Vom lange unter Verschluss gehaltenen Band erhofft sich die Leser_innenschaft neue Erkenntnisse nicht nur zum Thema des Buches – die Reflexionen der Kirchenväter bis Augustinus zu Sexualität und Lebensführung –, sondern zu Foucaults Werk im Allgemeinen und den großen Fragen nach Macht, Freiheit und Kritik, die dessen Rezeption bestimmen. Und tatsächlich bietet der Band überraschend neue Einsichten, (...) in deren Lichte sich die herrschende Meinung zu Foucaults Freiheits- und Kritikbegriff als falsch herausstellt. Heute ist die These verbreitet, dass Foucaults Arbeiten zur antiken Ethik und parrhesia als Beitrag zu einem normativen Freiheitsbegriff gewertet werden können. Wie können Freiheit und Widerstand innerhalb von Foucaults Theorie der Macht und Subjektivierung konzipiert werden? Karsten Schubert liefert die erste systematische Rekonstruktion der sozialphilosophischen Debatte um Freiheit bei Foucault und eine neue Lösung für das Freiheitsproblem: Freiheit als die Fähigkeit zur reflexiven Kritik der eigenen Subjektivierung – kurz: Freiheit als Kritik – ist das Resultat von freiheitlicher Subjektivierung in politischen Institutionen. Der Band zeigt so die Konsequenzen von Foucaults Freiheitsdenken für die Demokratietheorie und die allgemeine sozialphilosophische Freiheitsdiskussion auf.

Identity politics is commonly criticized as endangering democracy by undermining community, rational communication, and solidarity. Drawing on both radical democratic theory and standpoint theory, this article posits the opposite thesis: identity politics is pivotal for the democratization of democracy. Democratization through identity politics is achieved by disrupting hegemonic discourse and is, therefore, a matter of power, while such forms of power politics are reasonable when following minority standpoints generated through identity politics. The article develops this approach by connecting radical democratic (...) theories with standpoint theories and highlighting their commonalities and potential for mutual enhancement. Standpoint theory allows us to substantiate and reconcile two initially contradictory claims: particular minority standpoints are necessary to criticize the prevailing discursive and institutional orders, and these standpoints stem from intersubjective reason and embody ‘strong objectivity.’ This discussion presents a new perspective on the tension between particularity and universality, as well as the relationship between power and reason in democracy. Democratization is an oscillation between these polarities, and political theory should not aim to resolve this tension but to recognize and articulate it. Such recognition might involve elevating knowledge emerging from oppressed groups and exercising epistemic modesty when assessing specific forms of identity politics. (shrink)

I critically examine the semantic view of theories to reveal the following results. First, models in science are not the same as models in mathematics, as holders of the semantic view claim. Second, when several examples of the semantic approach are examined in detail no common thread is found between them, except their close attention to the details of model building in each particular science. These results lead me to propose a deflationary semantic view, which is simply that model construction (...) is an important component of theorizing in science. This deflationary view is consistent with a naturalized approach to the philosophy of science. (shrink)

Foucault's theory of power and subjectification challenges common concepts of freedom in social philosophy and expands them through the concept of 'freedom as critique': Freedom can be defined as the capability to critically reflect one's own subjectification, and the conditions of possibility for this critical capacity lie in political and social institutions. The article develops this concept through a critical discussion of the standard response by Foucault interpreters to the standard objection that Foucault's thinking obscures freedom. The standard response interprets (...) Fou-cault's later works, especially The Subject and Power, as a solution to the problem of freedom. It is mistaken, because it conflates different concepts of freedom that are present in Foucault's work. By differentiating these concepts, this paper proposes a new institutionalist approach to solve the problem of freedom that breaks with the partly anarchist underpinnings of Foucault scholarship: As freedom as critique is not given, but itself a result of subjectification, it entails a demand for 'modal robustness' and must therefore be institutionalized. This approach helps to draw out the consequences of Foucault's thinking on freedom for postfoundationalist democratic theory and the general social-philosophical discussion on freedom. (shrink)

This article provides an original account of slurs and how they may be differentially used by in-group and out-group speakers. Slurs are first distinguished from other terms and their role in social interaction is discussed. A new distinction is introduced between three different uses of slurs : the paradigmatic derogatory use, non-paradigmatic derogatory use, and non-paradigmatic non-derogatory use. I then account for their literal meaning and explain how a family-resemblance conception of category membership can clarify our understanding of the various (...) natural-language uses of slurs, -. The focus is restricted primarily to race-based and sex-based slurs used in the context of English speakers, and the article concludes with desiderata to be met by any subsequent analyses of slurs. In den aktuellen Kulturkämpfen kritisieren Konservative Identitätspolitik und “Cancel Culture” als Einschränkungen von individueller Freiheit. Der Artikel untersucht die dabei zugrundeliegenden Freiheitsbegriffe. Die konservative Kritik stützt sich in der Regel auf einen negativen Begriff von Freiheit als Nichteinmischung im Sinne der liberalen Tradition. In der politischen Theorie wird ein solcher negativer Freiheitsbegriff als Gegensatz zur Auffassung von sozialer Freiheit gesehen, die Freiheit in hegelianischer und kommunitaristischer Tradition als ein gemeinschaftliches Unternehmen begreift. Der Artikel zeigt, dass beide Konzepte – trotz ihrer (...) philosophischen Gegensätze – in der zeitgenössischen konservativen Kritik an Identitätspolitik übereinstimmen und daher politisch kompatibel sind. Beide Freiheitsbegriffe kranken an einem falschen Universalismus. Im Gegensatz dazu hilft die radikaldemokratische Tradition, Freiheit partikularistisch zu verstehen. Dabei wird verständlich, dass Identitätspolitik nicht in erster Linie eine Einschränkung individueller Freiheit ist, sondern als Demokratisierung der Demokratie ein Beitrag zur Freiheit aller ist. This paper assesses the role of the Refutation of Idealism within the Critique of Pure Reason, as well as its relation to the treatment of idealism in the First Edition and to transcendental idealism more generally. It is argued that the Refutation is consistent with the Fourth Paralogism and that it can be considered as an extension of the Transcendental Deduction. While the Deduction, considered on its own, constitutes a 'regressive argument', the Refutation allows us to turn the Transcendental Analytic (...) into a 'progressive argument' that proceeds by the synthetic method. I argue via examples that there are cases in which things that are not two distinct things qualitatively differ without contradiction. In other words, there are cases in which something differs from itself. Standard responses to such cases are to divide the thing into distinct parts, or to conceive of the thing under different descriptions, or to appeal to different times, or to deny that the property had is the property lacked. I show these responses to be unsatisfactory. I then (...) gather and systematize available ways of talking about such cases with phrases like ‘insofar as’, ‘qua’, ‘to the extent that’, ‘in some respect’, etc., while paying special attention to the scope of ‘not’ when used with these phrases. Gay men have been severely affected by the AIDS crisis, and gay subjectivity, sexual ethics, and politics continue to be deeply influenced by HIV to this day. PrEP (Pre-Exposure Prophylaxis) is a new, drug-based HIV prevention technique, that allows disentangling gay sex from its widespread, 40 yearlong association with illness and death. This article explores PrEP's fundamental impact on gay subjectivity, sexual ethics, and politics. It traces the genealogy of gay politics regarding homophobia and HIV stigma, suggesting a new biopolitical (...) and body political framework that accounts for the agency of activists as well as pharmapower, and proposing that PrEP is an example of democratic biopolitics. Highlighting the entanglement of medical technology, sexual ethics, and politics, the article shows how conservative and homonormative gay politics developed as a reaction to HIV stigma and how, by overcoming this stigma, PrEP enables a new era of intersectional queer politics and solidarities. It thereby develops a Foucauldian account of sexual liberation beyond the repression hypothesis that accounts for the ambivalence of sexual subjectification and the political potential of sexuality. This contribution provides an assessment of the epistemological role of scientific models. The prevalent view that all scientific models are representations of the world is rejected. This view points to a unified way of resolving epistemic issues for scientific models. The emerging consensus in philosophy of science that models have many different epistemic roles in science is presented and defended.

Human social intelligence comprises a wide range of complex cognitive and affective processes that appear to be selectively impaired in autistic spectrum disorders. The study of these neuro- developmental disorders and the study of canonical social intelligence have advanced rapidly over the last twenty years by investigating the two together. Specifically, studies of autism have provided important insights into the nature of ‘theory of mind’ abilities, their normal development and underlying neural systems. At the same time, the idea of impaired (...) development of the neurocognitive mechanisms underlying ‘theory of mind’ has shed new light on the nature of autistic disorders. This general approach is not restricted to the study of impairments but extends to mapping areas of social intelligence that are spared in autism. Here we investigate basic moral judgment and find that it appears to be substantially intact in children with autism who are severely impaired in ‘theory of mind’. At the same time, we extend studies of moral reasoning in normal development by way of a new control task, the ‘cry baby’ task. Cry baby scenarios, in which the distress of the victim is ‘unreasonable’ or ‘unjustified,’ do not elicit moral condemnation from normally developing preschoolers or from children with autism. Judgments of moral transgressions in which the victim displays distress are therefore not likely the result of a simple automatic reaction to the distress and more likely involve moral reasoning. Mapping the cognitive co-morbidity patterns of disordered development should encompass both impairments and sparings because both will be needed to make sense of the neural and genetic levels. Sustainability science seeks to extend scientific investigation into domains characterized by a distinct problem-solving agenda, physical and social complexity, and complex moral and ethical landscapes. In this endeavor it arguably pushes scientific investigation beyond its usual comfort zones, raising fundamental issues about how best to structure such investigation. Philosophers of science have long scrutinized the structure of science and scientific practices, and the conditions under which they operate effectively. We propose a critical engagement between sustainability scientists and philosophers of science (...) with respect to how to engage in scientific activity in these complex domains. We identify specific issues philosophers of science raise concerning current sustainability science and the contributions philosophers can make to resolving them. One problem often associated with identity politics is “positional fundamentalism,” the equating of social positions with epistemic possibilities and political dispositions. The criticism is that identity politics is usually more about who says something than what is said. This goes hand in hand with perspective relativity, which no longer allows for a common, universal position and therefore also prevents emancipative politics. To respond to this critique of positional fundamentalism and perspective relativism, I develop a new account of identity politics as (...) inherently intersubjective and fundamental to democracy. This approach is necessary to address the philosophical problem at the heart of debates about identity politics: the tension between particularist power politics, on the one hand, and politics as a universalist appeal to reason, on the other. Cognitive categories in the geographic realm appear to manifest certain special features as contrasted with categories for objects at surveyable scales. We have argued that these features reflect specific ontological characteristics of geographic objects. This paper presents hypotheses as to the nature of the features mentioned, reviews previous empirical work on geographic categories, and presents the results of pilot experiments that used English-speaking subjects to test our hypotheses. Our experiments show geographic categories to be similar to their non-geographic counterparts in (...) the ways in which they generate instances of different relative frequencies at different levels. Other tests, however, provide preliminary evidence for the existence of important differences in subjects’ categorizations of geographic and non-geographic objects, and suggest further experimental work especially with regard to the role in cognitive categorization of different types of object-boundaries at different scales. The paper advances a non-orthodox reading of political liberalism’s view of political legitimacy, the view of public political justification that comes with it, and the idea of the reasonable at the heart of these views. Political liberalism entails that full discursive standing should be accorded only to people who are reasonable in a substantive sense. As the paper argues, this renders political liberalism dogmatic and exclusivist at the level of arguments for or against normative theories of justice. Against that background, (...) the paper considers aspects of a more plausible, deeper and more inclusive idea of public political justification that builds on a thinner, potentially cosmopolitan idea of the reasonable. The paper considers what content such an idea may have, and identifies a method of inclusive abstraction through which it may be enriched in content to render it fruitful for the purposes of a justification of principles of political justice. But the move toward more depth and inclusiveness faces constructivism with two challenges. First, inclusivism about the scope of political justification might not be able to avoid dogmatism unless it invokes perfectionist considerations. And second, the authority and appeal of a fruitfully rich idea of the reasonable depends on whether the addressees of political justification already value wide acceptability. (shrink)

This paper develops co-ordinated multiple-domain supervenience relations to model determination and dependence relations between complex entities and their constituents by appealing to R-related pairs and by making use of associated isomorphisms. Supervenience relations are devised for order-sensitive and repetition-sensitive mereologies, for mereological systems that make room for many-many composition relations, as well as for hierarchical mereologies that incorporate compositional and hylomorphic structure. Finally, mappings are provided for theories that consider wholes to be prior to their parts.

Ontology, since Aristotle, has been conceived as a sort of highly general physics, a science of the types of entities in reality, of the objects, properties, categories and relations which make up the world. At the same time ontology has been for some two thousand years a speculative enterprise. It has rested methodologically on introspection and on the construction and analysis of elaborate world-models and of abstract formal-ontological theories. In the work of Quine and others this ontological theorizing in abstract (...) fashion about the world was supplemented by the study, based on the use of logical methods, of the ontological commitments or presuppositions embodied in scientific theories. In recent years both types of ontological study have found application in the world of information systems, for example in the construction of frameworks for knowledge representation and in database design and translation. As ontology is in this way drawn closer to the domain of real-world applications, the question arises as to whether it is possible to use empirical methods in studying ontological theories. More specifically: can we use empirical methods to test the ontological theories embodied in human cognition? We set forth the outlines of a framework for the formulation and testing of such theories as they relate to the specific domain of geographic objects and categories. (shrink)

Er soll nicht nur helfen, Macht und Herrschaft besser zu verstehen, sondern auch eine neue Grundlage für tiefere und radikalere Gesellschaftskritik bieten: Das Denken in Regimen bezieht Denk- und Wahrnehmungsmuster in die Analyse und Kritik von gesellschaftlichen Strukturen, (politischer) Macht und alltäglichen Normen und Praxen ein. Kurz: Regimeanalysen helfen uns zu sehen, was sonst unsichtbar bliebe, wie (...) etwa die rassistische Regulierung von Migration, die Normierung von Geschlechterverhältnissen oder die Neoliberalisierung von Universitäten. Es wundert nicht, dass ein Begriff, mit dem solch verschiedene Phänomene beschrieben werden können, »sehr weitläufig und oft ungenau und spekulativ« ist. Ordinary usage gives a way to think of identity through time: the Pittsburgh of 1946 was the same city as the Pittsburgh of today is--namely Pittsburgh. Problem: The Pittsburgh of 1946 does not exist; Pittsburgh still does. How can they have been identical? I reject the temporal parts view on which they were not but we may speak as though they were. Rather I argue that claiming their identity is not contradictory. I interpret ‘the Pittsburgh of 1946’ as ‘Pittsburgh as (...) it was in 1946’ and suggest that the apparent contradiction results from an ambiguity in the scope of ‘as’. (shrink)

Intuitions play an important role in contemporary philosophy. It is common for theories in epistemology, morality, semantics and metaphysics to be rejected because they are inconsistent with a widely and firmly held intuition. Our goal in this paper is to explore the role of epistemic intuitions in epistemology from a naturalistic perspective. Here is the question we take to be central: (Q) Ought we to trust our epistemic intuitions as evidence in support of our epistemological theories? We will understand this (...) question as employing an epistemic ‘ought’ – insofar as we aim at developing a correct epistemological theory, ought we to trust our epistemic intuitions as evidence for or against our epistemological theories? As it stands, (Q) needs further clarification. Whether something is trustworthy is relative to what (a) what it is and (b) what we’re asking it to do. Sam might trust Marie but not George to care for his children, while he might trust both to care for his pet fish. So in order to address (Q), we first need to explore two questions: What are epistemic intuitions? And what sort of epistemological theories do we want? We will take up each of these questions in the following sections. (shrink)

This chapter identifies and explores a series of challenges raised by the clinical concept of delusion for theories which conceive autonomy as an agency rather than a status concept. The first challenge is to address the autonomy-impairing nature of delusions consistently with their role as grounds for full legal and ethical excuse, on the one hand, and psychopathological significance as key symptoms of psychoses, on the other. The second challenge is to take into account the full logical range of delusions, (...) which may take the form of true or false factual beliefs, positive or negative evaluations, as well as the paradoxical delusion of mental illness. The third and final challenge is to make room for non-pathological or, autonomy-preserving delusions and to offer a credible way of distinguishing between these and pathological or, autonomy-impairing delusions. By setting out these challenges, we are able to, firstly, distinguish between two separate conceptions of objectivity that may be at work in existing accounts of delusions and, secondly, to put a spotlight on an elusive yet inescapable notion of agential success that underlies our thinking about autonomy as well as mental disorder. The paper argues that applications of the principle that “ought” implies “can” (OIC) depend on normative considerations even if the link between “ought” and “can” is logical in nature. Thus, we should reject a common, “factualist” conception of OIC and endorse weak “normativism”. Even if we use OIC as the rule ““cannot” therefore “not ought””, applying OIC is not a mere matter of facts and logic, as factualists claim, but often draws on “proto-ideals” of moral agency.

Wissenschaftsfreiheit wird vorherrschend als Freiheit der Wissenschaft von politischer Einmischung verstanden. Der Artikel kritisiert dieses negative Verständnis von Wissenschaftsfreiheit anhand einer Analyse seines prominentesten Vertreters, dem Netzwerk Wissenschaftsfreiheit, das damit eine Politisierung einseitig den Vertreter*innen gesellschaftskritischer Ansätze zuschreibt, während es die eigene Position als ‚rein wissenschaftlich‘ und politisch neutral dargestellt. Demgegenüber schlägt der Artikel ein kritisches Verständnis von Wissenschaftsfreiheit vor, das seine Politizität reflektiert. Ausgehend von der Analyse, dass starre Macht- und Privilegienstrukturen das zentrale Hindernis für die gemeinsame Arbeit an (...) wissenschaftlicher Objektivität sind, geht es beim kritischen Begriff der Wissenschaftsfreiheit um die Reflexion und Transformation des Verhältnisses von Wissenschaft und Politik. Dabei steht die Diversifizierung von Zugangschancen und Standpunkten innerhalb der Wissenschaft im Mittelpunkt – also die Neuverteilung von Macht und Privilegien. Der Artikel entwickelt dieses Verständnis aus einer Diskussion des Verhältnisses von Wissenschaft und Politik in zwei philosophischen Begründungsmöglichkeiten der Wissenschaftsfreiheit und aus einer Rekonstruktion der kritischen politischen Theorie, insbesondere der foucaultschen Machttheorie und der feministischen Standpunkttheorie. Er zeigt auf dieser Grundlage, dass drei verschiedene Arten der Diversifizierung der Wissenschaft – intern, extern-institutionell und extern-aktivistisch –, die vom vor dem Hintergrund des negativen Begriffs als Einschränkung der Wissenschaftsfreiheit verstanden werden, tatsächlich zu ihrer Verbesserung beitragen. -/- . Plato’s view on pleasure in the Republic emerges in the course of developing the third proof of his central thesis that the just man is happier than the unjust. Plato presents it as the “greatest and most decisive” proof of his central thesis, so one might expect to find an abundance of scholarly work on it. Paradoxically, however, this argument has received little attention from scholars, and what has been written on it has generally been harshly critical. I believe that (...) this treatment of the argument has been unfair and that the relevant passages deserve a more careful and charitable interpretation. In this paper, I take up two serious charges that scholars have leveled against this proof, that it is inconsistent and that it involves a “fatal ambiguity”. I show that these charges result from misinterpreting Plato’s text, and I offer an alternative interpretation of the relevant passages. In doing so, I hope to shed some light on the complexities involved in Plato’s unappreciated third proof. (shrink)

(In German.) The book addresses Rawls's post-1985 political liberalism. His justification of political liberalism -- as reflected in his arguments from overlapping consensus -- faces the problem that liberal content can be justified as reciprocally acceptable only if the addressees of such a justification already endorse points of view that suitably support liberal ideas. Rawls responds to this legitimacy-theoretical problem by restricting public justification's scope to include reasonable people only, while implicitly defining reasonableness as a substantive liberal virtue. But this (...) virtue-ethical grounding of political liberalism is itself unreasonable. The phenomenon of disharmony of practical reason gives the reasonable reasons to take it that political legitimacy does not obtain if and where moral-political principles are acceptable from their point of view only. Aesthetic non-cognitivists deny that aesthetic statements express genuinely aesthetic beliefs and instead hold that they work primarily to express something non-cognitive, such as attitudes of approval or disapproval, or desire. Non-cognitivists deny that aesthetic statements express aesthetic beliefs because they deny that there are aesthetic features in the world for aesthetic beliefs to represent. Their assumption, shared by scientists and theorists of mind alike, was that language-users possess cognitive mechanisms with which to objectively grasp abstract rules fixed independently of human (...) responses, and that cognizers are thereby capable of grasping rules for the correct application of aesthetic concepts without relying on evaluation or enculturation. However, in this article I use Wittgenstein’s rule-following considerations to argue that psychological theories grounded upon this so-called objective model of rule-following fail to adequately account for concept acquisition and mastery. I argue that this is because linguistic enculturation, and the perceptual learning that’s often involved, influences and enables the mastery of aesthetic concepts. I argue that part of what’s involved in speaking aesthetically is to belong to a cultural practice of making sense of things aesthetically, and that it’s within a socio-linguistic community, and that community’s practices, that such aesthetic sense can be made intelligible. Adrian Piper argues that the Humean conception can be made to work only if it is placed in the context of a wider and genuinely universal conception of the self, whose origins are to be found in Kant’s Critique of Pure Reason. This conception comprises the basic canons of classical logic, which provide both a model of motivation and a model of rationality. These supply necessary conditions both for the coherence and integrity of the self and also for unified agency. (...) The Kantian conception solves certain intractable problems in decision theory by integrating it into classical predicate logic, and provides answers to longstanding controversies in metaethics concerning moral motivation, rational final ends, and moral justification that the Humean conception engenders. In addition, it sheds light on certain kinds of moral behavior – for example, the whistleblower – that the Humean conception is at a loss to explain. (shrink)

I examine Hume’s ‘construal of the basic structure of human agency’ and his ‘analysis of human agency’ as they arise in his investigation of causal power. Hume’s construal holds both that volition is separable from action and that the causal mechanism of voluntary action is incomprehensible. Hume’s analysis argues, on the basis of these two claims, that we cannot draw the concept of causal power from human agency. Some commentators suggest that Hume’s construal of human agency is untenable, unduly skeptical, (...) or uniquely entailed by the limits of empiricism. However, as I argue, these criticisms depend either on a misunderstanding of Hume’s analysis of human agency or on a neglect of the historical context of his view. (shrink)

PrEP (Pre-Exposure Prophylaxis) is a relatively new drug-based HIV prevention technique and an important means to lower the HIV risk of gay men who are especially vulnerable to HIV. From the perspective of biopolitics, PrEP inscribes itself in a larger trend of medicalization and the rise of pharmapower. This article reconstructs and evaluates contemporary literature on biopolitical theory as it applies to PrEP, by bringing it in a dialogue with a mapping of the political debate on PrEP. As PrEP changes (...) sexual norms and subjectification, for example condom use and its meaning for gay subjectivity, it is highly contested. The article shows that the debate on PrEP can be best described with the concepts ‘sexual-somatic ethics’ and ‘democratic biopolitics’, which I develop based on the biopolitical approach of Nikolas Rose and Paul Rabinow. In contrast, interpretations of PrEP which are following governmentality studies or Italian Theory amount to either farfetched or trivial positions on PrEP, when seen in light of the political debate. Furthermore, the article is a contribution to the scholarship on gay subjectivity, highlighting how homophobia and homonormativity haunts gay sex even in liberal environments, and how PrEP can serve as an entry point for the destigmatization of gay sexuality and transformation of gay subjectivity. ‘Biopolitical democratization’ entails making explicit how medical technology and health care relates to sexual subjectification and ethics, to strengthen the voice of (potential) PrEP users in health politics, and to renegotiate the profit and power of Big Pharma. Two decades ago, Rolf Landauer (1991) argued that “information is physical” and ought to have a role in the scientific analysis of reality comparable to that of matter, energy, space and time. This would also help to bridge the gap between biology and mathematics and physics. Although it can be argued that we are living in the ‘golden age’ of biology, both because of the great challenges posed by medicine and the environment and the significant advances that have been made—especially (...) in genetics and molecular and cell biology—we feel that information as an essential aspect of life has been neglected, or at least misunderstood. I argue that law is not best considered an essentially contested concept. After first explaining the notion of essential contestability and disaggregating the concept of law into several related concepts, I show that the most basic and general concept of law does not fit within the criteria generally offered for essential contestation. I then buttress this claim with the additional explanation that essential contestation is itself a framework for understanding complex concepts and therefore should only be applied when it is (...) useful to gain a greater understanding of uses of the concept to which it is applied (adducing criteria for making such judgments of usefulness). With that in mind, I then show that applying the appellation of essential contestation to the concept of law does not helpfully illuminate the most general concept of law (usually of most interest to legal philosophers) and therefore it should not be used, while allowing that it might be more useful for the related concept of the rule of law. PrEP (Pre-Exposure Prophylaxis) is a relatively new drug-based HIV prevention technique and an important means to lower the HIV risk of gay men who are especially vulnerable to HIV. From the perspective of biopolitics, PrEP inscribes itself in a larger trend of medicalization and the rise of pharmapower. This article reconstructs and evaluates contemporary literature on biopolitical theory as it applies to PrEP, by bringing it in a dialogue with a mapping of the political debate on PrEP. To fully respond to the demands of multiculturalism, a view of toleration would need to duly respect diversity both at the level of the application of principles of toleration and at the level of the justificatory foundations that a view of toleration may appeal to. The paper examines Rainer Forst’s post-Rawlsian, ‘reason-based’ attempt to provide a view of toleration that succeeds at these two levels and so allows us to tolerate tolerantly. His account turns on the view that a constructivist (...) requirement of generality and reciprocity provides a suitable criterion of toleration since a commitment to this requirement is part of what defines people as reasonable. But it is neither plausible nor coherent to build such a requirement into an idea of reasonableness from which an account of toleration starts. Thus, constructivism cannot provide a tolerant criterion of toleration, if such criterion, in order to overcome the ‘paradox’ of intolerant toleration, must escape reasonable disagreement. (shrink)

This paper analyses Nozick's possible-worlds model of utopia. It identifies and examines three arguments in favour of the minimal state: (1) the minimal state is the real-world analogue of the possible-worlds model and can hence be considered to be inspiring; (2) the minimal state is the common ground of all possible utopian conceptions and can hence be universally endorsed; and (3) the minimal state is the best or at least a very good means for approximating or achieving utopia. While constituting (...) fascinating lines of inquiry, all arguments are found to be wanting and unable to yield the conclusions that Nozick intended to establish. Nonetheless, they establish interesting and important results, in particular the result that the minimal state is the maximal institutional structure that is in principle compatible with the complete satisfaction of the maximal non-arbitrary set of preferences that are in principle co-satisfiable, as well as the corollary that in utopia any state will exert at most the functions of a minimal state. Die Debatte um die politische Differenz stellt Kontingenz und Konfliktualität als fundamentale Eigenschaften des Politischen heraus. Dies birgt ein Problem für die postfundamentalistische Demokratietheorie, die auf Augenhöhe mit dieser Debatte argumentieren will: Durch die Kontingentsetzung aller normativen Begründungen ist zunächst unklar, welche Art von demokratischen Institutionen wie begründet werden kann, und sogar, ob es überhaupt eine von der postfundamentalistischen Sozialontologie ausgehend argumentierende normative Begründung für demokratische Institutionen geben kann. Meine These ist, dass Freiheit, verstanden als kontinuierliche selbstreflexive Kritik, derjenige normative (...) Begriff ist, der sich aus der Sozialontologie von Konflikt und Kontingenz herleiten lässt. Anders gesagt: Freiheit als Kritik ist derjenige Universalismus, der sich aus der Ontologie des Partikularismus ableitet. Freiheit als Kritik kann dabei einerseits das Operieren einiger Institutionen in liberal-pluralistischen Demokratien beschreiben, und andererseits als radikaldemokratisch-normativer Kritikbegriff für die Analyse ihrer Dysfunktionalität dienen. Um diese These zu begründen, gehe ich zurück zu einem Theoretiker, der eine Grundlage der aktuellen Debatte um das Politische bildet: Foucault, dessen Machttheorie als Ansatz einer Sozialontologie der Kontingenz und Konfliktualität gelten kann. Gleichzeitig hat Foucault den Begriff der Freiheit als den zu dieser Ontologie passenden normativen Begriff herausgestellt. (shrink)

Kant identifies what are in fact Free Riders as the most noxious species of polemicists. Kant thinks polemic reduces the stature and authority of reason to a method of squabbling that destabilizes social equilibrium and portends disintegration into the Hobessian state of nature. In the first Critique, Kant proposes two textually related solutions to the Free Rider problem.

The central hypothesis of the collaboration between Language and Computing (L&C) and the Institute for Formal Ontology and Medical Information Science (IFOMIS) is that the methodology and conceptual rigor of a philosophically inspired formal ontology greatly benefits application ontologies. To this end r®, L&C’s ontology, which is designed to integrate and reason across various external databases simultaneously, has been submitted to the conceptual demands of IFOMIS’s Basic Formal Ontology (BFO). With this project we aim to move beyond the level of (...) controlled vocabularies to yield an ontology with the ability to support reasoning applications. Our general procedure has been the implementation of a meta-ontological definition space in which the definitions of all the concepts and relations in LinKBase® are standardized in a framework of first-order logic. In this paper we describe how this standardization has already led to an improvement in the LinKBase® structure that allows for a greater degree of internal coherence than ever before possible. We then show the use of this philosophical standardization for the purpose of mapping external databases to one another, using LinKBase® as translation hub, with a greater degree of success than possible hitherto. We demonstrate how this offers a genuine advance over other application ontologies that have not submitted themselves to the demands of philosophical scrutiny. LinKBase® is one of the world’s largest applications-oriented medical domain ontologies, and BFO is one of the world’s first philosophically driven reference ontologies. The collaboration of the two thus initiates a new phase in the quest to solve the so-called “Tower of Babel”. (shrink)

„Political Correctness“, „Identitätspolitik“ und „Cancel Culture“ werden heutzutage überwiegend als Waffen von Konservativen eingesetzt, um ihre Privilegien gegen emanzipative Neuregelungen zu verteidigen. Solche Neuregelungen als Einschränkung der Kunst- und Meinungsfreiheit zu kritisieren ist deshalb meist falsch. Tatsächlich tragen „Political Correctness“, „Identitätspolitik“ und „Cancel Culture“ zur inklusiveren Verwirklichung der Demokratie bei. Im Artikel zeige ich, dass es darauf ankommt, auf welcher Ebene politische Regulierungen der Kunst stattfinden: nicht-staatlich im allgemeinen Kunstbetrieb, para-staatlich im öffentlich-rechtlichen Rundfunk, oder staatlich. Nur wenn der Staat mit (...) zentralisierter rechtlicher, ökonomischer und symbolischer Macht in laufende Debatten eingreift, kann man von problematischer Cancel Culture sprechen - das ist fast nie der Fall. Right-wing intellectuals often invoke Nietzsche's concept of slave morality to underpin their criticism of 'political correctness' ('PC'). This interconnection of Nietzsche's slave morality and 'PC' criticism is correct, as a systematic analysis of their common elements shows, which leads to a new description of 'PC' criticism as a defense of privilege. In contrast to the right-wing Nietzschean 'PC' critique, the left-wing Nietzschean concept of a privilege-critical ‘political judgement' understands politics as a struggle for power, in which the space of the (...) political and related discourses are always already regulated and determine the conditions under which resources and privileges are distributed. Therefore, it is appropriate for an emancipatory position to critically question the established norms and to support political projects that aim to rewrite them. Because 'PC', as emancipative political judgement, dismantles privileges, its restricting of the privileged is not a side effect to be avoided but one of its reasonable core effects. Left-wing Nietzscheanism helps to avoid being surprised by right-wing aggression and to counter it vigorously by setting strict political norms. (shrink)

In der sozialphilosophischen Debatte um Freiheit bei Foucault wird das ‚Freiheitsproblem‘ verhandelt: Wie können Freiheit und Widerstand innerhalb von Foucaults Theorie der Macht und Subjektivierung konzipiert werden? Die Arbeit unterscheidet systematisch vier verschiedene Interpretationsstrategien von Foucaults Werk, die es als kohärente sozialphilosophische Theorie konstruieren und dabei das Freiheitsproblem lösen sollen; sie rekonstruiert die Arbeiten von exemplarischen Vertreter_innen dieser Strategien: 1. Foucault ist kohärent (Paul Patton), 2. Foucault korrigiert sich (Thomas Lemke), 3. Foucault kritisiert kohärent (Martin Saar), 4. Foucault ist nicht (...) genug (Amy Allen). Das erste Ziel der Arbeit ist, die Debatte und die in ihr verhandelten Probleme und Begriffe durch die systematische Rekonstruktion zu differenzieren und klarer zu fassen. Dafür werden einige neue systematische Unterscheidungen entwickelt: u.a. das Freiheitsproblem der Machtdetermination im Gegensatz zum Freiheitproblem der Subjektivierung, Freiheit als Anders-handeln-Können im Gegensatz zu Freiheit als Kritik, verschiedene Modalitäten dieser Freiheitsbegriffe und eine Foucault-Lesart der Regierungstranszendenz im Gegensatz zu einer Lesart der radikalen Immanenz. Das zweite Ziel der Arbeit ist die Entwicklung einer neuen These zur Freiheit im Rahmen einer Subjektivierungstheorie durch die interne Kritik der vier Interpretationsstrategien auf Grundlage der dort entwickelten Differenzierungen. Freiheit als die Fähigkeit zur reflexiven Kritik der eigenen Subjektivierung ‒ kurz: Freiheit als Kritik ‒ kann verstanden werden als das Resultat von freiheitlicher Subjektivierung, deren gesellschaftlicher Ort politische Institutionen sind, die im Rahmen einer postfundamentalen, pluralen und liberalen politischen Theorie bestimmt werden können. Drittens verfolgt die Arbeit das Ziel, durch den Begriff der Freiheit als Kritik die allgemeine sozialphilosophische Debatte um Freiheitsbegriffe zu erweitern und ihn als einen Kandidaten neben der negativen, reflexiven und sozialen Freiheit zu präsentieren, der einerseits plausible Einsichten dieser drei Ansätze aufnimmt und andererseits ihre blinden Flecken korrigiert.
