Wissenschaftsfreiheit wird vorherrschend als Freiheit der Wissenschaft von politischer Einmischung verstanden. Der Artikel kritisiert dieses negative Verständnis von Wissenschaftsfreiheit anhand einer Analyse seines prominentesten Vertreters, dem Netzwerk Wissenschaftsfreiheit, das damit eine Politisierung einseitig den Vertreter*innen gesellschaftskritischer Ansätze zuschreibt, während es die eigene Position als ‚rein wissenschaftlich‘ und politisch neutral dargestellt. Demgegenüber schlägt der Artikel ein kritisches Verständnis von Wissenschaftsfreiheit vor, das seine Politizität reflektiert. Ausgehend von der Analyse, dass starre Macht- und Privilegienstrukturen das zentrale Hindernis für die gemeinsame Arbeit an (...) wissenschaftlicher Objektivität sind, geht es beim kritischen Begriff der Wissenschaftsfreiheit um die Reflexion und Transformation des Verhältnisses von Wissenschaft und Politik. Dabei steht die Diversifizierung von Zugangschancen und Standpunkten innerhalb der Wissenschaft im Mittelpunkt – also die Neuverteilung von Macht und Privilegien. Der Artikel entwickelt dieses Verständnis aus einer Diskussion des Verhältnisses von Wissenschaft und Politik in zwei philosophischen Begründungsmöglichkeiten der Wissenschaftsfreiheit und aus einer Rekonstruktion der kritischen politischen Theorie, insbesondere der foucaultschen Machttheorie und der feministischen Standpunkttheorie. Er zeigt auf dieser Grundlage, dass drei verschiedene Arten der Diversifizierung der Wissenschaft – intern, extern-institutionell und extern-aktivistisch –, die vom vor dem Hintergrund des negativen Begriffs als Einschränkung der Wissenschaftsfreiheit verstanden werden, tatsächlich zu ihrer Verbesserung beitragen. This essay presents a novel approach to specifying the meaning of the concept of populism, on the political position it occupies and on the nature of populism. Employing analytic techniques of concept clarification and recent analytic ideology critique, it develops populism as a political kind in three steps. First, it descriptively specifies the stereotype of populist platforms as identified in extant research and thereby delimits the peculiar political position populism occupies in representative democracies as neither inclusionary nor fascist. Second, it (...) specifies on this basis analytically–normatively the particular stance towards liberal representative democracy (in particular towards popular sovereignty and democratic legitimacy) that unifies populism’s political position and explains how populist politics can be compelling for democratic citizens. The normative core (populist ideology) turns out to require no more than two general principles of legitimizing political authority by elections. Surprisingly, it does not need a separate anti-pluralist or exclusionary commitment: it entails it. Third, this normative model allows a response to a contested question in the theoretical discussion, namely, whether populism (properly specified) can be democracy-enhancing. The article defends the negative answer in virtue of the normative core alone and does so as much vis-à-vis a minimal (purely electoral) as vis-à-vis a normatively ambitious (liberal) conception of democracy. The reconstruction of the normative core of populist ideology enables a novel argument to show that populism is incompatible with the continued democratic legitimation of political authority even in the normatively most austere conception of ‘electoral democracy’, not just with ‘liberal democracy’. Assuming a normatively more ambitious concept of democratic legitimation in terms of political autonomy, the model also produces an extremely direct argument showing that populists cannot fulfil their promise of ‘taking back control’ over political decision-making to the population. Karsten Schubert liefert die erste systematische Rekonstruktion der sozialphilosophischen Debatte um Freiheit bei Foucault und eine neue Lösung für das Freiheitsproblem: Freiheit als die Fähigkeit zur reflexiven Kritik der eigenen Subjektivierung – kurz: Freiheit als Kritik – ist das Resultat von freiheitlicher Subjektivierung in politischen Institutionen. Der Band zeigt so die Konsequenzen von Foucaults Freiheitsdenken für die Demokratietheorie und die allgemeine sozialphilosophische Freiheitsdiskussion auf.

Foucault's theory of power and subjectification challenges common concepts of freedom in social philosophy and expands them through the concept of 'freedom as critique': Freedom can be defined as the capability to critically reflect one's own subjectification, and the conditions of possibility for this critical capacity lie in political and social institutions. The article develops this concept through a critical discussion of the standard response by Foucault interpreters to the standard objection that Foucault's thinking obscures freedom. The standard response interprets (...) Fou-cault's later works, especially The Subject and Power, as a solution to the problem of freedom. It is mistaken, because it conflates different concepts of freedom that are present in Foucault's work. By differentiating these concepts, this paper proposes a new institutionalist approach to solve the problem of freedom that breaks with the partly anarchist underpinnings of Foucault scholarship: As freedom as critique is not given, but itself a result of subjectification, it entails a demand for 'modal robustness' and must therefore be institutionalized. This approach helps to draw out the consequences of Foucault's thinking on freedom for postfoundationalist democratic theory and the general social-philosophical discussion on freedom. (shrink)

Nietzsche and Shaw are famous and infamous: famous for their innovative and influential forms of writing, but infamous for their apparent support of totalitarianism and Nazism. However, while it has long been shown that Nietzsche’s provocative language about “breeding” and “masters and slaves” was intended to enhance culture through competition, it is still an open question how and when Shaw supported biological eugenics. Via Nietzsche’s “philosophical breeding,” this article presents a new reading of Shaw’s Man and Superman: on the one (...) hand, it contrasts Nietzsche’s philosophical Übermensch with Shaw’s eugenic Superman; and on the other hand, it connects Nietzsche’s agonistic enhancement of culture with Shaw’s philosophical reflections in “Don Juan in Hell.” In contrast to Tanner’s support of eugenic breeding in his Revolutionist’s Handbook, Shaw’s Don Juan remarkably resembles Nietzsche’s notion of “philosophical breeding” toward a more competent, truthful, and autonomous orientation that is needed in increasingly complex global politics. Identity politics is commonly criticized as endangering democracy by undermining community, rational communication, and solidarity. Drawing on both radical democratic theory and standpoint theory, this article posits the opposite thesis: identity politics is pivotal for the democratization of democracy. Democratization through identity politics is achieved by disrupting hegemonic discourse and is, therefore, a matter of power, while such forms of power politics are reasonable when following minority standpoints generated through identity politics. The article develops this approach by connecting radical democratic (...) theories with standpoint theories and highlighting their commonalities and potential for mutual enhancement. Standpoint theory allows us to substantiate and reconcile two initially contradictory claims: particular minority standpoints are necessary to criticize the prevailing discursive and institutional orders, and these standpoints stem from intersubjective reason and embody ‘strong objectivity.’ This discussion presents a new perspective on the tension between particularity and universality, as well as the relationship between power and reason in democracy. Democratization is an oscillation between these polarities, and political theory should not aim to resolve this tension but to recognize and articulate it. Such recognition might involve elevating knowledge emerging from oppressed groups and exercising epistemic modesty when assessing specific forms of identity politics. (shrink)

This contribution focuses on three aspects of Nietzsche’s art of living that have become relevant today especially in the United States (but not only here): first, regarding some facets of the economic-political conditions of any contemporary art of living; second, the widespread adoption of Nietzsche’s notion of self-overcoming and artistic self-design in entrepreneurship and individual’s lives; and third, how his notion of ‘incorporation’ has been further developed in current approaches to habit design. Eventually I will show via the example of (...) Anthony Robbins that some notions of Nietzsche’s art of living have become most popular outside of academia, namely in the commercial industries of what has been called ‘self-growth’ or ‘self-development.’. It is a popular thought that emotions play an important epistemic role. Thus, a considerable number of philosophers find it compelling to suppose that emotions apprehend the value of objects and events in our surroundings. I refer to this view as the Epistemic View of emotion. In this paper, my concern is with a rivaling picture of emotion, which has so far received much less attention. On this account, emotions do not constitute a form of epistemic access to specific axiological (...) aspects of their objects. Instead it proposes that they are ways of taking a stand or position on the world. I refer to this as the Position-Taking View of emotion. Whilst some authors seem sympathetic to this view, this it has so far not been systematically motivated and elaborated. In this paper, I fill this gap and propose a more adequate account of our emotional engagement with the world than the predominant epistemic paradigm. I start by highlighting the specific way in which emotions are directed at something, which I contrast with the intentionality of perception and other forms of apprehension. I then go on to offer a specific account of the valence of emotion and show how this account and the directedness of emotions makes them intelligible as a way of taking a position on something. In den aktuellen Kulturkämpfen kritisieren Konservative Identitätspolitik und “Cancel Culture” als Einschränkungen von individueller Freiheit. Der Artikel untersucht die dabei zugrundeliegenden Freiheitsbegriffe. Die konservative Kritik stützt sich in der Regel auf einen negativen Begriff von Freiheit als Nichteinmischung im Sinne der liberalen Tradition. In der politischen Theorie wird ein solcher negativer Freiheitsbegriff als Gegensatz zur Auffassung von sozialer Freiheit gesehen, die Freiheit in hegelianischer und kommunitaristischer Tradition als ein gemeinschaftliches Unternehmen begreift. Der Artikel zeigt, dass beide Konzepte – trotz ihrer (...) philosophischen Gegensätze – in der zeitgenössischen konservativen Kritik an Identitätspolitik übereinstimmen und daher politisch kompatibel sind. Beide Freiheitsbegriffe kranken an einem falschen Universalismus. Im Gegensatz dazu hilft die radikaldemokratische Tradition, Freiheit partikularistisch zu verstehen. Dabei wird verständlich, dass Identitätspolitik nicht in erster Linie eine Einschränkung individueller Freiheit ist, sondern als Demokratisierung der Demokratie ein Beitrag zur Freiheit aller ist. I present three versions –Grimm, Offe and Streeck—of a general argument that is often used to establish that the EU-institutions meets a legitimacy-disabling condition, the so called “no demos” argument (II), embedding them in the context of the notorious “democratic deficit” suspicions against the legal system and practice of the EU (I). After examining the logical structure behind the no-demos intuition considered as an argument (III), I present principled reasons by Möllers and Habermas that show why the “no demos” argument (...) fails to have bite in discussions of the legitimacy and status of the supranational level in the multi-level EU-architecture. These are complemented by another principled reason arising from John Dewey’s conception of the “public” as a clearer alternative for the “popular” requirement of democratic legitimation (IV). I conclude that all three conceptions together suggest that the hunt after pre-politically existing peoples as foundations of democratic legitimacy expresses no more than methodological nationalism without any footing in the material and conceptual requirements of democratic legitimation. Given the absence of a principled problem with the legitimacy of the priority and interference of supranational EU-law in the national legal and political orders, there are thus also no principled reasons to abandon or discredit the European project in the absence of a European nation or society. This essay investigates, via the concepts of the philosophy of orientation, Annie Duke’s decision-making theory in "Thinking in Bets" and scrutinizes as to what extent one can universalize the 'orientation skill' of decision-making with regard to our everyday and professional life.

Goethe's objections to Newton's theory of light and colours are better than often acknowledged. You can accept the most important elements of these objections without disagreeing with Newton about light and colours. As I will argue, Goethe exposed a crucial weakness of Newton's methodological self-assessment. Newton believed that with the help of his prism experiments, he could prove that sunlight was composed of variously coloured rays of light. Goethe showed that this step from observation to theory is more problematic than (...) Newton wanted to admit. By insisting that the step to theory is not forced upon us by the phenomena, Goethe revealed our own free, creative contribution to theory construction. And Goethe's insight is surprisingly significant, because he correctly claimed that all of the results of Newton's prism experiments fit a theoretical alternative equally well. In this essay, I will suggest ways of improving on Davidson’s conception of the explanatory autonomy of folk psychological explanations. For that purpose, I will appeal to insights from the recent theory of mind debate emphasizing the centrality of various forms of empathy for our understanding of another person’s mindedness. While I will argue that we need to abandon Davidson’s position of anomalous monism, I will also show that my account is fully compatible with Davidson’s non-reductive and interpretationist account of (...) meaning and mental content. Indeed, my account does more justice to the empathic capacities underlying our interpretive capacities, which Davidson himself has to acknowledge in thinking about the constitutive features of thought and meaning. More specifically, I will propose a new way of philosophically safeguarding the causal-explanatory autonomy of our ordinary action explanations by showing how our empathic capacities are involved in epistemically delineating the domain of rational agency. Der Aufsatz leistet eine Rekonstruktion und interne Kritik der besten Interpretationsstrategien von Foucaults Werk, die die Lösung dieses Problems zum Ziel haben, und entwickelt dabei eine neue These: Freiheit als Fähigkeit zur reflexiven Kritik der eigenen Subjektivierung ist abhängig von freiheitlicher Subjektivierung durch politische Institutionen. Die Interpretationsstrategien werden systematisch unterschieden und anhand der Arbeiten exemplarischer (...) Vertreter_innen diskutiert: 1. Foucault ist kohärent, 2. Foucault korrigiert sich, 3. Foucault kritisiert kohärent, 4. Foucault ist nicht genug. Gegen Lemke wird argumentiert, dass Freiheit nicht durch eine anarchistische, sondern nur durch eine institutionalistische Foucault-Lesart bestimmt werden kann. Mit Saar wird gezeigt, dass das Ziel einer eindeutigen Definition von Freiheit im Gegensatz zur Methode der genealogischen Kritik steht und nur im Rahmen der normativen politischen Theorie verfolgt werden kann. In Auseinandersetzung mit Allen wird argumentiert, dass Freiheit nicht in linken Bewegungen verortet werden kann, sondern nur in demokratischen Institutionen. (shrink)

Solche Neuregelungen als Einschränkung der Kunst- und Meinungsfreiheit zu kritisieren ist deshalb meist falsch. Tatsächlich tragen „Political Correctness“, „Identitätspolitik“ und „Cancel Culture“ zur inklusiveren Verwirklichung der Demokratie bei. Im Artikel zeige ich, dass es darauf ankommt, auf welcher Ebene politische Regulierungen der Kunst stattfinden: nicht-staatlich im allgemeinen Kunstbetrieb, para-staatlich im öffentlich-rechtlichen Rundfunk, oder staatlich. Nur wenn der Staat mit (...) zentralisierter rechtlicher, ökonomischer und symbolischer Macht in laufende Debatten eingreift, kann man von problematischer Cancel Culture sprechen - das ist fast nie der Fall. While ‘cancel culture’ is commonly regarded as limiting freedom of speech and artistic freedom, this article proposes a new understanding of ‘cancel culture’ as emancipatory norm-setting that is key for democratization. On a non-governmental level of the self-regulation of the art world, the argument for artistic freedom ignores the fact that art is permeated by power. The introduction of ‘politically correct’ norms leads to a justified redistribution of such power. On a parastatal level of public broadcasting and state cultural funding, (...) neutrality is necessary but should be understood materially to include marginalized voices. Restrictions of freedom of speech and artistic freedom do occur on the state-level of hate-speech regulation. Here, the danger of a potential shift from emancipatory regulation to a harmful restriction is particularly virulent, as a discussion of the German BDS ban shows. (shrink)

Identity politics is subject to similar critiques in contemporary public debate and political theory. A central topos of this critique is that identity politics is essentializing: it fixes subjects to their social position and resorts to a politics of particularity that leads to divisions in national citizenship and democratic discourse (the communitarian and liberal position) and to divisions within social movements (the critical position). Contrary to this one-sided critique, we propose a different interpretation with the concept of “constructivist identity politics.” (...) We show that political identities are not essentialistically given, but emerge from processes of social and political construction; that they are actively produced, learned, and practiced by political (sub)cultures and movements. In these processes of construction, political articulation and agency are produced, enabling subjects to critique relations of domination and discrimination. Following radical democratic theory, we argue that the particular political perspectives of identity politics thus enabled do not endanger democracy or solidarity in social movements, but contribute to their further democratization by actualizing the universal principles of democracy in particular disputes. While the construction processes of identity politics tend to essentialize and produce exclusions, critical reflection on such tendencies is also inherent to identity politics. This understanding also enables a critique of such identity politics that is not oriented towards the democratic values of equality and freedom and blocks critical self-reflection. After an overview of contemporary identity politics critique, we elaborate this constructivist understanding following debates in feminist and postcolonial theory since the 1980s. Building on this, we systematically develop the notion of constructivist identity politics by differentiating three aspects of it: subjectification, articulation, and representation. We refer to approaches by Foucault, Rancière, Laclau/Mouffe, and Hall and illustrate the respective aspects through examples of migrant self-organizations as well as gay culture and queer critique. Die Debatte um die politische Differenz stellt Kontingenz und Konfliktualität als fundamentale Eigenschaften des Politischen heraus. Dies birgt ein Problem für die postfundamentalistische Demokratietheorie, die auf Augenhöhe mit dieser Debatte argumentieren will: Durch die Kontingentsetzung aller normativen Begründungen ist zunächst unklar, welche Art von demokratischen Institutionen wie begründet werden kann, und sogar, ob es überhaupt eine von der postfundamentalistischen Sozialontologie ausgehend argumentierende normative Begründung für demokratische Institutionen geben kann. Meine These ist, dass Freiheit, verstanden als kontinuierliche selbstreflexive Kritik, derjenige normative (...) Begriff ist, der sich aus der Sozialontologie von Konflikt und Kontingenz herleiten lässt. Anders gesagt: Freiheit als Kritik ist derjenige Universalismus, der sich aus der Ontologie des Partikularismus ableitet. Freiheit als Kritik kann dabei einerseits das Operieren einiger Institutionen in liberal-pluralistischen Demokratien beschreiben, und andererseits als radikaldemokratisch-normativer Kritikbegriff für die Analyse ihrer Dysfunktionalität dienen. Um diese These zu begründen, gehe ich zurück zu einem Theoretiker, der eine Grundlage der aktuellen Debatte um das Politische bildet: Foucault, dessen Machttheorie als Ansatz einer Sozialontologie der Kontingenz und Konfliktualität gelten kann. Gleichzeitig hat Foucault den Begriff der Freiheit als den zu dieser Ontologie passenden normativen Begriff herausgestellt. (shrink)

Gay men have been severely affected by the AIDS crisis, and gay subjectivity, sexual ethics, and politics continue to be deeply influenced by HIV to this day. PrEP (Pre-Exposure Prophylaxis) is a new, drug-based HIV prevention technique, that allows disentangling gay sex from its widespread, 40 yearlong association with illness and death. This article explores PrEP's fundamental impact on gay subjectivity, sexual ethics, and politics. It traces the genealogy of gay politics regarding homophobia and HIV stigma, suggesting a new biopolitical (...) and body political framework that accounts for the agency of activists as well as pharmapower, and proposing that PrEP is an example of democratic biopolitics. Highlighting the entanglement of medical technology, sexual ethics, and politics, the article shows how conservative and homonormative gay politics developed as a reaction to HIV stigma and how, by overcoming this stigma, PrEP enables a new era of intersectional queer politics and solidarities. It thereby develops a Foucauldian account of sexual liberation beyond the repression hypothesis that accounts for the ambivalence of sexual subjectification and the political potential of sexuality. One problem often associated with identity politics is “positional fundamentalism,” the equating of social positions with epistemic possibilities and political dispositions. The criticism is that identity politics is usually more about who says something than what is said. This goes hand in hand with perspective relativity, which no longer allows for a common, universal position and therefore also prevents emancipative politics. To respond to this critique of positional fundamentalism and perspective relativism, I develop a new account of identity politics as (...) inherently intersubjective and fundamental to democracy. This approach is necessary to address the philosophical problem at the heart of debates about identity politics: the tension between particularist power politics, on the one hand, and politics as a universalist appeal to reason, on the other. Right-wing intellectuals often invoke Nietzsche's concept of slave morality to underpin their criticism of 'political correctness' ('PC'). This interconnection of Nietzsche's slave morality and 'PC' criticism is correct, as a systematic analysis of their common elements shows, which leads to a new description of 'PC' criticism as a defense of privilege. In contrast to the right-wing Nietzschean 'PC' critique, the left-wing Nietzschean concept of a privilege-critical ‘political judgement' understands politics as a struggle for power, in which the space of the (...) political and related discourses are always already regulated and determine the conditions under which resources and privileges are distributed. Therefore, it is appropriate for an emancipatory position to critically question the established norms and to support political projects that aim to rewrite them. Because 'PC', as emancipative political judgement, dismantles privileges, its restricting of the privileged is not a side effect to be avoided but one of its reasonable core effects. Left-wing Nietzscheanism helps to avoid being surprised by right-wing aggression and to counter it vigorously by setting strict political norms. (shrink)

Wie Herrschaft kritisieren, wenn Kategorien wie Staat, Souveränität und Demokratie nicht mehr funktionieren? Der Regimebegriff verspricht einen Ausweg aus diesem praktischen wie theoretischen Dilemma. Er soll nicht nur helfen, Macht und Herrschaft besser zu verstehen, sondern auch eine neue Grundlage für tiefere und radikalere Gesellschaftskritik bieten: Das Denken in Regimen bezieht Denk- und Wahrnehmungsmuster in die Analyse und Kritik von gesellschaftlichen Strukturen, (politischer) Macht und alltäglichen Normen und Praxen ein. Kurz: Regimeanalysen helfen uns zu sehen, was sonst unsichtbar bliebe, wie (...) etwa die rassistische Regulierung von Migration, die Normierung von Geschlechterverhältnissen oder die Neoliberalisierung von Universitäten. Es wundert nicht, dass ein Begriff, mit dem solch verschiedene Phänomene beschrieben werden können, »sehr weitläufig und oft ungenau und spekulativ« ist. Die AutorInnen aus dem Umfeld der Wiener Akademie der Künste führen deshalb in ihren Buchbeiträgen zunächst in die unterschiedlichen Regimebegriffe ein und möchten untersuchen, »welchen diskursiven und politischen Gewinn er verspricht und tatsächlich bringt.«. The challenge of developing humane migration and refugee politics in Western states is far from resolved. This ongoing failure is typically attributed to the increased influence of right-wing populism and neo-fascism in Western migration politics. In this article I discuss a more radical explanation: Christoph Menke argues that political liberalism and its framing of migration as an issue of subjective human rights is the deeper root of the problem. While the merit of Menke’s approach is its criticism of subjectification through (...) individual rights that blocks politics, I show that his Critique of Rights may lead to an anti-pluralist and paternalistic ‘radical republicanism’. To react to this problem, I propose a ‘reflective liberalism’ that allows to criticise subjectification without abandoning the form of individual rights. This position, which I develop through a discussion of Foucault’s concept of ‘freedom as critique’, shows that in addition to protecting minorities such as migrants, individual rights turn out to be part of a regime of critical subjectification that constitutes critical subjects. Such critical subjectification by law can help to break through the blockade of politics that prevent the development of humane migration and refugee politics. (shrink)

Ziel dieses Papiers ist es die Ordnungsethik – einen bereichsethischen Ansatz, der derzeit vor allem für wirtschaftsethische Fragestellungen benutzt wird – als eine universelle Methode zur Analyse von bereichsethischen Fragestellungen vorzustellen. Um das Vorhaben handhabbar zu machen, muss es in zweierlei Hinsicht eingeschränkt werden. Zum einen kann es sich hier natürlich nicht um eine voll ausgearbeitete Methodologie für die Analyse von bereichsethischen Fragestellungen handeln, sondern nur um eine methodische Skizze. Zum anderen soll es in diesem Papier im Wesentlichen um solche (...) bereichsethischen Fragestellungen gehen, deren Lösung die Implementierung von formellen wie informellen Regeln erfordert. The focus of this article is on the pragmatic presuppositions involved in the use of general terms in inductive practices. The main thesis is that the problem of characterizing the assumptions underlying the projection of predicates in inductive practices and the ones underlying the classification of crtain general terms as «natural kind terms» coincide to a good extent. The reason for this, it is argued, is that both classifications, «projectibility» and «natural kind term», are attempts to answer to the same (...) semantico-epistemological phenomenon, viz. underdertermination. It is proposed a «deflationary» reading of the so-called «theory of direct reference» as to enable an evaluation of its contribution to epistemological problems associated with this kind of phenomena, as well as it is argued that a purely de facto account of projectibility is not viable. The resulting hypothesis is that the conception of «natural kind terms» is only interesting insofar as they are seen as a kind of projectible general terms and thus as parts of classifications used in natural science, more generally, in inductive practices, and that this is a perspective that makes undue metaphysical readings avoidable. Für ein Gespräch über die Themen Political Correctness, Identitätspolitik, Streitkultur und die Rolle der politischen Bildung kamen im Juli 2021 Saba-Nur Cheema von der Bildungsstätte Anne Frank und Dr. Karsten Schubert von der Universität Freiburg in einem Zoom-Raum zusammen. Die Fragen stellten Prof. Dr. Beate Rosenzweig und Petra Barz, beide Mitglieder im Redaktionsbeirat der "Außerschulischen Bildung". PrEP (Pre-Exposure Prophylaxis) is a relatively new drug-based HIV prevention technique and an important means to lower the HIV risk of gay men who are especially vulnerable to HIV. From the perspective of biopolitics, PrEP inscribes itself in a larger trend of medicalization and the rise of pharmapower. This article reconstructs and evaluates contemporary literature on biopolitical theory as it applies to PrEP, by bringing it in a dialogue with a mapping of the political debate on PrEP. As PrEP changes (...) sexual norms and subjectification, for example condom use and its meaning for gay subjectivity, it is highly contested. The article shows that the debate on PrEP can be best described with the concepts ‘sexual-somatic ethics’ and ‘democratic biopolitics’, which I develop based on the biopolitical approach of Nikolas Rose and Paul Rabinow. In contrast, interpretations of PrEP which are following governmentality studies or Italian Theory amount to either farfetched or trivial positions on PrEP, when seen in light of the political debate. Furthermore, the article is a contribution to the scholarship on gay subjectivity, highlighting how homophobia and homonormativity haunts gay sex even in liberal environments, and how PrEP can serve as an entry point for the destigmatization of gay sexuality and transformation of gay subjectivity. ‘Biopolitical democratization’ entails making explicit how medical technology and health care relates to sexual subjectification and ethics, to strengthen the voice of (potential) PrEP users in health politics, and to renegotiate the profit and power of Big Pharma. This article analyzes whether Brandom’s ISA (inferential-substitutional-anaphoric) semantics as presented in Making It Explicit (MIE) and Articulating Reasons (AR) can cope with problems resulting from inferentialism’s near-implied meaning holism. Inferentialism and meaning holism entail a radically perspectival conception of content as significance for an individual speaker. Since thereby its basis is fixed as idiolects, holistic inferentialism engenders a communication-problem. Brandom considers the systematic difference in information among individuals as the „point“ of communication and thus doesn’t want to diminish these effects (...) of inferentialism. Instead, explains communication with a model of “navigating among perspectives without sharing contents”. The crucial element in this navigation-model is the functioning of anaphoric connections between tokens uttered in discourse that can be used by every individual speaker in their own perspectival semantic substitution-economies. The heart of Brandom’s semantics is the thesis of the purely inferential, hence non-referential nature of anaphora, coupled with the claim that anaphoric-inferential semantic mechanisms yield sufficient conditions for mutually successful “information-extraction” or interpretation. This article disputes the thesis and denies the claim. Regarding the former it is observed that all of Brandom’s plausible reconstructions of anaphoric discourse-structures rely on covert “reference-infiltrations” that can’t be eliminated. Regarding the latter, a new argument based on context-sensitive semantic phenomena in anaphoric settings shows that the crucial distinction between initiator or anaphoric antecedent and anaphoric dependent cannot be drawn according to Brandom’s own premises without overt and irreducible referential premises. The article concludes that either Brandom’s semantics can offer determinate contents, but then must accept genuinely referential semantic primitives, or else it leaves utterance-contents undeterminable and hence cannot explain communication. In der postmarxistischen politischen Philosophie wird die Veränderung gegenüber der Verstetigung analytisch und normativ bevorzugt. Deshalbleistet die postmarxistische Theorie keine realistische Analyse und normativ-differenzierende Bewertung von politischen Institutionen, insbesondere des Rechts. Der Beitrag liefert einen Ansatz, um diese Lücke zu schließen, indem er der Abblendung von institutionellen Fragen mit einer neuen postfundamentalistischen Institutionentheorie begegnet. Diese Theorie basiert auf dem Freiheitsbegriff der Kritik, der im Anschluss an Foucault entwickelt wird und zeigt, dass kritischer Subjektivität durch die Institutionalisierung von freiheitlichen Subjektivierungsregimen bedingt (...) ist. Dieser Freiheitsbegriff korrigiert den avanciertesten Ansatz der postmarxistischen Rechtstheorie, Menkes Rechtskritik. Deren Stärke ist es,die liberal entpolitisierende Subjektivierung des Rechts zu kritisieren, doch Menkes Vorschlag einer radikalen Politisierung ist paternalistisch. Mit Foucault lässt sich hingegen ein Recht denken, das Subjektivierung kritisiert und dennoch nicht paternalistisch ist, weil es die Subjekte zur Kritik der Institutionen befähigt. (shrink)

"Biopolitics" has become a popular concept for interpreting the COVID-19 pandemic, yet the term is often used vaguely, as a buzzword, and therefore loses its specificity and relevance. This article systematically explains what the biopolitical lens offers for analyzing and normatively criticizing the politics of the coronavirus. I argue that biopolitics are politics of differentiated vulnerability that are intrinsic to capitalist modernity. The situation resulting from the COVID-19 pandemic is, therefore, less of a state of exception than it might appear; (...) COVID-19 is a continuation and intensification of the capitalist biopolitics of differentiated vulnerability. In order to critically evaluate this situation, the article proposes the concept of "democratic biopolitics" and shows how it can be used, among others, for a queer critique of the differentiated vulnerabilities that are produced by the coronavirus and its capitalist governance. In contrast to widespread interpretations of democratic biopolitics that focus on collective care in communities, this article highlights the role of the state and of the redistribution of political power and economic resources as key for biopolitical democratization. PrEP (Präexpositionsprophylaxe) ist ein relativ neues Mittel zur Prävention von HIV-Infektionen. HIV-negative Menschen nehmen antivirale Medikamente ein, die verhindern, dass der Kontakt mit dem Virus zu einer Infektion führt. Im Gegensatz zum Kondomgebrauch basiert dieses Präventionsverfahren auf Medikamenten und nicht auf einer Verhaltensänderung. Aus der Perspektive der Biopolitik fügt sie sich in einen größeren Trend in Richtung Medikalisierung, des Anstiegs der Macht der Pharmaindustrie und der Reglementierung des Risikos ein. Sexuelles Verhalten ist das Ergebnis der Subjektivierung, des Prozesses, durch den (...) soziale Normen Subjekte und ihre Wünsche bilden. Die Medikalisierung von schwulem Sex durch PrEP verändert die sexuelle Subjektivierung und geht daher mit einer Veränderung der Praktiken von schwulem Sex einher. Nach einer kurzen Erläuterung der medizinischen Besonderheiten und der Geschichte von PrEP (1) vereint dieser Artikel eine Rekonstruktion zeitgenössischer theoretischer Ansätze zur Biopolitik im Zusammenhang mit PrEP (2) mit einer Darstellung aktueller politischer Debatten um PrEP (3). Die Untersuchung zeigt, dass sich Gouvernementalitätsstudien und die Italienische Theorie auf repressive Machtverhältnisse konzentrieren und daher die Komplexität der Debatte nicht berücksichtigen können, die sich aus der Subjektivität und Handlungsfähigkeit verschiedener beteiligter Akteure, insbesondere schwuler PrEP-Aktivisten, ergibt. Dennoch werden Interpretationen von PrEP als repressiver Macht auch von einigen Akteuren in der politischen Debatte um PrEP genutzt, meist ohne ausdrücklichen Bezug zur biopolitischen Theorie. Nikolas Roses und Paul Rabinows differenziertes Konzept der Biopolitik bietet einige Ansätze wie diejenigen der biopolitischen Bürgerschaft und der somatischen Ethik, um die Debatte um PrEP und die damit verbundenen komplexen Verhandlungen über Sexualität zu beschreiben. Ausgehend von diesen Ideen entwickle ich ein neues Konzept der ‚demokratischen Biopolitik‘ von PrEP, die eine weitere Demokratisierung der Sexualität im biopolitischen Zeitalter ermöglicht. (shrink)

Foucault bildet eine zentrale Grundlage der queeren und schwulen Theorie, die sich seit den späten 1980er Jahren insbesondere in den USA entwickelt hat. Seine Macht- und Subjekttheorie ist die Basis für eine nicht- essentialistische Analyse von Sexualität und für die Kritik ihrer normierenden Wirkung, die Foucault selbst in Der Wille zum Wissen (1983, frz. 1976) begonnen hat und die das Kerngeschäft der Queertheorie ist. Während Foucault als Grundlage der Queertheorie insgesamt rezipiert wird, gibt es eine spezifisch schwule Rezeption von Foucault, (...) die an seine vielfältigen Äußerungen zur schwulen Politik anschließt und dessen Machtanalyse und seine späteren Arbeiten zur Ästhetik der Existenz mobilisiert, um damit das schwule Leben vor, während und nach der AIDS-Krise zu analysieren. Associação Nacional de Pós-Graduação em Filosofia - ANPOF. Um dos problemas mais duradouros na discussão sobre Foucault tem sido o problema da liberdade. Mais precisamente, a questão é a seguinte: como a liberdade e a resistência podem ser pensadas e explicadas em uma teoria do poder e da subjetivação? Abordarei esse problema não falando sobre o próprio Foucault, oferecendo uma nova interpretação dos seus escritos, por exemplo. Em vez disso, sustento que o problema pode ser abordado apenas nos detendo sobre (...) o debate sócio-filosófico desencadeado por suas obras. O problema da liberdade não tem origem em Foucault, mas foi antes articulado nas discussões de sua obra por teóricos da política. Essas interpretações, mediante a construção do problema, vão além da mera exegese. São obras filosóficas elas mesmas complexas e enquanto tais são o principal objeto da minha análise. (shrink)

Die Veröffentlichung von Foucaults viertem Band der Geschichte der Sexualität, Die Geständnisse des Fleisches, wurde von der Foucault-Community und der interessierten Öffentlichkeit gespannt erwartet. Vom lange unter Verschluss gehaltenen Band erhofft sich die Leser_innenschaft neue Erkenntnisse nicht nur zum Thema des Buches – die Reflexionen der Kirchenväter bis Augustinus zu Sexualität und Lebensführung –, sondern zu Foucaults Werk im Allgemeinen und den großen Fragen nach Macht, Freiheit und Kritik, die dessen Rezeption bestimmen. Und tatsächlich bietet der Band überraschend neue Einsichten, (...) in deren Lichte sich die herrschende Meinung zu Foucaults Freiheits- und Kritikbegriff als falsch herausstellt. Heute ist die These verbreitet, dass Foucaults Arbeiten zur antiken Ethik und parrhesia als Beitrag zu einem normativen Freiheitsbegriff gewertet werden können. Dagegen zeigt Die Geständnisse des Fleisches, dass die für Foucault und unsere Gegenwart relevante Freiheit, die Fähigkeit zur reflexiven Selbst- und Machtkritik, ihren Ursprung in den Subjektivierungen des frühen Christentums hat, das Subjektivität zum ersten Mal an kritische Machtreflexion koppelt. Finally published 34 years after his death, Foucault's book Confessions of the Flesh sheds new light on the debate about freedom and power that shaped the reception of his works. Many contributors to this debate argue that Foucault's theory of power did not allow for freedom in the 'genealogical phase,' but that he corrected himself and presented a solution to the problem of freedom in his later works, especially through his reflection on ancient ethics and technologies of the self in (...) volumes two and three of History of Sexuality, as well as the concept of parrhesia. In contrast to this view, I argue that Confessions of the Flesh shows that a concept of freedom as self-critical hermeneutics that aims at identifying a foreign power within the subject was only developed in Foucault's analysis of Christian practices of penance and confession. This interpretation of Confessions of the Flesh opens a new field of inquiry into the genealogy of critique and both the repressive and emancipative effects of truth-telling and juridification. Der Bund-Länder-Beschluss zu Weihnachten erlaubt „Treffen mit 4 über den eigenen Hausstand hinausgehenden Personen“, aber nur bezüglich Mitglieder des „engsten Familienkreis[es], also Ehegatten, Lebenspartnern und Partnern einer nichtehelichen Lebensgemeinschaft sowie Verwandten in gerader Linie, Geschwistern, Geschwisterkindern und deren jeweiligen Haushaltsangehörigen.“ Obwohl es bei diesen Regelungen gar nicht um die sexuelle Orientierung oder Geschlechtsidentität der Personen geht, sind sie dennoch heteronormativ, bevorteilen also solche Lebensformen, die nach den Normen klassischer heterosexueller Beziehungsmodelle funktionieren. Oder andersherum gesagt: Sie benachteiligen zwar Singles und Menschen (...) ohne klassische Familie unabhänging davon, ob sie hetero, schwul, lesbisch, trans* oder non-binary sind, aber sie werten darüber hinaus queere Lebensformen ab. Die Debatte um die politische Differenz stellt Kontingenz und Konfliktualität als fundamentale Eigenschaften des Politischen heraus. Dies stellt die postfundamentalistische Demokratietheorie, die auf Augenhöhe mit dieser Debatte argumentieren will, vor ein Problem: Durch die Kontingentsetzung aller normativen Begründungen ist zunächst unklar, welche Art von demokratischen Institutionen wie begründet werden kann, und sogar, ob es überhaupt eine von der postfundamentalistischen Sozialontologie ausgehend argumentierende normative Begründung für demokratische Institutionen geben kann. Meine These ist, dass Freiheit, verstanden als kontinuierliche selbstreflexive Kritik, derjenige normative (...) Begriff ist, der sich aus der Sozialontologie von Konflikt und Kontingenz herleiten lässt. Anders gesagt: Freiheit als Kritik ist derjenige Universalismus, der sich aus der Ontologie des Partikularismus ableitet. Freiheit als Kritik kann dabei einerseits das Operieren einiger Institutionen in liberal-pluralistischen Demokratien beschreiben, und andererseits als normativer Kritikbegriff für die Analyse ihrer Dysfunktionalität dienen. Um diese These zu begründen, gehe ich zurück zu einem Theoretiker, der eine Grundlage der aktuellen Debatte um das Politische bildet: Foucault, dessen Machttheorie als Ansatz einer Sozialontologie der Kontingenz und Konfliktualität gelten kann. Gleichzeitig hat Foucault den Begriff der Freiheit als den zu dieser Ontologie passenden normativen Begriff herausgestellt. Durch eine Rekonstruktion und Kritik der sozialphilosophischen Debatte um Freiheit in Foucaults Werk lässt sich der Begriff der Freiheit als Kritik systematisch bestimmen. So kann – mit Foucault gegen Foucault – gezeigt werden, dass er nur innerhalb einer pluralistischen und liberalen Demokratietheorie gedacht werden kann. (shrink)

The Yogyakarta Principles for the application of human rights to sexual orientation and gender identity define gender identity as “each person’s deeply felt internal and individual experience of gender, which may or may not correspond with the sex assigned at birth, including the personal sense of the body and other expressions of gender, including dress, speech, and mannerisms.” This definition and its acknowledgment within human rights politics is a key step in the fight of trans people for legal protection. Our (...) aim is to analyze this definition both historically and systematically to find out how the Western liberal conception of rights fosters specific trans politics and limits the options for others. Specifically, we claim that political liberalism and the form of subjective rights that it brings about influence concepts of identity and political strategies. While we analyze the limits of the liberal framework, our aim is to think about how it is possible that even within this framework, non-normative bodies and queer identities can be acknowledged and supported through law. Academic freedom is under attack, both in authoritarian democracies, such as Hungary and Turkey, and in liberal Western democracies, such as the United States, the UK, France and Germany. For example, Gender Studies are being targeted by right-wing governments in Eastern Europe, and in France President Emmanuel Macron has attacked post-colonial and critical theories as “Islamo-gauchisme“, portraying them as a danger to the Republic. However, dominant discourses about academic freedom and free speech in the global north, lately especially in France (...) and Germany, focus on an alleged threat to academic freedom through “political correctness” and “cancel culture”, that, under scrutiny, often turn out to be exactly the opposite, namely defences of plurality and critical voices. Ein Grundprinzip der Demokratie ist die Gleichheit der Bürger_innen. Das Prinzip der Gleichheit ist zentral für demokratische Repräsentation. Es bedeutet, dass die Stimmen der Bürger_innen gleich viel zählen und dass ihre Interessen durch Repräsentant_innen möglichst gut abgebildet und vertreten werden. Es gilt sowohl für formale Repräsentation in den poli- tischen Institutionen, insbesondere bei Wahlen, als auch für sogenannte informelle Repräsentationsverhältnisse in der Öffentlichkeit, Kultur und Wissenschaft. Doch die real existierende Demokratie ist vom Ideal der Gleichheit weit entfernt. Sie ist asymmetrisch (...) und exkludierend. Die Stim- men privilegierter Menschen sind überrepräsentiert, während die Stimmen von diskriminierten Menschen unterrepräsentiert oder sogar ganz ausge- schlossen sind. (shrink)

Bericht zur Tagung "Jenseits der Person. Die Subjektivierung kollektiver Subjekte" an der Universität Leipzig, 6.–8. April 2016.

Identitätspolitik ist die politische Praxis von marginalisierten und diskriminierten Gruppen, die sich in Bezug auf eine kollektive Identität gegen ihre Benachteiligung durch Strukturen, Kulturen und Normen der Mehrheitsgesellschaft wehren. Ein oft an Identitätspolitik kritisiertes Problem ist „positionaler Fundamentalismus“ (Villa Braslavsky 2020, S. 74), also das Gleichsetzen sozialer Positionen mit epistemischen Möglichkeiten und politischen Einstellungen. Die Kritik lautet, bei Identitätspolitik käme es meist mehr darauf an, wer etwas sagt, als was gesagt wird. Dies gehe mit Relativismus einher, der keine gemeinsame, universelle (...) Position mehr ermögliche und deshalb auch emanzipative Politik verhindere (Feddersen/Gessler 2021, S. 101ff., 208f.). Um auf diese Kritik des positionalen Fundamentalismus und Relativismus zu antworten, entwickle ich eine neue Darstellung der Identitätspolitik als inhärent intersubjektiv und grundlegend für die Demokratie. Dabei stütze ich mich auf die radikale Demokratietheorie und die feministische Standpunkttheorie. Dieser Ansatz ist notwendig, um das philosophische Problem zu lösen, das im Mittelpunkt der Debatten über Identitätspolitik steht: die Spannung zwischen partikularistischer Machtpolitik einerseits und Politik als universalistischer Appell an die Vernunft andererseits.
