According to the Principle of Alternative Possibilities, an agent is morally responsible for an action of hers only if she could have done otherwise. The notion of a robust alternative plays a prominent role in recent attacks on PAP based on so-called Frankfurt cases. In this paper I defend the truth of PAP for blameworthy actions against Frankfurt cases recently proposed by Derk Pereboom and David Widerker. My defence rests on some intuitively plausible principles that yield a new understanding of (...) the concept of a robust alternative. I will leave aside whether PAP also holds for praiseworthy actions -/- Según el Principio de Posibilidades Alternativas, un agente es moralmente responsable de una acción sólo si hubiera podido actuar de otro modo. La noción de alternativa robusta desempeña un papel prominente en ataques recientes al PPA basados en los llamados casos Frankfurt. Mi defensa descansa en algunos principios intuitivamente plausibles que dan lugar a una comprensión nueva del concepto de alternativa robusta. The specific role of empeiria in Aristotle’s ethics has received much less attention than its role in his epistemology, despite the fact that Aristotle explicitly stresses the importance of empeiria as a requirement for the receptivity to ethical arguments and as a source for the formation of phronêsis.1 Thus, while empeiria is an integral part of all explanations that scholars give of the Aristotelian account of the acquisition of technê and epistêmê, it is usually not prominent in explanations of the (...) acquisition of phronêsis.2 The abundant mentions of empeiria in Aristotle’s ethical treatises are often eclipsed in the secondary literature... In his article 'Individualism and Descartes' (Teorema, vol. 16, pp. 71-86), William Ferraiolo puts into question the widely accepted interpretation of Descartes as an individualist about mental content. In this paper, I defend this interpretation of Descartes thought against Ferraiolo's objections. I hold, first, that the interpretation is not historically misguided. Second, I try to show that Descartes’s endorsement of anti-individualism would lead either to depriving skeptical hypotheses of their force or to rejecting the epistemological privilege of the first person. Finally, I argue that Ferraiolo’s objections to the individualistic interpretation rest on two important errors: a misapprehension of the argumentative order of the Meditations and a confusion between the notions of causal and constitutive dependence of content on the external environment. In what ways and how far does virtue shield someone against suffering evils? In other words, how do non-moral evils affect the lives of virtuous people and to what extent can someone endure evils while staying happy? The central purpose of this chapter is to answer these questions by exploring what Aristotle has to say about the effects of evils in human well-being in general and his treatment of extreme misfortunes.

According to complexity economics, a speculative bubble is a paradigmatic case of emergence which forms from individual behaviour. In order to provide a more detailed ontological investigation of this ‘lower level’, this paper aims to understand what a transaction is and how people actualize their financial choices. Given that selling and buying operations may involve just machines, it is argued that collective intentionality, at least in John Searle’s version, is not successful. It would seem, therefore, that the pivotal role is (...) played by documents. The paper focuses mostly on the documents’ capacity to anchor quasi-abstract entities to reality and to attribute social and economic properties, such as property having a certain value. My main aim in this paper is to improve and give further support to a defense of the Principle of Alternative Possibilities (PAP) against Frankfurt cases which I put forward in some previous work. In the present paper I concentrate on a recent Frankfurt case, Pereboom's "Tax Evasion". After presenting the essentials of my defense of PAP and applying it to this case, I go on to consider several objections that have been (or might be) raised against it and argue (...) that they don't succeed. I conclude by pointing out that my criticism of Pereboom's example suggests a general strategy against other actual or possible Frankfurt cases. (shrink)

In this book chapter, Moya argues that recognizing, indeed mobilizing, identities in the classroom is a necessary part of educating for a just and democratic society. Only a truly multi-perspectival, multicultural education can create the conditions needed to alter the negative identity contingencies that minority students commonly face, while creating opportunities for all students. By treating identities as epistemic resources and mobilizing them, we can draw out their knowledge-generating potential and allow them to contribute positively to the production and (...) transmission of knowledge. Extended cognition brings with it a particular phenomenology. It has been argued that when an artifact is integrated into an agent’s cognitive system, it becomes transparent in use to the cognizing subject. In this paper, I challenge some of the assumptions underlying how the transparency of artifacts is described in extended cognition theory. To this end, I offer two arguments. First, I make room for some forms of conscious thought and attention within extended cognitive routines, and I question the close (...) association drawn between attention and effort. Second, I vindicate the importance of paying careful attention to individual differences and the diverse ways in which bodies and technologies can be experienced. I end by offering some hints toward an alternative, and more accurate, account of the phenomenology of extended cognition. (shrink)

In her recent book Causation and Free Will, Carolina Sartorio develops a distinctive version of an actual-sequence account of free will, according to which, when agents choose and act freely, their freedom is exclusively grounded in, and supervenes on, the actual causal history of such choices or actions. Against this proposal, I argue for an alternative- possibilities account, according to which agents’ freedom is partly grounded in their ability to choose or act otherwise. Actual-sequence accounts of freedom are motivated by (...) a reflection on so-called Frankfurt cases. Instead, other cases, such as two pairs of examples originally designed by van Inwagen, threaten actual-sequence accounts, including Sartorio’s. On the basis of her view of causation, Sartorio contends, however, that the two members of each pair have different causal histories, so that her view is not undermined by those cases after all. In this paper I deal with Richard Moran's account of self-knowledge in his book Authority and Estrangement. After presenting the main lines of his account, I contend that, in spite of its novelty and interest, it may have some shortcomings. Concerning beliefs formed through deliberation, the account would seem to face problems of circularity or regress. And it looks also wanting concerning beliefs not formed in this way. I go on to suggest a diagnosis of these problems, according to which (...) they would arise out of a view of agents too strongly dependent on the will. /// Este trabajo se ocupa de la concepción del autoconocimiento en el libro de Richard Moran Authority and Estrangement. The work presented has the following approach: starting from the Pope's reflection on the planet and ecological problems, it is intended to show the philosophical influences that underlie Francisco's exposition. These influences make it possible to describe a philosophical profile present in the encyclical Laudato si’. In addition, since philosophy claims to know, it is not exhausted only in knowledge, but tries to know in order to act; therefore, the presence of an ethical proposal follows; and since all ethics leads (...) to action, it follows that action cannot be without some indicators, without an axiology on which human action on the planet revolves. The result is that Francisco offers an ethic of otherness that feels the other as an authentic neighbor, even those who are in the future. It is an ethic of common benefit and caring for the other whose fundamental axis is the person and for this reason he reflects the phenomenon of human life within life on Earth, with which its philosophical approach seems personalist, from a point of Christian view. El libro de María González Navarro se presenta a sí mismo como una “nueva hermenéutica” (23). La novedad involucra dos aspectos: uno que llamaremos metateórico y otro hermenéutico en propiedad. Hablando metateóricamente, el libro presenta una hermenéutica gadameriana vigorizada y robustecida por las teorías pragma-dialécticas de la argumentación. Desde el punto de vista hermenéutico propiamente dicho, la novedad reposa en que se considera que la interpretación correcta está indesligablemente vinculada a la argumentación abductiva.

In his paper “What the externalist can know a priori”, Paul Boghossian rejects the compatibility between self-knowledge and content externalism by arguing that compatibilists are committed to the absurd view that a subject can know, by reasoning purely a priori, substantive truths about the world, such as that water exists. In this paper I try to show that Boghossian’s incompatibilist argument does not succeed. According to Boghossian, it is enough, for an externalist to reach the undesired conclusion, that she satisfies (...) a number of conditions that can be known by her a priori. I argue that, by an externalist’s lights, some of these conditions are simply too weak to be acceptable by her and some of them can only be known a posteriori. So, compatibilists are not committed to the absurdity Boghossian ascribes to them. (shrink)

Reactivity, or the phenomenon by which subjects tend to modify their behavior in virtue of their being studied upon, is often cited as one of the most important difficulties involved in social scientific experiments, and yet, there is to date a persistent conceptual muddle when dealing with the many dimensions of reactivity. This paper offers a conceptual framework for reactivity that draws on an interventionist approach to causality. The framework allows us to offer an unambiguous definition of reactivity and distinguishes (...) it from placebo effects. Further, it allows us to distinguish between benign and malignant forms of the phenomenon, depending on whether reactivity constitutes a danger to the validity of the causal inferences drawn from experimental data. In this chapter, I propose a new framework for extended epistemology, based on a second-wave approach to extended cognition. The framework is inclusive, in that it takes into account the complex interplay between the diverse embodiments of extended knowers and the salient properties of technological artifacts, as well as the environment in which they are embedded. Thus it both emphasizes and exploits the complementary roles played by these different elements. In this paper I address the question whether self-knowledge is compatible with an externalist individuation of mental content. Against some approaches, I consider self-knowledge as a genuine cognitive achievement. Though it is neither incorrigible nor infallible, self-knowledge is direct, a priori (no based on empirical investigation), presumptively true and authoritative. The problem is whether self-knowledge, so understood, is compatible with externalism. My answer will be affirmative. I will defend this species of compatibilism against several objections, in particular those based on (...) the possibility of an individual’s being unwittingly switched between worlds. (shrink)

This paper analyses the arguments for and against what we have called automatic organ procurement model in relation to the organs of the deceased. For this purpose, this work provides empirical evidence to assess the potential impact of this model on donation rates and on public opinion. Specifically, we examine first the reasons supporting this model, with special reference to utilitarian and justice arguments. On the other hand, we analyse both the approaches based on the violation of pre mortem and (...) post mortem interests opposing this theoretical model and the rejection the model would generate in the population. Finally, we point out the aspects that, in our opinion, should be exhaustively regulated if this model were implemented. In particular, we refer to the legal status of the human body, the treatments for end-of-life patients, the incentives for health professionals and the recognition of the right to conscientious objection. Una de las bifurcaciones en el debate contemporáneo sobre la legitimidad de la democracia explora si ésta ofrece ventajas distintivamente epistémicas frente a otras alternativas políticas. Quienes defienden la tesis de la democracia epistémica afirman que la democracia es instrumentalmente superior o equiparable a otras formas de organización política en lo que concierne a la obtención de varios bienes epistémicos. En este ensayo presento dos (grupos de) argumentos a favor de la democracia epistémica, que se inspiran en resultados formales: el (...) teorema del jurado de Condorcet [TJC] y el teorema ‘diversidad supera habilidad’ [DSH]. Pese a su gran atractivo, sostengo que estos argumentos son incapaces de respaldar dicha tesis: no brindan razones para considerar que la democracia es epistémicamente superior (o equiparable) a algunas alternativas políticas no democráticas. En su lugar, sugiero que, sin requerir un cambio radical en nuestras formas de organización política, la epistemología democrática –el estudio de las ‘circunstancias epistémicas de la democracia’– puede ofrecer valiosas lecciones de sobre cómo optimizar, en nuestra situación, instituciones y procedimientos de toma de decisiones. Para ello, primero distingo entre varias maneras de evaluar procedimientos de toma de decisión colectiva. Argumento que, al considerarlos como formas de organización política, un factor importante en la evaluación de tales procedimientos involucra asuntos fácticos sobre los cuales puede aspirarse a obtener o promover algunos bienes epistémicos. En este contexto, presento algunos de los argumentos más importantes a favor de la democracia epistémica. A continuación, reúno algunas de las objeciones sobre la aplicabilidad de dichos argumentos y ofrezco razones independientes para dudar de que ofrezcan apoyo a la tesis de la democracia epistémica. Finalmente, defiendo que la epistemología democrática puede desempeñar un papel significativo en la legitimación de formas de organización colectiva que podrían denominarse ‘democráticas’. (shrink)

En su artículo de 2000, Hookway pretende argumentar que el principio de justificación inferencial de Fumerton no tiene las consecuencias escépticas que Fumerton observa en él. Nosotros consideramos que Hookway está en lo cierto. Sin embargo, después de hacer algunos comentarios acerca de sus principales consideraciones a favor de esta tesis, desarrollamos una línea argumentativa independiente que refuerce esa misma conclusión.

Davidson’s famous 1963 paper “Actions, Reasons, and Causes” contains, in nuce, the main lines of Davidson’s philosophy of action and mind. It also contains the seeds of some major problems of Davidson’s thought in these fields. I shall defend, following Davidson, that rationalization or reasons explanation is a species of causal explanation, but I will be contending, against Davidson’s approach, that causality is best viewed, in this kind of explanation, as an integral aspect of justification itself, and not as an (...) independent, additional condition. Davidson’s antisceptical considerations, like Putnam’s, are transcendental in character: they start from facts that the sceptic has to accept, and are intended to show that those facts would not be such if the sceptical hypotheses were true. It is doubtful that these considerations are finally successful. However, I do not think that Davidson was really interested in a detailed refutation of scepticism. His interest focused instead on the context which gives rise to it: the Cartesian image of the relationships between (...) subjectivity, intersubjectivity, and objectivity. Correspondingly, the true value of Davidson’s antisceptical reflections lies in the alternative image that inspires them, in the light of which scepticism no longer appears as an urgent and interesting problem. En este artículo se sostiene, en cambio, que el concepto de justificación es ya causal, de modo que no es necesario exigir un requisito causal independiente para entender (...) el concepto de acción intencional. Esta concepción causal de la justificación y de la acción intencional no se ve expuesta al problema de las cadenas causales desviadas que afecta a las teorías causales ortodoxas ni a la amenaza deI epifenomenismo de las propiedades mentales. -/- Both causal and non-causal action theories take the justification relation to be a non-causal, purely conceptual or logical relation between reasons and action. According to causal theorists, intentional action has to satisfy, besides the justification condition, an additional and independent causal condition. In this paper it is held, however, that justification is already a causal concept, so that there is no need to resort to an independent causal requirement in order to understand the concept of intentional action. This causal view of justification and intentional action does not face either the problem of wayward causalchains which infects orthodox causal theories or the threat of epiphenomenalism of mental properties. In a recent article, Robert Lockie brings about a critical examination of three Frankfurtstyle cases designed by David Widerker and Derk Pereboom. His conclusion is that these cases do not refute either the Principle of Alternative Possibilities or some cognate leeway principle for moral responsibility. Though I take the conclusion to be true, I contend that Lockie's arguments do not succeed in showing it. I concentrate on Pereboom's Tax Evasion 2. After presenting Pereboom's example and analyzing its structure, I distinguish (...) two strategies of Lockie's to defend PAP against it, which I call "No True Alternative Decision" and "No Responsibility", respectively. According to NTAD, Pereboom's example fails because the agent has alternatives to his decision. I hold that this strategy is faulty because the alternatives that Lockie points to are arguably not robust enough to save PAP. According to NR, the example fails because the agent is not blameworthy for his decision. After defending the intuitiveness of the agent's blameworthiness, I present Lockie's arguments against this blameworthiness and suggest that they might beg the question against Frankfurt theorists. I examine Lockie's main response to this question-begging objection and hold that it does not clearly succeed in meeting it. Moreover, I hold that this response faces other important problems. Additional responses appear to be unsatisfactory as well. Hence, Lockie's defense of the agent's blamelessness lacks justification. The general conclusion is that Lockie does not succeed in defusing Pereboom's Tax Evasion 2 as a counterexample to PAP. (shrink)

I provide an overview of the differences between psychological pessimism and philosophical pessimism. Based on a historic reading of the original 19th century German pessimist philosophers I provide a definition of what I call "transcendental pessimism" and sketch some of the reasons why it is different from other pessimist perspectives such as anti-natalism.

Sila elección está causada por factores ajenos a la voluntad del agente, la libertad y la responsabilidad moral parecen perder su base. Pero si la elección carece de causas, se convierte en un acto irracional y, con ello, irresponsable. La salida de este dilema consiste en advertir la importancia de las razones morales en la deliberación práctica. De acuerdo con la tesis central del presente trabajo, la sensibilidad hacia las razones morales es una condición necesaria de la libertad y la (...) responsabilidad moral. La inconmensurabilidad de tales razones con las razones no morales concede a la elección el lugar central que demanda la responsabilidad moral, pero, al mismo tiempo, la mantiene vinculada a la racionalidad, evitando su conversión en un acto irresponsable. Si esto es así, la disminución (o pérdida) de la sensibilidad de un agente hacia las razones morales significa también la disminución (o pérdida) de su libertad y responsabilidad moral. (shrink)

En el presente artículo se presenta el panorama y algunos de los más importantes avances que en Colombia se han dado en materia ambiental desde la Constitución Política de 1991. La metodología llevada a cabo es descriptiva y analítica, en tanto se estudian no sólo las normas sino las sentencias más relevantes que se han constituido en un hito en la protección de los derechos ambientales. En tal sentido, lo que se pretende evidenciar es la existencia de un panorama de (...) constitucionalización de los derechos ambientales con signicativos avances tales como el rol preponderante que ha adquirido el principio de precaución o el reconocimiento de la función ecológica de la propiedad. A notion that comes from the toolbox of social sciences, trust has become a mainstream epistemological concept in the last 15 years. The notion of epistemic trust has been distinguished from the notion of moral and social trust, the former involves kinds of inferences about the others that are rationally justifiable. If I trust a scientist about the efficacy of a vaccine against COVID-19, I must have an epistemic justification. I am therefore rationally justified in trusting her because I have (...) an epistemic reason to justify my belief. I will challenge the distinction between epistemic and moral and social trust by pointing to several social indicators that contribute to our trustful attitudes in a reasonable way. Social indicators of reputation, values and moral commitments to values are indispensable strategies to come to trust in a rational way, an attitude that is different from merely believing the truth. I also point out the fragility of trusting experts’ reputations and stress the importance of avoiding biases in trusting other people’s reputations to make our deference to experts more robust. El daño ambiental ha despertado el interés de la doctrina en Colombia, aunque aún no se aborda con rigor y profundidad. La razón, entre otras, es la omisión de los avances que ha dado el derecho comparado, donde la concepción del rol de las instituciones jurídicas va hasta una comprensión integral del daño a partir de la alteración funcional de los sistemas. Existe hoy cierto consenso respecto al deber ser del régimen de responsabilidad aplicable a esta noción integral del daño (...) ambiental, capaz de hacer frente a los componentes del medio natural y a todos los que lo conforman. El libro busca aportar al estudio del daño ambiental desde los avances antes descritos en la materia. (shrink)

En el presente trabajo sostenemos que la concepción de la intencionalidad en la teoría de la acción más ampliamente aceptada en la actualidad hace difícil una comprensión adecuada del papel de las emociones en la génesis e interpretación de la acción. La asimilación de las emociones a actitudes intencionales descuida lo que cabría llamar su contenido emocional y pasa por alto importantes diferencias entre su contenido intencional y el de las actitudes intencionales paradigmáticas, como creencias, deseos e intenciones. Sugerimos, sobre (...) esta base, que las relaciones externas y causales deberían tener un lugar más destacado en la comprensión y explicación de las acciones humanas. (shrink)

The economic crisis in Europe exposes the European Union’s political fragility. How a polity made of very different states can live up to the motto “Europe united in diversity” is difficult to envisage in practice. In this paper I attempt an “exegesis”—a critical explanation or interpretation of a series of published pieces (“the Series”) which explores, first, if European unity is desirable at all. Second, it presents a new methodology—analogical hermeneutics—used throughout the Series to approach the problem of unity. Third, (...) it conceptualises the source of unity as political identity. Fourth, it advances that the vehicle to share such identity is an analogical language: the political culture of human rights. Fifth, it submits the conditions under which such political culture could ground political identity through an open public sphere. Finally, it presents a way in which solidarity can grow as the increasingly diverse citizens of the European Union interact with each other. Even though the economic crisis can be solved by means of sound economic strategy (which is not the main object of my work), any successful economic strategy requires—as a precondition—a certain degree of political unity (the central concern of my research). My aim is to explore how the notion of personhood is tied to the notion of space--both physical and moral space. In particular, I argue against the Cartesian view of the disengaged/disembodied self and in favour of Charles Taylor's and Martin Heidegger's view of the engaged and embedded self. I contend that space, as the transcendental condition for the possibility of human agency, is the place where questions of identity are possible and answers, if any, are to be found. The human person has been analyzed from several points of view throughout the history. Great theologians, philosophers, anthropologists and sociologists and other specialists have written extensively on the subject. The philosophical contribution centered on the human person has been significant throughout history. In the last century, Romano Guardini, who received the Erasmus Prize for Best European Humanist and called "Master of Life" offers a view of reality man-centered, through a thin, deep and coherent approach on the individual. His work has (...) been labeled by some philosophers within the personalist current, and although his contributions were many, we want to highlight the elements of the meeting, the language and the self-acceptance. In this paper we propose how this approach to the human person can become an intinerary embodied in reality, that can help today to seek clarification and start delving into own personal knowledge enlightened by faith. -/- La persona humana ha sido analizada desde varios puntos de vista a lo largo de la historia. Grandes teólogos, filósofos, antropólogos y sociólogos entre otros especialistas han escrito profusamente acerca del tema. El aporte de una filosofía centrada en la persona humana ha sido significativo a lo largo de la historia. En el último siglo, Romano Guardini, quien recibió el Premio Erasmo al Mejor Humanista Europeo y llamado “Maestro de Vida”, propone una visión de la realidad centrada en el hombre, a través de una aproximación fina, profunda y coherente sobre la persona humana. Su trabajo ha sido catalogado por algunos filósofos dentro de la corriente personalista, y si bien sus aportes fueron muchos queremos resaltar los elementos del encuentro, el lenguaje y la aceptación de sí mismo. En este trabajo proponemos cómo dicha aproximación a la persona humana se puede convertir en un itinerario encarnado en la realidad que puede ayudar hoy en día a quienes buscan esclarecer y comenzar a ahondar en el propio conocimiento personal iluminados por la fe. Several European countries are approving legislative reforms moving to a presumed consent system in order to increase organ donation rates. Nevertheless, irrespective of the consent system in force, family's decisional capacity probably causes a greater impact on such rates. In this contribution we have developed a systematic methodology in order to analyse and compare European organ procurement laws, and we clarify the weight given by each European law to relatives' decisional capacity over individual's preferences (expressed or not while alive) regarding (...) the destination of his or her organs after death. In this sense, the results constitute the first comprehensive and comparative legislative mapping on European transplantation laws. (shrink)

Este artículo trata de mostrar la idea de sociedad y de convivencia política de los ciudadanos en el pensamiento de John Stuart Mill desde su perspectiva utilitarista, en la cual el objetivo es la felicidad de las personas.

Political integration has been part of the European project from its very beginnings. As far back as the early seventies there was concern in Brussels that an ingredient was missing in the political integration process. ‘Output legitimacy’ – the permissive consensus citizens grant to a government that is ‘delivering’, even if they do not participate in setting its goals – could not sustain unification indefinitely. Such a lacking ingredient – or ‘soul’ – has been labelled ‘European identity’ (EI) in an (...) abundant and growing academic literature. According to Aristotle, ‘polity’ is a specific ‘constitution’ (regime or politeia) of a ‘city’ (or polis): a (‘political’) community composed of ‘citizens’ (politai). No polis can exist unless the politai come together to form it and sustain it. But what will gather and keep them united? Citizens can be very diverse regarding their language, history, religion or economic activity. In absence of a motivation, diversity of itself will make each member of a community go their own way. What kind of bond is required among very diverse European citizens to keep their polis (the EU) – their political community – together? In this paper I analyse several responses – culture, deliberation, welfare, power, multiplicity. Then I attempt a synthesis suggesting that the answers might be referring to different aspects of a single notion – rather than exhaustive explanations of it. Finally I mention three issues regarding the concept of EI that require further study. (shrink)

Este artículo sugiere que los derechos humanos existen, que requieren fundamentación y que esa fundamentación debe ser objetiva para tener validez y legitimidad (debe ser verdadera). La clave para la fundamentación de los derechos humanos, aquí se propone, descansa en el concepto metafísico de naturaleza. El artículo concluye señalando el valor del diálogo, la comunicación y el consenso, si no para decidir cuál es la verdad, al menos para avanzar, a través de las contribuciones de todos, hacia el desvelamiento de (...) la verdad sobre la naturaleza humana. Los derechos humanos se ligan después al problema de la identidad política a través de la hermenéutica analógica. (shrink)

A través de su historia, la práctica de la medicina ha estado imbuida de diversas concepciones sobre la naturaleza humana, así como sobre los elementos, estados o procesos (tanto internos como externos) que dan origen a la enfermedad y aquellos que propician la salud. Si se consideran seriamente, tales concepciones se pronuncian sobre cuestiones ontológicas y metafísicas. En la medida en que sean dignas de crédito, sus pronunciamientos ontológicos y metafísicos resultan relevantes para múltiples facetas de la práctica médica, como (...) el diagnóstico, el tratamiento, la investigación, la prevención y el control de enfermedades, pero también para el cuidado y la promoción de la salud. En este capítulo se exploran cuestiones metafísicas generales en torno a la concepción de la práctica médica más influyente en el mundo actual: la biomedicina. Sostengo que, a pesar de que el asombroso éxito de las ciencias biomédicas nos ofrece razones para creer en la verdad (aproximada) de las representaciones que toman como base, esa confianza no debería estar asociada selectivamente a pronunciamientos específicos sobre qué cosas existen y cómo se conectan; además, nuestro grado de convicción en los resultados de la investigación biomédica debería estar calibrado al tomar en cuenta vulnerabilidades ampliamente reconocidas de este ámbito de indagación. Comienzo caracterizando la biomedicina como la aplicación de los resultados de la investigación científica a la práctica médica. Examino razones generales para creer en la verdad de las representaciones con las que opera este modelo de la práctica médica, recapitulando de manera panorámica el debate en torno al realismo científico. Luego consideraro aspectos relevantes para este debate que conciernen específicamente a las ciencias biomédicas, así como algunas consecuencias para el ámbito de la biomedicina que se desprenden de adoptar varias posiciones en torno al realismo científico. Concluyo ofreciendo una defensa del realismo carte blanche como la posición más sensata que puede adoptarse en este ámbito. (shrink)

Aunque la problemática de los daños ambientales ha atraído el interés sustancial de profesionales y académicos de diversas disciplinas, los motivos que impulsan esas prácticas han recibido poca atención en la literatura jurídica colombiana. Especialmente desde la perspectiva de la responsabilidad. Este capítulo presenta unas reflexiones preliminares de la responsabilidad por daños ambientales, para introducir el estudio de diversos temas, hacia una construcción doctrinal enmarcada no sólo en el deber de evitar el progresivo deterioro ambiental causado por el hombre, sino (...) para salvaguardar las especies vivas que habitan y habitarán este planeta, así como el legado que le quedará a las generaciones venideras. Have you ever kept a diary of your personal life? For many people, keeping a written record of their experiences, thoughts, feelings, travels or encounters with people is a common practice. For others, it is not. Perhaps for some it is something completely foreign. For Russian Orthodox priest Alexander Schmemann it was clearly not. His diary, two volumes of almost 600 pages each, has given an insight into the life, worries, joys and even disappointments of one of the most influential (...) theologians of the 20th century. On this occasion we would like to refer to the first volume and scrutinize a little of what this work brings to the world today. ¿Ha llevado usted un diario de su vida personal? Para muchas personas, llevar un registro escrito de sus vivencias, pensamientos, sentimientos, viajes o encuentros con personas es una práctica común. Para otros no. Quizá para algunos esto es algo completamente ajeno. Es evidente que para el sacerdote ortodoxo ruso Alexander Schmemann no lo fue. Su diario, dos tomos de casi 600 páginas cada uno, ha dejado ver a fondo la vida, preocupaciones, alegrías, e incluso desilusiones de uno de los teólogos más influyentes del siglo XX. En esta ocasión queremos referirnos al primer tomo y escudriñar un poco qué aporta esta obra al mundo de hoy. (shrink)

From the political point of view, European Union (EU) integration implies some kind of unity in the community constituted by EU citizens. Unity is difficult to attain if the diversity of citizens (and their nations) is to be respected. A thick bond that melts members' diversity into a 'European pot' is therefore out of the question. On the other hand, giving up unity altogether makes political integration impossible. Through a meta-theoretical analysis of normative positions, this paper proposes a composed notion (...) of European identity that links without binding. It contains four facets – cultural, political, social, external – with nuances, expressed in three binaries, that cut across all of them – history-project, ethos-achievement, commonness-uncommonness. I will submit that a workable European identity (and the related concepts of unity, polity and citizenship) can be better conceived as analogical – a mid way between blending unity and irreconcilable diversity. Naturalism, construed as the idea that philosophy should be continuous with science, is a highly influential view. Its consequences for epistemology, however, are rather odd. Many believe that naturalized epistemology allows eschewing traditional skeptical challenges. This is often seen as an advantage; but it also calls into question its claim of belonging to the philosophical inquiry into knowledge. This paper argues that skeptical challenges can be stated to defy epistemic optimism within naturalized epistemology, and that there are distinctively naturalistic forms (...) of skepticism. To that end, it outlines some assumptions underlying many attempts to naturalize epistemology. It contrasts these approaches to traditional epistemology and identifies the reasons offered by naturalistic epistemologists to dismiss traditional skeptical challenges. Next, it argues that the problem of skepticism can be sensibly stated within a naturalistic setting. Finally, it contends that there are distinctively naturalistic strategies to argue for skepticism and diagnoses the prospects of naturalism vis-à-vis these kinds of skeptical challenges. (shrink)

This article analyses the epistemic status of law and its presumption of being a science in relation with the so-called demarcation criterion proposed by different philosophers of science. Such criteria are the main analytical elements to differentiate scientific discourses from those who are not and the ones who pretend to be. In relation to those, pseudoscience and law are treated, to finally conclude with the exposition of the case of Daubert v. Merrill Dow Pharmaceuticals, in which a judicial process defined (...) demarcation criteria. This paper shows how the demarcation criteria of science and the concept of pseudoscience cannot be applied to law science given its own rationality. (shrink)

En los últimos tiempos el derecho ambiental ha ganado un puesto importante en el ámbito jurídico, hecho que refleja la preocupación que hoy se tiene por la relación del hombre con su entorno. Desde hace quince años, la Universidad Colegio Mayor de Nuestra señora del Rosario, por intermedio de su Facultad de Jurisprudencia y concretamente de la Especialización y la línea de investigación en Derecho Ambiental, ha propuesto a través de diversos proyectos avanzar en el conocimiento y análisis del ordenamiento (...) jurídico ambiental, aportando así al desarrollo, estructura y consolidación de esta rama jurídica. Bajo estos parámetros, el objetivo de esta publicación es hacer algunas reflexiones en torno a distintos temas que dentro del derecho público impactan o influyen al derecho ambiental y responder a los enormes desafíos que se presentan en la materia. Por tanto, el programa quiere contribuir desde la academia al diálogo crítico y propositivo que permita dar solución a los problemas encontrados en la aplicación del derecho ambiental. En el primer capítulo, Gloria Amparo Rodriguez describe los ordenamientos jurídicos constitucionales de Colombia, Ecuador y Bolivia a fin de analizar la forma en que cada uno de ellos consagra el derecho a un ambiente sano. A continuación, Martha Ovalle y Zelba Nidia Castro de Perez realizan un estudio de los principios de precaución y prevención, exponiendo su alcance, su fundamento desde el derecho internacional y cómo vienen siendo entendidos por nuestro ordenamiento jurídico, tanto jurisprudencial como legal. Luis Adolfo Diazgranados se ocupa de la responsabilidad de los funcionarios públicos en materia ambiental, para lo cual realiza un análisis de los deberes consagrados en la normatividad vigente. Continuando con esta temática, el profesor Jorge Agudo Gonzalez, de la Universidad Autónoma de Madrid, explora la incidencia del ambiente y los recursos naturales en los procesos contractuales, a fin de mostrar cómo estas materias se han constituido en variable fundamental en el devenir de la formación, celebración y ejecución de los contratos, desde un punto de vista crítico, los aspectos importantes del proceso sancionatorio ambiental, evidenciando las falencias y vacios del a Ley 1333 de 2009. Jairo Cabrera plantea algunas reflexiones sobre la responsabilidad, valiéndose de la doctrina internacional, sobre la problemática de la reparación por daño ambiental. Por su parte, Leonardo Güiza Suárez explica el régimen general de la responsabilidad ambiental en el ordenamiento jurídico a partir del daño de los bosques naturales y su incidencia sobre los derechos humanos. Andres Gomez Rey, desde la teoría del acto administrativo, desarrolla el análisis crítico del régimen jurídico de las aguas superficiales en el derecho ambiental. Giovani J. Herrera Carrascal realiza una disertación sobre los recursos naturales y el ambiente como elementos del espacio público que a su vez constituye en un componente del medio ambiente urbano a partir de la jurisprudencia y de las competencias respectivas. Por último, Marybell Ochoa Miranda trate el tema de los residuos hospitalarios en Colombia, exponiendo su régimen jurídico, las competencias de las autoridades ambientales, los deberes que en estos asuntos tienen los ciudadanos, proponiendo lineamientos para avanzar en la consolidación de la gestión integral de residuos hospitalarios y similares. Los intereses contrapuestos en relación con el manejo, uso, utilización y aprovechamiento de los recursos naturales de los territorios indígenas, generan conflictos ambientales en donde uno de los escenarios privilegiados de expresión de los mismos es el de la consulta previa: cuando se adelanta o por el contrario, cuando aunque sea obligatoria, no se impulsa o se hace de manera inadecuada, es decir, sin el cumplimiento de los requisitos mínimos establecidos.
