This work, in English "Struggle for power, organic crisis and judicial independence", has its origin in research academics of the IAEN carried out to provide expert advise to the Inter American Court of Human Rights in the case Quintana and others (Supreme Court of Justice) vs the State of Ecuador. The research is about the nature of the evolution of the ecuadorian state, the dynamics of its institutions, its players, parties, laws, its factors of instability, the way rights have been (...) deployed since the return to democracy in 1979, those who have benefited from neoliberal democracy and those who have paid the costs, and where in all this was the Supreme Court of Justice. The Introduction takes a look at this origin of the work and its intellectual import, provides a brief characterization of the Inter American Sistem of Human Rights Protection, how the Quintana Case fits within it, and an overview of the chapters and their logic. The first chapter analyzes the institutional and sociological factors that have contributed to Ecuador's historically unstable state, based primarily in an antagonistic struggle for power between the Executive and Legislative branches. The second chapter analyzes the economic and political factors that provoked an organic crisis, or crisis of hegemony, between 1997 and 2007 in Ecuador. The third chapter analyzes the evolution of the way in which judges are selected in Europe, the outcomes they have generated, and how they compare with the ecuadorian systems of judge selection in terms of securing judicial independence. The fourth chapter develops a theory of judicial independence in democracy and analyzes how Ecuador measures up to that standard, from when it became a neoliberal minimal democracy in 1981, to when it became a neoliberal false democracy as a consequence of instalation of a system evidently lacking in the people's support under the guise of the 1998 Constitution and its system of judge selection, and the new democratic horizons set by the 2008 Constitution, and the judicial system that springs from it. This paper takes a stand on Hamblin semantics and its relation to the semantics-to-pragmatics interface. Biased questions, where the speaker finds one of the options more likely and expects the confirmation that p is true, raise a concern about the limits of Hamblin semantics. I argue that biased questions have modified Hamblin semantics, while unbiased questions have unconstrained Hamblin semantics. The optional bias feature explains compositionally. It is triggered by likelihood presuppositions ranging Hamblin sets and highlighting the preferred alternative(s). Biased (...) effects are exceptionally possible in alternative and wh-questions, but only in polar questions, they can be encoded lexically and grammatically. I argue that Hamblin semantics covers all core types of questions, while some of its applications for non-questions are problematic. (shrink)

This paper introduces and discusses three models of future: a determinist model, a stochastic model, and the model of True Prophetic Knowledge. All three models coexist in natural languages and are represented both in their grammatical systems and in the text-building discourse strategies speakers and authors apply to.

I discuss the foundations of predicate ontologies based on two model notions – elementary states of affairs and eventualities, i.e. ordered pairs of initial and end states of affairs. Vendlerian classifications are oriented towards elementary states and tense logic, while Davidsonian classifications deal with eventualities and event logic. There are two kinds of atemporal predicates - fact and properties. Facts are propositional arguments of second-order predicates which add a special meaning that the embedded proposition was verified. Properties are atemporal first-order (...) predicates that lack eventive interpretation and are not associated with factive frames. Davidsonian states are homogeneous durable spatiotemporal things distinct both from atemporal properties and spatiotemporal dynamic predicates. Davidsonian states are causally independent, while resultatives are causally determined as they reconstruct a preceding event that has caused the end state p. I discuss the contrast between external and internal Davidsonian states. The former lack a priority argument and can be quantified extensionally. The latter have a priority experiential argument and can only be quantified intensionally. External states can be observed, while internal states cannot. (shrink)

John Stuart Mill's Utilitarianism is one of the most important, controversial, and suggestive works of moral philosophy ever written. Mill defends the view that all human action should produce the greatest happiness overall, and that happiness itself is to be understood as consisting in "higher" and "lower" pleasures. This volume uses the 1871 edition of the text, the last to be published in Mill's lifetime. The text is preceded by a comprehensive introduction assessing Mill's philosophy and the alternatives to (...) utilitarianism, and discussing some of the specific issues Mill raises in Utilitarianism. I argue against the orthodox view of the relationship between propositional and doxastic justification. The view under criticism is: if p is propositionally justified for S in virtue of S's having reason R, and S believes p on the basis of R, then S's belief that p is doxastically justified. I then propose and evaluate alternative accounts of the relationship between propositional and doxastic justification, and conclude that we should explain propositional justification in terms of doxastic justification. If correct, this (...) proposal would constitute a significant advance in our understanding of the sources of epistemic justification. (shrink)

The article proposes to further develop the ideas of the Extended Evolutionary Synthesis by including into evolutionary research an analysis of phenomena that occur above the organismal level. We demonstrate that the current Extended Synthesis is focused more on individual traits (genetically or non-genetically inherited) and less on community system traits (synergetic/organizational traits) that characterize transgenerational biological, ecological, social, and cultural systems. In this regard, we will consider various communities that are made up of interacting populations, and for which the (...) individual members can belong to the same or to different species. Examples of communities include biofilms, ant colonies, symbiotic associations resulting in holobiont formation, and human societies. The proposed model of evolution at the level of communities revises classic theorizing on the major transitions in evolution by analyzing the interplay between community/social traits and individual traits, and how this brings forth ideas of top-down regulations of bottom-up evolutionary processes (collaboration of downward and upward causation). The work demonstrates that such interplay also includes reticulate interactions and reticulate causation. In this regard, we exemplify how community systems provide various non-genetic ‘scaffoldings’, ‘constraints’, and ‘affordances’ for individual and sociocultural evolutionary development. Such research complements prevailing models that focus on the vertical transmission of heritable information, from parent to offspring, with research that instead focusses on horizontal, oblique and even reverse information transmission, going from offspring to parent. We call this reversed information transfer the ‘offspring effect’ to contrast it from the ‘parental effect’. We argue that the proposed approach to inheritance is effective for modelling cumulative and distributed developmental process and for explaining the biological origins and evolution of language. Conceptualism is the thesis that, for any perceptual experience E, (i) E has a Fregean proposition as its content and (ii) a subject of E must possess a concept for each item represented by E. We advance a framework within which conceptualism may be defended against its most serious objections (e.g., Richard Heck's argument from nonveridical experience). The framework is of independent interest for the philosophy of mind and epistemology given its implications for debates regarding transparency, relationalism and representationalism, demonstrative (...) thought, phenomenal character, and the speckled hen objection to modest foundationalism. I argue that you can have a priori knowledge of propositions that neither are nor appear necessarily true. You can know a priori contingent propositions that you recognize as such. This overturns a standard view in contemporary epistemology and the traditional view of the a priori, which restrict a priori knowledge to necessary truths, or at least to truths that appear necessary.

This chapter argues that scientific and philosophical progress in our understanding of the living world requires that we abandon a metaphysics of things in favour of one centred on processes. We identify three main empirical motivations for adopting a process ontology in biology: metabolic turnover, life cycles, and ecological interdependence. We show how taking a processual stance in the philosophy of biology enables us to ground existing critiques of essentialism, reductionism, and mechanicism, all of which have traditionally been associated with (...) substance ontology. We illustrate the consequences of embracing an ontology of processes in biology by considering some of its implications for physiology, genetics, evolution, and medicine. And we attempt to locate the subsequent chapters of the book in relation to the position we defend. (shrink)

I am going to argue that it is a cost of libertarianism that it holds our status as agents hostage to theoretical physics, but that claim has met with disagreement. Some libertarians regard it as the cost of doing business, not a philosophical liability. By contrast, Peter van Inwagen has addressed the worry head on. He says that if he were to become convinced that causal determinism were true, he would not change his view that humans are free and morally (...) responsible. Rather, he would give up at least one of the formerly-thought-to-be a priori truths that are elements in his argument for the incompatibility of causal determinism and the relevant sort of freedom. Thus, according to van Inwagen, our status as free and morally responsible agents would not be held hostage to the physicists or hang on a thread I think that van Inwagen’s strategy for securing our freedom and responsibility is unattractive. Somewhat tendentiously, I have called the rejection of an a priori ingredient in the incompatibilist’s argument, contingent upon learning that causal determinism is true, ‘metaphysical fip-flopping.’ -/- And it does seem that van Inwagen’s approach is implausible insofar as he is open to such metaphysical fip-fopping. That he is open to it—that he would fip-fop if he became convinced of the truth of causal determinism—is a problem for his actual philosophical position. Or so I will argue. (shrink)

The debate concerning the ontological status of musical works is perhaps the most animated debate in contemporary analytic philosophy of music. In my view, progress requires a piecemeal approach. So in this article I hone in on one particular musical work concept – that of the classical Western art musical work; that is, the work concept that regulates classical art-musical practice. I defend a fictionalist analysis – a strategy recently suggested by Andrew Kania as potentially fruitful – and I develop (...) a version of such an analysis in line with a broad commitment to philosophical naturalism. This paper aims to apply contemporary theories of causation to historiography. The main purpose is to show that historians can use the concept of causation in a variety of ways, each of which is associated with different historiographical claims and different kinds of argumentation. Through this application, it will also become clear, contrary to what is often stated, that historical narratives are (in a specific way) causal, and that micro-history can be seen as a response to a very specific (causal) (...) problem of Braudelian macro-history. Experiences of embodied remembering are familiar and diverse. We settle bodily into familiar chairs or find our way easily round familiar rooms. We inhabit our own kitchens or cars or workspaces effectively and comfortably, and feel disrupted when our habitual and accustomed objects or technologies change or break or are not available. Hearing a particular song can viscerally bring back either one conversation long ago, or just the urge to dance. Some people explicitly use their bodies to record, store, or (...) cue memories. Others can move skilfully, without stopping to think, in complex and changing environments thanks to the cumulative expertise accrued in their history of fighting fires, or dancing, or playing hockey. The forms of memory involved in these cases may be distinct, operating at different timescales and levels, and by way of different mechanisms and media, but they often cooperate in the many contexts of our practices of remembering. Many experienced runners consider the use of wearable devices an important element of the training process. A key techno-utopic promise of wearables lies in the use of proprietary algorithms to identify training load errors in real-time and alert users to risks of running-related injuries. Such real-time ‘knowing’ is claimed to obviate the need for athletes’ subjective judgements by telling runners how they have deviated from a desired or optimal training load or intensity. This realist-contoured perspective is, however, at odds with (...) sociological research indicating that users of wearables engage in active ‘data sense-making’ that is highly contextualised. To investigate how athletes use (or not) algorithmic analysis to understand, make sense of, and improve their performance in real-time, we undertook qualitative interviews with distance runners to explore lived experiences of running with wearables. The runners described how they actively interpreted data from wearables, drawing on their own experience, ‘somatic knowledge’, and embodied ways of knowing. This allowed them to assess the relevance and usefulness of data in relation to their own goals, intentions, and feelings. Our findings challenge the techno-utopic promises of real-time and predictive analytics. (shrink)

I argue how Filipino philosophy is an illusion we have taken as a belief, and that we need to remember again its illusory – but necessary – status for it to flourish. The normativity of this illusion impelled the discourse: what is philosophy? For new directions, the language of Filipino philosophy must be negative that pathologies in thinking be realized; it is a necessary illusion remembered once more: a nihilistic stance for new values to be created. I raise the question (...) of the non-identical character of language, of how nature is far larger than concepts, which makes misrepresentation possible (something evident in society—leaders to population, praxis to theory, philosophy to culture). The non-identicality reifies the illusion into belief which necessitates a decadent type of rationality. The illusory status of the nomenclature (‘Filipino philosophy’) must be remembered again for the dialectic to continue. In seeking new directions for Filipino philosophy, it is not enough that a new breed of thinkers merely accepts the value ascribed to it – along with the numerous errors and nuisances inherited along the way – but to create new value. With a critical stance, I present 5 assumptions that probe into some essential characteristics of the immanent pathologies of Filipino philosophy’s language that occasions the need for such struggle branded as assumptions. “Gettier cases” have played a major role in Anglo-American analytic epistemology over the past fifty years. Philosophers have grouped a bewildering array of examples under the heading “Gettier case.” Philosophers claim that these cases are obvious counterexamples to the “traditional” analysis of knowledge as justified true belief, and they treat correctly classifying the cases as a criterion for judging proposed theories of knowledge. Cognitive scientists recently began testing whether philosophers are right about these cases. It turns out that philosophers were (...) partly right and partly wrong. Some “Gettier cases” are obvious examples of ignorance, but others are obvious examples of knowledge. It also turns out that much research in this area of philosophy is marred by experimenter bias, invented historical claims, dysfunctional categorization of examples, and mischaracterization by philosophers of their own intuitive judgments about particular cases. Despite these shortcomings, lessons learned from studying “Gettier cases” are leading to important insights about knowledge and knowledge attributions, which are central components of social cognition. This paper consists of two parts. In the first part, I give an in-depth comparison and analysis of the theories of Frank Ankersmit and Eelco Runia, in which I highlight their most important resemblances and differences. What both have in common is their notion of the presence of the past as a ‘presence in absence’. They differ, however, with respect to the character of this past and the role representation plays in making it present. Second, I also argue that for (...) both Ankersmit and Runia, the presence of the past is always the present of our past, which excludes the experience of the otherness of the past, and which opens both theories to the criticisms of being self-centered and nationalistic. In this article, I question the unspoken assumption in historical theory that there is a trade-off between language or narrative, on the one hand, and experience or presence, on the other. Both critics and proponents of historical experience seem to presuppose that this is indeed the case. I argue that this is not necessarily true, and I analyze how the opposition between language and experience in historical theory can be overcome. More specifically, I identify the necessary conditions for a philosophy (...) of language that can be the basis for this. Second, I will also suggest and present one specific instance of such a solution. I argue that the existential philosophies of language of Martin Buber and Emmanuel Levinas can be exactly the kind of theory we need. For Buber and Levinas, language is not a means for accessing reality, but rather a medium of encounters between human beings. I present Levinas's and Buber's arguments, discuss how their views could be applied to the writing of history, and assess what the resulting picture of the writing of history could look like. The edition was made by Michiel Streijger, Paul Bakker and Hans Thijssen. First published as a printed book in 2010, the publication has been converted to open access with the CC BY-NC-ND license as of September 2023.

In this paper, I will argue with Ernst Cassirer that anticipation plays an essential part in the constitution of time, as seen from a transcendental perspective. Time is, as any transcendental concept, regarded as basically relational and subjective and only in a derivative way objective and indifferent to us. This entails that memory is prior to history, and that anticipation is prior to prediction. In this paper, I will give some examples in order to argue for this point. Furthermore, I (...) will also argue, again with Cassirer and contra Henri Bergson, that time should be seen as a functional unity, and not as a collection of three different things-in-themselves (past, present and future). In this paper we try to bring some clarification in the recent debate on causal pluralism. Our first aim is to clarify what it means to have a pluralistic theory of causation and to articulate the criteria by means of which a certain theory of causation can or cannot qualify as a pluralistic theory of causation. We also show that there is currently no theory on the\nmarket which meets these criteria, and therefore no full-blown pluralist theory of causation exists. In this paper, I will present what I take to be a standard view of morality, and I argue that this view amounts to a paradox: the moral event or moral concern, the source of morality, ultimately leads, through moral theory, to a denial of itself. I will show how Badiou and Levinas take a way out of this and in doing so deny the possibility of anticipating the moral. Furthermore, I claim that this anticipatory moment can be introduced back (...) by means of the concept of “practical wisdom” as used in analytical virtue ethics. Finally, I argue that the Kantian notion of the sublime is structurally the same as the moral event in Badiou and Levinas, and that our view of the sublime can benefit from both Levinas’ view and the concept of “practical wisdom” as well. In this paper, I formulate an existentialist view on the dialogue with the past, based on the philosophy of Martin Buber. This view is meant to supplement the traditional, hermeneutical view on the dialogue with the past. In the first part of this paper, I argue that the traditional hermeneutic view on the dialogue with the past is somewhat restricted. In the work of people such as Schleiermacher, Dilthey or even Gadamer, dialogue is always regarded as a primarily cognitive event, (...) focused on the “I” rather than the “you.” I argue that this means that they take only one aspect of the metaphor into account, and ignore the more existential dimension of dialogue. As an alternative, I use the philosophy of Martin Buber to formulate a point of view that does embrace the existential side of dialogue. I also compare the Buberian view of dialogue with that of Gadamer, and I suggest in which a Buberian historian would differ from a Gadamerian historian. (shrink)

In their landmark 2010 paper, “The weirdest people in the world?”, Henrich, Heine, and Norenzayan outlined a serious methodological problem for the psychological and behavioural sciences. Most of the studies produced in the field use people from Western, Educated, Industrialised, Rich and Democratic (WEIRD) societies, yet inferences are often drawn to the species as a whole. In drawing such inferences, researchers implicitly assume that either there is little variation across human populations, or that WEIRD populations are generally representative of the (...) species. Yet neither of these assumptions is justified. In many psychological and behavioural domains, cultural variation begets cognitive variation, and WEIRD samples are recurrently shown to be outliers. In the years since the article was published, attention has focused on the implications this has for research on extant human populations. Here we extend those implications to the study of ancient _H. sapiens_, their hominin forebears, and cousin lineages. We assess a range of characteristic arguments and key studies in the cognitive archaeology literature, identifying issues stemming from the problem of sample diversity. We then look at how worrying the problem is, and consider some conditions under which inferences to ancient populations via cognitive models might be provisionally justified. (shrink)

As a topic in the philosophy of psychology, dreaming is a fascinating, diverse, and severely underdeveloped area of study. The topic excites intense public interest in its own right, while also challenging our confidence that we know what the words “conscious” and “consciousness” mean. So dreaming should be at the forefront of our interdisciplinary investigations: theories of mind which fail to address the topic are incomplete. This chapter illustrates the tight links between conceptual and empirical issues by highlighting surprisingly deep (...) disagreements among leading dream scientists over what might seem basic aspects of their topic. This paper proposes a novel experimental approach that would help to determine whether perspectival shapes, such as the elliptical profile of a tilted plate or coin, are part of perceptual experience. If they are part of perceptual experience, then it should be possible to identify these shapes simply by attending appropriately to them. Otherwise, in order to identify perspectival shapes they must first be constructed in the visual imagination. We propose that these accounts of perspectival identification can be tested by (...) measuring the interference between visual and verbal working memory load, respectively, and the identification of perspectival shapes in the appearance of a 3D object. How induction was understood took a substantial turn during the Renaissance. At the beginning, induction was understood as it had been throughout the medieval period, as a kind of propositional inference that is stronger the more it approximates deduction. During the Renaissance, an older understanding, one prevalent in antiquity, was rediscovered and adopted. By this understanding, induction identifies defining characteristics using a process of comparing and contrasting. Important participants in the change were Jean Buridan, humanists such as Lorenzo Valla and (...) Rudolph Agricola, Paduan Aristotelians such as Agostino Nifo, Jacopo Zabarella, and members of the medical faculty, writers on philosophy of mind such as the Englishman John Case, writers of reasoning handbooks, and Francis Bacon. In Western political philosophy, democracy is generally the dominant view regarding what the best form of government is, and this holds even in respect to promoting minority rights. However, I argue that there is a better theory for satisfying minority interests and rights. I amass numerous studies from the social sciences demonstrating how democracy does poorly in accounting for minority interests. I then contend that a particular hybrid view that fuses a meritocracy with democracy can do a better job than (...) democracy in accounting for minority interests and in having more equal rights and fair policies coming from the legislative and executive branches. Finally, I defend this thesis from numerous counters. (shrink)

Aristotle, though not the first Greek virtue ethicist, was the first to establish virtue ethics as a distinct philosophical discipline. His exposition of the subject in his Nicomachean Ethics set the terms of subsequent debate in the European and Arabic traditions by proposing a set of plausible assumptions from which virtue ethics should proceed. His conception of human well-being and virtue as well as his brand of ethical naturalism were influential from antiquity through the Middle Ages and continue to be (...) influential today. (shrink)

On Despair. An Ontological Study (in Polish).

The main aims in this article are to discuss and criticize the core thesis of a position that has become known as phenomenal conservatism. According to this thesis, its seeming to one that p provides enough justification for a belief in p to be prima facie justified. This thesis captures the special kind of epistemic import that seemings are claimed to have. To get clearer on this thesis, the article embeds it, first, in a probabilistic framework in which updating on (...) new evidence happens by Bayesian conditionalization, and second, a framework in which updating happens by Jeffrey conditionalization. The article spells out problems for both views, and then generalizes some of these to nonprobabilistic frameworks. The main theme of the discussion is that the epistemic import of a seeming should depend on its content in a plethora of ways that phenomenal conservatism is insensitive to. (shrink)

The reason for physics’ failure to find a final theory of the universe is examined. Problems identified are: the lack of unequivocal definitions for its fundamental elements (time, length, mass, electric charge, energy, work, matter-waves); the danger of relying too much on mathematics for solutions; especially as philosophical arguments conclude the universe cannot have a mathematical basis. It does not even need the concept of number to exist. Numbers and mathematics are human inventions arising from the human predilection for measurement. (...) Following Aristotle, a single fundamental cause is proposed to explore the efficacy of using pure non-mathematical philosophy to explain the universe, contrary to current quantum physical views. The cause is taken as Time, which is then defined, surprisingly leading automatically to a definition of a three-dimensional space answering the question into what can a universe be placed (space before space seems non-sensical). This enables the philosophical arguments to derive a universal rule giving clear-cut descriptions (definitions) of force (both gravitational and electromagnetic), motion, energy, and particles. The formation of atomic nuclei and atomic properties together with an unexpected role for neutrinos follow. In particular, a Popper-test can be prepared by introducing the concept of measurement to allow the philosophy arguments to be tested in another discipline - mathematics. The solution agrees with human physical observations to a remarkable degree of accuracy, automatically explaining and predicting values for Planck’s and the fine-structure constants. Although mathematical, it is included as confirming the efficacy of philosophy in attaining a final theory. (shrink)

Loneliness in medicine is a serious problem not just for patients, for whom illness is intrinsically isolating, but also for physicians in the contemporary condition of medicine. We explore this problem by investigating the ideal physician-patient relationship, whose analogy with friendship has held enduring normative appeal. Drawing from Talbot Brewer and Nir Ben-Moshe, we argue that this appeal lies in a dynamic form of companionship incompatible with static models of friendship-like physician-patient relationships: a mutual refinement of embodied virtue that draws (...) both persons together. The ideal physician-patient relationship has a dialectical character that fosters each member's improvement of phenomenologically recognizing and embodying moral virtues. A key component of this dynamic is a commitment to the common goal of the patient's health, realized through joint interactivities and conversations over time. The physician's presence to the patient's suffering—understood best as an alienating phenomenological condition for the patient—orients and discloses possibilities for virtuous caregiving by structuring the meanings of the goals, conversations, and joint narrative constitutive of their relationship. Presence to suffering, paradoxically, is perhaps an important prerequisite for this dynamic partnership. These activities dialectically build an interpretive horizon of understanding through which moral goods and character refinement—in and for the other—may become revealed for both persons in their shared being-in-the-world. This analysis of suffering, mood, and revealing of (possible) moral goods has implications for addressing the modern problem of loneliness for patients and physicians, who are increasingly inhibited from building flourishing relationships with each other. To better understand the nature of joint expertise and its underlying processes, we need not only analyses of the general conditions for skilled group action, but also descriptive accounts of the features and dimensions that vary across distinct performances and contexts, such as sport and the arts. And in addition to positioning our accounts against current models of individual skill, we need concepts and lessons from work on collaborative processes in other cognitive domains. This paper examines ecological or situational components (...) of expert joint action in practice, then offers a selective survey of some key cognitive and affective resources that shape and transform group performance. Eliade and the Doctrine of Mystic Lights Eliade believed that in every religion there are reports about an experience of mystic light. Furthermore, all such reports mention that the person who experienced the light subsequently underwent a deep transformation of her or his spirit and began a new life, the life of a holy man or homo religiosus, which is identical – in its purest form – with the life of a mystic. A clear example of one such transformation is (...) Saul turning into Paul. But a closer analysis indicates, says the Author, that these changes can be of two kinds. They either come suddenly to an unsuspecting and unprepared individual, and that was the case of Saul, or they are a result of concentrated spiritual training, and such a case was described by Gregory Palamas. The former transformation leads to a religious conversion, the latter is the beginning of a new, mystic life. The Author argues that these forms of experience are seeing without using eyes, and as such, they may have served as a paradigm of vivid mental understanding. In Plato’s Philebus, Socrates’ second account of ‘false’ pleasure (41d-42c) outlines a form of illusion: pleasures that appear greater than they are. I argue that these pleasures are perceptual misrepresentations. I then show that they are the grounds for a methodological critique of hedonism. Socrates identifies hedonism as a judgment about the value of pleasure based on a perceptual misrepresentation of size, witnessed paradigmatically in the ‘greatest pleasures’.
