Whether and to what extent Ernst Cassirer’s philosophy of culture contains a normative element for the proper evaluation of symbolic forms is a central question in Cassirer interpretation. In this paper, my aim is to specify the nature of this normative element. I not only assert the existence of a real normative dimension in the philosophy of culture, but also specify the nature of its main element: the concept of freedom. The concept of freedom in Cassirer is by no means (...) an explicit facet of his systematic thought. However, this does not indicate that this is not an important part of his system. Rather, it might mean that Cassirer either thought it so basic he didn’t need to explicate it or he thought that it would be made clear through his exposition of symbolic forms. I will proceed by arguing for a “normative space” in Cassirer’s philosophy of culture. By “normative space” I mean a certain limitation to the philosophy of culture that makes room for the free act of the cultural agent for which she is responsible. In other words, by “normative space” I mean to suggest that Cassirer meant to leave room, and a prominent seat, for the normative element in the philosophy of culture. After establishing this, I will suggest that this normative task in the philosophy of culture is, from a first-person perspective, inevitably connected to the descriptive task, but from a third-person perspective, conceptually distinct. I will then move to better define what I take to be the main value of the normative task: freedom. The freedom that Cassirer defends is an ethical conception understood as both a constitutive norm for cultural action and a regulative ideal for the evaluation of cultural objects. Understanding freedom in this way allows us to conceive of it both as a fundamental phenomenon and an evaluative standard. (shrink)

This paper argues against the common justification for the necessity of the state through the particular difficulty of private property right. Instead, I argue that the necessity of the state is internal to the concept of right in general. In order to show this, I point out how Kants adoption of hylomorphic language for the concept of right, where there is a formal and material aspect of right, allows us to understand the Rechtslehre as progressing through a syllogistic deduction from (...) innate right (major), private right (minor) to public right (conclusion). Material right is made necessary through its subsumption under formal right in the civil condition. (shrink)

ABSTRACT This article examines the under-researched figure A.W. Rehberg in his exchange with Kant over the relationship between theory and practice in the philosophy of right. I argue that Rehberg raises, what I call, two problems of political matter which attempt to show that Kant's overly formal approach to political theory cannot justifiably determine political practice. The first problem is the problem of positive determinations of right, rather than merely negative prohibitions. Rehberg takes this to mean that Kant cannot determine (...) us to a specific form of constitution. I argue that Kant's innovation of intelligible property functions as a response to this critique in that it provides the possibility of synthetic propositions of right a priori. Second, Rehberg insists that an a priori system of right cannot relate to already formed historical communities. Here Kant's response comes close to agreeing with Rehberg as Kant takes prudential or historical reasoning to harmonize with the demands of a priori right in order to applied to the sensible world. Kant, in this instance, comes closer to Rehberg by denying centralized enlightened monarchy and the reliance on natural and historical development for the application of right. (shrink)

Pereira’s “The Projective Theory of Consciousness” is an experimental statement, drawing on many diverse sources, exploring how consciousness might be produced by a projective mechanism that results both in private selves and an experienced world. Unfortunately, pulling together so many unrelated sources and methods means none gets full attention. Furthermore, it seems to me that the uncomfortable breadth of this paper unnecessarily complicates his project; in fact it may hide what it seeks to reveal. If this conglomeration of diverse sources (...) and methods were compared to trees, the reader may feel like the explorer who cannot see the forest for the trees. Then again, it may be the author who is so preoccupied with foreground figures that the everpresent background is ultimately obscured. (shrink)

This article examines an appendix to the Doctrine of Virtue which has received little attention. I argue that this passage suggests that Kant makes it a duty, internal to his system of duties, to ‘join the graces with virtue’ and so to ‘make virtue widely loved’ (MM, 6: 473). The duty to make virtue widely loved obligates us to bring the standards of respectability, and so the social graces, into a formal agreement with what morality demands of us, such that (...) the social graces give the illusion of virtue. The existence of such a duty can answer Schiller’s persistent objection that Kant’s ethics scares away the Graces with Duty. (shrink)

This is an important collection in that it fleshes out the vague postulate of panpsychism with a detailed analysis of how it might be understood (if not exactly what it might mean). For the many skeptics who simply dismiss the very idea as ridiculous, there is much here to demonstrate that a good deal of serious thought has gone into this ancient proposal. There are many ways to interpret panpsychism, and they are well represented in this group of philosophers, each (...) speaking for a unique take on the subject or one of its variations– from cosmopsychism to panprotopsychism to panexperientialism to neutral monism, etc. The combination problem is fully interrogated, as is panpsychism associated with dualism, idealism, physicalism, theism, etc. Anyone reading this book is bound to gain some respect for the complexity of such subject matter and the compelling logic for approaching it. In ‘Godel’s Way’ three eminent scientists discuss issues such as undecidability, incompleteness, randomness, computability and paraconsistency. I approach these issues from the Wittgensteinian viewpoint that there are two basic issues which have completely different solutions. There are the scientific or empirical issues, which are facts about the world that need to be investigated observationally and philosophical issues as to how language can be used intelligibly (which include certain questions in mathematics and logic), which need to be decided by looking at (...) how we actually use words in particular contexts. When we get clear about which language game we are playing, these topics are seen to be ordinary scientific and mathematical questions like any others. In Beyond Physicalism, an interdisciplinary group of physical scientists, behavioral and social scientists, and humanists from the Esalen Institute’s Center for Theory and Research argue that physicalism must be replaced by an expanded scientific naturalism that accommodates something spiritual at the heart of nature.

In this paper, I show that we should understand the direction of fit of beliefs and desires in normative terms. After rehearsing a standard objection to Michael Smith’s analysis of direction of fit, I raise a similar problem for Lloyd Humberstone’s analysis. I go on to offer my own account, according to which the difference between beliefs and desires is determined by the normative relations such states stand in. I argue that beliefs are states which we have reason to (...) change in light of the world, whereas desires are states that give us reason to change the world. After doing this, I show how the view avoids various objections, including two from David Sobel and David Copp. The paper ends by briefly discussing the relevance of the view to the Humean theory of motivation. Joel Pust has recently challenged the Thomas Reid-inspired argument against the reliability of the a priori defended by Alvin Plantinga, Nicholas Wolterstorff, William Alston, and Michael Bergmann. The Reidian argument alleges that the Cartesian insistence on the primacy of a priori rationality and subjective sensory experience as the foundations of epistemic justification is unwarranted because the same kind of global skeptical scenario that Cartesians recognize as challenging the legitimacy of perceptual beliefs about the external world also undermine the reliability (...) of a priori rationality. In reply, Pust contends that some a priori propositions are beyond doubt and that fact can be used to support the overall reliability of reason. This paper challenges Pust’s argument. I argue that while Pust successfully undermines a radical skeptical view of reason, he does not refute a more modest skepticism. I conclude with some suggestions for Cartesian a priorists. (shrink)

Abstract. On the Direct Reference thesis, proper names are what I call ‘genuine terms’, terms whose sole semantic contributions to the propositions expressed by their use are the terms’ semantic referents. But unless qualified, this thesis implies the false consequence that sentences containing names that fail to refer can never express true or false propositions. (Consider ‘The ancient Greeks worshipped Zeus’, for instance.) I suggest that while names are typically and fundamentally used as genuine terms, there is a small class (...) of names, which I call ‘descriptive names’, whose reference is fixed by commonly associated definite descriptions, and I also suggest that there is an idiom of natural language on which such names can be used as abbreviated definite descriptions in a limited set of sentential contexts, including (1) positive and negative existentials, (2) cognitive ascriptions, and (3) uses of names to talk about myth. Uses of empty descriptive names in such contexts can then be either true or false. Relying on Gregory Currie’s theory of truth in fiction, I also propose an idiom on which fictional names can be used as short for a certain type of description in talk about fiction. Along the way, I provide arguments that names are used as short for descriptions in substantive existential statements as well as in both metamythic and metafictive contexts. I also discuss and criticize alternative views of these matters, including the views of David Braun, Saul Kripke, Peter van Inwagen, and others. (shrink)

I have read many recent discussions of the limits of computation and the universe as computer, hoping to find some comments on the amazing work of polymath physicist and decision theorist David Wolpert but have not found a single citation and so I present this very brief summary. Wolpert proved some stunning impossibility or incompleteness theorems (1992 to 2008-see arxiv.org) on the limits to inference (computation) that are so general they are independent of the device doing the computation, and even (...) independent of the laws of physics, so they apply across computers, physics, and human behavior. They make use of Cantor's diagonalization, the liar paradox and worldlines to provide what may be the ultimate theorem in Turing Machine Theory, and seemingly provide insights into impossibility, incompleteness, the limits of computation,and the universe as computer, in all possible universes and all beings or mechanisms, generating, among other things,a non- quantum mechanical uncertainty principle and a proof of monotheism. There are obvious connections to the classic work of Chaitin, Solomonoff, Komolgarov and Wittgenstein and to the notion that no program (and thus no device) can generate a sequence (or device) with greater complexity than it possesses. One might say this body of work implies atheism since there cannot be any entity more complex than the physical universe and from the Wittgensteinian viewpoint, ‘more complex’ is meaningless (has no conditions of satisfaction, i.e., truth-maker or test). Even a ‘God’ (i.e., a ‘device’ with limitless time/space and energy) cannot determine whether a given ‘number’ is ‘random’ nor can find a certain way to show that a given ‘formula’, ‘theorem’ or ‘sentence’ or ‘device’ (all these being complex language games) is part of a particular ‘system’. -/- Those wishing a comprehensive up to date framework for human behavior from the modern two systems view may consult my article The Logical Structure of Philosophy, Psychology, Mind and Language as Revealed in Wittgenstein and Searle 59p(2016). In recent years, philosophers have proposed a variety of accounts of the nature of harm. In this paper, I consider several of these accounts and argue that they are unsuccessful. I then make a modest case for a different view.

John Bell proposed an ontology for the GRW modification of quantum mechanics in terms of flashes occurring at space- time points. This article spells out the motivation for this ontology, inquires into the status of the wave function in it, critically examines the claim of its being Lorentz invariant, and considers whether it is a parsimonious but nevertheless physically adequate ontology.

The essay argues that while there is no general agreement on whether moral realism is true, there is general agreement on at least some of the moral obligations that we have if moral realism is true. Given that moral realism might be true, and given that we know some of the things we ought to do if it is true, we have a reason to do those things. Furthermore, this reason is itself an objective moral reason. Thus, if moral realism (...) might be true, then it is true. (shrink)

Editors' introduction to 3rd thematic issue on philosophy of medicine.

The main question addressed in this paper is whether some false sentences can constitute evidence for the truth of other propositions. In this paper it is argued that there are good reasons to suspect that at least some false propositions can constitute evidence for the truth of certain other contingent propositions. The paper also introduces a novel condition concerning propositions that constitute evidence that explains a ubiquitous evidential practice and it contains a defense of a particular condition concerning the possession (...) of evidence. The core position adopted here then is that false propositions that are approximately true reports of measurements can constitute evidence for the truth of other propositions. So, it will be argued that evidence is only quasi-factive in this very specific sense. (shrink)

Episodic memory (memories of the personal past) and prospecting the future (anticipating events) are often described as mental time travel (MTT). While most use this description metaphorically, we argue that episodic memory may allow for MTT in at least some robust sense. While episodic memory experiences may not allow us to literally travel through time, they do afford genuine awareness of past-perceived events. This is in contrast to an alternative view on which episodic memory experiences present past-perceived events as mere (...) intentional contents. Hence, episodic memory is a way of coming into experiential contact with, or being again aware of, what happened in the past. We argue that episodic memory experiences depend on a causal-informational link with the past events being remembered, and that, assuming direct realism about episodic memory experiences, this link suffices for genuine awareness. Since there is no such link in future prospection, a similar argument cannot be used to show that it also affords genuine awareness of future events. Constructivist views of memory might challenge the idea of memory as genuine awareness of remembered events. We explain how our view is consistent with both constructivist and anti-causalist conceptions of memory. There is still room for an interpretation of episodic memory as enabling genuine awareness of past events, even if it involves reconstruction. (shrink)

It is hard to see why the head and other brain-containing parts of a person are not themselves persons, or at least thinking, conscious beings. Some theorists have sought to reconcile us to the existence of thinking person-parts. Others have sought to avoid them but have relied on radical theories at odds with the metaphysic implicit in ordinary ways of thinking. This paper offers a novel, conservative solution, one on which the heads and other brain-containing parts of persons do exist (...) but are neither persons, thinkers, nor conscious beings. Passion is a hidden issue behind or at the heart of, contemporary theoretical debates about nationalism, identity politics and religious fundamentalism. It is not that reason and passion cannot be conceptually distinguished. They are, however, always entangled in practice - and this entanglement itself requires a conceptual account. So it is my ambition to blur the line between reason and passion: to rationalize (some of) the passions and to impassion reason. Passionate intensity has a legitimate place in the social world. (...) This extension of rational legitimacy to the political passions seems to me a useful revision of liberal theory which has been too pre-occupied in recent years with the construction of dispassionate deliberative procedures. It opens the way for better accounts of social connection and conflict and for more explicit and self-conscious answers to the unavoidable political questions: which side are you on? Why should a thought experiment, an experiment that only exists in people's minds, alter our fundamental beliefs about reality? After all, isn't reasoning from the imaginary to the real a sign of psychosis? A historical survey of how thought experiments have shaped our physical laws might lead one to believe that it's not the case that the laws of physics lie - it's that they don't even pretend to tell the truth. My aim in this paper is to defend an (...) account of thought experiments that fits smoothly into our understanding of the historical trajectory of actual thought experiments and that explains how any rational person could allow an imagined, unrealized (or unrealizable) situation to change their conception of the universe. How can people function appropriately and respond normatively in social contexts even if they are not aware of rules governing these contexts? John Searle has rightly criticized a popular way out of this problem by simply asserting that they follow them unconsciously. His alternative explanation is based on his notion of a preintentional, nonrepresentational background. In this paper I criticize this explanation and the underlying account of the background and suggest an alternative explanation of the normativity of elementary social practices (...) and of the background itself. I propose to think of the background as being intentional, but nonconceptual, and of the basic normativity or proto-normativity as being instituted through common sensory-motor-emotional schemata established in the joint interactions of groups. The paper concludes with some reflections on what role this level of collective intentionality and the notion of the background can play in a layered account of the social mind and the ontology of the social world. While evil has always fascinated philosophers, it is only in modern times that the existence of evil has been seen as a serious challenge to belief in the existence of a powerful and benevolent God. In order to demonstrate this, the following chapter traces the historical emergence of what philosophers today call “the problem of evil” through an analysis of the writings of Plato, Epicurus, Sextus Empiricus, Augustine, Aquinas, Calvin, Descartes, Bayle, and Hume.

Jaegwon Kim’s influential exclusion argument attempts to demonstrate the inconsistency of nonreductive materialism in the philosophy of mind. Kim’s argument begins by showing that the three main theses of nonreductive materialism, plus two additional considerations, lead to a specific and familiar picture of mental causation. The exclusion argument can succeed only if, as Kim claims, this picture is not one of genuine causal overdetermination. Accordingly, one can resist Kim’s conclusion by denying this claim, maintaining instead that the effects of the (...) mental are always causally overdetermined. I call this strategy the ‘ overdetermination challenge’. One of the main aims of this paper is to show that the overdetermination challenge is the most appropriate response to Kim’s exclusion argument, at least in its latest form. I argue that Kim fails to adequately respond to the overdetermination challenge, thus failing to prevent his opponents from reasonably maintaining that the effects of the mental are always causally overdetermined. Interestingly, this discussion reveals a curious dialectical feature of Kim’s latest response to the overdetermination challenge: if it succeeds, then a new, simpler and more compact version of the exclusion argument is available. While I argue against the consequent of this conditional, thereby also rejecting the antecedent, this dialectical feature should be of interest to philosophers on either side of this debate. This paper argues that Kant’s concept of ‘respect’ for the moral law has roots in Adam Smith’s concept of ‘regard’ for the general rules of conduct, which was translated as Achtung in the first German translation of the Theory of Moral Sentiments. After illustrating that Kant’s technical understanding of respect appeared relatively late in his intellectual development, I argue that Kant’s concept of respect and Smith’s concept of regard share a basic similarity: they are both a single complex phenomenon with (...) two core aspects, namely an attitude and a feeling. I then suggest that the concept of regard offered Kant a way to deal a problem concerning moral motivation that he was trying to solve at the time he likely first read Smith. I conclude by drawing some implications from the account I have offered for our understanding of Kant’s relation to Smith more generally. (shrink)

I argue that taxation for redistributive purposes is a property rights violation, responding to arguments (due to Nagel, Murphy, Sunstein, and Holmes) claiming that individuals lack ownership of their pretax incomes.

Empirical evidence from developmental psychology and anthropology points out that the human mind is predisposed to conceptualize the world in particular, species-specific ways. These cognitive predispositions lead to universal human commonsense views, often referred to as folk theories. Nevertheless, humans can transgress these views – i.e. they can contradict them with alternative descriptions, they perceive as more accurate – as exemplified in modern sciences. In this paper, I enquire about the cognitive faculties underlying such transgressions. I claim that there are (...) three faculties enabling us to part with these universal commonsense views of the world imposed by our nature. The first is our ability to represent representations – i.e. to form metarepresentations. The second is our ability to produce alternative representations both by explaining a familiar subject matter in terms of the principles governing different conceptual domains than the one that we are predisposed to apply to the subject matter and by directing our mind to new subject matters (for which we have no predisposed conceptual grasp), understanding them in terms of familiar domains. The third, finally, is our ability to give these representations an epistemic orientation. I defend my pure social account of global autonomy from Steven Weimer's recent criticisms. In particular, I argue that it does not implicitly rely upon the very kind of nonsocial conception of autonomy that it hopes to replace.

Nick Trakakis and Yujin Nagasawa criticise the argument in Almeida and Oppy . According to Trakakis and Nagasawa, we are mistaken in our claim that the sceptical theist response to evidential arguments from evil is unacceptable because it would undermine ordinary moral reasoning. In their view, there is no good reason to think that sceptical theism leads to an objectionable form of moral scepticism. We disagree. In this paper, we explain why we think that the argument of Nagasawa and Trakakis (...) fails to overthrow our objection to sceptical theism. (shrink)

Social epistemology is autonomous: When applied to the same evidential situations, the principles of social rationality and the principles of individual rationality sometimes recommend inconsistent beliefs. If we stipulate that reasoning rationally from justified beliefs to a true belief is normally sufficient for knowledge, the autonomy thesis implies that some knowledge is essentially social. When the principles of social and individual rationality are applied to justified evidence and recommend inconsistent beliefs and the belief endorsed by social rationality is true, then (...) that true belief would be an instance of social knowledge but not individual knowledge. In this paper, I propose a novel approach to investigating the nature of well-being and a new theory about wellbeing. The approach is integrative and naturalistic. It holds that a theory of well-being should account for two different classes of evidence—our commonsense judgments about well-being and the science of well-being (i.e., positive psychology). The network theory holds that a person is in the state of well-being if she instantiates a homeostatically clustered network of feelings, emotions, attitudes, behaviors, traits, and interactions (...) with the world that tends to have a relatively high number of states that feel good, that lead to states that feel good, or that are valued by the agent or her culture. According to phenomenalism, physical things are a certain kind of possibility for experience. This paper clarifies the phenomenalist position and addresses some main objections to it, with the aim of showing that phenomenalism is a live option that merits a place alongside dualism and materialism in contemporary metaphysical debate.

A common way of testing the inner sense theory of introspection exploits the possibility of damage to inner sense. Such damage is expected to lead to first-personal deficits/impairments of one kind or another. I raise various problems for this way of testing the theory. The main difficulty, I argue, stems from the existence of the method subserving confabulation.

In "Evil and the Justice of God", N.T. Wright presses the point that attempting to solve the philosophical problem of evil is an immature response to the existence of evil--a response that belittles the real problem of evil, which is just the fact that evil is bad and needs to be dealt with. As you might expect, I am not inclined to endorse this sort of sweeping indictment of the entire field of research on the philosophical problem of evil. (I (...) sort of doubt that Wright really meant to either.) But I do think that there is a kernel of truth in what I take to be Wright's fundamental objection to attempts to solve the philosophical problem of evil. In the first section of what follows, I will try briefly to explain why. I will then go on to argue that, despite this fact, certain efforts at solving the problem of evil avoid Wright's objection. Indeed, drawing on recent work by Elenore Stump, I will argue that one perfectly legitimate way to try to solve the philosophical problem of evil is to follow precisely what seems to be the main piece of advice in "Evil and the Justice of God": namely, to look more seriously than we have at the attitudes taken toward evil by human authors of and characters in the Bible, and to attend more carefully to what the Bible says about how God deals with evil. According to the evolutionary sceptic, the fact that our cognitive faculties evolved radically undermines their reliability. A number of evolutionary epistemologists have sought to refute this kind of scepticism. This paper accepts the success of these attempts, yet argues that refuting the evolutionary sceptic is not enough to put any particular domain of beliefs – notably scientific beliefs, which include belief in Darwinian evolution – on a firm footing. The paper thus sets out to contribute to this positive justificatory project, (...) underdeveloped in the literature. In contrast to a ‘wholesale’ approach, attempting to secure justification for all of our beliefs on the grounds that our belief-forming mechanisms evolved to track truth, we propose a ‘piecemeal’ approach of assessing the reliability of particular belief-forming mechanisms in particular domains. This stands in contrast to the more familiar attempt to transfer warrant obtained for one domain to another by showing how one is somehow an extension of the other. We offer a naturalist reply to the charge of circularity by appealing to reliabilist work on the problem of induction, notably Peter Lipton's distinction between self-certifying and non-self-certifying inductive arguments. We show how, for scientific beliefs, a non-self-certifying argument might be made for the reliability of our cognitive faculties in that domain. We call this strategy Humean Bootstrapping. (shrink)

Distributive Justice Theories of distributive justice seek to specify what is meant by a just distribution of goods among members of society. Many participants in debates about the morality of assisted dying maintain that individuals may only turn to assisted dying as a ‘last resort’, i.e., that a patient ought to be eligible for assisted dying only after she has exhausted certain treatment or care options. Here I argue that this last resort condition is unjustified, that it is in fact wrong to require patients to exhaust a prescribed slate of treatment or care options before being eligible for assisted dying. The last (...) resort condition effectively pits one right of patients, their right to refuse medical treatment or interventions, against another patient right acknowledged by advocates of assisted dying, the right to die. Drawing on an analogy with the legal notion of an unconstitutional condition, I argue that the last resort condition unjustly demands that an arguably more fundamental right—the right to refuse medical treatment or intervention—be foregone in order to acquire a less fundamental right—the right to die. I then address three rationales for the last resort condition and find that they subject individuals to arbitrarily stringent standards for exercising the right to die, standards to which those who seek to end their lives by voluntarily ending life-sustaining treatments are not subject. Subjecting those who seek assisted dying to the last resort condition therefore wrongfully infringes on their right to refuse medical treatment or interventions. (shrink)

I show that the common reading of Thomson, that she argues by analogy for the conclusion that abortion is permissible, is mistaken. The correct reading of Thomson is that she argues by counterexample, showing that arguments against abortion are unsound. The remainder of the paper highlights the lessons learned from Thomson once we read her aright.

This paper offers a brief account of Finnis' Natural Law Legal Theory (NLLT), primarily as it is presented in Natural Law and Natural Rights, and then defends Finnis' NLLT against the recent legal positivist criticism made by Matthew H. Kramer.
