This paper explores Saidiya Hartman's undertheorized account of 'redress' in conversation with the extensive uptake of her work on Black fungibility, subjection, and critiques of emancipation. Although Hartman uses the term in nearly all of her writing, little work has been done to clarify how Hartman conceptualizes redress as a response to the constitution of Black lives as abstract, exchangeable, and disposable. This paper offers an account of how Hartman theorizes redress, showing how it both resists, and acts as a (...) mechanism for, the constitution of Blackness as fungible. Consequently, I argue that Hartman's readers fundamentally skew her thinking in divorcing redress from her other key concepts. (shrink)

Attempting art: an essay on intention-dependenceIt is a truism among philosophers that art is intention-dependent—that is to say, art-making is an activity that depends in some way on the maker's intentions. Not much thought has been given to just what this entails, however. For instance, most philosophers of art assume that intention-dependence entails concept-dependence—i.e. possessing a concept of art is necessary for art-making, so that what prospective artists must intend is to make art. And yet, a mounting body of anthropological (...) and art-historical evidence and philosophical argument suggests that not only is such a criterion unsatisfied by most of the art-historical canon, but it also rests on a false premise: concepts of 'art' are not shared between cultures, nor even in the same culture across time. My dissertation aims to rectify this error by first exploring what our commitment to art's intention-dependence actually entails, and then showing that, properly understood, intention-dependence sets a number of important constraints on theories of art with respect to explanatory desiderata such as the success- and failure-conditions of art-attempts, the cross-cultural identification of art, and the reference of 'art' and art-kind terms. I begin by situating art's intention-dependence in the philosophical literature on intentional action, arguing that, properly conceived, intention-dependence is a weak criterion which can be satisfied either directly or indirectly. It therefore does not necessarily entail concept-dependence. I then use this distinction to motivate a new treatment of the success- and failure-conditions for art-attempts, arguing that the extant model's emphasis on compliance with 'the manner intended' is far too restrictive to capture actual artistic practices. I go on to show that Ruth Millikan's model of linguistic conventions supplies an independently plausible explanation of art's concept-independent origins in terms of the development of a system of indirectly intention-dependent conventions called an 'artworld'. I argue that this account of artworld development supplies us with the tools we need to distinguish art-kinds from other artifactual kinds. Finally, I turn my attention to methodological issues, arguing that even though 'art' is a social kind with its roots in arbitrary and historically-contingent networks of conventions, the philosophy of art is not merely an exercise in bare conceptual analysis. In fact, there is now a great deal of evidence to show that the ways we think about 'art' are inconsistent, incomplete, imperialistic, and largely unprincipled. Yet I argue that this does not mean that the artworld data have no bearing on theories of art. Instead, I argue that our best reflective understanding of our artworld practices sets the constraints on the reference of 'art' and art-kind terms. I argue that we have no privileged epistemic access to the ontology of social kinds; our only privilege lies in our ability to determine the proper subject of our inquiries. (shrink)

This blog post begins by showing the pejorative connotations inherent in the term 'Hindu' and goes on to lay bare the differences between Hinduism and other religions including Jainism and the Abrahamic religions. So that this necessary project of dialogues is not hijacked by celibates of various traditions; the post ends with these reflections: "The Hare Krishna movement, and all other prominent movements within the Sanatana Dharma including the various well known cults of hero-worship are all structured around centralised superstructures (...) which we acquired during our long history of colonisation. Many of these movements appeal to the Western mind because they are authoritarian with strict rules. But these rules have been negated within the Sanatana Dharma by thinkers ranging from Sri Utpaladeva to Sri Abhinavagupta to Sri Kshemraja. The Sanatana Dharma stresses marriage over celibacy not because it is akin to Protestantism. There is none to protest against. Nor is it better to marry than to burn. It is simply this; marriage is not a lower state than other choices in life. It is a first step towards recognising that one can indeed be two who form a monad.". (shrink)

The notion of aesthetic experience attempts to account for an important part of human experience and, although it embraces an immense and multifaceted variety, the complexity and vagueness of which have been an authentic challenge to its definition (to the point that some suggest its conceptual uselessness), it is still crucial and decisive for an entire philosophical discipline: aesthetics-which is not to be confused with the philosophy of art, although it often intersects with it. This chapter considers the case (...) of the city-which is not so much an object as a multifaceted and fragmented environment where aesthetic experiences can occur-in order to attempt to elucidate (or at least to make a contribution to the elucidation of) the meaning and scope of this philosophical topic. The standard of care in the United States favors stabilizing any adult who arrives in an emergency department after a failed suicide attempt, even if he appears decisionally capacitated and refuses life-sustaining treatment. I challenge this ubiquitous practice. Emergency clinicians generally have a moral obligation to err on the side of stabilizing even suicide attempters who refuse such interventions. This obligation reflects the fact that it is typically infeasible to determine these patients’ level of decisional capacitation—among other relevant information—in this (...) unique setting. Nevertheless, I argue, stabilizing suicide attempters over their objection sometimes violates a basic yet insufficiently appreciated right of theirs—the right against bodily invasion. In such cases, it is at least prima facie wrong to stabilize a patient who wants to die even if they lack a contrary advance directive or medical order and suffer from no terminal physical illness. This paper aims to deal with the disputes on transferring demonstration between the various sciences in the context of the medicine-geometry relationship. According to Aristotle’s metabasis-prohibition, these two sciences should be located in separate compartments due to the characteristics of their subject-matter. However, a thorough analysis of the critical passage in Aristotle’s Posterior Analytics on circular wounds forces a revision of the boundaries of the interactions between sciences, since subsequently Avicenna, on the grounds of this passage, would widen the area (...) of the transference of demonstration. Furthermore, the fact that Avicenna and Ibn al-Nafīs continued to use geometrical demonstrations in their anatomical investigations shows the need to understand kind-crossing prohibition as a reminder to take into account the present scientific infrastructure and logical rules before proceeding onto a scientific investigation instead of accepting it as a mere nominal doctrine. Therefore, whether kind-crossing was possible or not depended on the extent to which the conclusion derived at the end of the scientific investigation, using a different method after taking into account all these reminders, had contributed to the solution of a particular proposition or the achievement of an approximate truth. Abraham Maslow (1943) suggested a framework [1] to study human motivation, which was a starting point towards developing the quality of life(QOL) theory. On that article, he described a hierarchy of human needs, that is generally consist of fundamental needs which are required for human survival, and environment dependent ones, like society, safety and etc. In this (...) study, we are trying to represent a tangible mathematical model for assessing the sense of need for water in terms of the available source of water. On this very subject, M. Joseph Sirgy [2] states that ”From a human developmental perspective, QOL goals can be defined as satisfaction of human developmental needs in a community or society”. Accordingly, in the first section we propose a model for the water needs of an individual. In the second section, we continue the discussion by checking the behavior of the model on a given population, and each time by assuming that we have two out of three involved factors, we try to suggest an estimation for the other one. In the present paper, these authors argue on actual reasons why Hilbert’s axiomatic program to unify gravitation theory and electromagnetism failed completely. An outline of plausible resolution of this problem is given here, based on: a) Gödel’s incompleteness theorem, b) Newton’s aether stream model. And in another paper we will present our calculation of receding Moon from Earth based on such a matter creation hypothesis. More experiments and observations are called to verify this new hypothesis, albeit it is inspired from (...) Newton’s theory himself. (shrink)

Strategies for effectively communicating scientific findings to the public are an important and growing area of study. Recognizing that some complex subjects require recipients of information to take a more active role in constructing an understanding, we sought to determine whether it was possible to increase subjects’ intellectual effort via “priming” methodologies. In particular, we asked whether subconsciously priming “intellectual virtues”, such as curiosity, perseverance, patience, and diligence might improve participants’ effort and performance on various cognitive tasks. In the first (...) experiment, we found no significant differences in either effort or understanding between IV-primed and neutrally-primed individuals across two different priming techniques. The second experiment measured the effect of IV-priming on intellectual effort in simpler, shorter-duration puzzles and exploration activities; here, we observed an effect, but given its low strength and short duration, we do not believe that priming of IVs is a promising strategy for science communication. In this essay, I want to explore one of the most ironic episodes in the history of propaganda, the attempt by various federal agencies to moderate American WWII anti-Japanese propaganda films. My texts will be four films, two produced by the military, and two by Hollywood: December 7th (1943), directed by Gregg Toland and revised by John Ford; Air Force (1943), directed Howard Hawks; Know Your Enemy: Japan (1945), directed by Frank Capra; and Betrayal for the East (1945), directed by (...) William Berke. As all of these films are readily available on YouTube, I will be brief in my description of them. Instead, I will focus on how they served to intensify racial hatred of Japanese in general and Japanese-Americans in particular, and how the federal government tried to control that propaganda—but was limited by its own policies regarding Japanese-Americans. This is the first of a two-part paper in which I would like to propose some possible hypotheses on the early origins of symbolic function, which is the most typical feature of human being, based on disavowal mechanism. Briefly recalling the main stages of the history of symbolism, it will be possible to lay out many of its theories within the framework that we wish to outline with this work, this first part of which is mainly concerned with the basic (...) psychodynamic notion of disavowal and its possible applications, above all in regard to fetishism. This article responds to Nicholas Wolterstorff's attempt to ground human rights in the condition of being loved by God.

‘Attempted negligence’ is a category of criminal offense that many jurists and philosophers have law have deemed conceptually incoherent. In his Attempts: In the Philosophy of Action and the Criminal Law, Gideon Yaffe challenges this dismissal, anchoring his argument in cases of what he calls ‘mental self-management’ in which agents plan to bring about that they perform unintentional actions at a later time. He plausibly argues that mental self-management-type attempted negligence is possible. However, his account raises the question whether (...) such attempts can be successful: whether, in other words, attempts to perform unintentional actions at a later time could issue in actions that are, indeed, unintentional. Intuitively, at least, it would seem that we should answer in the affirmative. However, that answer poses problems for a plausible and widely-held account of intentional action. Al Mele, responding to Yaffe’s account, has pointed out this problem without, I think, providing a satisfactory resolution. I propose another way of vindicating the possibility of successful attempted negligence with small, if significant, revision to the standard view of intentional action. In these cases, I argue, agents fail to act intentionally because they render themselves, through their acts of self-management, unaware that they are successfully executing their intentions. Moreover, I argue that these agents’ intentions to bring about that they perform unintentional actions do not commit them to acting intentionally because of the nature of intentions to bring about actions. I offer an account of the intention to bring about that one A’s and defend it against some objections. (shrink)

In "Ordinary Morality Implies Atheism" (2009), I argued that traditional theism threatens ordinary morality by relieving us of any moral obligation to prevent horrific suffering by innocent people even when we easily can. In the current issue of this journal, Jerome Gellman attempts to rescue that moral obligation from my charge that theism destroys it. In this reply, I argue that his attempted rescue fails.

Marianna Charitonidou's books discuss the problem of changes in the creation of architecture in the 20th century. The author showed representatives of four generations of architects of this period. The first group is represented by Le Corbusier and Ludwig Mies van der Rohe. The second generation was described as a group of opponents to the CIAM environment centered around the Team X grouping and the activities of Alison and Peter Smithson and Aldo van Eyck. Generation three was discussed based on (...) the work of Aldo Rossi and Giancarlo Da Carlo. Generation four, active since the 1980s, was linked to the activities of Rem Koolhaas and Bernard Tschumi. In his article, ‘What's Wrong with Tooley's Argument from Evil?’, Calum Miller's goal was to show that the evidential argument from evil that I have advanced is unsound, and in support of that claim, Miller set out three main objections. First, he argued that I had failed to recognize that the actual occurrence of an event can by itself, at least in principle, constitute good evidence that it was not morally wrong for God to allow events of the kind in (...) question. Miller's second objection was then that, in attempting to show that it is unlikely that God exists, I had failed to consider either positive arguments in support of the existence of God or possible theodicies, and thus that I was unjustified in drawing any conclusions concerning the probability that theism is true in the light of the total evidence available. Miller's third and final objection was that one of the approaches to logical probability that I employed – namely, that based upon a structure-description equiprobability principle, rather than a state-description equiprobability principle – was unsound since it has clearly unacceptable implications. In response, I argue that all three of Miller's objections are unsound. The third objection, however, is nevertheless important since it shows that my type of argument from evil cannot be based merely on the evils found in the world. One must also consider good states of affairs, and their relations to bad ones. I show, however, that that deficiency can be addressed in a completely satisfactory manner. (shrink)

In various of my writings, both in Philosophical Studies and elsewhere, I have argued that an account of trying sentences is available that does not require quantification over alleged attempts or tryings. In particular, adverbial modification in such sentences can be dealt with, without quantification over any such particulars. In ‘Attempts’, Jonathan D. The Church faces a number of challenges concerning the sociological impact postmodernism is having on society. And one very significant area that has been profoundly disputed is the epistemological content of the concept of truth. Evangelical Christians believe in Objectivism: the conviction that there exists some ahistorical (outside of history) source, foundation or framework to which we can appeal to in determining the substance and nature of truth, knowledge, reality, right or wrong that is independent and external to personal experience (...) or thinking. However, the majority of people no longer believe in absolute truth but in relativism. Relativism is the denial that there exists such an ahistorical source or foundation that we can appeal to. Truth, knowledge, reality, right and wrong are all concepts that are relative to a specific conceptual scheme, framework, or paradigm founded in a society, religion and culture. This paper represents an endeavour to dialogically reunite the two perspectives by arguing for the seeking of the truths in both perspectives. God is Objective Truth and has become involved in history: in the existential; in the material setting of our relative and infallible thoughts and the slanted interpretative experiences of the Triune God and life. The synthesis will be an affirmation that for Christians Truth is discovered and revealed in fellowship within community. And members of the Body of Christ are first and finally called to reveal and demonstrate truth to the world - in their unity. (shrink)

Massimo Renzo has recently offered a theory of legitimacy that attempts to ground the state’s right to rule on the assumption that people in the state of nature pose an unjust threat to each other and can therefore, in self-defense, be forced to enter the state, that is, to become subject to its authority. I argue that depending on how “unjust threat” is interpreted in Renzo’s self-defense argument for the authority of the state, either his premise that “those who (...) pose an unjust threat to others can be justifiably coerced in self-defense, at least when they are morally responsible for posing the threat,” or his premise that “would-be independents pose an unjust threat to those living next to them in the state of nature,” or both of them are wrong. I further argue that his premise that would-be independents pose an unjust threat by refusing to enter the state is also mistaken. Refusing to enter the state, that is, refusing to be subject to the authority of the state, is no threat at all, and hence coercing people into entering the state is no means of self-defense and incapable of enhancing security. Renzo’s deduction of state authority from the right to self-defense fails. (shrink)

Once I had explored the research issue of North and South unification with a focus on the legal integration for uniform constitution and various statutes. It pushed me to deal with a big question, and looked like a semi-textbook with an inchoate idea and baby theory upon the completion of research project. The literature review thankfully had allowed the space of creativity and originality of my work product, and can also be a typical way of foreign graduate legal researchers in (...) the process of his dissertation work. They would be beneficial with new statutes and codes, for example, from the Korean Congress, that are enacted recently, which would be their research topic certainly original and contributive. This could be viewed as one of qualitative enclaves enmeshed into a larger scope of qualitative inquiry. This interplay is fairly consequential in excavating a new knowledge and research findings. It could be aboriginal -- one trait word to characterize the qualitative studies-- from the viewpoint of host country, but became original as a crop to expand the horizon of new knowledge. I have once argued that the quantitative studies are on generality of subjects and commonness for involved strands. This profile would vary that the qualitative studies tend to be strong with the story and enclaves. The e-age and rapid compression of space with the development of telecommunication technology also factor to change a paradigm of knowledge and research activities. At least, the contemporary society certainly would be more specific as if we can trace a person with the satellite spotting and the electronic identifier on the leg of sex criminals in Korea guarantees to be safeguarded from his potential danger. That may be favorable concerning the elements and environments of qualitative studies. For example, we may follow up by comparing the research work of Korean statute with the e-government of Korea displaying the statute. We can entertain many on-line sources of information and stories with the dissertations of aboriginal culture. With my time on the qualitative studies, I came across the nocebo effect illustrated with the fear of MERs-CoV in Korea. The effect looks into the negative dimension of human mind and his personality, which could aggravate the current challenge of national crisis, June, 2015. Paradoxically, the nocebo effect can be said to characterize the qualitative context of inquiry. As Freud suggested, the vast of human element is of unexplainable dimension that is less easily quantifiable or generizable over the population (Broome, 2010). This does not say that the continental researchers had been affected with a late nationalization or late development of region leaving them to search for an ego. This is to say that the qualitative studies could explain the part of truths for the universe and human. The researchers interested in deep knowledge could employ their method, but in ethics, who would not vulture the objects of his theme and conduct on due scientific ground. (shrink)

Predictive processing is an increasingly popular explanatory framework developed within cognitive neuroscience. It conceives of the brain as a prediction machine that tries to minimise prediction error. Predictive processing has also been employed to explain aspects of conscious experience. In this paper, I critically evaluate current predictive processing approaches to the phenomenology of time-consciousness from a Husserlian perspective. To do so, I introduce the notion of orthodox predictive processing to refer to interpretations of the predictive processing framework that subscribe to (...) representational views of cognition. As it turns out, current predictive processing accounts of time-consciousness are orthodox given their commitment to representational views of both brain functioning and perception, and, on the other hand, their reliance on the primacy of imagination over perception. However, I argue that such accounts are in fact closer to a Kantian-Brentanian approach to the phenomenology of time-consciousness than to the Husserlian account that they attempt to account for. This paper takes up David Kaplan's suggestion that the phenomenon of cognitive dynamics can be approached via a study of what it takes for someone to change her mind. It is argued that in order for a subject to be able to change her mind about something, there must be occasions on which the following is the case: (1) First, the subject believed of an 'x' that it was f, now she believes of 'x' that it is not-f. (2) She (...) stopped believing of 'x' that it was f before she started believing of 'x' that it was not-f. (3) She knows that (1) and (2). The first part of the investigation shows why (1) - (3) are necessary within an account of what it is for someone to change her mind. The second part focuses on condition (3) and argues that it entails that the sameness or difference of thought content over time must sometimes be an epistemic given, i.e., that the subject can know that a thought she entertains now is the same as a thought she entertained earlier. Hume’s Treatise, with its celebrated bundle theory of the self, is a significant contribution to the embryonic Newtonian experimental philosophy of the enlightenment. But the theory is inadequate as it stands, as the appendix to the Treatise makes clear. For this account of the self, apparently, rests on contradictory principles — propositions, fortunately, that can be reconciled, according to Hume. My paper is a critical exploration of Hume’s argument for this intriguing suggestion.

The aim of this paper is to paraphrase Theda Skocpol’s theory of social revolutions with the use of the conceptual apparatus of non-Marxian historical materialism. In the successive sections of this paper, the concepts of modernization, the nature of state power, an agrarian bureaucracy, and the mechanism of a victorious revolution are paraphrased. This paraphrase makes it possible to distinguish two kinds of agrarian bureaucracies, each resulting in social revolutions with different outcomes. A victorious revolution led to successful modernization in (...) the case of an economic agrarian bureaucracy, but not in the case of a political agrarian bureaucracy. (shrink)

In Wrongs and Crimes, Victor Tadros clarifies the debate about whether consent needs to be communicated by separating the question of whether consent requires expressive behaviour from the question of whether it requires “uptake” in the form of comprehension by the consent-receiver. Once this distinction is drawn, Tadros argues both that consent does not require uptake and that consent does not require expressive behaviour that provides evidence to the consent-receiver. As a result, Tadros takes the view that consent requires an (...) attempt to communicate, but nothing more. While I have found Tadros’s arguments for this conclusion intriguing and challenging, I am yet to be persuaded by them. In this essay, I try to say why. (shrink)

Bestrewn with relics of subjugation, the frameworks that hinge on social progress have failed to appraise the plight of the marginalized in the democratic discourse. This is the case in the Philippines, as in other fringed spaces caught in hegemonic world-building. In this setup, emancipation is anchored in salvific attempts – salvaging the marginalized from a messianic standpoint. This tends to produce a pejorative image of the marginalized as incapable of self-determination. I argue in a three-part discussion: (1) reexamine (...) the locus of the margin in critical theorizing; (2) retrace the act of recognition vis-à-vis the emancipative struggle; (3) present that the lifeworld of the marginalized offers redemptive alternatives for emancipation. Further, I argue that this offers a foremost framework in critical theorizing at the margin since their situatedness affords a stance that has not formed a patina of the West but is primarily informed by their rich local periphery. This text, commissioned by the OSUN Global Observatory of Academic Freedom, discusses how the concept of academic freedom is codified in Colombian Law and regulations of public and private higher education institutions. It also explores common conceptions of academic freedom among Colombian scholars, as well as commonly observed threats to it.

Actual situations where folk philosophy might have predicted precognition effects were studied and dealt with experimentally and theoretically. Extremely strong experimental results were obtained but the findings supported not precognition but the Many Bubble Interpretation, which uses at this time dynamical systems theory as applied to the physics of the brain. Further experiments and theoretical work were discussed.

Christy Mag Uidhir’s Art and Art-Attempts begins from two deceptively simple observations: artworks are the product of intentions, and intentions are the kinds of things that can fail to be realized successfully. Drawing on these observations, he argues that most contemporary theories of art must be rejected because they are not substantively intention-dependent: that is, they do not account for the fact that an attempt to make an artwork can fail. From his view that artworks must be the product (...) of art-attempts that are subject to failure, Mag Uidhir derives implications for many domains in the philosophy of art. He argues that artworks cannot be abstract objects, since abstract objects cannot participate in causal relations and thus can’t be the product of art attempts: one can’t coherently intend or attempt to create something that exists eternally. Things that we think of as repeatable artworks, then, can’t be abstract types: instead, Mag Uidhir proposes, every artwork is concrete, but some are tied together by a relation of relevant similarity. In this symposium, Mag Uidhir replies to three critics, David Davies, Sherri Irvin and Keith Lehrer. All three critics examine the relevant similarity relation that Mag Uidhir proposes to account for artworks that we treat as repeatable, while also considering a variety of other issues. (shrink)

This paper discusses and criticizes Joseph Nye’s account of soft power. First, we set the stage and make some general remarks about the notion of social power. In the main part of this paper we offer a detailed critical discussion of Nye’s conception of soft power. We conclude that it is too unclear and confused to be of much analytical use. However, despite this failure, Nye is aiming at explaining an important but also neglected form of social power: the power (...) to influence the will and not just the behavior of other agents. In the last part of this paper we briefly discuss Steven Lukes’ alternative view of a “third dimension” of power and end with a sketch of a more promising way to account for this neglected form of power. Sports physicians are continuously confronted with new biotechnological innovations. This applies not only to doping in sports, but to all kinds of so-called enhancement methods. One fundamental problem regarding the sports physician's self-image consists in a blurred distinction between therapeutic treatment and non-therapeutic performance enhancement. After a brief inventory of the sports physician's work environment I reject as insufficient the attempts to resolve the conflict of the sports physician by making it a classificatory problem. Followed by a critical assessment (...) of some ideas from the US President's Council on Bioethics, the formulation of ethical codes and attempts regarding a moral topography, it is argued that the sports physician's conflict cannot be resolved by the distinction between therapy and enhancement. Instead, we also have to consider the possibility that the therapy-based paradigm of medicine cannot do justice to the challenges of the continuously increasing technical manipulability of the human body and even our cognitive functions as well. At the same time we should not adhere to transhumanist ideas, because non-therapeutic interventions require clear criteria. Based on assistive technologies an alternative framework can be sketched that allows for the integration of therapeutic and non-therapeutic purposes. After a thorough definition of standards and criteria, the role of the sports physician might be defined as that of an assistant for enhancement. Yet the process of defining such an alternative framework is a societal and political task that cannot be accomplished by the sports physicians themselves. The homeostatic property cluster theory is widely influential for its ability to account for many natural-kind terms in the life sciences. However, the notion of homeostatic mechanism has never been fully explicated. In 2009, Carl Craver interpreted the notion in the sense articulated in discussions on mechanistic explanation and pointed out that the HPC account equipped with such notion invites interest-relativity. In this paper, we analyze two recent refinements on HPC: one that avoids any reference to the causes of the (...) clustering of properties and one that replaces homeostatic mechanisms with causal networks represented by causal graphs. We argue that the former is too slender to account for some inductive inference in science and the latter, thicker account invites interest-relativity, as the original HPC does. This suggests that human interest will be an un-eliminative part of a satisfactory account of natural kindness. We conclude by discussing the implication of interest-relativity to the naturalness, reality, or objectivity of kinds and indicating an overlooked aspect of natural kinds that requires further studies. In this article, I propose to integrate indigenous knowledges in the Philosophy for/with Children theory and practice. I make the claim that it is possible to treat indigenous knowledges, not only as topics for philosophical dialogues with children but as presuppositions of the philosophical activity itself within the Community of Inquiry. Such integration is important for at least three (3) reasons: First, recognizing indigenous ways of thinking and seeing the world informs us of other non-dominant forms of knowledges, methods to (...) produce knowledge and criteria to determine knowledge. Second, the dominance of western standards of producing and determining knowledge, especially in non-western societies, needs to be reduced, balanced and informed by local knowledges and experiences. And third, indigenous knowledges reinforce a culturally responsive P4wC that responds to the challenges arising in multicultural and ethnically diverse classrooms. There are two (2) possible intersections where such integration may take place, namely: a) Epistemology, where I claim that the integration of a “presentational epistemology” immanent in indigenous patterns of thinking provides a counterweight to Lipman’s strong adherence to analytic-representational epistemology, and b) Pedagogy, which takes shape in an “indigenized” Community of Inquiry that highlights the values of interconnectedness, situatedness and relationality. In this paper we discuss three examples of the appropriation of Kuhn’s ideas in philosophy of science. First we deal with classical logical empiricism. Perhaps somewhat surprisingly, the arch-logical empiricist Carnap considered Kuhn’s socio-historical account as a useful complementation, and not as a threat of the philosophy of science of logical empiricism. As a second example we consider the attempt of the so-called struc- turalist philosophy of science to provide a “rational reconstruction” of Kuhn’s approach. Finally, we will deal with (...) Friedman’s proposal to apply Kuhn’s ideas to the formulation of a modernized, historically enlightened Kantian approach that is based on the concept of a non-apodictic constitutive and historically moving a priori. This article first of all attempts to assess the proposals of 2006–2007 to amend Poland’s Constitution, aimed mostly at strengthening constitutional protection of unborn human life. Parliamentary work on this proposal begins with the submission of the Deputy’s bill on amendment of the Constitution, published in the Sejm Paper No. 993 of September 5, 2006, and ends with a series of votes at the 39th sitting of the Sejm of the fifth term of office, held on April 13, 2007, (...) on which it was decided not to adopt any amendment. In the course of the legislative process, several modifi cation were offered not only to Article 38 concerning protection of life, but also to Article 30 dealing with dignity as a source of rights. Each of these proposals had drawbacks, including inter alia: the lack of a definite period of protection or entitlement to dignity, resulting in the decreased protection in relation to issues concerning euthanasia; the application of new categories granting a specific status to unborn human life; specifying the standards for protection by means of legislative acts ranking lower than a constitution, resulting in the transfer of life protection into the sphere of regulation of ordinary legislation. The most conducive for strengthening of the protection of unborn human life, even if not free of imperfections, was an amendment of Article 30 proposed by the Committee in the following wording: “The inherent and inalienable dignity, conferred on the person from the moment of conception, shall be a source of freedoms and rights of persons and citizens. It shall be inviolable; the respect and protection thereof shall be the obligation of public authorities.” From the rejection of the proposals it is diffi cult to draw conclusions that are vital for interpretation of the existing provisions. However, a conclusion that the intention of the authors of the constitution was not to strengthen the constitutional protection of life is not legitimate, mostly because of their doubts about formal correctness of the proposed amendments (when deciding to reject them), particularly the doubts about legal consequences of their adoption. -/- Streszczenie Zasadniczym celem opracowania jest próba całościowej oceny propozycji nowelizacji Konstytucji RP mającej miejsce w latach 2006-2007, zmierzającej przede wszystkim do wzmocnienia konstytucyjnej ochrony życia człowieka przed narodzeniem. Prace parlamentarne nad analizowaną nowelizacją otwiera poselski projekt ustawy o zmianie Konstytucji zawarty w druku sejmowym 993 z dnia 5 września 2006 (projekt wpłynął do Sejmu 7 września); zamyka seria głosowań na 39 posiedzeniu Sejmu V kadencji, dnia 13 kwietnia 2007 roku; głosowań, które przesądziły o niewprowadzeniu żadnych zmian. W trakcie procesu legislacyjnego proponowano szereg formuł, zmieniających nie tylko art. 38 dotyczący ochrony życia, ale także art. 30, który dotyczy godności jako źródła praw. W zasadzie wszystkie zgłoszone propozycje posiadały wady, wśród których najważniejsze to: brak domknięcia okresu ochrony lub przysługiwania godności, skutkujący obniżeniem ochrony w kwestiach związanych z eutanazją; stosowanie nowych kategorii, prowadzące do nadania specyficznego statusu człowiekowi przed narodzeniem; określanie standardu ochrony za pośrednictwem aktów o randze niższej od konstytucji, prowadzące do przesunięcia ochrony życia przed narodzeniem w sferę ustawodawstwa zwykłego. Z punktu widzenia celu, jakim było wzmocnienie konstytucyjnej ochrony życia człowieka przed narodzeniem i wzmocnienie jego pozycji prawnej, najlepsza, choć nie pozbawiona usterek, była zaproponowana przez Komisję zmiana brzmienia art. 30 prowadząca do formuły: „Źródłem wolności i praw człowieka i obywatela jest przyrodzona i niezbywalna godność człowieka, przynależna mu od chwili poczęcia. Jest ona nienaruszalna, a jej poszanowanie i ochrona jest obowiązkiem władz publicznych.”. Na podstawie odrzucenia propozycji zmian trudno wyciągać wnioski istotne dla interpretacji aktualnie obowiązujących przepisów; wniosek, że ustrojodawca nie chciał wzmocnienia konstytucyjnej ochrony życie nie jest prawomocny, przede wszystkim ze względu na – istotne w procesie podejmowania decyzji o odrzuceniu propozycji zmian – wątpliwości, co do formalnej poprawności formułowanych propozycji, w tym wątpliwości co do konsekwencji prawnych ich przyjęcia. This (...) statement of Ingarden’s criticisms of the doctrines of the Vienna Circle has been mentioned in print, but his views have not been discussed, or indeed accurately reported to date. Issues include attempts generally; the problem of outcome luck; the impossibility defense; physical movement and intent; and reckless attempts, attempted rape, and attempted theft. In the final section, I offer a hypothetical that challenges Prof. Donnelly-Lazarov's theory.

Arendt claims that our natality (i.e., our condition of being born) is the “source” or “root” of our capacity to begin (i.e., of our capacity to initiate something new). But she does not fully explain this claim. How does the capacity to begin derive from the condition of birth? That Arendt does not immediately and unambiguously provide an answer to this question can be seen in the fact that her notion of natality has received very different interpretations. In the present (...) paper, I seek to clarify the notion. I bring together and examine Arendt’s scattered remarks about natality and propose a new interpretation that responds to the stated question. Along the way, I show how the various existing interpretations have arisen and argue that, in view of that question, they are inadequate. (shrink)

The aspiration for volitional evolution, or human evolution directed by humans themselves,has increased in philosophical, scientific, technical, and commercial literature. The prospect of shaping the very being who is the consumer of all other innovations offers great commercial potential, one to which all other innovations would in effect be subservient. Actually an amalgam of projected technical/commercial developments, this prospective innovation has practical and ethical ramifications. However, because it is often discussed in a scientific way (specifically that of evolutionary theory), it (...) first calls for examination in terms of common scientific approaches to evolution. Yet, as evolutionary-theory controversies point up, evolution may be considered as neither a directed nor a directable process – a problem for the ontology of volitional evolution. One challenge for theories and programs aiming to implement the proposed innovation is then whether it is theoretically coherent. While I offer responses to the challenge in the form of objections, these in turn remain problematic. Two central issues of responsible innovation arise: (1) If this prospect were feasible, would it be responsible to implement it, and (2) if it is not even theoretically coherent, is it responsible for innovators, even this early-on, to keep promoting it as if it were? Miranda Fricker argues of an injustice that is distinctly epistemic though it was born out of societal discrimination, identity power, and racial prejudice. More so, Fricker attempts to establish a theoretical space, where ethics, epistemology, and socio-politics can converge. An epistemology which concerns knowledge not for knowledge’s sake alone, but the kind of knowledge that can morally awaken a knowing subject and which can hopefully influence or bring forth a collective social and political change. I will further argue in (...) this paper that aside from moral awakening, the theory of epistemic injustice also attempts to correct our moral appropriations towards social phenomena as it aims to provide an unbiased epistemic basis on issues of social identities, namely: gender, race, religion, financial, economic, and social status, rank or position in work and institutions, among other factors. Epistemic injustice is a hybrid social theory that presupposes social ethical responsibility and epistemic justice among individuals, as well as in social institutions. It initially arose as part of the developments in virtue epistemology, a new trend in epistemology that emphasizes the role of virtue in knowledge, which sprung from the epistemic debates in virtue epistemology of the Anglo-American analytic philosophers. Epistemic injustice finds its own development of the theory now known as vice epistemology, which have special emphasis on non-virtuous acts, namely—vices. This paper is fundamentally aimed to introduce Miranda Fricker’s concept of “epistemic injustice,” including its possible indications within Philippine societal happenings. I then attempt to appropriate the phenomena of epistemic injustice as theorized by Fricker in the context of the Filipino social experience. This essay attempts to tackle the gaps between the apparent disparity in Philippine societies, particularly on issues that concerned the imperial Manila, the Bangsamoro, and other marginalized minorities, such as, transgender people, farmers, and fisher folks, as well as issues regarding the national language. In Authority and Estrangement, Richard Moran provides a fascinating account of how we know what we believe that he calls the “transparency account.” This account relies on the transparency relation between the question of whether we believe that p and the question of whether p is true. That is, we can consider the former by considering the grounds for the latter. But Moran’s account has been criticized by David Finkelstein, who argues that it fails to explain how we know our (...) attitudes and emotions more generally. The aim of this paper is to show how Moran’s transparency account can be extended to meet this criticism by modifying it, using insights from Davidson’s view on attitudes and emotions. (shrink)

This paper sets out to interpret the phrase ‘the city landscape’. Beginning with landscape aesthetics based on two categories — the picturesque and the sublime — the author attempts todemonstrate that a city can be interpreted in terms of a cultural landscape. This necessitates a re‑interpretation of the category of the sublime, whereby, through references to Edmund Burke, Theodor W. Adorno and Arnold Berleant, the sublime assumes the nature of a category which determines the existential situation of a person (...) in the world. Here, the sublime provides people with an impulse to undertake efforts to fashion their surroundings and forge the essence of the living world. As such, the sublime also becomes a category that promotes social activities aimed at improving the quality of life in a city, such as the activities of ‘urban gardeners’. (shrink)

Garrett Cullity concedes that saving a drowning child from a shallow pond at little cost to oneself is not actually analogous to giving money to a poverty relief organization like Oxfam. The question then arises whether this objection is fatal to Peters Singer's argument for a duty of assistance or whether it can be saved anyway. Cullity argues that not saving the drowning child and not giving money to organizations like Oxfam are still morally analogous, that is, not giving money (...) to organizations like Oxfam is morally nearly as bad as letting the child drown. I argue that Cullity's two arguments for this conclusion, an argument from "transitivity" and an argument from collective responsibility, fail. (shrink)

Today, the expression "media" firmly retains a broad language function both in professional and public discourse, the essence of which is a signification of the auditory, visual, audiovisual and digital-electronic "press", including both the tools and agents. The term seems scientific from academic viewpoint and precise in public discourse. However, analogies drawn from some of its connotations, which can serve as a foundation to signify various media organisations, are adequate only for some segments of the semantic field of the term (...) and for the roles of various entities described as “media” in the context of mass communication studies. In this paper we shall make an attempt to clarify whether the general name "media" and the more specific "medium" adequately marks the complex institutional system and its individual members to which it is applied in mass communication studies. To this end, after outlining the semantic scope of the term, we will try to identify differences postulated essential in the structure and operation of the constituents of the institutional structure it marks. These differences, viewed through specific types and cases, can either corroborate its use or can necessitate a refinement or rejection of its application. (shrink)

J.G. Frazer tells us about a last resort technique which Cambodian hunters use when they have caught nothing in their nets. The “technique” is they act as if they themselves have got caught in the net. Frazer explains this as the consequence of magical thinking, but I propose a different explanation.

This paper means to demonstrate the theoretical-and- methodological potential of a particular pattern of thought about culture. Employing an end-means and absolute value plus concept of reality approach, the continuous model of culture aims to embrace from one holistic standpoint various concepts and debates of the modern human, social, and political sciences. The paper revisits the debates of fact versus value, nature versus culture, culture versus structure, agency versus structure, and economics versus politics and offers the concepts of the rule (...) of law, state capitalism, a dialectical model of progress, and interpretative qualitative research, as well as of cultural diffusion, autonomy, alienation, and individuality. This model distinguishes between the ideal-symbolical and the instrumental functions of culture, sees culture as being sewn from universal binaries, and provides a certain understanding of the cognitive function of a value judgment, with positivism so far vague about the topic. It, too, suggests an extra method for investigating culture : the comparative literature study of culture enables social science to view literature as its potential in-depth interviewee— a case for arguing for a certain conception of interdisciplinarity as well. In addition, it predicts that cultural particularism or individuality remains an essential factor of human existence. Analyzing the issue of Eurocentrism in social science, the model finds modernity ’s concept of reality to be involved in ” methodological ” intellectualistic reductionism, characterizing it since the empiricism/ rationalism origination. Systematically confusing the universal oppositions in a Eurocentric manner, intellectualism becomes a contributing factor in unfolding post- modernity. (shrink)
