Starting from the many-world interpretation of quantum mechanics, this work gives a holistic view of consciousness. The entirety is complete and does not possess any particular physical properties or subjective experience. It is the superposition of all possibilities. Its partition, however, gives rise to physical properties and subjective experience simultaneously. They play complementary roles to each other. The latter cannot be conveyed to a third person, and cannot be reduced to the former. It in fact fills the informational gap which (...) is impossible for the former to fill. This paper connects the hard problem of consciousness to the interpretation of quantum mechanics. It shows that constitutive Russellian pan(proto)psychism (CRP) is compatible with Everett’s relative-state (RS) interpretation. Despite targeting different problems, CRP and RS are related, for they both establish symmetry between micro- and macrosystems, and both call for a deflationary account of Subject. The paper starts from formal arguments that demonstrate the incompatibility of CRP with alternative interpretations of quantum mechanics, followed by showing that RS entails Russellian pan(proto)psychism. (...) Therefore, CRP and RS are mutually supportive. It then provides a unified ontological picture by combining CRP and RS. The challenge faced by CRP, the combination problem, can be resolved by adopting a RS version of quantum mechanics. Technically, this is achieved by a co-consciousness relation capable of explaining the difference between first-person and third-person perspectives. The hierarchical structure of the relation removes any concern on the structural mismatch between the physical and the phenomenal. (shrink)

Nearly thirty years ago, Robert Alexy in his book The Concept and Validity of Law as well as in other early articles raised non-positivistic arguments in the Continental European tradition against legal positivism in general, which was assumed to be held by, among others, John Austin, Hans Kelsen and H.L.A. Hart. The core thesis of legal positivism that was being discussed among contemporary German jurists, just as with their Anglo- American counterparts, is the claim that there is no necessary connection (...) between law and morality. Robert Alexy has argued, however, that the law, besides consisting conceptually of elements of authoritative issuance and social efficacy, necessarily lays a claim to substantial correctness, which is derived from analytical arguments. Furthermore, if this claim to substantial correctness necessarily requires the incorporation of moral elements into law, then the ‘necessary connection thesis’, as defended by non-positivism, can be justified. Some of the most significant objections to this sort of claim, stemming from the Anglo-American world, are those introduced by Joseph Raz. In his ‘Reply’ to Robert Alexy, Raz raises at least three interesting criticisms, including, first, the ambiguity of ‘legal theory in the positivistic tradition’, second, the indeterminate formulations of the ‘separation thesis’, and, third, the necessary claim of law to legitimate authority as a moral claim. As a point of departure, I will argue that Raz’s three criticisms are misleading. For they do not enhance our understanding of the genuine compatibility or incompatibility between legal positivism and non-positivism. Despite the frequently reformulated theses of legal positivism and the various kinds of opponents responding thereto, the essential divergence between legal positivism and non-positivism was and remains the answer to the question of the relation between law and morality. Furthermore, I will clarify that in the strictest sense there can be three and only three logically possible positions concerning the relation between law and morality: the connection between them is either necessary, or impossible (i. e. they are necessarily separate), or contingent (i. e. they are neither necessarily connected nor necessarily separate). The first position is non-positivistic, while the latter two positions are, indeed, both positivistic, but in different forms: one may be called ‘exclusive’ legal positivism, the other ‘inclusive’ legal positivism. I will continue by showing that these three positions stand to one another in the relation of contraries, not contradictories, and that, taken together, they exhaust the logically possible positions concerning the relation between law and morality, never mind the tradition or authority from which these positions are derived. Raz mentions, however, many changeable formulations of the separation thesis, which even leads him to acknowledge ‘necessary connections between law and morality’. One who is trying to understand legal positivism would no doubt be puzzled by this claim. Nevertheless, I will argue that this is an alternative strategy of legal positivism, and it points to naturalistically oriented view. Although this necessary separation between law and morality, understood naturalistically, strikes one as strengthening the separation, in the end it leads to a weakened notion of necessity. This weakened necessary separation thesis, however, cannot be justified through the so-called claim of the law to legitimate authority, defended by Raz, for it is difficult to answer the question of whether a normally justified but factual authority can gain legitimate authority. Finally, the necessary connection between law and morality in a strong sense can still be justified by the claim of law to correctness, as per Alexy’s argument. (shrink)

The concept of human dignity has been criticized as either too thick or too thin. However, according to the non-positivistic standpoint, the legal normativity of human dignity can be justified and thus strengthened by means of its moral correctness. From the individual perspective, Mencius’ understanding of human dignity as an intrinsic value and Kant’s formula of ‘man as an end in itself’ can be adequately understood based on the differentiation of, as well as the connection between, principium diiudicationis and principium (...) executionis, between will and choice, and between homo phaenomenon and homo noumenon (that is, ‘humanity in the personality’). From the social perspective, since the dual dimensions of the individual and the social person are both fictive constructions, even Radbruch, once as a supporter of social law, has not replaced the concept of ‘legal person’ and, in the post-War period, acknowledges individualistic human dignity as the criterion for applying the famous ‘disavowal formula’. On the one hand, human dignity shows at least a weak normative character, which requires, firstly, balancing between the exercise of state powers and the constitutional review under the guidance of the dual dimensions of man and, secondly, optimization of the principle of human dignity in individual cases. On the other hand, through the necessary connection between the concept of dignity and that of personality, human dignity can exhibit a strong normative character, which unavoidably requires a metaphysical justification. Die Disziplin, die als „Juristische Methodenlehre“ bezeichnet wird, ist gegenwärtig chinesischen Juristen nicht fremd, sie stammt aber ursprünglich aus dem deutschen Sprachraum. In der Literatur finden sich auch verwandte Ausdrücke wie „Juristische Methodologie“, „Juristische Methodik“ bzw.„Methodenlehre der Rechtswissenschaft“. Seit Anfang des 21. Jahrhunderts wurde ihre Rezeption in China durch zwei Übersetzungen gekennzeichnet, nämlich die „rechtswissenschaftliche Methodenlehre“ (faxue fangfalun) und die „rechtliche Methodenlehre“ (falü fangfalun). Neben der herkömmlichen Methodenlehre entwickelte sich auch eine jüngere Theorie der juristischen Argumentation, die die weltweite Aufmerksamkeit (...) sogar außerhalb Deutschlands auf sich lenken konnte und deren Bestand in China einen ganz selbständigen Abschnitt verdient. Als Hintergrund dafür soll von vornherein ein Blick auf die Entwicklungen der chinesischen Rechtstheorie und Rechtsphilosophie nach 1978 und demzufolge auf die Entstehung der Methodenfrage in der chinesischen Rechtswissenschaft geworfen werden. El concepto de dignidad humana ha sido considerado o demasiado denso o demasiado delgado. Sin embargo, desde el punto de vista del no-positivismo, la normatividad jurídica de la dignidad humana puede ser justificada y reforzada por medio de su corrección moral. Desde una perspectiva individual, la comprensión de Mencio sobre la dignidad humana como un valor intrínseco y el imperativo categórico de Kant (el ser humano como un fin en sí mismo) podrían ser adecuadamente comprendidos con base en la diferencia (...) (así como la conexión) entre el principium diiudicationis y el principium executionis, entre voluntad y “elección”; así como entre homo phaenomenon y homo noumenon (es decir, humanidad en la persona de los seres humanos). Desde una perspectiva social, las dimensiones del individuo y la persona social son construcciones ficticias; inclusive Radbruch -alguna vez defensor del derecho social- no remplazó el concepto de “persona jurídica” y, en el periodo de posguerra, reconoció la dignidad humana individual como el criterio para aplicar su famosa “fórmula de Radbruch". Por una parte, la dignidad humana muestra cuando menos un carácter normativo débil, el cual requiere, primero, ponderar entre el ejercicio de los poderes estatales y el control de constitucionalidad bajo la guía de la dimensión dual del ser humano y, segundo, la optimización del principio de la dignidad humana en casos particulares. The second law of thermodynamics is traditionally interpreted as a coarse-grained result of classical mechanics. Recently its relation with quantum mechanical processes such as decoherence and measurement has been revealed in literature. In this paper we will formulate the second law and the associated time irreversibility following Everett’s idea: systems entangled with an object getting to know the branch in which they live. Accounting for this self-locating knowledge, we get two forms of entropy: objective entropy measuring the uncertainty of the (...) state of the object alone, and subjective entropy measuring the information carried by the self-locating knowledge. By showing that the summation of the two forms of entropy is a conserved and perspective-free quantity, we interpret the second law as a statement of irreversibility in knowledge acquisition. This essentially derives the thermodynamic arrow of time from the subjective arrow of time, and provides a unified explanation for varieties of the second law, as well as the past hypothesis. Zhang Zai posited that internal resonance manifests as a dynamic pattern of “motion within stillness,” emphasizing the significance of the state of “ultimate tranquility” in moral refinement. The “numinous” (shen) and “earthly energy” (diqi) serve as the driving forces for the emergence of internal resonance activities within the state of the great void tranquility. In contrast, Cheng Yi (...) explicitly opposed the “motion within stillness” model. Instead, he revealed the continuous inward resonance of Heavenly Principle through its interaction at dual poles, thus illuminating the potentiality of Heavenly Principle possessing inexhaustible intrinsic dynamism. At the subjective level, this potential manifests as proactive sincerity continually emerging amidst resistance to deviant thoughts. In summary, the internal resonance theories proposed by Zhang Zai and Cheng Yi respectively feature the “motion within stillness” of the great void and the “constant motion” of the Heavenly Principle, representing two distinct patterns of inductive dynamics and avenues for self-cultivation. The two Confucian scholars expounded the potentiality of internal resonance from their respective unique perspectives, thereby infusing novel theoretical implications into traditional theories of resonance. This paper critically examines Scheler’s mid‑period religious theory, focusing on his pursuit of a harmonious cosmic order and religious experience by integrating Catholic theology and phenomenology. The argument has four key stages. First, I argue that the realization of this cosmic order, which enables communion with both the cosmos and God, relies on three elements: spiritual intuition, love, and faith in God’s reality. Second, I contend that these elements, in turn, originate from God’s self‑revelation and divine love, which establish a (...) bidirectional relationship between humanity and God. Third, I demonstrate that this mutuality is deepened through Scheler’s dual‑layered cosmic order, which employs analogy and phenomenological intuition to distinguish between the microcosm and the macrocosm. Finally, I identify two critical limitations in Scheler’s framework: his oversimplification of the divine–human asymmetry through analogy and his insufficient treatment of the origins of evil. Therefore, while Scheler’s synthesis offers valuable insights, it necessitates the further exploration of metaphysical and religious questions, particularly those concerning divine transcendence and the nature of evil. This article examines the neo-Confucian response to the question, “How to achieve the state of oneness,” as put forth by Cheng Yi and Cheng Hao. While both philosophers achieve this state through internal affectivity, their interpretations diverge significantly. Cheng Yi views internal affectivity as an inherent goodness that emanates from the pre-manifested mind but warns against emotional instability and desires. He thus rejects the notion of “teaching benevolence through perception.” (yijue xunren) and instead emphasizing the primacy of the unmanifested mind (...) in attaining oneness. Conversely, Cheng Hao stresses the inward perception of bodily sensations and supports “teaching benevolence through perception.” He argues that through sensory arousal and the transformation of vital energy, the mind and body can achieve harmony, thereby embodying the benevolence present in “heaven, earth, and all things.” This divergence in their approaches to oneness reflects their differing responses to Buddhism and contrasting views on human nature. Residents' high medical expenses is the core challenge that needs to be solved urgently in China's medical reform for a long time. Based on the panel data of 30 provinces in Chinese Mainland during 2011–2019, we evaluate the impact of China's national comprehensive medical reform pilot policy on residents' medical expenses by using the difference-in-differences model. The results show that the pilot policy was generally conducive to reducing residents' medical expenses, resulting in a reduction of 2.13% in per capita medical (...) expenses for inpatients, but the effect on per capita medical expenses for outpatients was insignificant. Mechanism analysis shows that hospital competition and institutional environment played a moderating role in the effect of the pilot policy on residents' medical expenses reduction. The more intense the hospital competition and the better the institutional environment, the more significant of the reduction effect. In addition, the reduction effect of the pilot policy was greater in the central provinces, the provinces with poor medical infrastructure, and the provinces with strong financial strength. This study provides useful policy insights for deepening medical reform and reducing residents' medical expenses. (shrink)

This paper presents five studies on the development and validation of a scale of intellectual humility. This scale captures cognitive, affective, behavioral, and motivational components of the construct that have been identified by various philosophers in their conceptual analyses of intellectual humility. We find that intellectual humility has four core dimensions: Open-mindedness (versus Arrogance), Intellectual Modesty (versus Vanity), Corrigibility (versus Fragility), and Engagement (versus Boredom). These dimensions display adequate self-informant agreement, and adequate convergent, divergent, and discriminant validity. In particular, Open-mindedness (...) adds predictive power beyond the Big Six for an objective behavioral measure of intellectual humility, and Intellectual Modesty is uniquely related to Narcissism. We find that a similar factor structure emerges in Germanophone participants, giving initial evidence for the model’s cross-cultural generalizability. (shrink)

Desire is an important philosophical topic that deeply impacts everyday life. Philosophical practice is an emerging trend that uses philosophical theories and methods as a guide to living a eu‐ daimonic life. In this paper, we define desire philosophically and compare different theories of desire in specific Eastern and Western traditions. Based on the Lacanian conceptual–terminological triad of “Need‐Demand‐Desire”, the research of desire is further divided into three dimensions, namely, the subject of desire, the object of desire, and the desire (...) itself. The concept of desire is then an‐ alyzed from this triad and these three dimensions through different philosophical theories. This paper selects Buddhism as the representative of Eastern tradition, and Stoicism as the representative of the West, paying special attention to Stoicism’s “spiritual exercises” following Pierre Hadot. By exploring and comparing the Buddhist paths to liberation from suffering (i.e., the Four Noble Truths and the Noble Eightfold Path) and the two theoretical pillars in Stoicism (i.e., the notions of “living according to nature” and “the dichotomy of control”), practical guidance is then provided for un‐ derstanding and regulating desire in times of crisis. This understanding and regulation of desire constitutes a philosophical therapy for today’s troubles, particularly those caused by excessive or irrational desires. (shrink)

Background: Postoperative pneumonia is a preventable complication associated with adverse outcomes, that greatly aggravates the medical expenses of patients. The goal of our study is to identify risk factors and outcomes of postoperative pneumonia.

Aworkshop was held August 26–28, 2015, by the Earth- Life Science Institute (ELSI) Origins Network (EON, see Appendix I) at the Tokyo Institute of Technology. This meeting gathered a diverse group of around 40 scholars researching the origins of life (OoL) from various perspectives with the intent to find common ground, identify key questions and investigations for progress, and guide EON by suggesting a roadmap of activities. Specific challenges that the attendees were encouraged to address included the following: What key (...) questions, ideas, and investigations should the OoL research community address in the near and long term? How can this community better organize itself and prioritize its efforts? What roles can particular subfields play, and what can ELSI and EON do to facilitate research progress? (See also Appendix II.) The present document is a product of that workshop; a white paper that serves as a record of the discussion that took place and a guide and stimulus to the solution of the most urgent and important issues in the study of the OoL. This paper is not intended to be comprehensive or a balanced representation of the opinions of the entire OoL research community. It is intended to present a number of important position statements that contain many aspirational goals and suggestions as to how progress can be made in understanding the OoL. The key role played in the field by current societies and recurring meetings over the past many decades is fully acknowledged, including the International Society for the Study of the Origin of Life (ISSOL) and its official journal Origins of Life and Evolution of Biospheres, as well as the International Society for Artificial Life (ISAL). The thorny problem, which we are confronted with in translating the term of “Sein”(Being) from western Philosophy into Chinese, highlights the ambiguity, paradoxy and vagueness of the issue of Sein from a specific viewpoint. Although there is no exact equivalent in Chinese for the word of “Sein”, we use several different words to express the meanings consisted in the issue of “Sein”. By comparison we may find that what is discussed by Zhuang Zi using the terms of “Shi” and “Fei” (...) are just in a considerable degree the same issue discussed by Heidegger using the terms of “Sein” and “Dasein”. This article explores the essence of the human (insān) as it is understood in Twelver Shīʿī philosophy and mysticism. It presents a Shīʿī philosophical elucidation regarding the possible existence of extraterrestrial intelligent lifeforms and what their relationship with “humanhood” might be. This line of reasoning is presented with a general sketch of how, in Shīʿī Islamic thought, a “human being” is characterized by specific traits and the relationship of human beings with the archetype of the Perfect Human (al‐Insān al‐Kāmil). Following (...) this is a review of Shīʿī Imāmī traditions regarding extraterrestrial intelligent life and the plurality of worlds. This sequence ultimately allows for a unique analysis of humanhood according to the Shīʿī philosophical viewpoint and helps determine if the term “human” can be used for other intelligent beings with similar ontological features and intelligence levels. Hui Shi (370-310B.C.E.?) is a unique one among the pre-Qin scholars. The object and orientation of his scholarship emphasized on “chasing after the materials” or the research for objective knowledge of natural things. He shows a tendency of tolerating and advocating diversity and variety, and intentionally pursuing new and unusual ideas. In certain degree he judges the value of knowledge by its truthfulness rather than its usefulness. As pointed out by Wing-tsit Chan, Hui shi represents a “tendency in ancient China (...) toward intellectualism for its own sake”. (shrink)

In this article, we develop the intersection of Shīʿī Islamic philosophy and extraterrestrial life. We explain the view of Ḥukamā (Islamic Philosophers) and what implications it holds for asserting a plurality of worlds and life forms. In addition to this, we bring Shīʿī hadīth sources which also suggest the existence of other life forms outside the earth. Combining the philosophical and textual evidence, we argue that the Shīʿī school not only suggests the existence of extraterrestrial life but also provides a (...) potential framework for possible human-extraterrestrial interactions. This book researches the thought of Jin Yuelin’s epistemology with some notions and methods of contemporary epistemology as the frame of reference. There are two kinds of academical significance in this book, one is that author has accurately comprehended the specific content, inadequacies and contradictions in Jin’ s epistemology, recognized the methods by which Jin Yuelin built his theory of knowledge. The other is that author has known about the differences in research objects and methods between Jin’s theory and contemporary (...) epistemology, and showed the position of Jin’s epistemology in the whole theory of knowledge through the comparative study. On the one hand, the book focuses on the core problem of Jin Yuelin’ epistemology that is how objective knowledge is produced. On the other hand, it is made up of seven chapters in accordance with the structure of Jin’s Theory of Knowledge. The first chapter introduces and comparatively analyzes the comprehensions about the concepts of “knowledge” and “epistemology” between Jin Yuelin and contemporary epistemologists. This chapter supplies the means and methods for following chapters. The second chapter describes Jin’s standpoint and criticism to idealism starting mode, analyzes the objective starting mode that belongs to Jin’s theory and reveals his negative attitude to skepticism. This chapter shows the essential characteristics of the Jin Yuelin’s epistemology. The given is the content of sensation, which is the most basic part of cognitive activity. Moreover Jin Yuelin regards sensation as foundation of knowledge, so the research on theory of the given is separated from the whole study of cognitive activity and treated as the third chapter, which presents Jin’s theory of the given and analyzes the problems of Jin’s theory, then introduces some kinds of theory of the given and theory of perception in the contemporary epistemology, finally comparatively investigates theories of the given between Jin Yuelin and contemporary epistemologists. From the perspective of cognitive activity, the fourth chapter describes the perceptual activity, the activity of knowing, the activity of thinking, means and outlines of reception in Jin’s epistemology, then exposes its contradictions and inadequacies; Induction is the important research object of the Western epistemologists, similarly Jin Yuelin paid more attention to induction and regards the principle of induction as outline of reception. In fact, his standpoint about the principle of induction is vital and creative, so the study of induction separately belongs to the fifth chapter. This chapter presents the Jin’s comprehension about the principle of induction and some answers to the problem of induction in contemporary epistemology, then comparatively analyzes two kinds of the thought about induction. The sixth chapter successively introduces being, nature and fact which all are objects of cognitive activity, then analyzes the problems within them. From the perspective of cognitive results, the last chapter presents the Jin’s standpoint about verification and demonstration of proposition, definition and criteria of truth, then simply describes the point views of contemporary epistemologists about verification and truth of proposition, finally comparatively investigates two kinds of thought. From the vertical, the thesis analyzes the fundamental sections of objective knowledge one by one, such as the given, experience, idea, proposition and truth. From the horizontal, the book focuses on the three main parts of knowledge event, for example, cognitive activity, objects of knowledge and the true proposition treated as knowledge. In a word, the whole book is coherent and organic unity. Through the comparative study, it can be concluded that it is reasonable for Jin Yuelin to enjoy a high academic status, because he is the first philosopher who specializes in the study of epistemology. At the same times, he improves transmission of logic, metaphysics and epistemology from the Western to China. So, his hard work enriches and expands the realm of Chinese philosophy. With the development of the study of epistemology, descriptive content of it, such as, perceptual activity and rational activity, will be regarded as the objects of psychology and cognitive science. Meanwhile, normative content will be retained. For example, analysis of conditions of knowledge, justification for belief claims, comprehension about the proofs of justification, as well as reactions to challenges of skepticism. The latter will continue to be objects of epistemology, of course, they must establish close relationships with psychology and cognitive science. According to this prospect, we should split Jin Yuelin’s theory of knowledge, of which the descriptive content would be allocated to psychology and cognitive science. Robert Orsi’s History and Presence identifies a major lacuna in the modern understanding of religion. If secularism is characteristic of the modern era, Orsi argues that it is not the absence of the faith. Instead, it is the approval of a certain kind of religion in which the "real presence," an interaction of sacred, metaphysical realm in the everyday life of the faithful, is ignored. While considering Orsi’s critique, this paper investigates the notion of presence in Shi'i Islam along with (...) a brief study of similar notions in Catholicism and Judaism. This paper argues that the notion of presence or hudur plays a significant role in the everyday life of Shiʻi Muslims and attempts to define it according to the context of visitation prayers and the narrations of the Shi'i Imams. It moreover suggests that this overlooked aspect in the modern study of religion could provide grounds for a more empathetic dialogue of religions. (shrink)

This article analyzes Mencius 7B.23, a concise passage that offers complex ethical dilemmas. It provides a close reading of the passage, along with relevant passages elsewhere in the text and, occasionally, in other texts. The narrow goal of the article is to present a coherent reading of the passage within the context of the Mencius as a whole. This reading suggests that while the passage touches upon a wide range of topics, including personal credibility and political responsibility, the overarching concern (...) is on being a morally superior person, on the difficult dilemmas such people may face, and on how they would respond to them. More broadly, the article shows that while the philosophical practice of "weighing circumstances" (quan 權) allows moral agents in exceptional cases to break certain moral or ritual rules, Mencius seems unwilling to apply this discretion when morality as a whole, or the integrity of the person who embodies it (shi 士), are involved. Artists rarely shy away from a drink and other psychoactive substances, yet it seems that there has never been much discussion on what aesthetic or artistic relevance this has to their works and their reception. I outline the scale of the phenomenon focusing on some prominent examples and distinguish a subset of what I call ‘high artworks’. In such artworks, I argue, drug experiences are encoded: their drug-related contextual and intrinsic properties or content are aesthetically or artistically relevant and should (...) be mentioned in any in-depth analysis. I then further argue that it is impossible or at least very difficult to fully appreciate or produce optimal evaluations of a high artwork, unless one has oneself had drug-induced experiences of the kind encoded in the work. This is because such experiences afford one the relevant phenomenal knowledge that is otherwise inaccessible, yet required to gain an adequate level of competence allowing one to fully grasp the work. Why engage in inquiry? According to many philosophers, the goal of inquiring into some question is to come to know its answer. While this view holds considerable appeal, this paper argues that it stands in tension with another highly attractive thesis: knowledge does not require absolute certainty. Forced to choose between these two theses, I argue that we should reject the idea that inquiry aims at knowledge. I go on to develop an alternative view, according to which inquiry aims at (...) maximizing the epistemic value of our credences. This alternative view makes room for knowledge that falls shy of certainty, and it coheres nicely with a rich body of work in epistemic decision theory. I proceed to highlight the implications of this replacement for some important topics in epistemology, including the dogmatism paradox, the nature of interrogative attitudes, and the norm of practical reasoning. She adroitly analyzes the main concepts that inform Du Bois’s critique of American democracy, such as the color line and double consciousness, before examining how these concepts might inform our understanding of contemporary struggles, from Black Lives Matter to the campaign for reparations for slavery. She stresses the continuity in Du Bois’s (...) thought, from his early writings to his later embrace of self-segregation and Pan-Africanism, while not shying away from assessing the challenging implications of his later work.This wonderful book vindicates the power of Du Bois’s thought to help transform a stubbornly unjust world. 1 Introduction1 In the 1980s, hermeneutics was often incorporated into deconstructionism and literary theory. Rather than focus on authorial intentions, the nature of writing itself including codes used to construct meaning, socio-economic contexts and inequalities of power,2 Gadamer introduced a different perspective; the interplay between effects of history on a reader’s understanding and the tradition(s) handed down in writing. This interplay in which a reader’s prejudices are called into question and modified by the text in a fusion of understanding and (...) topic revitalized the study of the printed word. Gadamer’s turn to language for understanding the meaning of Being also appealed to the post-modern antipathy toward modernity and metaphysics.3 If the truth and validity of interpretations are limited to communities of language, then our mode of being in history cannot but be historical. This point of view rendered Gadamer’s phenomenological hermeneutics vulnerable to the critique of moral and epistemological relativism. However, Gadamer’s theory of interpretation also stems from re-examination of the beginning of knowledge in the Pre-Socratics and Plato, and on this basis, is receptive to another dimension of inquiry than that which was trending in North America. -/- At the East-West Center, University of Hawai’i at Manoa in 1982, Chung-ying Cheng for the first time introduced onto-hermeneutics to an audience of esteemed philosophers including Li Zehou, Ren Jiyu, Feng Youlan, and Zhang Liwen.4 In contrast to schools of deconstruction and literary theory that had disengaged the interpreter from trans-historical sources of meaning and truth, Cheng explained that interpreters exist within a cosmological order inextricable from responsibility to harmonize Heaven and Earth in creative acts of interpretation. By integrating Chinese cosmology into hermeneutics through ontology, he tacitly challenged philosophers in the West to re-examine assumptions about humanity’s place in nature and by implication, Gadamer’s recovery of the beginnings of knowledge in Western philosophy. -/- Cheng’s Neo-Confucianism is inspired by the method and goals of Thomé H. Fang. The following words by Fang seem to prefigure, although in an indistinct and bundled way, aspects of Cheng’s philosophy including a Mencian theory of human nature, comprehensive observation, and creativity: “In the very process of living in concord with creative Nature, Man is charged with an ideal to be fully realized in the light of the principle of comprehensive harmony.”5 Like Fang, Cheng reinvigorates Chinese culture and language, but not solely in order to vindicate the insights of Neo-Confucianism. He has studied Western thought, from pragmatism and the analytic school to German idealism and phenomenology, to unlock and clarify philosophical concepts within the Yijing tradition and thereby render them intelligible to Anglophones. The result has been an awakening of Western scholars to the moral and cultural consequences of decoupling their thought from metaphysical foundations that are neither dogmatic nor doctrinal. -/- Not unlike the dialectic of Gadamer’s dialogue form, onto-generative hermeneutics integrates contrary positions on the same topic in order to blend both sides into a world philosophy, or as Cheng says, a “totalizing or integrative theory,”6 not to be confused with a theoretical rewording of a theory. On the contrary, the universal scope and relevance of hermeneutics stems from personal experience. Just as Gadamer, in response to faction and strife, immersed himself in Plato during the war years, and developed a method with which to harmonize opposites, so too, according to On-cho Ng, was Cheng moved by faction, strife and political persecution to develop a path toward unity.7 Gadamer taught at McMaster University in Hamilton, Ontario, and Cheng at the University of Hawai’i at Manoa among other institutions in North America. They facilitated trans-continental educational and cultural ties. Similar experiences yield similar insights irrespective of differences of time and place. Hence, authors in this issue who reside in Europe, China and North America, delineate the differences between Gadamer and Cheng, yet also, in light of Cheng’s onto-generative method and cosmology, develop integrative theories. Due to the page-budget restriction of the publisher, certain articles of this special theme will be subsequently published in the next issue. -/- 2 Integrative Theory This special issue of The Journal of Chinese Philosophy confirms a dimension of hermeneutics that Cheng has both motivated and inspired. The contributors do not abide by the conviction that since thought is mediated by language, interpretations cannot transcend culture. On the contrary, their research exemplifies the fruits of trans-historical onto-dialogical hermeneutics within limits defined by their field inquiry, organized into Parts I and II, around three themes: language, the philosophy of history and ethics. -/- Andrew Fuyarchuk introduces the theme of ontology in relation to Gadamer’s turn to language. Fuyarchuk argues that Chung-ying Cheng’s criticism of Gadamer’s hermeneutics is informed by Heidegger’s concept of Dasein and thereby overlooks how Gadamer’s Platonic-Pythagorean problem of the division between the One and Many is harmonized in the event of language, which in turn positions Gadamer in proximity to the presupposed grounds of receptivity in Cheng’s onto-generative hermeneutics. Lauren Pfister’s contributing article addresses the year 2000 meeting between Cheng and Gadamer in Heidelberg and expands the transhistorical grounds of meaning in Gadamer to matters of theology. Pfister’s summary of the written Chinese record of their conversation indicates that Cheng does not address the role of Christian philosophy and hence, the role of the inner word in Gadamer’s hermeneutics. This is important not only for detecting changes in Cheng’s philosophical development, but also for modifying his hermeneutics along the lines of a living conversation, possibilities explored by Pfister in a sequel to the article submitted to this issue. Nevertheless, by raising the issue of how Gadamer’s turn to language for understanding the meaning of Being extends possibilities in Cheng’s thought, Pfister anticipates the article by Katarina Gajdosova. She returns to the roots of Chinese thought during the Warring States period and broadens the meaning of names in recently excavated texts. Contrary to the conventions about how to understand terms, she appeals to both Heidegger’s ontology and Cheng’s notion of receptivity and creativity to reinterpret naming in relation to cosmology. Along the same lines, insofar as the event of Being is lingual, Jay Goulding captures its emergent structure in an evolving community of scholars and scholarship. He recalls his philosophical journey toward Cheng’s philosophy that begins in conversations with Gadamer at McMaster University in Hamilton, leads to Heidegger and Asian thought, expands into turning points with teachers and colleagues from various backgrounds that by increments contributed to Goulding’s formulation of “Daoist phenomenology.” -/- Although differing traditions guide their inquiries and research, Cheng and Gadamer recall the wisdom of the past to ameliorate the fragmentation in contemporary life. This leads them to re-examine the origins of philosophy; historical roots and thus sources of creative re-interpretations East and West whose affinities are developed in contributions by Hyun Höchsmann and Friederike Assandri. Höchsmann assesses convergences and divergences in the origins of Chinese and Western philosophy (Confucius and Socrates, the Yijing and Pre-Socratics) that culminates in pairing Gadamer’s understanding of paideia in the context of Plato’s political cosmology in the Timaeus with moral and social cultivation in The Western Inscription. She delineates the limits of this comparison which in turn justifies introducing Vattimo’s notion of locality. Assandri’s comparative analysis moves between India and China, Buddhism and Tang Daoism. Based on Gadamer’s argument that writing detaches concepts from their cultural moorings, she defines and applies three levels of understanding in onto-generative hermeneutics to Buddhist terms that were assimilated into the Benji Jing and in so doing clarifies essential dimensions of Daoism. -/- Contributions by Stephen Palmquist and Nicholas Brasovan position Cheng in relation to Kant and Gadamer by way of Aristotle’s ethics respectively. On the one hand, Palmquist plots Cheng’s evolving criticism of Kant’s moral philosophy and draws on crucial dimensions of Gadamer’s hermeneutics to reposition that criticism in a constructive relation to Kant’s emphasis on the philosophical conditions of morality while also indicating how religious dimensions of his thought answer Cheng’s concerns for lived moral action. For Palmquist, Gadamer enables a constructive criticism of Cheng. On the other hand, Brasovan compares Cheng’s Yijing-based account of moral deliberation with Gadamer’s Aristotelian-based ethics and reasons that in contrast to Cheng, Gadamer’s hermeneutical consciousness is disengaged from practical knowledge. For Brasovan, Cheng is a constructive critic of Gadamer. Palmquist and Brasovan’s divergent angles on Gadamer and Cheng map onto a dialectic of contrast and complementarity that constitutes the inner logic of Cheng’s philosophy. In other words, Gadamer and Cheng ought to be read alongside one another for the sake of removing discrepancies and contradictions, which constitutes the organic structure of their thinking. -/- 3 Our Mode of Being in History Is Not Historical The conversations between Cheng and Gadamer in this issue of The Journal of Chinese Philosophy pivot on language, philosophy of history and ethics within a comparative framework of analysis, but also explore the grounds that make the comparisons possible. Those grounds are informed by Chinese cosmology, and function to wrest Gadamer from the shadow of Heideggerian facticity and reposition him within the range of Cheng’s ideas about our place in nature that is embedded in his question about how mind emerges from inorganic matter.8 -/- For Gadamer scholars of Heidegger, human finitude, our ownmost individuating death ensures that hermeneutics is always open to the other as other, always on the way toward understanding the meaning of Being. To arrest the process in a concept of “the Absolute” cannot but represent someone’s point of view, and thereby render hermeneutics indistinguishable from ideology. However, insofar as finitude is defined by them in terms of an onto-theological concept of immorality, finitude is a metaphysical concept consistent with epistemologies and confuse beings with the meaning of Being. As a result, the celebrated political value of hermeneutics to always be on the way toward an understanding of the meaning of Being admits subtle variations on the same worldview that are insufficiently self-critical. -/- Gadamer scholars of Heidegger are right. A transformation in ethos and opening to the meaning of Being depends on awareness of finitude. Yet this awareness does not yield openness to more of the same, i.e., discourse structurally incapable of coming to unity but instead, for both Gadamer and Cheng, openness to a distinctly different ontological dimension of reality. As Sandra Wawrytko and So-Seong Park indicate,9 this ontological dimension is prefigured in the experience of being-as-a-whole or the totality of all possible relations in both Chinese totemic shamanistic rituals,10 and Greek Dionysian festivals.11 Through these religious experiences human ethos and therefore consciousness is expanded and elevated from being centered on one’s ownmost concerns toward an affinity with all sentient beings from insects and plants to animals. The channel for this affinity is an auditory disposition and hence, the emotions, compassion, and feeling response. -/- The capacity for an auditory disposition, or as Gadamer calls it, listening consciousness to respond to the inter-relationality and therefore inherent balance of nature is developed through music, song and dance of the religious rituals and festivals. They facilitate the unity of mind with nature. This use of music, that transforms ordinary consciousness, explains Cheng’s emphasis on the receptivity of feeling response in comprehensive observation, and Gadamer’s emphasis on openness to the other in attunement. However, an auditory disposition characteristic of pre-literate oral cultures that reveals the “All” need not rely on religion. As theorists about the evolution of language have explained,12 modern languages preserve their pre-historical past in music or prosody. That is to say, the song and dance that revealed the totality of inter-related beings to an ethos of comprehensive observation and attunement toward beings in classical civilizations is retained in the back-and-forth movement or rhythm of the dialogue form. Our mode of being in history is a mode of being in nature – through the music of language. -/- While alerting the reader to the limits of a nominalist interpretation, Gadamer expresses the inner law of the nature as follows: “in perishing there is always becoming, and in becoming there is always perishing.”13 Considered in process, opposites generate and blend into each other. This law of nature applies to everything.14 Hence, in a manner comparable to Pfister’s concluding insights, onto-dialogical hermeneutics is not only open to discrete events of otherness but moreover, to the moving structure of reality expressed, as Gajdosova suggests, in the existential moment of naming. Considered as interplay of tension and resolution with a life of its own, the dialectic of a dialogue is self-similar to the way in which an organism grows (by instinct). There is, therefore, a sense in which the art of interpretation extends the human mind into the eternal cycles of nature such that we participate in the articulation of the inner telos/homeostasis toward which all beings strive and importantly for Gadamer scholars of Heidegger, within the material limits of energy to which our embodied minds are self-evidently subject. In the Western philosophical tradition, the earliest recognized paradoxes are attributed to Zeno of Elea (ca. 490–430 B.C.E.) and to Eubulides of Miletus (fl. 4th century B.C.E.). In the Chinese tradition, the earliest and most well-known paradoxes are ascribed to figures associated with the “School of Names” (ming jia 名家), a diverse group of Warring States (479–221 B.C.E.) thinkers who shared an interest in language, logic, and metaphysics. Their investigations led some of these thinkers to propound puzzling, paradoxical statements such (...) as “Today go to Yue but arrive yesterday,” “White horses are not horses,” and “Mountains and gorges are level.” Such paradoxes seem to have been intended to highlight fundamental features of reality or subtleties in semantic relations between words and things. Why were thinkers who advanced paradoxes categorized as a school of “names”? In ancient China, philosophical inquiry concerning language and logic focused on the use of “names” (ming 名, also terms, labels, or reputation) and their semantic relations to “stuff” (shi 實, also objects, features, events, or situations). Hence for classificatory purposes, second-century B.C.E. Han-dynasty archivists grouped together assorted pre-Han figures whose most prominent ideas seemed to concern the relation between names and stuff—or at least strange, unorthodox uses of names—and dubbed them a school or lineage (jia 家) devoted to the study of names. Unfortunately, both the label and the grouping are misleading. Historically, the school was a retrospective, taxonomical fiction. The figures classified under the “School of Names” never formed a distinct circle, movement, tradition, or line of influence devoted to any particular doctrine, theme, method, or way of life. Their intellectual interests overlapped at most only partly, while also overlapping extensively with those of texts associated with other schools or traditions, such as the Mohist “Dialectics” 墨辯, the Zhuangzi 莊子, the Xunzi 荀子, and the Annals of Lü Buwei 呂氏春秋. What perhaps does set the School of Names apart is that some (though not all) of the figures associated with it apparently delighted in propounding paradoxical or preposterous sayings, while the other texts just mentioned generally (though not exclusively) seek to explain and debunk such utterances. Simon Blackburn has not shied away from the use of vivid imagery in developing, over a long and prolific career, a large-scale philosophical vision. Here one might think, for instance, of ‘Practical Tortoise Raising’ or ‘Ramsey's Ladder’ or ‘Frege's Abyss’. Blackburn develops a ‘quasi-realist’ account of many of our philosophical and everyday commitments, both theoretical (e.g., modality and causation) and practical (e.g., moral judgement and normative reasons). Quasi-realism aims to provide a naturalistic treatment of its targeted phenomena while earning the (...) right to deploy all of the ‘trappings’ of realism—i.e., while eschewing any idea that our normal thought and talk about such phenomena are pervasively in error. The quasi-realist project is that of explaining how (as Huw Price puts it here) ‘the folk come to “talk the realist talk” without committing ourselves—us theorists, as it were—to “walking the metaphysical walk”’ (p. 136). Quasi-realism, too, can speak of truth, facts, properties, belief, knowledge, and so on. The imagery in this collection also abounds, though, in capturing a different view of quasi-realism: No fewer than three of the contributors picture Blackburn as wanting to have his cake and eat it too (Louise Antony asking, in addition, ‘Who doesn't? Abstract This article delves into the study of the term «tark-i awlà» (abandoning performance of that which is better and doing that which is less than better) as an approach for defending the infallibility of the prophets when confronting verses from the Holy Qur‘ān that apparently prove the prophets committed sins; and after going into the semantics of «tark-i awlà», the following question has been made the focus of discussion and study: are the intellectual arguments proving the infalliblity of the (...) Prophets in agreement with the fact that the prophets committed tark-i awlà? According to the author, considering that tark-i awlà is a type of error and lapse and because the intellectual arguments for infallibility (like the trust and certitude of the people, the guiding purpose of prophet hood, the necessity of following the prophets, the principle of luṭf (grace) and absence of disinclination in the hearts of the people towards the prophets) necessitate the negation of all types of errors and lapses from the prophets, the prophets must be infallible from tark-i awlà too and this approach by Islamic theologians in justifying the verses that indicate the committing of sins by the prophets is not successful. Accepting the committing of tark-i awlà by the prophets is to accept that they committed errors and is against the belief of the Shi‘a regarding the infallibility of the prophets. As a result, Shi‘a theology will face a great challenge in justifying the verses that indicate the committing of errors and lapses by the Prophets which, according to the author, necessitates a revision of the Shi‘a theological belief in regards to the absolute infallibility of the prophets. The German pioneer of electrophysiology, Emil du Bois-Reymond (1818–1896), is generally assumed to have remained silent on the subject of the brain. However, the archive of his papers in Berlin contains manuscript notes to a lecture on “The Seat of the Soul” that he delivered to popular audiences in 1884 and 1885. These notes demonstrate that cerebral localization and brain function in general had been concerns of his for quite some time, and that he did not shy away from these (...) subjects. (shrink)

This paper leads us in reflections regarding the ontological status of a situation inspired by two main sources: the Zhuangzi--a multifarious compilation from Warring States China (ca. 4th c. BCE)--and José Ortega y Gasset's (1883-1955) Unas Lecciones de Metafísica (Some Lessons in Metaphysics)--the transcripts of a course on metaphysics by a Spanish philosopher of the early 20th century. Much as other ontologically subjective entities and events, situations do not preexist the intentional subject: instead, they are created alongside our act of (...) noticing. In Classical Chinese, shi , commonly rendered "propensity" and the closest the language comes to our concept of situation, denotes a dynamic process that incorporates the conscious subjective agent as well as other entities as constitutive elements. Here a situation is not reducible to the discrete phenomena and events that we can discern within a given space-time; rather, it necessitates our thinking about it to arise. These ontological reflections are important for a philosophy of action. They help us notice the role of attention in the creation of situations--as in the creation of worlds--hence the importance of understanding what the agent notices and fails to notice, what we privilege as worthy of our attention and what passes inadvertent among the world's plural affordances. The relational affordances that we actualize and reify as constituting a situation depend on what we are socialized and educated to see when looking at the world, thus situations and agents co-create one another over time. This acknowledgement is crucial to retrain our agency in order to illuminate our blind spots, overcome our uncritical certainties which generate absolutist tendencies, and move beyond fixed, reduced, and contingent corners from which to interpret the world. Ever since its inception, the theory of evolution has been reified into an “-ism”: Darwinism. While biologists today tend to shy away from the term in their research, the term is still actively used in the broader academic and societal contexts. What exactly is Darwinism, and how precisely are its various uses and abuses related to the scientific theory of evolution? Some call for limiting the meaning of the term “Darwinism” to its scientific context; others call for its abolition; yet (...) others claim the term refers to a myth-like story. In this paper we propose a conceptually grounded overview of the term. We show how the scientific dimension of Darwinism feeds into, and is influenced by, guises of Darwinism as a methodology and as an ethically and politically charged “worldview”. The full meaning of Darwinism, as well as how this meaning has changed over time, can only be understood through the complex interaction between these three dimensions. (shrink)

Faik Kurtulmuş’s exploration of the epistemic basic structure (EBS) invites us to think about the generation, dissemination, and absorption of knowledge in a society, emphasizing the role of institutions in determining epistemic outcomes. Moreover, Kurtulmuş—in joint work with Gürol Irzık—offers a normative take on the EBS from the viewpoint of the theory of justice and does not shy away from drawing specific policy recommendations. Thus, a powerful, innovative concept is used to extend an influential theory and draw out its practical (...) implications. What more is there to wish for? A project of such ambition inevitably faces serious challenges. I address the issue of the alignment between the ideal and non-ideal elements of Kurtulmuş’s theory with an eye toward the practicalities of social reform. My central claim is that the philosophers striving to promote distributive epistemic justice need to think carefully about whom they intend to address with their proposals and how to persuade such addressees. I also maintain that emphasis on a holistic approach to social reform represents a major hindrance to its pragmatic success. (shrink)

People sometimes knowingly undermine the achievement of their own goals by, e.g., playing the lottery or borrowing from loan sharks. Are these agents acting irrationally? The standard answer is “yes.” But, in a recent award-winning paper, Jennifer Morton argues “no.” On her view, the norms of practical reasoning an agent ought to follow depend on that agent’s resource context (roughly, how rich or poor they are). If Morton is correct, the orthodox view that the same norms of practical rationality apply (...) to all agents needs revision. I argue that Morton’s arguments fail on empirical and philosophical grounds. What’s at stake? If Morton is correct, poverty relief agencies ought to re-design their incentives so resource-scarce agents can rationally respond to them. If I’m correct, resource-scarce agents do act irrationally in the cases under discussion, and we shouldn’t be shy about saying so. Instead of declaring them rational, we should try to understand the causes of their irrational behavior and help them better succeed by their own lights. (shrink)

The debate about the definition of Latinidad as a social identity has fluctuated between accounts that put it closer to ethnicity or closer to race. We present and defend the claim that the multiplicity of features and experiences of Latinxs in the United States is best accounted for by placing Latinidad in a different theoretical space. We draw from the ecological psychology and enactive literature on affordances to argue that Latinidad can be better understood as a social identity affordance: a (...) multifaceted landscape of possibilities for interaction, to do and to be done unto. We then focus on four areas that are part of the objective factors that have come to constitute Latinidad and which provide reasons to shy away from both race and ethnicity: the facts of mestizaje and hybridization, a vexed relation to the land, the political horizons and histories of this population, and the multiplicity of sensory-based cultural practices of Latinxs. It is precisely the many and deep variations across Latinxs that make social affordances an apt way to conceptualize a social identity whose reality is asserted pragmatically in many aspects of social life in the U.S. (shrink)
