This work discusses an empirical study of reasoning as it occurs in conversations. Reasoning in this context has features not usually accounted for in standard methods for describing argumentation (e.g., Toulmin, (1964), Toulmin, Rieke, and Janik (1984)). For example, insufficient attention has been paid to challenges which can be used to shift the ground of an argument and to the development of multiple conversational grounds. Moreover, even though the value of cooperative efforts in building arguments is widely recognized, more needs (...) to be said about analyzing co-constructed arguments. This empirical work was primarily descriptive and concerned with how people construct arguments in conversations, but one goal of the study was to lay groundwork for comparing the quality of reasoning in conversations which differ with respect to whether the arguments they contain are primarily the contributions of individuals or are genuinely co-constructed arguments. The article outlines a general epistemological theory of argument: a theory that regards providingjustified belief as the principal aim of argumentation, and defends it instrumentalistically. After introducing some central terms of such a theory (2), answers to its central questions are proposed: the primary object and structure of the theory (3), the function of arguments, which is to lead to justified belief (4), the way such arguments function, which is to guide the addressee's cognizing (5), objective versus subjective aspects of (...) argumentation (6), designing different types of argument (7). Then the notion of '(argumentatively) valid argument' is defined and criteria for the adequate use of such arguments are introduced (8). Two books have been particularly influential in contemporary philosophy of science: Karl R. Popper's Logic of Scientific Discovery, and Thomas S. Kuhn's Structure of Scientific Revolutions. Both agree upon the importance of revolutions in science, but differ about the role of criticism in science's revolutionary growth. From the many useful challenges they have directed at my position, I have chosen to focus on two. The dominant issue raised by their papers concerns my definition of argument, and particularly problems with the idea of a dialectical tier. I have selected that as the first strand. (...) I propose some changes to the conceptions of argument and of argumentative discussion in Ralph Johnson's Manifest Rationality (2000). An argument is a discourse whose author seeks to persuade an audience to accept a thesis by producing reasons in support of it and discharging his dialectical obligations. An argumentative discussion (what Johnson calls ‘argumentation’) is a sociocultural activity of constructing, presenting, interpreting, criticizing, and revising arguments for the purpose of reaching a shared rationally supported position on some issue. Johnson's theory (...) of argumentative discussion, with occasional modifications, is derived from this definition as a sequence of 17 theorems. Argumentative discussion is a valuable cultural practice; it is the most secure route to correct views and wise policies. (shrink)

Hamblin held that the conception of 'fallacy' as an argument that seems valid but is not really so was the dominant conception of fallacy in the history of fallacy studies. The present paper explores the extent of support that there is for this view. After presenting a brief analysis of 'the standard definition of fallacy,' a number of the definitions of 'fallacy' in texts from the middle of this century – from the standard treatment – are considered. This is followed (...) by a review of the definitions of 'fallacy' in the earlier history of logic books, including those of Aristotle, Whately, Mill and De Morgan. The essay concludes that there is scarcely any support for Hamblin's view that this particular definition of 'fallacy' was widely held. (shrink)

Famously in the last century, philosophers of various stripes explored in various ways the possibility that at least certain philosophical debates are in some manner deficient in sense. No study in the philosophy of science created such controversy in the seventies as Paul Feyerabend's Against Method. In this work, Feyerabend reviews that controversy, and extends his critique beyond the problem of scientific rules and methods, to the social function and direction of science today. In the first part of the book, he launches a sustained and irreverent attack on the prestige of science in the West. This volume gives a theoretical account of the problem of analyzing and evaluating argumentative discourse. After placing argumentation in a communicative perspective, and then discussing the fallacies that occur when certain rules of communication are violated, the authors offer an alternative to both the linguistically-inspired descriptive and logically-inspired normative approaches to argumentation. The authors characterize argumentation as a complex speech act in a critical discussion aimed at resolving a difference of opinion. The various stages of a critical discussion are outlined, (...) and the communicative and interactional aspects of the speech acts performed in resolving a simple or complex dispute are discussed. Appeals to emotion—pity, fear, popular sentiment, and _ad hominem_ attacks—are commonly used in argumentation. Instead of dismissing these appeals as fallacious wherever they occur, as many do, Walton urges that each use be judged on its merits. He distinguished three main categories of evaluation. First, is it reasonable, even if not conclusive, as an argument? Second, is it weak and therefore open to critical questioning for argument? And third, is it fallacious? The third category is a strong charge that incurs (...) a critical burden to back it up by citing evidence from the given text and context of dialogue. Walton uses fifty-six case studies to demonstrate that the problem of emotional fallacies is much subtler than has been previously believed. Ranging over commercial advertisements, political debates, union-management negotiations, and ethical disputes, the case studies reveal that these four types of appeals, while based on presumptive reasoning that are tentative and subject to default, are not always or necessarily fallacious types of argumentation. In Between Facts and Norms, Jürgen Habermas works out the legal and political implications of his Theory of Communicative Action (1981), bringing to fruition the project announced with his publication of The Structural Transformation of the Public Sphere in 1962. This new work is a major contribution to recent debates on the rule of law and the possibilities of democracy in postindustrial societies, but it is much more.
