This paper tracks the development of Merleau-Ponty's inquiries into language through the themes of institution, symbolism, and nature in his Collège de France lectures of 1953-1960. It seeks to show the continuity of Merleau-Ponty's inquiries over this period. The Problem of Speech course (1953-1954) constitutes his last extended treatment of speech, language, and expression, and it leaves many questions unanswered. Nonetheless, a careful study of the course reveals that the inquiries that follow into institution and symbolism, and later (...) into nature, do not mark a sharp rupture with his earlier thought. Rather, the later investigations are required by those into language and expression to clarify the underlying functions that support them. Ultimately, the themes of language and nature will be deeply interwoven in Merleau-Ponty's late thought, with institution and symbolism serving as important mediating concepts. (shrink)

In his initial lecture course at the Collège de France, Merleau-Ponty attempted to develop a new analysis of rational thought in order to clarify its link with corporeal-perceptive life. Este ensaio celebra as cinco décadas da publicação do livro A ordem do discurso de Michel Foucault, realizando uma reflexão acerca de sua repercussão entre as ciências sociais e sobre seus usos, principalmente, no campo da linguagem na parte relacionada à análise do discurso de linha francesa. Portanto, trata-se de uma retrospectiva crítica cuja análise começa com a entrevista que Foucault concedeu algumas semanas antes de proferir esta aula aos brasileiros Sergio Paulo Rouanet e José Guilherme Merquior. Em seguida, o (...) presente trabalho faz uma breve história da entrada de Foucault ao Collège de France e, por fim, lida com a microfísica do discurso que se encontra nesta aula, sobretudo, da rarefação do sujeito, além dos seus usos nas ciências humanas e sociais mais o campo da linguagem em torno da pragmática e das análises de discurso. Este estudo tem como objetivo principal discutir qual o lugar da memória nas pesquisas históricas empreendidas pelo filósofo francês Michel Foucault, o qual foi responsável pelo desenvolvimento de duas frentes metodológicas de trabalho: a arqueologia do saber e a genealogia do poder, conhecidas hoje como arqueogenealogia foucaultiana. Ao longo de mais de 30 anos dedicados a estas pesquisas, Michel Foucault ganhou projeção nacional e internacional pela sua inquietante forma de aliar a militância política com o trabalho acadêmico, demonstrando, com isso, (...) qual era o papel do intelectual frente aos desafios e demandas no mundo do pós-guerra. Recebeu a maior honraria no mundo da intelectualidade francesa ao ser eleito professor do célebre Collège de France, assumindo, por mais de uma década, a cátedra história dos sistemas de pensamentos. Em uma de suas últimas entrevistas, declarou que todos os seus gestos tinham como principal objetivo: criar a história como os seres humanos se tornam sujeitos em nossa cultura. Esta declaração deixa evidente qual o lugar que a história ocupa em sua obra, mas qual seria o lugar da memória nesses seus empreendimentos? Por que a história aparece em seu trabalho como lugar privilegiado enquanto a memória tem um lugar de coadjuvante? São estas as reflexões iniciais que buscamos realizar neste nosso trabalho. The principal objective of this study is to present and discuss the elements that emerge from Michel Foucault's archeological undertakings, which, in our view, configure the existence of a new rhetoric that deals with what the French philosopher called the rarefaction of the subject and rarefaction of discourse in his inaugural lecture at the Collège de France (Foucault, 1996). This new rhetoric would be in charge of reflecting and analyzing the phenomena that result from both the rarefaction of (...) the subject and the rarefaction of discourse, that is, such rhetoric invests in what is responsible for imposing on the speaking subject what to say and how to say it. Therefore, it turns to certain mechanisms of control of discourses that Foucault presented in The Discourse on Language, a work that completes five decades of its publication. This Foucauldian rhetoric also has as its main function to deal with the history of the present, that is, to reflect on what we do and think at this exact moment, which, in turn, would be in charge of contributing to the history of how we became subjects in a culture like ours, at this stage of high modernity and the Information Age. From this perspective, she would be interested in the processes of identification and subjectivation that result from the ways in which we become subjects. In short, it is a study that seeks to present elements that demonstrate the emergence of a new rhetoric that emerges from the work of Michel Foucault, who, according to Deleuze (1992), increasingly invested in a generalized pragmatics. The forceful impact of Michel Foucault’s work in the humanities and social sciences is apparent from the sheer abundance of its uses, appropriations, and refigurations. This article calls for greater self-conscious reflexivity about the relationship between our uses of Foucault and the opportunities afforded by his work. We argue for a clearer distinction between analytics and concepts in Foucault-inspired work. In so doing we draw on key moments of methodological self-reflection in Foucault’s Collège de France lectures and elsewhere. (...) This distinction helps identify different ways that Foucault might be put to productive use today as well as what can go wrong therein, a concern we develop with reference to Giorgio Agamben’s post-Foucaultian contributions to political theory. We are eager to open up a possibility that has been infrequently explored despite Foucault’s contemporary influence—-the idea that critique in and through Foucault is empirical critique. This idea can help facilitate a gain in reflexivity in the broader landscapes of contemporary theory, inquiry, and critique. (shrink)

In his 1953 lectures at the College de France, Merleau-Ponty dedicated much effort to further developing his idea of embodied subject and interpreted fresh sources that he did not use in Phenomenology of Perception. Notably, he studied more in depth the neurological notion of "body schema". According to Merleau-Ponty, the body schema is a practical diagram of our relationships to the world, an action-based norm with reference to which things make sense. Merleau-Ponty more precisely tried to describe the fundamentally (...) dynamic unity of the body, i.e. the fact there are various possibilities how the practical "diagram" of body schema could be de-differentiated (in pathology) or further refined (via cognitive and cultural superstructures, symbolic systems). This chapter summarises Merleau-Ponty's interpretation of the notion, while contrasting it to the more traditional understanding of the body in phenomenology and recent philosophical texts dealing with body schema. Foucault's governmentality lectures at the Collège de France analyze the history of the state through the lens of governmental reason. However, these lectures largely omit consideration of the relationship between discipline and the state, prioritizing instead raison d'État and liberalism as dominant state technologies. To remedy this omission, I turn to Foucault's early studies of discipline and argue that they provide materials for the reconstruction of a genealogy of the "disciplinary state." In reconstructing this genealogy, I demonstrate that (...) the disciplinary state marks the "dark side" of the liberal state, a dark side which is, moreover, largely obscured in the governmentality lectures. I further construe the difference between this early genealogy of the state and the later governmental studies in methodological terms. At stake in this difference is the historiographic status of capitalism and social conflict. Foucault's governmentality lectures employ what I term an "idealist disavowal," thereby treating capitalism and social conflict as irrelevant to the history of the state. The early disciplinary studies, on the other hand, enact a "materialist avowal," by which these objects are avowed as central to the explanation of how and why the state develops. Finally, I argue that Foucault's governmental genealogy of the liberal state is explanatorily and analytically incomplete, while the genealogy of the disciplinary state contributes to its completion on both fronts. It has been commonplace to equate Foucault’s 1979 series of lectures at the Collège de France with the claim that for neoliberalism, unlike for classical liberalism, the market needs to be artificially constructed. The article expands this claim to its full expression, taking it beyond what otherwise would be a simple divulgation of a basic neoliberal tenet. It zeroes in on Foucault’s own insight: that neoliberal constructivism is not directed at the market as such, but, in principle, at (...) society, arguing that the value of this insight goes beyond the critique of a neoliberal present. The neoliberal rationale rather helps him to reveal a unique historical architecture, a latent approach to the social dissimilar to the one that has long predominated in the human sciences. The inversion of homo œconomicus in neoliberal theory amounted to the unearthing of a ‘social subject of interest’ within civil society. Such a subject, barely recognized by neoliberals who simply instrumentalize it for the sake of the market, demonstrates that the social is not necessarily the natural product of ethical subjects; that society may also need to be constructed. Marcus Aurelius’s Meditations constitutes an important source and subject for Michel Foucault’s 1981 lectures at the Collège de France, translated into English as Hermeneutics of the Subject. One recurring theme in these lectures is the deployment by Hellenistic/Roman philosophers such as Aurelius of the practice and figure of dance. Inspired by this discussion, the present essay offers a close reading of dance in the Meditations, followed by a survey of the secondary literature on this subject. Overall, I will (...) attempt to show that, despite Aurelius’s self-consciously critical comportment toward dance, dance nevertheless performs a critical function in the construction of what I will term his “political ethics.” This political ethics, I will argue, is composed of an ethics of patient tolerance funded by the generosity that flows from the micro-political power generated by cultivating the god that Aurelius identifies within each of us. O presente artigo recupera as noções de guerra de raças e de biopoder nas lições ministradas por Michel Foucault no Collège de France intituladas Il faut défendre la Société (1976), para refletir sobre a relação entre neoliberalismo e violência política. Nesse sentido, interessa-me examinar como o pensamento de Foucault formulou o problema do biopoder vinculado ao da violência de raça para analisar nossa atual política (neo)liberal em termos de paradigmas raciais e coloniais.

How can imperceptible knowledge such as professional routines in class immediacy be taught? How to express their main principles and their construction in formation? These routines create a sense of security among both students and teachers; it is a frame favouring successful classroom management. They come under the scope of integrated competencies, and this prompts their analysis in view of understanding a central link within initial professionalization. This paper will present the concept of professional routines as an educational practice in (...) regards to professional development, then the conceptual frame, the analytical method, some results followed by a discussion and conclusion. Comment enseigner un savoir imperceptible comme des routines professionnelles dans l’immédiateté de la classe? Comment dégager les principes organisateurs et leur construction en formation ? Pour une gestion de classe efficace, il est essentiel de recourir à des routines professionnelles. Elles soutiennent le sentiment de sécurité tant chez l’enseignant que chez les élèves. Elles relèvent de compétences incorporées, ce qui force à leur analyse pour une articulation phare dans une formation professionnalisante. Nous présenterons le concept des routines professionnelles comme un savoir-faire nécessaire au développement professionnel, le cadre conceptuel, la méthodologie, quelques résultats et la discussion suivie de la conclusion. Neste capítulo, vamos tratar do discurso-corpo demarcado pelas utopias em justaposição com as heterotopias em duas produções cinematográficas do horror francês contemporâneo. Dessa forma, o corpo que operamos é feito de discurso, ou seja, todo seu tecido, seus órgãos, seus sistemas, seus ossos são discursos sobrepostos pelo visível e pelo dizível, da mesma forma, como demonstrou Foucault na obra O Nascimento da Clínica em 1963.

Este artigo busca adentrar pelas questões relacionadas à biopolítica do corpo, sobretudo, daquelas ligadas à estatização do biológico e do racismo do Estado, que aparecem nos trabalhos de Michel Foucault e que aqui evocamos para analisar o corpo enquanto objeto discursivo analisável dessa biopolítica em duas produções francesas de horror, - Frontière(s) e em À l’interieur – que exibem imagens dos tumultos de Outubro de 2005, acontecimento marcado pelos protestos contra a política de perseguição aos sans-papiers que vitimou três jovens (...) de origem africana. É a partir daí que retomaremos a discussão do “quem somos nós”, em Foucault, para refletir sobre o sujeito, a menoridade e a liberdade na estatização do corpo, um lugar da memória nacional. (shrink)

Os corpos no cinema estão sob a ordem de um olhar soberano que nos diz para onde devemos olhar e como devemos fazer isso. É um olhar poderoso que tudo sabe e tudo pode. Um olhar que nos posiciona não como simples espectadores, mas como sujeitos. É a partir daí que buscamos compreender como se arquitetam o medo, ou seja, qual é a ordem do cinema de horror, tecido com a pena do medo? Nessa arquitetura, os corpos aparecem como lugares (...) para vigiar e punir em espaços utópicos e heterotópicos. Espaços de memórias. Espaços de poder vigiar e punir. Espaço onde se impõe uma posição de sujeito, um poder sobre o sujeito. Portanto, os corpos no cinema de horror são artefatos para uma arqueologia do medo, escrita pelo poder do horror sobre estes corpos. Daí nosso interesse por esses lugares. Para demonstrar essa arqueologia, utilizaremos dois filmes franceses, produzidos em 2007, Frontière(s) e À l’interieur como espaços de horror construídos para o medo pelas vias da utopia e heterotopias pensadas por Michel Foucault, filósofo do presente, do nosso presente para compreender como se arquitetam tal medo por meio de sua história arqueológica, prática de um espaço chamado Labedisco/UESB. Descartes développe, dans ses Principes de la Philosophie, les principes fondateurs de son système construit sur l’identification de la matière à l’espace. L’analyse de ses principes nous invite à repenser le rôle de la métaphysique dans la constitution de la science et permet aussi de comprendre comment les concepts de matière, substance, espace, étendue géométrique, mouvement, infini et vide sont devenus les questions centrales de la science du XVIIe siècle.

Cet article se base sur des résultats d’enquête récents montrant que, chez des adolescents marocains âgés de dix à dix-huit ans, les manifestations de pensée critique dialogique se si-tuent majoritairement dans une « perspective épistémologique » appelée « relativisme » par un modèle développemental élaboré dans les quinze dernières années avec la méthode de la théorie ancrée. Pour comprendre ces résultats de recherche, qui contrastent avec ceux obte-nus auprès d’adolescents québécois et français appartenant aux mêmes groupes d’âge, nous décrivons, dans (...) un premier temps, le modèle développemental dans lequel ils prennent sens. Nous illustrons ensuite les manifestations de « perspective épistémologique relativiste » chez les adolescents marocains à l’aide d’extraits de verbatim. Les élèves ont tendance à se décen-trer de leur vécu personnel, à se représenter le point de vue d’autrui en général et à co-construire des points de vue convergents avec les pairs. Dans un deuxième temps, prenant appui sur une approche de la représentation sociale en tant que « scène », et sur la littérature touchant aux rôles des aînés dans les sociétés africaines, nous éclairons ces résultats de re-cherche par l’analyse d’une représentation sociale fréquemment mobilisée par les jeunes Ma-rocains interviewés : celle de la hiérarchie des âges et du devoir d’écoute envers les plus âgés. L’analyse de cette « scène » met en lumière des attitudes sociales inculquées aux adolescents en contexte culturel marocain, susceptibles de favoriser le développement d’une « perspective épistémologique relativiste » en matière de pensée critique dialogique. The educators of the 21st century have a great task ahead. In today’s world, the educators are expected to have a great deal of professional and personal qualities, and extraordinary skills. This descriptive-correlational study aimed to determine perceptions of college students on a well-qualified educator. The study included 123 selected college students from different colleges in Central Luzon, Philippines using a convenience sampling technique. As data collection tool, a questionnaire prepared by the researcher team was used. Some of the findings (...) of the study include: (1) the respondents answered agree on the context of professional and personal qualities that a teacher should have; (2) while in terms of the skills exhibited by an educator, it got an answer to Very Satisfactory. We also found significant differences in professional qualities, learning and innovation skills and life and career skills when grouped according to the respondent’s profile. There was low-to-moderate evidence of the relationship that existed between the qualities and skills of an educator. The results further confirmed the relationship through regression analysis and found that communication skills affect the qualities of an educator. Based on the results, we discussed and recommended practical suggestions on professional, personal and skills improvements of an educator. (shrink)

A militância política de Jorge Amado no Partido Comunista é um capítulo à parte na história do comunismo no Brasil, que completou 100 anos no dia 25 de março. Ela também é algo marcante em sua obra, a ponto da crítica literária brasileira, de tradição uspiana, considerá-la uma forma de panfleto partidário da nossa esquerda. Nesta exposição, pretende-se realizar uma breve discussão acerca de suas lutas políticas, das quais se destacam as questões religiosa e racial, que levaram Jorge Amado a (...) criar um projeto de lei, no período que exerceu o mandato de deputado constituinte pelo PCB, em 1946, assegurando a liberdade religiosa no Brasil. Aqui, também se destaca a sua amizade com o povo de candomblé que lhe honrou com títulos, como o de Obá de Xangô e Ogã de Iansã; além da forma como a crítica o rotulava de regionalista e escritor panfletário. Contudo, esta é uma forma de homenagear tanto o mais famoso dos doze Obás de Xangô da Bahia, quanto o Partidão, nesse seu centenário. Em termos metodológicos, trata-se de uma leitura ensaística foucaultiana sobre esses fatos e acontecimentos que marcaram duplamente a vida de Jorge Amado e do Comunismo no Brasil, já que lançamos mão de uma parte da maquinaria teórica do militante comunista do PCF (Partido Comunista Francês), Michel Foucault, como vontade de verdade, comentário, discurso, autoria, obra, descontinuidade (na continuidade) e dispersão. Tout le film est toujours une microphysique du pouvoir, en potence, d’être étudier. Aujourd’hui l'augmentation des productions d'horreur et son public ont fait le film d'horreur une «contreculture» dominante, mais toujours sous l'effet négatif du pouvoir et du savoir qui disqualifient les discours, matérialisée dans ces films, ce qui les rend illégitime et exiler en soi espace filmique, transformée en un lieu adapté pour interdite et marquée par certaines pratiques discursives avec certains dispositifs d'exclusion. Paradoxalement, les types marginaux qui apparaissent (...) dans l'ordre de ces productions occupent les positions de sujets à exercer le pouvoir dans l'horreur et dans le même temps le renforcement de leur marginalité et de son objectivation. Ces aspects et les spécificités qui caractérisent les productions d'une part, nous ont amenés à identifier les pratiques de l'objectivation qui transforment corps dans les sujets dans l'horreur; d'autre part, de démontrer que ces films constituent une nouvelle technologie de contrôle social des corps, mais l'objectif principal de cette étude est d'analyser les relations de pouvoir à travers l'antagonisme des stratégies dans ce discours, qui est, pour savoir ce que cela signifie d'avoir un corps libre, nous examinons ce qui se passe sur le corps subjugué dans les films d'horreur, prenant l'archeogenealogie de Foucault comme base théorique. Cette questionhypothèse aurait un autre groupe: d'où pourrait faire une telle histoire? Nous supposons que dans les moments de crise, les films d'horreur ont beaucoup à prouver, donc nous avons opté pour un très similaire à celui qui Foucault a été invité par les experts de la revue Cahiers du cinéma pour discuter des conditions pour les productions cinématographiques comme Le Chagrin et la Pitié (1969), Portier de nuit (1974) et Lacombe Lucien (1974), quand on a regardé le déclin du gaullisme et l’ascention de Valéry Giscard d'Estaing , le vainqueur de la présidentielle de 1974, avec le soutien de l'ancien droit Tardieu et petainistes, anciens alliés de l'occupation du Führer Hitler de la France, entre 1940 à 1943. Maintenant, les conditions de production sont ceux qui marquent la fin des gouvernements socialistes de Mitterrand et Chirac, et le retour au pouvoir de la droite, à l'ascension politique de Nicolas Sarkozy. Au milieu de la crise économique de l'Union Européenne, flotte dans l'air la peur terrifiante de risque que l'arrivée de l'extrême droite au pouvoir. La présence croissante d'immigrants est aussi dans l'ordre d'une nouvelle crise de l'identité française. Ce sont les conditions de production de À l'intérieur, Frontière (s),Martyrs, Ils, La Meute, Captifs et Derrière les murs et, des films qui font partie de notre corpus. À la methodologie, nous développons les trois concepts opérationnels: le dispositif filmique de la mémoire, de la vérité et de l'objectivité pour traiter la mémoire populaire, recodé dans ces films et soi-disant perçu par nous comme l'un des principaux modes de contrôle des corps d’horreur; la notion d’intericonicité est encore utilisée pour indiquer des images qui renvoient à d'autres, mais tout en réalisant que chaque image a dans sa juxtaposition afin de utopies des hétérotopies. Donc, nous avons décidé de donner une nouvelle forme à cette notion, y compris l'utopique juxtaposés à des espaces hétérotopiques, sous l'influence de la discussion faite par Foucault dans le Corps utopique et Les hétérotopies. The first work that René Descartes wrote was the Compendium Musicæ in 1618, this was his first experiment with the future cartesian method. As a work of youth, the author must have studied music in your education, mainly in the college of La Flèche. Conventionally, the work of Gioseffo Zarlino had been considered the main source, because was cited in the Compendium. Since the text starts with music´s definition and eight propositions, about which the rest of work was developed; check (...) the way that them appear in other treatises of the time could help to deduce the possible musical sources that the author used.This dissertation starts with a necessary reconstitution of philosophical and musical context of the epoch, followed by an analysis of jesuits conceptions of knowledge and music. In this way, it can be considered what motivated the author to write about music, as his the debates. In resemblance to his mature work, the text proposes a methodological turn that is only perceived with the context of the time in mind. After an interpretation of the definition of the music and the eight propositions, it could be possible compare with the others works form the epoch to verify his musical sources. With this process, it could evidence the influence of Aristotle, Aristoxenus, Jean de Murs, Pontus de Tyard, Gioseffo Zarlino and Francisco de Salinas. (shrink)

People often reason about omissions. One line of research shows that people can distinguish between the semantics of omissive causes and omissive enabling conditions: for instance, not flunking out of college enabled you (but didn’t cause you) to graduate. Another line of work shows that people rely on the normative status of omissive events in inferring their causal role: if the outcome came about because the omission violated some norm, reasoners are more likely to select that omission as a cause. (...) We designed a novel paradigm that tests how norms interact with the semantics of omissive enabling conditions. The paradigm concerns the circuitry of a mechanical device that plays music. Two experiments used the paradigm to stipulate norms and present a distinct set of possibilities to participants. Participants chose which causal verb best described the operations of the machine. The studies revealed that participants’ responses are best predicted by their tendency to consider the semantics of omissive relations. In contrast, norms had little to no effect in participants’ responses. We conclude by marshaling the evidence and considering what role norms may play in people’s understanding of omissions. Au lieu de se demander simplement “que veut dire être Français?” une seconde interrogation devrait suivre sur la façon dont se (...) construit la femme voilée dans la société française. En faisant appel à la philosophie de Hegel, les réflexions philosophiques employées pour ce projet cherchent à poser de nouvelles questions pouvant éclairer le débat sur l’identité nationale: la femme voilée est-elle l’Antigone des temps modernes? This study explores the employee retention strategies implemented by administrators in educational institutions, focusing on Immaculate Conception College of Balayan, Inc. The qualitative case study involved 10 participants, including administrators and employees selected based on stable tenure and appropriate qualifications. Through face- to-face interviews, key determinants influencing retention, such as teacher satisfaction, job contentment, professional growth, and loyalty, were identified. Recognition and incentives emerged as the primary retention strategy, significantly influencing employee satisfaction and fostering a sense of belonging. The study (...) concludes that these strategies are effective, contributing to the retention of skilled professionals. Recommendations emphasize the importance of recognizing and providing incentives as core strategies for administrators in educational settings, recognizing their role in creating a positive work environment and promoting sustained employee commitment. Despite being a women's problem for a long time, catcalling has recently attracted lawmakers' attention. In 2019, the Philippine government enacted Republic Act 11313, or the Safe Spaces Act, which prohibits and punishes gender-based sexual harassment. However, despite the existence of the law, catcalling continues to be rampant. This study aims to explore the experiences of women in Quezon City who have been subjected to catcalling and to provide answers regarding the effects of catcalling on the victims, the locations where (...) catcalling is most prevalent, the most common perpetrators, and the victim's views on the Safe Spaces Act. This research uses a qualitative descriptive approach. Purposive sampling was used to select respondents, and respondents were interviewed using an interview guide to gather information. The findings indicate that women are most vulnerable to catcalling in public spaces, and the perpetrators are strangers or bystanders. Victims went through mental, emotional, and behavioral changes after the incident. Moreover, not all victims think that the law effectively addresses the problem because catcalling is still prevalent, and public awareness campaigns are lacking. (shrink)

: This paper addresses the need to examine teaching practices from the observation that they are beyond what they should be. This task devolved to scientists of education is to learn about teaching practices in their relationship to student learning in order to build the database useful to teacher educators and reflexivity necessary for any teacher about their own practice. The concepts of competence, pattern and are useful instrument in this endeavor of explanation and understanding of the practices. The proposed (...) theoretical framework is illustrated by a perspective of teaching practices of teachers in schools and colleges. These differ in many aspects and this requires the testing of new hypotheses to explain -/- La présente contribution traite de la nécessité d’étudier les pratiques d’enseignement à partir du constat de ce qu’elles sont au delà de ce qu’elles devraient être. Cette tâche dévolue aux chercheurs en sciences de l’éducation vise à mieux connaître les pratiques d’enseignement dans leurs relations aux apprentissages des élèves afin de constituer la base de données utiles aux formateurs d’enseignants et nécessaire à toute réflexivité des enseignants à propos de leur propre pratique. Les notions de compétence, de schème et d’instrument sont utiles à cette entreprise d’explication et de compréhension des pratiques. La proposition de cadrage théorique est illustrée par une mise en perspective des pratiques d’enseignement de professeurs des écoles et de collèges. Celles-ci se distinguent sur bien des aspects ce qui réclame la mise à l’épreuve de nouvelles hypothèses explicatives. (shrink)

L’objectif de cet article est de comprendre l’importance de la métaphysique analytique pour le travail philosophique et pour l’enseignement dans le contexte français. Pour cela, je commencerai par exposer ce qu’il faut entendre par métaphysique analytique, puis j’examinerai plusieurs conditions de possibilité de la métaphysique analytique en France : la relecture de l’histoire de la métaphysique, des découvertes en logique, une réflexion sur l’objectif et un examen rapide des conditions matérielles et sociales d’enseignement et de recherche.

In this work we present the function and we determine the nature of conventions and hypotheses for the scientific foundations according with the conventionalist doctrine that arose in France during the turning of the XIX century to the XX. The doctrine was composed by Henri Poincaré, Pierre Duhem and Édouard Le Roy. Moreover, we analyze the relation that conventions and hypotheses can establish with metaphysical thesis through criteria used by scientists in order to determine the preference for certain theories. (...) Thereunto, we promote an immanent interpretation of published works between 1891 and 1905. As result, we reveal that the authors, though being classified as belonging to the same doctrine, don't have only common grounds, but also divergences. Poincaré and Le Roy agree that geometrical conventions are chosen in accordance with convenience criteria. However, they disagree about the value convenience aggregate to scientific knowledge. In regards to natural phenomena, the three authors agree that reality can't be described univocally by the same set of conventions and hypotheses. Yet, Poincaré and Duhem both believe that there are experimental, rational and axiological criteria that justify scientist's satisfaction with certain theories and we indicate how those criteria are related with metaphysics. We conclude that conventionalists, even if warily and implicitly, searched to approach metaphysics in order to justify scientific activity. (shrink)

On Oct. 24, 2019, French philosopher Sylviane Agacinski was scheduled to speak at the Université de Bordeaux-Montaigne on « l’être humain à l’époque de sa reproductibilité technique » [the human being in the era of its technological reproducibility]. Amidst “violent threats” and their purported inability to assure the safety of Agacinski, the organizers cancelled the event. Agacinski and other French intellectuals lament what they perceive to be part of a “drifting liberticide”, a form of censorship that forbids the exchange of (...) ideas and forecloses open space for debate. The story goes that Agacinski, notable for her staunch opposition to surrogacy and extending assisted reproductive technologies (ARTs) to non- heterosexual couples, as well as her anthropological claim that the fabric of our social order relies on the heteronormative structure of sexual difference, has been silenced. In a communiqué to the university, student organizations such as Riposte Trans and Mauvais Genre-s pleaded “no platform”, indicating that Agacinski’s reactionary homophobic and transphobic positions run contrary to the university’s mission of safeguarding against discrimination. The Système de philosophie by Pierre Sylvain Régis can be considered as the achievement both of the scientific liveliness of the Académie des Sciences in the 17th century and of its fruitful relationship with the Royal Society. Since it aims to shape the new conception of the universe in terms of a system, the Système represents one of the most mature achievements of Cartesian philosophy and it is characterized by an empirical interpretation of Descartes’ thought. The Système therefore reflects two (...) important phenomena occurring in the Europe of the 17th century: the scientific revolution and the proliferation of Academies. In fact, this ambitious work could be undertaken with the support of the Académie des Sciences and the Journal des Sçavants. My paper will analyse the French context by focusing to outline the role which the Académie de France had both in France, as the medium of dissemination of the new philosophy despite censorship, and abroad, in particular through the relationship with the Royal Society in England. I aim to analyse the role of the Journal des Sçavants as a means to share ideas other than by correspondence and as a trait d’union between “rationalist France” and “empiricist England”. I intend to question whether it is possible to establish a connection between the empirical interpretation of French Cartesianism, the consolidation of the Académie de France and the employment of new means of academic communication. The paper will show that the second half of 17th century France represents a remarkable exception to the conventional picture, which states that in 17th century Europe, following the success of a mechanistic interpretation of reality, two philosophical school clashed: rationalism, predominating on the continent, and empiricism, in England. This article addresses the problems associated with aircraft noise with or without pilots. It asks whether the administrative measures taken by France and the United Arab Emirates are sufficient and efficient to combat noise pollution. It examines the aeronautical preventive measures, as well as those related to urbanism, before discussing remedial measures for aircraft noise. This article finds that the administrative measures taken by the UAE, in comparison to those of France, are insufficient and ineffective. One of the (...) reasons is that the preventative and suppressive measures reflect the transversal nature of noise: they are both national and international regulations, but they are not homogenous, unitary and structured. Legislative policies, taking into account expert suggestions and opinions, must emerge in the UAE by following the recommendations on the protection of the environment of international institutions, such as ICAO. Thus, the mitigation measures would be used to redistribute aircraft noise to diminish its impact on the most sensitive areas. This article recommends measures such as modifying runways, as well as routes, and special manoeuvres to reduce noise during take-off and approach. (shrink)

One of the most disputed questions among economists is that of "the role" and "size" that the public sector should have in a rich and developed country like France. -/- The importance of this question is understandable, because the history of nations is filled with examples of a sector (or a branch) of the economy becoming too large, or remaining too small, hampering growth or making the economy more vulnerable. A recent case is that of the "Financial Corporations Sector", (...) which doubled in size in several countries during the two decades leading up to the 2008 economic collapse [1]. -/- It is therefore legitimate to ask whether this is not also the case, in France, with "General Government" or "the Public Sector". -/- We explain why the argument most often used by those who hold this opinion (that the ratio "public expenditure/GDP" is a good measure of the size of the public sector and that in France it is too high) is not a serious one. -/- . This paper seeks to show that in the work of Bataille there is a general social theory articulated around the notion of the sacred. According to our reading hypothesis, Bataille deepened and extended the movement initiated by Durkheim, who postulated the syntax of the sacred archaic as the most fundamental part of the social grammar. But he did so interpreting the Durkheimnian legacy in the light of a conception of multitude understood as general economy of collective passion. To do this, (...) he borrowed from psychoanalysis and German phenomenology, producing an original theory of the social bond, the structure and dynamics of human groups, with which he proceeded to analyze the discontents of his time. Given the tragic anthropology that framed this intellectual enterprise, the result was the impossible or transgressed social theory that takes the name of heterology. (shrink)

Histoire et utilisation du robot Bien que la robotique soit un marché économique relativement jeune et en pleine croissance, la genèse des robots remonte à l’Antiquité. Le premier robot à être déployé sur des lignes d’assemblage est Unimate, utilisé dès 1961 par General Motors. La robotique, en se di usant dans tous les pans de notre économie, va impacter les business modèles de nombreuses industries comme l’automobile et l’aéronautique mais aussi la construction ou l’agriculture. Aujourd’hui les robots industriels et de (...) service servent à de multiples tâches allant de la logistique à l’usinage en passant par la fonderie. La robotique constitue aussi et surtout un enjeu sociétal contribuant à relever les dé s de la mobilité, de la santé, de l’autonomie, du vieillissement et de l’éducation. Absence de dé nition et de régime juridique spéci que au robot En France, la notion de robot ne fait pas l’objet d’une dé nition juridique qui lui est propre. Les dé nitions relatives à l’environnement robotique peuvent tout de même se retrouver dans la norme ISO 8373:2012. Bien que les robots intéressent les juristes à plusieurs titres, le législateur n’a, à ce jour, pas adopté de régime juridique spéci quement applicable aux robots. Il convient donc de rechercher dans le droit positif le corpus de textes applicables aux robots. Ce corpus pourra alors recevoir l’appellation de « droit de la robotique ». Garanties Le vendeur d’un robot industriel et de service doit se conformer aux garanties légales que sont la garantie des vices cachés et la garantie d’éviction. Il doit également respecter les éventuelles garanties qui ont pu être convenues contractuellement Clauses contractuelles Le fournisseur d’un robot industriel et de service doit être particulièrement attentif aux clauses contractuelles rela- tives à la garantie, à la propriété intellectuelle, à la con dentialité, à la responsabilité et à la conformité aux directives techniques. Les spéci cités liées au robot, telles que les éléments relatifs à l’intelligence arti cielle, pourront être intégrées dans des annexes spéci ques. Intelligence arti cielle L’algorithme d’intelligence arti cielle dont est équipé un robot industriel et de service peut, dans certaines condi- tions, béné cier d’une protection grâce au droit d’auteur, à la protection du savoir-faire et au brevet. Aucun régime spécial n’existe à ce jour protégeant les œuvres conçues par le robot intelligent. Mobilité Les véhicules et drones autonomes utilisés au sein même de l’usine sont considérés comme des machines. Etant don- né les risques existants, il convient de xer de règles internes d’utilisation. Les véhicules autonomes ne peuvent à ce jour quitter l’espace privé. En revanche, les drones peuvent circuler dans l’espace aérien en respectant strictement le cadre réglementaire. Douanes Le taux de perception des droits de douanes d’un robot industriel et de service est conditionné par la connaissance de l’origine, préférentielle ou non préférentielle, du robot qui est déterminée par la position tarifaire de ce dernier. Le robot industriel et de service entre dans le chapitre 84, qui concerne notamment les machines, de la nomenclature du système harmonisé établi par l’Organisation mondiale de douanes. Sécurité En application de la « directive machines », le robot peut recevoir la quali cation de machine ou de quasi-machine. En vertu de cette directive, mais également au titre du Code du travail, de nombreuses obligations en matière de santé et de sécurité doivent être respectées pour la commercialisation et l’utilisation des robots. Conformité Le Code du travail, en transposant la « directive machines », a prévu de nombreuses obligations et procédures, appli- cables aux robots industriels et de service, permettant ainsi de s’assurer que ces derniers respectent les exigences de conformité nécessaires en matière de santé et de sécurité. Maintenance Dans le cadre de la maintenance, le fournisseur d’un robot industriel et de service est soumis à plusieurs obligations législatives aux titres de la disponibilité des pièces détachées et de la location. Les dispositions contractuelles de- vront prendre en considération les spéci cités propres au robot et ne pas ignorer la maintenance prédictive. Quali cation juridique Dans le cadre de la conception, de la fabrication et de l’utilisation du robot, il convient de porter une attention par- ticulière à quatre textes spéciaux qui peuvent être applicables aux robots industriels et de service : le règlement 428/2009 sur les biens à double usage, la directive 2014/35/UE applicable au matériel électrique basse tension, la directive 2014/53/UE applicable aux équipements radioélectriques et la directive 2014/30/UE sur la compatibilité électromagnétique. Responsabilité Bien que les régimes de responsabilité, civile et pénale, ne sont pas adaptés aux robots autonomes, la responsabilité civile de droit commun, la responsabilité du fait des choses, la responsabilité du fait des produits défectueux et la responsabilité des commettants du fait de leurs préposés peuvent s’appliquer en cas de fait dommageable causé par le robot tout comme la responsabilité pénale en cas d’infraction commise dans le cadre de l’utilisation du robot. Assurance La police d’assurance relative aux robots doit permettre de protéger le robot contre les risques auxquels ils sont confrontés mais également d’assurer la responsabilité pour les dommages qu’ils pourraient causer, on peut alors parler de « dommages robotiques ». Données et bases de données Les bases de données contenues dans un robot industriel et de service doivent respecter les droits dont dispose l’auteur sur la structure de la base de données et/ou les droits du producteur des bases de données dans lesquelles gurent les données utilisées. La réglementation Informatique et libertés est également applicable au robot lorsque celui-ci collecte et/ou traite des données personnelles. Droit de la robotique dans le monde Aucun Etat ne s’est à ce jour doté d’un régime juridique détaillé et spéci que à la robotique. Des dispositions juri- diques relatives aux robots peuvent tout de même se retrouver de façon éparse dans certains droits étrangers concer- nant notamment les drones et les véhicules terrestres autonomes. El documento afirma que existe una fuerte obligación moral de garantizar que los participantes enfermos de un estudio clínico hagan una transición después del estudio hacia una atención de la salud apropiada. Con “atención de la salud apropiada” se hace referencia al acceso para los participantes a la (...) atención de la salud, proporcionada principalmente por el National Health Service (en adelante NHS), el sistema de salud del Reino Unido, y/o a la intervención en estudio, también llamada producto o tratamiento en investigación. Las guías “Atención después de la investigación” están dirigidas principalmente a los miembros de los 79 comités de ética de investigación del NHS y a quienes presentan sus estudios de investigación ante estos comités. Se trata de un documento borrador muy avanzado, trabajado en numerosas reuniones, durante más de 3 años, que ha sido discutido por participantes de estudios y miembros de la comunidad, miembros y presidentes de comités de ética de investigación del Reino Unido, especialistas internacionales en ética de la investigación, representantes de la industria y otras partes interesadas. This is a very advanced draft document, worked in several meetings, for more than three years, that has been discussed with study participants and community members, members and chairs of RECs in the UK, international specialists in research ethics, industry representatives and other stakeholders. The drafting of the guidelines is the result of the collaboration of Neema Sofaer and Penney Lewis, both researchers at King's College London, at the Centre of Medical Law and Ethics of Dickson Poon School of Law, and Hugh Davies, Research Ethics Advisor of the Health Research Authority (HRA) of the NHS.
