A summary of issues related to symbolic capital, authorial presences, and intellectual property rights, and the necessity of finding a way out of 500-600 years of capitalist exploitation of the knowledge commons.

Kaplan (1990; 2011) argues that there are no unspoken words. Hawthorne and Lepore (2011) put forward examples that purport to show that there can be such words. Here, I argue that Kaplan is correct, if we grant him a minor variation. While Hawthorne and Lepore might be right that there can be unspoken words, I will argue that they fail to show that there can be uninstantiated words.

An argument for the abolition of Intellectual Property Rights (IPR) and a step into the wild blue yonder – i.e., beyond Open Access (OA) and Creative Commons (CC) protocols. The “Introduction,” prior to “Paralogisms for Artist-scholars” utilizes an almost Pater-esque aesthetic deployment of time-senses and verb tenses that also resembles the doubled subjective states of Derridean exposition, but actually opens on to theologically inflected re-considerations of the generative nature of gramma.

Chris Marker’s portrait of Alexandre Medvedkine in the 1993 film Le tombeau d’Alexandre/The Last Bolshevik is highly instructive of his own relationship to Soviet cinema. Most especially, this difficult or troubled rapport with the antecedents to cinéma vérité in the West (and its protean formal properties, in terms of structure and often satirical-critical commentary) comes forth in the figures he assembles to comment upon Medvedkine’s life work. When Medvedkine’s Scast’e (Le Bonheur/Happiness) (1934) leaked to the West (c.1967), sent like an (...) “SOS” in multiple bottles to various film archives (one by one from deep within the Soviet film world), Marker and SLON received a copy by way of Jacques Ledoux (curator of the Cinémathèque Royale de Belgique, in Belgium). The film opened the floodgates of a retrospective survey of Soviet filmmaking repressed and forgotten other than by remote and distant figures (partisans) who somehow survived the Stalinist purges of the 1930s. In this paper I outline and defend a new approach to personal-identity—personal-identity non-cognitivism—and argue that it has several advantages over its cognitivist rivals. On this view utterances of personal-identity sentences express a non-cognitive attitude towards relevant person-stages. The resulting view offers a pleasingly nuanced picture of what we are doing when we utter such sentences.

This chapter presents a positive philosophy of male sexuality: one that is not rooted in so-called toxic masculinity and which is compatible with gender equality. I argue that, for such a sexuality to be possible, respect is the moral baseline. However, the status quo for male sexuality is shaped by white supremacy and heteronormativity. To resist these values, men must do more than merely cross some minimal moral threshold for permissible sex. Rather, they ought to develop a caring character so (...) that they would want to seek out their own and their partner’s (robust) sexual fulfillment. Men ought actively to develop ways to increase pleasure for themselves and their partners. (shrink)

Co-authored research paper written with José Vela Castillo on the subject of Pablo Román's wall of 1,000 images, Vienna, 2013. -/- “Vienna” or “The Wall” is an ongoing project by architect/artist Pablo Román that, upon its completion, will consist of the round number of 1,000 images taped onto an off-white wall. One of the many walls he has designed/produced in the past months (architectural or otherwise), its elementary condition is at the same time enhanced and diminished by its very presence (...) as wall-cum-images, or as images-out-of-a-wall, eroding its foundational condition to a flickering-tele-techno-pixelated spectral apparatus. Its radically modern and outdated presence reconfigures contemporary reflections on what architecture and what the modern is, indirectly referencing “Fundamentals,” the 2014 Venice Architecture Biennale curated by Rem Koolhaas. Not-I/Thou: The Other Subject of Art & Architecture is to be a highly focused exhibition/folio of works by perhaps 12 artists (preferably little-known or obscure), with precise commentaries denoting the discord between the autonomous object (the artwork or architectural object per se) and the larger field of reference (worlds); inference (associative magic), and insurrection (against power and privilege) – or, the Immemorial. Engaging the age-old “theological apparatuses” of the artwork, the folio is intended to upend the current fascination with personality, (...) celebrity, and fashion to reach the timeless horizon of the subject of Art and Architecture as the subject other than the subject of Art and Architecture proper. Word as image, and image as word, is the central paradox given to this discord – an elective, yet universal condition that also makes certain art and architectural works heedlessly existential-metaphysical (and, therefore, “theological”). This paper, as part of the essay “White Paper: Gray Areas and Black Zones,” is a preliminary investigation of the conceptual architecture for the overall, ongoing exhibition/book project. (shrink)

Kristie Miller and James Norton present a new account of metaphysical explanation, not as a philosophical technicality but as a feature of everyday life. This is the notion that we all use in ordinary contexts when we give explanations of a certain sort: Miller and Norton build their account on investigation of these explanatory practices.

This essay addresses arguments regarding the “place” or “non-place” in which ideas originate and whether they are wholly transcendental, wholly contingent, or a combination of transcendental and contingent. Far from a resuscitation or recitation of Medieval scholastic disputations, the essay seeks to situate these untimely concerns in the context of spent discursive and ideological systems that support capitalist exploitation of the knowledge commons, exploitation only made possible because of a decisive and historically determined reduction of knowledge to fully contingent status (...) as spectral commodity. “Else-where” is a synoptic survey of the representational values given to art, architecture, and cultural production from 2002 through 2011. Written primarily as a critique of what is suppressed in architecture and what is disclosed in art, the essays are informed by the passage out of post-structuralism and its disciplinary analogues toward the real Real . While architecture nominally addresses an environmental ethos, it also famously negotiates its own representational values by way of its putative autonomy ; its main repression (...) in this regard is “landscape,” figure of the Other and figure of the Real. Engaging forms of spectrality, and not necessarily speculative intelligence per se, architecture is also “conscious” of its own complicity in capitalist orders, a complicity that in part underwrites its avant-garde forms of agitation since the onset of modern architecture. As a result, and over the course of the twentieth century, architectural vanguards have successively been depleted such that they return only as reified half-measures in the late-modern production of difference. As such, the essay “Actually Existing Ground” examines the failed promise of Landscape Urbanism. Since the 1960s, as with the allied arts, architecture has evacuated many of the utopian gestures given to modernism and embraced a form of ultra-contingency in a direct alliance with the post-modern and post-Marxist concession to markets and to cultural production as principal means of establishing formal hegemony. This recourse or surrender to the economic-determinist ethos of post-modernity, regardless of attempts to problematize it and/or critique it through types of what Manfredo Tafuri has called “operative criticism” , has, arguably, all but failed, and with the suggestive return circa 2011 of new forms of resistance an exit from the accommodating spirit of the times is indicative of the expectation of strenuous, yet highly formal and non-discursive operations within artistic and architectural production. The essays collected in “Else-where” cross various disciplines, inclusive of landscape architecture, architecture, and visual art, to develop a nuanced critique of an emergent formal regard in the arts that is also an invocation of the highest coordinates given to the arts – formal ontology as speculative intelligence itself – or the return of the universal as utopian thought “here-and-now.”. While the contemporary philosophical literature is replete with discussion of the control or freedom required for moral responsibility, only more recently has substantial attention been devoted to the knowledge or awareness required, otherwise called the epistemic condition. This area of inquiry is rapidly expanding, as are the various positions within it. This chapter introduces two major positions: the reasonable expectation view and the quality of will view. The chapter then explores two dimensions of the epistemic condition that serve as fault (...) lines along which these two views diverge. The first dimension concerns different kinds of ignorance. The second concerns what agents can be directly blameworthy for. The chapter closes by sketching a novel approach that incorporates advantages of opposing positions on this topic. (shrink)

Temporal non-dynamists hold that there is no temporal passage, but concede that many of us judge that it seems as though time passes. Phenomenal Illusionists suppose that things do seem this way, even though things are not this way. They attempt to explain how it is that we are subject to a pervasive phenomenal illusion. More recently, Cognitive Error Theorists have argued that our experiences do not seem that way; rather, we are subject to an error that leads us mistakenly (...) to believe that our experiences seem that way. Cognitive Error Theory is a relatively new view and little has been said to explain why we make such an error, or where, in the cognitive architecture, such an error might creep in. In this paper we remedy this by offering a number of hypotheses about the source of error. In so doing we aim to show that Cognitive Error Theory is a plausible competitor to Phenomenal Illusion Theory. (shrink)

Brief essay on Giorgio Agamben's concept of "bare life" from Homo Sacer: Sovereign Power and Bare Life (1998), with reference to The Time that Remains: A Commentary on the Letter to the Romans (2005).

Sometimes it is not one’s place to blame or forgive. This phenomenon is captured under the philosophical notion of standing. However, there is an asymmetry to be explained here. One can successfully blame, even if one lacks the standing to do so. Yet, one cannot successfully forgive if one lacks the standing to do so. In this article we explain this asymmetry. We argue that a complete explanation depends on not only a difference in the natures of the standing to (...) blame and forgive but also a difference in the natures of blame and forgiveness themselves. The 11 experimental, pseudo-avantgarde visual poems (wordless, other than title and date) are an indirect homage to the late-great filmmaker and photographer, Chris Marker (1921-2012), foremost to his penchant for utilizing disintegrating imagery in his film-essays and multimedia installations. All images were captured using a Research in Motion, BlackBerry 8520 cellphone, and subsequently 100-percent de-saturated, and 100-percent contrast-adjusted, using Microsoft Office Picture Manager. The images, as a result, resemble the primitive production values given to the pinhole camera, and the “dogmatic” (...) (uniform) adjustments (as above), applied to the original BB images, reference the early strictures applied to filmmaking by Lars von Trier. The above-mentioned, black-and-white adjustments notwithstanding, all images are used “as captured,” without cropping. The series begins and ends in Botwnnog, Northwest Wales, in May and August of 2013, respectively, with interregnums and brief idylls in Rijeka, Croatia, Trieste and Ancona, Italy, and Igoumenitsa, Ioannina, and Athens, Greece. Tracking the peregrinations of the author of the poems across Europe, and intimately associated with the then-nascent research and exhibition project, “Not-I/Thou: The Other Subject of Art & Architecture,”* the poems are also a compressed form of scholarship, albeit operating in the shadow-lands of knowledge per se, and evoking the non-discursive side of literary-artistic production, a penumbral zone within cultural production that nonetheless references the discursive arts (essay and/or full-blown treatise), but favors the paradox and/or tautology – privileging, then, the much-desired destruction of dialectics. Many of the following literary-critical texts (not all quite conventional “long-form” essays) originally appeared on the Landscape Agency New York website, LANY Archive-Grotto, on the web portal Geocities, between the years 1997 and 2008 – i.e., over a period of roughly ten years. Versions of some were published in various journals, academic or otherwise. In re-presenting them here, the intention is to trace a proverbial “red thread” that crosses the entirety of the work, arguably what might be denoted the works-based (...) agency of works, and, arguably, the telltale trace of what is otherwise known as the “life-work,” yet for works versus for authors. -/- The entire, retrospective apparatus of The Editioning of Gardens is also, decidedly, an homage to New York, New York, either where or from where much of the research was undertaken and “lived.” Manhattan, indeed, haunts these pages, directly and indirectly – that is to say, the unparalleled access to libraries, bookstores, universities, galleries, cafés, pubs, restaurants, cinemas, parks, and the streets is quite simply the source for the often-intense, yet suitably critical exegetical works. -/- This book is meant to both recapitulate themes crossing the “life-work” of the works collected, but to also illustrate the transitional gestalt of the 1990s and 2000s, something we collectively have not yet quite exited, and something that still haunts and gives pause to architects and landscape architects today. In naming this collection “The Editioning of Gardens,” the intention is to draw attention to the fact that it is landscape that underwrites almost all architectural interventions, whether acknowledged or denied, and that it is “landscape” – in the widest sense of the word – that we inherently and collectively inhabit. -/- NOTA BENE: -/- While many of the essays and texts presented here have been previously published as “working papers” or “reviews” on the LANY Archive-Grotto website, or in journals and P2P dossiers (i.e., in open-access collections posted to research repositories, here denoted Things Czech and Dossier LANY), their presentation in book form makes them more readily accessible and effectively new works as totality. Most have also been re-edited and re-formatted for inclusion in The Editioning of Gardens. -/- All texts are also dated so as to situate them in the timeframe in which they appeared (or were written), as snapshots or surveys of passing times. While re-edited and re-formatted for presentation here, they have not been re-written as such due to their implied “historic” and “time-based” nature. As collection, however, they function as an (un)timely reminder of critical exegesis as rite of passage – underscoring the significance of the title of the collection. Press Release for Works for Works, Book 1: Useless Beauty (Punctum Books, 2022).

In this paper, I aim to discuss what puns, metaphysically, are. I argue that the type-token view of words leads to an indeterminacy problem when we consider puns. I then outline an alternative account of puns, based on recent nominalist views of words, that does not suffer from this indeterminacy.

Miller analyzes the relationship between consent and autonomy by offering three pictures. For autonomy, Miller distinguishes between procedural, substantive, and weak substantive autonomy. The corresponding views of consent are what Miller has termed as consensual minimalism, consensual idealism, and consensual realism. The requirements of sexual consent under consensual minimalism are a voluntary informed agreement. However, feminist critiques reveal the inadequacies of this simple position. Consensual idealism, which corresponds with substantive autonomy, offers a robust picture where consent and (...) autonomy must be based on non-oppression. However, this view is considered too ideal and it ignores context. Weak substantive autonomy takes into account the context in the sexual domain. Correspondingly, consensual realism takes into account the context and still fulfills the requirements of consent. (shrink)

Not-I/Thou: The Other Subject of Art and Architecture is a series of essays delineating the gray areas and black zones in present-day cultural production. Part One is an implicit critique of neo-liberal capitalism and its assault on the humanities through the pseudo-scientific and pseudo-empirical biases of academic and professional disciplines, while Part Two returns to apparent lost causes in the historical development of modernity and post-modernity, particularly the recourse to artistic production as both a form of mnemonics and periodic (and (...) renascent) avant-garde agitation. In-between these twin systems of taking the measure of things, Art and Architecture, as forms of speculative intellectual capital, emerge from the shadow-lands of half-conscious and half-unconscious forces to become gestures toward a type of knowledge that has no utilitarian or generic agency. Defying the tendencies of such discourses to fall prey to instrumental orders that effectively neuter the inherent radical agenda of both, Art and Architecture are represented in this series of essays as noetic apparatuses, operating at the edge of authorized systems of knowledge, quietly and secretly validating and valorizing the shadowy and recondite, collective and personal operations of intellect in service to no particular end. One feature of language is that we are able to make mistakes in our use of language. Amongst other sorts of mistakes, we can misspeak, misspell, missign, or misunderstand. Given this, it seems that our metaphysics of words should be flexible enough to accommodate such mistakes. It has been argued that a nominalist account of words cannot accommodate the phenomenon of misspelling. I sketch a nominalist trope-bundle view of words that can.

Temporal dynamists typically hold that it seems to us as though time robustly passes, and that its seeming so is explained by the fact that time does robustly pass. Temporal non-dynamists hold that time does not robustly pass. Some non-dynamists nevertheless hold that it seems as though it does: we have an illusory phenomenal state whose content represents robust passage. Call these phenomenal passage illusionists. Other non-dynamists argue that the phenomenal state in question is veridical, and represents something other than (...) robust passage. Call this the veridical passage-less view. This paper argues against in favour of the latter view over the former, by arguing that we should reject passage illusionism. (shrink)

One argument for the moving spotlight theory is that it better explains certain aspects of our temporal phenomenology than does any static theory of time. Call this the argument from passage phenomenology. In this paper it is argued that insofar as moving spotlight theorists take this to be a sound argument they ought embrace a new version of the moving spotlight theory according to which the moving spotlight is a cresting wave of causal efficacy. On this view it is more (...) than just presentness that is temporary: a range of other fundamental properties are also temporary because presentness synchronically changes the fundamental properties that are instantiated in the present moment, from those instantiated when that moment is future, or past. On this view having experiences as of presentness co-varies with the presence of presentness, allowing the moving spotlight theorist to provide a compelling explanation for why we have the temporal phenomenology we do, and to explain how we can know that we are present by reflecting on the nature of said phenomenology. Many think that sentences about what metaphysically explains what are true iff there exist grounding relations. This suggests that sceptics about grounding should be error theorists about metaphysical explanation. We think there is a better option: a theory of metaphysical explanation which offers truth conditions for claims about what metaphysically explains what that are not couched in terms of grounding relations, but are instead couched in terms of, inter alia, psychological facts. We do not argue that our account is superior (...) to grounding-based accounts. Rather, we offer it to those already ill-disposed towards grounding. (shrink)

According to the Value-Neutrality Thesis, technology is morally and politically neutral, neither good nor bad. A knife may be put to bad use to murder an innocent person or to good use to peel an apple for a starving person, but the knife itself is a mere instrument, not a proper subject for moral or political evaluation. While contemporary philosophers of technology widely reject the VNT, it remains unclear whether claims about values in technology are just a figure of speech (...) or nontrivial empirical claims with genuine factual content and real-world implications. This paper provides the missing argument. I argue that by virtue of their material properties, technological artifacts are part of the normative order rather than external to it. I illustrate how values can be empirically identified in technology. The reason why value-talk is not trivial or metaphorical is that due to the endurance and longevity of technological artifacts, values embedded in them have long-term implications that surpass their designers and builders. I further argue that taking sides in this debate has real-world implications in the form of moral constraints on the development of technology. (shrink)

The quest for a unified “Theory of Everything” that explains the fundamental nature of the universe has long been a holy grail for scientists and philosophers, dating back to the ancient Greeks’ search for Arche. -/- So far, the mainstream of research on A Theory of Everything primarily focuses on the lifeless phenomena and laws of physics while ignores the realm of biology. However, a fundamentally different approach to the ToE has been put forward, presenting a viable alternative to address (...) the challenge of a Theory of Everything. This approach does not seek the ultimate “building block” but rather aims to uncover the intangible rules that fundamentally govern everything in the universe, seeking their universality across the vast spectrum, from the minute subatomic world to the mega mass cosmic world and the magical biological world. -/- To address the challenge, a set of the fundamental interrelationships is introduced and represented by a model, the Fundamental Interrelationships Model. This model cohesively represents these fundamental interrelationships, including serial-parallel relationships, transition of state, critical point, continuation-discontinuation, convergence-divergence, contraction-expansion, singularity-plurality, commonality-difference, similarity, symmetry-asymmetry, periodicity, dynamics-stability, order-disorder, limitation-without limitation, hierarchical structure, and cohesive interconnectedness. These interrelationships, found in nature, can be interpreted as the fundamental laws of physics. -/- Built on the foundation of the Fundamental Interrelationships Model, a collection of the well-established laws of physics and theories are represented and unified, including Newton’s three laws of motion, the four laws of thermodynamics, Einstein’s space-time relationship, Heisenberg’s uncertainty principle, Noether’s theorem, Schrodinger’s wave function collapse, chaos theory and complexity theory. The list continues to grow… Based on this model, a groundbreaking research has, for the first time, put forward a new hypothesis that unifies the Big Bang theory with the evolutionary theory, published in a book in 2022. This research unequivocally demonstrates that the evolution of life also follows the fundamental laws of physics, marking a significant stride toward addressing the longstanding challenge of a comprehensive Theory of Everything. -/- Subsequent studies reveal that the evolution of life (including the evolution of multicellularity), embryonic development, evolution of society (civilisation), and the evolution of the universe all adhere to these fundamental interrelationships. It has been suggested that there is something worrisome, puzzling, or incomprehensible about the sorts of causal loops sometimes involved in backwards time travel. This paper disentangles two distinct puzzles and evaluates whether they provide us reason to find backwards time travel incomprehensible, inexplicable, or otherwise worrisome. The paper argues that they provide no such reason.

I reconsider the concept of dignity in several ways in this article. My primary aim is to move dignity in a more relational direction, drawing on care ethics to do so. After analyzing the power and perils of dignity and tracing its rhetorical, academic, and historical influence, I discuss three interventions that care ethics can make into the dignity discourse. The first intervention involves an understanding of the ways in which care can be dignifying. The second intervention examines whether the (...) capacity to care should be considered a distinguishing moral power – as rationality often is – in light of which humans have dignity. In the third intervention, I cast dignity as a fundamentally relational concept and argue that relationality is constitutive not only of dignity but also of the wider enterprise of normativity. I understand relationality as the condition of connection in which all human beings stand with some other human beings. A thought experiment involving the last person on earth helps to reframe the normative significance of human relatedness. Dignity emerges as fundamentally grounded in relationality. (shrink)

Mainstream analytic epistemology regards knowledge as the property of individuals, rather ‎than groups. Drawing on insights from the reality of knowledge production and dissemination ‎in the sciences, I argue, from within the analytic framework, that this view is wrong. I defend ‎the thesis of ‘knowledge-level justification communalism’, which states that at least some ‎knowledge, typically knowledge obtained from expert testimony, is the property of a ‎community and possibly none of its individual members, in that only the community or some ‎members (...) of it collectively possesses knowledge-level justification for its individual members’ ‎beliefs. I address several objections that individuals, qua individuals, have or are able to ‎acquire knowledge-level justification for all the beliefs they obtain from expert testimony. I ‎argue that the problem I identify with individualism is invariant under any specific account of ‎justification, internalist or externalist. ‎. (shrink)

This paper has three main sections. The first section provides a general characterisation of presentism, eternalism and growing blockism. It presents a pair of core, defining claims that jointly capture each of these three views. This makes clear the respects in which the different views agree, and the respects in which they disagree, about the nature of time. The second section takes these characterisations and considers whether we really do have three distinct views, or whether defenders of these views are (...) somehow talking past one another when they claim to disagree. The third section looks at the key objections to each view and considers some of the replies that can be made to those objections. The paper concludes by offering some thoughts about how future research might help us resolve the debate between defenders of these three views. (shrink)

It was once held to be a virtue of the growing block theory that it combines temporal dynamism with a straightforward account of in virtue of what past-tensed propositions are true, and an explanation for why some future-tensed propositions are not true (assuming they are not). This put the growing block theory ahead of its principal dynamist rival: presentism. Recently, new growing block theorists have suggested that what makes true, past-tensed propositions, is not the same kind of thing as what (...) makes true, present-tensed propositions. They have done so in an attempt to defuse a particular epistemic objection to their view. In this paper it is argued that the new growing block theorist faces a dilemma. The more unified a strategy is for responding to the epistemic objection, the more that strategy results in the new growing block model positing truthmakers that are similar to those posited by the presentist, which erodes the purported advantage of the growing block theory over presentism. On the other hand, versions of the new growing block theory that embrace disunified strategies are better able to differentiate themselves from presentism, but are unattractive because of their disunity. It has been widely argued that words are analogous to species such that words, like species, are natural kinds. In this paper, I consider the metaphysics of word-kinds. After arguing against an essentialist approach, I argue that word-kinds are homeostatic property clusters, in line with the dominant approach to other biological and psychological kinds.
