The meanings of utterances and thoughts are commonly regarded in philosophical semantics as abstract objects, called «propositions», which account for how different utterances and thoughts can be synonymous and which constitute the primary truth-bearers. I argue that meanings are instead natural properties that play causal roles in the world, that the kind of «One over Many» thinking underlying the characterization of shared meanings as abstract objects is misguided and that utterances and thoughts having truth-values in virtue of their meanings does (...) not entail that meanings themselves are truth-bearers. In this paper, we draw on developmental findings to provide a nuanced understanding of background emotions, particularly those in depression. We demonstrate how they reflect our basic proximity (feeling of interpersonal connectedness) to others and defend both a phenomenological and a functional claim. First, we substantiate a conjecture by Fonagy & Target (International Journal of Psychoanalysis 88(4):917–937, 2007) that an important phenomenological aspect of depression is the experiential recreation of the infantile loss of proximity to significant others. Second, we argue (...) that proximity has a particular cognitive function that allows individuals to morph into a cohesive dyadic system able to carry out distributed emotion regulation. We show that elevated levels of psychological suffering connected to depressive background emotions may be explained not only in terms of a psychological loss, but also as the felt inability to enter into dyadic regulatory relations with others—an experiential constraint that decreases the individual’s ability to adapt to demanding situations. Scaffolded Minds offers a novel account of cognitive scaffolding and its significance for understanding mental disorders. The book is part of the growing philosophical engagement with empirically informed philosophy of mind, which studies the interfaces between philosophy and cognitive science. It draws on two recent shifts within empirically informed philosophy of mind: the first, toward an intensified study of the embodied mind; and the second, toward a study of the disordered mind that acknowledges the convergence of the explanatory concerns of (...) psychiatry and interdisciplinary inquiries into the mind. The book sets out to accomplish a dual task: theoretical mapping of cognitive scaffolding; and the application/calibration of fine-grained philosophical distinctions to empirical research. It introduces the notion of actively scaffolded cognition (ASC) and offers a taxonomy that distinguishes between intrasomatic and extrasomatic scaffolding. It then shows that ASC offers a productive framework for considering certain characteristic features of mental disorders, focusing on altered bodily experience and social cognition deficits. We sometimes fail unwittingly to do things that we ought to do. And we are, from time to time, culpable for these unwitting omissions. We provide an outline of a theory of responsibility for unwitting omissions. We emphasize two distinctive ideas: (i) many unwitting omissions can be understood as failures of appropriate vigilance, and; (ii) the sort of self-control implicated in these failures of appropriate vigilance is valuable. We argue that the norms that govern vigilance and the value of self-control (...) explain culpability for unwitting omissions. (shrink)

This paper starts by distinguishing three views about the phenomenal character of perceptual experience. ‘Low-level theorists’ argue that perceptual experience is reducible to the experience of low-level properties, ‘high-level theorists’ argue that we have perceptual experiences of high-level properties, while ‘disunified view theorists’ argue that perceptual seemings can present high-level properties. The paper explores how cognitive states can penetrate perceptual experience and provides an interpretation of cognitive penetration that offers some support for the high-level view.

The Philosophy of Psychiatry is a unique area of research because the nature of the subject matter leads to quite distinct methodological issues. Naturalism, Interpretation, and Mental Disorder is an original new work focusing on the challenges we face when trying to interpret and understand mental illness. Se pretende en este sentido plantear que la tendencia regulatoria en materia de obtenciones vegetales en Colombia no sólo va en contravía de los intereses de los pueblos indígenas, sino además de su patrimonio colectivo que les ha garantizado una gran diversidad que (...) hoy por hoy es sustento de su alimentación. Authenticity has become a widespread ethical ideal that represents a way of dealing with normative gaps in contemporary life. This ideal suggests that one should be true to oneself and lead a life expressive of what one takes oneself to be. However, many contemporary thinkers have pointed out that the ideal of authenticity has increasingly turned into a kind of aestheticism and egoistic self-indulgence. In his book, Varga systematically constructs a critical concept of authenticity that takes into account the reciprocal (...) shaping of capitalism and the ideal of authenticity. Drawing on different traditions in critical social theory, moral philosophy and phenomenology, Varga builds a concept of authenticity that can make intelligible various problematic and potentially exhausting practices of the self. Grief is often described as characterized by a particular emotional response to another person’s death. While this is true of paradigm cases, we argue that a broader notion of grief allows accommodating forms of this emotional experience that deviate from the paradigmatic case. The bulk of the paper explores such a nonparadigmatic form of grief, anticipatory-vicarious grief, which is typically triggered by pondering the inevitability of our own death. We argue that AV-grief is a particular moral emotion that serves a (...) unique function and is indissolubly linked to the practical identities of human agents. At least some serial killers are psychopathic serial killers. Psychopathic serial killers raise interesting questions about the nature of evil and moral responsibility. On the one hand, serial killers seem to be obviously evil, if anything is. On the other hand, psychopathy is a diagnosable disorder that, among other things, involves a diminished ability to understand and use basic moral distinctions. This feature of psychopathy suggests that psychopathic serial killers have at least diminished responsibility for what they do. In this (...) chapter I consider whether psychopathic serial killers might be properly said to be both evil and morally responsible for their actions. I argue that psychopathic serial killers are plausibly evil in at least one recognizable sense of the term, but that they are nevertheless not likely to be responsible for many of the evils they perpetuate. The DSM‐5 highlights two essential psychological features of anorexia nervosa (AN): recalcitrant fear of gaining weight and body image disturbance. Prominent accounts grant false beliefs about body weight and shape a central role in the explanation of AN behavior. In this article, we propose a stronger emphasis on recalcitrant fear. We show that such fear can explain AN behavior without the intermediary of a false belief, and thus without the associated explanatory burdens and conceptual difficulties. This paper aims to contribute to debates about the nature of philosophical inquiry and its relation to science. The starting point is the Discontinuity View (DV), which holds that philosophy is discontinuous with science. Upon critically engaging two lines of argument in favor of DV, the paper presents and defends the Continuity View (CV), according to which philosophy and science are continuous forms of inquiry. The critical engagement sheds light on continuities between philosophical and scientific inquiry while underlining special normative (...) competences of philosophical work. As to the last paragraph, the most striking feature of the inner morality of law is that it is such a possible characteristic, surplus quality which is not a sine qua non, which law is conceivable without. However, it (...) is a question whether law can long do without it? In principle, the legislator is free in deciding on what legal consequence he attaches to what course of conduct14 and it is also desirable that legal concepts be freed from moral overtones. Nevertheless, the legal complex cannot be torn out of its social context, nor can it steadily conflict with other complexes (religions, moral, or political values, norms and ideologies) law is to develop in living interrelationship with. Otherwise, it is subject to danger that (I) law-observance in average cases is weakened; (2) the reified functioning of and approach to law are strengthened and make law alienated; and (3) it blurs the social objectives the law intends to serve and, especially in hard cases, makes its application rootless and floating. A pathological situation only becomes more pathological, if the pathology of contents is accompanied by the pathology of means. Or, it brings the promise of real solution closer, if the adequateness of means also provides, by the strength of publicity, for the direct mobilization of society. Este paper busca aportar elementos para el debate de la pérdida de legitimidad del principio de precaución en el derecho colombiano y ante las autoridades públicas. Para demostrar esta premisa, el autor se vale del análisis de la heurística de la disponibilidad y del descuido de la probabilidad, así como del estudio de caso de la tardía aplicación del principio en el Programa de Erradicación de Cultivos de Uso Ilícito mediante aspersión aérea con Glifosato.

Este artículo aborda, desde la relectura del trabajo de Alfred Schütz “La ejecución musical conjunta” (“Makingmusictogether”), la idea de intersubjetividad como sintonía en las relaciones sociales explorando en los elementos señalados por el autor, como la dimensión temporal, el cara a cara y la sincronización con el Otro. Se abre así una posibilidad de comprensión de los procesos intersubjetivos, en la perspectiva del reconocimiento de la alteridad (Levinas) como constitutiva de intersubjetividad, y se plantea la pregunta de si es posible, (...) en contextos de exclusión, avanzar hacia la constitución de sintonía entre sociedad y Estado. El artículo propone una serie de comentarios a propósito de la noción de Phrónesis, el carácter del estudio es introductorio y prevé esclarecer considerandos aristotélicos respecto a la noción, librándola de interpretaciones erróneas.

El presente reporte de investigación muestra, de manera sintética, los resultados de una pesquisa presentada en el 2012 para optar por el grado de Licenciatura en Docencia en la Universidad Estatal a Distancia. La exploración de los desafíos éticos en el contexto educativo costarricense desde el planteamiento de Martin Buber y Emmanuel Lévinas es lo que pretende formular la presente investigación, procurando aportar al diálogo nacional el insumo de un elemento filosófico innovador, tenor de un impulso en futuros planteamientos educativos (...) costarricenses que propicien un desarrollo humano cada vez más integral, donde la persona sea considerada en relación armónica con lo existente. Además, se presentan una serie de desafíos éticos que se desprenden de un análisis, en el cual confluyen diversas fuentes de información. La novedad radica en la confluencia de voces y la lectura ética de estos postulados desde el pensamiento de Martin Buber y Emmanuel Lévinas. La meta de la investigación postula un aporte al modelo educativo costarricense, así como a grupos gremiales de la educación y población en general, desde el enfoque de la filosofía del encuentro, desde el planteamiento del diálogo buberiano y el planteamiento de alteridad levinasiano, se puedan encontrar insumos necesarios para un replanteamiento -tanto desde el aspecto teórico como práctico- en el quehacer educativo nacional. Recent criticisms of medicine converge on fundamental questions about the aim of medicine. The main task of this paper is to propose an account of the aim of medicine. Discussing and rejecting the initially plausible proposal according to which medicine is pathocentric, the paper presents and defends the Autonomy Thesis, which holds that medicine is not pathocentric, but sanocentric, aiming to promote health with the final aim to enhance autonomy. The paper closes by considering the objection that the Autonomy Thesis (...) is overly permissive and allows many highly controversial procedures as legitimate parts of medicine. (shrink)

As a result of the doctoral research developed by the main author (Vargas-Chaves, 2017), it was identified the evolution and perspectives of the pharmaceutical patent in the international trade system, as well as it future legal research needs in this topic, both immediate and long-term. Furthermore, a number of problems of public health were highlighted in which the patent-term-extension mechanisms have produced a lack of access to medicines.

Medicine is increasingly subject to various forms of criticism. This paper focuses on dominant forms of criticism and offers a better account of their normative character. It is argued that together, these forms of criticism are comprehensive, raising questions about both medical science and medical practice. Furthermore, it is shown that these forms of criticism mainly rely on standards of evaluation that are assumed to be internal to medicine and converge on a broader question about the aim of medicine. Further (...) work making medicine’s internal norms explicit and determining the aim of medicine would not only help to clarify to what extent the criticism is justified, but also assist an informed deliberation about the future of medicine. To illustrate some of the general difficulties associated with such a task, the paper concludes by critically engaging Edmund Pellegrino’s account of the aim of medicine as well as the Hastings Center’s consensus report. Causal decision theory defines a rational action as the one that tends to cause the best outcomes. If we adopt counterfactual or probabilistic theories of causation, then we may face problems in overdetermination cases. Do such problems affect Causal decision theory? The aim of this work is to show that the concept of causation that has been fundamental in all versions of causal decision theory is not the most intuitive one. Since overdetermination poses problems for a counterfactual theory of causation, (...) one can think that a version of causal decision theory based on counterfactual dependence may also be vulnerable to such scenarios. However, only when an intuitive, not analyzed notion of causation is presupposed as a ground for a more plausible version of causal decision theory, overdetermination turns problematic. The first interesting consequence of this is that there are more reasons to dismiss traditional theories of causation (and to accept others). The second is to confirm that traditional causal decision theory is not based on our intuitive concept of the causal relation. (shrink)

Este texto nace de la necesidad de aproximarse a reflexiones desde América Latina frente al debate comercio- cultura puesto que se ha encontrado que a nivel internacional hay dos posiciones claramente definidas. De una parte, los Estados Unidos defienden la liberalización cultural por considerarla un bien y servicio más. De otra parte, regiones como Canadá, Francia, Quebec -y en diferentes grados la Unión Europea- defienden la excepción cultural. How do people understand the concepts of mental health and disorder? The objective of this paper is to examine the impact of several factors on people’s judgments about whether a condition constitutes a mental disorder or a healthy state. Specifically, this study examines the impact of the source of the condition, its outcome, individual valuation (i.e., the value the individual attaches to the condition), and group valuation (i.e., the value the relevant group attaches to the condition). While we find that (...) people’s health and disorder judgments are driven by perceived dysfunction, we also find that health and disorder judgments are impacted differently by these factors. Health judgements are impacted by outcome and individual valuation, and disorder judgments are impacted by condition source. These results suggest that the folk concept of mental health is positive (i.e., mental health is more than the absence of mental disorder) and normativist (i.e., value judgments play a significant role in determining whether a condition counts as healthy), while the concept of mental disorder aligns with a naturalist perspective, at least to the extent that dysfunction plays an important role in categorizing a condition as a disorder. However, our finding that people’s dysfunction judgments are influenced by individual valuation and outcomes poses a strong challenge to naturalist accounts. El artículo, de carácter aporético, asume como objetivo caracterizar sutilmente los desafíos de la educación artística, a partir de una crítica a la modernidad, hipermodernidad, así como a las manifestaciones de la sociedad estetizada. Se confuta la mirada de progreso desde una óptica emancipadora, con la premisa fundamental de lograr la elaboración del ¿por qué arte?, en los artistas.

Se brindan una serie de consideraciones prologales para justificar el establecimiento de una arquitectónica fenomenológica del tiempo en Emmanuel Levinas. El problema del tiempo se encuentra disperso en la obra levinasiana, en constante dialogo y confrontación con autores de la época, tanto de tradición fenomenológica como de tradición filosófica judía. El artículo recorre de manera proemial las diferentes etapas del pensamiento levinasiano y reconoce las periferias con las cuales el autor dialoga y confuta su propuesta, denominada como “Deformalización del tiempo”. Filosofía Judía, una noción, problemática, incluso ambigua para muchos, catalogada como incierta, dado su ligamen con una comprensión de filosofía regionalizada, e incluso como una filosofía de una nación. Sin embargo, tales barullos encuentran una contraposición, desde un área académica que apunta al esclarecimiento de la noción. Uno de los trabajos que retoman esta labor de elucidación se desprende del texto intitulado “History of Jewish Philosophy” editado por Daniel H. Frank y Olivier Leaman (1997), en dicho trabajo se realiza una (...) mención de principios y fundamentos, así como una descripción de diferentes momentos del pensamiento desde la época medieval hasta nuestros días. En el escrutinio de las fuentes de reflexión de la designada Filosofía Judía, ahí se reconocer como elementos de inspiración el Tanaj, el Talmud y la interacción con las escuelas griegas de pensamiento; además, en lo que respecta al itinerario investigativo, los autores exponen una serie de propuestas, de múltiples autores ligados a este tendencia, entre los que se pueden citar Moses Maimonides, Hermann Cohen, Franz Rosenzweig, Martin Buber y Emmanuel Levinas. Este artículo acomete el análisis de la concepción de temporalidad desarrollada por el filósofo alemán Franz Rosenzweig (1886-1929), a partir del escrutinio de su principal obra Der Stern der Erlösung (1921), desde una perspectiva fenomenológica. El tiempo, ahí, se comprende en una tridimensionalidad, a la luz de la noción del «Día de Dios». El planteamiento del pensador judío evidencia una ruptura con las tesis filosóficas modernas, que presentan el tiempo como absoluto. En oposición a esta creencia, establece una relación entre (...) redención e historia del mundo, donde la eternidad comprende, en su estructura, pasado, presente y futuro. En la primera parte, se expondrá una breve semblanza del casselense. A continuación, se presenta una exposición de la tradición judía sobre el tiempo, de la que se deriva una crítica a su concepción moderna. A continuación, se expone la doctrina sobre el tiempo que presenta La estrella de la redención y, finalmente, se concluye mostrando la relación entre temporalidad y eternidad como la expuso Franz Rosenzweig. While philosophical questions about health and disease have attracted much attention in recent decades, and while opinions are divided on most issues, influential accounts seem to embrace negativism about health, according to which health is the absence of disease. Some subscribe to unrestricted negativism, which claims that negativism applies not only to the concepts of health and disease as used by healthcare professionals but also to the lay concept that underpins everyday thinking. Whether people conceptualize health in this manner has (...) implications for medical care and public health, and so we set out to examine this claim in two studies. Participants were asked to assess and compare the health states of two people presented in two vignettes. We found that both lay people and medical students conceptualize health as something more than the absence of disease. We argue that our findings highlight a need to rethink unrestricted negativism and indicate a need to rethink the way the debate has traditionally focused on disease. (shrink)

Debates about the genuine disease status of controversial diseases rely on intuitions about a range of factors. Adopting tools from experimental philosophy, this paper explores some of the factors that influence judgments about whether low sexual desire should be considered a disease and whether it should be medically treated. Drawing in part on some assumptions underpinning a divide in the literature between viewing low sexual desire as a genuine disease and seeing it as improperly medicalized, we investigate whether health and (...) disease judgments are affected by factors such as an individual’s gender, the cause of the low desire, whether the desire is high or low, and both personal and societal valuations of the condition. Our main findings indicate that (a) the cause of a condition influences whether it is judged a disorder, (b) how the individual values the condition influences whether the condition is seen as a proper target of medical intervention, and (c) perceived dysfunction influences judgments regarding health, disorder classification, medicalization, and medical intervention. Our findings help further illuminate the intricate interplay of factors that influence judgments about health and disease in controversial conditions. (shrink)

One of the problems that are often indicated as a criticism of different forms of representationalism is the difficulty to find definitions that are neither semantic nor realist in a simple sense. The present work tackles this class of critiques from a contextualist point of view, assuming those semantic aspects that are necessary for a concept of representation, but showing that semantic relations of representation should neither be static, nor referential in a classical and strictly realist sense. Two distinctions are (...) crucial for our proposal: On the one hand, we have the distinction between closed and open systems; on the other, a tripartite distinction between structural, informational and semantic representations. En el presente capítulo se formulan unos lineamientos teóricos de la innovación ambiental, como forma de concebir aquellas innovaciones que respondan a las expectativas de los dos sectores involucrados en este ámbito. Para lograr lo anterior, el autor se aproxima a la innovación como un proceso mediante el cual se satisfacen necesidades, más allá de introducir mejoras o solucionar problemas a situaciones de deterioro a ambiental o agotamiento de recursos naturales. Adicional a lo anterior, se analiza el concepto de valor (...) compartido que generan las innovaciones ambientales entre stakeholders y shareholders y, por último, se desarrollan las dos dimensiones a las que deben responder este tipo de innovaciones. En este paper los autores realizan un análisis transversal de la innovación ambiental como estrategia social y ambientalmente responsable de las empresas. Para dar cuenta del valor compartido generado el texto se enmarca en el cambio tecnológico generalizado y las prácticas socialmente responsables para mitigar las emisiones de gases de efecto invernadero, y para coadyuvar a lo más vulnerables a adaptarse a los efectos del calentamiento global.

A large part of the contemporary literature on dehumanization is committed to three ideas: (a) dehumanization involves some degree of denial of humanness, (b) such denial is to be comprehended in mental terms, and (c) whatever exact mechanisms underlie the denial of humanness, they belong in the realm of post-perceptual processing. This chapter examines (c) and argues that the awareness of minds might belong to perceptual processing. This paves the way for the possibility that dehumanization might, at least in part, (...) be a perceptual phenomenon, such that dehumanizers visually perceive the dehumanized as exhibiting lesser-than-human minds. It is perhaps unsurprising that the first systematic investigations of dehumanization approached the phenomenon as linked to contexts of war, genocide, extreme hatred, and violence. One guiding hypothesis was that dehumanizers exclude the dehumanized from a moral community of human beings, implicitly conceptualized as displaying distinct individualities and being embedded in caring interpersonal relations. By comprehending the dehumanized as deindividuated entities to which moral norms and considerations of fairness do not apply (Opotow 1990), dehumanizers are able to disengage from moral restrictions and self-sanctions (Bandura 1999). Este paper propone una crítica sobre la categorización del principio de precaución como una norma jurídica vinculante. En aras de redimensionarlo y comprender su complejidad en la gestión del riesgo, los autores proponen un ejercicio reflexivo a partir del caso de los organismos modificados genéticamente, y así trazar una ruta sobre el fin que este principio persigue a cada caso en concreto.

El artículo presenta un estudio de la visión antropológica de Martin Buber (1878-1965) y Emmanuel Levinas(1906-1995), la postura de ambos procura un “volver al ser humano”, el primero desde la óptica del pensamiento dialógico y el segundo a partir del planteamiento de alteridad. Los autores describen un itinerario antropológico con una innegable influencia de la tradición judía, (hasidista y mesiánica),en contraposición a las posturas totalizantesde la filosofía moderna(Hegel, Heidegger), es por esta razón que se considera oportuno establecer un paralelismo entre (...) ambos para desvelar las desavenencias, pero enfocando las concomitancias en torno a la pregunta ¿Qué es el hombre?El artículo asume como objetivo reconocer las “cercanías” y “lejanías” entre los autores, a partir de nociones clave como: “Yo-Tú” buberiano y “Visage” levinasiano, la búsqueda del sentido de lo humano desde la intersubjetividad y reciprocidad frente a la extrañeza y radical alteridad. El artículo concluye exponiendo un pensamiento que responde a la vida, donde la ética se manifiesta como filosofía primera. (shrink)

Este capítulo explica el concepto de la proactividad en materia ambiental y en el ámbito de la salud pública, a partir del caso de estudio del uso del Glifosato en las campañas de aspersión contra cultivos de uso ilícito en Colombia. Nuestra propuesta se sustenta en una distinción entre acción proactiva-positiva y acción proactiva-negativa, siendo la primera la que permite entender que el ser humano es resiliente por naturaleza, y la segunda la que lleva al Estado a no intervenir ante (...) situaciones de vulnerabilidad evidenciable, bajo un supuesto de ponderación errónea de derechos afectados. Al estar despejado este escenario, este capítulo se adentra en el concepto de condiciones de certeza científica absoluta, para invocar o descartar la aplicación del principio de precaución. Acto seguido, y valiéndonos del límite de razonabilidad sobre las evidencias científicas ante un riesgo potencial e inminente, se plantea la aplicación del principio de prevención cuando tal límite es superado. La derivación de las reflexiones resultantes, facilita la labor de protección en el citado caso de estudio, siendo éste el siguiente paso en el restablecimiento de los derechos vulnerados de los afectados con la aspersión aérea con Glifosato. El presente artículo procura presentar una reflexión respecto a la noción de falso pacifismo como manifestación de violencia estructural desde los postulados de Emmanuel Mounier, específicamente a partir de la concepción de Revolución Personal y Comunitaria. La investigación parte de las concepciones del autor personalista, para finalizar esgrimiento una serie de posturas alternativas desde la obra mounierana para re-pensar las manifestaciones de crisis actual.

Proponents of manipulation arguments against compatibilism hold that manipulation scope (how many agents are manipulated) and manipulation type (whether the manipulator intends that an agent perform a particular action) do not impact judgments about free will and moral responsibility. Many opponents of manipulation arguments agree that manipulation scope has no impact but hold that manipulation type does. Recent work by Latham and Tierney (2022, 2023) found that people's judgments were sensitive to manipulation scope: people judged that an agent was less (...) free and responsible when a manipulation was existential (impacting at least one but not all agents) than when the manipulation was universal (impacting every agent). This study examines people's judgements about existential and universal manipulation cases that involve both intentional and non‐intentional outcomes. We found that manipulation scope also affects people's free will and responsibility judgments in manipulation cases involving both intentional and non‐intentional outcomes. Interestingly, we also found that manipulation type influences the effect that manipulation scope has on people's free will judgments but not their moral responsibility judgments, which indicates that people's free will and responsibility judgments can come apart. This puts pressure on the prevalent assumption that judgments about free will and moral responsibility are conceptually bound together. (shrink)

Respiratory rhythms sustain biological life, governing the homeostatic exchange of oxygen and carbon dioxide. Until recently, however, the influence of breathing on the brain has largely been overlooked. Yet new evidence demonstrates that the act of breathing exerts a substantive, rhythmic influence on perception, emotion, and cognition, largely through the direct modulation of neural oscillations. Here, we synthesize these findings to motivate a new predictive coding model of respiratory brain coupling, in which breathing rhythmically modulates both local and global neural (...) gain, to optimize cognitive and affective processing. Our model further explains how respiratory rhythms interact with the topology of the functional connectome, and we highlight key implications for the computational psychiatry of disordered respiratory and interoceptive inference. Este essay-paper busca aportar algunos elementos para el debate de la caracterización del acceso a los medicamentos como un derecho global, partiendo de una serie de reflexiones que teóricos realizan sobre un asunto que se constituye en uno de los principales focos de desigualdad en el mundo.

El presente artículo tiene como objetivo destacar la problemática de las prácticas de extensión o prolongación de los derechos de exclusividad sobre los medicamentos, llevadas a cabo por la industria farmacéutica, una vez el término de protección vía patente está por finalizar. A través de tres escenarios se pone de manifiesto las implicaciones de este fenómeno, destacándose la necesidad de involucrar activamente al Estado para garantizar así unas condiciones equitativas de acceso a los medicamentos.

El daño ambiental ha despertado el interés de la doctrina en Colombia, aunque aún no se aborda con rigor y profundidad. La razón, entre otras, es la omisión de los avances que ha dado el derecho comparado, donde la concepción del rol de las instituciones jurídicas va hasta una comprensión integral del daño a partir de la alteración funcional de los sistemas. Existe hoy cierto consenso respecto al deber ser del régimen de responsabilidad aplicable a esta noción integral del daño (...) ambiental, capaz de hacer frente a los componentes del medio natural y a todos los que lo conforman.
