During the 19th and the 20th century the concept of system undergoes significant transformations. The interplay of biology and sociology gives rise to an olistic definition of the concept, in order to understand society by means of schemes developed in the field of theoris of organisms. It is possible to follow this development from Pareto and Henderson, to Parsons, and finally to Luhmann, by examining the various biological models to which they refer.

Usually regarded as a 1970s phenomenon, this article demonstrates that the debate between Jürgen Habermas and Niklas Luhmann continued until Luhmann’s death in 1998, and that the development of the two theorists’ positions during the 1980s and 1990s was characterised by convergence rather than by divergence. In the realm of legal theory, the article suggests, convergence advanced to the extent that Habermas’ discourse theory may be characterised as a normative superstructure to Luhmann’s descriptive theory of society. It (...) is further shown that the debate’s result was an almost complete absorption of Habermas’ theory by Luhmann’s systems theoretical complex – an outcome facilitated by Luhmann’s deliberate translation of central Habermasian concepts into systems theoretical concepts. The article argues that both the debate and Habermas’ conversion were made possible because not only Habermas’ but also Luhmann’s work can be considered a further development of the German idealist tradition. What Luhmann did not acknowledge was that this manoeuvre permitted the achievement of Habermas’ normative objectives; nor did he notice that it could eradicate a central flaw in the system theoretical construction, by allowing the context within which distinctions are drawn to be mapped – an issue of pivotal importance for grasping relationships between different social systems, and coordinating them, via the deployment of legal instruments. Habituellement considéré comme un phénomène des années 1970, le débat entre Jürgen Habermas et Niklas Luhmann s’est en réalité poursuivi jusqu’à la mort de Luhmann, en 1998 ; et l’évolution des positions des deux théoriciens au cours des années 1980 et 1990 s’est caractérisée par une convergence, plutôt que par une divergence. Dans le domaine de la théorie du droit, suggère cet article, la convergence a progressé dans la mesure où la théorie de la discussion (Diskursetheorie) d’Habermas peut (...) se caractériser comme une superstructure normative au regard de la théorie descriptive de la société formulée par Luhmann. De plus, le résultat du débat a été une absorption presque complète de la théorie habermassienne par le complexe de la théorie des systèmes de Luhmann – issue facilitée par le fait que ce dernier a délibérément traduit les concepts habermassiens centraux dans les concepts de la théorie des systèmes. Le débat et la conversion d’Habermas ont été possibles parce que le travail de celui-ci mais aussi celui de Luhmann peuvent être considérés comme un fruit de la tradition idéaliste allemande. Luhmann n’a pas vu que cette manœuvre permettait la réalisation des objectifs normatifs d’Habermas ; pas plus qu’il n’a perçu qu’il pouvait éradiquer une faille centrale de la construction de la théorie des systèmes en permettant de cartographier le contexte dans lequel les distinctions sont tracées – problème d’importance cruciale pour saisir les relations entre les différents systèmes sociaux et les coordonner via le déploiement d’instruments juridiques. Der Artikel diskutiert Niklas Luhmanns Konzeption von Kommunikation als emergentem Phänomen. Erstens soll gezeigt werden, dass sich Luhmann, entgegen jüngster Einwände, in der Tat als sozialer Emergentist rekonstruieren und als solcher in die aktuelle Debatte um Reduktion und Emergenz des Sozialen einordnen lässt. Zweitens soll dadurch Licht auf die generellen Probleme und Voraussetzungen einer emergentistischen Soziologie geworfen werden. Um diese Ziele zu erreichen, wird zunächst geklärt, welche Positionen sich in der Soziologie grundsätzlich gegenüber stehen und auf welcher Grundlage (...) class='Hi'>Luhmann als Emergentist einzuordnen ist. Anschließend soll die Emergenz der Kommunikation als eigenständiges soziales Phänomen erläutert und ins Verhältnis zum Individuum gesetzt werden. Schließlich wird Luhmanns Konzeption mit Hilfe einiger Adäquatheitsbedingungen aus der allgemeinen Wissenschaftsphilosophie als unzureichend kritisiert. Ziel ist dabei auch die Klärung der Bedingungen für eine plausible Emergenztheorie innerhalb der Soziologie. Nach einer abschließenden Zusammenfassung der wesentlichen Ergebnisse soll ein Ausblick auf eine aussichtsreiche soziologische Emergenzkonzeption geboten werden. (shrink)

The article aims at contrasting the autopoietic understanding of an individual and her or his actions as described by Niklas Luhmann with Paul Ricoeur’s notion of narrative identity, focusing on people as legal subjects. The article assumes that when legal subjects necessitate ethical engagement and evaluation, the law could cease to deal with problems in a mere legalistic fashion but is allowed the freedom to appeal to norms of justice external to itself as in other natural law theories. Through (...) narrative identity the deeds of role players are to be understood in greater complexity than what a self-referential legal system is comfortable in dealing with. (shrink)

Since at least Luhmann, contingency – whose conceivability must be reduced to a great extent by means of “reduction of complexity“ in order to assure stability of social and psychological systems – has been an important topos of sociological theory. What is a genuinely philosophical approach of the past decades, on the other hand, is the idea of its conceivability as being conducive for the purpose of individual autonomy. If both assumptions held equally true, collectivity and mature individuality would (...) effectively contradict each other: Mere affiliation with a collective would be the most efficient way to flee from the existential threat that is contingency, while the questioning of affiliation would require the capacity of enduring said threat. However, an individual that is thoroughly shielded from specific experiences of contingency will have little reason to break loose from its original collective environment and to expose itself to the burden of contingency. Consequently, autonomy would solely – if ever – be possible outside of any collective context and the idea of reasonably founded social liability coined at times of the Enlightenment would ultimately become obsolete. Alasdair MacIntyre and Hans Blumenberg rank among the authors who have dealt with this dilemma in their own specific ways. What makes both of them relevant to the search for a possible solution is the emphasis with which they have included existential as well as cultural contingency in the topos of human identity. The consideration of narrative categories plays an important part at this point: For it is MacIntyre´s conception of the human being as a “story-telling animal“ – surely Blumenberg would concur with this wording – that allows us to particularly understand the myth-building, rhetoric engagement with the world´s unreliability as a crucial structural factor of man´s conduct of life. Contingency always had to be “digested“ in some way or other, either had to be veiled and disowned or made accessible and bearable in order to guarantee man´s metaphysical potentiality – which both MacIntyre and Blumenberg do by molding the unpredictable and the perilous into collective and singular narrations. It is obvious that the collective narratives are superordinate to the individual ones: First and foremost, we are always members of a specific cultural environment who can only hope to obtain an autonomous identity by means of distancing ourselves from this environment to a certain extent. At the same time, as mentioned before, this cultural context serves as the best possible protection against existential contingency; in this regard, MacIntyre and Blumenberg think of cultural reduction of contingency as necessary but yet obstructive to the formation of a resilient individual and autonomous identity. Setting out from here, this essay discusses the extent to which the individual recognition of cultural and existential contingency plays a part in MacIntyre´s and Blumenberg´s concept of a responsible yet socially agreeable identity. It will become obvious that a close connection can be drawn between the affirmation of one´s own cultural contingency and the one of one´s potential suffering in “limit situations” (Karl Jaspers): Human identity could only live up to the task of dealing with existential contingency appropriately by equally admitting its own cultural contingency – and thus the cultural contingency of every other person as well. The affirmation of cultural contingencies and differences would establish a new “genre-specific” reliability that could potentially dismantle the paradigm of (post)modern tentativeness criticized by MacIntyre and Blumenberg and that could return visions of an open and humane future to contemporary societies. "Siamo come lucciole che hanno disimparato a illuminare e che prima si sono messe a girare attorno alla lanterna magica dell'ideale ascetico e ora attorno alle insegne pubblicitarie al neon. Lucciole che hanno scordato d’avere una potenzialità di orientatività preziosa nel proprio sistema affettivo" (G. Cusinato, La totalità incompiuta, Milano 2008, 314). Che cos'è una persona? Come si costituisce concretamente l'identità personale? Che rapporto c'è fra identità personale e identità psichica? C'è coincidenza fra persona e homo sapiens? La persona è (...) ancora oggi, nonostante tutto, al centro del dibattito filosofico, sociologico, giuridico e bioetico, eppure la sua dimensione sembra sfuggire continuamente alle reti concettuali e alle categorie epistemologiche della scienza. In questo lavoro si propone una fenomenologia della persona a partire dal confronto con la teoria dei sistemi autopoietici di Maturana e Varela e dei sistemi sociali di Luhmann, mettendo in luce che la persona non può essere considerata un sistema autopoietico. La persona si delinea piuttosto come un sistema excentrico che si costituisce mediante l'esecuzione dell'atto. Questa prospettiva viene esplorata attraverso un dialogo serrato con l'antropologia filosofica tedesca, la stessa che all'inizio del Novecento mette in luce che l'uomo non ha un'essenza precostituita e proprio per questo necessita di un processo di Bildung. L'antropologia filosofica di Scheler e Plessner nasce nella Germania degli anni Venti in un periodo ancora fluido in cui l'eclissi delle tradizionali concezioni dell'uomo non aveva ancora lasciato il posto alla cristallizzazione totalitaria dell'uomo di massa che si sarebbe imposta negli anni Trenta. The double subjectivity of conscience and the need to test conscientious objections -/- Abstract In spite of the collapse of the traditional objective concept of conscience and the subsequent subjectivation of conscience, conscientious objections are still often considered as a valid ground for exemption from legal and professional obligations. Conscientious objections are seen as more serious than ordinary moral objections. It is not evident why this is so. I argue, with Niklas Luhmann, that the function of conscience is to (...) protect the moral core of a person’s identity. Overruling conscientious objections threatens this core. Claims of conscience are usually founded on the right of freedom of conscience. This right is not absolute. I discuss the view of Richard Arneson who rejects the right of freedom of conscience and defends the right against conscience. I agree with Arneson that, at the one hand, conscientious objectors may constitute a threat to the social and legal order when their objections are not recognised and, at the other hand, too easy giving in to conscientious objections may also threaten the viability of social and legal order. That is why it is needed to determine when conscientious objections cannot be taken at face value, but should be subjected to a series of tests. The aim of these tests is to contain the number of objectors. I discuss 6 criteria for determining whether conscientious objections ground an exemption to legal and professional obligations. At the end of the article I discuss the conscientious objections of medical doctors. (shrink)

Context: The problems that are most in need of interdisciplinary collaboration are “wicked problems,” such as food crises, climate change mitigation, and sustainable development, with many relevant aspects, disagreement on what the problem is, and contradicting solutions. Such complex problems both require and challenge interdisciplinarity. Problem: The conventional methods of interdisciplinary research fall short in the case of wicked problems because they remain first-order science. Our aim is to present workable methods and research designs for doing second-order science in domains (...) where there are many different scientific knowledges on any complex problem. Method: We synthesize and elaborate a framework for second-order science in interdisciplinary research based on a number of earlier publications, experiences from large interdisciplinary research projects, and a perspectivist theory of science. Results: The second-order polyocular framework for interdisciplinary research is characterized by five principles. Second-order science of interdisciplinary research must: 1. draw on the observations of first-order perspectives, 2. address a shared dynamical object, 3. establish a shared problem, 4. rely on first-order perspectives to see themselves as perspectives, and 5. be based on other rules than first-order research. Implications: The perspectivist insights of second-order science provide a new way of understanding interdisciplinary research that leads to new polyocular methods and research designs. It also points to more reflexive ways of dealing with scientific expertise in democratic processes. The main challenge is that this is a paradigmatic shift, which demands that the involved disciplines, at least to some degree, subscribe to a perspectivist view. Constructivist content: Our perspectivist approach to science is based on the second-order cybernetics and systems theories of von Foerster, Maruyama, Maturana & Varela, and Luhmann, coupled with embodied theories of cognition and semiotics as a general theory of meaning from von Uexküll and Peirce. Gesellschaft ist ein schwieriger, weil prinzipiell nie konkret faßbarer Gegenstand der Erkenntnis. Zu diesem Problem gibt es u.a. transzendentale, phänomenologische, systemtheoretische Ansätze. Die Gegenstandsverfassung hat weitreichende forschungspraktische Konsequenzen, auch hinsichtlich sozialwissenschaftlicher Wissenschaftlichkeit. Pragmatismus und Semiotik fand, trotz Apels Peirce- und Joas’ Meadrezeption, noch nicht genügend Beachtung. Gesellschaft wird nicht als Objekt, sondern als erkenntnisdeterminierendes Ziel eines kognitiven Verhaltens eingeführt. Sie wird so kontextualisiert in einer Wahrheitstheorie, die sowohl objektive Fakten wie kognitive Allgemeinheit in sich vereint, und zwar konkret in jeder (...) Zeichenrelation. Von hier ließe sich die Systemtheorie Luhmanns debattieren, nicht in ihren attraktiven Anwendungen, sondern ihrem logischen Kern nach. (shrink)

The current debates in social sciences show that the paradox of observing—the embeddedness of observer in the process of observing—is at the heart of the controversy about their cognitive status and future. Although the problem of observing has been addressed in numerous theoretical perspectives—some of which (Habermas, Leydesdorff, Maturana, and Luhmann) are examined in this article—the prospects for resolving this paradox remain problematic. Locating a point that allows reflection on the process of autopoiesis in general, not just the operation (...) of a particular autopoietic system, may be one condition for resolving this paradox. Such point will offer reflection on all autopoietic systems, including the observer. The dynamic balance between equilibrium and disequilibrium is the mechanism which regulates the process of autopoiesis. Since the function of regulation is essentially a reflective function, this equilibrium between equilibrium and disequilibrium, which can be identified with the concept of homeorhesis introduced by Conrad Waddington, may offer a possibility to reflect on the process of observing. Orientierung steht am Anfang von allem, ohne selbst ein greifbarer Anfang zu sein. Als Letzt- und Grundbegriff geht sie jedem Denken und jeder Lebenstätigkeit voraus und ermöglicht sie. Dennoch war sie selbst bislang kaum Gegenstand philosophischer Reflexion. In seiner Philosophie der Orientierung macht Werner Stegmaier – bekannt durch seine Beiträge zu Nietzsche, Dilthey, Luhmann und Levinas – sie zum Ausgangspunkt, um die Philosophie selbst im Hinblick auf ihr praktisches, lebensweltliches Potential hin neu zu denken. Das breite Spektrum des Sich-Orientierens (...) und des Orientiert-Seins im Denken, die Bedingungen und Strategien der Orientierung im Alltag und ihr Ziel, die Ungewissheit, das Grundproblem der Orientierung, zu bewältigen, werden von ihm in die Perspektive der Philosophiegeschichte gestellt und im Blick auf aktuelle philosophische Fragestellungen systematisch untersucht. Die Beiträge des Bandes, abgerundet von einem Nachwort Werner Stegmaiers, eröffnen diesem genuinen Ansatz einen breiten Reflexions- und Diskussionsraum und zeigen so seine Bedeutsamkeit nicht nur für die Philosophie im Ganzen, sondern auch über ihre Grenzen hinaus. This chapter will explore the dynamics of power underpinning ethical issues within smart cities via a new paradigm derived from Systems Theory. The smart city is an expression of technology as a socio-technical system. The vision of the smart city contains a deep fusion of many different technical systems into a single integrated “ambient intelligence”. ETICA Project, 2010, p. 102). Citizens of the smart city will not experience a succession of different technologies, but a single intelligent and responsive environment through (...) which they move. Analysis of such an environment requires a framework which transcends traditional ontologically-based models in order to accommodate this deep fusion. This chapter will outline a framework based on Latour’s Actor-Network Theory and Luhmann’s treatment of society as an autopoetic system. We shall use this framework to map the influence of relevant factors on ethical issues, irrespective of their composition or type. For example, under this treatment, both human praxis and technical design can be viewed as comparable tools of domination. This chapter will provide a framework for the analysis of relations between any elements of the smart city, ranging from top-level urban management processes down to individual device operations. While we will illustrate the use of this schema through examination of ethical issues arising from power dynamics within the smart city, it is intended that this example will demonstrate the wider utility of the model in general. El presente trabajo se propone señalar algunas tareas posibles para la ética del discurso de Karl-Otto Apel en la actualidad. Tales tareas pueden concentrarse en la necesidad de una teoría de la institucionalización del discurso práctico, como forma de racionalidad práctica realizada socialmente. La pregunta que se ha de responder es qué condiciones marco debe cumplir el discurso para que pueda ser puesto en práctica y qué efectos político-institucionales puede producir en el contexto de instituciones realmente existentes. A partir de (...) Gehlen y de Luhmann -aunque en menor medida-, Apel interpreta a las instituciones como sistemas de autoafirmación que, por un lado, liberan a los sujetos de la carga de la acción, pero, por otro lado, limitan o condicionan la racionalidad práctica consensual-argumentativa propia del discurso. Las coerciones (Sachzwänge) funcionales de las instituciones configuran un campo de acción y un tipo de racionalidad que, de acuerdo con Apel, deberían estar bajo el control del discurso institucionalizado como esfera pública racional (Öffentlichkeit). La relación entre los criterios normativos ideales del discurso práctico institucionalizado y las instituciones realmente existentes debe interpretarse como una tensión o entrelazamiento dialéctico no superable. Si esta interpretación es correcta, la ética del discurso, en tanto teoría crítica de la sociedad, no puede ser entendida como una aplicación sin más de criterios normativos ideales a la realidad histórica o de adecuación de esa realidad a los criterios ideales en su sentido vertical, sino como de mutua correlación horizontal. ¿Què se avizora para el ser humano cuando se piensa en un tema tan existencial como lo es el de sus derechos? ¿Predomina la incertidumbre, la desazòn, los diagnòsticos interminables sobre los males por los cuales la especie humana agonizarà inexorablemente? ¿O por el contrario, se vislumbra con optimismo un futuro de posibilidades siempre abiertas? La cuestiòn de los derechos humanos remite a reflexiones muy profundas en torno a la Identidad y a la Alteridad. Ambas nociones aparecen como supuestos implicitos (...) o explicitos en las diversas estrategias empleadas para el abordaje de un tema tan complejo. El fondo cultural desde el que emergen acompaña las perspectivas teòricas de interpretaciòn y las politicas que las ponen en pràctica. En ambos planos surge con frecuencia la palabra tolerancia aunque en occasiones es utilizada con un significado muy ambiguo. La tolerancia requiere de seres razonables para alcanzar sociedades autènticamente democràticas. La razonabilidad a su vez se logra en la medida en que se estimule el desarrollo del pensamento critico. En este contexto, los aportes de la epistemologia de la complejidad de Edgar Morin, (la cual surgiò como alternativa frente a las epistemologias cerradas), posee una especial relevancia para la reflexiòn de los derechos humanos en el contexto històrico-cultural latinoamericano. En esa misma linea se ubica la teoria general de los sistemas sociales de Niklas Luhmann y las reflexiones sobre la identidad del sociòlogo polaco Zygmunt Baumann. En esta ponencia se busca mostrar la estrecha interrelaciòn entre esos autores con respecto al modo de interpretar la identidad y la alteridad, bases ineludibles para la construcciòn del respeto por los derechos del otro en cuanto tal. E-mails: [email protected] e [email protected] WhatsApp: (82)98143-8399. -/- PREMISSA -/- Se até a década de 1960 podia-se falar em uma Sociologia dividida por países, após essa época, tendo em vista um processo significativo de circulação de informações pelos mais variados meios de comunicação, pode-se dizer que os (...) principais cientistas sociais se tornaram globalizados, assim como a literatura sociológica. As questões sociais, que até então podiam estar localizadas em países ou em blocos de países, também se tornaram mundializadas, e vários pensadores passaram a refletir sobre temas chamados de pós-modernos, hipermodernos ou simplesmente contemporâneos, e que afetam um país, uma região ou todo o mundo. A Sociologia contemporânea, porém, mantém uma relação significativa com as grandes vertentes da Sociologia anterior: • a marxista ou histórico-estrutural, com suas variações; • a durkheimiana ou funcionalista, com o desenvolvimento de um neofuncionalismo; • a weberiana ou compreensiva, com o desenvolvimento da fenomenologia e da hermenêutica; • a teórica e pragmática estadunidense, com variadas linhas. Além dessas vertentes, pensadores como Jean-Gabriel de Tarde e Georg Simmel, que estavam um tanto esquecidos, pelo menos no Brasil, em razão da ênfase em Émile Durkheim, num caso, e em Max Weber, em outro, retomaram seus lugares de destaque. Essas vertentes inspiraram outros tantos pensadores, que – refletindo sobre a realidade em que vivem, mesclando ou não contribuições de diferentes linhas teóricas e formulando uma série de conceitos – demonstram as possibilidades e a diversidade do pensamento sociológico e fazem a Sociologia avançar muito no processo de compreensão da realidade contemporânea. A combinação de diversas vertentes teóricas torna difícil fazer qualquer enquadramento ou mesmo tentar classificar determinados autores. Muitos analistas veem nisso uma crise de paradigmas na Sociologia contemporânea. Essa “crise” poderia ser entendida do ponto de vista epistemológico; entretanto, sempre houve diversidade de epistemologias na Sociologia. Acreditamos que essa diversidade epistemológica, de teorias, de objetos e de métodos, concorrentes ou não, na explicação de fenômenos sociais deve ser vista como indicativo de vigor, e não de decadência. The solution to this problem, according to Luhmann, cannot be reduced (...) to exposing some kind of puppeteer in the background, pulling the strings, as much as sociologists and political scientists would not like. According to Luhmann, here we are dealing with the consequences of the differentiation of modern society. In his opinion, this influence can be traced and subjected to theoretical reflection. It is about what one could say about the "own meaning" and "own behavior" of modern society. The concept of "mass media", according to Luhmann, covers all public organizations and enterprises that use technical means to disseminate messages, if mass products are made by them for yet undefined addressees. Den moralske virkelighed er en filosofisk undersøgelse af moral og etik i videst mulige forstand, der bunder i en frustration over oplevelser med den filosofiske etik. Den filosofiske etik skal vejlede os moralsk i vore handlinger, men det synes som om den hverken kan hjælpe os med det eller redegøre for moralen. Moral er et samfundsmæssigt fænomen, men det gør den filosofiske etik typisk ikke meget ud af. I en situation, hvor etikken er i krise, er det derfor værd at (...) se på, hvad moralsociologien kan berige etikken med. Pointen er ikke, at sociologien skal afløse eller begrunde etikken. Idéen er, at udvikle en filosfisk etik, der er sociologisk informeret. I det perspektiv analyseres Émile Durkheim, Niklas Luhmann og Zygmundt Bauman, ligesom det afslutningsvist skitseres, hvordan en sociologisk informeret etisk refleksion kunne se ud. (shrink)

The outline of the development of Performance Art features happenings in New York and Vienna in the sixties as well as body art and performances with closed circuits in the seventies (among others). Action Art, Environmental Theater and Intermedia are the terms defining the main characteristics of the works discussed. The research method is mainly based on Intertextuality (Mikhail Mikhailovich Bakhtin) and Systems Theory (Niklas Luhmann).

This book is a PhD dissertation and a very personal book at the same time. It asks the question whether society can and should be a point of orientation ("Bezugspunkt") for the human individual. Please note, that this cannot be a scientific book: If sociology is defined as society observed by society (or by sociologists, who are the agents of society), society observed by a single person (and for the aim of this single person) cannot be scientific. This is also (...) true if the researcher adheres to reason and scientific methodology: observations and understanding created by the human individual for its own private purposes simply are not scientific because they lack universality. "Bezugspunkt Gesellschaft" studies a number of different strains of sociology (and their scientific representatives, e.g. Pierre Bourdieu, Niklas Luhmann, Ralf Dahrendorf, Norbert Elias, Berger/Luckmann) in order to find out what it is that sociology studies? Is sociology the study of a society of human beings? Or is it true that society does not consist of human beings, but, as Luhmann claims, of acts of communication? Or is it true, as Bourdieu claims, that society consists of the instances of freedom abandoned half willingly, half out of habitude, by human individuals like in the case of a coffeehouse waiter who over time has just given up the idea that he could be anything else than a coffeehouse waiter. This book was inspired by a deconstructivist method of analysis in the field of literary theory where researchers state that it is of no interest what the author of a book wanted to say. Instead we should treat the work of literature as if the society of the author's epoch had written it. This theoretical "murder" of the human being in the form of the authors of works of literature in literary theory might have its analogy in sociology: Maybe sociology is also, like literary theory, not about people? However, if sociology is not about people - what can sociology teach us, us people? The book looks at different concepts of society throughout history, starting from the ancient concept that society is community, or that it is a circle of friendships, to more modern and dystopian concepts like that society is some kind of unhuman society. The book ends with the "Balzac machine", representing the incredibly talented and prolific French author Honoré de Balzac as a person who was an expert in the study of society and entirely blind to the phenomenon of society at the same time. The paradox of Balzac manifested itself in the fact that he literally worked himself to death in an attempt to gain society's recognition. (shrink)

The following article was written to honour Johan Buitendag’s contribution to the discipline of eco-theology. Assuming an interdisciplinary stance, eco-theology in general and his work, in particular, is observed from the position of legal theory and sociology. As such, eco-theology is not assessed on theological grounds but is treated interdisciplinary through comparison with environmental law. More specifically, the project of eco-theology is shown to share certain characteristics with the nascent subdiscipline of Earth systems law within environmental law. It is argued (...) that one of the most important of these is the use of norms as an ecological strategy. This is understandable as both the religious and legal systems rely on the norm form to a lesser or greater extent. However, in the legal sociology of systems theory, the shortcomings of norms have been eloquently argued. This article thus posits the limits of norms to eco-theology and Earth systems law as a challenge deserving attention. However, social systems theory has its shortcomings, and a preliminary line of flight away from this challenge is suggested in the shape of Agamben’s description of the monastic form-of-life, where life and norm overlap so intensely that suggestions of a new worldview gain plausibility. Global law settings are characterized by a structural pre-eminence of connectivity norms, a type of norm which differs from coherency or possibility norms. The centrality of connectivity norms emerges from the function of global law, which is to increase the probability of transfers of condensed social components, such as economic capital and products, religious doctrines, and scientific knowledge, from one legally structured context to another within world society. This was the case from colonialism and colonial law to contemporary global supply (...) chains and human rights. Both colonial law and human rights can be understood as serving a constitutionalizing function aimed at stabiliz- ing and facilitating connectivity. This allows for an understanding of colonialism and contemporary global governance as functional, but not as normative, equivalents. (shrink)

Arthura Kaufmanna filozofia prawa wyrasta przede wszystkim z neokantyzmu aksjologicznego reprezentowanego przez „późnego” Gustava Radbrucha, którego uważał on za najważniejszego ze swych nauczycieli, oraz z hermeneutyki filozoficznej Hansa-Georga Gadamera. W późniejszym okresie znaczący wpływ na Kaufmanna wywarł Charles S. Peirce, którego pracami posiłkował się opracowując problematykę analogii (wiążąc ją z opracowanym przez Pierca zagadnieniem abdukcji) oraz ontologii relacji. Niektóre wątki poglądów Kaufmanna nawiązują do egzystencjalizmu Karla Jaspersa oraz antropologii Karla Löwitha. Obecne są także inspiracje tomistyczne i arystotelesowskie. Jest to filozofia (...) prawa o charakterze maksymalistycznym. Kaufmann wpisuje się w sięgającą starożytności tradycję uprawiania filozofii, w której stawia się pytania o całość; filozofia pyta o to, co to jest "byt w ogóle", byt "w całości"; filozofia prawa stawia pytania o to, co to jest prawo "w całości", prawo "w ogóle" . Podejmuje wprost fundamentalne zagadnienia należące do zasadniczych dziedzin filozoficznych – epistemologiczne, ontologiczne, etyczne, nie stroniąc także od zagadnień z zakresu logiki. Uprawiana przez niego filozofia ma charakter systemowy, co sprawia, że jej zrozumienie zakłada ujęcie całości propozycji. Sam Kaufmann uważa, że systemy filozofii prawa należą już do historii, jednak ta uwaga jest o tyle jedynie trafna w odniesieniu do niego samego, że jego filozofia prawa – w zgodzie z jego deklaracjami – nie zmierza do „gotowych rozwiązań” konkretnych kwestii prawnych, ale zmierza do ukształtowania pewnego sposobu refleksji nad prawem. Jego koncepcja jest ważnym głosem w sporze klasycznego pozytywizmu z koncepcjami niepozytywistycznymi. Za prawo w pełnym tego słowa znaczeniu uznaje konkretne rozstrzygnięcie, co niewątpliwie łączy jego podejście z amerykańskim realizmem prawnym. Rekonstruowana przez Kaufmanna struktura procesu „urzeczywistniania” prawa, dokonywana w kontekście i na użytek kultury prawnej typu kodeksowego, kontynentalnego, uwyraźnia obecność elementów typowych dla kultury prawa precedensowego –wnioskowanie od przypadku do przypadku. Jednocześnie za istotny problem każdego porządku normatywnego uznaje uogólnienie. Jest to znamienny teoretyczny wyraz narastającej świadomości współwystępowania obok siebie zasadniczych elementów każdego z tych typów kultur prawnych. Kaufmann trafnie dostrzega, że w konkretnym rozstrzygnięciu są obecne elementy normatywne wykraczające poza to, co jest zawarte w aktach normatywnych. Podobnie jak Ronald Dworkin, Kaufmann wskazuje, że dokonujący rozstrzygnięcia, czy tego chce, czy nie, „stosuje” szereg elementów normatywnych spoza aktów normatywnych. Analizy prowadzą do wniosku, że propozycja Kaufmanna zawodzi, gdy przechodzi on do ontologicznych uogólnień, przede wszystkim przez brak uwzględnienia w swych podstawach takich punktów odniesienia, które są zewnętrzne wobec badanego procesu „urzeczywistniania” prawa. To, czym jest osoba, determinowane jest systemem prawnym i kulturą, w której prawo funkcjonuje. Przy takim ujęciu Kaufmann nie osiąga jednego z ważnych celów, do którego zmierzał, nie wskazuje kryteriów pozwalających stwierdzić, czy stopniowa – dokonywana zgodnie z odkrytymi przez hermeneutykę filozoficzną wymaganiami poprawnego rozumienia – zmiana normatywnego sensu systemu prawnego zmierza ku „ustawowemu bezprawiu”, czy też nie.
