En este trabajo pretendemos dar cuenta de cómo los criterios de delimitación entre el conocimiento animal y el conocimiento humano en la epistemología contemporánea no son adecuados para agotar la complejidad epistemológica del fenómeno. Buscamos, así, establecer una tercera vía de interpretación, proponiendo una taxonomía de niveles que satisfaga las necesidades de clasificación del conocimiento animal sin dejar de lado la particularidad propia del conocimiento humano, a saber, la reflexividad. De esta manera, se pretende reinterpretar cómo ha sido concebido el (...) conocimiento animal en la epistemología contemporánea para reconstruir, a partir de las posturas mencionadas, una vía alternativa que dé cuenta, adecuadamente, de las particularidades del conocimiento animal en relación con el conocimiento humano. This introduction to this collection of essays presents diverse perspectives on social identities, inviting readers to reconsider established notions and explore new approaches to understanding these complex social phenomena. The contributions challenge traditional philosophical boundaries, intersecting ontological, epistemological, ethical, and political considerations. // The authors situate different views on the ontology of social identities within some extant options. Thus, they contrast their "social identity affordance view" with two alternative approaches: the Cambridge Social Ontology group's positioning theory and Weichold & Thonhauser's (...) broad conception of social identities. Their view understands social identities as realities that structure social life and shape individuals' self-conceptions, emphasizing the importance of historical contingency and social context. // The introduction then proceeds to review the contributions to the volume. On a view implicitly endorsed by many, a concept is epistemically better than another if and because it does a better job at ‘carving at the joints', or if the property corresponding to it is ‘more natural' than the one corresponding to another. This chapter offers an argument against this seemingly plausible thought, starting from three key observations about the way we use and evaluate concepts from en epistemic perspective: that we look for concepts that play a role in explanations (...) of things that cry out for explanation; that we evaluate not only ‘empirical' concepts, but also mathematical and perhaps moral concepts from an epistemic perspective; and that there is much more complexity to the concept/property relation than the natural thought seems to presuppose. In this paper, I propose to analyse two objections raised by Turner Jr in his paper “On Two Reasons Christian Theologians Should Reject The Intermediate State” in order to show that the intermediate state is an incoherent theory. As we shall see, the two untoward consequences that he mentions do not imply a metaphysical or logical contradiction. Consequently, I shall defend an Intermediate State and I shall propose briefly one metaphysical conception of the human being able to reply to Turner (...) Jr’s objections. (shrink)

Este artículo estudia la justificación normativa de la adopción de los ensayos clínicos aleatorizados por parte de las autoridades sanitarias británicas como estándar metodológico en 1946. A partir de un análisis de los distintos intereses de los participantes en el proceso (pacientes, médicos, farmacéuticas y el propio Estado) argumentamos que la aleatorización se adoptó como mecanismo de asignación imparcial de tratamientos, aunque sus propiedades estadísticas no fueran bien comprendidas. Tal justificación permanece aún vigente.

The empirical study of belief is emerging at a rapid clip, uniting work from all corners of cognitive science. Reliance on belief in understanding and predicting behavior is widespread. Examples can be found, inter alia, in the placebo, attribution theory, theory of mind, and comparative psychological literatures. Research on belief also provides evidence for robust generalizations, including about how we fix, store, and change our beliefs. Evidence supports the existence of a Spinozan system of belief fixation: one that is automatic (...) and independent of belief rejection. Independent research supports the existence of a system of fragmented belief storage: one that relies on large numbers of causally isolated, context-sensitive stores of belief in memory. Finally, empirical and observational data support at least two systems of belief change. One system adheres, mostly, to epistemological norms of updating; the other, the psychological immune system, functions to guard our most centrally held beliefs from potential inconsistency with newly formed beliefs. Refining our under- standing of these systems can shed light on pressing real-world issues, such as how fake news, propaganda, and brainwashing exploit our psychology of belief, and how best to construct our modern informational world. Teacher quality, its effect on students’ outcomes, and the association of these with economic growth, is the core of recent discussions in Latin America given the region’s weak results in international learning assessments. This paper investigates whether there is an effect of philosophy on the outcomes of critical reading for students in B.Ed. programs in Colombia. Relying on exact matching combined with propensity score matching with regression adjustment, we use national data from Colombia to show that students in B.Ed. in (...) philosophy outperformed students in other B.Ed. in critical reading test (0.401–0.124 SD), and, importantly, with higher effects observed for students with lower prior academic achievement (0.44 SD). This suggests that philosophy can help to narrow educational outcomes of students whose socioeconomic conditions are disadvantageous, contributing to social justice in education. (shrink)

The purpose of this essay is to articulate a specific desideratum for any theory of Latinidad, namely, that there is no adequate conception of Latinx without an attendant conception of Afro-Latinx. In order to be reflective of those whom it purports to describe in the U.S. and elsewhere in the hemisphere, the term Latinx must be plastic enough to encompass the many internal differences, and even antagonisms, between its different constituent parts. Within it, we argue here in particular, it must (...) include its Afro-descended history, which includes not just African-descended people but also a denial of the influences of African-descended culture writ large. Our central claim here, then, is that a certain African-descendedness is constitutive of Latinidad in multiple registers, including history, cultural practices, and social identificatory processes despite Latinidad’s pernicious exclusionary history. El presente artículo introduce el lector a la filosofía analítica de la religión desde un punto de vista histórico y haciendo énfasis en su evolución. El objetivo es doble: primero dar a conocer una nueva disciplina que se ha desarrollado de manera notoria dentro del habla inglesa pero que ha sido ignorada dentro de la filosofía de habla hispana; segundo, comprender su nacimiento y algunas de sus principales características.

La mal llamada “Conquista del Desierto” constituyó una serie de campañas militares ocurridas en el actual territorio patagónico argentino entre los años 1878 y 1885 cuyo resultado fue el asesinato, la violación y sometimiento a la esclavitud de diversos pueblos y comunidades indígenas. Este no fue un caso aislado, sino que se suma a una serie de ataques sistemáticos que han sufrido los indígenas en la Argentina. En los últimos años, a raíz del reclamo y las luchas de los pueblos (...) y comunidades indígenas, así como también de las organizaciones de derechos humanos, se han comenzado a juzgar algunos de estos hechos. En particular, la Masacre de Napalpí (1924) y la Masacre de La Bomba (1947) fueron los primeros que lograron respuestas judiciales favorables. En ambos se determinó que el accionar estatal era constitutivo de un genocidio y, por lo tanto, se debía resarcir a las comunidades actuales. Ahora bien, la Campaña del Desierto, al día de hoy, no tiene respuesta por parte del Estado. Teniendo presente este panorama, nuestro objetivo en este trabajo es reconstruir los diferentes problemas que enfrenta la posibilidad del reclamo judicial. Para ello, comenzaremos describiendo en qué consistió la Campaña del Desierto. Luego, explicaremos la noción de genocidio aplicado a hechos de injusticias históricas. Como tercer paso, reconstruiremos los casos jurisprudenciales que se han preocupado por genocidios indígenas ocurridos en el pasado. Con este panorama revelado, nos enfocaremos en los diferentes problemas jurídicos y políticos que surgen en los reclamos de justicia. (shrink)

En el presente texto se defenderá la idea según la cual, la filosofía y el filosofar están intrínsecamente ligados. Se partirá de un caso paradigmático, el caso de la filosofía analítica. A partir de su definición,se pretenderá mostrar que las características más sobresalientes de dicha corriente están fundamentalmente ligadas al acto de filosofar.Por medio de dicho ejemplo, se desea mostrar que enseñar la filosofía consiste en enseñar a filosofar, y que por lo tanto una no puede ser separada de la (...) otra. Aprender a filosofar es entonces, aprender a ver un problema detrás de cada página de un texto filosófico, una argumentación detrás de cada problema y finalmente, una verdad detrás de cada argumentación. El precio a pagar por dicha separación es bastante alto, se podría hablar de épocas de decadencia intelectual. (shrink)

Intellectual progress involves forming a more accurate picture of the world. But it also figuring out which concepts to use for theorizing about the world. Bayesian epistemology has had much to say about the former aspect of our cognitive lives, but little if at all about the latter. I outline a framework for formulating questions about conceptual change in a broadly Bayesian framework. By enriching the resources of Epistemic Utility Theory with a more expansive conception of epistemic value, I offer (...) a picture of our cognitive economy on which adopting new conceptual tools can sometimes be epistemically rational. Since the concept of “nudge” was introduced in 2008 by Thaler and Sunstein, proposing that small interventions based on changes in choice architectures can alter people’s behavior and make it easier for them to achieve their desired goals, the application in public policy of behavioral economics has gained significant attention. This has led to the emergence of different types of policies based on behavioral insights, which have been used in a variety of areas, including health or finance, with the goal (...) of promoting well-being and addressing social and economic issues. After providing a basic theoretical background as a frame of reference to understand gender violence, this study explores the use of tools from the field of behavioral economics as it is applied in public policy. Regulatory (paternalistic) and non-regulatory (libertarian) interventions based on behavioral insights will be considered: nudges, boosts, shoves, budges, or sludge audits, are examined as potential interventions to use in matters related to this type of violence. After evaluating these behavioral policy instruments and their potential effectiveness, the limitations of the behavioral perspective are recognized, and the need for a multifaceted approach to combating gender violence is acknowledged. The article concludes by arguing that public policies addressing gender violence should not only utilize behavioral tools but should also incorporate strategies related to education, legislation, and social norms. El trabajo consiste en una elucidación de los elementos que conforman el concepto de pena natural (poena naturalis) en el Derecho penal. Se puede caracterizar la pena natural como el daño o sufrimiento que recae sobre el autor de un delito, producto de la comisión del mismo, que debe ser descontado de la pena legal que ha de aplicársele. Si bien existe un mínimo acuerdo sobre esto, tanto en la jurisprudencia como en la doctrina penal se observan serios desacuerdos acerca (...) de los requisitos que se deben cumplir para reconocer que se está frente a una pena natural. Para elucidar los elementos, se utilizará el constructivismo conceptual de Ronald Dworkin, a fin de describir el desacuerdo y sus implicancias, reconocer los elementos principales de la pena natural y justificarlos bajo su mejor luz moral. ABSTRACT This study focuses on the clarification of the conceptual elements of poena naturalis in criminal law settings. The poena naturalis is the damage or suffering that falls on the convict for its commission. This damage must be deducted from the poena forensis to be applied. Although there is a minimum agreement about the concept of poena naturalis, in the jurisprudence and among legal scholars, there are serious disagreements about the elements of poena naturalis. To elucidate the elements, I will adopt Ronald Dworkin’s conceptual constructivism to describe the disagreement and its implications. At last, I will justify the main elements of the poena naturalis by their best moral light. (shrink)

Is suffering really bad? The late Derek Parfit argued that we all have reasons to want to avoid future agony and that suffering is in itself bad both for the one who suffers and impersonally. Nietzsche denied that suffering was intrinsically bad and that its value could even be impersonal. This paper has two aims. It argues against what I call ‘Realism about the Value of Suffering’ by drawing from a broadly Nietzschean debunking of our evaluative attitudes, showing that a (...) recently influential response to the debunking challenge (the appeal to phenomenal introspection) fails. It also argues that a Nietzschean approach is well suited to support the challenge and is bolstered by the empirical literature. Desde que en 2008 se introdujera el concepto de nudge en el libro Nudge, que argumentaba que las pequeñas intervenciones basadas en cambios en la arquitectura de elección pueden alterar el comportamiento de las personas y facilitarles el logro de sus objetivos deseados, el uso de la economía del comportamiento en políticas públicas ha crecido significativamente, lo que ha llevado a la aparición de diferentes intervenciones basadas en conocimientos conductuales. Estas intervenciones se han aplicado en distintas áreas de políticas públicas (...) y administrativas, incluyendo salud, finanzas, o medio ambiente, con el objetivo de promover el bienestar y abordar problemas sociales y económicos. El uso de estas aplicaciones en cuestiones relacionadas con la violencia de género ha sido con frecuencia ignorado. De este modo, el objetivo de este estudio es analizar el uso de herramientas de la economía del comportamiento en políticas públicas, como nudges, boosts o auditoría de sludges y su aplicación a asuntos relacionados con este tipo de violencia. Al mismo tiempo que se señalan los posibles beneficios de su uso, también se reconocen las limitaciones del enfoque conductual, apuntando a la necesidad de una aproximación multifacética para combatir dicha violencia. Este artículo presenta y defiende una concepción expresiva del mundo perceptual que depende de la intersubjetividad. En un primer momento se muestra el desarrollo del concepto de expresión en Husserl y en Merleau-Ponty. El punto central de este desarrollo es que, en contraste con la concepción tradicional del concepto de expresión que es lingüística y consiste en el manifestarse exteriormente de algo interno, se propone ahora una idea de expresión que ya no separa radicalmente lo expresado de la expresión, no (...) se concibe como traducción, y se aplica a la relación entre subjetividad y corporalidad. Para ajustar la aplicación de la expresión a la percepción, se argumenta que las apariencias perceptuales requieren de una cualificación en términos de la posición o perspectiva del sujeto que percibe. Esta “posición” o perspectiva no es únicamente espacio-temporal, sino que también es pragmática. Finalmente, se introduce la intersubjetividad, entendida pragmáticamente, a través de la idea de que hay maneras de explorar el mundo con los sentidos que son constituidas socialmente por los diferentes grupos sociales de los que hacemos parte. Se argumenta que esta concepción pragmatista, diferente a la ruta predominante en fenomenología basada en el significado como un asunto de conciencia de la experiencia, también es defendible en el terreno fenomenológico, particularmente a través de la noción husserliana de toma de posición (Stellungnahme) y la idea merleau-pontiana de las maneras de interrogar el mundo perceptualmente. -/- This article presents and defends an expressive and intersubjectively dependent conception of the perceptual world. The first section deals with the phenomenological development of the concept of expression in Husserl and Merleau-Ponty. In this development, and in contrast with the traditional conception of expression –a linguistic conception based on the external manifesting of something inner–, a new conception appears: one that doesn’t keep a hard separation between the expression and what is expressed, is not modeled after translation, and can be applied to the relationship between subjectivity and corporeality. To further precise the way expression and perception fit together, I argue that perceptual appearances require being qualified in terms of the position or perspective of the perceiving subject. This “position” or perspective is not only spatiotemporal but also pragmatic. Lastly, a pragmatically understood intersubjectivity is brought into play. I look at the fact that there are different ways of exploring the world with our senses that are socially constituted. This constitution takes places in and through the different social groups to which we belong. I argue that this pragmatist conception, while different from the dominant phenomenological understanding that takes meaning to be about the consciousness of experiences, is also defensible on phenomenological grounds. This alternative understanding finds support in Husserl’s idea of position-taking (Stellungnahme) and Merleau-Ponty’s claim that there exist different ways of interrogating the world perceptually. Intuitively, collective nouns are pseudo-singular: a collection of things (a pair of people, a flock of birds, etc.) just is the things that make ‘it’ up. But certain facts about natural language seem to count against this view. In short, distributive predicates and numerals interact with collective nouns in ways that they seemingly shouldn’t if those nouns are pseudo-singular. We call this set of issues ‘the distribution problem’. To solve it, we propose a modification to cover-based semantics. On this semantics, (...) the interpretation of distributive predicates and numerals depends on a cover, where the choice of cover is strongly semantically constrained by the noun with which they interact. This article provides a philosophical response to the need for truth-telling about colonial history, focussing on the Australian context. The response consists in inviting philosophers and the public to engage in social-justice practices specified by a model called Distributed Truth-Telling (DTT), which integrates the historiography of injustices affecting Indigenous peoples with insights from social philosophy and cultural evolution theory. By contrast to official and large-scale truth commissions, distributed truth-telling is a set of non-elitist practices that weave three components: first, multisite, (...) multiformat, and multiscale inquiries into injustices; second, remedial imaginings and reasoning about moral repair and reconciliated futures; and finally, emotions suitable for motivating agents to cooperatively plan and implement moral revolutions. Distributed truth-telling can entrench virtuous feedback loops that contribute to moral revolutions. However, vicious feedback loops associated with collective denial and biases can impair distributed truth- telling and thwart moral revolutions. (shrink)

Ou celui entre l’homosexualité et les sciences cognitives? Et finalement, quel lien peut-il y avoir entre ces trois termes à première vue juxtaposés? Il y a une réponse à chacune de ces trois questions et nous proposons d’explorer ces réponses dans le cadre de cette étude. Dans cette étude nous nous proposons d’étudier la présence du Christ dans l’Eucharistie dans une perspective métaphysique et ontologique. Dans les deux premières sections nous définirons et montrerons qu’il faut distinguer: le problème de l’Eucharistie et la question fondamentale de l’Eucharistie. Nous défendrons la thèse selon laquelle le problème de l’Eucharistie en est vraiment un seulement pour ceux qui acceptent l’ontologie de l’aristotélisme, plus précisément celle de la transsubstantiation. Or, nous montrerons que l’ontologie de la transsubstantiation suppose des problèmes théoriques (...) insurmontables et nous suggérerons que nous devons nous intéresser plutôt à la question fondamentale de l’Eucharistie. Afin de montrer qu’il est possible de donner une réponse à la question fondamentale de l’Eucharistie, nous esquisserons une solution à partir d’une ontologie des tropes. (shrink)

Many think that expressivists have a special problem with negation. I disagree. For if there is a problem with negation, I argue, it is a problem shared by those who accept some plausible claims about the nature of intentionality. Whether there is any special problem for expressivists turns, I will argue, on whether facts about what truth-conditions beliefs have can explain facts about basic inferential relations among those beliefs. Our purpose is to describe the application of legitimate defense in so-called non-confrontational situations. To do this, we will conceptualize gender violence as that which against women, due to their condition as such, and we will describe the absence by the courts in the identification of this problem. Second, we will analyze the reception of Argentine and international legislation on the treatment of gender violence and the recommendations and criteria to take into account when interpreting and applying criminal law. Finally, (...) we will present the treatment of legitimate defense in contexts of gender violence, analyzing each of its elements. Our conclusions will focus on the need to address situations of gender violence based on international regulations for the application of legitimate defense in non-confrontational situations. This paper provides an interpretation of Aristotle’s criticism to the solution to Meno’s Paradox suggested by Plato. According to Aristotle, when Plato says that reminiscence (anámnēsis) is achieved, what is actually achieved is induction (epagōgê). Our interpretation is based on two aspects: (1) semantic criticism, since Plato’s use of the term anámnēsis is unusual; and (2) the theory is not able to give an adequate explanation of the effective discovery.

Applied behavior analysis (ABA) has featured an increasing concern for understanding and considering the cultural diversity of the populations behavior analysts serve in recent years. As an expression of that concern, the new BACB’s Ethics Code for Behavior Analysts is more explicit and comprehensive in its inclusion of ethical obligations concerning cultural diversity. The purpose of this paper is to offer a discussion on the limitations of both our capacity and willingness to know and overcome our ignorance about our own (...) and other cultures. We examine different ways in which our ignorance of other cultures plays out even in willful compliance with the BACB ethics code. We suggest part of the problem is that the BACB ethics code seems to operate under the assumption that practitioners are always aware or can be aware of what they do not know and their biases. In contrast, we offer a reflection on a more complex picture of our understanding of ourselves and other cultures where we cannot assume people are aware of what they ignore and of their biases. Ethically, we find that in some cases these blindspots are accounted for by the BACB ethics code and should be foreseen and addressed by the behavior analyst (BA). But in other cases, when a person is not aware of what they ignore, understanding the connection between cultural diversity ignorance and professional behavior requires a different approach. Our analysis suggests an attitude of being thoughtfully diligent and humble while learning about cultural diversity issues and examining the areas where we might be ignorant and not aware of our ignorance. We argue that BAs’ obligations to respect the dignity of clients and their families and to provide effective treatment call for this attitude of diligence and humility that goes beyond mere compliance. In his comment, McGann argues that in my “From Sensorimotor Dependencies to Perceptual Practices: Making Enactivism Social,” I have overlooked a group of enactivist theories that can be grouped under the participatory sense-making label. In this reply, I explain that the omission is due to the fact that such theories are not accounts of perception. It is argued that, unlike participatory sense-making, the approach of the “From Sensorimotor Dependencies to Perceptual Practices” article does not focus on the perceptual aspects of (...) things social, but on the social aspects that are constitutive of perception in general. I conclude by underscoring the central argument of the original article: that the adequate notion to make enactivism about perception social is that of “perceptual practices,” a social practices-based notion of perception. Malem Seña in “¿Puede las malas personas ser buenos jueces?” analyzed the judicial morality. At first time from a historical analysis, the judges were not required to base their judgments, because they were the mirror of legitimacy and morality of their decisions. With the advent of rationalism and modern State, the sentences should be the foundation. The situation that put the judge person in the background. In this situation, the answer to the question posed in the job would be: "Yes, (...) bad people can be good judges", answer hardly accepted by all. Malem Seña, far from giving a definite answer, ends his work with the insinuation that judges should maintain an image of morality, rather than being morally unimpeachable agents. This situation raises questions about different dimensions of analysis that have been shelved, and in particular try to analyze why this importance takes the image of morality. To do this, from the perspective of the concepts of Slavoj Žižek‘s ideology and fantasy, it will attempt to reach some responses or generate argumentative lines about the importance of the image of morality on morality itself. Can we reify the form of a substance? Is it possible to identify DNA as the principle of our personal and numerical identity? These questions will be studied through Berti’s reading of Aristotle’s hylomorphism. Indeed, Enrico Berti proposes the identification of the DNA to the Aristotelian notion of form, thesis which raises many questions from an exegetical point of view and a metaphysical perspective. We will present the sources of Berti’s reading and one of the main objections made by Aristotle. (...) Thus, different versions of the Berti’s thesis will be examined and then, a thought experiment that makes them false. There is a close relationship between education and citizenship. Liberal political theorists tend to spend much of their work justifying the role of educational institutions in political communities. However, the development of these proposals is usually thought for subjects who do not have disabilities, arbitrarily excluding a significant proportion of society. This not only happens at an educational level, it is replicated in various areas of social life. In this sense, in the present work I am going to propose that (...) the adequacy approach proposed by Debra Satz is extremely valuable to think about the educational equity of people with disabilities. The choice is not accidental or arbitrary. Satz is a renowned philosopher whose interest in education and its importance in forming citizens for diverse and plural societies. To do this, I will begin by presenting three possible models of special education: the special school, integration and inclusion. Then the two paradigms that prevail in the characterization of disability will be addressed: the social model and the medical model. Instead, I will reconstruct the third proposal elaborated by Satz in order to evaluate with which inclusive education model and disability paradigm it is compatible and why it is presented as a valuable proposal in this field. This paper presents an impact evaluation of the policies for teacher education programs within the framework of the National Development Plan 2014-2018. The programs were compelled to obtain high-quality accreditation, increase the credits in school practices, and the English level, among other requirements. Relying on multivariable regression, it shows that, for the year 2021, there is no association between high-quality accreditation in most modules of the Saber Pro tests, or it is negative in the global score and quantitative reasoning. In (...) a second step, using Differences–in–Differences, it evidences how the changes made by the programs had positive effects on the performance of students compared to other professional programs. The results show significant improvement in most modules of the Saber Pro test, except for the English module. The effects were homogeneous by characteristics of the students and institutions, but heterogeneous by area of knowledge, indicating that the effect is mainly due to the curricular changes of the programs. In the present work I am interested in addressing a specific aspect within the conceptual problem that poena naturalis implies. In other words, here I will answer the question about what is the poena naturalis. We can be recognized three theories: one that affirms that the poena naturalis is a compensation for culpability, another according to which the poena naturalis is the product of clemency or compassion, and the last that defends that the principles of legality, proportionality and rationality allow (...) justifying the poena naturalis. I will stop at each one of them in order to carry out a critical examination that will allow me to conclude which is the conception that best supports natural punishment. (shrink)

La doctrina establecida por la Corte Suprema de Justicia de la Argentina en relación a los crímenes de lesa humanidad cometidos durante la última dictadura militar, expresamente declaraba la obligación del Estado de investigar y juzgar a los responsables de su comisión. La Corte no sólo caracterizó dichos delitos, sino que también estableció que no eran susceptibles de amnistía, indulto, ni prescripción. Pero, en el año 2017 dictó el fallo “Muiña” donde, por voto mayoritario, decidió otorgarle el beneficio del “2 (...) por 1” a un condenado por dichos delitos. La consecuencia fue su inmediata libertad por el vencimiento de la condena. La respuesta de la sociedad fue clara. Con diversas manifestaciones, la sociedad civil, las instituciones y las personalidades públicas se declararon en contra de la sentencia. Más aún, del voto de los mismos jueces se observan expresiones que denotan un gran pesar a la hora de tomar la decisión. Más precisamente, sostenían estar ante un dilema. En este trabajo, lejos de realizar un análisis de la interpretación jurídica que se efectuó en la sentencia, se propone trabajar sobre el concepto de dilema y la posibilidad de aplicación en el presente caso. La finalidad concreta es indagar si se está ante un dilema y en su caso si los jueces utilizan este concepto como un arma argumentativa para lograr adhesión o compasión de la opinión pública. En este sentido, se comenzará relatando el marco jurídico del fallo, donde se describirá la historia judicial de Muiña y los argumentos dados por el voto mayoritario y el minoritario de la Corte. Luego, se realizará un análisis del concepto de dilema, para reconstruirlo sobre la base de dos grandes posturas: Una lógica conceptual y otra fenomenológica. Posteriormente, se realizará un examen de la dimensión institucional del derecho y la moralidad judicial, para - finalmente - poder intentar responder si se está efectivamente ante un dilema. Epistemic Utility Theory is often identified with the project of *axiology-first epistemology*—the project of vindicating norms of epistemic rationality purely in terms of epistemic value. One of the central goals of axiology-first epistemology is to provide a justification of the central norm of Bayesian epistemology, Probabilism. The first part of this paper presents a new challenge to axiology first epistemology: I argue that in order to justify Probabilism in purely axiological terms, proponents of axiology first epistemology need to justify a (...) claim about epistemic value—what I label ‘Downwards Propriety’—much stronger than any they have offered justification. The second part of this paper offers an argument that this challenge cannot be met: that there is no hope for providing a purely axiological justification of Downwards Propriety, at least given widely accepted assumptions about epistemic value. Y-a-t-il une inconsistance entre la thèse d’un Dieu chrétien et l’existence du mal ? Notre argumentation se basera sur l´excellente thèse développée par Alvin Plantinga, qui soutient, contre John L. Mackie, la consistance du théisme face au problème du mal. Cependant, nous refuserons de suivre la métaphysique modale adoptée par Alvin Plantinga et proposerons une position actualiste, et plus précisément l’essentialisme sérieux prôné par E. J. Lowe. Nous montrerons qu’il est alors possible de suivre l’argumentation logique de Plantinga tout en (...) soutenant un essentialisme sérieux. (shrink)

This paper critically explores the ethical dimensions of Behavioral Public Policy (BPP), a domain grounded in the understanding that human rationality is bounded and that this limitation often leads to behaviors deemed irrational. By applying the behavioral lens, which posits that people operate under bounded rationality, BPP aims to craft interventions that safeguard individuals against their biases. However, this approach raises significant ethical concerns, both in the scientific underpinnings of BPP and its application through policy interventions. Accordingly, this paper examines (...) two distinct ethical dimensions of BPP, both as a scientific discipline and through its intervention methodologies. The analysis of the first dimension argues that, viewing bounded rationality as only instrumental in decision-making processes, risks oversimplifying ethical complexities. Such simplification may ignore the moral and value-based rationalities underlying decisions, potentially misattributing instances of immorality and akrasia (the failure to act according to one's judgment) to mere deficiencies in rational thinking. Secondly, the paper examines the impact of BPP on moral behavior and character development, addressing ethical concerns like the evidentiary basis of BPP research, the bounded rationality of choice architects themselves, and the morality of behavior changes induced by policy. Overall, this article provides a much-needed examination of the moral considerations associated with behavioral strategies in public policy and its epistemological foundations, contributing to a more comprehensive understanding of their ethical implications . This article aims to explore, through the civil society’s opinion, the polarisation between ‘winners’ and ‘losers’ and the group of the ‘new excluded’, or ‘new poor’, that has emerged as a result of the European economic crisis and the social transformations that followed in the Greek society. Based on the Theory of Justice introduced by John Rawls (1971), and using the approach of Critical Discourse Analysis, this study focuses on the discourse analysis of the perception of 97 representatives of local (...) and national NGOs, both formal and informal. The main results focus on different self and others’ presentations, especially during the economic crisis, and on the creation of an unbalanced, fragmented and exclusion-cantered society. However, the definition of rich and poor appears ambiguous through the analysis of various linguistic strategies of Greek NGOs revealing a hidden face of the society. (shrink)

This article covers the different stages of the constitution of the person that goes beyond selfishness and self-affirmation and is formed as the inseparable unity of the metaphysical subject that is expressed in the "Other-in-the same" and "Being-for-the-other". This leads one to say that the person is intrinsically relation and exteriority that is realized in the language that transcends the inner self. This relationship, considered internally as a footprint, and in the exterior as visage, invokes a third party that establishes (...) and holds it. We aim to do two things in this article. On the positive end, our goal is to explain how some seemingly incompatible aspects of belief live together, by presenting distinct mechanistic explanations of each of them: in particular we want to show how belief can be discerning, credulous, rational, and irrational. After clarifying our positive view, we take aim at some competitor views in the second half of the paper, particularly offering critiques of epistemic vigilance and social marketplace accounts of (...) belief. —Commentary on Mikhalevich and Powell on invertebrate minds.— Whether or not arthropods are sentient, they can have moral standing. Appeals to sentience are not necessary and retard progress in human treatment of other species, including invertebrates. Other increasingly well-documented aspects of invertebrate minds are pertinent to their welfare. Even if arthropods are not sentient, they can be agents whose goals—and therefore interests—can be frustrated. This kind of agency is sufficient for moral status and requires that we consider their welfare.

There seems to be an inconsistency at the heart of Aristotle’s Metaphysics: a differentia is said both to presuppose its genus (in vii 12) and to be logically independent from it (in x 7). I argue that the relation of analogy resolves this inconsistency, restores the coherence of the concepts of differentia and species, and gives x 7 its rightful place in the development of the Metaphysics.

We present a systematic and qualitative review of academic literature on early conceptual development (0–24 months of age), with an emphasis on methodological aspects. The final sample of our review included 281 studies reported in 115 articles. The main aims of the article were four: first, to organise studies into sets according to methodological similarities and differences; second, to elaborate on the methodological procedures that characterise each set; third, to circumscribe the empirical indicators that different sets of studies consider as (...) proof of the existence of concepts in early childhood; last, to identify methodological limitations and to propose possible ways to overcome them. We grouped the studies into five sets: preference and habituation experiments, category extension tasks, object sorting tasks, sequential touching tasks and object examination tasks. In the “Results” section, we review the core features of each set of studies. In the “Discussion” and “Conclusions” sections, we describe, for one thing, the most relevant methodological shortcomings. We end by arguing that a situated, semiotic and pragmatic perspective that emphasises the importance of ecological validity could open up new avenues of research to better understand the development of concepts in early childhood. En la literatura jurídica existe un acuerdo generalizado en que los topes máximos de la pena establecidos la legislación son un límite infranqueable por los jueces. Sin embargo, al abordar el límite mínimo los desacuerdos comienzan a surgir. El objetivo del presente trabajo será el de defender que los mínimos penales, si bien son vinculantes para los jueces, pueden ser dejados de lado cuando las circunstancias particulares del caso lo ameriten. El método empleado será análisis conceptual, más precisamente, al contructivismo (...) interpretativista propuesto por Ronald Dworkin, aplicado al estudio de la jurisprudencia y la doctrina argentina. El resultado final será una justificación – apoyada en la concepción comunicativa del castigo – según la cual los límites mínimos pueden ser dejados de lado en casos concretos y excepcionales, como cuando la culpabilidad del acusado o la lesividad de su conducta se muestran desproporcionadas con el límite mínimo. De esta manera se busca dar respuesta a un problema que se encuentra presente en la práctica jurídica y, sobre todo, brindar herramientas argumentativas para que los operadores judiciales puedan resolver aquellos casos donde este límite se encuentre en discusión. It is usual to identify initial conditions of classical dynamical systems with mathematical real numbers. However, almost all real numbers contain an infinite amount of information. I argue that a finite volume of space can’t contain more than a finite amount of information, hence that the mathematical real numbers are not physically relevant. Moreover, a better terminology for the so-called real numbers is “random numbers”, as their series of bits are truly random. I propose an alternative classical mechanics, which is (...) empirically equivalent to classical mechanics, but uses only finite-information numbers. This alternative classical mechanics is non-deterministic, despite the use of deterministic equations, in a way similar to quantum theory. Interestingly, both alternative classical mechanics and quantum theories can be supplemented by additional variables in such a way that the supplemented theory is deterministic. Most physicists straightforwardly supplement classical theory with real numbers to which they attribute physical existence, while most physicists reject Bohmian mechanics as supplemented quantum theory, arguing that Bohmian positions have no physical reality.
