Classically, Christians have professed the saving efficacy of the cross. Does Karl Rahner? Recent commentary on Foundations of Christian Faith has described Rahner as conflating “atonement” generally with penal substitutionary theories of a changing God, as ruling out the redemptive significance of Christ’s death, and as denigrating the normativity of Scripture in order to do so. This article responds to these claims, unfolding Rahner’s soteriology and arguing that he advances a theology of the cross which affirms its saving efficacy, including (...) in the last decade of his work. A long-standing debate in group ontology and group epistemology concerns whether some groups possess mental states and/or epistemic states such as knowledge that do not reduce to the mental states and/or epistemic states of the individuals who comprise such groups (and are also states not possessed by any of the members). Call those who think there are such states inflationists. There has recently been a defense in the literature of a specific type of inflationary knowledge—viz., knowledge of facts about group (...) minds or group self-knowledge (GS-K). In this paper I address whether some groups do possess such knowledge. I argue that we have good reason to think they do not. I do so by exploring the most explicit defense of such knowledge in the literature—Lukas Schwengerer’s (2022) defense—as well as other ways of defending this thesis and arguing that such ways are problematic. In the latter part of the paper, I explain why the two most popular inflationary approaches to group knowledge simpliciter are incompatible with there being GS-K. In doing so I work to show why even inflationists should reject the view that there is inflationary group self-knowledge. (shrink)

Metaethical constructivism aims to explain morality’s authority and relevance by basing it in agency, in a capacity of the creatures who are in fact morally bound. But constructivists have struggled to wring anything recognizably moral from an appropriately minimal conception of agency. Even if they could, basing our reasons in our individual agency seems to make other people reason-giving for us only indirectly. This paper argues for a constructivism based on a social conception of agency, on which our capacity to (...) recognize ourselves as having reasons ties us inescapably to others. It argues that mutual recognition is a pervasive feature of linguistic concepts, and builds this into a view called transformative expressivism. (shrink)

Dentre essas consequências, defende que o reconhecimento do dolo eventual na estrutura finalista do delito acontece de forma incoerente, devido, sobretudo, aos postulados que fizeram do finalismo uma das teorias mais aceitas pela doutrina, a saber: o respeito às estruturas lógico-objetiva e a inclusão do dolo no tipo subjetivo.

The APA has recently taken steps to address concerns related to teaching and supporting philosophers and students who come from less privileged backgrounds. I want to add to this project by fleshing out some concrete ways that philosophy professors contribute to the challenges faced by first-generation and financially disadvantaged philosophers and students. I hope that in making these behaviors explicit, it may be easier for faculty to acknowledge and overcome them.

This dissertation investigates conceptions of responsibility at work in contemporary intergenerational nuclear waste policy. It argues that articulations of responsibility at work in current policy unduly privileges resemblance to the present as a condition for that responsibility holding as an intergenerational relation. The dissertation begins by arguing that current waste disposal practices depend on a view of responsibility contingent on the presumption that future generations will be minimally epistemologically, socially, and politically continuous with present generations. Extant policy is therefore found (...) to place an asymmetric and unjust burden on future generations. The dissertation thus concludes that responsibilities to future generations require that responsibility be thought prior to particular determinations of the possible identity of our inheritors. The main aim of this article consists in an interpretation of the concept of Ereignis (Event) in the work of Martin Heidegger, explaining central aspects of the modification produced in the development of this work by the movement known as Kehre (turn-around), which implies the transition from the fundamental ontology or analytics of the finitude for the thought of the truth of Being.

Following neo-Aristotelians Alasdair MacIntyre and Martha Nussbaum, we claim that humans are story-telling animals who learn from the stories of diverse others. Moral agents use rational emotions, such as compassion which is our focus here, to imaginatively reconstruct others’ thoughts, feelings and goals. In turn, this imaginative reconstruction plays a crucial role in deliberating and discerning how to act. A body of literature has developed in support of the role narrative artworks (i.e. novels and films) can play in allowing us (...) the opportunity to engage imaginatively and sympathetically with diverse characters and scenarios in a safe protected space that is created by the fictional world. By practising what Nussbaum calls a ‘loving attitude’, her version of ethical attention, we can form virtuous habits that lead to phronesis (practical wisdom). In this paper, and taking compassion as an illustrative focus, we examine the ways that students’ moral education might usefully develop from engaging with narrative artworks through Philosophy for Children (P4C), where philosophy is a praxis, conducted in a classroom setting using a Community of Inquiry (CoI). We argue that narrative artworks provide useful stimulus material to engage students, generate student questions, and motivate philosophical dialogue and the formation of good habits which, in turn, supports the argument for philosophy to be taught in schools. Contemporary philosopher David Benatar has advanced the self-evidently controversial claim that “coming into existence is always a harm.” Benatar’s argument turns on the basic asymmetry between pleasure and pain, an asymmetry he seeks to explain by the principle that those who never exist cannot be deprived. Benatar’s import is almost incredible: humans should cease to procreate immediately, thereby engendering the extinction of the species—a view known as “anti-natalism.” According to many of his readers, the ancient Hebrew sage Qoheleth expresses a (...) pessimistic nihilism that runs as thick as Benatar’s. Prima facie grounding for this assertion is that Qoheleth, like Benatar, raises the issue of whether coming into existence may be a harm—and gives an affirmative answer. In two passages, Ecclesiastes 6:1-6 and 4:1-3, Qoheleth declares that an unborn hypothetical person is “better off” than their existent counterpart. Yet the meaning and implication of these words is far from obvious. Does Qoheleth imply that the non-exister’s state, and non-existence in general, is universally superior to existence? Or is he instead speaking exceptionally, of particular persons in rare circumstances? By examining the two “better”-statements in their literary context, I will argue that Qoheleth intends these examples as exceptions. He does not go so far as to make the supremely nihilistic claim that coming into existence is always, or even generally, a net harm; yet, he does concede that in certain cases, it can be. Beyond this, I will explore how the two thinkers’ divergent conclusions can be traced to a deeper difference of philosophical method. This question concerning non-existence opens a window to Qoheleth’s broader scheme of values and therefore serves as a surprisingly useful entry point by which to engage his philosophy. According to the canonical formulation of the modal account of luck [e.g. Pritchard (2005)], an event is lucky just when that event occurs in the actual world but not in a wide class of the nearest possible worlds where the relevant conditions for that event are the same as in the actual world. This paper argues, with reference to a novel variety of counterexample, that it is a mistake to focus, when assessing a given event for luckiness, on events distributed (...) over just the nearest possible worlds. More specifically, our objection to the canonical formulation of the modal account of luck reveals that whether an event is lucky depends crucially on events distributed over all possible worlds–viz., across the modal universe. It is shown that an amended modal account of luck which respects this point has the additional virtue of avoiding a notable kind of counterexample to modal accounts of luck proposed by Lackey (2008). Destaca-se a importância da vítima no processo de perfilamento de criminosos, pois é com base na averiguação dos traços físicos e psicológicos deixados na pessoa que sofreu o delito que é possível traçar o perfil criminal do ofensor. Constata-se a estagnação do ensino do criminal profiling no Brasil.

RESUMO: As novas tecnologias revolucionaram tanto as relações humanas quanto as formas de exploração. Com o uso massivo e a dependência das redes sociais, muitas pessoas descobriram fontes de ganhos fnanceiros a partir da exposição da imagem, seja da sua ou de outrem. Nesse cenário, a intimidade de centenas de crianças é exposta por seus pais ou responsáveis em troca de audiência, fama e recursos fnanceiros. Partindo dessa problemática, o presente artigo investiga os impactos do trabalho infantil mediante a exploração (...) da imagem e da intimidade da criança nas plataformas digitais. In this scenario, the intimacy of hundreds of children is exposed by their parents or guardians in exchange for audience, fame and fnancial gain. Based on this problem, this article investigates the impacts of child labor through the exploitation of the image and intimacy of the child on digital platforms. This essay examines Qoheleth’s Catalogue of the Times poem in Eccl 3:2–8. I argue that the two most common scholarly interpretations of the poem’s overall meaning fail to sufficiently account for its literary context and that an underdeveloped alternative reading is to be preferred. When we read the poem in light of two other closely related passages, 1:4–11 and 3:9–15, it becomes clear that a poem ostensibly about “time” is much less concerned with “timing” than is typically thought, but instead (...) signifies Qoheleth’s frustration with the inevitable equilibrating tendency embedded into every human task. Os autores estudam um caso de linchamento ocorrido na cidade de Guarujá. Formulam sua hipótese a partir da teoria mimética de René Girard, demonstrando, no caso concreto, a presença de sinais vitimários que tornam um indivíduo suscetível a ser tomado como bode expiatório de uma comunidade em crise. Problematizam sobre a questão da mentalidade persecutória, justiça comunitária e sistema judiciário.

RESUMO Versa o presente artigo sobre a regulação do linchamento no Direito Romano do período antigo, em especial sobre o artigo 9º da Tábua III das Leis das XII Tábuas. A partir de uma metodologia de análise qualitativa, revisão bibliográfica e interpretação textual, os autores objetivam ampliar a visão tradicional sobre o linchamento, compreendendo a institucionalização de sua prática no Direito Romano e sua função no contexto de formação da cultura jurídica do período antigo. A hipótese de trabalho é a (...) de que o artigo 9º da Tábua III das Leis das XII Tábuas apresenta, historicamente, uma forma de punição intermediária entre a linchamento popular extralegal e a pena criminal prevista em lei. Do ponto de vista jurídico-antropológico, a comprovação da hipótese permitiria concluir a ideia de que a pena praticada na antiguidade é uma evolução do controle social informal da violência. ABSTRACT The following paper is about the lynching regulation in Roman law in Ancient Era, especially in what comes about the article 9 of Table Three from Twelve Tables. Making use of a methodology based in qualitative analisys, literature review and interpretation, the auctor aim to expande the traditional view about lynching, understanding the institutionalization of their practice in Roman Law and it’s function in the legal culture in Ancient Era. The working hipothesis is that the article 9 of Table Three of Twelve Tables presents, in a historical context, a intermediate form of punishment between extralegal collective lynching and criminal penalty provided by law. From a legal-anthropological point of view, the proof of the hypothesis would allow us to conclude the idea that the penalty practiced in antiquity is an evolution of informal social control of violence. A tragédia de Orestes, escrita pelo tragediógrafo grego Ésquilo, influenciou decisivamente o pensamento ético-político de Hegel. Em seu ensaio sobre o Direito Natural (1802-1803), o filósofo alemão associa seu conceito de absoluto com sua interpretação da tragédia grega, ato com o qual expõe sua concepção da vida ética absoluta, dando continuidade à ideia que havia esboçado, no âmbito teológico, em "O Espírito do cristianismo e seu destino", i.e., a de que o destino e a justiça trágica forneceriam os termos de (...) uma alternativa aos conceitos jurídicos kantianos e cristãos de justiça. Mas, em "Sobre as maneiras de tratar cientificamente o direito natural", Hegel vai além. Ele demonstra que o gênero trágico apresenta uma concepção de ética e política que pode ser uma alternativa às concepções modernas do direito natural, o que permite a Hegel opor a representação trágica da unidade da vida ética absoluta ao dualismo e às dicotomias que estruturam as teorias políticas de seu tempo. Essa intuição da tragédia propiciou ao filósofo compreender a vida ética absoluta como o verdadeiro fundamento da ética e da política. Enquanto tal, ela pressupõe, necessariamente, todas as teorias do Direito Natural. Hegel denomina essa representação da unidade da vida ético-política como "a representação da tragédia da vida ética". A obra emblemática e talvez até mesmo inspiradora dessa compreensão do direito natural é "Eumênides", de Ésquilo, peça que encerra a trilogia "Oresteia". A partir dela, Hegel desenvolve, no capítulo intitulado “a ciência especulativa e o direito natural”, sua concepção trágica da vida ética absoluta. É que a tragédia de Orestes expõe o problema político que Hegel quer resolver: as relações entre o universal e o particular, o todo e as partes, o Estado e o indivíduo, etc. Além de explicitar o problema político, a obra de Ésquilo também expõe a solução do que Hegel considera ser o conflito absoluto, i.e., o jogo das oposições (universal/particular, todo/partes, Estado/indivíduos) que consiste na essência da vida ética e política. Tal solução se dá, na peça, com o julgamento do herói, Orestes, e a consequente pacificação das Erínias, transformadas em Eumênides. Esse movimento é a culminação da trilogia "Oresteia" e ilustra o tipo de reconciliação que Hegel procurava produzir com sua Filosofia do Direito: a (re)organização da totalidade ética. (shrink)

Em sua Filosofia do Direito, Hegel, ao tratar da instituição da família e de seu papel na educação dos filhos, intuiu um traço característico da subjetividade infantil: no coração das crianças haveria um desejo de pertencer ao mundo dos adultos. Trata-se de um desejo que poderíamos qualificar de mimético, no sentido da teoria de René Girard, já que as crianças adotam os pais como seus primeiros modelos. Na teoria hegeliana, esse elemento mimético adquire, junto à educação infantil, uma importante função (...) na formação da personalidade moral. A educação é uma exigência da própria criança, que possui de maneira inata o sentimento de não estar satisfeita em ser aquilo que é e o desejo de pertencer ao mundo adulto. Hegel, por isso, é um crítico da pedagogia que estagna as crianças na subjetividade infantil. Representando-as como perfeitas no estado de imperfeição em que se encontram, essa pedagogia perturba a espontânea carência do estado infantil, traço que impele naturalmente a criança ao autodesenvolvimento. O erro desse tipo de abordagem pedagógica está em não conceber o papel da mediação na formação da personalidade moral. Se o adulto, enquanto modelo, valoriza a criança em seu estado de infantilidade, é natural que ela adote essa mesma estima sobre si mesma, seguindo a opinião exterior. Logo, a valoração subjetiva, que deveria centrar-se no modelo ético, volta-se, pela mediação do modelo adulto, ao próprio Eu vazio da criança, que cresce concebendo- se como realidade autônoma, independente dos demais, gerando nela o desinteresse pelas relações substanciais do “mundo do espírito”. O narcisismo infantil seria, pois, uma decorrência da perda de referência ao modelo ético da vida adulta. Desse vazio “ontológico” da criança surge a necessidade de sua formação por meio do processo pedagógico. Os pais, que constituem o modelo imediato das crianças, não só devem estimular nelas a adoção do comportamento ético, como também punir as suas transgressões morais. A finalidade da punição não é a justiça enquanto tal. Trata-se, antes, de uma intimidação subjetiva e moral exercida contra a liberdade ainda encerrada na natureza, tendo como escopo elevar, na consciência e na vontade, a esfera da universalidade e da razão. Portanto, na educação dos filhos, o ético e o mimético são indissociáveis. Lendo Hegel a partir de René Girard, poder-se-ia usar o termo “mimeticidade” para designar essa unidade entre a imitação natural (subjetividade) e a promoção pedagógica e cultural de modelos comportamentais voltados ao Bem (moral objetiva). Pela adoção de modelos éticos, a criança tem a oportunidade de vivenciar a “eticidade” ainda sem oposição, como seu sentimento mais imediato, mais íntimo e “próprio”, vindo a adquirir, na vida adulta, a autonomia moral concreta de uma personalidade livre e racional, exercida em coerência com as demais. The paper seeks to show that the period between the years 756 and 1031, a period officially recognized as the domination of the Umayyad dynasty in the Iberian Peninsula, saw the emergence of the most important movement for the recovery of classical Greek works known, and offered the foundations for the second Renaissance, the Italian. It also shows that translation is a process that can fundamentally alter original works, as they depend on the translator's interpretation, as well as the existence (...) of equivalent words and concepts in the language to be translated. Both problems were identified in the recovery of classical Greek works by the Toledo School of Translators. The result was that Italian Renaissance was, in fact based on what had been made available by the Toledo School of Translators, which confirms the thesis that the first Renaissance was the Islamic one and that the Italian Renaissance was a later movement. Resumo A transferência de embriões em bovinos tem o objetivo principal de aprimorar o melhoramento genético e otimizar a reprodução bovina A importância dessa prática é destacada pela sua contribuição para a maximização de características desejadas nos rebanhos, como qualidade de carne, eficiência reprodutiva e resistência a condições ambientais adversas. Este trabalho descreve e analisa as técnicas avançadas utilizadas nesse processo, incluindo seleção genômica, sexagem de embriões, produção in vitro, protocolos não cirúrgicos, sincronização reprodutiva, criopreservação de embriões e uso de (...) marcadores de fertilidade. A compreensão aprofundada dessas técnicas é fundamental para o sucesso da transferência de embriões, bem como para a capacidade de personalizar e aprimorar as características específicas dos rebanhos. Enfatizando a importância da expertise de profissionais especializados em reprodução bovina, este trabalho busca oferecer uma visão abrangente das práticas atuais e avanços tecnológicos nesse campo. Ao unir ciência e prática, torna-se importante a comparação de técnicas, bem como relacionar resultados eficientes para promover qualidade genética, trazer a sustentabilidade e envolver a técnica em um cenário atualizado da indústria. The importance of this practice is highlighted by its contribution to maximizing desired characteristics in herds, such as meat quality, reproductive efficiency and resistance to environmental conditions adverse. This work describes and analyzes the advanced techniques used in this process, including genomic selection, embryo sexing, in vitro production, non-surgical protocols, reproductive synchronization, embryo cryopreservation and the use of fertility markers. An in-depth understanding of these techniques is critical to the success of embryo transfer, as well as the ability to customize and enhance specific herd characteristics. Emphasizing the importance of the expertise of professionals specialized in bovine reproduction, this work seeks to offer a comprehensive view of current practices and technological advances in this field. When combining science and practice, it becomes important to compare techniques, as well as relate efficient results to promote genetic quality, bring sustainability and involve the technique in an updated industry scenario. No capítulo 1, “Do escudo de Aquiles à capa do Batman: o heroísmo togado e seus riscos à democracia”, discutimos a ascensão do protagonismo político no Poder Judiciário a partir da categoria antropológica do herói, expondo a delicada relação entre heroísmo e instituições democráticas. Para isso, traçamos um breve histórico do heroísmo e suas características, apresentando, posteriormente, uma analogia entre elas e a atuação do Ministro Joaquim Barbosa no curso da Ação Penal nº 470 do STF (Caso Mensalão). Tecemos também (...) alguns apontamentos sobre o Estado Democrático de Direito, a função do Poder Judiciário e os riscos que a propagação de escândalos públicos e a flexibilização de regras e princípios jurídicos podem trazer às instituições do Estado Democrático de Direito. O tema de fundo dessa análise é a relação simbiótica entre a violência e a produção mítica de heróis, segundo a teoria de Girard. No capítulo 2, “Satã: a violência na fundação da cultura”, analisamos a obra “Vejo Satã cair como um relâmpago”, de René Girard, apresentando sua teoria (mimética) e seu estudo antropológico da Bíblia e dos Evangelhos. O intuito é demonstrar a possibilidade de interpretar racionalmente dados antes percebidos como sobrenaturais, explorando, com Girard, as contribuições da revelação judaico-cristãs para a relação entre o homem, a violência e a organização político-religiosa do mundo antigo. O principal tema exposto na resenha é o da violência fundadora, base da cultura e da sociedade, que Girard identifica na figura bíblica de Satã. Mais do que mero símbolo religioso, Satã é a representação de um mecanismo de pacificação deflagrado em situações de crise social. Seu modus operandi consiste na reunião da sociedade contra um inimigo comum, um bode expiatório contra o qual levantam-se falsas acusações que sustentam sua perseguição e assassinato. Consideramos esse tema fundamental para a moderna e contemporânea compreensão dos processos de perseguição e vitimização político-social. A revelação cristã é a entrada em cena, no campo histórico, de um pensamento que se coloca francamente ao lado da vítima acusada pela comunidade. As ideologias penais da proteção do débil, os direitos individuais e os direitos humanos são efeitos políticos e jurídico do triunfo da cruz sobre a cultura satânica do assassínio de bodes expiatórios. No capítulo 3, “A violência no Direito: confissão e produção de bodes expiatórios”, aplicamos a teoria mimética para compreender o instituto jurídico da confissão do ponto de vista antropológico. Com base no Livro de Jó, investigamos a origem religiosa da extração forçada de confissões e demonstramos sua íntima relação com os rituais religiosos praticados na antiguidade, que usavam da assunção de culpa como um instrumento para legitimar a violência contra seus bodes expiatórios. Com isso, pretendemos apontar para a necessidade de mitigação do valor probatório da assunção de culpa no contexto de um Estado Democrático de Direito. Incorporada às intuições jurídicas, a confissão deve ser tomada como instrumento laico e totalmente desvinculado das práticas expiatórias que lhe deram origem. No capítulo 4, “Direito penal e preocupação pelas vítimas: a renovação dos princípios de ofensividade e proteção de bens jurídicos após a experiência do totalitarismo", analisamos o surgimento e desenvolvimento da ideia de crime como ofensa a bens jurídicos. Trata-se de um ensaio de história das ideias jurídicas em que traçamos a evolução histórica das ideias de ofensividade e proteção de bens jurídicos, desde sua gênese na experiência liberal e iluminista, passando por seu enfraquecimento durante o Direito Penal nacional-socialista, até culminar em seu ressurgimento e renovação nos dias atuais. O intuito desta análise é situar o princípio da ofensividade, enquanto garantia assegurada nas Constituições do Pós-guerra, no quadro histórico da moderna preocupação pelas vítimas, efeito cultural da religião cristã que discutimos no capítulo 2 (“Satã: a violência na fundação da cultura”). Por fim, no quinto e último capítulo, “O Direito após a revelação do mecanismo vitimário”, procuramos rematar a temática do Direito no quadro da antropologia de Girard, explorando o papel desempenhado pela revelação cristã do mecanismo expiatório na cultura ocidental, especialmente no que diz respeito à formação de uma ética de proteção das vítimas, eixo fundamental dos Direitos Humanos. Por isso, demonstramos como o Direito Penal, no ocidente, está dividido entre o sacrifício e o perdão. Resultado da lógica do cristianismo sacrificial, o moderno Direito constitui-se na forma híbrida de um Katéchon: ou seja, como racionalização do mecanismo vitimário, re-direcionado, por meio das instituições jurídicas e políticas, contra atos de perseguição de minorias e vulneráveis . Homology is a biological sameness relation that is purported to hold in the face of changes in form, composition, and function. In spite of the centrality and importance of homology, there is no consensus on how we should understand this concept. The two leading views of homology, the genealogical and developmental accounts, have significant shortcomings. We propose a new account, the hierarchical-dependency account of homology, which avoids these shortcomings. Furthermore, our account provides for continuity between special, general, and serial homology.

The objective of this article is to offer an interpretation of the utopian society described in Plato's Republic from a simplified theory of fractals. Plato conceptualizes his Republic as a static society in terms of structure and its components, the people, as having a behavior that can be programmed as linear and not dynamic (LNDS). Based on this analogy, real social functioning (NLDS) is conceptualized, applying the concept of fractal and its corresponding fracton, as the force of attraction that acts (...) in social groups. Thus, social groups obey a fractal geometry, a geometry that reproduces the pyramidal shape, the apex being the crystallization of authority, power or leadership. Modern society, in analogy with Plato's Republic, is also a fractal production machine, replicating pyramid-shaped hierarchical structures and the respective fractons. Individuals are the basic unit of all these fractals. They are the building blocks of all groups at all levels of society. But replication is not self-similar due to fluctuations in cognition and behavior. (shrink)

This article aims to show the emergence of Pre-Socratic Natural Philosophy using the cosmological Big-Bang analogy, where from a certain moment in time and space a universe appears, first in its "inflationary" moment and, soon, in constant expansion. In the case of natural philosophy, it arose with Thales at a certain moment in space and time. It also had its “inflationary” period marked by a large number of philoso-phers and a profound change in the understanding of nature. This period lasted (...) for about 5 generations until philosophy entered its paradigmatic period with Plato and Aristotle. How was the Natural Philosophy Big Bang (NPBB) possible? What were the main factors that made this possible? The text discusses these aspects, and for the author, the main factor must be sought in the internal dynamics of Greek thought and not in external causes, such as the exchange with Babylonians and Egyptians or the economic dynamics. -/- To explain the NPBB, I use the hypothesis of linguistic relativism, meaning that “lan-guage shapes the mind”, in the same line that Bruno Snell used in his 1956 book. That is, the development of the Greek language would be the preponderant factor to explain the dynamics that led to the NPBB. We believe that this hypothesis (currently criti-cized for being excessively deterministic) is justified when applied to the aforemen-tioned situation and can be summarized as follows: “An extraordinary situation re-quires an equally extraordinary explanation”. A set of historical occurrences justifies the application of the strong version of the concept of linguistic relativism, something that today would be difficult to occur. -/- The text synthesizes the main milestones of linguistic relativism, goes through the description of the turn of the oralist society to a society based on writing, which rad-ically changes the way knowledge is stored, in addition to enabling its critical evalua-tion, one of the foundations of philosophy and science. Several authors who are al-ready classics follow a similar line without, however, clearly adopting the author's position. These are the cases of Burnet, Havelock, and Ong. The text also shows some details of the linguistic evolution of Greek and its origins in the oralist mythical tradi-tion. -/- The main conclusion is that linguistic relativism in its strong version is an adequate method to deal with NPBB situation. -/- . In a recent paper in this journal, we proposed two novel puzzles associated with the precautionary principle. Both are puzzles that materialise, we argue, once we investigate the principle through an epistemological lens, and each constitutes a philosophical hurdle for any proponent of a plausible version of the precautionary principle. Steglich-Petersen claims, also in this journal, that he has resolved our puzzles. In this short note, we explain why we remain skeptical.

The text's objective is to show that the Western scientific tradition, since the pre-Socratics, has as one of its traits the search for a unitary and uni-versal system of knowledge. Since the modern age, many attempts have been directed toward the search for the unification of science, culminating in Neurath's analytical philosophy and efforts in cybernetics. These efforts reflected an epistemological expectation for the unity of science, seeking methods and languages that would allow such an achievement. But such an expectation (...) has not yet satisfied the hopes of the monists. The diversifi-cation of science deepened and, at the same time, the problems faced by humanity increased the need for science to offer answers to solve the great global problems. The planet and humanity are under severe pressure in many ways. Pollution and depletion of water resources, threats of mass extinction of biodiversity, deforestation, desertification, global climate change, persistent poverty for large contingents of the world's population, attacks on democratic systems and values in many countries, and, at this moment, a pandemic of great proportions. In short, a threat to the sus-tainability of the planet and civilization as such. The paper goes through Mode 1 of knowledge production, showing that this Model is limited and insufficient to solve the problems humanity is facing. Model 2 of knowledge production is suggested as the immediate perspective to support the cope with humanity´s global problems. This Agenda presupposes a new way to unify science, which transdisciplinarity can bring. Therefore, the unity of science wouldn´t be through reduction-ism or the unification of language, but through the new modus operandi of transdisciplinary practice. (shrink)

The article presents two antagonistic views of reality, one coming from modern science and the other from flat-Earthers, to discuss the relationships between common-sense, science, and reality. The concrete fact under analysis refers to the solar system and the position of the earth in this system, that is, the duality of geocentrism and heliocentrism. After discussing the reasons for denying geocentrism with arguments from theoretical physics, we return to discussing the duality against the backdrop of the history of science, showing (...) that the issue was much more complex when the Ptolemaic paradigm passed to the Copernican one in the 16th century. The article shows that the paradigm shift presupposed the invention of a reality that took more than 100 years to stop being an invention and become a reality. From an epistemological point of view, a discovery, even if it corresponds to empirical facts, needs theoretical support to be considered true or, in the terms we are dealing with here, to be considered reality and part of common sense. Ontologically speaking, we cannot consider a certain worldview as an existing reality beyond the mental model that created it. (shrink)

This article aims to discuss on Rousseau's justification for his Metaphysical position. We note in Rousseau a justification of personal nature in response to the arguments of materialist and atheist philosophers. Rousseau also criticizes the "systems spirit". In this context that Rousseau back to read Descartes to develop a doctrine of his own. This expedient opens the perspective of a moral and personal dimension in research for truth.

In this paper we present two distinctly epistemological puzzles that arise for one who aspires to defend some plausible version of the precautionary principle. The first puzzle involves an application of contextualism in epistemology; and the second puzzle concerns the task of defending a plausible version of the precautionary principle that would not be invalidated by de minimis.

Kahneman's theory of two systems assumes that human decision making in Economy is based on two cognitive systems, one that is automatic, intuitive and mostly unconscious, and one that is reflexive, rational and fully conscious. The authors consider Kahneman’s approach incomplete and limited in accounting for the creativity of embodied agents grasping the opportunities afforded by physical and social environments. This limitation leads us to argue for the existence of a third system in decision making in Economy, the creative intuition (...) based on direct perception of affordances, addressing not only the dispositions and goals of agents but also the social and environmental responsibility of corporations and governments. The authors argue that the third decision-making system the authors propose implies a concept of intuition that is different from the type of association process discussed by Morewedge and Kahneman [2] and gives an example of the third system operation, the Bolsa Família in Brazil, and finding new options for the funding of similar programs. A teoria dos dois sistemas (Kahneman, 2011), em suas várias vertentes, assume que a tomada de decisão humana é baseada em dois sistemas cognitivos: um que é automático, rápido, agindo com mínimo esforço cognitivo, intuitivo (no sentido de Morewedge & Kahneman, 2010), e majoritariamente inconsciente; e outro que é reflexivo, lento, atuando com intenso esforço cognitivo, racional e totalmente consciente. Neste trabalho, investigamos a teoria dos dois sistemas e sua aplicação na tomada de decisão econômica em governos democráticos, com ênfase (...) especial na proposta de Kahneman. Consideramos sua abordagem incompleta e limitada na explicação do processo intuitivo que orienta a tomada de decisão. Essa limitação nos leva a defender a existência de um terceiro sistema de tomada de decisão em Economia: a intuição ecológica criativa, baseada no attunement entre affective drives e percepção direta de affordances, abordando não só as disposições e objetivos dos agentes, mas também a responsabilidade socioambiental das empresas e governos. Argumentamos que o terceiro sistema de tomada de decisão que propomos implica um conceito de intuição diferente do associativismo de ideias de Simon (1992), e damos como exemplo do funcionamento do terceiro sistema o processo de tomada de decisão que conduziu à formação do Banco Finapop, no Brasil. Esta investigação tem por objetivo geral promover uma exposição do estado da arte do conceito de dolo eventual na dogmática penal, e, como objetivo específico, estabelecer bases metodológicas de como esse conceito pode ser construído, sistematizado e delimitado em relação à culpa consciente. A delimitação dos conceitos jurídico-penais é um importante instrumento para o estabelecimento de limites ao exercício do poder punitivo estatal. O conceito de dolo, na medida em que autoriza a aplicação de penas mais rigorosas em comparação à (...) culpa, demanda que a dogmática estabeleça claramente seus limites. Tarefa necessária não apenas para o conceito geral de dolo, mas também para o controverso “dolo eventual”, figura jurídica cuja conceituação e aplicação tem propiciado intensos debates na doutrina especializada, que, há pelo menos 200 anos, discute o problema de sua distinção com relação à outra figura não menos debatida, a da culpa (consciente). Devido à dificuldade de sua resolução, o pai do finalismo, Hans Welzel, considerou a distinção entre dolo eventual e culpa consciente uma das questões mais tormentosas do direito penal. Visando contribuir para o esclarecimento do tema, esta investigação apresenta dialeticamente os principais critérios e argumentos formulados na resolução desse intrincado problema jurídico, abrangendo, para este fim, tanto a discussão do período clássico da dogmática alemã (que legou vários conceitos até hoje debatidos e usados nesta matéria) quanto da moderna dogmática jurídico-penal, que tenta, a partir de novas abordagens, resolver a “tormentosa” questão. In this paper we shed new light on the Argument from Disagreement by putting it to test in a computer simulation. According to this argument widespread and persistent disagreement on ethical issues indicates that our moral opinions are not influenced by any moral facts, either because no such facts exist or because they are epistemically inaccessible or inefficacious for some other reason. Our simulation shows that if our moral opinions were influenced at least a little bit by moral facts, we (...) would quickly have reached consensus, even if our moral opinions were affected by factors such as false authorities, external political shifts, and random processes. Therefore, since no such consensus has been reached, the simulation gives us increased reason to take seriously the Argument from Disagreement. Our conclusion is however not conclusive; the simulation also indicates what assumptions one has to make in order to reject the Argument from Disagreement. The simulation algorithm we use builds on the work of Hegselmann and Krause (J Artif Soc Social Simul 5(3); 2002, J Artif Soc Social Simul 9(3), 2006). (shrink)

O nada é um signo, uma representação linguística do que se pensa ser a ausência de tudo. O que existe são representações mentais do nada. Como uma definição ou um conceito é uma afirmação sobre o que uma coisa é, o nada não é positivamente definido, mas apenas representado, fazendo-se a relação entre seu símbolo (a palavra "nada") e (...) a ideia que se tem da não-existência de coisa alguma. O "nada" não existe, mas é concebido por operações de mente. Esta é a concepção de Bergson, oposta à de Hegel, modernamente reabilitada, de que o nada seria uma entidade de existência real, em oposição ao ser. -/- . (shrink)

The term “altruism” is used in many ways. In this thesis, I discuss altruism as a motivation, which is an influential notion in philosophy and the social sciences. Questions about the nature and the possibility of altruistic motivation have inspired much debate, both in academia and in everyday conversations. How can we know when we are truly altruistic and when we are merely helping others as a means to some egoistic goal? Are humans even capable of genuine altruistic motivation or (...) are we always egoistic deep down? Before answering questions like these, however, we need to ask a more fundamental question: how should we define altruistic motivation? The standard account of altruistic motivation in the literature defines it as an ultimate desire to increase the welfare of others. The central claim I will argue for in this thesis is that this standard account is intrinsically flawed and should be abandoned. -/- The problem with the standard account of altruistic motivation, in short, is its reliance on the notion of “ultimate desire”, which is a limited and unfruitful way of conceptualizing altruistic motivation. The criticism I propose is based on an interdisciplinary analysis of many aspects of the standard account, discussing its philosophical basis, its use in scientific research, its historical development, and its relation to common sense and morality. -/- This thesis is divided into four parts, each composed of two chapters. Part I presents the many technical accounts of altruism present in the scientific literature, distinguishing the standard account of altruistic motivation from alternative accounts of altruism. I discuss the hypotheses of psychological altruism, which states that some of our ultimate desires aim to increase the welfare of others, and psychological egoism, which states that all of our ultimate desires are egoistic. In this first part, I discuss some of the central philosophical concepts underlying the standard account of altruistic motivation, showing their implications for the debate about psychological altruism. -/- Part II discusses the main arguments for the existence of altruistic motivation. I argue that the main arguments in the scientific literature fail in making a defense of psychological altruism and that the definition of altruistic motivation makes the solution to the debate on psychological altruism virtually impossible. I conclude that the standard account makes altruistic motivation an unverifiable and unfruitful notion for scientific research. -/- Part III discusses the history of altruism and egoism, focusing particularly on early modern philosophy. I argue that the modern accounts of altruism and egoism diverge from the contemporary standard account of altruistic motivation. Reading the debates in modern philosophy through the lens of psychological altruism and psychological egoism oversimplifies and impoverishes the modern debate. I argue that the standard account also fails in representing the original use of “altruism”, proposed by Auguste Comte. In this third part, I show how the use of the standard account of altruistic motivation cannot be based on its historical foundations. -/- Finally, Part IV addresses the normative character of altruism and discusses some alternative ways of conceptualizing altruism. I argue that the standard account of altruistic motivation does not reflect the ordinary use of the term “altruism” and fails in accounting for its normative character. As an alternative, I propose an alternative account of altruism, virtue altruism. I claim that this account better reflects the ordinary intuitions about altruism, accommodates the descriptive and normative dimensions of altruism, is at home with most of the historical accounts of altruism, and may promote the active promotion of altruistic actions. It will be the point of departure of this brief reflection concerning this subject, as well as about the placement of Poincaré’s thought in the scenario offered by some contemporary perspectives.
