This Open Access book addresses the age-old problem of infinite regresses in epistemology. How can we ever come to know something if knowing requires having good reasons, and reasons can only be good if they are backed by good reasons in turn? The problem has puzzled philosophers ever since antiquity, giving rise to what is often called Agrippa's Trilemma. The current volume approaches the old problem in a provocative and thoroughly contemporary way. Taking seriously the idea that good reasons are (...) typically probabilistic in character, it develops and defends a new solution that challenges venerable philosophical intuitions and explains why they were mistakenly held. Key to the new solution is the phenomenon of fading foundations, according to which distant reasons are less important than those that are nearby. The phenomenon takes the sting out of Agrippa's Trilemma; moreover, since the theory that describes it is general and abstract, it is readily applicable outside epistemology, notably to debates on infinite regresses in metaphysics. Dans cet article, il sera fait un bref rappel du modèle traditionnel d’interprétation des lois, toujours prescrit dans la doctrine, sinon épousé verbalement dans les tribunaux canadiens. Il sera démontré que ce modèle ne peut pas représenter toute la réalité du travail d’interprétation des juristes canadiens, pour plusieurs raisons. L’herméneutique, la sociologie critique, l’analyse du discours, prenant pour objet les textes législatifs, les jugements rendus, les arguments pratiques entendus, ont montré l’étendue du comportement réflexif réel, l’étendue du champ interprétatif visant (...) les circonstances d’une cause. Les textes législatifs donnent de fait de plus en plus de place à l’interprétation des circonstances pertinentes à l’encadrement de l’action des justiciables. Sur un plan empirique, l’analyse des jugements, de même que les prises de position de juges lorsqu’ils s’expriment en dehors du forum judiciaire, mettent en évidence la variété des motifs effectivement pris en considération, l’espace considérable de délibération éthique impliquant de fait tous les interprètes, qu’ils soient simples citoyens d’une communauté, inspirés par l’un ou l’autre des ordres sociaux, ou acteurs spécialisés de l’ordre juridique. Cet article se propose d’examiner comment se produit actuellement, en droit canadien ou québécois, l’interprétation des juristes, dans des processus décisionnels réflexifs, en situations complexes, voire même dans la perspective du développement des institutions. This book contains a selection of papers from the workshop *Women in the History of Analytic Philosophy* held in October 2019 in Tilburg, the Netherlands. It is the first volume devoted to the role of women in early analytic philosophy. It discusses the ideas of ten female philosophers and covers a period of over a hundred years, beginning with the contribution to the Significs Movement by Victoria, Lady Welby in the second half of the nineteenth century, and ending with Ruth (...) Barcan Marcus’s celebrated version of quantified modal logic after the Second World War. The book makes clear that women contributed substantially to the development of analytic philosophy in all areas of philosophy, from logic, epistemology, and philosophy of science, to ethics, metaphysics, and philosophy of language. It illustrates that although women's voices were no different from men's as regards their scope and versatility, they had a much harder time being heard. The book is aimed at historians of philosophy and scholars in gender studies. (shrink)

Jeanne-Marie Jackson’s The African Novel of Ideas: Philosophy and Individualism in the Age of Global Writing provides an analytic framework for understanding the novel as a form of philosophical expression in African intellectual history. More specifically, she uses individualism as a tool for tracking the expression of abstract “philosophical thinking” in a selection of African novels. For Jackson, it is the fictional individual in the novel who is the primary bearer of philosophical thought. Jackson situates this interpretative heuristic vis-à-vis (...) the debates about ethnophilosophy which dominated African philosophy in third quarter of the twentieth century. Like Paulin Hountondji, perhaps the most well-known critic of ethnophilosophy, Jackson emphasizes that philosophical practice, at a bare minimum, requires a second-order reflexivity toward conventional hegemonic beliefs in a given society, and this second order discourse takes the form of an argumentative stance toward those beliefs. Her general suggestion is that the best place to look for philosophical thought in the aforementioned sense is to examine individual thinkers, whether real or fictional. (shrink)

Standard lore holds that magnetic forces are incapable of doing mechanical work. More precisely, the claim is that whenever it appears that a magnetic force is doing work, the work is actually being done by another force, with the magnetic force serving only as an indirect mediator. However, the most familiar instances of magnetic forces acting in everyday life, such as when bar magnets lift other bar magnets, appear to present manifest evidence of magnetic forces doing work. These sorts of (...) counterexamples are often dismissed as arising from quantum effects that lie outside the classical regime. In this paper, we show that quantum theory is not needed to account for these phenomena, and that classical electromagnetism admits a model of elementary magnetic dipoles on which magnetic forces can indeed do work. In order to develop this model, we revisit the foundational principles of the classical theory of electromagnetism, showcase the importance of constraints from relativity, examine the structure of the multipole expansion, and study the connection between the Lorentz force law and conservation of energy and momentum. It is common lore that standard, Kripke-style semantics for quantified modal logic is incompatible with the view that no individual may belong to more than one possible world, a view that seems to require a counterpart-theoretic semantics instead. Strictly speaking, however, this thought is wrong-headed. This note explains why.

Yunkaporta’s 2019 text Sand Talk carves out a language of resistance to the McDonaldisation of Indigenous research. While historic scholarly engagement with Aboriginal culture has overemphasized content, Yunkaporta demonstrates how this has occurred to the exclusion of the processes of Indigenous knowledge transmission and creation. Yet a process view requires engagement with the how not only the what. Such knowledge transmission is discerned in daily lived relationship between land, spirit, and people; binding epistemology to participation in a specific landscape embedded (...) within a living culture. Place-making for Indigenous knowledges requires exploring how Indigenous ways of valuing, knowing and being, shaped by cultural activities on Country, offer new understandings for western metaphysics. -/- Through a close study of Yunkaporta’s Sand Talk this article explores: fractal thinking and the pattern of creation in Indigenous cosmology; the role of custodianship in respectful interaction between living systems; alternative Indigenous understandings of non-linearity, time and transience; the process-panpsychism and animism present in Indigenous perceptions of cosmos as living Country illustrated in the Dreaming and Turnaround creation event; the role of embodied-cognition, haptic- and situated- knowledge in Indigenous science; Indigenous holistic reasoning and the mind-body connection; the relational metaphysic embedded in ritual and yarning practice; the knowledge encoded in place-based totemic mythology, lore, and ritual; and Indigenous understandings of complex systems as adaptive, self-organising and patterned. This article does not offer a process reading of Indigenous thought but rather demonstrates the significant contribution to process metaphysics that may be provided by an Aboriginal Australian perspective. In Michel de Certeau’s Invention of the Everyday, improvisational community dance function as a catalyst for the subversive art of the oppressed, via its ancient Greek virtue/power of mētis, being “foxlike.” And in de Certeau’s The Possession of Loudun, this foxlike dance moves to the stage, as an improv chorus that disrupts the events at Loudon when reimagined as a tetralogy of plays at City Dionysia. More precisely, Loudun’s tetralogy could be interpreted as a series of three tragedies and one (...) comedy, the latter of which involves the chorine nuns’ channeling of anomie into a proto-feminist transfiguration. More precisely, the tactical prowess of the nuns’ chorus leader, namely the prioress Jeanne des Anges, elevates her to the status of an angelic prophet, which in de Certeau’s theatrical dancing critique makes her the Loudun tetralogy’s Dionysian, foxlike mage. In conclusion, this analysis suggests de Certeau’s relevance for revolutionary social justice today. (shrink)

The early Presocratics’ major speculative and critical initiatives—in particular, Anaximander’s conceptions of the justice of the cosmos and of the apeiron as its archē and Xenophanes’s polemics against immorality and anthropomorphism in the depiction of the gods and against any claim to divine inspiration—appear to break with Hesiod’s form of thought. But the conceptual, critical, and ethical depth of Hesiod’s own rethinking of the lore that he inherits complicates this picture. Close examination of each of their major initiatives together with (...) the relevant passages in Hesiod shows that even in the course of departing from his thought, Anaximander and Xenophanes also reappropriate and renew it. In a postscript I pose some questions for future inquiry into Heraclitus’s and Parmenides’s receptions of Hesiod. (shrink)

I argue that (i) even though Adam Smith’s four stages theory has been criticized with good reasons as both vitiated by undue generalization from modern Europe to the first stage and made bottom-heavy by assumptions of modern episteme, yet, in his writings an alternative view emerges where the savage is not just crushed under the weight of want and isolation but is endowed with imagination and sympathy; (ii) his picture of the fourth stage is, far from a triumphal apology of (...) Capitalism, a tragic diagnosis of an inner tension between ambition and greed and their unintended beneficial effects; (iii) the tensions in the picture are not just a report of tensions out there, but also depend on Smith’s pre-comprehension of the phenomena he tries to account for; (iv) and yet, the tragic character of this picture is to be credited to his integrity; I summarize peculiarities of Smith’s peculiar outlook, post-empiricism, as well as its potentialities (sect 2). I then reconstruct his view of development of language and science, suggesting that his theory of association of ideas and imagination provides a consistent account of both science and lore, yielding a comparatively less ethnocentric evaluation of the savage mind (sect. 3). I reconstruct his virtually twofold reconstruction of subsistence in the rude and early state, arguing that he tends to ascribe inability to evolve to want and isolation and describes his own view of evolution as a necessary path but also that in several passages imagination and sympathy do play a role also for the savage (sect. 4). I compare Smith’s view of the first stage with his diagnosis of commercial society arguing that his reconstruction is burdened by eighteenth-century ideology as well as by modern episteme and I conclude with an ambivalent appraisal of Smith’s comparison between the polished man and the savage. -/- . Missing Links, Lucas Ferraço Nassif instructs that “cinema exists in the tension of desires, from everything that is in the game”. And “what is in the game vibrates”, or becomes perceptible in the tempo of film and filmic thought that somehow promises to reveal the nature of this world (maybe, a world that’s about to end). To approach such perception is to submit to description, says Nassif, and then proceeds to investigate the act of describing in all its perilous demand and exhausting impossibility. What can we know, after all, of Chantal Akerman’s Jeanne Dielman, at whom we look and look? Or of any seemingly-unified object that, in being worthy of our attention, must be recognized most fundamentally for the way it slips and blurs? I’m dazzled by this writer’s courage to “work on the void”, to tilt, heart in mouth, at ghosts and ruins. Ist die Entstehung des Lebens Zufall, ist es Folge einer physikalischen Logik, die noch zu entdecken ist, oder ist „Lebensfreundlichkeit“ ein eigenes Prinzip des Naturgeschehens, das zum Beispiel offene Naturkonstanten der physikalischen Gesetze festlegt, zu denen die geheimnisvollen Grossen Zahlen der Kosmologie gehören – „The (...) Lore of Large Numbers…“? Wissenschaftlich bleibt diese Frage nicht eindeutig zu klären; intuitiv wird das „Prinzip lebensfreundlich“ der menschlichen Evolution wohl am ehesten gerecht. Dabei ist „lebensfreundlich“ in diesem Artikel nicht psychologisch im Sinne menschlicher Beziehungen gemeint, sondern eine Art Kurzbezeichnung für eine Physik, die im Kosmos irgendwann und irgendwo Leben, auch menschliches Leben mit Geist und Bewusstsein ermöglicht. I contend that “philosophos” is meant to carry the connotation of a Pythagorean: Euenus is a native from Paros which had a strong Pythagorean community down to the end of the fifth century. Moreover, “philosophos” was used to refer to the Pythagoreans, as can be seen from the story related by Cicero from Heraclides Ponticus (Tusc. Disp. V, iii, 7-8; cp. DL, 1.12; 8.8). I argue (against Burkert) that even if this story is part of the lore surrounding Pythagoras and, (...) hence, without historical value as for Pythagoras, it may still be used as evidence for the use of “philosophos” among latter-day Pythagoreans. An essay on the compatibility of Jewish and Muslim aspirations for the Land that argues that a vision of peaceful coexistence to provide a spur to the settling of grievances, but that this vision must respect the deeply felt aspirations of both communities, including in particular those underpinned by religious lore. Existing formulations of the aims of each community are blatantly inconsistent; it is time to attempt to characterise the just and religiously authentic goals of each community in ways that (...) are compatible. I argue that there religious and personal dimensions of the conflict that have been displaced by less deep-seated political goals, but which can be addressed more readily. I outline a tiered constitutional settlement that could address legitimate aspirations by avoiding the anathema of partition. (shrink)

There is a long-standing debate in epistemology on the structure of justification. Some recent work in formal epistemology promises to shed some new light on that debate. I have in mind here some recent work by David Atkinson and Jeanne Peijnenburg, hereafter “A&P”, on infinite regresses of probabilistic support. A&P show that there are probability distributions defined over an infinite set of propositions {\ such that \ is probabilistically supported by \ for all i and \ has a high (...) probability. Let this result be “APR”. A&P oftentimes write as though they believe that APR runs counter to foundationalism. This makes sense, since there is some prima facie plausibility in the idea that APR runs counter to foundationalism, and since some prominent foundationalists argue for theses inconsistent with APR. I argue, though, that in fact APR does not run counter to foundationalism. I further argue that there is a place in foundationalism for infinite regresses of probabilistic support. (shrink)

There are two areas of particular importance in Heathen ethics. One is the growth and maintenance of ethical personal power or 'might and main': the inner strength and drive that is necessary to develop and sustain a good character and reputation, and to achieve worthy deeds during our life. The second is the pursuit of relationships and community life that promote individual, group, and community well-being and effective functionality. Any thoughtful reading of Heathen history, old texts, tales, poems and sagas (...) will show how important these two factors were in ancient Heathen life. This was generally illustrated by showing the painful, cascading disruptions that were caused by failures of, and transgressions against, these ethical values and aspirations. Modern Heathens can benefit from a fuller understanding of ancient Heathen ethical views: both their strengths and their weaknesses, their pros and cons. Only by a thoughtful grasp of these concepts can we make the best use of the elder ways as Heathens living in today’s world. This book offers philosophical discussions of certain Heathen ethical concepts, as well as guidelines for using these concepts to live ethically strong and spiritually healthy lives as modern Heathens. Fulfilled OATHS build Heathen might and main, increasing our personal power. Unpaid SHILD (moral obligation) weakens our might and main; taking responsibility for shild heals personal power. FRITH is a fabric of interwoven might and main, created and shared by many: the roots of relationship and community. LUCK and WYRD can be expressed through flows of might and main, discovered along the complex, hidden paths that lead to Heathen wisdom. Judaic Logic is an original inquiry into the forms of thought determining Jewish law and belief, from the impartial perspective of a logician. Judaic Logic attempts to honestly estimate the extent to which the logic employed within Judaism fits into the general norms, and whether it has any contributions to make to them. The author ranges far and wide in Jewish lore, finding clear evidence of both inductive and deductive reasoning in the Torah and other books of the Bible, and (...) analyzing the methodology of the Talmud and other Rabbinic literature by means of formal tools which make possible its objective evaluation with reference to scientific logic. The result is a highly innovative work – incisive and open, free of clichés or manipulation. Judaic Logic succeeds in translating vague and confusing interpretative principles and examples into formulas with the clarity and precision of Aristotelean syllogism. Among the positive outcomes, for logic in general, are a thorough listing, analysis and validation of the various forms of a-fortiori argument, as well as a clarification of dialectic logic. However, on the negative side, this demystification of Talmudic/Rabbinic modes of thought (hermeneutic and heuristic) reveals most of them to be, contrary to the boasts of orthodox commentators, far from deductive and certain. They are often, legitimately enough, inductive. But they are also often unnatural and arbitrary constructs, supported by unverifiable claims and fallacious techniques. Many other thought-processes, used but not noticed or discussed by the Rabbis, are identified in this treatise, and subjected to logical review. Various more or less explicit Rabbinic doctrines, which have logical significance, are also examined in it. In particular, this work includes a formal study of the ethical logic (deontology) found in Jewish law, to elicit both its universal aspects and its peculiarities. With regard to Biblical studies, one notable finding is an explicit formulation (which, however, the Rabbis failed to take note of and stress) of the principles of adduction in the Torah, written long before the acknowledgement of these principles in Western philosophy and their assimilation in a developed theory of knowledge. Another surprise is that, in contrast to Midrashic claims, the Tanakh (Jewish Bible) contains a lot more than ten instances of qal vachomer (a-fortiori) reasoning. In sum, Judaic Logic elucidates and evaluates the epistemological assumptions which have generated the Halakhah (Jewish religious jurisprudence) and allied doctrines. Traditional justifications, or rationalizations, concerning Judaic law and belief, are carefully dissected and weighed at the level of logical process and structure, without concern for content. This foundational approach, devoid of any critical or supportive bias, clears the way for a timely reassessment of orthodox Judaism (and incidentally, other religious systems, by means of analogies or contrasts). Judaic Logic ought, therefore, to be read by all Halakhists, as well as Bible and Talmud scholars and students; and also by everyone interested in the theory, practise and history of logic. (shrink)

This article looks at legends of the basilisk, a fabulous creature of ancient and medieval lore that was believed to kill with a glance, and shows how many characteristics of the basilisk were transferred to the rattlesnake in the New World. The deadly power of "fascination, " also known as "the evil eye, " which legend attributes to both basilisk and rattlesnake, was understood as an expression of resentment over the perceived lack of status of reptiles in the natural world (...) and directed at so-called "higher" animals. The persistence of such legends suggests some of the limitations of capitalistic American society in dealing with inequalities. (shrink)
