El objetivo de este artículo es comprender la influencia de la gestión del conocimiento en el fortalecimiento de habilidades gerenciales. Se realizó una revisión bibliográfica de 35 autores, a partir de la cual se destacan 7 factores claves en común, en la implementación de modelos de gestión, como: información, aplicabilidad, construcción de conocimiento, trabajo colaborativo, cultura organizacional, transferencia del conocimiento y tecnología. Adicionalmente se identificaron habilidades gerenciales que se deben fortalecer, principalmente el liderazgo inspirador, pensamiento estratégico y comunicación. Este análisis (...) permitió concluir que, en la implementación de modelos de gestión del conocimiento, se desarrollaron procesos meta cognitivos, que involucran el desarrollo de habilidades gerenciales tanto a nivel técnico, como a nivel interpersonal, al igual que el desarrollo de estrategias orientadas al aprendizaje basado en problemas el cual fortalece las competencias directivas. A su vez se identificó la importancia de continuar investigando y definiendo estrategias de capitalización del conocimiento tácito, como ventaja competitiva en una organización. (shrink)

Recent studies demonstrate a moral self effect: continuity in moral values is crucial to ascriptions of identity in and over time. Since Locke, personal identity has been referred to as a ‘forensic’ concept, meaning that it plays a role in attributions of moral responsibility. If moral values are crucial to identity over time, then perceived changes in a person’s set of values may reduce responsibility for past deeds. To test this, we examined the moral self effect in parole contexts. In (...) this empirical article, we conducted two experiments, in which participants were significantly more likely to grant parole to agents who underwent a moral change as opposed to mere behavioral change. O debate fomentado nos anos oitenta entre liberais e “comunitaristas” tende a contrastar radicalmente as concepções teóricas de John Rawls e Charles Taylor, sendo o primeiro o representante principal da vertente liberal e o segundo do “comunitarismo”. Ao contrário do que sustenta essa distinção, neste artigo proponho ir para além dela, a fim de defender que há convergências dos autores no que tange à discussão sobre o pluralismo. Em um primeiro momento, apresento os diagnósticos de Rawls e de Taylor quanto (...) ao fato do pluralismo nas sociedades modernas como uma característica contextual irreversível (I). Em um segundo momento, diante da tensão ética insuperável entre divergentes concepções bem, a saída mais viável caminha para a justiça. Para tanto, desenvolvo a concepção de “justiça política” de Rawls em “O Liberalismo Político” e as publicações mais recentes de Charles Taylor como em “Secularism and Freedom of Conscience”, “A Secular Age” e “Why We Need a Radical Redefinition of Secularism?”, que parecem sustentar certa “virada liberal-rawlsiana” no pensamento do autor (II). Em um terceiro momento, efetuo uma distinção entre o fato do pluralismo (razoável) e o valor do pluralismo, para finalmente concluir o artigo argumentando que tanto Rawls como Taylor tendem a defender o pluralismo como um valor político para as instituições e não como um valor moral abrangente para os indivíduos. The boundary problem is related to the binding problem, part of a family of puzzles and phenomenal experiences that theories of consciousness (ToC) must either explain or eliminate. By comparison with the phenomenal binding problem, the boundary problem has received very little scholarly attention since first framed in detail by Rosengard in 1998, despite discussion by Chalmers in his widely cited 2016 work on the combination problem. However, any ToC that addresses the binding problem must also address the boundary problem. (...) The binding problem asks how a unified first person perspective (1PP) can bind experiences across multiple physically distinct activities, whether billions of individual neurons firing or some other underlying phenomenon. To a first approximation, the boundary problem asks why we experience hard boundaries around those unified 1PPs and why the boundaries operate at their apparent spatiotemporal scale. We review recent discussion of the boundary problem, identifying several promising avenues but none that yet address all aspects of the problem. We set out five specific boundary problems to aid precision in future efforts. We also examine electromagnetic (EM) field theories in detail, given their previous success with the binding problem, and introduce a feature with the necessary characteristics to address the boundary problem at a conceptual level. Topological segmentation can, in principle, create exactly the hard boundaries desired, enclosing holistic, frame-invariant units capable of effecting downward causality. The conclusion outlines a programme for testing this concept, describing how it might also differentiate between competing EM ToCs. (shrink)

According to a bits generation technique, that is, bits can only take a binary value of 0 in the absence of wave function collapse and 1 when wave function collapse occurs, that is, regardless of the value random in which the collapse of the wave function occurs that in the past caused the development of an alternative technique of classic bits to be renounced and remains currently an impossibility in normal science, through series of quantum entanglements, using BCD, EBCDIC or (...) ASCII coding standard in computing, data are teleported surpassing c, from a sender to a receiver, theoretically placed at any distance. This technique is a new discovery with theoretical foundation in the work “Superluminal Data Transmission supported by Quantum Entanglement” (1) by this author, stored, since April 2023, as a preprint, in the ResearchGate, and Philpapers repositories, and pending implementation by communications engineering in a longterm future. In this work it is unequivocally established that the maximum speed c for this type of transmission is false, causing critical break with Relativity. This new technique, unlike the one presented in my previous paper, it is a version much simpler that can be implemented according to the current state of technology, so at present the instantaneous transmission of information can be tested experimentally. Guido Löhr's recent article makes several insightful and productive suggestions about how to proceed with the empirical study of collective action. However, their critique of the conclusions drawn in Gomez-Lavin & Rachar (2022) is undermined by some issues with the interpretation of the debate and paper. This discussion article clears up those issues, presents new findings from experiments developed in response to Löhr's critiques, reflects on the role of experimental research in the development and refinement of philosophical theories, and (...) adds to Löhr's suggestions about the path forward. This paper uses the tools of experimental philosophy to examine the nature of interpersonal normativity in collective action, focusing on cases of immoral collective action and collective action by friends. The results of our two studies, which expand on recent empirical interventions into longstanding debates in social ontology, demonstrate that according to our everyday judgments there are interpersonal obligations in cases of collective action, even when immoral, and that, while friendship elicits judgments of togetherness, it does not affect the norms (...) of collective action. We also situate these results in the philosophical literature and discuss their consequences for a “pluralism” about sociality. (shrink)

Open peer commentary on the article “Constructivist Model Building: Empirical Examples From Mathematics Education” by Catherine Ulrich, Erik S. Tillema, Amy J. Hackenberg & Anderson Norton. Upshot: I argue that radical constructivism poses a series of deep methodological constraints on educational research. We focus on the work of Ulrich et al. to illustrate the practical implications of these constraints.

Some arguments against David Lewis’s modal realism seek to exploit apparent inconsistencies between it and anthropic reasoning. A recent argument, in particular, seeks to exploit an inconsistency between modal realism and typicality anthropic premises, premises common in the literature on physical multiverses, to the effect that observers who are like human observers in certain respects must be typical in the relevant multiverse. Here I argue that typicality premises are not applicable to the description of Lewis’s metaphysical multiverse, where the proportions (...) of metaphysically possible observers possessing the pertinent properties can be independently established by metaphysical reasoning. However, other kinds of reasonable anthropic premises can be seen to be consistent with and usable within modal realism. (shrink)

This paper examines a parallel between Aristotle’s account of phantasia and contemporary psychological models of working memory, a capacity that enables the temporary maintenance and manipulation of information used in many behaviors. These two capacities, though developed within two distinct scientific paradigms, share a common strategy of psychological explanation, Aristotelian Faculty Psychology. This strategy individuates psychological components by their target-domains and functional roles. Working memory and phantasia result from an attempt to individuate the psychological components responsible for flexible thought and (...) are thus implicated in most of our robust cognitive processes, from reading comprehension to problem solving. We then present two novel objections which suggest that these capacities cannot explain our ability to engage in flexible thought. To escape the resultant impasse, we survey alternatives and argue that most promising strategies depend on identifying the behaviors attributed to intelligent thought and action. (shrink)

The “film as philosophy” (FAP) hypothesis turned into a field if its own right during the 2000s, after S. Mulhall’s On Film (2001). In this work, Mulhall defended that some films philosophize for themselves. This caused controversy. Around the same time of On Film’s release, B. Russell published the article “The philosophical limits of film” (2000). This article had one of the first attacks against FAP, posing some main objections based on metaphilosophical grounds, which were called the “generality” and the (...) “explicitness” objections. These objections made by Russell and by M. Smith are based on the idea that film and philosophy are too different in their purposes or ways of presentation, ideas that are grounded in implicit or explicit conceptions of philosophy. In this chapter, these will be analyzed, as well as some other metaphilosophically grounded objections, as a line of reasoning connecting to attempts of responding to them will be drawn. After doing so, it will be concluded that their metaphilosophical grounds are implausible, and, thus, they are not definite objections against FAP. (shrink)

Ever since Freud pioneered the “talking cure,” psychologists of various stripes have explored how autobiographical narrative bears on self-understanding and psychic wellbeing. Recently, there has been a wave of philosophical speculation as to whether autobiographical narrative plays an essential or important role in the constitution of agentic selves. However, embodiment has received little attention from philosophers who defend some version of the narrative self. Catriona Mackenzie is an important exception to this pattern of neglect, and this paper explores Mackenzie’s work (...) on embodiment and self-narrative with the aim of better understanding the adequacy of autobiographical narrative as an account of the agentic self. I argue that Mackenzie’s narrative account of embodied subjectivity and agency is incomplete, for it over-estimates the reach of narrative and underestimates the cognitive and agentic powers of the lived body. However, the method of stem cell research involves the use and unavoidable destruction of human embryo. As a result of this, many theologians, scholars and analysts have condemned the research programme. Their argument is that the embryo use in stem cell research is human person; hence it is immoral. Working memory is thought to be the psychological capacity that enables us to maintain or manipulate information no longer in our environment for goal-directed action. Recent work argues that working memory is not a so-called natural kind and in turn cannot explain the cognitive processes attributed to it. This paper first clarifies the scope of this earlier critique and argues for a pluralist account of working memory. Under this account, working memory is variously realized by many mechanisms that contribute to (...) the maintenance and manipulation of information across tasks. This view in effect updates one of the earliest pluralist formulations of working memory. Juxtaposing this view against deflationary descriptions allows us to delineate two gradients that help us chart various accounts of working memory and identify their respective theoretical commitments. In turn, we can isolate those accounts that fail to accord with the evidence supporting a pluralist view, and we can begin to rehabilitate working memory as a pluralist, and ultimately more informative, construct. In this paper we advance a new solution to Quinn’s puzzle of the self-torturer. The solution falls directly out of an application of the principle of instrumental reasoning to what we call “vague projects”, i.e., projects whose completion does not occur at any particular or definite point or moment. The resulting treatment of the puzzle extends our understanding of instrumental rationality to projects and ends that cannot be accommodated by orthodox theories of rational choice.

É amplamente reconhecido que para mitigar a mudança climática antropogênica são necessários urgentes esforços institucionais em várias dimensões: tecnológicos, infraestruturais, mas também socioculturais. Isso significa que, para que haja a transição ecológica para uma sociedade mais verde e sustentável, um conjunto de mudanças estruturais econômicas, políticas e culturais deverão ser rearticuladas nos próximos anos. Por um lado, ao passo que é inegável que, para conter a mudança antropogênica, o uso do poder institucional deve ser usado de modo mais incisivo nas (...) mais diversas esferas que estruturam o social. Por outro lado, não fica evidentemente se as liberdades serão afetadas e, em caso positivo, como elas serão afetadas. Diante da urgência do problema, o artigo propõe normativamente explorar o conflito entre, por um lado, a exigência do uso do poder institucional para conter a mudança climática antropogênica em tempo e, por outro, a garantia pelo mais amplo esquema de liberdades políticas, econômicas e civis nas sociedades democráticas liberais. Generally, we confidently ascribe valuing states to ourselves. We make statements such as “I value democracy” or “I value my best friend” - our sense of who we are depends on doing so. Yet what justifies that confidence? If you were asked “Do you value philosophy, or are you just doing it for the money?”, how might you go about generating such knowledge? I will operate with the notion that valuing involves, at a minimum, a set of distinctive emotional dispositions (...) toward the valued object. Given this view of valuing, a plausible explanation stemming from Tooming and Miyazono is the following: to know whether we value, we need to predict our potential or future emotional reactions. That is, they suggest that affective forecasting is necessary to generate knowledge of valuing states. I argue that, despite its intuitive appeal, affective forecasting is not necessary. I then consider a more modest claim, namely that affective forecasting is still explanatorily powerful when it comes to self-knowledge of valuing states, as it explains the difficulty of generating such knowledge. I reject this further claim, arguing that there is a stronger available explanation: the use of theories about valuing. (shrink)

Este artículo se propone analizar la reinterpretación del concepto kantiano de crítica como una actitud ética en la obra de Foucault, destacando su relevancia para la hermenéutica crítica contemporánea. Por un lado, se explora cómo la práctica del cuidado de sí se convierte en un medio para “controlar” y “limitar” el poder, permitiendo así el ejercicio constante de la libertad. Esta concepción ética implica una nueva comprensión de la libertad, no como contrapuesta al poder, sino como su antecedente. La reflexión (...) crítica sobre la libertad, la ética y la verdad ofrece la posibilidad de transformarse continuamente a través del trabajo incesante en la construcción y el cultivo de uno mismo. Por otro lado, se presenta un método filosófico crítico basado en la autorreflexión, una ética hermenéutica del cuidado de sí, que abre nuevos horizontes interpretativos para dar forma al yo. La sociedad del siglo XXI ha sufrido una mutación histórica en lo que respecta a los métodos de producción y los impactos derivados de la generación de información. Este período se caracteriza por su inmersión en el entorno digital, donde los individuos, como ciudadanos, se encuentran bajo la manipulación, por un lado, de sus datos mediante técnicas de vigilancia y, por otros, expuestos a cámaras de resonancia mediática. Este panorama plantea desafíos significativos en cuanto a la manera en que interactúan (...) con la información y cómo esta afecta sus vidas. La relación entre los medios de comunicación y los acontecimientos, además, se encuentra atravesada por el concepto de interpretación, donde la capacidad de comprender y la habilidad para reconstruir narrativas son elementos que determinan la comprensión y el sentido de lo que ocurre en nuestro mundo. El autor presenta la historia de las ondas gravitacionales según Einstein, uniéndola a su biografía y a su época con el fin de comprenderla en su conexión con la historia de los semitas, la personalidad de Einstein en el manejo de sus circunstancias generadoras de conflicto en sus relaciones de competencia con sus colegas y en la formulación de la llamada teoría general de la relatividad. Recaeremos en las vicisitudes que vivió Einstein en el tránsito de que su trabajo científico (...) pasara a la ciencia normal como un pilar de la física teórica. Trataremos como Einstein introdujo el éter relativístico confiriéndole un “olor de materialidad” a su explicación geométrica de la gravedad, donde indudablemente, no cabe, pero que él tuvo que ceder ante la presión eso sí justificada de sus más connotados colegas, liderados por Lorentz. Einstein lo tuvo que hacer para mantenerse en la cola que lo llevaría al Nobel. Fue así, como desarrollando el hilo del éter relativista, en junio de 1916, introdujo las ondas gravitacionales de las que, en un acto de liberación personal y honradez científica, cuando pudo, en 1938, demostró como no podían existir, dentro del escenario de su relatividad, para de inmediato también darle fin al éter relativista. Quien enseña sin emancipar no solo embrutece, predicaba Joseph Jacotot, sino que también adoctrina. Pasado un siglo y medio desde entonces, el filósofo y esteta francés emérito de la Universidad de París VIII y European Graduate School Jacques Rancière, en un ejercicio característico de la filosofía de la educación, publica en 1987 El maestro ignorante a partir de la experiencia de Jacotot. Feminist studies of female genital cutting (FGC) provide ample evidence that many women exercise effective agency with respect to this practice, both as accommodators and as resisters. The influence of culture on autonomy is ambiguous: women who resist cultural mandates for FGC do not necessarily enjoy greater autonomy than do those women who accommodate the practice, yet it is clear that some social contexts are more conducive to autonomy than others. In this paper, I explore the implications for autonomy theory (...) of these understandings of the relation between culture, FGC, and women’s agency. I review the range of worldwide FGC practices – including “corrective” surgery for “ambiguous genitalia” in Western cultures as well as the various initiation rites observed in some African and Asian cultures – and the diverse cultural rationales for different forms of FGC. I argue that neither latitudinarian, value‐neutral accounts of autonomy nor restrictive, value‐saturated accounts adequately explain women’s agentic position with respect to FGC. I then analyze a number of educational programs that have enhanced women's autonomy, especially by strengthening their introspection, empathy, and imagination. Such programs, which engage women's autonomy skills without exposing them to autonomy‐disabling cultural alienation, promote autonomy‐within‐culture. This understanding of autonomy as socially situated, however, entails neither endorsement of FGC nor resignation to its persistence. (shrink)

Various schemes have been devised to tackle the problem of poor quality of University graduates in Nigeria. In spite of this, the problem has persisted. This paper essentially links poor quality graduates in Nigeria to the decentralized examination system which governs University degree examinations. Therefore, for detail study, this paper focuses on the linkage between the problem of poor quality graduates and credibility of the decentralized, individualized and autonomous University examination systems. The approach adopted in this paper is predicated on (...) the fact that the subjective nature of University examination systems undermines quality by “shielding” the prospective graduate from facing a universally standardised objective evaluation. The objective of this paper is to devise a scheme towards finding a lasting solution to the problem. To achieve this goal, the paper postulates a thesis called – Joint Graduation, Convocation and Certification Programme (JGCCP) – which would involve universal testing and certification of graduates in Nigeria. It is a standardized framework which will allow for harmonized and universal approach to solving the problem. The objective is based on the fact that examination is the most important instrument used in Nigeria in determining quality of graduates. (shrink)

Based on the personal stories of two women directors from each country, we discuss similarities and differences in the role and characteristics of women corporate directors and the processes and behaviours they are involved in as directors within and outside the boardroom. We also investigate the role of gender-related dynamics in these two countries, focusing on board roles and processes, and (...) the visible and invisible board structures with which women corporate directors contend. El artículo aborda el problema de la relación entre el ser humano y la técnica en el mundo actual desde una perspectiva filosófica. Volver a la concepción de la filosofía griega permite concebir hoy el quehacer filosófico como un ejercicio vital, sin fracturas entre el pensamiento y la acción. La patente plasticidad del ser humano evidencia la constitutiva apertura que determina su especificidad y, además, columbra la estrecha vinculación entre técnica, creación y cuidado a partir del acontecimiento del habitar. El (...) cuidado no puede tener lugar sin cierta promoción de un ethos cultural centrado en el miramiento, la asistencia y la preocupación por uno mismo y por el Otro. El olvido de la relación entre la creación y el cuidado conduce a un desequilibrio ethopoiético entre la condición ontológica del ser humano, como ser nacido, finito y vulnerable, y el desarrollo tecnológico, impulsado por la digitalización de la vida y el ascendente papel de las nuevas tecnologías en la sociedad. Advertir y remediar dicho desequilibrio supone repensar la originaria relación entre la creación técnica y el cuidado ético, así como la importancia de la ética para la persistencia de lo orgánico. Martha Nussbaum, Axel Honneth e Avishai Margalit defendem que a humilhação privaria os indivíduos de respeitarem (ou estimarem) a si mesmos. Neste artigo será salientado como cada autor, à sua maneira, salienta pontos sobre a (...) humilhação: a humilhação institucional (Avishai Margalit), a humilhação como a face pública da vergonha social (Martha Nussbaum), e por fim a humilhação como rompimento de expectativas normativas de reconhecimento (Axel Honneth). The thesis, typical among dualists, that there are no necessitation relations between events of consciousness and physical events implies that it is prima facie lucky that in our world the apparently existing psychophysical laws usually match events of consciousness and physical events in a “harmonious” way. The lucky psychophysical laws argument concludes that typical dualism amounts to a psychophysical parallelism that is prima facie too improbable to be true. I argue that an anthropic reasoning in the space of possible worlds (...) makes the appearance of a harmonious match situation unsurprising, and that this is all that is needed for the argument to be harmless to a typical dualist. Não é novidade no ambiente acadêmico as reticências da teórica crítica Nancy Fraser para com a teoria da justiça de John Rawls. Mais especificamente, sua desconfiança é que a justiça rawlsiana não seja capaz de capturar devidamente a complexidade das desigualdades sociais nas sociedades contemporâneas: seja porque sua teoria moral (da justiça) é presumidamente descolada de uma teoria social de fundo; seja porque sua teoria moral (da justiça) é considerada reducionista (ou “monista”). Porém, o espírito do presente artigo não é (...) de aprofundar suas diferenças metodológicas, mas sim colocar as bases para se pensar possíveis “semelhanças de família” entre suas concepções de justiça. Afinal, ambas as formulações se apresentam como abordagens “deontológicas”, ou seja, que priorizam o correto (o justo) sobre o bem. Na primeira seção, retorna-se ao célebre debate redistribuição e reconhecimento, onde Fraser apresenta as novas abordagens liberais – com destaque à de Rawls - como as principais representantes do paradigma redistributivo no cenário contemporâneo. Ao mergulhar nessas passagens, é possível revelar precisamente quais os pontos de concordância e discordância de Fraser para com a teoria deontológica de Rawls. Dando continuidade, na segunda seção é explorado sua principal discordância: o presumido “reducionismo” da teoria da justiça rawlsiana à dimensão redistributiva (econômica), aqui chamada de crítica do reducionismo redistributivo. Se essa objeção procede ou não é objeto da terceira e última seção. Nela, é argumentado que mesmo que as preocupações normativas de Fraser (quanto ao problema do reducionismo) sejam válidas, ainda assim, esse problema não se aplica à teoria rawlsiana. Ao contrário, é argumentado que é possível encontrar “semelhanças de família” entre as concepções de Fraser e Rawls: (a) no seu alicerce e compromisso com o pluralismo, (b) na sua investigação e defesa do status igualitário entre as pessoas e, finalmente, (c) na constatação que o ideal normativo da igualdade democrática entre as pessoas (ou paridade de participação) requer dos arranjos institucionais não somente a redistribuição de recursos e bens econômicos, como também elementos de qualidades diferentes. Quadruple Helix Collaborations (QHCs) is a cooperation model in which industry, government, academia, and the public interact to innovate. This paper analyses the impact of a training intervention to provide specific knowledge, skills, and attitudes to deal with barriers commonly found in the progress of QHCs. We designed, implemented, and evaluated three training programs in Austrian, Colombian, Danish, and Spanish institutions. We analysed trainees’ (n = 66) and trainers’ (n = 9) perceptions to identify the competencies acquired with the intervention (...) and the approach’s limitations. We used online questionnaires (35 trainees; 9 trainers), semi-structured interviews (10 trainees), and a focus group (6 trainers). Trainees answered positively regarding their self-perception about the impact of the course and highlighted the acquisition of inspiration for their practice (score 4.1 out of 5.0) and knowledge (3.7). In contrast, they perceived that a deeper interaction with other participants (2.7) was challenging. After the courses, 74% of respondents indicated that they know more about how QHCs work in practice, and 86% about collaboration or engagement methods. Moreover, participants plan to be more sensitive towards setting common goals (71%) and power imbalances (63%). Trainers’ perceptions align with those expressed by participants, except that they considered that the interaction amongst participants during the course was higher. Qualitative analysis of interviews with participants and the focus group with trainers provides more detail about the strengths and weaknesses of the intervention. Our study shows that the collaborative design and implementation of training impact the participant’s learning competencies, with potential implications in their medium- to long-term practice. My aim is to extend and complement the arguments that others have already made for the claim that women who are citizens of economically disadvantaged states and who have been trafficked into sex work in economically advantaged states should be considered candidates for asylum. Familiar arguments cite the sexual violence and forced labor that trafficked women are subjected to along with their well-founded fear of persecution if they’re repatriated. What hasn’t been considered is that reproductive rights are also at stake. (...) I explain how reproductive rights are implicated in sex trafficking. Moreover, I contend that sex traffickers’ abuse of women’s reproductive rights is persecutory and that that this persecutory abuse obliges destination states to offer asylum to transnational sex trafficking victims. I start by sketching reproductive human rights doctrine. I then examine studies of women who are in post-trafficking recovery programs in order to ascertain the impact of their past experience of forced sex work on their reproductive freedom and health. On the basis of these findings, I maintain that, among other outrages, sex trafficking systematically violates victims’ reproductive human rights. In view of this abuse, women trafficked into sex work might seem to be prime candidates for asylum in destination states. Yet, economically well-off destination states are not particularly receptive to this idea, and international law provides some justification for their chilliness. Preliminary to challenging them, I explicate four ways in which international anti-trafficking law and international refugee law interfere with viewing women trafficked into sex work as refugees and approving their applications for asylum. The second half of my paper aims to overcome those legal obstacles. In the interest of parsimony and because there are many continuities between U.S. refugee law and anti-trafficking law and the policies of similar destination states, I focus mainly on the U.S. in this part of the paper. To anchor my argument, I spotlight two precedents in refugee law for taking reproductive human rights seriously and several precedents for treating trafficked women as members of a distinct social group as required by refugee law. I then urge that a law enforcement gestalt has gained undue influence over U.S. legal practices where anti-trafficking law intersects with refugee protection law. A human rights gestalt is needed as a counterweight, for otherwise victims of sex trafficking and the reproductive abuse they’ve suffered are erased. Taking up a human rights perspective and mobilizing the precedents I’ve identified, I show that respecting the reproductive human rights of women who have been trafficked into sex work entails that affluent destination states must recognize their right to asylum. I defend the hypothesis that the semantic paradoxes, the paradoxes about collections, and the sorites paradoxes, are all paradoxes of reference fixing: they show that certain conventionally adopted and otherwise functional reference-fixing principles cannot provide consistent assignments of reference to certain relevant expressions in paradoxical cases. I note that the hypothesis has interesting implications concerning the idea of a unified account of the semantic, collection and sorites paradoxes, as well as about the explanation of their “recalcitrance”. This paper focuses on the question of What kind of engineering ethics (EE) is needed to develop holistic engineers who can practice and promote the principles of sustainable development? -/- It is argued that, given the existence of other models, an approach to EE, as argued for at EESD 2016, centred on “training engineers for handling ethical dilemmas in sustainability contexts” (Lundqvist and Svanstrom 2016) is inadequate to address the sustainability challenge facing engineers.. We contend that while EE is now (...) a diverse and fragmented field sociological tools can be used to understand this diversity. A framework is offered for understanding different approaches. This is used as the basis for arguing for a more extended and broad approach which allows us to focus on the relationship between social structure and human action and the need for “adequate social institutions and structures” (Becker 2012: 28) to enable ethical action. Thus engineers not should only understand the constraints and enablers emanating from the environments in which they work but can also strive for change in these environments. (shrink)

In this paper I consider recent discussions within the representationalist theories of phenomenal consciousness, in particular, the discussions between first order representationalism (FOR) and higher order representationalism (HOR). I aim to show that either there is only a terminological dispute between them or, if the discussion is not simply terminological, then HOR is based on a misunderstanding of the phenomena that a theory of phenomenal consciousness should explain. First, I argue that we can defend first order representationalism from Carruthers' attacks (...) and ignore higher order thoughts in our account of phenomenal consciousness. Then I offer a diagnostic of Carruthers' misunderstanding. In the last section I consider further reasons to include mindreading abilities in an explanation of phenomenal consciousness. (shrink)

In this study, I aimed to carry out a comparative analysis of the methods of conversational philosophy and sage philosophy as contributions towards overcoming the problem of methodology in African philosophy. The purpose was to show their points of convergence and probably, if possible, their point of divergence as well. I did not intend to show that the method of one is superior or inferior to the other. The objective was to provide an analysis to show that the two methods (...) are essentially the same with little variations. Thereafter, I highlighted their significance as methods of doing African philosophy and discussed their problems as well. I used the methods of analysis and hermeneutics. From the study, I concluded that conversational philosophy is an extension or a modified form of sage philosophy. The implication of this conclusion is that sage philosophy and conversational philosophy should overlap each other in research and purposes. (shrink)

The particle-wave, of matter and eld, has intrinsically three spatial dimensions and one temporal dimension. The spacetime is intrinsically the structural quality of particle-wave. This paper argues that potential cases of oppression, such as sex trafficking, can sometimes comprise autonomous choices by the trafficked individuals. This issue still divides radical from liberal feminists, with the former wanting to ‘rescue’ the ‘victims’ and the latter insisting that there might be good reasons for ‘hiding from the rescuers.’ This article presents new arguments for the liberal approach and raises two demands: first, help organizations should be run by affected women and be open-minded about whether or not (...) the trafficked individuals should remain in the sex industry. Second, the career choices of trafficked individuals should be expanded by the introduction of an opportunity-extending right to asylum. (shrink)

It is often said that human rights are the rights that people possess simply in virtue of being human – that is, in virtue of their intrinsic, dignity-defining common humanity. Yet, on closer inspection the human rights landscape doesn’t look so even. Once we bring perpetrators of human rights abuse and their victims into the picture, attributions of humanity to persons become unstable. In this essay, I trace the ways in which rights discourse ascribes variable humanity to certain categories of (...) people. I set the stage for my discussion of the human in relation to human rights by examining John Locke’s account of the justification for punishment. For Locke, in committing a crime one abrogates one’s humanity and forfeits one’s rights. Likewise, I argue, human rights discourse takes a scalar view of humanity. I consider victims of genocide who are dehumanized as helpless and passive, victims of state persecution who are super-humanized as righteously agentic, and perpetrators of genocide who are dehumanized as out-of-control beasts. In each case I use relevant testimony to argue that the scalar view of humanity is factually incorrect and morally deplorable. For genocide victims, I discuss testimony that Selma Leydesdorff gathered from women who survived the Srebrenica massacre. For a victim of persecution, I discuss Liao Yiwu’s memoire of his detention and imprisonment in China because of his artwork protesting the Tiananmen Square massacre. For perpetrators of genocide, I discuss testimony Jean Hatzfeld gathered from Hutu men who systematically murdered Tutsis in the Rwandan genocide. Finally, I apply my critique of dehumanized and super-humanized victims and dehumanized perpetrators to the problem of transnational trafficking in persons and argue that the view I advocate necessitates reforming immigration policy with respect to persons trafficked into forced labor. The thesis aims to provide an interpretation of John Rawls’ social bases of self-respect from the debate on redistribution and recognition in the current state of the art of theories of justice. The first chapter reenacts the reception of Rawlsian theory in the debate based on three critiques: (a) Iris Young's critique of the allocative-distributive paradigm, (b) Axel Honneth’s critique of the legal-political limitation, (c) Nancy Fraser's critique of the redistributive-reductionism. Far from considering the conception of ‘justice as fairness’ as (...) an insensitive terrain for dealing with matters of recognition, criticisms point out, on the contrary, the attempts of liberal Rawlsian theory to move into these issues, mainly taking the social bases of self-respect into account. However, these criticisms agree that Rawls' theory of justice would fail for several reasons. In the following chapters, each of these criticisms is addressed. The second chapter replies to Young's criticism. Contrary to what the author have supposed, ‘justice as fairness’ is better understood as a relational conception of justice rather than an allocative-distributive one. The third chapter addresses Honneth's criticism. On the one hand, the Critical Theorist is right in stating the limitations of Rawls' theory of justice; however, on the other hand, a deontological theory of justice – like the Rawlsian one – conceives these limitations as a normative advantage rather than as a theoretical flaw. The fourth chapter focuses on Fraser's critique. Likewise in her deontological model, it is argued that ‘justice as fairness’ would also have taken the cultural dimension of justice duly into account as well as, more specifically, status inequalities and cultural conflicts. Given the compatibility between their normative models, in the fifth and last chapter, a return to Fraser's deontological recognition via Rawls is advocated. (shrink)
