My paper refers to Leszek Kołakowski’s Main Currents of Marxism: Its Origin, Growth, and Dissolution (Oxford: Clarendon Press 1987). Kołakowski’s intention was to write a textbook on the history of Marxism based on his lectures but his book is much more than that. It is a philosophical treatise in which Marx’s doctrine of mankind and the program of its liberation are critically analysed and reinterpreted. The core of Marx’s philosophy is the idea of man and the belief that (...) the real existence of humans is not identical with their essence. Kołakowski shows that this belief is rooted in mythological thinking, the Platonic tradition, and in the Christian thought. A moral that follows from Kołakowski’s critical analysis of Marx’s doctrine is that man has never lived in a paradise and yet he perceives himself as banished thereof; that he will never enter a paradise and yet he cannot live without the faith that this is somehow possible. Therefore, what he should do is to have a minimum of common sense and skepticism related to it, for they would protect him against the traps laid by false prophets repeatedly asserting that they know the means to construct the paradise today or at least tomorrow. In the article the author describes theoretical reasons that stood behind Kołakowski's transition from being an orthodox Marxist to become an actual leader of the polish revisionist movement. His intention is to concentrate on those aspects of Kołakowski's thought that have not changed, apart from any biographical and psychological reasons. (1) First of those features is Kołakowski's inability of completability, the anti-code disposition. (2) The second trait is the moral attitude, an intention to influence on people's morality by convincing them (...) that social and internal (necessarily bound with social) changes are desirable; that an existential calm demolishes morality. (3) Third feature concerns the fact that Kołakowski did not attempt to create his own philosophy, he was rather a historian of ideas, a skeptic, and a critic. (shrink)

Architecture and Deconstruction Case of Peter Eisenman and Bernard Tschumi -/- Introduction Towards deconstruction in architecture Intensive relations between philosophical deconstruction and architecture, which were present in the late 1980s and early 1990s, belong to the past and therefore may be described from a greater than before distance. Within these relations three basic variations can be distinguished: the first one, in which philosophy of deconstruction deals with architectural terms but does not interfere with real architecture, the second one, in which (...) a collaboration between Jacques Derrida and a group of architects interested in his concepts is commenced, and the third one, in which completed or only designed objects or new concepts of deconstruction created by architects gain their supremacy over philosophy. The following book analyses these three possible ways, first of all with the reference to Peter Eisenman and Bernard Tschumi. -/- Peter Eisenman -/- Misreading… and Other Errors -/- The issue of relations between Peter Eisenman’s work and philosophy of deconstruction may be referred to his activity more than ten years preceding his direct collaboration with Jacques Derrida (in 1985) and organisation of the exhibition Deconstructivist Architecture at Museum of Modern Art in New York (in 1988). As soon as at the stage of designing the first houses (House I-III, 1967-1970), which almost entirely inscribed in formalistic aesthetics of Modernism, the architect analysed the problem of architecture dependence on its assumptions. All his later designs may be treated as consequence of this initial interest in relations between practice and theory, and at the same time as an introduction to manipulations later on led at the level of metaphysics of architecture. Beginning with the issue of presence, considered in comments to House VI (1972), the number of ideas having their analogies in philosophy of deconstruction increased. The text entitled The End of the Classical: The End of the Beginning, The End of the End (1984), in which Eisenman criticised questions of representation in architecture, its delusive strive for truth and comparably unattainable attempts at ultimate definition of elementary rules, should be acclaimed the breaking point. This attitude was extended by numerous strategies disturbing architecture rules defined at metaphysical level in an essay Moving Arrows, Eros, and Other Errors: an Architecture of Absence (1986). The issue of Eisenman’s passage from formalism to deconstruction has already been much discussed in the literature (Rosalind Krauss, Thomas Patin among others), still it should be mentioned that the threads similar to Derrida’s concept included in Eisenman’s writing reveal untranslatability of architecture and philosophy. -/- Choral Works or Separate tricks -/- In 1985-1986 a series of seven disputes between Jacques Derrida and Peter Eisenman took place. The pretext for them were designs concerning Parc de la Villette in Paris. The situation of many months of collaboration between a notable philosopher of the second half of the 20th c. and an architect that already had a huge theoretical oeuvre, ended up with a publication of a large volume entitled Chora L Works and it became at the same time a vast study area for historians of contemporary architecture and philosophers. Derrida’s contribution to concept works were his considerations over the idea of chôra, the properties related to this concept were about to be reflected in shapes of the park. Therefore, Chora L Works became an example of the abilities of contemporary art, both in its capability of translation from philosophical ideas to artistic forms and its resistance to tradition of representing in architecture some phenomena and values originating outside this discipline. In the final period of their collaboration both interlocutors started to polemicise with each other more decidedly, what became a separate part of their thought exchange. The exchange of letters between Derrida and Eisenman at the turn of 1989 ended up the period of their direct contacts, nevertheless, at this time precisely a large group of experts in issues of deconstruction joined the discussion and extended the revealed in the former dispute problems into more than ten years of further considerations and publications. Except for a long text by Jeffrey Kipnis, who had participated in the meetings of the philosopher and the architect, there appeared also comments of researchers of artistic theories (K. Michael Hays, Thomas Patin), philosophers (Andrew Benjamin), and even experts in Greek literature (Maria Theodorou or Ann Bergren). Following these debates a contemporary reflection on architecture has saturated with indeed numerous concepts originating in philosophy of deconstruction. -/- Architecture which imitates mute philosophy -/- The series of Jacques Derrida and Peter Eisenman meetings, which took place in the period of 1985-1987, induced many authors to make comments. Some of them (Jeffrey Kipnis, Ann Bergren, Maria Theodorou) developed the subject of chôra which was introduced to the discussion by Derrida. The problem that was about to be solved was the question of tying up the concept of chôra with architecture, including Eisenman’s architecture and the series of meetings within frames of Chora L Works project. Kipnis on this occasion paid attention to chôra and its character of anachronia which infects any being created within chôra. In other words any event has its counterpart (analogon) in another, earlier event. He demonstrated the similarity of structure of many events and statements from the times of Derrida and Eisenman’s meetings to the almost identical behaviour of figures in Plato’s dialogue Timaeus. The loss of beginning present in this phenomenon was appropriate to both features of chôra and the effects of typical analyses of philosophy of deconstruction. Bergren’s analyses focused on accentuating gender of chôra, which, according to this author, had been neglected hitherto in discussions. She collated chôra descriptions with characteristics of women in myths, early Greek epic and philosophy and she arrived at a conclusion that chôra has features of a single woman and a married one at the same time. And yet Theodorou’s studies showed that in the Homeric epics chôra is not treated as an idea but is related with single things and events. The other part of the comments (represented by Andrew Benjamin and K. Michael Hays’ utterances) concerns Eisenman’s attitude to tradition which was treated as a variety of iteration understood philosophically. Benjamin commenced his considerations at the point of closeness between a definition of tradition and a concept of chôra understood as perpetuation (placement). A problematic issue was for him Eisenman’s complex relation to tradition based on its contest and affirmation at the same time. Overcoming the simple subordination to tradition – according to Benjamin – was based on awareness of the role of repetition in culture not known before. Hays made an attempt to explain the pleasure and torment of repetition with the support of Sigmund Freud and Roland Barthes’ concepts. According to Hays repetitions are attempts of a single being to a certain primal state perceived as free of any tension. In a similar way Rosalind Krauss explained a motif of a grate present in Modernistic art and also exceptionally frequent in Eisenman’s work. -/- Annex Architecture is still writing Balzac novels. Peter Eisenman and literature -/- Architecture’s approach to writing, script or literature, present within Peter Eisenman’s work, is an exceptional phenomenon, furthermore a complex one. The article considers four possible relations. The first one relates to Eisenman’s characteristics as a person extremely gifted with the ability to wordplay, which very ‘play’ reveals skills to create architectural images. In the second approach the attention has been paid to Eisenman’s interests – in the first period of his oeuvre – in linguistic works by Noam Chomsky and his transformational-generative grammar. The third kind of relations applied to overcoming the need for autonomy of architecture (and of modernist aesthetics at the same time) and renew interests in questions of meaning in architecture. The fourth sort of relations occurred when Eisenman started to create reflections of historic or literary narrations in architecture – ‘stone stories’ and architectural fictions of their kind. -/- Bernard Tschumi -/- From perversion to deconstruction In Bernard Tschumi’s writings from the 1970s and 1980s we can find a transposition of important threads of post-structuralist ideas deriving from Georges Bataille, Roland Barthes and Jacques Derrida’s works. The analysis of the architect’s writings also shows roots in Phillippe Sollers, Michel Foucault and Denis Hollier’s works. The analysis of borrowed elements from the beginnings of Tschumi’s theoretical activity may be helpful in explaining the contents of his later writings motre inspired by philosophy of deconstruction. The set of his earliest views was inspired by Marxism, Neo Marxism and French Structuralism, mainly by the writings of Henri Levebre and Guy Debord. From the thought of Levebre Tschumi took interest for city as not only a question of urbanistics but also a political issue. From Debord’s concepts he borrowed a conviction about the role of situational violation for changes in the society structure. Some of these beliefs were preserved in his own concepts of architecture as an event. From this period derived also his will to change conservative elements of social structure not by means of political revolution but of theoretical and creative activity. Tschumi acknowledged that the effective way of the proceedings towards achieving his aims would be accepting the role of both a critical intellectualist and architecture expert who would not hide away his left-wing orientation. The speculations defined by the architect as ‘revolting analyses’ were about to characterise contradictions which tear the society apart, penetrate architecture and constitute the basis of culture. Spreading away of the conscience of false assumptions hidden away in various disciplines could have weakened cohesion of a conservative society and influence the will to change among the elites. This way the beginnings of political revolution were rooted in philosophy of architecture. In 1977 Tschumi published his text entitled The Pleasure of Architecture inspired by Roland Barthes’s The Pleasure of the Text, it also included some concepts derived from Georges Bataille and Jacques Derrida. First of all the author used Barthes’s concept which made an assumption that literary activity is pervaded by the spirit of resistance towards social rules, and Tschudi transferred this remark onto architecture. From the ideas of Bataille, acquainted via Holier’s work, he derived his belief that two concepts of space, a conceptual one (defined as Pyramid) and a sensual one (defined as Labirynth), not losing their distinct features, they join in the concept of experienced space which exceeds contradictions. The exceeding itself was defined as the basic rule of architecture and it was referred to situations in which architecture not only negates social needs, but also disavows its own tradition. Crossing the borders applies not only to political issues or permanent rules of the very discipline but also interfering with other fields (especially literature and film). The fact that architecture is associated with organising events turned Tschumi’s attention to questions of violence that result from upsetting architectural order of a given building by its users and the one hand, and on the other from forcing the users to specific acts imposed by this very order. The analysis of the concepts used by Tschumi in his early writings indicates that they are close to definitions that would occur in his reflection in the following years influenced by philosophy of deconstruction. -/- Approaching deconstruction Tschumi in his theories developed in the 1980s presumed that the current social world had undergone a deep process of decay, and the reaction against which ought to be based on ordering-up actions, and also preserving the main outline of disintegration of the whole and its elements in the state of conflict. The statements concerning the nature of the contemporary to Tschumi social relations were applied by him to the world of architecture, this led him to coming up with designing strategies that took into consideration the destabilised character of conditions in which works of architecture were created. New ways of conduct invented by Tschumi drew their inspiration from literature and research on literature, psychoanalysis, structural linguistics, structuralism and post structuralism, and eventually also deconstruction philosophy. The proposed methods were opposed by their author both to functionalism continuity trends and postmodern architecture. Tschumi’s proposals contradicted any forms of conservatism or traditionalism in political sphere as well as in reference to tendencies in architecture. They were not simple contradictions of social or architectural rules, they intrude them from the inside, weaken or escalate the already existing incongruities, they move the boundaries between the areas. Revolutionary illusions about the possibility of radical changes were replaced with strategies which completed, tainted or test former rules in the series of formal games of permutation and combination. Quite different from avant-garde formalism Tschumi’s games were not about maintaining the autonomy of a given area, but on the contrary – polluting it with other areas’ influences. Tschumi enjoyed demonstrating illusions of architecture concerning simple relations between form and function, or between form and meaning. Making use of Freud, Lacan and Foucault’s research he introduced a category of “madness” into architecture allowing an observation that the recognised norms are nothing but merely ones of many possible principles of behaviour, and their recognised status resulted from unjustified hindering innovativeness which is crucial for architecture. To reborn architecture’s capability of changing Tschumi also made use of Barthes’s discoveries concerning rules of narration and works by writers who applied in their writing knowledge on linguistics. Making a work’s author unclear by various mechanical transformations of its elements was however apparent only, and formal rigours imposed on the process of designing liberated possibilities difficult to obtain in more traditional creative action. Another mode of acting introduced by Tschumi was combining his work of elements deriving from outside architecture; joining space records with notation of motion and events accompanying architectural objects among others. These architectural and extra-architectural elements were not unified, on the contrary their heterogenous and conflictual character was stressed. This is how shock, anxiety and instability, typical for live in great metropolises, infiltrated architecture. Taking some ideas of deconstruction philosophy as a pattern Tschumi also took into critical consideration in his essays traditional in architecture oppositions between form and figuration, or theory and practice. By combining various inspirations he eventually worked out an idea of architectural event, which he understood as a series of actions contesting its own field, redefining its sources, principles and elements. An event, understood in this way, was not so much producing works as rather creating conditions of their production and at the same time designing the society different from a hierarchic one. -/- Park of deconstruction Among numerous philosophical strategies of deconstruction most frequently used was questioning the practice of strong opposition of two reasons. In many cases Bernard Tschumi’s writings just consider functioning of the conflict juxtaposition of the ideas of structure and ornament or theory and practice in history of architecture. Violation of traditional relations between terms of this kind, both old and modern, raised Jacques Derrida’s objections, when he was induced for the first time to co-operate with architects’ milieu. During this long lasting thought exchange the philosopher eventually acknowledged Bernard Tschumi’s arguments for reasoning the encroachment of architecture’s fundamental rules. Deconstruction applied in architecture was not a simple transposition or analogy of practices that had been applied by philosophy of deconstruction. We may even say that considering architectural terms became an important formula of deconstruction. Architecture understood in philosophical way became something beyond the practice and theory of its own discipline, a sort of metaphysics of both philosophy and architecture. The deliberate encroachment of simplicity of dividing architecture into theory and practice, for the first time became a clear aim for Tschumi in his drawings and texts entitled The Manhattan Transcripts. The contents of this series of works was a record of characteristic features of this New York district in such a way that not only objects were the subject of the record but also relations between objects, people and events. The record was about to take into consideration a conflict character of elements of this representation and at the same time to avoid applying to them the rule of mimetism. The record became a form of reflection over the very record by an increased control over the ways of representation. Architecture which was considered in the The Manhattan Transcripts was not directed to fulfill the needs of inhabitation or production, it was rather related with hitherto usually marginalised liminal situations: building ostentatiously big monuments, religious cult, war etc. Architecture operating in these relations focused also the attention on the included in it continuous tendency to overpass its own restrictions, the role of violence as its not recognised factor, or the meaning of excess and shock in its operation. Architecture moving from reason towards madness became even more visible in the design of Parisian Parc de la Villette, whose pavilions were defined as folies (in French it means both small park buildings and follies). The park was supposed to be on the one hand a reflection of traditional society disintegration while on the other it questioned basic rules of producing a work of architecture. The traditional rules of designing, based on ordering up, were replaced with the strategies of dysfunction and dissociation. In Tschumi’s opinion methods of this kind may be equivalent of what Derrida named différance. Instead of aiming at mergence, any diversity, plays or variations were strengthen. Tschumi’s texts, in which he explained his attitude, were completed by Derrida’s extent statement entitled Point de folie – Maintenant l’architecture. Derrida’s article is the most significant of all his statements on architecture as a form of thinking and activity. According to the philosopher, architecture should divide space (in French defined as espacement), what enables both thinking and action – it arranges the space of an event. Tschumi’s buildings, defined as folies, in an essential way destabilise any created order, and at the same time they refresh it. Derrida’s statement suggests that architecture may become both metaphor of an order merging a language or a society but also of inner forces which deconstruct and reconstruct it. Therefore architecture is at the same time a construction, a deconstruction and a reconstruction. Parc de la Villette stands out in this system with its attempt to step beyond the scheme of an easy repetition and its heading for chances of achieving more radical otherness. -/- Conclusion Destruction as construction. Paradoxes of deconstruction in architecture -/- Scepticism about persistence and common importance of fundamental values of human culture evinced in philosophers and writers’ works as early as in Greek antiquity, nevertheless it was not expressed so strongly as in the second half of the 20th century. Especially in Heidegger’s work Being and Time (although originated in 1927, still influential in all later philosophy) the following states were characterised: the state of losing the ground (Abgrund), of being out of sight (Unheimlichkeit) and of being out of dwelling (Un-zuhause-sein) – as the basis of self-confidence of conscious being there (Dasein). The entire criticism of philosophy of home and dwelling draws the inspiration from this early writing of the German philosopher, it combines crisis of basic terms of metaphysics with social conditions which are dictated by living in large metropolis. The crisis of both metaphysical foundation and home appears to be similar to the situation of weakening the relations between a man and his dwelling in extensively expanding cities. Whereas philosophy, as well as many disciplines of social sciences, have diagnosed for a long time the destabilisation of fundamental ideas of Western culture and crucial changes in the ways of dwelling, architecture itself occurred to be “the last fortress of metaphysics” (J. Derrida). Among contemporary architects, Peter Eisenman and Bernard Tschumi were the ones who engaged most decidedly in the issues of critical analysis of architecture foundation and its social role. Both the architects noticed new formulas of contemporary social and individual existence, tremendously different from the entire history, and at the same time they affirmed lack of adequacy of architecture concepts to new situations. Both Eisenman and Tschumi used to describe the existing architecture as a tool for consolidation of highly integrated and hierarchised societies, and also as a discipline extremely uncoincidental with the current character of social life based on ideas of freedom and diversity. The means to transform architecture and make a factor of further social changes out of it, was a concept that accentuated revealing the inner contradictions of this discipline, and considering them in designing strategies. Eisenman’s activity, in regard of what has just been noticed, was focused on questioning the basic rules of traditionally comprehended architecture, especially the rule of purpose. The American architect noticed that the concept of architecture as fulfilment the need of location, hides away the fact that the location has to be constantly reconsidered, and hence it is overtaken by change (dislocation). Therefore new concept of architecture propounded architectural activity to translocate the concept of location – more than before – but also to change its status perpetually. Such comprehended architecture should claim, as its main purpose, the constant revision of this purpose and create itself anew permanently. Even Eisenman’s earliest designs of houses nos. I-IV broke with such values as the sense of safety, closeness and familiarity, and just on the contrary they accentuated senses of strangeness, homelessness and loss of confidence. The contradictions within architecture noticed by Tschumi referred to combination of intellectual and sensual values in architecture, when their non-appropriation was defeated by an additional condition, namely the way of experience based on pleasure of excess, marked by insanity. The features of folly were especially visible in his designs of gardens, where the order of planning was mixed with sensual experience introduced by particular elements (both the ones created by nature, and the buildings defined as folies). Parc de la Villette designed by the French architect in Paris put in question not only the common understanding of purpose in architecture but also the ideas of order and integrity, as its plan was based on the combination of independent layers with records of grids of points, various lines and planes. The architecture that collides inadequate elements with each other was supposed to be a kind of an event with no beginning and no end. The architecture treated as an event became a form of a space weakened articulation that maintains its diversity and lack of accordance of the elements building it up. The analyses of Eisenman and Tschumi’s theoretical writings indicate how much the aims of architecture have actually changed; instead of supporting social persistence, the architecture is rather intensifying contradictions, and instead of providing people with the sense of safety, it sublimes danger. From simple acts of defamiliarisation, increasing the distance to itself and enhancing the role of theory, through discomfort, anxiety, not feeling someone at home, weirdness, excess, shock and violence, architecture reached the edge of stability and uncertainty, only to make an attempt at penetrating what is impossible and unutterable, and recording what cannot become the subject of any records. -/- . No evangelistic erroneous network of ideas can guarantee the satisfaction of these two demands : (1) propagate the network without revision and (2) completely insulate itself against losses in credibility and adherents through criticism. If a network of ideas is false, or inconsistent or fails to solve its intended problem, or unfeasible, or is too costly in terms of necessarily forsaken goals, its acceptability may be undermined given only true assumptions and valid arguments. People prefer to adopt ideologies that (i) (...) are logically consistent, (ii) are more truth-like and of higher information content than their rivals, (iii) are systematically organised, (iv) solve their problems better than their rivals, (v) do not contain unfeasible demands, and (vi) do not contain uneconomic demands. Truth and validity therefore act as Darwinian-like filters on ideologies. Using Popper's notion of situational analysis and with reference to Darwinian evolution, considered as a special case of the former, and Bartley's theory of comprehensively critical rationalism I argue that a propagandist cannot guarantee his message or his movement from sound criticism. All positions are in a methodological sense open to argument. Moreover, the logic of a propagandist's situation constrains him into making his message and himself open to criticism in order to maximize its chances of being propagated through the population. But he then loses control of the message in two respects. Firstly, his audience are disposed to select from the competing ideas they encounter those that satisfy (i) to (vi) because of man's evolutionary history. Secondly, he cannot guarantee protection from criticism even a privileged section of his message because he cannot predict in a systematic way what logical repercussions each protective reformulation of the ideology will have on other sections of the ideology and what criticism the ideology will encounter. He cannot do the latter because of certain logical properties of theories that endow them with unfathomable depths. Marxism and Freudianism serve as case studies, especially for the analysis of Popper's notion of the immunizing stratagem, a methodological/logical device that is supposed to save theories from criticism. "Immunizing stratagems" either abandon the ideology they are meant to protect or seriously lower its chances of being reproduced. (shrink)

In Nigeria, if the effects of development policies were felt by every Nigerian citizen, the search for respite would have assumed committed and prompt dimensions. Common hindrances to social development seem to be inflation, corruption, embezzlement, extreme ethnicity, selfishness and man's inhumanity to man. Nigeria has suffered exploitation in two phases: first in the colonial era, and second, during the post-colonial era, in which the nation is struggling against the forces of independent colonialism by its own people. Nigerians have approached (...) their struggles in various dimensions. Their criticisms have been registered freely in newspapers, magazines, radio and television. Yet, nothing has changed. Many have suffered different shades of attacks and embarrassment in the course of protest, while a few are doing it intellectually through some literary means. Chris Nwamuo, a Theatre Arts Administrator, a teacher, a playwright and a play director falls within this category. He has offered his voice as a cry for the underdogs of this society and has exhibited this attribute in several of his plays, one of which is The Prisoners. The play makes the author a "Marxist" in some way. The theory of class struggle forms the basis of modern socialism pioneered by Karl Mark, Friedrich Engels, as well as the conservative advocate of social reform, Lorenz Von Stein (Killian and Turner 279). The theory of class struggle, encapsulated in class-consciousness in its restricted sense, incorporates as a central feature, the burning conviction that members of a class suffer from a shared state of injustice. In the Marxian analysis, class-consciousness has always been understood as a political consciousness of one's own rational class interests and their opposition to the interest of other classes. The article analyzes the views on the philosophy of Azerbaijan Enlightenment, the famous Azerbaijani historian of philosophy of the XX century, Enver Mirzekulievich Akhmedov (1920-1984). E.Akhmedov was one of the first scientists who studied the Azerbaijan philosophy of enlightenment in stages and systematically. He briefly referred to the legacy of almost every author, thoroughly studied by him during the period of Azerbaijan Enlightenment. E.Akhmedov managed to create a general philosophical picture of the era of enlightenment in Azerbaijan, which was formed (...) from the beginning of the XIX century and went through a difficult path of development until the 20s of the XX century. Despite the fact that in his works on the history of philosophy he tried to preserve scientific objectivity as much as possible, there is an ideological line of that time in his legacy, which is observed among most of our scientists who conducted research in the field of social sciences during the Soviet period. This moment makes it impossible, without a critical approach, to comprehend within the framework of the modern scientific paradigm, the rich legacy of E.Akhmedov and other historians of philosophy of the Soviet era. The obligatory Marxist-Leninist line of the Soviet era, the search for materialism and atheism in every period and thinker of the history of philosophy, unfortunately, undermines the scientific objectivity of research at this stage. The interpretation of such factors in the legacy of E.Akhmedov and our other scientists, based on scientific and philosophical critical analysis, allows the works of our historians of philosophy of the Soviet period to remain relevant in our time. Cinema is neither neutral nor a universal medium. Particularly in African contexts, cinema contributes to European exceptionalism, imposes European values as the norm, and acts as an instrument of cultural and psychological control. It seems that African cinema is ontologically, politically, and aesthetically Eurocentric. By introducing an intercultural philosophical approach to the realm of cinema, we aim to move away from Eurocentrism in African cinema towards a more intercultural and dialogical orientation as an input for the liberation of humanity. (...) Based on findings from a dramaturgical analysis of five films, we argue that African cinema shows a deficiency in communicating liberation and it often fails to portray African people’s values, will, and interests as it has been alienated from its nature and purpose. Overall, African cinema seems to be either in a state of assimilation or confusion. By exploring aesthetics of liberation in African cinema and art (as described in African and intercultural philosophy,) we search for alternative film aesthetics and a mode of filmmaking that seeks to liberate the image and the minds of the filmmakers and spectators of African cinema. Inspired by Kimmerle’s aesthetic-ethic alternative ‘Living (with) art’, we propose an alternative for critical filmmaking based on aesthetics of liberation with an intercultural orientation: Living cinema. Living cinema is a dialogical and liberational cinema with aesthetics of liberation at its core. Based on aesthetic-ethic principles of African philosophy and interculturality, the liberating function of living cinema can be found in reconnecting the aesthetics and filmmaking with African values. Simultaneously, it might be contributing to the liberation of world cinema as it has an impact on both the hegemonic and the suppressed cinema. (shrink)

This study which utilized the critical analysis, analyzed Wittgenstein’s concept of language-game and its implications in philosophical discipline and contemporary society. To delineate the origin of the problem of language in terms of epistemological dimension, the researcher analyzed the related concepts on classical philosophy. To determine the origin of the concept of language-game, the researcher used the historical method. To constructively criticize the end-goal of language-game, the hermeneutical approach of Hans Georg Gadamer was employed. From the findings and with (...) the aid of the above-mentioned methods, the researcher had come up with these conclusions. Language is inalienable in the sociological nature of man. Man is always related or connected to the other. In this sense, man shares his very subjectivity with the other. Unless he realizes this, he cannot actualize the essential part of his nature. In every aspect of man’s life, it is imperative for him to negotiate, communicate, and collaborate with the members of his household and society. Wittgenstein is the one of the philosophers who gave deeper commitment and emphasis on the concerns of language in man’s life. Mastering our use of language is not just for the sake of conventional understanding, but, more importantly, we use it in its proper context in order to express our thoughts clearly and in the process to understand ourselves. It is because, as we speak or write using language as medium of communication, we are projecting ourselves to the other. If we come up with the c common understanding, then we will be able to create a harmonious society. This study provided the readers with a better understanding of the importance of proper use of words or terminologies in their proper context. It is because this research delved on the conceptual and analytical mechanisms of using language in order to give a systematic pattern of corrective thinking and application for word’s use. Aside from affirming the importance of language in connection with our contemporary activities, this research looked into a deeper realization on the workings of language. This realization originated from Wittgensteinian context of understanding. As affirmation for Wittgenstein, it is appropriate to say that to understand a word in its proper context is to understand the sentence. To understand a sentence is to understand a language. To understand a language means to be master of technique. This signifies that understanding is to know how to do something; in the case of language, understanding language means knowing how to use it. The researcher realized that understanding the meaning of a word is not something private to the mental life of an individual, but something which exist out in the open, in the public domain. This means that understanding the meaning is objectively understandable by people. However, the researcher did not agree with Wittgenstein’s view that philosophy should stop once we clear the way of understanding how our language works. Instead, the researcher adheres to the fact that philosophy as enterprise is an undying process in search for truth. For the researcher, we do not stop philosophizing because our imaginations continue to desire progress in terms of creativity. Thus, he affirmed Gadamer in claiming that we should not hinder our philosophical endeavors by breaking it. Even if we can clear the confusions and misunderstanding of language, still our active minds cling to what is new in the field of learning things. This research led to the formulation of other theories which can be useful tool in understanding the complexities with regards to ourselves and our society as a whole. Freedom is a necessary prerequisite for living, as most existentialists emphasized. A prominent existentialist, Sartre, fully appreciated the importance of freedom in helping humans lead authentic lives. In his philosophical magnum opus, Being and Nothingness, he boldly contends that human beings possess absolute freedom, meaning they are not determined by external factors or pre-existing essence, and are therefore responsible for creating their 'own' meaning and purpose in life. Admittedly, Sartre claims that man's freedom is tied to responsibility. He proposed the (...) notion of freedom and responsibility as a moral compass for leading an authentic existence. This critical analysis explores Sartre's notion of existential freedom, focusing on its philosophical conceptions, implications, and deficiencies. This paper will properly understand Jean-Paul Sartre's notion of freedom and responsibility, starting by defining freedom in the way Sartre wants us to conceive it. This paper will examine some of the objections raised by Alvin Plantinga against Sartre's philosophy of freedom. And finally, this paper will also analyze Sartre's notion of freedom and responsibility and reveal its incompatibilities with universal morality. By critically evaluating Sartre's concept of existential freedom, this analysis aims to contribute to a deeper understanding of his existentialist philosophy and stimulate further dialogue on the nature and implications of human freedom. One of the central strengths of Salem's analysis of Nasserism is that she recognizes both its world-historical significance as a progressive nationalist movement, and its severe limitations. In the first section of this paper, I discuss Salem's notion of the "afterlives" of the Nasserist project by drawing attention to one of the most debilitating legacies of that project, namely the transformation of Egyptian politics into petty bourgeois politics. In the second section, I argue that while Salem does not explicitly draw (...) on Hegel's understanding of tragedy in her account of Nasserism, her analysis of Nasserism essentially amounts to depicting it as a Hegelian tragedy. By placing Salem's book in conversation with Hegel (and his philosophy of action), we can make explicit what I take to be one of the central claims made by Salem, namely that when passing judgment on past and present national liberation movements we should remember that innocence is "only non-action, like the mere being of a stone" [nur das Nichttun wie das Sein eines Steines] (Hegel 1986, 346). In the third section of this paper, I raise some critical points about Salem's characterization of the nationalism that was associated with the Nasserist project, as well as about the deployment of the concept of modernity in her analysis. I argue that her account of modernity in the book does not distinguish between the concept of modernity as it refers to a certain kind of normative philosophical discourse, and modernization theory qua theory of development. Finally, I draw on Salem's use of the concept of hegemony in order to pose a question regarding the political significance of the contemporary cultural hegemony of Islamist movements in Egypt. The main thesis of this paper is that justice is not a natural law that (re)establishes equilibrium and order in the universe, but a disposition enforced by a fighting will to render to every man his due in line with a regime of rights, powers, or immunities to use, enjoy and control some external goods. Inasmuch as there is no sense, feeling or instinct of justice, it is reasonable to assert that people regulate their conduct under the authority of a (...) legislative authority according to certain ideas of justice, which they adopt and promote through a steady effort of knowledge and will. Critical analysis of the main types of justice − associative justice, punitive justice, corrective justice, restorative justice, functional justice, normative justice, commutative justice and distributive justice − from a liberal democratic perspective highlights the formal requirements of justice in different social arrangements and in relation to various aspects of personal and social life. Because it lacks a natural foundation of justice and people have strong interests in enforcing a certain idea of justice, public debates about justice entail a clash of militant wills. Debaters engage in a struggle for political hegemony trying to exclude from the public sphere the rival ideas about justice. In other words, all substantive debates about justice are carried out in an agonistic public sphere. The more civilized and reasonable the agonistic debates about justice are, the more likely the idea of justice is to fit the vital interests of individuals and society. (shrink)

This essay considers the theoretical disagreement between Isaiah Berlin and Hannah Arendt on the meaning and value of freedom. Berlin thinks that negative liberty as non-interference is commendable because it is attuned to the implication of value pluralism that man is a choice-making creature and cannot be otherwise. By contrast, the political freedom to act is in Arendt’s view a more fulfilling ideal because it is only in political action that man’s potentiality is actualised, his unique identity manifested and his (...) being-in-the-world-with-others reaffirmed. What lies beneath the two thinkers’ dispute over the most satisfactory meaning of freedom, I argue, is a deeper disagreement over human nature itself. The implication of this analysis for the contemporary debate between pluralist liberals and their agonistic critics is briefly discussed in conclusion. (shrink)

Across a wide range of cultural forms, including philosophy, cultural theory, literature and art, the figure of the clock has drawn suspicion, censure and outright hostility. In contrast, even while maps have been shown to be complicit with forms of domination, they are also widely recognised as tools that can be critically reworked in the service of more liberatory ends. This paper seeks to counteract the tendency to see clocks in this way, arguing that they have many more interesting possibilities (...) than they are usually given credit for. An analysis of approaches to clocks in continental philosophy critiques the way they have too often been dismissed as unworthy of further analysis, and argues that this dismissal is based upon an inadequate understanding of how clocks operate. Seeking to move towards more critical and curious approaches, the paper draws inspiration from critical cartography in order to call for the development of a ‘critical horology’ which would emphasise both the fundamentally political nature of clocks, and the potential for designing them otherwise. A discussion of temporal design provides a range of examples of how clocks might open up new horizons within the politics of time. (shrink)

In a 1978 lecture in Tokyo, Foucault drew a comparison between his own philosophical methodology and that of ‘Anglo-Saxon analytic philosophy’, claiming the label ‘analytic philosophy of politics’ for his own approach. This may seem like a somewhat surprising comparison given the gulf between contemporary analytic and continental philosophy, but I argue that it is a very productive one which indeed might help us reconsider this gulf. I proceed through a comparison between Foucault and the speech act theory of J. (...) L. Austin, one of the analytic philosophers Foucault had in mind in his Tokyo lecture. By focusing on the methodological commonalities between Foucault and Austin, this article identifies the core of a philosophical methodology that cuts across the analytic/continental divide in philosophy in general while constituting a powerful alternative to the methods applied by analytic political philosophers specifically. This approach, which I term ‘analytic critique’, is one that starts from a critical analysis of what happens in ordinary lived experience and theorizes ‘bottom-up’ in an avowedly politically engaged way – thereby challenging the conceptual and political aloofness of contemporary political philosophy in the liberal-Rawlsian tradition. Foucault’s appropriation of the label ‘analytic philosophy’, it is argued, ought to function as a call to more imaginative methodological-theoretical engagement across the traditional division between continental and analytic approaches. This paper introduces Richard Rorty’s notion of the liberal ironist and his vision of a liberal utopia and explores the implications of these for philosophical questions concerning morality, as well as morality in general. Rorty’s assertions of the contingency of language, society and self are explored. Under the contingency of language, the figure of the ironist is defined, and Rorty’s conception of vocabularies is discussed. Under the contingency of society, Rorty’s definition of liberalism, his opposition of literary culture to materialist (...) and metaphysical culture, and his notions concerning utopian politics are discussed. Under the contingency of self, Rorty’s critique of Kantian and his appropriations of Deweyan and Freudian conceptions of morality are presented. Other key factors discussed are Rorty’s theory of the separation of the private and public spheres of life and his ideas concerning cruelty and human solidarity. In this way, a critical analysis of Rorty’s proposed balance between private, ironic doubt and public, liberal social hope is presented and assessed in terms of its merit as a system of thought suited to the needs of post-metaphysical, liberal societies. Every activity of man is often done in a certain way. This includes the study of religion. Scholars have generally adopted various methods in studying religion. Some of these methods have been classified as unacademic, while some are academic and scientific. It is accepted that the proper way to study religion academically is through the scientific method which is a systemic and objective analysis of religious phenomena (Kirkpatric ed. 1159). Some other methods identified include: the polymethodic approach, descriptive approach, speculative (...) approach, culture area approach. Others are the use of library, interviews, online sources and participant observation. This paper is an attempt to identify and critically evaluate the methods used by three scholars of African traditional religion and culture in presenting selected topics in their works. In the process, the merits and demerits will be highlighted and constructive suggestions will be given. (shrink)

Exploring online criticisms of the ‘take the knee’ protest during ‘Euro 2020’, this article examines how alt- and far-right conspiracies were both constructed and communicated via the social media platform, Twitter. By providing a novel exploration of alt-right conspiracies during an international football tournament, a qualitative thematic analysis of 1,388 original tweets relating to Euro 2020 was undertaken. The findings reveal how, in criticisms levelled at both ‘wokeism’ and the Black Lives Matter movement, antiwhite criticisms of the ‘take the knee’ (...) protest were embroiled in alt-right conspiracies that exposed an assumed Cultural Marxist, ‘woke agenda’ in the tournament’s organization and mainstream media coverage. In conclusion, it is argued that conspiratorial discourses, associated with the alt-right, provided a framework through which the protest could be understood. This emphasises how the significance of conspiracy functions to promote the wider dissemination of alt-right ideology across popular cultural contexts, such as sport. (shrink)

The ‘Warsaw School of History of Ideas’ is the name given to a ‘revisionist think tank’ which was led by the historian Bronisław Baczko from 1956 to 1968 in Communist Poland. This group reunited scholars like Leszek Kołakowski or Krzysztof Pomian around questions related to political believes, theological conceptions or utopian thought. Expelled from the University, B. Baczko left Poland and seek shelter in Geneva where he became a Professor of history of Ideas and historiography. Katerina Kolozova is a Macedonian philosopher whose publications from last two decades aim to analyze various topics using François Laruelle’s “non-philosophy” or “non-standard philosophy.” Non-philosophy could be roughly described as radicalized deconstruction: Laruelle claims that not everything can be grasped by a philosophy: for Laruelle, “philosophy is too serious an affair to be left to the philosophers alone.”1 Non-philosophy opposes the “principle of sufficient philosophy” through which philosophy determines and decides what is real. According to Laruelle, the ultimate limit of (...) philosophical thought and its self-proclaimed sufficiency lies in its inherent tendency to close itself in a transcendental system of autofetishist conceptions, which presume that one can grasp the Real (“The Real is neither capable of being known or even ‘thought,’ but can be described in axioms. [...] Even ‘immanence’ only serves to name the Real which tolerates nothing but axiomatic descriptions or formulations.”) by a philosophical thought, or that the Real could be mediated only through human thought. Laruelle criticizes this tendency of philosophy, which is usually expressing itself through the structure of “philosophical Decision.” (“To philosophize is to decide Reality and the thoughts that result from this, i.e. to believe to be able to order them in the universal order of the Principle of Reason [Logos].”) Katerina Kolozova use Laruelle’s non-philosophy to explore more explicitly political topics. In the Cut Of Th e Real (2014), she criticized certain dogmatism of poststructuralist philosophy and feminist theory, namely their symptomatic rejection of the Real and the One. In Toward a Radical Metaphysics of Socialism (2015) and The Lived Revolution (2016) Kolozova presented a rereading of Marx, whose work she found relevant for the critique of speculative philosophical dimension of the capitalist economy, embodied in the 2008 global finance crisis, and in the latter book, she explored the possibility of a new political solidarity, based on “bodies in pain.” Kolozova doesn’t call to philosophically reconstruct Marx’s thought for the current situation, but she goes back to Marx with the help of Laruelle’s non-Marxism, contrary to the usual approach of Marxist philosophers, who often try to create certain philosophical system of Marx’s work. Together with Eileen A. Joy, Kolozova edited the anthology After the “Speculative Turn” (2016), which addressed recent realist and materialist tendencies in feminist philosophy. In her most recent book, Capitalism’s Holocaust of Animals (2019), Kolozova aimed to explore broader philosophical foundations of neoliberal capitalism, and its dealing with nonhuman animals and their suffering. According to Kolozova, “We have to start by coming to terms with what we did to the animals in the constitutive act of philosophy and via proxy to all those dehumanised that belong to the species of man ‘by courtesy’ only.” . This article advances a critical analysis of John Rawls’s justification of liberal democratic nuclear deterrence in the post-Cold War era as found in The Law of Peoples. Rawls’s justification overlooked how nuclear-armed liberal democracies are ensnared in two intransigent ethical dilemmas: one in which the mandate to secure liberal constitutionalism requires both the preservation and violation of important constitutional provisions in domestic affairs, and the other in which this same mandate requires both the preservation and violation of the liberal (...) commitment to international legal arrangements and to the rule of law generally. On this view, the choice to violate constitutional provisions and international legal arrangements is evidence of nuclear despotism. Moreover, this choice does not imply that the ethical foreign policy dilemmas were resolved. Instead, it implies that the dilemmas force liberal democratic governments into implementing ethically paradoxical policy outcomes. (shrink)

En este texto se realiza un análisis marxista del concepto de liberación animal en Peter Singer y Gary Francione, mostrando su convergencia liberal. El estudio comparativo se inscribe en el paradigma marxista dentro de los Critical Animal Studies (CAS) y la filosofía práctica. En un primer momento, se muestran las divergencias y convergencias entre el bienestar utilitario y la abolición deóntica, el neobienestarismo y el abolicionismo, haciendo énfasis en una preferencia común y fundamental por una sociedad liberal democrática post-especista (...) (i.e. un capitalismo democrático). En un segundo momento, desde una lectura marxista, se muestran dos potencialidades del principio de igual consideración y el principio de no reificación. En un tercer momento, se examinan las limitaciones de la crítica antiespecista a la explotación de los animales por las sociedades capitalistas, la desnaturalización de su especismo y el planteamiento de una topología política liberal reformista. Al final del proceso, se recapitulan y sopesan las cinco convergencias halladas, al igual que las dos potencialidades y limitaciones de los conceptos, como contribuciones a nuevos estudios sobre crítica e interpretación de los autores y nuevos abordajes del problema de la liberación animal. -/- This work realize a Marxist analysis of the concept of animal liberation in Peter Singer and Gary Francione, showing their liberal convergence. The comparative study is part of the Marxist paradigm within the Critical Animal Studies (CAS) and practical philosophy. At first, the divergences and convergences between utilitarian welfare and deontic abolition, new welfarism and abolitionism are shown, emphasizing a common and fundamental preference for a post-speciesist liberal democratic society (i.e. a democratic capitalism). In a second moment, from a Marxist reading, two potentialities of the principle of equal consideration and the principle of non-reification are shown. In a third moment, the limitations of the anti-speciesist critique of the exploitation of animals by capitalist societies, the denaturation of their speciesism and the approach of a liberal reformist political topology are examined. At the end of the process, the five convergences found are recapitulated and weighed, as well as the two potentialities and limitations of the concepts, as contributions to new studies on criticism and interpretation of the authors and new approaches to the problem of animal liberation. Marxism has long been subject to criticism from the theorists of Political Ecology, and in recent years, as the concerns of Green thinkers have become harder to ignore, Marxists have begun to respond to this challenge, defending and sometimes amending Marxist theory in response to Green criticisms. This paper addresses one issue within this debate: the controversy over Marx’s commitment to the growth, or development, of the productive forces. My aim is to dispute the contention of Marx’s Green critics, that (...) his concept of the development of the productive forces leads inevitably to the exacerbation of ecological problems, and, more speculatively, to suggest some advantages of using this concept to investigate ecological problems. The thesis that there is a reciprocal relationship between human beings and work—i.e., although man controls work, he may find in it either fulfillment or degradation—has its roots in the Marxist theory of alienation. This paper, therefore, tackles this problem from a Marxist perspective. It examines Marx and Engels’s analysis of the history and causes of human alienation by presenting their views on human nature and how work is related to the individual’s search for meaning and fulfillment. The two—man and (...) work—cannot be separated, for doing so leads to alienated work (production alienation) and alienated worker (self-alienation). Hence, the problem of employee satisfaction has to be dealt with from the perspective of how employees experience their relation to their work. (shrink)

During the last two years, senior high school teachers struggled with course contents in a neoliberal education. While the Mass Training of Teachers (MTOT) focuses on pedagogical knowledge, their concern is to deepen their content knowledge. As a result, they face difficulty in teaching the subjects, one of which is Marxism under Disciplines and Ideas in the Social Sciences (DISS). Enriching this paper, the query turns to the key participants of the sector and seek their insights. Then, critical analysis (...) applies what the literature says about the way Marxism is taught. This book was completed by the early 1960s and published in 1984 but it has not lost its topicality, for it contains an important re-assessment of the relations of two main streams of contemporary philosophy - the Analytical and the Dialectic. Adherents and critics of these traditions tend to assurnethat they are diametrically opposed, that their roots, concerns and approaches contradict each other, and that no reconciliation is possible. In contradistinction Russell derives both traditions from the common root of the (...) dissatisfaction with the arguments against speculative philosophy. These according to the author leave a lacuna - certain elementsof our Weltanschaaung have been removed, but they cannot be removed without replacement lest we have an incomplete world view, so incomplete in fact that it cannot be viable. According to Russell part of this vacuum is taken up by the analytical tradition but this tradition is not capable of taking up the remainder of it. That portion of the vacant space is however taken up by the dialectical tradi tion, which in turn cannot itself handle the whole of the problem. Thus the two reactions to the demise of speculative philosophy appear to be complementary in at least this sense. But the author goes further, for according to hirn the analytical arguments themselves clearly point to the emergence of dialectical problems, and the dialectical problems themselves need some such background to arise. Intimate partner violence (IPV) perpetrated by women against men is a prominent yet hidden phenomenon. Given that little is known about this problem, this study set out to analyse discourses from publicly available groups, pages and accounts on Facebook to gain further insight into the perpetration of violence by women against men within heterosexual intimate relationships. This study is shaped by three objectives. First, the various forms of IPV that females perpetrated against their male partners were investigated in accordance with (...) the South African Domestic Violence Amendment Act 14 of 2021. Secondly, the study analysed publicly available discourses in the form of posts, comments and replies that Facebook Users employed to narrate IPV against men. Third, the study investigated the role of social media in the area of female perpetrated IPV. The application of critical discourse analysis as a theoretical framework exposed the hidden power dynamics that worked silently and implicitly in the texts to conceal the injustice and oppression of violence perpetrated by women against men. Legitimation strategies such as positive self-representation and negative representation of the ‘other’, were used to make IPV perpetration appear natural and necessary. Discourses of humour, demon possession and witchcraft signaled a strong denial of female perpetrated IPV. These discourses were shaped by masculinity ideology, patriarchy and the social conditions of the country. These factors determined properties of discourse as Facebook Users drew on them to make sense of female perpetrated IPV. The role of social media as a platform for engagements on this issue was equally crucial as users were able to resist power dynamics and counter dominant hegemonic discourses that legitimise female perpetrated IPV. While research on the subject of female perpetrated IPV in South Africa is growing, there is a still a gap from a social media perspective that analyses discourses from a critical linguistic perspective to reveal the hidden power dynamics that contribute to the continuation of this phenomenon. This study attempted to address this gap and concluded that masculinity ideology, patriarchy and high levels of femicide in the country are central to the legitimation of female perpetrated IPV. The position of this paper is that the political developments in Nigeria has bearing with Protagoras’ “man is the measure”. This dictum simply implies humanism. It is based on this that this work posits that humanism is what underlies and informs the political developments in Nigeria. Hence, it is argued that all the political eras in Nigeria have the well-being of human beings as their impetus. Thus, this work is premised on the need to meet up with the welfare of (...) Nigerians, in which its failure has resulted in the political developments experienced within the Nigerian-nation states. This conclusion is reached through critical analysis and evaluation. I argue that trends of diagnosing anti-Muslim attitudes and activism as “Islamophobia” in European and the U.S. contexts may actually aid and abet more subtle varieties of the very stigmatization and exclusion that the “phobia” moniker aims to isolate and oppose. My comparative purpose is to draw into relief—to make explicit and subject to critical analysis— features of normative public discourse in these two sociopolitical contexts broadly perceived to be peaceful, prosperous, liberal-democratic. The features I focus on function under (...) the auspices of tolerant and nonexclusionary forms of “civic nationalism” that, in effect, fuel the conflict in question. (shrink)

One has to be dedicated to learn the jargon and then plow through 551 pages of text and 238 pages of notes. Meanwhile, we are told time and again that this is just an outline of what is to come! -/- Though he severely criticizes the excesses of the three movements, (...) this is a deconstructive and New Age Mystical and postmodern interpretation of religion, philosophy and the behavioral sciences from a very liberal,spiritual point of view—i.e., without the worst of decon, pm and NAM jargon, rabid egalitarianism and anti-scientific anti-intellectualism. -/- He analyzes in some detail the various world views of philosophy, psychology, sociology and religion, exposing their fatal reductionistic flaws with (mostly) care and brilliance, but most of the sources he analyzes are of almost no relevance today. They use terminology and concepts that were already outdated when he was researching and writing 20 years ago. One has to slog thru endless pages of jargon -laden discussion of Habermas, Kant, Emerson, Jung et.al. to get to the pearls. -/- You get a terrific sampling of bad writing, confused and outdated ideas and obsolete jargon. -/- If one has a good current education, it is doubly painful to read this book (and most writing on human behavior). Painful because it´s so tortured and confusing and then again when you realized how simple it is with modern psychology and philosophy. The terminology and ideas are horrifically confused and dated (but less so in Wilber´s own analysis than in his sources). -/- This book and most of its sources are would-be psychology texts, though most of the authors did not realize it. It is about human behavior and reasoning-about why we think and act the way we do and how we might change in the future. But (like all such discussion until recently) none of the explanations are really explanations, and so they give no insight into human behavior. Nobody discusses the mental mechanisms involved. It is like describing how a car works by discussing the steering wheel and metal and paint without any knowledge of the engine, fuel or drive train. In fact, like most older ´explanations` of behavior, the texts quoted here and the comments by Wilber are often more interesting for what kinds of things they accept (and omit!) as explanations, and the kind of reasoning they use, than for the actual content. -/- If one is up on philosophy and cognitive and evolutionary psychology, most of this is archaic. Like nearly everyone (scholars and public alike--eg, see my review of Dennett´s Freedom Evolves and other books), he does not understand that the basics of religion and ethics-- in fact all human behavior, are programmed into our genes. This chapter interrogates the role that liberalism plays in Immanuel Wallerstein’s grand and sweeping narrative of modern history. From liberalism’s beginnings as an ideological response to the French Revolution in 1789, to its apotheosis in the global hegemony of the USA after the Second World War, to its final dissolution in the collapse of Soviet communism, liberalism is the analytical thread that animates Wallerstein’s World-Systems Analysis of the modern period. Anthropological problems are among the eternal problems of philosophy. This issue is especially actualized at critical moments in the development of society. This is the period humanity is going through today. The revival of anthropocentric types of research, finding new ways and a holistic approach to human research proves the relevance of this study. Humanity is once again experiencing a paradigm shift in world history. The first quarter of the XXI century showed itself as an intensification of globalization processes, (...) which in turn led to multiple ups and downs of cultural and social life. The idea of a polycentric, multipolar world remained only in the mode of a categorical imperative. The coming form of human existence, if it takes place, should not only restore to people the meaning lost during the industrial civilization, but also avoid the costs of a dangerous alliance of information technology and biotechnology. In the context of the next threat of total war and the threat of a split in the world, an appeal to comparative philosophy should contribute to the final approval of such a worldview, which is based on the value of human life, brotherhood and spiritual unity of all people. The modern, global world is characterized by the inevitable interpenetration of cultures, the erasure of the boundaries of cultural areas. The article provides a comparative analysis of modern philosophical and anthropological concepts. Speaking as an approach and method, philosophical comparative studies continue its development in philosophical and anthropological knowledge, where it becomes one of the methodological directions. The article analyzes the modern anthropological concepts of the West, which have found their reflection in the concept of mental causality by D. Kim and in the concept of "homo compensator" by O. Marquard. And also carried out a philosophical analysis of the philosophical and anthropological concepts of the East, which are reflected in the works of the Chinese philosopher F. Yulan, in Japanese existentialism N. Kitaro and in the concept of "hoodie" M. Iqbal. (shrink)

It is often supposed that Marxist philosophy and Wittgensteinian philosophy are not just very different but that they are opposed to each other. Wittgenstein was notoriously against theorizing in philosophy whereas Marx tried to give a scientific account of human society and culture. Marx famously said that ‘[t]he philosophers have only interpreted the world, in various ways; the point is to change it’, while Wittgenstein was concerned with conceptual considerations and had very little to say about workers' struggles. My aim (...) in this paper is to show that these apparent differences dissolve once one realizes that Marx and Wittgenstein thought differently about the nature of philosophy. In the course of coming to this conclusion I will look at misinterpretations of Wittgenstein's philosophy from Perry Anderson and Alex Callinicos as well as at Wittgensteinian criticisms of Marxist philosophers such as Leon Trotsky, John Rees and Slavoj Žižek. I will conclude that Marxist philosophers stand to gain from a clearer understanding of Wittgenstein's philosophy and that Wittgensteinians can similarly gain from an appreciation of the kind of analysis of economics, society and politics offered by Marxists. John Dewey is a pragmatic and evolutionary philosopher who, with his instrumentalist philosophy, seeks to apply philosophy as well as to update philosophy based on new findings in the field of experimental science. He believed that with the introduction of the Darwinian origin scheme, a great event had taken place in the world of natural sciences and a revolution had taken place in the thinking and way of thinking of the time. Dewey enters his new philosophy by using the problem (...) of changing the types and concepts that are inferred from it. According to Dewey, epistemology and conventional ethics have come to an end, and we need to bring about a fundamental transformation and revision. Keywords such as the essence of objects, the fundamental principles, the invisible objects that regulate or control our lives and our world, are challenged by Darwin's theory. Dewey's philosophy of inquiry criticizes absolute principles. Dewey's philosophy of ethics and epistemology is realized in nature, along with natural selection and with the mechanism of the principles of adaptation of living beings. Individual and society, opinion and action, world and hereafter, right and wrong, are two parts that Dewey tries to unite. He considers man and society as a single, continuous, organ-like or organic matter. Dewey's evolutionary ethics and epistemology can be useful as a new tool for the philosophical society of Iran, with the consideration that its practical results in our society should be constantly evaluated. What does social justice require in contemporary societies? What are the requirements of social democracy? Who and where are the individuals and groups that can carry forward agendas for progressive social transformation? What are we to make of the so-called new social movements of the last thirty years? Is identity politics compatible with egalitarianism? Can cultural misrecognition and economic maldistribution be fought simultaneously? What of the heritage of Western Marxism is alive and dead? And how is current critical social (...) theory to approach these and other questions? Much of the most productive work done in recent social theory has revolved around such issues, in particular, around those concerning the relationship between the politics of recognition and the politics of distribution. After the intense theoretical focus over the last fifteen years or so on the issues of recognition politics—multiculturalism, multi-nationalism, identity politics, group-differentiated rights, the accommodation of difference, and so on—some social theorists have worried that attention has been diverted from important issues of distributive equality—systematic impoverishment, increasing material inequality, ‘structural’ unemployment, the growth of oligarchic power, global economic segmentation, and so on. While some critics seem to have adopted a blunt ‘it’s the economy, stupid’ line of criticism,1 others have attempted to develop an overarching, integrative theoretical framework adequate to the diverse issues concerning both economic and cultural justice. For example, Axel Honneth proposes that a suitably developed and normatively robust theory of intersubjective recognition can adequately integrate an analysis of apparently diverse contemporary struggles: those for a just division of labor and hence, a fair distribution of resources and opportunities, as well as those for a culture free of identity-deforming disrespect and denigration. The vertiginous rise of right-wing populism, especially in its “nationalist, xenophobic and conservative form”, and some “racist, anti-Semitic, homophobic and sexist” drifts associated with this phenomenon – whether real or perceived as such – make the mainstream media play a double role. On the one hand, the mainstream media reflect the struggle for political hegemony between different vested interests; on the other hand, they engage in the fight against right-wing populism blasting both right-wing populist candidates and their voters or supporters. (...) Many mainstream journalists ask citizens to realize a “sanitary cordon”, a “wall” or a “republican front” to block far-right populism and preserve liberal democracy. Moreover, they urge people to be wary of all attempts to “dediabolize” or “normalize” some tokens of right-wing populism. The main idea of this article is that right-wing populism is more harmless than is generally believed and, if excessive, negative media coverage doesn’t baffle but feed it. Populism is essentially a latent side effect of liberal democracy. Populism rises and becomes obtrusive only if a significant part of society perceives a regime of illiberal majoritarianism instead of one of liberal democracy. Right-wing populists are chiefly frustrated “ci-devants” who feel dispossessed of their past, identity, properties, qualities, privileges or titles. Inasmuch as the causes of collective frustration are many and varied (e.g. the real or just perceived corruption of the elites, the “system”, the deep state, the relocation of jobs, immigration, national sovereignty, national identity, communitarianism, radical Islamism, the status of some traditional institutions, some chapters of official history, etc.), there will always be right-wing populists, whether they are self-declared or covert. By adopting David G. Hackett’s thesis that the media are “agents of hegemony”, we applied the critical analysis of discourse to a set of 346 media articles in order to reveal the discursive sources of power, domination, inequality and partiality. The articles appeared in The New York Times and Le Monde during the period 2016-2017, at the time when the presidential elections took place in the United States and France. The articles were selected according to the occurrence of the keywords “Donald Trump” – “populism” and “Marine Le Pen” – “populisme” within the titles. The analysis of these articles reveals a divisive discursive structure that correspond to a real political cleavage in society. It is true that populism presents a “Manichean outlook”, in which there are only friends and foes” and no compromise is possible. It is also true that mainstream media reinforce this Manichean perspective on society and make populists feel marginalized and politically disempowered. The mainstream media may appease right-wing populism if they treat its followers as legitimate and equal political actors. For this, they have to give up the narrative structures that underscore insurmountable divergences and irreconcilable interests. In a liberal democracy, mass media should chiefly play the role of mediator. They may not aim to defeat or re-educate certain categories of citizens just because they advocate “wrong” political solutions. (shrink)

In this paper, I develop a quasi-transcendental argument to justify Kant’s infamous claim “man is evil by nature.” The cornerstone of my reconstruction lies in drawing a systematic distinction between the seemingly identical concepts of “evil disposition” (böseGesinnung) and “propensity to evil” (Hang zumBösen). The former, I argue, Kant reserves to describe the fundamental moral outlook of a single individual; the latter, the moral orientation of the whole species. Moreover, the appellative “evil” ranges over two different types of moral failure: (...) while an “evil disposition” is a failure to realize the good (i.e., to adopt the motive of duty as limiting condition for all one’s desires), an “evil propensity” is a failure to realize the highest good (i.e., to engage in the collective project of transforming the legal order into an ethical community). This correlation between units of moral analysis and types of obligation suggests a way to offer a deduction of the universal propensity on behalf of Kant. It consists in tracing the source of radical evil to the same subjective necessity that gives rise to the doctrine of the highest good. For, at the basis of Kant’s two doctrines lies the same natural dialectic between happiness and morality. While the highest good brings about the critically acceptable resolution of this dialectic, the propensity to evil perpetuates and aggravates it. Instead of connecting happiness and morality in an objective relation, the human will subordinatesmorality to the pursuit of happiness according to the subjective order of association. If this reading is correct, it would explain why prior attempts at a transcendental deduction have failed: interpreters have looked for the key to the deduction in the body of Kant’s text, where it is not to be found, for it is tucked, instead, in the Preface to the first edition. The liberal-egalitarian concept formulated by John Rawls in his book A Theory of Justice is still vehemently debated today. Critics of this concept include, among others, Rodion Belkovich and Sergei Vinogradov, according to whom Rawlsians inevitably face a dilemma: they need to reject either the difference principle or luck egalitarianism, and each of these solutions leads to the erosion of the basic foundations of Rawls’s theory. The article presents a detailed analysis of the arguments put forward by Belkovich and Vinogradov (...) and demonstrates that the dilemma they identified is flawed for three reasons. First, it blurs the distinction between luck egalitarianism and “straight egalitarianism,” which assumes the complete equality of income and wealth in society. Luck egalitarians do not support the idea of absolute equality in distribution and consider inequality that reflects people’s responsibility for their own choices fair. Second, Rawlsian egalitarianism is essentially equated with luck egalitarianism, while they represent two clearly distinguishable approaches. Third, the kidnapper’s argument, which proves that the difference principle is incompatible with luck egalitarianism, does not provide solid reasoning against the difference principle. The argument is only applicable under limited conditions, when the difference principle is embedded as an assumption in the “argument from incentives,” which in turn is put forward by the potential beneficiaries of this incentive. According to the author’s conclusion, the above mentioned considerations clearly indicate that Rawlsians do not face any dilemma of choosing between luck egalitarianism and the difference principle, and the criticism of Rawls’s theory proposed by Belkovich and Vinogradov should be considered groundless. A well-ordered society faces a crisis whenever a sufficient number of noncompliers enter into the political system. This has the potential to destabilize liberal democratic political order. This article provides a formal analysis of two competing solutions to the problem of political stability offered in the public reason liberalism literature—namely, using public reason or using convergence discourse to restore liberal democratic political order in the well-ordered society. The formal analyses offered in this article show that using public reason fails completely, (...) and using convergent discourse, although doing better, has its own critical limitations that have not been previously recognized properly. The Parmenides is arguably the pivotal text for understanding the Platonic corpus as a whole. I offer a critical analysis that takes as its key the closely constructed dramatic context and mimetic irony of the dialogue. Read with these in view, the contradictory characterizations of the "one" in the hypotheses dissolve and reform as stages in a systematic response to the objections that Parmenides earlier posed to the young Socrates' notions of forms and participation, potentially liberating Socrates from his (...) dependence on sensible simile and yielding a distinctively conceptual articulation of the difference and relation of forms and their sensible participants. The dialogue as a whole thereby functions as the means for the "conversion" of the soul to eidetic being for which Plato has the elder Socrates call in Republic VII. (shrink)

This paper analyses the interpretation of the Marxist dialectic proposed by three important French philosophers of the twentieth century: Maurice Merleau-Ponty (1908-1961), Jean-Paul Sartre (1905-1980) and Raymond Aron (1905-1983). Starting from different theoretical and political points of view, they criticize the historical determinism of the Marxist dialectic and propose three different “philosophies of freedom.” In the Adventures of the Dialectic (1955), Merleau-Ponty criticizes a theory of human history based only on economic structure, and denounces the violence of the Soviet communism. (...) He also accuses his friend Sartre – who had a more favourable attitude towards Soviet communism – of “ultrabolshevism.” Merleau-Ponty was subsequently active in the French non-communist Left. The existentialist philosopher Sartre always sympathized with the Left, and supported the French Communist Party (PCF) until the 1956 Soviet invasion of Hungary. In his Critique of Dialectical Reason (1960), Sartre also underlined the failure of the Soviet revolution, and criticized the violence of Marxist revolutionary thought. The last part of this paper deals with the philosopher and political sociologist Raymond Aron, who had a lifelong, sometimes fractious, friendship with Sartre. He always defended a “skeptical and anti-ideological” liberal position. In his best known book The Opium of the Intellectuals (1955), Aron argues that in post-war France, Marxism was the opium of the intellectuals. In this book, Aron chastised French intellectuals for what he described as their harsh criticism of capitalism and democracy and their simultaneous defense of Marxist oppression, atrocities, and intolerance. In opposition to the dialectical ideology of Marxism, Aron proposes an antitotalitarian philosophical and political theory based on the development of individual liberties. (shrink)

The Orthodox Churches are part of the ecumenical movement with the inner wish to clarify the theological elements which keep the whole Christianity divided. For this goal, every Church is represented somehow in discussions by her theologians who are training to carry a theological dispute at this level. The Romanian Orthodox Church was indirectly represented in the World Council of Church by professor Ion Bria (1929-2002), who had worked officially at the Ecumenical Centre in Geneva for more than 20 years. (...) This theological research has the aim to speak to us about Bria’s personality and ecumenical activity. In order to accomplish this goal, I will expand my research in three chapters. In the first one, I will present his biographical life. Until this moment he remains the most important Romanian theologian involved in the ecumenical dialogue. The second chapter deals with the history of the modern ecumenical movement and also with Bria’s perspective on the dialogue between Orthodoxy and ecumenism, which are for him two correlative elements. Bria comes to confront the anti-ecumenical part within the Orthodox Church who does not accept the Christian dialogue being afraid of heresy. Bria explain how through dialogue, the line between Orthodoxy and the other Christians can be overrun. In the third chapter I explain the missionary concept ‘liturgy after the Liturgy’, both historically and theologically. Being aware that there are some uncertainties around this concept I decided to clarify it in a proper way. Bria is known as the promoter of this concept, so I will search to find out who is the originator of this expression as such. In the same chapter I will analyze the ecclesiological elements from Bria’s writings. The ecumenical dialogue is interpreted of being an ecclesiological problem par excellence so I will outline Bria’s position regarding the teaching of the Church. In conclusion I will present in a synthetic way the results of this study. (shrink)

This article provides a critical analysis of the situationist challenge against Aristotelian moral psychology. It first outlines the details and results from 4 paradigmatic studies in psychology that situationists have heavily drawn upon in their critique of the Aristotelian conception of virtuous characteristics, including studies conducted by Hartshorne and May (1928), Darley and Batson (1973), Isen and Levin (1972), and Milgram (1963). It then presents 10 problems with the way situationists have used these studies to challenge Aristotelian moral psychology. (...) After challenging the situationists on these grounds, the article then proceeds to challenge the situationist presentation of the Aristotelian conception, showing that situationists have provided an oversimplified caricature of it that goes against the grain of much Aristotelian text. In evaluating the situationist challenge against the actual results from empirical research as well as primary Aristotelian text, it will be shown that the situationist debate has advanced both an extreme, untenable view about the nature of characteristics and situations, as well as an inaccurate presentation of the Aristotelian view. In Kritik der Macht, Axel Honneth analyzes the basic postulates of Max Horkheimer’s Critical Theory. This an-alysis is part of a broader examination of what he considers to be the main critical theories of the twentieth cen-tury. This work focuses on the analysis that Honneth carries out, and on the evaluation of the judgments that he makes of Horkheimer’s political-critic-al program. We propose to review the aporias that Honneth points out as deficiencies in Horkheimer’s theory, and then to (...) evaluate them in the light of the Critical Theory of the Frankfurt School founder. From the critical pos-itions that were developed, we will try to show that both projects conglomer-ate diverse disciplines such as Marx-ist theory, Freudian psychology and sociology. These theoretical incorpor-ations make important readjustments to the classical Marxist model and reconfigure the horizon of political action during the 20th century, offer-ing theoretical analyses that continue to be valuable in the spectrum of the political theory in the 21st century. Одной из особенностей прагматизма является, как известно, трактовка познания, свободная от апелляции к корреспондентной теории истины и постулирования независимой (от человека) реальности. Все прагматисты, к каким бы воззрениям по частным вопросам они ни склонялись, придерживаются операциональной концепции познания. Согласно этой концепции, достаточным основанием знания является его применимость на практике. Данный аспект неоднократно затрагивался в ходе дискуссий о сходствах и различиях марксизма и прагматизма. Несмотря на существенное расхождение между прагматизмом и марксизмом в понимании природы знания, многие исследователи пытались провести параллели между (...) этими двумя интеллектуальными традициями. В частности, Бертран Рассел указывал на близость философии Дьюи «доктрине другого экс-гегельянца, Карла Маркса, как она была сформулирована в его “Тезисах о Фейербахе”». По мнению Рассела, если не придавать слишком большого значения терминологическим нюансам, Марксова теория деятельности, или праксиса, в главных моментах «едва отличима от инструментализма». Этот взгляд получил распространение даже среди прагматистов, а также американских марксистов (точнее, троцкистов), которые в конце 40-х годов прошлого века трактовали прагматизм Дьюи как прямое продолжение и развитие марксизма. Дж. Новак, к примеру, утверждал, что «самым выдающимся современным мыслителем, впитавшим в себя все лучшее, что было у Маркса, является Дьюи». В. Ленина — как практика, а не теоретика — Новак считал, в свою очередь, «скрытым последователем» Дьюи. Согласно бывшему марксисту С. Хуку, прагматизм — это философия «экспериментального натурализма», т. е. теория, «развивающая наиболее здравые и продуктивные идеи Маркса о мире». В статье (с опорой главным образом на аргументацию советских марксистов) критически пересматривается философский диалог между марксизмом и прагматизмом. Основное внимание уделяется понятию деятельности, или праксиса, а также взаимосвязи субъекта и объекта в познании. // It is well-known that pragmatism advocates an approach on cognition without appealing to man-independent reality and truth as correspondence with reality. Instead, pragmatists, notwithstanding the diversity of their particular views, hold an operational conception of knowledge, according to which all that is needed is knowledge to have a suitable kind of correspondence with practice. This point has been scrutinized in the long standing discussion about the convergences and deviations between Marxism and pragmatism. The profound divergence between Marxism and pragmatism with regard to the aforementioned issues was not enough to prevent philosophers from attempting to trace affinities between these two distinct intellectual trends. For example, Bertrand Russell pointed out the “close similarity” of Dewey’s doctrine to “that of another exHegelian, Karl Marx, as it is delineated in his Theses on Feuerbach.” Russell thinks that Marx’s concept of activity or praxis is in spite of differences in terminology “essentially indistinguishable from instrumentalism.” This line of reasoning seems to be quite influential, even among pragmatists. Notably, some American Marxists (especially Trotskyists, to be exact) at the late 40’s overemphasized the affinity between Dewey’s pragmatism and Marxism, and even understood Dewey’s pragmatism as a continuation of Marxism. For example, G. Novack comments that “[t]he most outstanding figure in the world today in whom the best elements of Marx’s thought are present is John Dewey,” and presents Lenin as “an unavowed disciple of Dewey in practice.” According to S. Hook, a former Marxist who turned to pragmatism and became one of the most influential philosophers who discussed the relation between Marxism and pragmatism, the latter is “the philosophy of experimental naturalism” which can be regarded “as a continuation of what is soundest and most fruitful in Marx’s philosophical outlook upon the world.” In this paper, I intend to critically reassess this philosophical dialogue between Marxism and pragmatism, by further deploying the argumentation provided mainly by Soviet Marxists with regard to the aforementioned issues, focusing especially on two of them: the concept of activity (or praxis) and the interrelation of subject and object in cognition. Suppose we accept Nietzsche’s claim that critical reflection undermines our evaluative commitments. Then it seems that we are left with a pair of unappealing options: either we engage in critical reflection and find our evaluative commitments becoming etiolated; or we somehow immunize certain evaluative commitments from the effects of critical reflection. Nietzsche considers both of these paths, labeling the person who results from the first path “the last man” and the person who results from the second “the (...) fanatic.” I consider Nietzsche’s analysis of these two character types, discuss why he thinks that in modernity these are the options with which we are faced, and ask whether Nietzsche thinks that there is a third way. Art as Festival Art has been a privileged sphere in the sense that it appeales to art-receivers because of its power of taking them outside the sphere of everyday life (commonplaceness) and practicality. For the first time the philosophers of ancient Greece propagated this view. In this paper the Pythagorean and Aristotle’s views are considered; however they have different metaphysical bases, there is some aspect common to theirs aesthetics. In 20th century it is Helmut Kuhn, Hans-Georg Gadamer and Władysław Stróżewski (...) who express similar ideas and convictions about an exceptionality of the meeting between art and man. In the first part of the article (the ancient) notion of “leisure” (scholé) is presented, while in the second one the case of “festival”, Festlichkeit and Eigenzeit is taken into account. (shrink)

Arthur Kaufmann is one of the most prominent figures among the contemporary philosophers of law in German speaking countries. For many years he was a director of the Institute of Philosophy of Law and Computer Sciences for Law at the University in Munich. Presently, he is a retired professor of this university. Rare in the contemporary legal thought, Arthur Kaufmann's philosophy of law is one with the highest ambitions — it aspires to pinpoint the ultimate foundations of law by explicitly (...) proposing an ontology, a general theory of knowledge and concept of a person. Kaufmann's work derives, first of all, from the thinking of Gustav Radburch, his teacher, and then from ideas of Karl Engish and Hans-Georg Gadamer. The philosophy undertakes to pursue the ultimate foundation of law, law which is understood by Kaufmann, first of all, as a "concrete judgement" that is, what is right in a concrete situation. Justice belongs to the essence of law and "unjust law" is contradictio in adiectio. Kaufmann opposes all those theories, which as the only foundation for establishing just law (Recht) adopt legal norms (Gesetz). In Kaufmann's opinion , such theories are powerless in the face of all types of distortions of law rendered by political forces. He suggests that the basic phenomenon which needs to be explained and which cannot be disregarded by a philosopher of law is so-called "legal lawlessness" ("Gestzliches Unrecht"). "Legal lawlessness" which forms a part of life experience for the people of twentieth century totalitarian states. It proved "with the accuracy of scientific experiment" that the reality of law consists of something more than bare conformity with legal norms. The existence of lex corrupta indicates that law contains something "non-dispositive" which requires acknowledgment of both law-maker and judge. Kaufmann, accepting the convergent concept of truth and cognition, assumes that "non-dispositive" content, emerging as the conformity of a number of cognitive acts of different subjects (inter-subjective communicativeness and verifiability), indicates the presence of being in this cognition. The questions "What is law?" and "What are the principles of a just solution?" lead straight to the ontology of law, to the question about the ontological foundations of law. Kaufmann discerns the ontological foundations of law in the specifically understood "nature of things" and, ultimately, in a "person". He proposes a procedural theory of justice, founded on a "person". In my work, I undertake to reconstruct the train of thought which led Kaufmann to the recognition of a "person" as the ontological foundation of law. In the first part, the conception of philosophy adopted by Kaufmann, initial characteristics of law — of reality which is the subject of analysis, as well as, the requirements for proper philosophical explanation of law posed by Kaufmann are introduced. In the second, Kaufmann's reconstruction of the process of the realisation of law is presented. Next, the conception of analogy which Kaufmann uses when explaining law is analyzed. In the fourth part, Kaufmann's conception of ontological foundations of law is discussed. A critical analysis is carried out in which I demonstrate that the theory of the ontological foundation of law proposed by Kaufmann and the concept of a person included in it do not allow a satisfac¬tory explanation of the phenomenon of "legal lawlessness" and lead to a number of difficulties in the philosophical explanation of law. Finally, the perspectives of a proper formulation of the issue of the ontological foundations of law are drafted in the context of the analyzed theory. My interest is centered on the conception of philosophy adopted by Kaufmann, according to which the existence of the reality is inferred on the basis of a certain configuration of the content of consciousness, whereas at the point of departure of philosophy of law, the data to be explained is a certain process, which is, basically, a process of cognition, while the reality appears only as a condition for the possibility of the occurrence of the process. I wish to argue that the difficulties which appear in the explanation of law are a consequence of the assumed fundamental philosophical solu¬tions, which seem to be characteristic, though usually not assumed explicitly, in philoso¬phy and theory of law dominant at present in continental Europe. Thereby, I wish to show the significance of ontological and epistemological solutions to the possibility of a proper formulation of the problems posed by philosophy and theory of law. Kaufmann proclaims himself in favour of a philosophy which poses questions about the ultimate foundations of understanding of the reality. In epistemology, he assumes that answers to the questions "What is reality like?" and ultimately "What is real?" are inferred on the basis of uniformity of a cognitive acts of different subjects. Cognition of the reality is accomplished exclusively through the content of conceptual material. The two fundamental questions posed by philosophy of law are "What is just law?" and "How is the just law enacted?" The latter is a question about the process of achieving a solution to a concrete case. Since, in Kaufmann's opinion, law does not exist apart from the process of its realisation, an answer to the question about the manner of realisation of law is of fundamental significance to answering the question: "What is law?" and to the explanation of the question about the ontological grounding of law, which is, as well, the foundation of justice. The proper solution has to take into account the moment of "non-dispositive" content of law; its positiveness understood as the reality and, at the same time, it has to point to the principles of the historical transformation of the content. Law, in the primary meaning of the word, always pertains, in Kaufmann's opinion, to a concrete case. A legal norm is solely the "possibility" of law and the entirely real law is ipsa res iusta, that which is just in a given situation. Determination of what is just takes place in a certain type of process performed by a judge (or by man confronted with a choice). Kaufmann aims to reconstruct this process. A question about the ontological foundation of law is a question about the ontological foundations of this process. In the analyzed theory it is formulated as a question about the transcendental conditions, necessary for the possibility of the occurrence of the process: how the reality should be thought to make possible the reconstructed process of the realisation of law. Kaufmann rejects the model for finding a concrete solution based on simple subsump¬tion and proposes a model in which concrete law ensues, based on inference by analogy, through the process of "bringing to conformity" that which is normative with that which is factual. Kaufmann distinguishes three levels in the process of the realisation of law. On the highest level, there are the fundamental legal principles, on the second legal norms, on the third — concrete solutions. The fundamental principles of law are general inasmuch as they cannot be "applied" directly to concrete conditions of life, however, they play an important part in establishing norms. A judge encounters a concrete situation and a system of legal norms. A life situation and norms are situated on inherently different levels of factuality and normativeness. In order to acquire a definite law both a norm (system of norms) and a life situation (Lebenssachverhalt) should undergo a kind of "treatment" which would allow a mutual conformity to be brought to them. Legal norms and definite conditions of life come together in the process of analogical inference in which the "factual state" ("Tatbestand") — which represents a norm, and in the "state of things" ("Sachverhalt") — which represents a specific situation are constructed. A "factual state" is a sense interpreted from a norm with respect to specific conditions of life. The "state of things" is a sense constructed on the basis of concrete conditions of life with respect to norms (system of norms). Legal norms and concrete conditions of life meet in one common sense established during the process of realisation of law. Mutatis mutandis the same refers to the process of composition of legal norms: as the acquisition of concrete law consists in a mutual "synchronization" of norms and concrete conditions of life, so acquisition of legal norms consists of bringing to conformity fundamental principles and possible conditions of life. According to Kaufmann, both of these processes are based on inference through analogy. As this inference is the heart of these processes it is simultaneously a foundation finding just law and justice. How does Kaufmann understand such an inference? As the basis for all justice he assumes a specifically interpreted distributive justice grounded on proportionality. Equality of relations is required between life conditions and their normative qualification. Concrete conditions of life are ascribed normative qualification not through simple application of a general norm. More likely, when we look for a solution we go from one concrete normative qualified case to another, through already known "applications" of norms to a new "application". The relation between life conditions and their normative qualifica¬tion has to be proportional to other, earlier or possible (thought of) assignments of that which is factual to that which is normative. Law as a whole does not consist of a set of norms, but only of a unity of relations. Since law is a, based on proportion, relative unity of a norm and conditions of life, in order to explain law in philosophical manner, the question about ontological base of this unity has to be asked. What is it that makes the relation between a norm and conditions of life "non-dispositive"? What is the basis for such an interpretation of a norm and case which makes it possible to bring a norm and conditions of life into mutual "conformity"? This is a question about a third thing (next to norms and conditions of life), with respect to which the relative identity between a norm and conditions of life occurs, about the intermediary between that which is normative and that which is factual and which provides for the process of establishing of norms, as well as, finding solutions. It is the "sense" in which the idea of law or legal norm and conditions of life have to be identical to be brought to mutual "conformity". In Kaufmann's opinion such a sense is nothing else but the "nature of things" which determines the normative qualification of the reality. Since establishment of this "sense" appears to be "non-dispositive" and controlled inter-subjectively (namely, other subjects will reach a similar result) so, in conformity with the convergent concept of truth, the "nature of things" must be assigned a certain ontological status. According to Kaufmann this is a real relation which occurs between being and obligation, between the conditions of life and normative quality. However, it should be underlined that from the point of view of the analyzed system the "nature of things" is a correlate of constructed sense, a result of a construction which is based on the principle of consistent understanding of senses ("non-normative" and "normative") and is not a reality which is transcendent against the arrangement of senses. In Kaufmann's theory, inference from analogy appears to be a process of reshaping the concepts (senses) governed by tendency to understand the contents appearing in relations between that which is factual and that which is normative in a consistent way. The analogical structure of language (concepts) and recognition of being as composed of an essence and existence is an indispensable requirement for the possibility of the realisation of law, based on specifically understood inference from analogy. It is necessary to assume a moment of existence without content which ensures unity of cognition. Existence emerges thus as a condition of the possibility of cognition. According to Kaufmann, the "nature of things" is the heart of inference through analogy and the basis for establishment of finding of law. Inference from the "state of things" to a norm or from a norm to the "state of things" always means inference through the "nature of things". The "nature of things" is the proper medium of objective legal sense sought in every cognition of law. In Kaufmann's view, the question whether the "nature of things" is ultima ratio of interpretation of law or is only a means of supplement gaps in law or whether it is one of the sources of law, is posed wrongly. The "nature of things" serves neither to supplement the gaps nor is it a source of law as, for example, a legal norm may be. It is a certain kind of "catalyst" necessary in every act of making law and solving a concrete case. Owing to "nature of things" it is possible to bring to a mutual conformity the idea of law and possible conditions of life or legal norms and concrete conditions of life. In Kaufmann's conception the "nature of things" is not yet the ultimate basis for understanding the "non-dispositiveness" of law. The relation between obligation and being is determined in the process of the realisation of law. Both the process itself and that which is transformed in this process are given. A question about the ontological bases of "material" contents undergoing "treatment" in the process of the realisation of law and about being which is the basis of regularity of the occurrence of the process arises. Only this will allow an explanation that the result of the process is not optional. Thus, a question about reality to which law refers and about the subject realising the law has to be formed. To this, Kaufmann gives the following answer: that which is missing is man but not "empirical man" but man as a "person". A "person" understood as a set of relations between man and other people and things. A "person" is the intermediary between those things which are different — norm and case are brought to conformity. A "person" is that which is given and permanent in the process of the realisation of law. It determines the content of law, is "subject" of law; this aspect is described by Kaufmann as the "what" of the process of realisation of law. A "person" consists of precisely just these relations which undergo "treatment" in the process. On the other hand, a "person" is "a place" in which the processes of realisation of law occur, it is the "how" of normative discourse, a "person" is that which determines the procedure of the process, being "outside" of it. This aspect of a "person" is connected with the formal moment of law. A "person" being, at the same time, the "how" and the "what" of the process of the realisation of law, is also, to put it differently, a structural unity of relation and that which constitutes this relation (unity of relatio and relata). According to this approach a "person" is neither an object nor a subject. It exists only "in between". It is not substance. Law is the relation between being and obligation. That which is obligatory is connected with that which is general. That which is general does not exist on its own, it is not completely real. Accordingly, a "person" as such is also not real. It is relational, dynamic and historical. A "person" is not a state but an event. In Kaufmann's opinion, such a concept of a "person" helps to avoid the difficulties connected with the fungibility of law in classical legal positivism. A "person" is that which is given, which is not at free disposal and secures the moment of "non-dispositiveness" of law. Kaufmann concludes: "The idea (»nature«) of law is either the idea of a personal man or is nothing". Theory points at the structure of realising law and explains the process of adoption of general legal norms for a concrete situation. The analysis has shown however, that in this theory a satisfactory answer to the question about the ultimate foundations of law is not given. It seems that in the analyzed theory the understanding of human being takes place through understanding of law. What is good for man as a "person", what is just, what a "person" deserves may be determined only against the existing system of law. A "per¬son" adopted as a basis of law is the reality postulated in the analysis of the process of the realisation of law. It is a condition of possibility of this process ( explaining, on one hand, its unity and, on the other hand, the non-dispositive moments stated in this process). A "person" in the discussed theory is entirely defined by the structure of law, it can be nothing more than that which is given in law, what law refers to, what law is about. Being, which is a "person", is constituted by relations between people and objects, the relations which are based on fundamental links between norms and conditions of life established in a process of bringing them to conformity. It has to be assumed that man as a "person" is a subject of law only as far as realising law "treats" given senses according to their current configuration. The system of law is a starting point and it describes in content what man is as a "person". Moreover, being a "person" is the condition for entering legal relations. Consistently, Kaufmann writes that "empirical man" is not the subject of law, man is not "out of nature" a "person". People become "persons" due to the fact that they acknowledge each other as "persons" — acknowledging, at the same time, law. This acknowledgement is a con¬dition of existence, of the possibility of the occurrence of process of realisation of law and of constituting legal relations which ultimately constitute a "person". Kaufmann assumes, that law tends towards a moral aim: it may and must create an external freedom, without which the internal freedom to fulfil moral obligations cannot develop. However, this postulate is not based on the necessary structure of human being. From the point of view of his system, it is nothing more than only a condition for the possibility of the occurrence of the process of the realisation of law — lack of freedom would destroy the "how" of this process. Thus, the postulate to protect the freedom of personal acts has to be interpreted, in accordance with the analyzed theory, as a postulate, the fulfilment of which aims ultimately at the accomplishment of the very same process of realisation of law itself and not the realisation of a given man. Kaufmann considers a "person" to be an element which unites the system of law as a whole. Law is a structure of relations, which are interdependent and inter-contingent. Consequently, a "person" which is to form the ontological basis of law has to be entity consisting of all relations. Being also the "how" of the process of realisation of law, if a "person" is to warrant its unity, it has to be a common source for all procedures. Hence, a single "person" would constitute a subject of law. Man appears to be only a moment of a certain entirety, realisation of which should be an aim of his actions. Law, creating a "person" as an object and subject of law becomes a primary entity. In the analyzed theory, the basis for determination of aims which law sets to man is not the allocation of man-subject to something which improves him but rather, such relation is only just constituted by law. A question appears, why should aims set in law also be the aims of "empirical man"? Why is this "empirical man" to be punished in the name of a "person" understood in such a way? If, however, it is assumed that what is man is determined by a system which is superior to him, then man has to be understood only as a part of a whole and there are no grounds to prohibit istrumental treatment of man and so the road to all aspects of totalitarianism might be opened. A problem of the application of created theory to the reality arises, the reality which the theory pretends to explain. Ultimately in his theory Kaufmann does not give any systemic grounds for a radical questioning of the validity of any legal norms. Every new norm becomes an equal part of system of norms. It is only its interpretation and application to given conditions of life that may be disputable, however, this refers to all norms without exception. Cohesive inter-pretation of norms and applications is necessary and sufficient for the acquisition of just law. New norms have to be interpreted in the light of others, correspondingly, the other norms require reinterpretation in the light of the new ones. Contradiction in interpretation of a norm does not form a basis for questioning norms but may serve only to question the manner of their interpretation (understanding). Therefore, no grounds exist to assume any legal norm as criminal or unjust, and in consequence, to question any consistently realised system based on formally, properly established norms, as "legal lawlessness". As law and a "person" do not exist without the process of realisation of law, the role of legal safety becomes crucial as the condition for the possibility of the occurrence of the process of realisation of law. Denying legal safety would be tantamount to negation of law in general (also of moral law) as negation of safety takes away, at the same time, the basis for occurrence of the process of realisation of law. Moreover, any lack of legal safety would also mean lack of a basis for the existence of man as a "person". Kaufmann's thesis, that civil disobedience is legalized only when it has a chance to lead to success, consistent with his concept of the foundations of law, seems to point directly to conclusions which deny the facts taken under consideration and doubtlessly Kaufmann's own intentions, since it would have to be assumed that accordingly there are no grounds to question a legal system in force based on violence which secures its operation. Force finally seems to determine which one of the mutually irreconcilable normative systems constitute law and which does not. A legitimate position is one which leads to success, it is the weaker system which is negated. If so, then basically violent imposition of law is not an act directed against the law in force but, to the contrary, realisation of law. In the context of the new system the former system of law may be talked about as unjust solely in the sense of being incapable of being consistently united with the new. However, at the base, ultimately, lies force which reaffirms differences and excludes from the process of realisation of law certain norms and their interpretations. Kaufmann was aiming at grounding of that which is "non-dispositive" in a certain given framework of interpretation. Nevertheless, he does not provide foundations for the understanding of phenomena, which he undertakes to explain at a point of departure. Instead of explaining them the theory negates the possibility of their existence. The reality postulated in regard to "non-dispositive" moments of the reconstructed process of acquiring law consist of a specifically understood "person", which appears in Kaufmann's conceptions as a condition of the possibility of the realisation of law. According to this approach understanding of a "person" may be only a function of law. To understand "legal lawlessness" and foundations of justice it is necessary to look for such theory of law in which understanding of man as a "person" and being is not a function of understanding of law (in which a "person" is not only a condition for possibility of reconstructed process of realisation of law; for possibility of cognition processes). It seems necessary to start from theory of being and a "person" based on broader experience than the one assumed by Kaufmann and reconstruct the ontological foundations of the process of realisation of law only in such perspective. Kaufmann points out that that to which law refers is ipsa res iusta a concrete relation of man to other people and things. This relation, in his theory, appears to be basically only just constituted by law (normative senses "applied" to conditions of life). Therefore, understanding the relation between a given man and other people and things which constitute the aim of his actions, that is understanding of good, is enacted against the background of constitution of senses; constitution which is a result of a process aiming towards consistent understanding of particular contents (of nor¬mative and non-normative senses). "Being" is secondary towards constructed senses it is only their correlate. The primary relation consists of relation of a man to law (system of norms), while the secondary relation is one of man to something which is the aim of his action (relation between man and good). Considering such approach it is difficult to envision a satisfying answer to the fundamental question: why does law put concrete man under any obligation to obey it? The source of this problem can be seen in reduction of the base for understanding good to content of obligation formulated in auto-reflection. Such reduction seems to be a consequence of Kaufmann's adoption of "convergent concept of truth" and in con¬sequence his recognition of indirect, essentialistic grasp of reality formulated in concepts as the basic and only foundation of theory of being and of law. In view of such an approach, analogy of law, concepts and being is the condition for the possibility of the process of transformation of senses which aims at consistent interpretation of all law. Existence is postulated with respect to the possibility of unity of experience and cognition. However, also a different approach to understanding of the problem of being and good is possible. In spontaneous cognition being is affirmed, first of all, not as a certain, non-contradictory, determined content, but as something existing. Together with a cer¬tain content (passed indirectly through notions) existence of being is co-given. The basis for unity of being is not formed by the consistence of content, as it is in the case of the theories departing from the analysis of cognition processes, but by an act of existence realising content (essence). Such an approach makes it also possible to go beyond the convergent concept of truth. It is worth mentioning that allocation of an agent to good is realised not only by the content of duty. A statement that something is good is primary with respect to determination of this good in content. The recognised good always bears some content, however, there are no reasons to base the concept of good exclusively on indirect, formulated in concepts cognition. As primary, can be adopted the relation of man to good and not of man to law. Determination in content appears to be only an articulation of aspectual cognition of being, as an object of action. In such a case the basis for relative unity of norm and conditions of life is not the "nature of things" understood as correlate of sense but it is relation to good based on internal constitution of man as potential, not self-sufficient being. It does not mean, that the moments of the process of realisation of law singled out by Kaufmann are not important to determination of what is just. He, quite rightly, points to significant role played by norms in the evaluation of concrete situations, in man's search for closer specification in content of good innate to him. The structure of process of determining law for a concrete situation, to a great degree corresponds to the processes of determining law which take place not only in the legal sciences. Kaufmann's analyses of the process of realisation of law show the complexity of the structure of these processes and point towards important moments allowing a better understanding of law and man. Nevertheless, these analyses cannot be a basis for construction of philosophical theory of law, theory which hopes to point out the ultimate, ontological foundations for understanding law. Kaufmann's results may become fully valid only in a more general perspective including broader experience at the point of departure. (shrink)

This paper critically evaluates the classification of research-related fraudulent activities, with an emphasis on the specific misconduct falsification. The analysis begins by interrogating the assumption that all acts of fraud in research are intentional, suggesting that some instances may inadvertently arise during the course of scholarly activities. Misconducts like fabrication and falsification are categorized as fraudulent primarily due to their generation during research activities and their direct contribution to the distortion of scientific knowledge. Plagiarism, while deceptive, does not necessarily originate (...) from the research process nor lead directly to such distortion, and therefore is not classified as de facto fraud. The paper proposes that the definition of falsification – as established by the PHS – requires refinement to prevent wrongful allegations and convictions, enhance transparency, and offer clearer guidelines. This nuanced understanding is vital for safeguarding the credibility of the research process and protecting scientists from unfounded career-damaging accusations. Ultimately, this paper advocates for a clearer definition of falsification to protect the integrity of scientific research and prevent the miscarriage of justice. (shrink)

The purpose of the work is to study the definition and purpose of man for nature and cognition. The study was based on an article by K.R. Popper's «Evolutionary Epistemology». A critical analysis of Popper's theses and schemes for the evolution of theories is carried out. The importance of the emergence of a system of times of the language as a consequence of its descriptive function is noted. The problem with which the cycle of development of life and knowledge (...) begins is revealed. In the work of the scheme proposed by Popper, the language is included. As a result of the discussion, a key element of the essence of man is revealed: understanding the problem of death. This understanding makes it possible to relate oneself to the problem, which is the reason for the existence of the most general evaluation categories: «good» and «evil». So, a person can determine the goal of development - overcoming the problem, in contrast to nature, the development of which is aimed at avoiding the problem. Having reached the goal, a person will go beyond himself as a phenomenon defined by an understanding of the problem. In this case, self-transcendence is the transition of a person to a new quality. The role of philosophy in the processes of self-transcendence taking place in modern society is discussed. (shrink)
