The Metaphysics of Morals is Kant's major work in applied moral philosophy in which he deals with the basic principles of rights and of virtues. It comprises two parts: the 'Doctrine of Right', which deals with the rights which people have or can acquire, and the 'Doctrine of Virtue', which deals with the virtues they ought to acquire. Mary Gregor's translation, revised for publication in the Cambridge Texts in the History of Philosophy series, is the only complete translation of the (...) whole text, and includes extensive annotation on Kant's difficult and sometimes unfamiliar vocabulary. A new introduction by Roger Sullivan sets the work in its historical and philosophical context. This volume will be of wide interest to students of ethics and of legal and political philosophy. Immanuel Kant's Groundwork of the Metaphysics of Morals ranks alongside Plato's Republic and Aristotle's Nicomachean Ethics as one of the most profound and influential works in moral philosophy ever written. In Kant's own words its aim is to search for and establish the supreme principle of morality, the categorical imperative. Kant argues that every human being is an end in himself or herself, never to be used as a means by others, and that moral obligation is an expression of the (...) human capacity for autonomy or self-government. What is the relationship between fear, danger, and the law? Cass Sunstein attacks the increasingly influential Precautionary Principle - the idea that regulators should take steps to protect against potential harms, even if causal chains are uncertain and even if we do not know that harms are likely to come to fruition. Focusing on such problems as global warming, terrorism, DDT, and genetic engineering, Professor Sunstein argues that the Precautionary Principle is incoherent. Risks exist on all sides of social situations, (...) and precautionary steps create dangers of their own. Diverse cultures focus on very different risks, often because social influences and peer pressures accentuate some fears and reduce others. Instead of adopting the Precautionary Principle, Professor Sunstein argues for three steps: a narrow Anti-Catastrophe Principle, designed for the most serious risks; close attention to costs and benefits; and an approach called 'libertarian paternalism', designed to respect freedom of choice while also moving people in directions that will make their lives go better. He also shows how free societies can protect liberty amidst fears about terrorism and national security. Very few moral philosophers have written on climate change.1 This is puzzling, for several reasons. First, many politicians and policy makers claim that climate change is not only the most serious environmental problem currently facing the world, but also one of the most important international problems per se.2 Second, many of those working in other disciplines describe climate change as fundamentally an ethical issue.3.

The focus of Norton's book is the distinction between objectives and values in developing environmental policies. Norton argues that environmentalism is a coalition of many groups working toward common objectives, but unlike other social action movements the environmental coalition does not have shared moral principles.

It is conventional wisdom among political philosophers that ideal principles of justice must guide our attempts to design institutions to avert actual injustice. Call this the ideal guidance approach. I argue that this view is misguided— ideal principles of justice are not appropriate "guiding principles" that actual institutions must aim to realize, even if only approximately. Fortunately, the conventional wisdom is also avoidable. In this paper, I develop an alternative approach to institutional design, which I call institutional failure analysis. The (...) basic intuition of this approach is that our moral assessment of institutional proposals is most effective when we proceed from a detailed understanding of the causal processes generating problematic social outcomes. Failure analysis takes the institutional primary design task to be obviating or averting institutional failures. Consequently, failure analysis enables theorists to prescribe more effective solutions to actual injustice because its focuses on understanding the injustice, rather than specifying an ideal of justice. It is widely recognized that changes are occurring to the earth’s climate and, further, that these changes threaten important human interests. This raises the question of who should bear the burdens of addressing global climate change. This paper aims to provide an answer to this question. To do so it focuses on the principle that those who cause the problem are morally responsible for solving it (the ‘polluterpays’ principle). Virtue ethics is standardly taught and discussed as a distinctive approach to the major questions of ethics, a third major position alongside Utilitarian and Kantian ethics. I argue that this taxonomy is a confusion. Both Utilitarianism and Kantianism contain treatments of virtue, so virtue ethics cannot possibly be a separate approach contrasted with those approaches. There are, to be sure, quite a few contemporary philosophical writers about virtue who are neither Utilitarians nor Kantians; many of these find inspiration in ancient (...) Greek theories of virtue. But even here there is little unity. Although certain concerns do unite this disparate group (a concern for the role of motives and passions in good choice, a concern for character, and a concern for the whole course of an agent''s life), there are equally profound disagreements, especially concerning the role that reason should play in ethics. One group of modern virtue-theorists, I argue, are primarily anti-Utilitarians, concerned with the plurality of value and the susceptibility of passions to social cultivation. These theorists want to enlarge the place of reason in ethics. They hold that reason can deliberate about ends as well as means, and that reason can modify the passions themselves. Another group of virtue theorists are primarily anti-Kantians. They believe that reason plays too dominant a role in most philosophical accounts of ethics, and that a larger place should be given to sentiments and passions -- which they typically construe in a less reason-based way than does the first group. The paper investigates these differences, concluding that it is not helpful to speak of virtue ethics, and that we would be better off characterizing the substantive views of each thinker -- and then figuring out what we ourselves want to say. Practical wisdom is the intellectual virtue that enables a person to make reliably good decisions about how, all-things-considered, to live. As such, it is a lofty and important ideal to strive for. It is precisely this loftiness and importance that gives rise to important questions about wisdom: Can real people develop it? If so, how? What is the nature of wisdom as it manifests itself in real people? I argue that we can make headway answering these questions by modeling wisdom (...) on expert skill. Presenting the main argument for this expert skill model of wisdom is the focus of this paper. More specifically, I’ll argue that wisdom is primarily the same kind of epistemic achievement as expert decision-making skill in areas such as firefighting. Acknowledging this helps us see that, and how, real people can develop wisdom. It also helps to resolve philosophical debates about the nature of wisdom. For example, philosophers, including those who think virtue should be modeled on skills, disagree about the extent to which wise people make decisions using intuitions or principled deliberation and reflection. The expert skill model resolves this debate by showing that wisdom includes substantial intuitive and deliberative and reflective abilities. (shrink)

This paper examines what agents should do when others fail to comply with their responsibilities to prevent dangerous climate change. It distinguishes between six different possible responses to noncompliance. These include what I term (1) 'target modification' (watering down the extent to which we seek to prevent climate change), (2) ‘responsibility reallocation’ (reassigning responsibilities to other duty bearers), (3) ‘burden shifting I’ (allowing duty bearers to implement policies which impose unjust burdens on others, (4) 'burden shifting II’ (allowing some to (...) protect peoples rights in ways which impose otherwise unjustified burdens on the duty bearers, (5) 'compromising moral ideals' (permitting agents to compromise non-justice ideals that they are otherwise bound by); and (6) ‘promoting compliance (implementing policies and creating institutions which reduce noncompliance). It concludes by outlining a methodological framework for evaluating these options, and by setting out my tentative and provisional evaluation of which responses are the least bad. (shrink)

Some authors have called for increased research on various forms of geoengineering as a means to address global climate change. This paper focuses on the question of whether a particular form of geoengineering, namely deploying sulfate aerosols in the stratosphere to counteract some of the effects of increased greenhouse gas concentrations, would be a just response to climate change. In particular, we examine problems sulfate aerosol geoengineering (SAG) faces in meeting the requirements of distributive, intergenerational, and procedural justice. We argue (...) that SAG faces obstacles to meeting the requirements of all three considered kinds of justice, because its impacts can harm some persons and communities much more than others; it poses serious risks to future generations; and SAG is especially prone to unilateral implementation. While we do not claim that SAG ought not to be implemented, we argue that it is the responsibility of proponents of SAG to recognize and address these ethical obstacles before advocating its implementation. Principles of distributive justice are normative principles designed to guide the allocation of the benefits and burdens of economic activity.

Climate change confronts humanity with a challenge it has never faced before. It combines issues of global justice and intergenerational justice on an unprecedented scale. In particular, it stands to adversely affect the global poor. So far, the global community has failed to reduce emissions to levels that are necessary to avoid unacceptable risks for the future. Nor are the burdens of emission reductions and of coping with climate impacts fairly shared. The shortcomings of both political and individual climate action (...) thus seem like a paradigmatic case for non-ideal theory. Non-ideal theory can be understood as a form of political theorising that compares different responses to (i) failures of agents to comply with the demands of justice and (ii) unfavourable circumstances. Insofar as non-ideal theory also aims to be action-guiding, it asks normative theorists for a more thorough engagement with the empirical context so as to arrive at practical recommendations for the ‘here and now’. This volume examines the normative issues that become relevant when the non-ideal circumstances of the climate context are fully taken into account. It is comprised of three parts: The first collects chapters that reflect on general issues in responding to the shortcomings of current climate action. Chapters in the second part propose more specific practical reforms. The third part examines how moral values ought to be brought into the scientific, political, and public debates under the non-ideal circumstances of this world. (shrink)

Concerns about the risks of unmitigated greenhouse gas emissions are growing. At the same time, confidence that international policy agreements will succeed in considerably lowering anthropogenic greenhouse gas emissions is declining. Perhaps as a result, various geoengineering solutions are gaining attention and credibility as a way to manage climate change. Serious consideration is currently being given to proposals to cool the planet through solar-radiation management. Here we analyze how the unique and nontrivial risks of geoengineering strategies pose fundamental questions at (...) the interface between science and ethics. To illustrate the importance of integrated ethical and scientific analysis, we define key open questions and outline a coupled scientific-ethical research agenda to analyze solar-radiation management geoengineering proposals. We identify nine key fields of coupled research including whether solar-radiation management can be tested, how quickly learning could occur, normative decisions embedded in how different climate trajectories are valued, and justice issues regarding distribution of the harms and benefits of geoengineering. To ensure that ethical analyses are coupled with scientific analyses of this form of geoengineering, we advocate that funding agencies recognize the essential nature of this coupled research by establishing an Ethical, Legal, and Social Implications program for solar-radiation management. The main body of this paper assesses a leading recent theory of fairness, a theory put forward by John Broome. I discuss Broome's theory partly because of its prominence and partly because I think it points us in the right direction, even if it takes some missteps. In the course of discussing Broome's theory, I aim to cast light on the relation of fairness to consistency, equality, impartiality, desert, rights, and agreements. Indeed, before I start assessing Broome's theory, I discuss (...) two very popular conceptions of fairness that contrast with his. In this paper we explore the connections between ethics and decision theory. In particular, we consider the question of whether decision theory carries with it a bias towards consequentialist ethical theories. We argue that there are plausible versions of the other ethical theories that can be accommodated by “standard” decision theory, but there are also variations of these ethical theories that are less easily accommodated. So while “standard” decision theory is not exclusively consequentialist, it is not necessarily ethically neutral. Moreover, (...) even if our decision-theoretic models get the right answers vis-`a-vis morally correct action, the question remains as to whether the motivation for the non-consequentialist theories and the psychological processes of the agents who subscribe to those ethical theories are lost or poorly represented in the resulting models. The first impacts of climate change have become evident and are expected to increase dramatically over the next decades. Thus, it becomes more and more pressing to decide who has to compensate those people who suffer from negative impacts of climate change but have neither contributed to the problem nor possess the resources to cope with the consequences. Since the frequently invoked Polluter Pays Principle cannot account for all climate-related harm, I will take a closer look at the much more (...) controversial Beneficiary Pays Principle. It is argued that, appropriately qualified, the Beneficiary Pays Principle can help to identify additional duty-bearers. As a response to climate change, geoengineering with solar radiation management has the potential to result in unjust harm. Potentially, this injustice could be ameliorated by providing compensation to victims of SRM. However, establishing a just SRM compensation system faces severe challenges. First, there is scientific uncertainty in detecting particular harmful impacts and causally attributing them to SRM. Second, there is ethical uncertainty regarding what principles should be used to determine responsibility and eligibility for compensation, as well as determining how (...) much compensation ought to be paid. Many fine-grained decisions concerning climate change involve significant, even severe, uncertainty. Here, we focus on modelling the decisions of single agents, whether individual persons or groups perceived as corporate entities. We offer a taxonomy of the sources and kinds of uncertainty that arise in framing these decision problems, as well as strategies for making a choice in spite of uncertainty. The aim is to facilitate a more transparent and structured treatment of uncertainty in climate decision making.

If deployed, aerosol geoengineering (AG) could involve unfairness to both present and future parties. I discuss three broad risks of unfairness that an AG deployment policy might carry: (1) causing disproportionate harm to those least responsible for climate change, (2) burdening future parties with the costs and risks of AG, and (3) excluding some interested parties from contributing to AG decision-making. Yet despite these risks, it may be too hasty to reject AG deployment as a potential climate change policy. I (...) argue that since it is very unlikely that a completely fair climate change policy will be pursued, we have ethical reason to prefer some “incompletely fair” policy. Given various facts about our world, it might be the case that some AG policy is ethically preferable to many other feasible climate change policies, even if AG carries deeply problematic risks of unfairness. Solar radiation management (SRM), a form of climate engineering, would offset the effects of increased greenhouse gas concentrations by reducing the amount of sunlight absorbed by the Earth. To encourage support for SRM research, advocates argue that SRM may someday be needed to reduce the risks from climate change. This paper examines the implications of two moral constraints—the Doctrine of Doing and Allowing, and the Doctrine of Double Effect—on this argument for SRM and SRM research. The strongest arguments for the permissibility of geoengineering (also known as climate engineering) rely implicitly on non-ideal theory—roughly, the theory of justice as applied to situations of partial compliance with principles of ideal justice. In an ideally just world, such arguments acknowledge, humanity should not deploy geoengineering; but in our imperfect world, society may need to complement mitigation and adaptation with geoengineering to reduce injustices associated with anthropogenic climate change. We interpret research proponents’ arguments as an application of a particular (...) branch of non-ideal theory known as “clinical theory.” Clinical theory aims to identify politically feasible institutions or policies that would address existing (or impending) injustice without violating certain kinds of moral permissibility constraints. We argue for three implications of clinical theory: First, conditional on falling costs and feasibility, clinical theory provides strong support for some geoengineering techniques that aim to remove carbon dioxide from the atmosphere. Second, if some kinds of carbon dioxide removal technologies are supported by clinical theory, then clinical theory further supports using those technologies to enable “overshoot” scenarios in which developing countries exceed the cumulative emissions caps that would apply in ideal circumstances. Third, because of tensions between political feasibility and moral permissibility, clinical theory provides only weak support for geoengineering techniques that aim to manage incoming solar radiation. In this paper, I address the question of whether aerosol geoengineering (AG) ought to be deployed as a response to climate change. First, I distinguish AG from emissions mitigation, adaptation, and other geoengineering strategies. Second, I discuss advantages and disadvantages of AG, including its potential to result in substantial harm to some persons. Third, I critique three arguments against AG deployment, suggesting reasons why these arguments should be rejected. Fourth, I consider an argument that, in scenarios in which all available (...) climate change strategies would result in net harm to persons, we ought to adopt that response to climate change which would result in the least net harm. Solar radiation management is a form of geoengineering that involves the intentional manipulation of solar radiation with the aim of reducing global average temperature. This paper explores what precaution implies about the status of solar radiation management. It is argued that any form of solar radiation management that poses threats of catastrophe cannot constitute an appropriate precautionary measure against another threat of catastrophe, namely climate change. Research of solar radiation management is appropriate on a precautionary view only insofar as such (...) research aims to identify whether any forms of solar radiation management could be implemented without creating new or exacerbating existing threats of catastrophe. Much of the work on the ethics of climate engineering over the last few years has focused on the front-end of the potential timeline for climate intervention. Topics have included the initial taboo on bringing the discussion of climate engineering into the open, guidelines to put in place before commencing research, and governance arrangements before first deployment. While this work is clearly important, the current paper considers what insights can be gleaned from considering the tail-end, that is, by using the (...) requirement for future cessation as a criterion for any acceptable climate engineering strategy. After showing that time-limited interventions are a key part of the rhetoric of leading climate engineering advocates, the paper examines the implications of imposing a ‘cessation requirement’ on solar radiation management and carbon dioxide removal strategies. Consideration of a cessation requirement turns out to reveal a great deal about what ought to be happening now, before any decision to proceed with climate engineering deployment has been taken. One central question of climate justice is how to fairly allocate the global emissions budget. Some commentators hold that the concept of fairness is hopelessly equivocal on this point. Others claim that we need a complete theory of distributive justice to answer the question. This paper argues to the contrary that, given only weak assumptions about fairness, we can show that fairness requires an allocation that is at least as prioritarian as the equal per capita view. Since even the equal (...) per capita view is more prioritarian than is politically feasible, fairness is univocal enough for all practical purposes. (shrink)

Integrated assessment models of climate and the economy provide estimates of the social cost of carbon and inform climate policy. We create a variant of the Regional Integrated model of Climate and the Economy (RICE)—a regionally disaggregated version of the Dynamic Integrated model of Climate and the Economy (DICE)—in which we introduce a more fine-grained representation of economic inequalities within the model’s regions. This allows us to model the common observation that climate change impacts are not evenly distributed within regions (...) and that poorer people are more vulnerable than the rest of the population. Our results suggest that this is important to the social cost of carbon—as significant, potentially, for the optimal carbon price as the debate between Stern and Nordhaus on discounting. (shrink)

Climate change will cause large numbers of casualties, perhaps extending over thousands of years. Casualties have a clear moral significance that economic and other technical measures of harm tend to mask. They are, moreover, universally understood, whereas other measures of harm are not. Therefore, the harms of climate change should regularly be expressed in terms of casualties by such agencies such as IPCC’s Working Group III, in addition to whatever other measures are used. Casualty estimates should, furthermore, be used to (...) derive estimates of casualties per emission source up to a given date. Such estimates would have wide margins of error, but they would add substantially to humanity’s grasp of the moral costs of particular greenhouse gas emissions. (shrink)

Many commentators fear that climate engineering research might lead policy-makers to reduce mitigation efforts. Most of the literature on this so-called ‘moral hazard’ problem focuses on the prediction that climate engineering research would reduce mitigation efforts. This paper focuses on a related ethical question: Why would it be a bad thing if climate engineering research obstructed mitigation? If climate engineering promises to be effective enough, it might justify some reduction in mitigation. Climate policy portfolios involving sufficiently large or poorly planned (...) reductions in mitigation, however, could lead to an outcome that would be worse than the portfolio that would be chosen in the absence of further climate engineering research. This paper applies three ethical perspectives to describe the kinds of portfolios that would be worse than that ‘baseline portfolio’. The literature on climate engineering identifies various mechanisms that might cause policy-makers to choose these inferior portfolios, but it is difficult to know in advance whether the existence of these mechanisms means that climate engineering research really would lead to a worse outcome. In the light of that uncertainty, a precautionary approach suggests that researchers should take measures to reduce the risk of mitigation obstruction. Several such measures are suggested. (shrink)

In their ‘Ethical and Technical Challenges in Compensating for Harm Due to Solar Radiation Management Geoengineering’ (2014), Toby Svoboda and Peter Irvine (S&I) argue that there are significant technical and ethical challenges that stand in the way of crafting a just solar radiation management (SRM) compensation system. My aim in this article is to contribute to the project of addressing these problems. I do so by focusing on one of S&I’s important ethical challenges, their claim that the polluter pays principle (...) (PPP) is too problematic to be useful in determining responsibility for SRM compensation. Their argument for the latter claim consists in a series of allegations, mostly in the form of questions, that are thought to indicate serious difficulties standing in the way of using the PPP to craft a just compensation system. I argue that S&I fail to substantiate these allegations: the PPP is not as problematic as S&I suggest, and moreover, is a viable candidate for determining responsibility for SRM compensation. Disagreements about morally appropriate mitigation policies arise in part from implicit disagreements about the nature and moral significance of needs. One key question is what, if anything, distinguishes “needs” from “mere wants.” One approach, prominent in economics and implemented in existing integrated assessment models of climate change, rejects a hard distinction between needs and wants. An alternative approach, prominent in the philosophical literature on needs, identifies needs with the requirements for autonomous agency, which is the capacity to set and pursue (...) one’s own goals. A second key question is in what sense, if any, the satisfaction of needs should take precedence over the satisfaction of wants. Those who reject the distinction between wants and needs can say only that some desires should be weighted more heavily than others. Those who endorse the distinction can say that, given certain ethical assumptions, it is wrong to frustrate one person’s needs in order to satisfy others’ mere wants. Thus, rejecting the distinction between wants and needs tends to justify less aggressive mitigation policies, in which satisfying the so-called “wants” of present generations compensates for frustrating the so-called “needs” of future generations. Endorsing the distinction between wants and needs, along with certain ethical assumptions, tends to justify more aggressive mitigation policies. Both positions are intellectually defensible; understanding them helps illuminate disagreements over mitigation policy. (shrink)
