering” approach to metaethical enquiry, which is not in this way restricted by our present discourse. On this approach, we will seek to understand the psychology, semantics, metaphysics and epistemology, not just of our present concepts, but also of other (...) possible normative concepts. The ultimate point of the enquiry is to choose between the available alternatives: to decide what kinds of normative concepts to use, going forward. The paper aims to make this suggestion precise, in a way that (a) answers worries about circularity, (b) answers worries about “changing the subject”, (c) retains metaethics as a truth-seeking enquiry, and (d) leads to an independently plausible methodology. It is common to distinguish between disagreement in the state sense (being in disagreement) and disagreement in the activity sense (having a disagreement). This paper deals with the question of what it is for two people to have a disagreement. First, I present and reject the thesis according to which having a disagreement is a matter of expressing conflicting attitudes. I argue that this is not sufficient for having a disagreement: two people can express conflicting attitudes without having a disagreement. (...) Second, I present and reject the thesis according to which having a disagreement involves not only the expression of conflicting attitudes, but also the persuasive attempt to bring the other around to one’s view. I argue that this is not necessary for having a disagreement: two people can have a disagreement without trying to change each other’s minds. Finally, I put forward an alternative account that goes beyond the mere expression of conflicting attitudes, but that does not go as far as to posit the attempt to change someone’s mind. Having a disagreement, I submit, is a matter of expressing conflicting attitudes and demanding agreement, that is, advancing the normative claim that the other should share one’s attitude. (shrink)

Predicates of personal taste have attracted a great deal of attention from philosophers of language and linguists. In the intricate debates over PPT, arguably the most central consideration has been which analysis of PPT can best account for the possibility of faultless disagreement about matters of personal taste. I argue that two models of such disagreement—the relativist and absolutist models—are empirically inadequate. In their stead, I develop a model of faultless taste disagreement which represents it as involving a novel incompatibility (...) relation between preferences that I call type-noncotenability. This model is available to all parties in the ongoing debates about PPT, but it points up an advantage enjoyed by expressivist accounts of PPT. In closing, I consider four objections against the model that, while failing to fully undermine it, open up promising avenues of inquiry about the nature of disagreement. (shrink)

Legal philosophers make a number of bold, contentious claims about the nature of law. For instance, some claim that law necessarily involves coercion, while others disagree. Some claim that all law enjoys presumptive moral validity, while others disagree. We can see these claims in at least three, mutually exclusive ways: (1) We can see them as descriptions of law’s nature (descriptivism), (2) we can see them as expressing non-descriptive attitudes of the legal philosophers in question (expressivism), or (3) we can (...) see them as practical claims about how we should view law or order our society (pragmatism). This paper argues that we should understand these claims in the pragmatist way, as claims about how we should view law or order society. (shrink)

The aim of this paper is to reconstruct Charles L. Stevenson’s metaethical view. Since his metaethical view is a form of emotivism, I will start by explaining what the core claims of emotivism are. I will then explore and comment on the specific claims of Stevenson’s proposal. Last, I will offer an overview of the objections that have traditionally been raised against emotivism.

When, in 1979, A. J. Ayer was asked for an evaluation of his youthful Language, Truth and Logic (LTL), he replied: ‘I suppose the most important of the defects was that nearly all of it was false’. Like many of the claims in the book itself, this verdict is open to question. What was wrong with LTL was not so much that what it said was false, but that it presented philosophical issues in an excessively simple and aggressive way. Yet (...) it was just this quality that put the book and its author on the philosophical map, ensuring for them an important place in the history of twentieth-century philosophy. LTL presented a challenge to traditional ways of doing philosophy, the reverberations of which are still evident today. (shrink)

Bernard Williams proposed his relativism of distance based on the recognition “that others are at varying distances from us”. Recent work in moral psychology and experimental philosophy highlights the prevalence of folk relativism in relation to spatial and temporal distance. However, Williams’ relativism of distance as well as recent empirical findings which seem to support some of Williams’ main ideas on this issue have received scant attention. In this article, we would like to focus on the phenomenon of moral relativism (...) regarding spatiotemporal distance as an entry point to the nature of folk moral relativism and the methodology of meta-ethics. To do so, we first introduce Williams’ relativism of distance. Then we compare Williams’ approach on this matter to recent experimental approaches on folk relativism. On this score the main result is that Williams’ proposal is consistent with several well-established insights on the experimental study of folk relativism. Williams’ relativism of distance is not only empirically plausible, but it is also of relevance for shaping the methodology of an empirically informed meta-ethics. Many have argued that various features of moral disagreements create problems for cognitivism about moral judgment, but these arguments have been shown to fail. In this paper, I articulate a new problem for cognitivism that derives from features of our responses to moral disagreement. I argue that cognitivism entails that one of the following two claims is false: (1) a mental state is a belief only if it tracks changes in perceived evidence; (2) it is intelligible to make moral judgments (...) that do not track changes in perceived evidence. I explain that there is a good case that (1) holds such that we should prefer theories that do not entail the negation of (1). And I argue that the seeming intelligibility of entirely intransigent responses to peer disagreement about moral issues shows us that there is a good case that (2) holds. (shrink)

This chapter has two sections, each focusing on a distinct way in which ethical disagreement and variations in ethical judgment matter for theories of ethical thought and talk. In the first section, we look at how the variation poses problems for both cognitivist and non-cognitivist ways of specifying the nature of ethical judgments. In the second, we look at how disagreement phenomena have been taken to undermine cognitivist accounts, but also at how the seeming variation in cognitive and non-cognitive contents (...) between parties of deep ethical disagreement challenges both cognitivist and non-cognitivist accounts of disagreement itself. Metaethical noncognitivists have trouble arriving at a respectable semantic theory for moral language. The goal of this article is to make substantial progress toward demonstrating that these problems may be overcome. Replacing the predominant expressivist semantic agenda in metaethics with a dynamic perspective on meaning and communication allows noncognitivists to provide a satisfying analysis of negation and other constructions that have been argued to be problematic for metaethical noncognitivism, including disjunctions. The resulting proposal preserves some of the key insights from (...) recent work on the semantics of expressivism while highlighting the widely neglected early noncognitivists' sympathies to the kind of dynamic story I intend to tell here. A comparison between the advertised dynamic semantic story and current proposals that treat expressivism as a pragmatic rather than semantic theory about moral language is provided. (shrink)

Moral non-cognitivists hope to explain the nature of moral agreement and disagreement as agreement and disagreement in non-cognitive attitudes. In doing so, they take on the task of identifying the relevant attitudes, distinguishing the non-cognitive attitudes corresponding to judgements of moral wrongness, for example, from attitudes involved in aesthetic disapproval or the sports fan’s disapproval of her team’s performance. We begin this paper by showing that there is a simple recipe for generating apparent counterexamples to any informative specification of the (...) moral attitudes. This may appear to be a lethal objection to non-cognitivism, but a similar recipe challenges attempts by non-cognitivism’s competitors to specify the conditions underwriting the contrast between genuine and merely apparent moral disagreement. Because of its generality, this specification problem requires a systematic response, which, we argue, is most easily available for the non-cognitivist. Building on premisses congenial to the non-cognitivist tradition, we make the following claims: (1) In paradigmatic cases, wrongness-judgements constitute a certain complex but functionally unified state, and paradigmatic wrongness-judgements form a functional kind, preserved by homeostatic mechanisms. (2) Because of the practical function of such judgements, we should expect judges’ intuitive understanding of agreement and disagreement to be accommodating, treating states departing from the paradigm in various ways as wrongness-judgements. (3) This explains the intuitive judgements required by the counterexample-generating recipe, and more generally why various kinds of amoralists are seen as making genuine wrongness-judgements. Indexical contextualism (IC) is an account of predicates of personal taste (PPTs) which views the semantic content of PPTs as sensitive to the context in which they are uttered, by virtue of their containing an implicit indexical element. Should the context of utterance change, the semantic content carried by the PPT will also change. The main aim of this paper is to show that IC is unable to provide a satisfactory account of PPTs. I look at what I call “pure” (...) IC accounts and show that because they fail to respect empirical data regarding disagreements where neither person is at fault, known as “faultless disagreements”, they must be rejected. I then go on to consider what I call IC “plus” (IC+) accounts. Such accounts attempt to account for the faultlessness of such disagreements using a simple indexical semantics, whilst introducing some extra ingredient to account for the disagreement part. I focus on two main versions of IC+: Gutzmann’s (in: Meier, van Wijnberger-Huitink (eds) Subjective meaning: alternatives to relativism, De Gruyter, Berlin, 2016) expressivist account, and López de Sa’s (in: García-Carpintero, Kölbel (eds) Relative truth, Oxford University Press, Oxford, 2008; Erkenntnis 80(Supp 1):153–165, 2015) presuppositional account. I discuss some internal worries with these accounts before going on to some final remarks about IC/IC+ in general. I conclude that neither IC nor IC+ can provide a satisfactory semantics for PPTs. In this paper we motivate and develop a new approach to predicates of personal taste within the framework of semantic relativism. Our primary goal is to explain faultless disagreement—the phenomenon where two parties disagree, yet both have uttered something true—which is often thought to arise from the use of predicates of personal taste. We combine semantic relativism with an expressivist semantics to yield a novel hybrid theory which we call _Expressive-Relativism_. We motivate the theory by rehearsing a famous objection to (...) Relativism from Frege which we interpret as severing the connection between contradiction and disagreement for relativists. Endorsing the objection, we respond by enriching relativism with an expressivist component which explains disagreement over matters of taste as a refusal to share perspectives rather than as resting on contradiction. (1.6) The average moral relativist often admonishes others to be more tolerant of those who engage in alternative ethical practices and to refrain from making negative moral judgments about them. (1.7) The average moral relativist sometimes makes negative moral judgments about the behavior of others—e.g., by harshly judging moral absolutists to be intolerant—but is less inclined to do so when the relativist’s metaethical views are salient in a context of judgment. Sociologists often ask why particular groups of people have the moral views that they do. I argue that sociology’s empirical research on morality relies, implicitly or explicitly, on unsophisticated and even obsolete ethical theories, and thus is based on inadequate conceptions of the ontology, epistemology, and semantics of morality. In this article I address the two main problems in the sociology of morality: (1) the problem of moral truth, and (2) the problem of value freedom. I identify two ideal–typical approaches. (...) While the Weberian paradigm rejects the concept of moral truth, the Durkheimian paradigm accepts it. By contrast, I argue that sociology should be metaphysically agnostic, yet in practice it should proceed as though there were no moral truths. The Weberians claim that the sociology of morality can and should be value free; the Durkheimians claim that it cannot and it should not. My argument is that, while it is true that factual statements presuppose value judgments, it does not follow that sociologists are moral philosophers in disguise. Finally, I contend that in order for sociology to improve its understanding of morality, better conceptual, epistemological, and methodological foundations are needed. (shrink)

People occasionally change their moral beliefs and principles, and they may experience such changes as occurring independently of their wishes. Moral realists argue that this phenomenon of moral conversion is evidence for moral realism, and against noncognitivism. However, contemporary noncognitivists can acknowledge such changes--including changes "against our wills"--and can account for the changes in a simpler and more plausible manner. If moral realism posits real moral facts to account for moral conversion the result will be an extreme and untenable inflation (...) of moral realist ontology. (shrink)

What are the historical origins of the argumentum ad consequentiam, the argument from consequences, sometimes featured as an informal fallacy in logic textbooks? As shown in this paper, knowledge of the argument can be traced back to Aristotle. And this type of argument shows a spotty history of recognition in logic texts and manuals over the centuries. Very often, different people, with different constitutions and comic sensibilities, will make divergent, conflicting judgments about the comic properties of a given person, object, or event, on account of those differences in their constitutions and comic sensibilities. And in many such cases, while we are inclined to say that their comic judgments are in conflict, we are not inclined to say that anybody is in error. The comic looks like a poster domain for the phenomenon of faultless disagreement. I argue (...) that the kind of theory that does the best job of accounting for the appearance of faultless disagreement is a de se version of a response-dependence account, according to which thinking that x is funny is self-attributing a property of the type, being disposed to have R to x in C. Quasi‐realists are expressivists who say much of what realists say. To avoid making their view indistinguishable from realism, however, they usually stop short of saying everything realists say. Many realists therefore think that something important is missing from quasi‐realism. I argue that quasi‐realists can undermine this thought by defending a version of quasi‐realism that I call super‐quasi‐realism. This version seems indistinguishable from realism, but I argue that this is a mistaken impression that arises because we cannot believe super‐quasi‐realism.

In this paper I argue that the explanationist argument in favour of moral realism fails. According to this argument, the ability of putative moral properties to feature in good explanations provides strong evidence for, or entails, the metaphysical claims of moral realism. Some have rejected this argument by denying that moral explanations are ever good explanations. My criticism is different. I argue that even if we accept that moral explanations are (sometimes) good explanations the metaphysical claims of realism do not (...) follow. (shrink)

Moral emotions have been badly neglected by philosophical ethics. In my view to the detriment of this discipline because they are not only important for the moral evaluation of persons but also for value theory and thus also for a theory of morally right actions. This paper outlines my account of moral emotions. Emotions such as regret or shame are sometimes but not always moral emotions. I will determine when they are moral emotions. This paper elaborates and defends an expressivist account of the claims of mind-independence embedded in ordinary moral thought. In response to objections from Zangwill and Jenkins it is argued that the expressivist 'internal reading' of such claims is compatible with their conceptual status and that the only 'external reading' available doesn't commit expressivisists to any sort of subjectivism. In the process a 'commitment-theoretic' account of the semantics of conditionals and negations is defended.

In the 1960s, Peter Geach and John Searle independently posed an important objection to the wide class of 'noncognitivist' metaethical views that had at that time been dominant and widely defended for a quarter of a century. The problems raised by that objection have come to be known in the literature as the Frege-Geach Problem, because of Geach's attribution of the objection to Frege's distinction between content and assertoric force, and the problem has since occupied a great deal of the (...) attention both of defenders of broadly noncognitivist views, and of their critics. In this article I explain Geach and Searle's historical objections, and put the subsequent discussion into dialectical context, paying some attention to the developments along the way and how they have enhanced our overall understanding of the problem. Recent break-throughs in surgery and the discovery of an effective immunosupressive drug called cyclosporin, have brought a Renaissance in organ transplants. These medical advances have also heightened concern over the already critical shortage of body organs. Several alternatives have been suggested which may help alleviate the organ shortage. One such alternative is to allow commerce in human organs. This article discusses the morality of commercialization of human organs within the framework of several ethical theories.

Eriksson thinks that moral disagreements are intuitively faulty whereas disagreements about taste are intuitively faultless. He attempts to account for this difference by arguing, first, that moral judgements and taste judgements differ with regard to the presence of a disposition to challenge conflicting judgements and, second, that the intuition that a judgement is mistaken consists in the disposition to challenge it. In this article, I focus on the reasons given to support the first claim and argue that they are not (...) sufficient. First, I assess the thesis that a taste judgement is only contingently connected with a disposition to challenge conflicting judgements. Second, I focus on the claim that a moral judgement is in part a disposition to challenge conflicting judgements. Wilfrid Sellars described the moral syllogism that supports the inference “I ought to do x” from “Everyone ought to do x” as a “syntactical disguise” which embodies a “mistake.” He nevertheless regarded this form of reasoning as constitutive of the moral point of view. Durkheim was the source of much of this reasoning, and this context illuminates Sellars’ unusual philosophical reconstruction of the moral point of view in terms of the collective intentions of an ideal community of rational members for (...) which the syllogism is empirically valid. The reconstruction also sheds light on the question of the status of common sense and normativity in Sellars’ naturalistic metaphysics. (shrink)

The global turn in media ethics has presented a tough challenge for traditional models of moral theory: How do we assert common moral standards while also showing respect for the values of those from outside the Western tradition? The danger lies in advocating for either extreme: reason-dependent absolutism or cultural relativism. In this paper, I reject Cliff Christian’s attempts to solve the problem and propose instead a moral theory of universal standards that are discovered via a mix of rationally grounded (...) methods. Such universality refutes relativism but, because it is grounded in evolutionary naturalism and life-world philosophy—as opposed to a Kantian or theological transcendentalism—it also avoids absolutism. Although environmental philosophy and the human exploration of space share common beginnings, scholars from either field have not given adequate attention to the possible connections between them. In this essay, we seek to spur the rapprochement and cross-fertilization of philosophy and space policy by highlighting the philosophic dimensions of space exploration, pulling together issues and authors that have had insufficient contact with one another. We do so by offering an account of three topics: planetary exploration, planetary protection and the search (...) for extraterrestrial life, and terraforming. The resulting synthesis seeks to change our thinking about earthbound environmental ethics as it considers the philosophical dimensions of space exploration, and introduces the possible benefits of a humanities-oriented approach to space policy. Hybrid expressivists depart from pure expressivists by claiming that moral sentences express beliefs and desires. Daniel Boisvert and Michael Ridge, two prominent defenders of hybrid views, also depart from pure expressivists by claiming that moral sentences express general attitudes rather than an attitude towards the subject of the sentence. This article argues that even if the shift to general attitudes helps solve some of the traditional problems associated with pure expressivism, a view like Ridge's, according to which the descriptive meaning (...) is speaker relative, turns out to have problems explaining moral disagreement. Leiter (2016) charges public philosophy with being “neoliberal”. To understand that charge better, I define, in §1, three versions of public philosophy which might be concerned and two pictures of its practice targeted by Leiter. I also compare two deliberative sites wherein those pictures may play out. In §2, I sketch how Leiter’s two paradoxes for “neoliberal” public philosophy lead to a revised public philosophy. §3 questions the paradoxes’ empirical grounding and scope. Lastly, in §4, I assume Leiter’s picture and (...) illustrate how philosophical dialogue, through appeal to personal self-image and “moral perceptions”, may still influence public discourse. I conclude that Leiter both over- and understates his case and that his conclusions require greater scrutiny. (shrink)

Brian Leiter throws down two gauntlets to philosophers engaged in dialogue with the broader public. If, with the first, public philosophers recognize that they cannot offer substantive answers but only sophisticated method, they nevertheless fail to realize that said method does not resonate with the very public whom they purport to help. For, with the second, that method does not engage the emotivist and tribalist cast of contemporary public discourse: emotivist because a person’s moral and political beliefs are a function (...) of emotional attitudes or affective responses for which she adduces reasons post hoc; tribalist because the person tracks not the inferential relation between beliefs but her similarity with interlocutors. In order to understand the full extent of this critique, it is necessary, first, to parse strands of public philosophy, distinct discursive sites, and pictures of philosophical practice and, then, to probe the critique’s empirical groundedness and intended scope. These elements in place, it is then possible to sketch public philosophy reconceived along Leiter’s lines as equal part rigor and rhetoric. That sketch may be somewhat filled out through two tactics employed in Jeffrey Stout’s work. These form part of a toolkit for philosophical dialogue whereby philosophers get a discursive grip on non-discursive factors underlying public discourse and push back on Leiter's dilemma. (shrink)

In Part I, I offer a "constructivist" interpretation of Xunzi's philosophy. On the constructivist view, there is no privileged description of the world. Concepts, categories, and norms as social constructs help us effectively manage our way through the world, rather than reveal or express univocal knowledge of it. ;In the opening chapter, I argue that dao should be understood as open ended and that Xunzi's worldview allows for a plurality of legitimate daos---at least at the theoretical level. Chapter Two discusses (...) the concepts of li and lei and rejects the idea that true categories follow from a "god-like" understanding of rational patterns. Rather, patterns and categories are mutually entailing. That is, categories are not simply based on patterns, but are at the same time a precondition for patterning. Chapter Three addresses the related concept of ming , and the idea of zhengming . Attuning names is not matching them to any transcendent standard, but making them fitting given our nature and circumstances. It is constructing and maintaining a socially responsible language. I also discuss here the complex manner in which early Confucians understood names to be developed and sanctioned. In Chapter Four I discuss ritual theory and argue that Xunzi offers a this-world centered religious sensibility. Far from a matter of slavishly following a code of behaviors set down perfectly by ancient sages, the performance of li requires interpretation in every application. Further, norms associated with li may evolve in response to changing needs and conditions. In the final chapter of Part I, I turn to the issue of virtue and moral development, arguing that there is no fixed set of virtues. ;Part II shifts focus to the contemporary relevance of a constructivist way of thinking by using it to understand the cross-cultural dynamics taking place in international discourse on human rights. In short, interpreting the arguments of contemporary representatives of East-Asian countries through a constructivist lens reveals them to be more compelling than they might otherwise have seemed. This dissertation investigates the plausibility of metaethical relativism, or more specifically, what I call “moral truth-value relativism”: the idea that the truth of a moral statement or belief depends on who utters or has it, or who assesses it. According to the most prevalent variants of this view in philosophical literature – “standard relativism” – the truth-values are relative to people’s moralities, often understood as some subset of their affective or desirelike attitudes. Standard relativism has two main contenders: absolutism – (...) the view that the truth-values of moral statements and beliefs do not vary in that way – and non-cognitivism – the view that moral judgements do not have truth-values, since they express affective or desire-like attitudes rather than beliefs. Almost the entire dissertation concerns the plausibility of standard relativism in contrast to absolutism. Part 1 examines first the two main arguments for standard relativism: that it accounts for the connection between moral judgements and motivation (chapter 2), and for the prevalence of diversity of moral opinion (chapter 3). Then the most common objection is considered: that it is inconsistent with the existence of genuine moral disagreements (chapter 4). I argue that these arguments are inconclusive. Both relativism and absolutism can account for the features discussed. Part 2 focuses on the fact that different people have different strongly held intuitions about the relative or absolute nature of morality. I argue that given a common methodological approach in philosophy and metaethics, which takes such intuitions as evidence of correct analyses, this difference in intuitions suggests that neither a relativist nor absolutist analysis can be correct for everyone’s moral judgements. I argue that this result holds both given semantic internalism (chapter 6) and given semantic externalism (chapter 7). To get one single analysis of everyone’s moral judgements we would have to abandon the intuitionbased methodology. In chapter 8, however, I argue that we can maintain this methodology if we accept analysis pluralism, the view that different analyses hold for different people’s moral judgements. (shrink)
