Counterpossibles, counterfactuals conditional with impossible antecedents, are notoriously contested; while the standard view makes them trivially true, some authors argue that they can be non-trivially true. In this paper, I examine the use of counterfactuals in the context of games, and argue that there is a case to be made for their non-triviality in a restricted sense. In particular, I examine the case of retro problems in chess, where it can happen that one is tasked with evaluating counterfactuals about illegal (...) positions. If we understand illegality as a type of restricted impossibility, those counterfactuals are non-trivial counterpossibles. I suggest that their non-triviality stems from their role in practices of rule coordination and revision, and suggest that this model could be generalized to counterpossibles in different domains. I then compare the approach to the accounts of Vetter 2016 and Locke 2019. (shrink)

I argue for the existence of a ‘ratcheting-up effect’: the behavior of moral saints serves to increase the level of moral obligation the rest of us face. What we are morally obligated to do is constrained by what it would be reasonable for us to believe we are morally obligated to do. Moral saints provide us with a special kind of evidence that bears on what we can reasonably believe about our obligations. They do this by modeling the level of (...) sacrifice a person can realistically bear. Exposure to moral saints thus ‘ratchets-up’ our obligations by combating a type of ignorance that would otherwise defeat those obligations. (shrink)

The moral community is a social community, and as such it is vulnerable to social problems and pathologies. In this essay I identify a particular way in which participation in the moral community can be constrained by social factors. I argue that features of the social world—including power imbalances, oppression, intergroup conflict, communication barriers, and stereotyping—can make it nearly impossible for some members of the moral community to hold others responsible for wrongdoing. Specifically, social circumstances prevent some marginalized people from (...) engaging in what Stephen Darwall calls “felicitous moral address” (Darwall 2006). We should think of some members of the moral community as having “second-class moral citizenship” in ways that parallel second-class political citizenship. The injustice of second-class moral citizenship can be understood by drawing an analogy with Miranda Fricker’s notion of “epistemic injustice” (Fricker 2007). Fricker’s account of how people can be undermined in their capacity as knowers can be extended to show how people can be undermined in their capacity as makers of moral claims, which can be called “claimant injustice”. Abstract It would be puzzling if the morally best agents were not so good after all. Yet one prominent account of the morally best agents ascribes to them the exact motivational defect that has famously been called a “fetish.” The supposed defect is a desire to do the right thing, where this is read de dicto . If the morally best agents really are driven by this de dicto desire, and if this de dicto desire is really a fetish, then (...) the morally best agents are moral fetishists. This is puzzling. I resolve the puzzle by showing that on a proper understanding of the interaction between de dicto and de re moral motivation, it is not only not fetishistic, but quite possibly desirable, to be motivated by a de dicto desire to do the right thing. My argument relies partly on an appeal to a non-buck-passing account of moral rightness, according to which rightness is itself an additional reason-giving property over and above the right-making properties of an action. If this account of moral rightness is correct, then we would expect the morally best agents to exhibit de dicto moral motivation. However, since their de dicto desire acts in concert with de re desires, there is no reason to consider it a fetish. It is well-known that racism is encoded into the social practices and institutions of medicine. Less well-known is that racism is encoded into the material artifacts of medicine. We argue that many medical devices are not merely biased, but materialize oppression. An oppressive device exhibits a harmful bias that reflects and perpetuates unjust power relations. Using pulse oximeters and spirometers as case studies, we show how medical devices can materialize oppression along various axes of social difference, including race, gender, class, (...) and ability. Our account uses political philosophy and cognitive science to give a theoretical basis for understanding materialized oppression, explaining how artifacts encode and carry oppressive ideas from the past to the present and future. Oppressive medical devices present a moral aggregation problem. To remedy this problem, we suggest redundantly layered solutions that are coordinated to disrupt reciprocal causal connections between the attitudes, practices, and artifacts of oppressive systems. It is technically possible to clone a human being. The result of the procedure would be a human being in its own right. Given the current level of cloning technology concerning other animals there is every reason to believe that early human clones will have shorter-than-average life-spans, and will be unusually prone to disease. In addition, they would be unusually at risk of genetic defects, though they would still, probably, have lives worth living. But with experimentation and experience, seriously unequal (...) prospects between cloned and noncloned people should erode. We shall ignore arguments about cloning that focus on the potential for harm to the fetus or resultant human being, where harm is understood solely in terms of physical and mental health. Unless the resultant people would generally have lives worth living there is no positive case for cloning, or any other form of reproduction, for that matter. If the resultant beings will generally have lives worth living there is a prima facie case for allowing cloning. We imagine the case in which the resultant beings will have lives well worth living. El objetivo que aquí se propone es mostrar que los argumentos tradicionales están motivando nuevas propuestas que mantienen la actualidad del debate, como las de Robert Stalnaker y (...) Susan Wolf famously claimed that the life of the moral saint is unattractive from the “point of view of individual perfection.” I argue, however, that the unattractive moral saints in Wolf’s account are self-defeating on two levels, are motivated in the wrong way, and are called into question by real-life counter-examples. By appealing to a real-life case study, I argue that the best life from the moral point of view is not necessarily unattractive from the individual point of view.

The purpose of this essay is to make the case that the ethical issues raised by the current U.S. practice of direct-to-consumer prescription drug advertising are worthy of study in philosophy courses, and to provide instructors with some ideas for how they might approach teaching the topic, despite the current relative scarcity of philosophical literature published on it. This topic presents a unique opportunity to cover ground in ethics, critical thinking, and scientific literacy simultaneously. As a case study, the practice (...) of DTC advertising is both theoretically rich and universally relevant to students’ lives. The nature of these ads—numerous, diverse, visually and thematically entertaining—makes them delicious fodder for in-class activities, small group work, discussion-based learning, creative projects, and customizable essay topics. I offer a set of suggestions for approaching the study of DTC drug ads that is informed by my own experience doing so in bioethics courses. Ultimately, including this topic on your syllabus not only contributes to students’ philosophical skills and knowledge, but also helps them become better informed as citizens and potential “consumers” of health care. Many philosophical discussions hinge on the concept of knowability. For example, there is a blooming literature on the so-called paradox of knowability. How to understand this notion, however? In this paper, we examine several approaches to the notion: the naive approach to take knowability as the possibility to know, the counterfactual approach endorsed by Edgington (1985) and Schlöder (2019) , approaches based on the notion of a capacity or ability to know (Fara 2010, Humphreys 2011), and finally, approaches that make (...) use of the resources of dynamic epistemic logic (van Benthem 2004, Holliday 2017). In this paper I offer a systematic account of actions of trust and inquire into their cognitive motivation. I first develop the distinction and relationship between attitudes and actions of trust, and then assess Paul Faulkner's thesis that the Humean model cannot explain the cognitive motivation of some actions of trust under circumstances of uncertainty. While I will accept his diagnosis, I will contend that a weaker version of the Humean model could provide this explanation. My proposal will be an (...) attempt to show why some doxastic characteristics of trust would allow for this analysis. In particular, I will show how the nature of the reliance relation, which constitutes actions of trust, requires that trustors believe in the possibility of accomplishing their intentions by means of the trusted party’s collaboration. I will argue that this means-end belief can cognitively motivate trust even in situations where the trustor is uncertain as to whether the trusted party will prove trustworthy. (shrink)

The purpose of cultural competence education for medical professionals is to ensure respectful care and reduce health disparities. Yet as Berger and Miller (2021) show, the cultural competence framework is dated, confused, and self-defeating. They argue that the framework ignores the primary driver of health disparities—systemic racism—and is apt to exacerbate rather than mitigate bias and ethnocentrism. They propose replacing cultural competence with a framework that attends to two social aspects of structural inequality: health and social policy, and institutional-system activity; (...) and two psychological aspects of structural inequality: the clinical encounter, and the epistemic. -/- We agree with the structural approach. To that end, we think it would be fruitful to include attention to physical contributors to structural inequality, namely the material artifacts used in medicine. Devices, tools, and technologies can materialize biases, perpetuate oppression, and contribute to health disparities. Granted, not everything that interests philosophers can be squeezed into medical education. Nevertheless, there are compelling reasons for including the study of material artifacts in education designed to reduce health disparities. First, devices and tools often carry forward biases from the past, and keep biases hidden from plain sight. Second, by studying these artifacts, future clinicians can begin to see themselves as part of a larger sociotechnical system. Finally, as medicine becomes increasingly tech-laden, it’s important for clinicians to see how material artifacts (including algorithms) connect individuals to structures. This will help to undermine oversimplified narratives according to which objective tools and technologies can correct for the bias and subjectivity of flawed human beings. (shrink)

Twenty years ago I put a sign on the door to my office —and it’s still there— with the sentence of Peirce that I have used in my title: "The life of science is in the desire to learn" (CP 1.235, c.1902). I learned this quote from the late professor of logic at MIT, George Boolos. Like him, I put it on my door to invite students to come in to inquire, to ask questions, since their questions are not just (...) the life of science, but also the sparks that inflame my passion for teaching. Those —professors and students— who desire to learn are the real agents, the main characters, of philosophical development. Philosophy should not be understood and taught as the transmission of old solutions to outdated problems, but as a way of life devoted to learning the truth wherever we might find it. My exposition will be divided into four sections: 1) A brief presentation of Peirce, focusing on his work as a professional scientist and a scientific philosopher; 2) Peirce considered as an educational philosopher; 3) Some practical suggestions I have drawn from Peirce's ideas and from my experience teaching philosophy today; and finally, 4) A brief conclusion. The aim of this article is to describe in some detail the actual relationship between Charles S. Peirce and Alfred N. Whitehead, paying particular attention to the Peircean notions of science and metaphysics, with the conviction that this contrast can help to understand better the scope and depth of C. S. Peirce’s thought.

The main purpose of this article is to show how the language is conceived in the encyclical Fides et ratio, especially taking into account its relationship with truth. It is also attempted to present an analitical study of the text concerning language: the different references to it and the consideration of the modern sciences of language; how truth is linked to language and signification, and how human language though linguistic communication can surely renew and enhance the rational expressin of Christian (...) faith. According to Charles S. Peirce and to Mariano Artigas, science is the collective and cooperative activity of all those whose lives are animated by the desire to discover the truth. The particular sciences are branches of a common tree. The unity of science is not achieved by the reduction of the special sciences to more basic ones: the new name for the unity of the sciences is cross-disciplinarity. This is not a union of the sciences themselves, but rather the unity (...) and dialogue of scientists, the real inquirers into the truth. In the light of Peirce’s and Artigas’s teachings, we can see that philosophers are in just the right place to call for this unity of sciences. This call should not be seen as promoting a return to the old scientism, but seeks a deep dialogue between the particular sciences and philosophy in order to deal with the presuppositions of the scientific enterprise. The key to the cross-disciplinarity of knowledge is not revolution, but rather shared efforts in a unique mixture of continuity and fallibilism, of affection and reason, of the attempt to understand others’ disciplines as well as our own. In a recent opinion paper, it was argued that individuals with multiple retractions or a record of academic misconduct should not serve as editors, including as editors-in-chief, on the editorial boards of scholarly or academic journals. As a first step towards appreciating how such a policy could be applied in practice, the presence of 30 individuals listed on the Retraction Watch Leaderboard on editorial boards was screened. Six cases are highlighted to gain an appreciation of the potential reputational risks that (...) journals and publishers might incur by including individuals with a tainted academic record on editorial boards. Given the reputational, legal and other risks associated with this type of assessment and decision, more formal positioning and guidance are needed by global ethics policy-related bodies such as COPE, the ICMJE, and the CSE, even more so in journals that claim to follow these organizations’ ethical guidelines. The aim of my paper is to highlight that for Peirce the reality of God makes sense of the whole scientific enterprise. The belief in God is a natural product of abduction, of the "rational instinct" or educated guess of the scientist or the layman, and also the abduction of God may be understood as a "proof" of pragmatism. Moreover, I want to suggest that for Peirce scientific activity is a genuine religious enterprise, perhaps even the religious activity par excellence, (...) and that to divorce religion from science is antithetical to both the scientific spirit and the real Peirce. Understanding the real Peirce requires to deal with his religious concerns, which are increasingly recognized as being perhaps as philosophically important as his scientific concerns. Since a key notion in this project is the idea of "il lume naturale" that Peirce borrowed from Galileo, I want also to pay attention to that expression which during years I have been following through Peirce's papers and books. -/- In order to try to explain some of this, my paper is arranged into four brief sections after this already long introduction: 1) God and scientific inquiry; 2) The belief in God as a product of abduction; 3) Galileo and Peirce: Il lume naturale; and by way of conclusion 4) Some remarks on the religious framework of Peirce's approach. Para intentar comprender la visión que Eugenio d'Ors tiene de España a principios de los años 30 del pasado siglo, es necesario entender su biografía. Cuando Eugenio d’Ors deja Barcelona en julio de 1921 solo le faltaban tres meses para cumplir los cuarenta años. A los cuarenta —escribió su hijo Álvaro— lo más normal es que los hombres no cambien ya su caudal de ideas. La originalidad de la época catalana sobre el resto de la producción de d'Ors no significa, (...) sin embargo, un menosprecio de los años posteriores. Fue en gran medida su producción no catalana y su constante actividad y participación en muchos otros proyectos españoles y europeos, lo que hizo que su “gloria catalana” no quedara diluida y que su figura tenga hoy un lugar destacado en las letras españolas. Por todo ello, la exposición está organizada en las tres secciones siguiente: 1) Su biografía catalana; 2) la primera etapa de su biografía castellana, y 3) Su visión de España en los años 30. Being a philosopher and doing philosophy in the 21st century demands a real blending of thought and life, a real learning of how to share quality scholarship with big audiences. Stephenson (2022) has argued that Kant’s thesis that all transcendental truths are transcendentally a priori knowable leads to omniscience of all transcendental truths. His arguments depend on luminosity principles and closure principles for transcendental knowability. We will argue that one pair of a luminosity and a closure principle should not be used, because the closure principle is too strong, while the other pair of a luminosity and a closure principle should not be used, because the luminosity principle is too strong. In my paper I make a summary assessment of the connection between Eugeni Crexells and Eugeni d'Ors and that of both of them with pragmatism. I organize it in three sections: 1. First, the philosophical formation of Crexells and its relation with D'Ors; 2. Eugeni d'Ors and pragmatism, and 3. Joan Crexells and pragmatism.

Malicious moral envy is an aversive reaction to a rival’s moral properties or accomplishments, accompanied by a tendency to level-down the target by morally tarnishing or sabotaging them. In this essay I give an account of malicious moral envy, showing how it is a sub-type of envy more generally. I describe Donald Trump’s behaviors toward Barack Obama and Anthony Fauci as a case study of malicious moral envy. I argue that malicious moral envy is puzzling, first because it is self-defeating, (...) and then—more interestingly—because it betrays an ambivalence about morality and moral requirements. I explore how malicious moral envy relates to other issues in the literature on moral ambivalence, including moral exemplars, moral saints, admirable immorality, and the pathologizing of moral outliers. Ultimately I suggest that mild forms of malicious moral envy may play an important role in helping agents navigate the socially complex and constantly changing landscape of moral requirements. I argue that modal epistemology should pay more attention to questions about the structure and function of modal thought. We can treat these questions from synchronic and diachronic angles. From a synchronic perspective, I consider whether a general argument for the epistemic support of modal though can be made on the basis of modal thoughs’s indispensability for what Enoch and Schechter (2008) call rationally required epistemic projects. After formulating the argument, I defend it from various objections. I also examine the (...) possibility of considering the indispensability of modal thought in terms of its components. Finally, I argue that we also need to approach these issues from a diachronic perspective, and I sketch how to approach this task. (shrink)

Charles S. Peirce (1839-1914) made relevant contributions to deductive logic, but he was primarily interested in the logic of science, and more especially in what he called 'abduction' (as opposed to deduction and induction), which is the process whereby hypotheses are generated in order to explain the surprising facts. Indeed, Peirce considered abduction to be at the heart not only of scientific research, but of all ordinary human activities. Nevertheless, in spite of Peirce's work and writings in the field of (...) methodology of research, scarce attention has been paid to the logic of discovery over the last hundred years, despite an impressive development not only of scientific research but also of logic. -/- Having this in mind, the exposition is divided into five parts: 1) a brief presentation of Peirce, focusing on his work as a professional scientist; 2) an exposition of the classification of inferences by the young Peirce: deduction, induction and hypothesis; 3) a sketch of the notion of abduction in the mature Peirce; 4) an exposition of the logic of surprise; and finally, by way of conclusion, 5) a discussion of this peculiar ability of guessing understood as a rational instinct. -/- . Knowledge is necessary for certain moral obligations. In learning something new, one sometimes triggers a moral obligation. This paper argues that the existence of these knowledge-based obligations poses a problem for the view that we are not only free to choose the course of our own lives, including our careers and personal projects, but also free to change our minds and quit at any time to pursue something else. For if our choice of life path has generated knowledge-based moral obligations (...) that we must fulfill, then it is apparently not true that we can quit at any time. To resolve this tension, this paper proposes a relatively demanding set of conditions under which it is permissible to swap one career or life project for another. The resulting compromise reconciles the moral force of knowledge-based obligations with the basic freedom to choose less-than-optimal careers and projects. It also highlights the distinctive role played by knowledge and expertise in generating the intractable problem of morality’s demandingness. (shrink)

One usually makes assertions by means of uttering indicative sentences like “It is raining”. However, not every utterance of an indicative sentence is an assertion. For example, in uttering “I will be back tomorrow”, one might be making a promise. What is to make an assertion? C.S. Peirce held the view that “to assert a proposition is to make oneself responsible for its truth” (CP 5.543). In this thesis, I interpret Peirce’s view of assertion and I evaluate Peirce’s reasons for (...) holding it. I begin by reconstructing and assessing Peirce’s case for such view as it appears in (EP 2.140, 1903), (EP 2.312-313, 1904), and (CP 5.546, 1908). Then, I continue by elaborating on three aspects of Peirce’s view of assertion, namely, assertion as an act involving a certain kind of responsibility, the proposition as what is asserted, and responsibility for truth as a responsibility to give reasons. With respect to these three aspects, I argue for the following claims: (1) Peirce construed the responsibility involved in asserting as a moral responsibility; (2) Peirce held that propositions are types; and (3) Peirce was committed to a dialogical interpretation of “responsibility to give reasons”. Finally, I end by presenting two objections to Peirce’s view of assertion and its corresponding replies. I conclude that Peirce’s account of assertion is a valuable contribution to the philosophical debate on assertion. (shrink)

El objetivo de esta colaboración es, en primer lugar, dar noticia de algunas coordenadas básicas de la discusión contemporánea acerca del lenguaje y la diferencia de los sexos, prestando especial atención a la acusación de esencialismo con la que se descalifican los contendientes entre sí. En segundo lugar, quiero llamar la atención acerca de la insuficiencia de las razones esgrimidas por el discurso feminista de la diferencia y por el discurso de la complementariedad cultural, que en última instancia vienen a (...) favorecer —en total oposición, sin duda, a los deseos de sus valedores— una perpetuación de la discriminación de las mujeres1. En tercer lugar, esbozo unas pautas para la eliminación de algunos elementos sexistas que todavía subsisten en la lengua española. -/- El trabajo se articula en cuatro secciones: 1) El debate contemporáneo sobre el esencialismo; 2) El discurso biológico sobre la diferencia sexual; 3) La construcción cultural de la diferencia sexual; y finalmente, 4) La búsqueda de un nuevo lenguaje. El propósito unificador que otorga sentido al conjunto radica en el empeño por ganar en comprensión de lo que es el ser humano mediante la reflexión filosófica sobre la diferenciación sexual que se detecta, se expresa o se crea, a través o en el lenguaje. La perspectiva que adopto —desde una óptica preferentemente hispánica, pero prestando especial atención a la cultura angloamericana— es decididamente filosófica, y aspira a integrar armónicamente aportaciones multidisciplinares, datos y planteamientos teóricos procedentes de las ciencias biomédicas y de las humanidades. Esta actitud supone una concepción de la filosofía que, lejos de un eclecticismo acrítico, busca encontrar las razones de la verdad en la confrontación de opiniones opuestas, sabedora con la mejor tradición que todos los pareceres formulados seriamente, en cierto sentido, dicen algo verdadero. Una segunda consecuencia de la adopción de esta perspectiva filosófica es que he evitado convertir el trabajo en una investigación lexicográfica de la lengua española, limitando ésta exclusivamente al final de la última sección. The aim of this paper is to describe the situation of mutual ignorance between American and Hispanic philosophical traditions, paying special attention to the figure and thought of the founder of pragmatism, Charles S. Peirce (1839-1914). In order to do this, first of all I will justify the usage of the expression "Hispanic Philosophy", highlighting its heuristic and practical value. Secondly, I will discuss some of Peirce's comments in relation with the Hispanic world. In a world of ever growing specialization, the idea of a unity of science is commonly discarded, but cooperative work involving cross-disciplinary points of view is encouraged. The aim of this paper is to show with some textual support that Charles S. Peirce not only identified this paradoxical situation a century ago, but he also mapped out some paths for reaching a successful solution. A particular attention is paid to Peirce's classification of the sciences and to his conception of science (...) as a collective and cooperative activity of all those whose lives are animated by the desire to discover the truth. -/- . Abstract: Faced with the thesis of the exhaustion of analytic philosophy, the work of Susan Haack shows a process of deep transformation within analytical philosophy. Instead of considering the analytic tradition as an abrupt breakdown with classical pragmatism, the resurgence of pragmatism in the last decades endorses, on the contrary, the continuity between both movements. In this process Susan Haack's work has a decisive role. This paper around the pragmatism of Susan Haack is organized into three sections: 1) The pragmatist (...) development in Haack's biography; 2) the two rival versions of pragmatism; and 3) the future of pragmatism. -/- Frente a la tesis del agotamiento de la filosofía analítica, el trabajo de Susan Haack muestra un proceso de profunda transformación en el seno de la filosofía analítica. Bertrand Russell was never to forget the course he gave in Barcelona in the spring of 1920. In the bitter title-page of An Inquiry into Meaning and Truth (1940), after the legal ruling which had suspended him from teaching at City College, New York, he expressly mentions his lectures in Barcelona, along with those he had given at the Universities of Uppsala and Copenhagen and at the Sorbonne. He also alludes briefly to them in his Autobiography (Russell 1990, II, 143), (...) but their circumstances and import have received no attention to date. The aim of this paper is to bring to light the available information on this subject in the Russell Archives (McMaster University, Canada) and the papers left by Joan Crexells (1896-1926) and Eugenio d'Ors (1881-1954), the two Catalan philosophers behind Russell's visit, and to put forward an assessment of Russell's influence on Spanish philosophy. La atención relativamente escasa que los estudiosos del filósofo y científico norteamericano Charles S. Peirce (1839-1914) han prestado a lo largo de los años a la dimensión religiosa de su pensamiento siempre me ha resultado un tanto sorprendente. Desde mis primeras lecturas de Peirce me impresionó profundamente la ubicuidad de las referencias religiosas en sus escritos, especialmente en los años de madurez. En mis encuentros con reconocidos estudiosos peirceanos solía preguntarles acerca de Dios y la religión en Peirce, y la (...) respuesta que recibí casi siempre era que efectivamente había una gran cantidad de cuestiones religiosas en su obra, pero que no estaban interesados en ello. Dentro del espacio disponible, mi exposición está organizada en cuatro secciones: 1) Una presentación del artículo de 1908; 2) La noción de realidad; 3) ¿Cuál es realmente el Argumento Olvidado?, y 4) Una discusión de su alcance destacando el poder de la abducción. Citaré a algunos de los comentaristas más relevantes y aportaré un texto del propio Peirce interpretando su artículo que no he visto hasta ahora citado: se trata de la carta de Peirce del 28 de noviembre de 1908 (L 212) en la que explica a su amiga Mary Huntington el artículo publicado en el Hibbert Journal poco tiempo antes. Los filósofos han construido la filosofía a partir de la reflexión sobre el hombre y su realidad circundante más inmediata. Al menos en la época presente, la filosofía en cuanto reflexión sobre el ser, debe partir —en mi opinión— de la consideración atenta de los artefactos que constituyen casi en su totalidad —con excepción de los seres humanos y de algunos pocos animales y plantas que hay en nuestro ámbito habitual— el mundo efectivo en el que nos encontramos: la pluma (...) con la que escribo, el papel, la mesa, la silla, los libros, los cigarrillos, la habitación y todo el edificio en el que estoy, incluso las palabras que estoy garabateando, la lámpara que me ilumina, quizás también la luz eléctrica que despide la bombilla: ¿no son todas esas cosas artefactos? Me permito aventurar de antemano que esas cosas, los artefactos, son los elementos relevantes para el filósofo de nuestros días: la noción de artefacto —que tiene una vetusta tradición— puede proporcionar un modelo racional explicativo válido para afrontar viejas y nuevas cuestiones de la metafísica y del lenguaje. -/- . This work, in English "Struggle for power, organic crisis and judicial independence", has its origin in research academics of the IAEN carried out to provide expert advise to the Inter American Court of Human Rights in the case Quintana and others (Supreme Court of Justice) vs the State of Ecuador. The research is about the nature of the evolution of the ecuadorian state, the dynamics of its institutions, its players, parties, laws, its factors of instability, the way rights have been (...) deployed since the return to democracy in 1979, those who have benefited from neoliberal democracy and those who have paid the costs, and where in all this was the Supreme Court of Justice. The Introduction takes a look at this origin of the work and its intellectual import, provides a brief characterization of the Inter American Sistem of Human Rights Protection, how the Quintana Case fits within it, and an overview of the chapters and their logic. The first chapter analyzes the institutional and sociological factors that have contributed to Ecuador's historically unstable state, based primarily in an antagonistic struggle for power between the Executive and Legislative branches. The second chapter analyzes the economic and political factors that provoked an organic crisis, or crisis of hegemony, between 1997 and 2007 in Ecuador. The third chapter analyzes the evolution of the way in which judges are selected in Europe, the outcomes they have generated, and how they compare with the ecuadorian systems of judge selection in terms of securing judicial independence. The fourth chapter develops a theory of judicial independence in democracy and analyzes how Ecuador measures up to that standard, from when it became a neoliberal minimal democracy in 1981, to when it became a neoliberal false democracy as a consequence of instalation of a system evidently lacking in the people's support under the guise of the 1998 Constitution and its system of judge selection, and the new democratic horizons set by the 2008 Constitution, and the judicial system that springs from it. Thirty years ago Richard Rorty detected the similarities between Wittgenstein's Philosophical Investigations (1953) and the philosophical framework of Charles S. Peirce (1839-1914), the founder of pragmatism. Rorty tried to show that Peirce envisaged and repudiated in advance logical positivism and developed insights and a philosophical mood very close to the analytical philosophers influenced by the later Wittgenstein (Rorty 1961). In spite of that, the majority of scholars have considered both thinkers as totally alien. Some scholars have attributed the pragmatist flavor (...) of the Philosophical Investigations to the influence of Frank P. Ramsey, who awoke Wittgenstein from the dogmatic slumber of the Tractatus. Nevertheless, the real scope of the influence of American pragmatist philosophy in Wittgenstein's later thought is not clearly known. The purpose of my paper is not to describe the common themes between Wittgenstein and Peirce, but the way in which recent scholarship has established some links between both philosophers. -/- . En mi breve texto, deseo dar noticia de su colaboración con nuestro Grupo de Estudios Peirceanos y del importantísimo catálogo que constituye la Bibliografía Peirceana Hispánica (1883- 2000) por él preparada y que publicamos en un volumen conjunto en el año 2006 [Nubiola & Zalamea 2006].

This paper investigates the semantics of implicit comparatives (Alice is tall compared to Bob) and its connections to the semantics of explicit comparatives (Alice is taller than Bob) and sentences with adjectives in plain positive form (Alice is tall). We consider evidence from two experiments that tested judgments about these three kinds of sentence, and provide a semantics for implicit comparatives from the perspective of degree semantics.

The Lewis-Sider argument from vagueness is one of the most powerful objections against restricted composition. Many have resisted the argument by rejecting its key premise, namely that existence is not vague. In this paper, I argue that this strategy is ineffective as a response to vagueness-based objections against restricted composition. To that end, I formulate a new argument against restricted composition: the argument from determinate vagueness. Unlike the Lewis-Sider argument, my argument doesn’t require accepting that existence is not vague, but (...) only that it is not vague in a specific way, which, I argue, is entailed by restricted composition. I show that the rejection of this species of vague existence follows from assumptions even friends of vague existence should be happy to accept. (shrink)

El objetivo de este trabajo es dar noticia de la recepción del pragmatismo en la obra y el pensamiento de Eugenio d’Ors, reuniendo algunos resultados de nuestros trabajos preceden- tes. Dedicamos una primera parte a describir el encuentro de Eugenio d’Ors con el pragmatismo. En segundo lugar describimos su conexión con William James a quien llegó a conocer en París. En tercer lugar, damos cuenta de en qué consiste la denominada “superación del pragmatismo” por parte de Eugenio d’Ors y, por (...) último, señalamos las afinidades más relevantes de su pensamiento con algunas de las intuiciones más originales del pragmatismo de Charles S. A surprising fact about the Hispanic philosophical historiography2 of the 20th century is its almost complete ignorance of the American philosophical tradition. This disconnect is even more surprising when one takes into account the striking affinities between the topics and problems treated by the most relevant Hispanic thinkers (Unamuno, Ortega, Vaz Ferreira, Ferrater Mora, Xirau) and the central questions raised in the most important native current of American thought in the late 19th and 20th centuries, pragmatism. In recent years there (...) has been a resurgence of pragmatist philosophy in contemporary culture, which is producing a deep renovation and transformation. One of the important features of this process is precisely the recuperation and improved understanding of the thought of Charles S. Peirce, who offers suggestions for dealing with some of the most persistent problems in contemporary philosophy, and who in addition can help us to reassume our responsibilities as philosophers, responsibilities that a good part of the philosophy of the 20th century had renounced. We can confidently say, as will be clear from what follows, that Spain and the Latin American countries are playing an important role in this increased understanding and diffusion of Peircean thought throughout the world. This article shows how feminism welcomed and was influenced by the pragmatism of John Dewey. While in real terms his impact on European feminism has been minimal, this was not the case in contemporary America. In this article we study both how Dewey’s ideas were received amongst American feminists, as well as certain aspects of his thinking that could be enormously useful in present-day debates between critical and postmodern feminists. We compare the Deweyan and feminist arguments against the traditional dualisms (...) that acted as philosophical support for social inequality, paying particular attention to mind–body dualism, and the consequent undervaluation of physical and emotional wellbeing. We also show that John Dewey’s proposals were, in fact, more radical than those of the feminists of the day. Indeed, democracy has to be understood as a way of life that affects every dimension of experience, and is crucial to the personal and social growth that enables the unjust social inequalities between men and women to be overcome. The relationship between William James and Ludwig Wittgenstein (1889-1951) has recently been the subject of intense scholarly research. We know for instance that the later Wittgenstein's reflections on the philosophy of psychology found in James a major source of inspiration. Not surprisingly therefore, the pragmatist nature of the philosophy of the later Wittgenstein is increasingly acknowledged, in spite of Wittgenstein’s adamant refusal of being labeled a “pragmatist”. In this brief paper I merely want to piece together some of the available (...) evidence of Wittgenstein’s high regard for William James, not only for his thoughts, but even more so for his character.
