Argument from analogy is a common and formidable form of reasoning in law and in everyday conversation. Although there is substantial literature on the subject, according to a recent survey ( Juthe 2005) there is little fundamental agreement on what form the argument should take, or on how it should be evaluated. Th e lack of conformity, no doubt, stems from the complexity and multiplicity of forms taken by arguments that fall under the umbrella of analogical reasoning in argumentation, dialectical (...) studies, and law. Modeling arguments with argumentation schemes has proven useful in attempts to refine the analyst’s understanding of not only the logical structures that shape the backbone of the argument itself, but also the logical underpinning of strategies for evaluating it, strategies based on the semantic categories of genus and relevance. By clarifying the distinction between argument from example and argument from analogy, it is possible to advance a useful proposal for the treatment of argument from analogy in law. (shrink)

This paper proposes a framework for representing in Bayesian terms the idea that analogical arguments of various degrees of strength may provide inductive support to yet untested scientific hypotheses. On this account, contextual information plays a crucial role in determining whether, and to what extent, a given similarity or dissimilarity between source and target may confirm an empirical hypothesis over a rival one. In addition to showing confirmation by analogy compatible with the adoption of a Bayesian standpoint, the proposal outlined (...) in this paper reveals a close agreement between the fulfillment of Hesse’s (Models and analogies in science, University of Notre Dame Press, 1963) criteria for analogical arguments capable of inductive support and the attribution of confirmatory power by the lights of Bayesian confirmation theory. In this sense, the Bayesian representation not only enriches a framework, Hesse’s, of enduring relevance for understanding scientific activity, but may offer something akin to a proof of concept of it. Analogical reasoning projects a property taken to hold of something or things (the source) to something else (the target) on the basis of just those similarities premised in the analogy. Standard similarity-based accounts of analogical reasoning face the question: Under what conditions does a collection of similarities sufficiently warrant analogical projection? One answer is: When a thing’s having the premised similarities somehow determines its having the projected property. Standardly, this answer has been interpreted as claiming that a formally defined determination (...) relation exists between the variables of which the determining properties are values and the variable of which the determined property is a value. This paper supplies another answer: Analogical projection is warranted when an item’s having the projected property is grounded in its having the premised similarities. Drawing on the metaphysics of grounding, we propose a model of grounded analogy on which analogical reasoning is valid under metaphysical necessity. Our model thus provides one answer to John Stuart Mill’s question of how analogical reasoning based on limited information about a single source case can provide an indefeasible justification for analogical projection. Once a relation of total grounding is ascertained to hold between some similarities and the projected property, no other properties bear on the projectability of the projected property from the source to the target. This paper is a case study. After formulating three norms for critical assessment of argumentation (section 1), I give a brief overview of Galileo’s argumentative strategy in his Dialogue and present his argument for the cause of the tides, which appears as an argument by analogy (section 2). I then discuss possible reconstructions of this argumentation, with one particular suggestion in detail. These arguments seem to fall short, given the aforementioned set of norms (section 3). This leads to my own (...) proposal of Galileo’s argument. I defend this proposal and it’s general idea - that is, the argument’s pattern. It will be classified as ‘interventionist’ and useful regarding the goals of critical assessment (section 4). Finally, I suggest that the pattern of argument is applicable to other cases and useful for applied theory of science (section 5). (shrink)

This paper presents an attempt to bridge the gap between logical and cognitive treatments of strategic reasoning in games. There have been extensive formal debates about the merits of the principle of backward induction among game theorists and logicians. Experimental economists and psychologists have shown that human subjects, perhaps due to their bounded resources, do not always follow the backward induction strategy, leading to unexpected outcomes. Recently, based on an eye-tracking study, it has turned out that even human subjects who (...) produce the outwardly correct ‘backward induction answer’ use a different internal reasoning strategy to achieve it. The paper presents a formal language to represent different strategies on a finer-grained level than was possible before. The language and its semantics help to precisely distinguish different cognitive reasoning strategies, that can then be tested on the basis of computational cognitive models and experiments with human subjects. The syntactic framework of the formal system provides a generic way of constructing computational cognitive models of the participants of the Marble Drop game. (shrink)

The machine conception of the organism (MCO) is one of the most pervasive notions in modern biology. However, it has not yet received much attention by philosophers of biology. The MCO has its origins in Cartesian natural philosophy, and it is based on the metaphorical redescription of the organism as a machine. In this paper I argue that although organisms and machines resemble each other in some basic respects, they are actually very different kinds of systems. I submit that the (...) most significant difference between organisms and machines is that the former are intrinsically purposive whereas the latter are extrinsically purposive. Using this distinction as a starting point, I discuss a wide range of dissimilarities between organisms and machines that collectively lay bare the inadequacy of the MCO as a general theory of living systems. To account for the MCO’s prevalence in biology, I distinguish between its theoretical, heuristic, and rhetorical functions. I explain why the MCO is valuable when it is employed heuristically but not theoretically, and finally I illustrate the serious problems that arise from the rhetorical appeal to the MCO. (shrink)

There is ample justification for having analogical material in standardized tests for graduate school admission, perhaps especially for law school. We think that formal-analogy questions should compare different scenarios whose structure is the same in terms of the number of objects and the formal properties of their relations. The paper deals with this narrower question of how legitimately to have formal analogy test items, and the broader question of what constitutes a formal analogy in general.

This paper begins with a rigorous critique of David Stove''s recent bookThe Rationality of Induction. In it, Stove produced four different proofs to refute Hume''s sceptical thesis about induction. I show that Stove''s attempts to vindicate induction are unsuccessful. Three of his proofs refute theses that are not the sceptical thesis about induction at all. Stove''s fourth proof, which uses the sampling principle to justify one particular inductive inference, makes crucial use of an unstated assumption regarding randomness. Once this assumption (...) is made explicit, Hume''s thesis once more survives.The refutation of Stove''s fourth proof leads to some observations which relate Goodman''s grue paradox with randomness of a sample. I formulate a generalized version of Goodman''s grue paradox, and argue that whenever a sample, no matter how large, is drawn from a predetermined smaller interval of a population that is distributed over a larger interval, any conclusion drawn about the characteristics of the population based on the observed characteristics of the sample is fatally vulnerable to the generalized grue paradox. In this paper, I will propose a classification of analogies based on their internal structure. Selecting the criteria used in that classification first requires discussing the minimal constitutive parts of any analogy. Accordingly, I will discuss the differences between analogy and similarity and between analogy and “synalogy,” and I will stress the importance of the analogy of operations and procedures. Finally, I will set forth a classification of the different types of analogies, which lends itself to a further understanding of (...) the differences between certain modulations of the general idea of analogy, such as archetypes, prototypes, models, simulations, parables, paradigms, canons, maps, thought experiments, myths, utopias, dystopias and fables. The logical empiricists held that an analogical hypothesis does not gain any acceptability from the analogy on which it is founded. On this view, the acceptability of a hypothesis cannot be discounted by criticizing the foundational analogy. Yet scientists commonly appear to level exactly this sort of criticism. If scientists are able to discount the acceptability of analogical hypotheses in this way, then the logical empiricist view is mistaken. I analyze four forms of analogy counterargument, disanalogy, misanalogy, counteranalogy, and false (...) analogy, with examples from the debate over the asteroid impact hypothesis. This essay presents a dialogical framework for treating philosophical disagreements as persuasion dialogues with analogical argumentation, with the aim of recasting philosophical disputes as disagreements over analogies. This has two benefits: it allows us to temporarily bypass conflicting metaphysical intuitions by focusing on paradigmatic examples, similarities, and the plausibility of conclusions for or against a given point of view; and it can reveal new avenues of argumentation regarding a given issue. This approach to philosophical disagreements is illustrated by studying the (...) role of argumentation by analogy in disputes over Lockean justifications of intellectual property rights, and disagreements over whether artificial agents should be treated as moral agents. Finally, a nonexhaustive list of possible global and local points of contention over analogical arguments is identified in order to highlight potential avenues of argumentation in disagreements over analogies. There is deep ambivalence about analogy, both as an object of philosophical fascination and in contexts of practice, like archaeology, where it plays a seemingly central role. In archaeology there has been continuous vacillation between outright rejection of analogical inference as overtly speculative, even systematically misleading, and, when this proves un-tenable, various stock strategies for putting it 'on a firmer foundation'. Frequently these last are accomplished by assimilating analogy to more tractible (better warranted, more readily controllable) forms of inference, salvaging (...) respectability but at the expense, ironically, of reverting to a strategy of elimination. I have been struck by the parallels between this pattern of response and that typical of philosophy; the central question raised in both contexts is that of whether, or in what sense, there is any distinctively analogical form of inference and what sort of warrant (formal, methodological) accrues to it. In what follows I will assess two recent philosophical positions on this question, first in their own terms and then in consideration of archaeological uses of analogy. In this I hope to put the projects of justification themselves on a firmer footing. (shrink)

How should biological behaviour be modelled? A relatively new approach is to investigate problems in neuroethology by building physical robot models of biological sensorimotor systems. The explication and justification of this approach are here placed within a framework for describing and comparing models in the behavioural and biological sciences. First, simulation models – the representation of a hypothesis about a target system – are distinguished from several other relationships also termed “modelling” in discussions of scientific explanation. Seven dimensions on which (...) simulation models can differ are defined and distinctions between them discussed: 1. Relevance: whether the model tests and generates hypotheses applicable to biology. 2. Level: the elemental units of the model in the hierarchy from atoms to societies. 3. Generality: the range of biological systems the model can represent. 4. Abstraction: the complexity, relative to the target, or amount of detail included in the model. 5. Structural accuracy: how well the model represents the actual mechanisms underlying the behaviour. 6. Performance match: to what extent the model behaviour matches the target behaviour. 7. Medium: the physical basis by which the model is implemented. No specific position in the space of models thus defined is the only correct one, but a good modelling methodology should be explicit about its position and the justification for that position. It is argued that in building robot models biological relevance is more effective than loose biological inspiration; multiple levels can be integrated; that generality cannot be assumed but might emerge from studying specific instances; abstraction is better done by simplification than idealisation; accuracy can be approached through iterations of complete systems; that the model should be able to match and predict target behaviour; and that a physical medium can have significant advantages. These arguments reflect the view that biological behaviour needs to be studied and modelled in context, that is, in terms of the real problems faced by real animals in real environments. “The question for us,” as Ronald Giere writes in Understanding Scientific Reasoning, “is whether analogies play any role in the JUSTIFICATION of [a] new theory.” Giere’s answer is an emphatic “No.” (Giere 1984, pp. 79-80). Although most philosophers of science would probably qualify Giere’s unmitigated rejection of analogical justification, few attribute much significance to analogical arguments in science. And when philosophers do grudgingly acknowledge an analogical argument, they are hesitant to analyze it.Take, for example, Charles Darwin’s argument for natural selection. (...) This essay concerns itself with the methodology of practical ethics. There are a variety of methods employed in ethics. Although none have been firmly established as dominant, it is generally agreed that casuistry, or the case-based method, is one important strategy commonly used for resolving ethical issues. Casuists compare the case under consideration to a relevantly similar precedent case in which judgements have already been made, and they use these earlier judgements to determine the proper resolution of the present case. (...) In this article, I try to provide a better understanding of the nature of contemporary casuistry. To accomplish this, I explain the basic features of casuistic reasoning. The second section focuses on the logic of casuistry. By assessing casuistic reasoning from the logical viewpoint, casuistry can be reconstructed as a logically correct method of reasoning. The third section looks at casuistry from the epistemic point of view and investigates the justificatory force of casuistic reasoning. Finally, in the fourth section, I show the usefulness of formal casuistry. (shrink)

In this article I am concerned with analogical reasoning in ethics. There is no doubt that the use of analogy can be a powerful tool in our ethical reasoning. The importance of this mode of reasoning is therefore commonly accepted, but there is considerable debate concerning how its structure should be understood and how it should be assessed, both logically and epistemically. In this paper, I first explain the basic structure of arguments from analogy in ethics. I then discuss the (...) diversity of analogical arguments that can be found in ethics. I analyse their structure, assess them from a logical viewpoint, and show how they can be epistemically challenged and defended. The result of this investigation is that, contrary to a commonly held view, analogical reasoning can be a logically valid type of ethical reasoning that can provide reasons for action that are not worse than the reasons provided by any other kind of practical reasoning. The image of a ball rolling along a series of hills and valleys is an effective heuristic by which to communicate stability concepts in ecology. However, the dynamics of this landscape model have little to do with ecological systems. Other landscape representations, however, are possible. These include the particle on an energy landscape, the potential landscape, and the Lyapunov function landscape. Arguments from analogy are pervasive in everyday reasoning, mathematics, philosophy, and science. Informal logic studies everyday argumentation in ordinary language. A branch of fuzzy logic, approximate reasoning, seeks to model facets of everyday reasoning with vague concepts in ill-defined situations. Ways of combining the results from these fields will be suggested by introducing a new argumentation scheme—a fuzzy analogical argument from classification—with the associated critical questions. This will be motivated by a case study of analogical reasoning in the virtual friendship (...) debate within information ethics. The virtual friendship debate is a disagreement over whether virtual friendships are genuine friendships. It will be argued that the debate could move away from its current impasse, caused by unproductive metaphysical and logical assumptions, if extant arguments are reinterpreted as fuzzy analogical arguments from classification, and subjected to a new set of critical questions which would replace the quest for facts of essence about friendship with an emphasis on empirical data, persuasion, and definitional power. The works of the Tibetan logician Phya pa Chos kyi seng ge (1109–1169) make abundant use of a particular type of argument that I term ‘argument by parallels’. Their main characteristic is that the instigator of the argument, addressing a thesis in a domain A, introduces a parallel thesis in an unrelated domain B. And in the ensuing dialogue, each of the instigator’s statements consists in replicating his interlocutor’s previous assertion, mutatis mutandis, in the other domain (A or B). I (...) show that such a dialogue involves two parallel arguments that develop in an intersecting zigzag pattern, and discuss the principles involved in the establishment of the conclusion from the perspective of parity of reasoning and analogical argument. I examine the overall rhetorical strategy directing the use of arguments by parallels and the pedagogical and explanatory functions they can serve. I also evaluate the plausibility of their use in Phya pa Chos kyi seng ge’s works mirroring a contemporary practice of oral debate, and reflect on the status of such arguments in the framework of Indo-Tibetan logic. Work on analogy has been done from a number of disciplinary perspectives throughout the history of Western thought. This work is a multidisciplinary guide to theorizing about analogy. In a recent paper, Jakob Hohwy argues that the emerging predictive processing perspective on cognition requires us to explain cognitive functioning in purely internalistic and neurocentric terms. The purpose of the present paper is to challenge the view that PP entails a wholesale rejection of positions that are interested in the embodied, embedded, extended, or enactive dimensions of cognitive processes. I will argue that Hohwy’s argument from analogy, which forces an evidentiary boundary into the picture, lacks the argumentative resources to (...) make a convincing case for the conceptual necessity to interpret PP in solely internalistic terms. For this reason, I will reconsider the postulation and explanatory role of the evidentiary boundary. I will arrive at an account of prediction error minimization and its foundation on the free energy principle that is fully consistent with approaches to cognition that emphasize the embodied and interactive properties of cognitive processes. This gives rise to the suggestion that explanatory pluralism about the application of PP is to be preferred over Hohwy’s explanatory monism that follows from his internalistic and neurocentric view of predictive cognitive systems.
