abstract The moral value of distributive equality constitutes one of the most contentious debates in political philosophy. Following Frankfurt, many philosophers have claimed that the intuitive appeal of equality is illusory and that egalitarian intuitions are fundamentally intuitions about the importance of satisfying basic needs. According to this argument, our intuitions tell us that inequality ceases to matter once a certain threshold has been reached. Despite the widespread appeal to intuitions regarding this issue, few empirical studies have tried to assess (...) whether Frankfurt and his followers are right in claiming the lack of intuitiveness of equality per se. In a series of three experiments, we show that experimental evidence does not allow us to settle the intuitiveness of each theory: laypeople are divided in the consideration of the respective importance of needs and equality. While our results do show that laypeople attach special importance to needs‐fulfilment, it also seems that they are divided when it comes to the importance they grant to equality once needs are fulfilled. No theory is unanimously backed by participants, and it seems that, fundamentally, divisions among philosophers reflect deep divisions among people. (shrink)

This paper tries to understand how three medieval philosophers (Roger Bacon, Albert the Great and John Buridan) developed the idea of a special logic for ethics, taking into account Aristotle's thesis according to which ethics does not need theoretical syllogisms and uses a special kind of scientific reasoning. If rhetoric is a good candidate, we find three different readings of this approach and then three different theories of ethical reasoning.

The purpose of this paper is to show how the phenomenology of the body developed in his late writings by the Czech philosopher Jan Patočka can be seen as the final stage of the archaeology of the Lebenswelt developed by Edmund Husserl and reshaped by Martin Heidegger. According to this exegetical and philosophical hypothesis, only a phenomenology of the body can be a serious attempt to resolve the conflict between the so-called “manifest” and “scientific” images of the world, in which (...) the concept of Lebenswelt is rooted. The peculiarity of Jan Patočka’s phenomenology of the body is to stress the strong connection between the notion of sense, the affective dimension of human experience and the necessity of taking into consideration a “bodily” point of view on the experience. Ernst Mach, le célèbre physicien autrichien, est principalement connu en épistémologie et en philosophie de la psychologie pour avoir été l’auteur d’une théorie de l’expérience sensible qui le positionna, aux côtés de William James, comme l’un des représentants de ce courant philosophique connu sous le nom de « monisme neutre ». L’un des développements les plus fructueux de cette théorie de l’expérience semble avoir été la psychologie de la forme, tant dans la version qu’en a livrée l’École de Graz que (...) l’École de Berlin. Or, le concept de Gestalt est en contradiction fagrante avec la théorie moniste défendue par Mach. Si, comme il le soutient, l’expérience est reconductible à une série d’éléments, et à eux seuls, elle ne peut alors ni supporter unmode de structuration interne, qui présiderait à l’organisation de l’ensemble articulé de ses parties élémentaires, ni manifester, comme en supplément d’elle-même, un élément qui viendrait se surajouter aux éléments sensibles qui la constituent. Toute psychologie de la forme est dualiste dans son principe car elle présuppose que l’expérience ne se sufft pas d’une seule catégorie de constituants sensibles. Ce paradoxe doctrinal relevé, quel statut est-il dès lors permis d’accorder à la théorie de l’expérience élaborée par Mach dans la généalogie de la Gestaltpsychologie ? -/- Mon intention dans cette étude est de défendre la thèse que, loin de s’exclure, le projet d’une analyse des sensations et la notion de Gestalt se complètent dans la théorie de l’expérience développée par Mach. Je soutiendrai l’idée que l’on retrouve chez Mach une conception de l’expérience sensible selon laquelle la perception s’oriente dans le fux des sensations grâce à un processus de reconnaissance d’entités « unes et indivisibles », que l’on pourrait considérer comme des entités de nature fgurale. Selon cette ligne interprétative, la notion de Gestalt constitue l’un des développements nécessaires de la théorie des sensations proposée par Mach. Mais nous verrons cependant en quoi l’approche de Mach se distingue des approches canoniques du concept de Gestalt. (shrink)

Dans cette étude, nous nous proposons d’appliquer à la sphère phénoménale la thèse conceptualiste selon laquelle le contenu d’un acte de perception est intégralement réductible à un contenu conceptuel. Il s’agit de défendre l’idée que les qualités phénoménales — les qualia — sont elles aussi justiciables, à l’instar de l’ensemble de ce qui compose le contenu de l’expérience perceptive, d’une identification conceptuelle. Pour mener à bien notre projet, nous étendrons, au prix de quelques rectifications, la thèse conceptualiste initialement développée par (...) J. McDowell à la phénoménologie de la perception. Cela nous permettra d’établir un dialogue fructueux entre les débats actuels en philosophie de l’esprit et la (proto-)phénoménologie husserlienne. Contrary to what is generally said about the reception of Epicurus in the Middle Ages, many medieval authors agreed on his great wisdom, even if he made some philosophical and theological errors. From the 12th century to the 14th century on can find several "Lives of Epicurus" in which the best sayings of Epicurus are gathered from ancient sources (Seneca, Cicero, Lactantius, etc.). In this paper, we follow these quite unknown sources about Epicureanism in the Middle Ages. We try to (...) show that if Epicurus was considered as a wise man in the MIddle Ages, Epicureans are condemned because after the Revelation of God's word, Christians can only accept Epicurus's ascetic ethics, not his errors about the eternity of the world, the mortality of the soul et the subordination of happiness to pleasure. While psychologists and political scientists have long investigated issues of interest to philosophers, the development of political experimental philosophy has remained limited. This slow progress is surprising, given that political philosophers commonly acknowledge the relevance of empirical data for normative theorizing. In this chapter, we illustrate the importance of empirical data by outlining recent developments in three domains related to theories of justice, where empirical results reinforce or endanger popular philosophical theories. Our first showcase concerns the boundaries of the concept (...) of fairness. While both libertarian thinkers and social egalitarians have united in rejecting the concept of natural injustice, we show that people do consider that unpreventable natural inequalities can be described as unfair. Second, we take the example of impartiality devices, such as the veil of ignorance or the idea of an impartial spectator, to show that such devices are efficient at shifting people’s intuitions in a more impartial manner. Third, we review empirical data on fairness intuitions to show that people conform to a pluralist theory of justice, valuing desert, needs-satisfaction, and equality at the same time. However, distribution according to desert enjoys a privileged position: people mostly care for the satisfaction of basic needs of deserving recipients, and people are willing to tolerate large inequalities in meritocratic contexts. The centrality of desert leads to dilemmas for mainstream egalitarian theorists, as theories that do not recognize the value of desert could fail to find support or legitimacy within the population. In his commentary on Aristotle’s Physics, Nicole Oresme raises a question that he is apparently the first to ask in these terms, in such a context: do all beings have the desire to persevere into being? Before him, this question is not found in any of the medieval commentaries on Aristotle’s Physics. But after him it became canonical until at least the 16th century, since it can be found in Pietro Pomponazzi’s works for example. The novelty here consists in questioning (...) the validity of Averroes’ thesis, in his own commentary on the Physics, according to which all beings have the desire to persist into being, using the Augustinian analysis of voluntary death and suicide. How can we explain that one can freely put an end to his days if he is naturally inclined by a desire for life and even for eternity? Oresme’s solution consists in justifying not only the possibility, but also the moral obligation to accept death under certain conditions. In most cases, we do not really want to die. The desperate man wishes to cancel his misfortune and the heroic man who sacrifices himself for his country wishes to immortalize himself in the memory of other men. From a moral point of view, Nicole Oresme justifies only one case of voluntary death: that of individual sacrifice for the common good. The aim of this paper is to analyze precisely this important turning point in the long history of the notion of conatus in the West by comparing this quaestio from the commentary on the Physics with the glosses that accompany the French translation of the Nicomachean Ethics realised by Oresme at the court of Charles V. The fact that our asking God to do something can make a difference to what he does underwrites the point of petitionary prayer. Here, however, a puzzle arises: Either doing what we ask is the best God can do or it is not. If it is, then our asking won’t make any difference to whether he does it. Hunger strikes are commonly repressed in prison and seen as disruptive, coercive, and violent. Hunger strikers and their advocates insist that incarcerated persons have a right to hunger strike, which protects them against repression and force-feeding. Physicians and medical ethicists generally ground this right in the right to refuse medical treatment; lawyers and legal scholars derive it from incarcerated persons’ free speech rights. Neither account adequately grounds the right to hunger strike because both misrepresent the hunger strike as noncoercive and (...) nonviolent. I articulate an alternative, dual account of the right to hunger strike. On the remedial argument, the right to hunger strike should be legally protected as a right to petition for redress, in light of incarcerated people’s structural vulnerability to abuse and given inadequate grievance mechanisms. The constructive argument derives the right to hunger strike from the right to resist oppression and stresses the normative permissibility of the use of coercive tactics to defend one’s liberty interests in the face of carceral oppression. -/- . Unlike Derrida’s ‘there is no outside text, Lacan approaches the Real, that which lies beyond language, from two sides: the imaginary and the symbolic. In the first part of this work, by drawing upon the imaginary side of Lacanian Real, which is object petit a and by considering some literary and philosophical definitions of the pre-symbolic abyss, it is attempted to illustrate the non-representation artworks’ illustration of the pre-linguistic bodily urges and sensations. Next, by drawing upon symbolic side of (...) the Lacanian Real, which is sinthome, it will be shown how some artists create their own symbolic order and the New by approximating a point of idiomaticty just like what Lacan did with his mathemes. In the second part of the paper, Joe Weight’s Darkest Hour (2017) is analyzed to show how Winston Churchill first turns into an object petit a, and plugs the gap of the symbolic order by being elected as a prime minister; however, the impending fall of England by Nazi attacks strip Churchill of his self-confidence, then he resorts to people and by their hands, he rewrites himself anew turning himself into a sinthome and like Joyce and Lacan, who have created their own symbolic order, Churchill temporarily turns England into his own symbolic order to win the war. The United States Fish and Wildlife Service in Alaska, USA, conducted a species status assessment for a petition to list the Alexander Archipelago wolf (Canis lupus ligoni) under the Endangered Species Act in 2020-2022. This federal undertaking could not be adequately prepared without including the knowledge of Indigenous People who have a deep cultural connection with the subspecies. Our objective is to communicate the authoritative expertise and voice of the Indigenous People who partnered on the project by demonstrating how their (...) knowledge contributed to the species status assessment. The Indigenous knowledge applied in the assessment is the cultural and intellectual property of those who have shared it. We employed rapid appraisal research to expeditiously develop a preliminary and qualitative understanding of Indigenous People's cultural and ecological knowledge of Alexander Archipelago wolves. We used semi-directed interviewing and inductive coding from grounded theory for text analysis. Indigenous knowledge contributed to the agency's understanding of the Alexander Archipelago wolf in Southeast Alaska and helped the agency with their classification decision. Indigenous research partners explained the rich cultural significance and position of wolves in Tlingit society and described human–wolf relationships and ecological interactions. The agency used a single-species assessment approach based in species ecology and conservation biology, whereas the Indigenous wolf experts applied a multi-species, community ecology approach based in a sociocultural context of balance and respect. The Indigenous wolf experts successfully addressed knowledge gaps identified by the agency. The partners were challenged by a short regulatory timeframe that did not allow for comprehensive study of Indigenous knowledge and constrained review and feedback by Indigenous experts. The United States Fish and Wildlife Service learned that its assessment framework was not designed to account for an Indigenous worldview. To level the playing field, the agency and Indigenous experts should discuss how to co-develop an assessment framework that equitably applies both perspectives. (shrink)

The coronavirus disease 2019 (COVID-19) crisis ought to serve as a reminder about the costs of failure to consider another long-term risk, climate change. For this reason, it is imperative to consider the merits of policies that may help to limit climate damages. This essay rebuts three common objections to carbon taxes: (1) that they do not change behaviour, (2) that they generate unfair burdens and increase inequality, and (3) that fundamental, systemic change is needed instead of carbon taxes. The (...) responses are (1) that there is both theoretical and empirical reason to think that carbon taxes do change behaviour, with larger taxes changing it to a greater extent; (2) that undistributed carbon taxes are regressive but distributing the tax receipts can alleviate that regressivity (and, in many cases, make the overall effect progressive); and (3) that while small changes for increasing democratic decision-making may be helpful, (fundamental) change takes time and the climate crisis requires urgent action. The aim of this article is to present Paul Natorp’s position in the debate over the allocation of chairs in philosophy to experimental psychology. Natorp triggered the public controversy within psychology when an experimental psychologist, Eric Jaensch, was awarded the chair of Hermann Cohen in 1912. Natorp published an editorial in the «Frankfurter Zeitung» and in the following year, 1913, submitted a petition for the establishment of new chairs for experimental psychology in Germany. In this way, Natorp hoped to prevent (...) the abolition of “pure” philosophy from German universities. When the controversy began, Natorp wrote another essay, Philosophie und Psychologie. Natorp’s article aimed to clarify the logical domains of philosophy and psychology and to present his philosophical psychology as a solution to their conceptual overlap. Natorp’s article is also important for Natorpforschung because it was the last time that Natorp discussed his psychological point of view, only to apparently abandon his project of a philosophical psychology. Solar radiation management (SRM) may help to reduce the negative outcomes of climate change by minimising or reversing global warming. However, many express the worry that SRM may pose a moral hazard, i.e., that information about SRM may lead to a reduction in climate change mitigation efforts. In this paper, we report a large-scale preregistered, money-incentivised, online experiment with a representative US sample (N = 2284). We compare actual behaviour (donations to climate change charities and clicks on climate change petition (...) links) as well as stated preferences (support for a carbon tax and self-reported intentions to reduce emissions) between participants who receive information about SRM with two control groups (a salience control that includes information about climate change generally and a content control that includes information about a different topic). Behavioural choices are made with an earned real-money endowment, and stated preference responses are incentivised via the Bayesian Truth Serum. We fail to find a significant impact of receiving information about SRM and, based on equivalence tests, we provide evidence in favour of the absence of a meaningfully large effect. Our results thus provide evidence for the claim that there is no detectable moral hazard with respect to SRM. [Open access]. (shrink)

What responsibilities do audiences have in engaging with artworks? Certain audience responses seem quite clear: for example, audiences should not vandalize or destroy artworks; they should not disrupt performances. This paper examines other kinds of resisting responses that audiences sometimes engage in, including petitioning the artist to change their works, altering copies of artworks, and creating new artworks in another artist’s fictional world. I argue for five claims: (1) while these actions can sometimes infringe on the rights of artists, the (...) rights of artists are not absolute; (2) the fact that such actions are based on mistaken interpretations of the artworks has no normative weight; (3) there can be reason to object to additions and alterations whose conception of the artwork is morally worse than the original (and so, there can be reason to support additions and alterations whose conception is morally better); (4) petitioning raises special moral problems; and, most important, (5) some of these actions are valuable because they involve creative and aesthetic activity. Those acts of audience resistance that are creative, morally improve on the original work, and that minimize the infringement of the artists’ rights are good, and should be encouraged. (shrink)

Cet article analyse le risque de corruption que les arrêts Citizens United de 2010 et l’apparition des Super-PACs font peser sur le système électoral états-unien. Lors de la dernière campagne présidentielle, plus de 730 millions de dollars ont été investis dans des publicités électorales par de riches contributeurs et des entreprises privées regroupés en Super-PACs. Nous montrons que cet afflux d’argent consacré à des publicités politiques expose la démocratie américaine à trois formes de « corruption grise », en favorisant la (...) banalisation de pratiques contestables et en troublant la frontière entre ce qui est licite et ce qui ne l’est pas. (1) Déplafonné, le soutien financier aux candidats risque de s’apparenter à de la subornation; (2) certaines des techniques publicitaires employées semblent réduire l’exercice de conviction démocratique à une tentative de corruption de l’électeur; (3) enfin les immenses inégalités d’influence politique que ce système de financement induit participent de la corruption des affaires démocratiques en favorisant leur captation par un petit nombre d’individus fortunés. Nous mettons en évidence que le refus systématique de la Cour Suprême d’envisager ces phénomènes comme des vecteurs de corruption se fonde sur une conception discutable de la démocratie comme système de libre concurrence pour le pouvoir politique. Comprendre la démocratie à partir de son impératif d’égalité permet à l’inverse de rendre visible la corruption à laquelle son système de financement électoral expose la démocratie américaine. In December 2013, the Nonhuman Rights Project (NhRP) filed a petition for a common law writ of habeas corpus in the New York State Supreme Court on behalf of Tommy, a chimpanzee living alone in a cage in a shed in rural New York (Barlow, 2017). Under animal welfare laws, Tommy’s owners, the Laverys, were doing nothing illegal by keeping him in those conditions. Nonetheless, the NhRP argued that given the cognitive, social, and emotional capacities of chimpanzees, Tommy’s confinement constituted (...) a profound wrong that demanded remedy by the courts. Soon thereafter, the NhRP filed habeas corpus petitions on behalf of Kiko, another chimpanzee housed alone in Niagara Falls, and Hercules and Leo, two chimpanzees held in research facilities at Stony Brook University. Thus began the legal struggle to move these chimpanzees from captivity to a sanctuary, an effort that has led the NhRP to argue in multiple courts before multiple judges. The central point of contention has been whether Tommy, Kiko, Hercules, and Leo have legal rights. To date, no judge has been willing to issue a writ of habeas corpus on their behalf. Such a ruling would mean that these chimpanzees have rights that confinement might violate. Instead, the judges have argued that chimpanzees cannot be bearers of legal rights because they are not, and cannot be persons. Les citoyens manquant pour la plupart de sagesse ou de compétence, le bien commun serait mieux assuré en confiant le pouvoir à un individu éclairé ou à une élite experte. Une réponse commune à cette objection concède la prémisse mais affirme la priorité au gouvernement par le peuple sur le gouvernement pour le peuple : le (...) droit égal à la participation devrait l’emporter sur la promotion de la compétence, même si celle-ci est requise par le bon gouvernement. La démocratie se trouve alors réduite à un ensemble de procédures équitables, traitant les citoyens en égaux ; elle ne se définit plus par la poursuite du bien commun. Il est toutefois une autre réponse à l’objection, qui évite cette dérive vers un procéduralisme étroit. Elle consiste à nier la prémisse et à affirmer la sagesse politique du peuple. Il n’est pas vrai que le gouvernement pour le peuple serait mieux assuré en confiant le pouvoir à un petit nombre de sages ou d’experts, fussent-ils les meilleurs parmi les citoyens. Hannah Arendt argued that refugees pose a major problem for liberalism. Most liberal theorists endorse the idea of human rights. At the same time, liberalism takes the existence of sovereign states for granted. When large numbers of people petition a liberal state for asylum, Arendt argued, these two commitments will come into conflict. An unwavering respect for human rights would mean that no refugee is ever turned away. Being sovereign, however, allows states to control their borders. States supposedly committed to (...) human rights will thus often violate the rights of refugees by denying them entry. I attempt to defend liberalism from Arendt’s criticism by outlining a rights-based model of asylum that is enforceable by sovereign states. This approach avoids the question of what border-enforcement measures, if any, are defensible at the level of ideal justice, and instead seeks to outline a framework of refugee rights that can be realized in a world in which migration controls are a fact of life. Central to my argument is a distinction between the place where a person is recognized as a rights-bearing agent and the potentially different place where he or she exercises those rights. (shrink)

Broadening access to both computational and educational resources is crit- ical to diffusing machine learning (ML) innovation. However, today, most ML resources and experts are siloed in a few countries and organizations. In this article, we describe our pedagogical approach to increasing access to applied ML through a massive open online course (MOOC) on Tiny Machine Learning (TinyML). We suggest that TinyML, applied ML on resource-constrained embedded devices, is an attractive means to widen access because TinyML leverages low-cost and globally (...) accessible hardware and encourages the development of complete, self-contained applications, from data collection to deployment. To this end, a collaboration between academia and industry produced a four part MOOC that provides application-oriented instruction on how to develop solutions using TinyML. The series is openly available on the edX MOOC platform, has no prerequisites beyond basic programming, and is designed for global learners from a variety of backgrounds. It introduces real-world applications, ML algorithms, data-set engineering, and the ethi- cal considerations of these technologies through hands-on programming and deployment of TinyML applications in both the cloud and on their own microcontrollers. To facili- tate continued learning, community building, and collaboration beyond the courses, we launched a standalone website, a forum, a chat, and an optional course-project com- petition. We also open-sourced the course materials, hoping they will inspire the next generation of ML practitioners and educators and further broaden access to cutting-edge ML technologies. (shrink)

This chapter develops an account of epistemic nihilism—roughly, the rejection of truth’s intrinsic or instrumental value in favor of statements that reject or obscure truth to secure an advantage for the speaker—by examining three instances of such nihilism: lying, bullshit, and trolling. It further argues that epistemic nihilism, exacerbated by changes in the media landscape, can pose a significant threat to liberal democratic institutions and ideals by undermining the democratic ideal of good faith engagement on a level playing field, while (...) also encouraging undemocratic actions (e.g., terrorism) among interlocutors who take the nihilist’s claims seriously. Finally, this chapter argues that in extreme cases, we are justified in denying epistemic nihilists a platform from which to speak by drawing a parallel with vexatious litigant laws that deny individuals the right to petition courts for redress on the grounds that abuse of that right results in significant harm to both individuals and the legal system itself. Hence, I will use the term Technopoly when I am referring to Postman; the term Technopolis is my own. -/- In his book From Faith to Fun: The Secularisation of Humour, Russel Heddendorf argues that humour is a technology (Heddendorf 2009: 32-34), as it is understood and theorized by Neil Postman in Technopoly. Russel Heddendorf also argues that “Technopoly” is a term correlated with Wittgenstein’s use of the term “worldview” (Weltanschauung) (Heddendorf 2009: 11). -/- I would like to draw on these thoughts to propose that Technopoly (or Technopolis) could be the secularized Kingdom of God, namely that Technology is the Religion of the 21st century, and that Fun is a paradigm of such a Technology / Technique. God is yet another technique or Technology of and in Technopoly. -/- The godless individual in the 21st century, I will argue, is as much a believer as the faithful in the Sacred Religion (term used in opposition to Secular or rather Technological or Technologized Religion, which is Fun). He believes in Fun (as a post-modern form of pleasure), as much as the believer believes, or more accurately, believed in God. In the 21st century, the faithful in Sacred Religion believes in a fun God, as opposed to the serious God of the past. Fun is turning into the Technologized Religion for all; for the faithful in Godly / Sacred Religion, as well for as the unfaithful. Fun (pleasure, humour) is the definitive qualia of 21st century pleasure. The mechanics of Fun make it absolutely functional for controlling people; as Aldous Huxley wrote in Brave New World, people “are controlled by inflicting pleasure” (cited in Heddendorf 2009: 158). Now, indulging in pleasure is having Fun. In the 21st century, nobody is unfaithful, nobody disputes God, because God has been manufactured into Fun. We are living in the most religious century of all. -/- The commodity of God, now inextricably blended into work and leisure ethics and culture, is as unavoidable as survival. You don’t work, you don’t survive, you don’t exist. You work, you are entitled to leisure, or free time – the time (“busy-time”) when you are busy is work. The free time of leisure (“fun-time”) is a time for fun (pleasure). The time dedicated to Fun is culturally (capitalistically) pre-defined; no moment is actually free, each moment that is sold as free is to be bought with Work Time tokens –which is money. Believe is Enjoy. Happiness, achieved through pleasure, and pleasure through Fun, and Life as Play, is the recipe for Teleology in the 21st century. -/- The Technological God (Fun), as the Sacred God before him, is sovereignty’s technique or a social “mode of release”: demonstrations, marches, petitions, freedom of speech, citizen and human rights vindications, are “modes of release”, so that the next day, feeling relieved and released that you are working for a better life and a better world, you can wake up cheerfully to walk to your workplace, feeling it will change because of your marching, or your petition, or your speech, or the mass you attended, or the prayer you said yesterday. Thus life continues unchanging, through postponing hope; the tension of the tragedy is always released (lysis) in catharsis: refreshment for the next day of work. Art, especially cinema, (namely, simulated life) follows the same cathartic principles as real life. Thus, you can keep coping, and hoping in the meantime is of much help. Religion, Art, Science, Therapy, and Technology are all technologies used to market life, sell it or lend it, and humans are buying it back. Fun is free to produce, and expensive to buy. (shrink)

The paper presents a critical evaluation of the existing anthologies of Romanian oratory and analyzes the pertinence of a new research line: how to trace back the foundations of Romanian versatile political memory, both from a lexical and from an ideological point of view. As I argue in the first part of the paper, collecting and editing the great speeches of Romanian orators seems crucial for today’s understanding of politics (politicians’ speaking/ actions as well as voters’ behavior/ electoral habits). In (...) the second part, I focus on the particularities generated by a dramatic change of media support (in the context of Romania’s high rates of illiteracy at the end of the 19th century): from “writing” information on the slippery surface of memory (declaimed political texts such as “proclamations,” “petitions,” and “appeals”) to “writing” as such (transcribed political speeches). The last part of the paper problematizes the making of a new canon of Romanian eloquence as well as the opportunity of a new assemblage of oratorical texts, illustrative for the 19th century politics, and endeavors to settle a series of virtual editing principles. (Conference proceedings 2014) This presentation (International Development Ethics Association, July 2014) considers economic vulnerability, exploring the risk of deprivation of necessary resources due to a complex and rarely discussed vulnerability that arises from hope. Pierre Bourdieu’s sociological account of French petit-bourgeois aspiration in The Social Structures of the Economy has recently inspired Wendy Olsen to introduce the term “aspiration paradox” to characterize cases wherein “a borrower's status aspirations may contribute to a situation in which their borrowings exceed their capacity (...) to repay,” leaving the individual much the worse, due to an aspiration to betterment. If such financial opportunities were not made available to these people – if some were denied loans due to a careful assessment of their vulnerability – would they be better off? We should seriously consider that they might be. I will hazard the straightforwardly paternalistic suggestion that limiting access to lending to those who are vulnerable to their aspirations can be a just policy. Because aspiration paradox is a cross-cultural phenomenon, and because lending frequently involves asymmetries in mathematical education between borrowers and lenders, I hope to elude at least some of the charges of colonialism that have gained a stronger purchase on adaptive preference arguments. Why did the white working classes in the United States and elsewhere turn to the far right instead of uniting with the raced and gendered working class to overthrow capitalism? In this paper, I bring core concepts coined by Karl Marx in conversation with Jacques Lacan to show how the far-right exploited desires and fears around subjects' fundamental non-wholeness, which the insecurities of neo-liberal capitalism have heightened, for its political gain. I explain how the far-right offered its followers several unconscious (...) fantasy objects petit a to cover over subjects' non-wholeness: first, the money fetish, which is also at the center of the American Dream, serves to secure the illusion of wholeness on earth; second, religion offers the illusion of wholeness in the sky, producing subjects who endure rather than rebel against their suffering on earth. Finally, it brands the sexed and raced working classes as inferior to uphold the illusion of the white working-class subjects as superior and whole, which further undermines the creation of a revolutionary proletariat. In its January 20th, 2010 decision in Citizens United vs. Federal Election Commission, the United States Supreme Court ruled that certain restrictions on independent expenditures by corporations for political advocacy violate the First Amendment of the Constitution, which provides that “Congress shall make no law […] abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances.” Justice Kennedy, writing for the 5-4 majority, (...) held that “[b]y suppressing the speech of manifold corporations, both for-profit and non-profit, the Government prevents their voices and view-points from reaching the public and advising voters on which person or entities are hostile to their interests” (Citizens United vs. Federal Election Commission 558 U.S. 38-9 (2010); emphasis added). Much of the language of the opinion, and some of its reasoning, as this passage illustrates, presupposes that corporations are agents capable of speech, and that it is (at least in part) in the light of this that limitations on political advocacy by corporations are prohibited by the Constitution. -/- While there are other strands in the argument, they are interwoven with the conception of the corporation as agent and speaker, with its voice and its viewpoints. The dissenters on the court objected on precisely this point (among others). Justice Stevens wrote sarcastically in his dissent, joined by Justices Ginsburg, Breyer, and Sotomayor, that “[u]nder the majority’s view, I suppose it may be a First Amendment problem that corporations are not permitted to vote, given that voting is, among other things, a form of speech” (558 U.S. 33 (2010)). Justice Sotomayor suggested in oral argument that the Court’s century-old practice of treating corporations as persons rests on a conceptual mistake. -/- My concern in this essay is not with the question whether the restrictions violate the Constitution. There are many issues that bear on this which will be outside the scope of my discussion. My concern is with the proper conceptual framework for understanding the agency of corporations and corporate speech, and the role that conceptions of these play in the background of the majority’s reasoning. The issue is legal, but it also has philosophical, conceptual and semantic aspects. It will be the latter aspects, and their potential to shed light on legal reasoning, that are my main focus. An adequate framework requires saying what properly speaking the corporation is, how agency is expressed through the corporation, whose agency it is, centrally whether the corporation is an agent or person in its own right, and in what sense it can be said to be capable of speech. I draw on recent work in collective action theory, particularly with respect to the semantics of collective action sentences (Ludwig 2007) and the analysis of the proxy agency in collective action (Ludwig 2014), to show (i) that corporations are neither genuine agents nor (therefore) capable of engaging in genuine speech, (ii) that consequently the First Amendment does not apply to corporations per se, and (iii) that a better understanding of the mechanisms of corporate agency casts doubt on more indirect arguments for extending the First Amendment to “corporate speech” as well. Dans notre article sur « L’Epistémologie des vertus. Analyse des vertus épistémiques de Linda Zagzebski », nous ciblons les arguments principaux qui caractérisent l’approche d’Epistémologie des vertus de Linda Zagzebski. Son épistémologie des vertus part de l’éthique de la vertu, fidèle à la notion aristotélicienne de la vertu. Son développement sur les vertus épistémiques se dégage de l’analyse de la notion même de vertu. Le concept d’ordre moral et/ou éthique, regorge en son sein, à travers ses cinq traits définitionnels, une (...) catégorie appelée à favoriser l’acquisition de la connaissance. C’est pour autant dire que la connaissance fait appel à un autre type de vertus ; il s’agit des vertus épistémiques ou cognitives ou encore intellectuelles. Elles font partie des vertus morales tout en se distinguant d’elles un tout petit peu. Au cœur de cette réflexion réside la préoccupation de savoir quel est l’élément déclencheur de ce sous-ensemble de vertus. Si les vertus morales naissent de l’attrait pour le bien, les vertus épistémiques naissent de la motivation pour la connaissance, c’est-à-dire visant le contact cognitif avec la réalité. La vertu de l’originalité intellectuelle ou l’inventivité se connecte non pas à la recherche du bien moral classique, mais à l’obtention de la connaissance, mieux à la motivation pour accroître la connaissance de l’espèce humaine. Deux composantes sont dans ce sens plus importantes pour parler des vertus épistémiques chez Linda Zagzebski : la motivation pour la connaissance et la réussite fiables. Sur ce, on parle de vertu épistémique, cognitive ou intellectuelle que lorsqu’il y a à la fois la motivation pour la connaissance et la réussite dans le processus d’acquisition de cette connaissance. C’est pour autant dire que seule la motivation pour la connaissance ne suffit pas, il faut une réussite ou atteinte de l’objectif poursuivi. (shrink)

Comme de nombreux penseurs antiques avant et après eux et contrairement à Socrate, Calliclès et Diogène ont déclaré avoir fondé leur éthique sur l’observation de la nature. Et pourtant, les deux discours normatifs qui sont tirés d’une nature que l’on pourrait a priori croire être la même sont on ne peut plus opposés. Calliclès croit que l’homme est appelé à dominer autrui ; Diogène pense plutôt qu’il doit se dominer lui-même ; le premier est un hédoniste débridé, le second croit (...) que le bonheur ne s’achète qu’au prix du sacrifice des désirs artificiels. Comment expliquer cette dichotomie ? Nous empruntons deux routes explicatives. D’abord, nous montrons que pour Calliclès et Diogène, la notion de nature non seulement diffère, mais est observée sous un angle différent. La première est celle des tyrans et de dieux anthropomorphes, la seconde, celle de petits animaux et de dieux autarciques. La première concerne la relation des hommes entre eux ; la seconde, celle de l’homme avec lui-même. Ensuite, nous exposons la différence des présupposés normatifs qui précèdent ou accompagnent l’observation de la nature ; nous contrastons, pour ce faire, les formes d’anticonventionnalisme et d’anti-intellectualisme défendues par Calliclès et Diogène. -/- SUMMARY. Like many ancient thinkers before and after them and contra Socrates, Callicles and Diogenes said they based their ethics on the observation of nature. And yet, the two normative discourses that are derived from nature that we might a priori believe to be the same could not be more opposed. Callicles believes that people are called to dominate others, Diogenes rather thinks people must dominate themselves. The first is an unbridled hedonist, the second believes that happiness can be bought only at the price of sacrificing artificial desires. How to explain this dichotomy? We take two explanatory routes. First, we show that for Callicles and Diogenes, the notion of nature not only differs but is observed from a different angle. The first one is the nature of tyrants and anthropomorphic gods, the second that of small animals and autarkic gods. The first focuses on the relationship between people, the second focuses on the relationship of a person with themselves. Secondly, we expose the difference in normative assumptions that precede or accompany the observation of nature; in order to do so, we contrast anticonventionalism and anti-intellectualism forms proper to both Callicles and Diogenes. Il est courant de diviser le champ d’investigation de l’éthique entre trois sous- domaines : la méta-éthique, l’éthique normative et l’éthique appliquée. L’éthique appliquée est le domaine le plus concret : on y traite par exemple des questions de savoir s’il faut autoriser l’avortement, l’euthanasie, la peine de mort... L’éthique normative traite de ces questions à un niveau plus abstrait : elle se demande ce qui fait qu’une action ou un type d’action est moralement bonne ou mauvaise. La relation entre (...) l’éthique normative et l’éthique appliquée est un peu comme la relation entre la science pure, comme la physique, et l’ingénierie (Timmons : 17). Le domaine le plus abstrait de l’éthique est la méta-ethique : elle ne s’occupe par de la question de savoir ce qui fait qu’une action est bonne ou mauvaise (éthique normative) et encore moins de la question de savoir si le suicide est moralement bon ou mauvais. Elle s’intéresse à trois types de questions. Les premières sont métaphysiques : qu’est-ce qu’une valeur, qu’une norme (sont-ce des propriétés naturelles comme la masse, des propriétés non naturelles ? Des choses qui n’existent pas ?) ? Existe-t-il des valeurs objectives ? Les secondes sont épistémologiques : comment connaissons-nous les valeurs et les normes ? Par la raison ? L’intuition ? Les émotions ? Dans la mesure où la méta-éthique semble être le domaine le plus abstrait de l’éthique, la prudence pédagogique voudrait qu’on l’étudie en dernier : commencer par un cas concret, puis remonter petit à petit vers des questions plus abstraites. Pour des raisons qui vous apparaîtront j’espère au fur et à mesure, j’ai choisi de commencer néanmoins par des questions qui relève de la méta-éthique. Hobbes's place in the history of political philosophy is a highly controversial one. An international symposium held at Queen Mary, University of London in February 2009 was devoted to debating his significance and legacy. The event focussed on recent books on Hobbes by Quentin Skinner and Philip Pettit, and was organised around four commentaries on these new works by distinguished scholars. This paper is designed to introduce the subject of the symposium together with the commentaries and subsequent responses from (...) class='Hi'>Petit and Skinner. It examines the themes of language and liberty in the philosophy of Hobbes and concludes by highlighting some of the ways in which further research into Hobbes's debt to Aristotle's Politics will prove fruitful and illuminating. The reconciliation of high medieval philosophical theories and its praxis is expressed in this opus. The “oust Duterte” petition is a move not of an individual political being but rather of a political sphere upon which the individual is subjected to. The role of philosophy has always been subjected to the endeavor of continuously seeking the truth. The truth is categorized as logical and ontological, where it is hermeneutically subjected to the philosophical engagement proponents of ontology and logic, St. Anselm (...) of Canterbury, and St. Thomas Aquinas respectively. The highlight of this paper is explicating the inviolability of the ruler – constituent relationship under the interpretation of ontology and logic. The contribution of this opus is its pure philosophical engagement into a situation which is material, as such that the latter is viewed by its antecedent vis a vis the evolution of the philosophical theories presented as modalities. Human life in contemporary society is extremely complex and there are various external factors that directly affect the realization in the individual ends. In this work I analyze the effects of the global market economy, manifested by a mode of production and distribution of goods and services in the form of a global network of economic relations, which involve people, transnational corporations and political and social institutions in moral sphere of people, affecting their choices and the realization of these choices. (...) Individual freedom can be understand as a freedom to realize our choices in the environment of a global economic market, but it is still problematic in the sense that the choices of goods and services available in this market do not reflect individual choices, but a set of preferences standardized according to the market itself. In this paper I will reflect about the individual freedom in economic globalization pointing from the debate between Pettit and Berlin that social freedom advocated by Republican Petit can be satisfactory for a start. will give an overview of the fascinating communication between G. W. Leibniz and Pierre Bayle on pre-established harmony and sudden change in the soul which started from Bayle’s footnote H to the article “Rorarius” in his Dictionnaire historique et critique (1697) and ended in 1706 with Bayle’s death. I will compare the views presented in the communication to Leibniz’s reflections on the soul in his partly concurrent Nouveaux essais sur l’entendement humain (1704) and argue that many topics in the communication (...) with Bayle are discussed with more details in Nouveaux essais. I also argue that the communication helped Leibniz to respond to Locke’s views concerning uneasiness in An Essay Concerning Human Understanding, II, xxi. Bayle himself, however, was not able to completely understand Leibniz’s views on spontaneity as he was unaware of the contents of the Nouveaux essais, especially the systematic role of petites perceptions in Leibniz’s philosophy of mind. I will also reflect on whether the controversy could have ended in agreement if it would have continued longer. (shrink)
