El derecho a la propiedad forma parte indiscutible de la historia y evolución del constitucionalismo, y encuentra su reconocimiento en el artículo 33 de la Constitución Española delimitado por su función social. Cuando se van a cumplir 40 años de nuestra Carta Magna es un buen momento para realizar una revisión de su configuración en nuestro sistema constitucional y, teniendo en cuenta la apertura de nuestro texto constitucional, aproximarnos al mismo desde una perspectiva multinivel, atendiendo por tanto a la importancia (...) de su configuración en el nivel externo, en especial en el Convenio Europeo de Derechos Humanos y en el Derecho de la Unión Europea. This paper introduces pragmatic hypotheses and relates this concept to the spiral of scientific evolution. Previous works determined a characterization of logically consistent statistical hypothesis tests and showed that the modal operators obtained from this test can be represented in the hexagon of oppositions. However, despite the importance of precise hypothesis in science, they cannot be accepted by logically consistent tests. Here, we show that this dilemma can be overcome by the use of pragmatic versions of precise hypotheses. These pragmatic (...) versions allow a level of imprecision in the hypothesis that is small relative to other experimental conditions. The introduction of pragmatic hypotheses allows the evolution of scientific theories based on statistical hypothesis testing to be interpreted using the narratological structure of hexagonal spirals, as defined by Pierre Gallais. Health data processing fields face ethical and legal problems regarding fundamental rights. As we know, patients can benefit in the Digital Era from having health or medical information available, and medical decisions can be more effective with a better understanding of clinical histories, medical and health data thanks to the development of Artificial Intelligence, Internet of Things and other Digital technologies. However, at the same time, we need to guarantee fundamental rights, including privacy ones. The complaint about ethical and legal (...) requirements – including constitutional ones – is particularly relevant in the processing of health data. This paper is focused on the problem of the consent required to the processing of health data and the exceptions established in the new European Union General Data Regulation, which cover the processing of this special data -within other aims- for scientific, historical and statistical research as legitimate purposes, which include biomedical research. The conclusion is that these open concepts are problematic both for the protection of privacy rights and for the legal security/certainty of research. On one hand there are several interpretation problems, regarding the processing of health data and the protection of information privacy. On the other hand, professionals must follow the Multilevel legal framework and to guarantee fundamental rights in the processing of health data, so there are also problems of interpretation for researchers. Aportaciones heurísticas a la investigación en el derecho constitucional. Los principios democráticos en la doctrina constitucional española como ejemplo práctico.

La protección de los derechos fundamentales en el sistema multinivel europeo exige de criterios hermenéuticos que posibiliten la delimitación del contenido y extensión del derecho fundamental en juego. Así, debemos considerar los derechos fundamentales reconocidos a nivel nacional (Constituciones), internacional (Convenio Europeo de Derechos Humanos) y de la Unión Europea (Carta de Derechos Fundamentales de la Unión Europea). -/- Es necesario delimitar los criterios de interconexión más adecuados para llegar a los criterios de interpretación de los que se deriven las (...) exigencias y garantías de los derechos fundamentales. En el marco de los países miembros de la Unión Europea, que son a su vez parte del Consejo de Europa, es donde se da este sistema multinivel a tres bandas, donde será necesario analizar los criterios de interconexión desde el derecho de la Unión Europea, que es el que consagra el criterio del máximo nivel de protección aplicable, tras la entrada en vigor del Tratado de Lisboa el 1 de diciembre de 2009, y que como veremos es compatible con los límites constitucionales consagrados en la doctrina constitucional de los Estados miembros, así como con el Convenio Europeo de Derechos Humanos (teniendo en consideración la futura adhesión de la UE), puesto que este criterio implica que a la hora de tutelar los derechos fundamentales habrá que buscar el nivel más alto de protección de los mismos. Resumen: El régimen jurídico de la utilización de los drones plantea grandes retos, siendo esencial un estudio que atienda a los diferentes niveles de regulación, que al menos en la Unión Europea están afectados de provisionalidad y contingencia; así ocurre con el Reglamento 216/2008. Lo mismo ocurre a nivel interno en el Derecho español con la Ley 18/2014 y el nuevo proyecto. Sin embargo, es necesario establecer una adecuada regulación del uso civil de los drones y de la tecnología incorporada (...) -que está en constante desarrollo- garantizando al mismo tiempo seguridad jurídica para las operaciones con drones, y el respeto de los derechos fundamentales que pueden verse afectados, y ello desde una perspectiva multinivel (UE, interno). Este trabajo pretende precisamente un análisis de la actual normativa europea y española desde esa perspectiva, atendiendo en particular al uso civil de los drones. Abstract: The legal framework the use of the drones points out great challenges, and it is essential to develop a study to attend the different levels of regulation, that at least in the European Union, we can see with provisionality and contingency, as it is the case of the Regulation 216/2008. The same thing happens internally in Spanish Law with the Law 18/2014. However, we need to establish an adequate regulation of the civilian use of drones and embedded technology - which is in constant development - while ensuring legal security for drone operations, and respect for fundamental rights that may be affected, with a multi-level legal perspective (EU, internal). Hay doble pulsión en el centro de la discusión del razonamiento deductivo. Una conduce aparentemente a la abstracción y dominios arbitrarios, mientras que la otra conduce a la concreción y la dependencia del contenido. El objetivo de esta investigación es diseñar, aplicar y validar un instrumento de evaluación que nos permita corroborar si el razonamiento deductivo maneja reglas lógicas o contenidos. La muestra de estudio se compuso de 80 participantes (edad 18-77 años). El test consta de 60 ítems categorizados en: (...) formalidad, integrabilidad, complejidad y modalidad. Los resultados ponen de manifiesto la fiabilidad del test de razonamiento deductivo con un alpha de Cronbach. 775 y con un índice de validación. 850 para el índice de inteligencia no verbal (INV) del RIAS. Cómo conclusión inferimos que el razonador deductivo no dispone de un cuerpo preciso de reglas generales deductivas, sino que usa colecciones de reglas heurísticas cada vez menos abstractas. It is the aim of this work to study the assumptions and conditions for the original position of sameness in experience, just as it occurs in the synthesis of the datum singular and distinct. The polarization of single tone (einstimmig) intentional rays in an αvτó already contains the aporiae peculiar to the experience of the identical, whose revelation shall lead us, on the one hand, to one of the nuclei of the analysis of passive synthesis, and, on the other hand, to point up how critical revision of the numerical or extensional model of self-identity is for the unity of meaning. Then, it will be a question of pointing out the reasons why in a phenomenology of identity, the renunciation of the phenomenological legitimacy of the αvτó as a guarantee for the different positions of identity must be observed. Timelines is an inquiry into the nature of time, both as an apparent feature of the external physical world and as a fundamental feature of our experience of ourselves in the world. The principal argument of Timelines is that our coventional ideas about time are largely mistaken and that what we think of as independent physical time is actually our calibration of a certain relation between events. Although previous treatments of affective injustice have identified some particular types of affective injustice, the general concept of affective injustice remains unclear. This article proposes a novel articulation of this general concept, according to which affective injustice is defined as a state in which individuals or groups are deprived of “affective goods” which are owed to them. On this basis, I sketch an approach to the philosophical investigation of affective injustice that begins by establishing which affective goods are fundamental, and (...) then considers which subsidiary goods—such as freedoms, resources, opportunities, and forms of recognition—may be necessary for the provision of those fundamental affective goods. Drawing from and developing ideas in the extant literature, I argue that two such fundamental affective goods include subjective well-being and emotional aptness. I then show that by analyzing deprivations of the subsidiary goods that enable a person to pursue and attain subjective well-being and emotional aptness, it is possible to shed new light on the cases of affective injustice that have been described in the extant literature, while also identifying other kinds of cases that have not been theorized to the same extent. Erick J. Ramirez, Miles Elliott and Per‑Erik Milam (2021) have recently claimed that using Virtual Reality (VR) as an educational nudge to promote empathy is unethical. These authors argue that the influence exerted on the participant through virtual simulation is based on the deception of making them believe that they are someone else when this is impossible. This makes the use of VR for empathy enhancement a manipulative strategy in itself. In this article, we show that Ramirez et al.’s ethical (...) rejection of empathy enhancement through VR is based on confusion. First, we show that this misunderstanding stems from the conception of empathy-enhancing simulations solely as failed attempts at “being someone else,” along with ignoring the crucial difference between the psychological perspective-taking processes of imagine-other and imagine-self. Then, having overcome that misconception, we argue that the ethical misgivings about the use of VR to promote empathy should disappear and that these projects have greater potential for behavioural change than purely sympathy-focused interventions. A continuing challenge for researchers and practitioners alike is the lack of data on the effectiveness of corporate–community investment programmes. The focus of this article is on the minerals industry, where companies currently face the challenge of matching corporate drivers for strategic partnership with community needs for programmes that contribute to local and regional sustainability. While many global mining companies advocate a strategic approach to partnerships, there is no evidence currently available that suggests companies are monitoring these partnerships to see (...) if they do, in fact, represent ‘strategic’ investments. This article argues that applying the management concept of ‘investment performance’ to corporate–community partnerships requires questioning traditional evaluation methods that focus on the results of programmes or activities. We adopt a case study approach to introduce an evaluation framework that considers performance from both corporate and community perspectives and that conceptualises partnership performance as comprising four aspects: (1) the contribution of the partnership to the overall portfolio of a company’s community investment programmes, (2) the appropriateness of the partnership model, (3) the effectiveness of the partnering relationship and (4) the ability of the partners to achieve programme goals. The application of this evaluation framework to an established corporate–community partnership programme provided some useful insights as to how partnership performance can be improved. (shrink)

This study aims to investigate the relationship between job burnout and employee performance in the feed industry during the ASF outbreak. Further, the researchers employed a descriptive-correlational research design in order to analyze the acquired data and produce pertinent findings. Thus, the researchers gathered data from one hundred two (102) feed industry employees. The Maslach Burnout Inventory (MBI) and Individual Work Performance Questionnaire (IWPQ) were employed to ascertain the extent of job burnout experienced by the respondents and evaluate employee performance, (...) respectively. Based on the statistical analysis, there is a significant relationship between job burnout and employee performance. Moreover, the study's findings were thoroughly analyzed and discussed. (shrink)

Filipino's love for the elderly is undeniable. However, despite the respect they have for the elderly, an increasing amount of elderly abandonment is rising in the Philippines. The drastic increase in statistics of abandonment will still grow over the years because aging is inevitable. The primary goal of this study is to dig deeper into the experiences, challenges, and coping mechanisms of abandoned senior citizens inside of a home for the aged to spread awareness about this certain topic. By the (...) use of Interpretative Phenomenological Analysis, the study come up with the following findings: (1) The abandoned senior citizens chose to be inside the facility because they don't want to be a burden in their original homes. (2) Faith and religious works affect their psychological well-being. (3) Physical appearance does not affect their self-esteem. (4) Social support boosts their psychological well-being as well. (5) One of the biggest reasons why abandoned senior citizens left their homes is being neglected to cause them to leave and stay in home for the aged (6) Lastly, people inside the facilities accepted the fact that death is drawing closer to them but they don't want to die yet. Why is space 3-dimensional? The fi rst answer to this question, entirely based on Physics, was given by Ehrenfest, in 1917, who showed that the stability requirement for n-dimensional two-body planetary system very strongly constrains space dimensionality, favouring 3-d. This kind of approach will be generically called "stability postulate" throughout this paper and was shown by Tangherlini, in 1963, to be still valid in the framework of general relativity as well as for quantum mechanical hydrogen atom, giving the same constraint (...) for space{dimensionality. In the present work, before criticizing this methodology, a brief discussion has been introduced, aimed at stressing and clarifying some general physical aspects of the problem of how to determine the number of space dimensions. Then, the epistemological consequences of Ehrenfest's methodology are critically reviewed. An alternative procedure to get at the proper number of dimensions, in which the stability postulate - and the implicit singularities in three-dimensional physics - are not an essential part of the argument, is proposed. In this way, the main epistemological problems contained in Ehrenfest's original idea are avoided. The alternative methodology proposed in this paper is realized by obtaining and discussing the n-dimensional quantum theory as expressed in Planck's law, de Broglie relation and the Heisenberg uncertainty relation. As a consequence, it is possible to propose an experiment, based on thermal neutron di raction by crystals, to directly measure space dimensionality. Finally the distinguished role of Maxwell's electromagnetic theory in the determination of space dimensionality is stressed. (shrink)

El propósito de Levinas coincide con el intento moderno de recuperación de la verdad y del sentido aunque en una dirección y contenidos distintos. Si en Hegel la Aufhebung tendía a la Totalidad y lo Mismo , para Husserl será esencial la apertura de Mundo que tiene lugar ya en la experiencia de conciencia del ego trascendental, mientras que Heidegger, por su parte, primará la pregunta por el Ser. El intento de Levinas, en cambio, no será recomponer la relación entre (...) el yo, por un lado, y el mundo, lo absoluto, las cosas o el ser, por el otro, sino la recuperación de la relación entre yo-y-otro. No es un simple cambio en la dirección o en el contenido del sentido de la reflexión filosófica, sino un intento serio de encontrar una nueva significación, «otra manera que ser» que no termine siendo otro proyecto más de integración y síntesis. Lo que propone Levinas es una auténtica salida para la que traza el itinerario que va del ser al otro, recurriendo sencillamente a la experiencia que cotidianamente se nos impone a cada uno de nosotros con un peso incontestable, a saber: la presencia de las diferencias, de lo asimétrico, en definitiva, la manifestación del otro en tanto que otro. Es esta experiencia heterónoma ordinaria, esta vivencia diaria de la alteridad como dato primordial del fenómeno de la intersubjetividad el ámbito que ha intentado explorar nuestro autor. ¿Acaso es esta responsabilidad así sentida conjugable con una experiencia filosófica universal? ¿La responsabilidad puede llevarse hasta el límite de la substitución por el otro, hasta la de-posición del Yo sin identidad? ¿Qué tipo de relación puede darse con algo absolutamente asimétrico, exterior, previo e irreductible? ¿De dónde viene esa asignación apremiante de responsabilidad que llega hasta arrojarme en la obsesión y el asedio? ¿Cómo puede ser éticamente plausible un mandato tan traumatizante y violento que termina por convertir al sujeto en rehén, sustituido ya por los otros? ¿Es posible conciliar la libertad y la autónoma decisión del sujeto con una consideración de la subjetividad como «heme aquí», absoluta pasividad expuesta a los otros y vulnerabilidad de una piel que se ofrece al ultraje y la herida?. En definitiva: ¿es la subjetividad algo de lo que partimos o a lo que llegamos? (shrink)

William Paley ( Natural Theology , 1802) developed the argument-from-design. The complex structure of the human eye evinces that it was designed by an intelligent Creator. The argument is based on the irreducible complexity ("relation") of multiple interacting parts, all necessary for function. Paley adduces a wealth of biological examples leading to the same conclusion; his knowledge of the biology of his time was profound and extensive. Charles Darwin’s Origin of Species is an extended argument demonstrating that the "design" of (...) organisms can be explained by natural selection. Moreover, the dysfunctions, defects, waste, and cruelty that prevail in the living world are incompatible with a benevolent and omnipotent Creator. They come about by a process that incorporates chance and necessity, mutation and natural selection. In addition to science, there are other ways of knowing, such as art, literature, philosophy, and religion. Matters of value, meaning, and purpose transcend science. (shrink)

Although logical consistency is desirable in scientific research, standard statistical hypothesis tests are typically logically inconsistent. To address this issue, previous work introduced agnostic hypothesis tests and proved that they can be logically consistent while retaining statistical optimality properties. This article characterizes the credal modalities in agnostic hypothesis tests and uses the hexagon of oppositions to explain the logical relations between these modalities. Geometric solids that are composed of hexagons of oppositions illustrate the conditions for these modalities to be logically (...) consistent. Prisms composed of hexagons of oppositions show how the credal modalities obtained from two agnostic tests vary according to their threshold values. Nested hexagons of oppositions summarize logical relations between the credal modalities in these tests and prove new relations. (shrink)

Being in a mood—such as an anxious, irritable, depressed, tranquil, or cheerful mood—tends to alter the way we react emotionally to the particular objects we encounter. But how, exactly, do moods alter the way we experience particular objects? Perceptualism, a popular approach to understanding affective experiences, holds that moods function like "colored lenses," altering the way we perceive the evaluative properties of the objects we encounter. In this essay, I offer a phenomenological analysis of the experience of being in a (...) mood that illustrates the limitations of the colored lens metaphor and demonstrates the basic inadequacy of the perceptualist account of moods. I argue that when we are in a mood, it is common to experience a kind of "emotional disconnection" in which we perceive evaluative properties that would normally elicit strong emotional reactions from us, but nonetheless we find that, in our present mood, we remain emotionally numb to these perceptions. Such experiences of "seeing but not feeling" are difficult to understand from within the perceptualist paradigm. Building on the work of Martin Heidegger, I sketch an alternative, phenomenological analysis of moods that can better account for experiences of emotional disconnection. On this alternative account, being in a mood does not merely alter the content of our perceptions but, rather, alters the way we interpret the overall significance of what we perceive, relative to a certain situational context. El presente trabajo pretende ser un guía y un prontuario para que el profesorado de filosofía haga uso de los conocimientos lingüísticos del alumnado. A dichos conocimientos se dedican muchas horas de trabajo escolar y pueden ser utilizados para mejorar el desempeño del alumnado en las materias de filosofía. Por otra parte, los productos de éstos que se evalúan en las materias de filosofía son de naturaleza lingüística, por lo que tal vez conviene una cierta sintonía con las materias correspondientes (...) en lo que se refiere a la evaluación de sus producciones lingüísticas. La exposición se basa en un doble hilo conductor. El primero, que estructura secuencialmente el trabajo, sigue las propiedades habituales que se consideran en un texto: cohesión, coherencia y adecuación. Estas propiedades sirven para introducir la teoría relevante que pueden servir al profesorado de filosofía para encontrar en los textos de lingüística lo que busca en orden a mejorar las habilidades de expresión y comprensión de su alumnado. Se complementa con la sugerencia de criterios de evaluación para las producciones textuales del mismo. El segundo hilo conductor se basa en diversos problemas de comprensión de textos. (shrink)

News about personal data breaches or data abusive practices, such as Cambridge Analytica, has questioned the trustworthiness of certain actors in the control of personal data. Innovations in the field of personal information management systems to address this issue have regained traction in recent years, also coinciding with the emergence of new decentralized technologies. However, only with ethically and legally responsible developments will the mistakes of the past be avoided. This contribution explores how current data management schemes are insufficient to (...) adequately safeguard data subjects, and in particular, it focuses on making these data flows transparent to provide an adequate level of accountability. To showcase this, and with the goal of enhancing transparency to foster trust, this paper investigates solutions for standardizing machine-readable policies to express personal data processing activities and their application to decentralized personal data stores as an example of ethical, legal, and technical responsible innovation in this field. This is a sketch of the basis and role of consciousness and the minimally required elements and constraints of any setting that may produce consciousness. It proposes that consciousness (as we know it) is a biologically-mediated product of evolved recursive and hierarchically nested representational systems that obey information theoretic principles and Bayesian (probabilistic) feedback and feedforward predictive modeling processes.

Metascientific criteria used for explaining or constraining physical space dimensionality and their historical relationship to prevailing causal systems are discussed. The important contributions by Aristotle, Kant and Ehrenfest to the dimensionality of space problem are considered and shown to be grounded on different causal explanations: causa materialis for Aristotle, causa efficiens for young Kant and an ingenious combination of causa efficiens and causa formalis for Ehrenfest. The prominent and growing rôle played by causa formalis in modern physical approaches to this (...) problem is emphasized. (shrink)

[ENG] On the basis of a reading of Heidegger's Der Ursprung des Kunstwerkes, the problematic of understanding the relational concepts of "earth" and "world" is developed. The proposal here is situated from an existential approach that links the earth with the concepts of sublimity and world, understood on the basis of an opening within imagination. To articulate these ideas, this paper fundamentally draws from arguments by Kant, Nancy and Arendt. The proposal here is that Heidegger seeks to explain how the (...) tear caused by the earth in the work of art would sublimate the imagination in an openness towards the world. -/- [ESP] A partir de una lectura del artículo Der Ursprung des Kunstwerkes escrito por Heidegger, se desarrolla la problemática de comprender los conceptos relaciónales de tierra y mundo. La propuesta aquí se sitúa desde una perspectiva existencial que liga la tierra con los conceptos de sublimidad y el mundo, comprendidos desde una apertura en la imaginación. Para articular estas ideas, el presente escrito se apoya fundamentalmente en argumentaciones de Kant, Nancy y Arendt. Lo aquí propuesto es que Heidegger buscaría dar cuenta del modo en que la desgarradura causada por la tierra en la obra de arte sublimaría la imaginación en una apertura hacia el mundo. (shrink)

This is a conjecture about the conditions and operating structures that are required for the phenomenality of certain mental states. Specifically, full-blown phenomenality is assumed, as contrasted with constrained examples of phenomenal experience such as sensations of color and pain. Propositional attitudes and content, while not phenomenal per se, are standardly concurrent and may condition phenomenal states (e.g., when tied to false beliefs). It is conjectured that full phenomenality natively arises in coherent processes of situated sensory synthesis and representation (with (...) conceptual content) that are looped, mereologically whole and multi-dimensional. And that phenomenal states are typically phase-states within a parameterized conjoint structure of world and experiencer processes that are causally modulated across Markov blankets (which are conditionally independent and may be nested: cf. M. Kirchoff, et. al., 2017, 2018; and T. Burge, 2010, re: anti-individualism). Though they may, it is not accepted that phenomenally conscious states must be targets of higher-order representations (cf. A. Byrne, 2004). (shrink)

John Stuart Mill and Jeremy Bentham are often said to have held opposed views concerning the way “the value” of different pleasures should be estimated. Mill is accused of being an inconsistent utilitarian because he thought that, when comparing the value of two pleasures, we should not forget to take their “quality” into account. Bentham, on the other hand, is said to have believed that we should take “only quantity” into consideration. By verifying what they actually wrote, and reflecting on (...) what they meant by words like “value”, “quantity”, and “quality”, we find that these allegations are largely imaginary and that the difference between Mill and Bentham on this question has (at least) been exaggerated. Bentham, for example, did not write that "quantity of pleasure being equal, pushpin is as good as poetry", as is so often reported. In his Principles of Morals and Legislation he clearly tells us why he rejects the inaccurate word “quantity”, when speaking of “the value of (a lot of) pain or pleasure”, and he explicitly introduces “quality” – both the word and the concept – in his analysis of rewards and punishments. These clarifications allow us to sort-out a few other confusions concerning utilitarianism. We explain, for example, why authors like Amartya Sen and Michael Sandel are mistaken in believing that rights and freedoms have “no intrinsic value” (only instrumental value) in utilitarian ethics. Nesse sentido, o autor constrói um argumento no sentido de mostrar que as alegações de Karl Popper, segundo as quais não pode ser concedido estatuto de cientificidade ao darwinismo, carecem de fundamento. O autor defende também a necessidade de um questionamento firme em relação a todo e qualquer argumento fornecido pela ciência, pois nem a (...) capacidade de previsão nem a universalidade das leis são garantia de que a ciência, também ela, nunca caia em erro. /// Aim of the present article is to show that the doctrine of evolution defended by Charles Darwin is grounded on propositions that are verifiable, as are verifiable many of its secondary propositions. The author builds up an argument that goes in the direction of showing how the allegations by Karl Popper against the scientific nature of Darwinism are not grounded in reality. The author of the article also defends the necessity of a firm questioning in relation to each and every argument advanced by the practitioners of science, since nor its anticipatory capacity nor the universality of its laws are warrant enough that the science never falls into error. A general sketch on how the problem of space dimensionality depends on anthropic arguments is presented. Several examples of how life has been used to constraint space dimensionality (and vice-versa) are reviewed. In particular, the influences of three-dimensionality in the solar system stability and the origin of life on Earth are discussed. New constraints on space dimensionality and on its invariance in very large spatial and temporal scales are also stressed.

Everyone has heard of "the invisible hand," the famous metaphor used by Adam Smith (1723-1790) in The Wealth of Nations. Although he uses the expression only once in the book, it has given rise to controversy that has lasted for over two centuries. -/- The famous expression has been understood, in (at least) two very different ways. In one way by most of academia, and in a very different way by Keynes, Noah Chomsky and more lately by Mark Blaug (in (...) the second edition of The New Palgrave, 2008). -/- In the standard textbook interpretation, it is considered a poetical name for "the price mechanism" and presented as an argument in favor of laisser-faire and free trade. In this paper we recall the less well-known interpretation (of Keynes, Blaug and Chomsky), showing that Smith was more reserved towards laisser-faire than is commonly believed and that by "invisible hand" he did not mean the price mechanism. The present article studies the epictetean philosophical use of some passages of the Greek and Roman history. The concepts of love-friendship (philía) and personal con- venience (sumphéron) second the philosopher to explain why happiness (eudaimonía) has not been reached by the human being in all history. All historical war or strife (pólemos), such as the Trojan, the Medics and the Peloponnesian wars, is provoked by epistemological-moral mistakes derived from the ignorance of which is the correct place to put the sumphéron; (...) such correct place is only the personal “rational capacity” ( proháiresis). This causal explanation of the incorrect and vicious human actions, of which history is full and which destroy the existent philía between nations and provoke pólemos, constitutes an authentic epictetean philosophy of history. Nevertheless, those vicious actions have a justification in a superior Cosmological level because they are pre-determined and ordered by the God-Providence. This leads us to the possibility of observing that the stoic philosophy of history, particularly the epictetean, is analogous to some modern speculative systems of history like the ones developed by Vico or Hegel. Ya desde los años sesenta, sólo un problema obsesionaba a Deleuze: el ejercicio del pensamiento, “¿qué significa pensar? ¿A qué llamamos pensar?”. Su preocupación se orientaba, por ello, a pensar de otro modo, de manera diferente. Su cometido era, en palabras de José Luis Pardo, “introducir una diferencia en la práctica de la filosofía”. Pero como preludio a esta tarea era preciso perder toda nuestra memoria, coagulada en palabras, prácticas y conceptos ya establecidos, era necesario alterar nuestros hábitos especulativos.

Space is one of the most fundamental concepts over which scientific knowledge has been constructed. But it is also true that space concepts extrapolate by far the scientific domain, and permeate many other branches of human knowledge. Those are fascinating aspects that could di per se justify the compilation of a long bibliography. Another one is the passion for books. My interest in some physical, historical and philosophical problems concerning the concept of space in Physics, and its properties, can be (...) traced back to the early 1980. Since that time, I have being studying, with several collaborators, the influence of space dimensionality in different physical phenomena, like the Casimir Effect, neutron diffraction, Cosmic Microwave Background Radiation and the stability of Schrödinger’s and Dirac’s hydrogen atom in arbitrary number of dimensions, as well as epistemological aspects of the works of Kant, Ehrenfest an others on this particular subject. Meanwhile, I gave lectures about the History of the Concepts of Space in Physics at the Centro Brasileiro de Pesquisas Físicas (CBPF), at the Program of History of Sciences, Technics and Epistemology of the Federal University of Rio the Janeiro (UFRJ) and also at the Physics Institute of the State University of Rio de Janeiro (UERJ). As a consequence of both this interest and my love for books, I continuously bought books on space for my personal library which contains now quite one half of all the books quoted here. In 1996, Roberto Moreira and I published the Sources for the History of Space concepts in Physics: From 1845 to 1995 in the series Notas de Física of the CBPF (NF # 084/96), which is still available online. This was a first initiative to share our bibliography on space. At that time, it contained 1075 references, including 414 books entirely devoted to space, 380 articles in periodical journals and proceedings and 281 miscellaneous citations. After fifteen years, I decided to focus my attention here to collect what in my opinion are the 601 essential books which could be useful for anyone interested on learning about space. An important restriction is imposed here by language: only texts written in English, French, German, Italian, Spanish, Portuguese and Latin were considered. References are given in chronological order covering the period between 1739 and 2010. For each year, the books are listed in alphabetical order of authors’ name. One of the most disputed questions among economists is that of "the role" and "size" that the public sector should have in a rich and developed country like France. -/- The importance of this question is understandable, because the history of nations is filled with examples of a sector (or a branch) of the economy becoming too large, or remaining too small, hampering growth or making the economy more vulnerable. A recent case is that of the "Financial Corporations Sector", which (...) doubled in size in several countries during the two decades leading up to the 2008 economic collapse [1]. -/- It is therefore legitimate to ask whether this is not also the case, in France, with "General Government" or "the Public Sector". -/- We explain why the argument most often used by those who hold this opinion (that the ratio "public expenditure/GDP" is a good measure of the size of the public sector and that in France it is too high) is not a serious one. -/- . Se trata de un artículo que busca una relectura de los textos y problemas en la obra del filósofo francés Louis Althusser. Hay dos líneas argumentativa que sigue la relectura: 1) su materialismo aleatorio, y 2) su teoría del lenguaje.

El trabajo consiste en una elucidación de los elementos que conforman el concepto de pena natural (poena naturalis) en el Derecho penal. Se puede caracterizar la pena natural como el daño o sufrimiento que recae sobre el autor de un delito, producto de la comisión del mismo, que debe ser descontado de la pena legal que ha de aplicársele. Si bien existe un mínimo acuerdo sobre esto, tanto en la jurisprudencia como en la doctrina penal se observan serios desacuerdos acerca (...) de los requisitos que se deben cumplir para reconocer que se está frente a una pena natural. Para elucidar los elementos, se utilizará el constructivismo conceptual de Ronald Dworkin, a fin de describir el desacuerdo y sus implicancias, reconocer los elementos principales de la pena natural y justificarlos bajo su mejor luz moral. ABSTRACT This study focuses on the clarification of the conceptual elements of poena naturalis in criminal law settings. The poena naturalis is the damage or suffering that falls on the convict for its commission. This damage must be deducted from the poena forensis to be applied. Although there is a minimum agreement about the concept of poena naturalis, in the jurisprudence and among legal scholars, there are serious disagreements about the elements of poena naturalis. To elucidate the elements, I will adopt Ronald Dworkin’s conceptual constructivism to describe the disagreement and its implications. At last, I will justify the main elements of the poena naturalis by their best moral light. (shrink)

Due to the COVID-19 pandemic, the academe was introduced to online education, which is complicated. The sudden shift of traditional face-to-face classes to digital learning impacted every student's self-efficacy and motivation towards their studies. This study investigates the relationship between the self-efficacy and academic motivation of the 304 freshmen college students from private higher education institutions in the Philippines. Based on the data gathered, the participants' level of self-efficacy (x̄ = 3.27) and academic motivation (x̄ = 5.93) is high. Further, (...) the statistical analysis concluded a relationship between self-efficacy and academic motivation (r=.002, at 0.05 level) among the graduating college students. Implications of the study were discussed, and recommendations for future research were suggested. (shrink)

La reafirmación de la reflexión contemporánea sobre las subjetividades -de acción, de enunciación, de sensibilidad, de pasión, etc.- sólo es posible llevarse a cabo si se acepta lo político como su ámbito. Objectives: The study determined the competencies of teachers and performance of learners in 2017-2018 National Achievement Test. It identified the influence of teachers’ competencies on performance of learners. Methods: It employed descriptive-correlational and explanatory designs and it involved three divisions in Northern Mindanao region, Philippines. Findings: The Grade 10 and 6 teachers have possessed very satisfactory competencies across areas, while the Grade 10 and Grade 6 learners had a low mastery and very low mastery, respectively. Furthermore, there was no significant (...) relationship between the competencies of teachers and the performance of learners, while their competencies did not significantly influence the performance of learners. Conclusion: Teachers were deemed competent in all areas and learners had not acquired most of the competency standards of the curricula. Hence, no matter how competent teachers are, this would not contribute significantly to improving the performance of learners in the National Achievement Test. Thus, competencies of teachers cannot determine the performance of learners. (shrink)

The aim of this paper was to present ongoing research on the social representations relating to ritalin in Brazil between 1998 and 2008. Over this period, there was a considerable increase in ritalin usage and expansion of its use to purposes other than therapeutic use. Ritalin has been used not only for treating attention disorders, but also to enhance cognitive functions in healthy individuals. The research has developed through two fields of investigation with different methodologies. In the first field, Brazilian (...) scientific and popular publications have been investigated, with analysis on the arguments justifying ritalin usage and how scientific results are disseminated to the lay public in large-circulation newspapers. In the second field, focus groups have been used to explore the social representations that university students, students' parents and healthcare professionals have in relation to the use of ritalin for enhancing cognitive performance. -/- . Suponiendo que tiene sentido y es pertinente, la cuestión tiende a parecernos baladí. Ciertos discursos corrientes dan una respuesta aún antes de formular la pregunta -por eso nos parece retórica-, nos la presentan como un adorno literario, y a la respuesta como un hecho antes que como un problema.
