Foucault's theory of power and subjectification challenges common concepts of freedom in social philosophy and expands them through the concept of 'freedom as critique': Freedom can be defined as the capability to critically reflect one's own subjectification, and the conditions of possibility for this critical capacity lie in political and social institutions. The article develops this concept through a critical discussion of the standard response by Foucault interpreters to the standard objection that Foucault's thinking obscures freedom. The standard response interprets (...) Fou-cault's later works, especially The Subject and Power, as a solution to the problem of freedom. It is mistaken, because it conflates different concepts of freedom that are present in Foucault's work. By differentiating these concepts, this paper proposes a new institutionalist approach to solve the problem of freedom that breaks with the partly anarchist underpinnings of Foucault scholarship: As freedom as critique is not given, but itself a result of subjectification, it entails a demand for 'modal robustness' and must therefore be institutionalized. This approach helps to draw out the consequences of Foucault's thinking on freedom for postfoundationalist democratic theory and the general social-philosophical discussion on freedom. (shrink)

Since approval of the EU General Data Protection Regulation (GDPR) in 2016, it has been widely and repeatedly claimed that the GDPR will legally mandate a ‘right to explanation’ of all decisions made by automated or artificially intelligent algorithmic systems. This right to explanation is viewed as an ideal mechanism to enhance the accountability and transparency of automated decision-making. However, there are several reasons to doubt both the legal existence and the feasibility of such a right. In contrast to the (...) right to explanation of specific automated decisions claimed elsewhere, the GDPR only mandates that data subjects receive meaningful, but properly limited, information (Articles 13-15) about the logic involved, as well as the significance and the envisaged consequences of automated decision-making systems, what we term a ‘right to be informed’. Further, the ambiguity and limited scope of the ‘right not to be subject to automated decision-making’ contained in Article 22 (from which the alleged ‘right to explanation’ stems) raises questions over the protection actually afforded to data subjects. These problems show that the GDPR lacks precise language as well as explicit and well-defined rights and safeguards against automated decision-making, and therefore runs the risk of being toothless. We propose a number of legislative and policy steps that, if taken, may improve the transparency and accountability of automated decision-making when the GDPR comes into force in 2018. (shrink)

Die Debatte um die politische Differenz stellt Kontingenz und Konfliktualität als fundamentale Eigenschaften des Politischen heraus. Dies birgt ein Problem für die postfundamentalistische Demokratietheorie, die auf Augenhöhe mit dieser Debatte argumentieren will: Durch die Kontingentsetzung aller normativen Begründungen ist zunächst unklar, welche Art von demokratischen Institutionen wie begründet werden kann, und sogar, ob es überhaupt eine von der postfundamentalistischen Sozialontologie ausgehend argumentierende normative Begründung für demokratische Institutionen geben kann. Meine These ist, dass Freiheit, verstanden als kontinuierliche selbstreflexive Kritik, derjenige normative (...) Begriff ist, der sich aus der Sozialontologie von Konflikt und Kontingenz herleiten lässt. Anders gesagt: Freiheit als Kritik ist derjenige Universalismus, der sich aus der Ontologie des Partikularismus ableitet. Freiheit als Kritik kann dabei einerseits das Operieren einiger Institutionen in liberal-pluralistischen Demokratien beschreiben, und andererseits als radikaldemokratisch-normativer Kritikbegriff für die Analyse ihrer Dysfunktionalität dienen. Um diese These zu begründen, gehe ich zurück zu einem Theoretiker, der eine Grundlage der aktuellen Debatte um das Politische bildet: Foucault, dessen Machttheorie als Ansatz einer Sozialontologie der Kontingenz und Konfliktualität gelten kann. Gleichzeitig hat Foucault den Begriff der Freiheit als den zu dieser Ontologie passenden normativen Begriff herausgestellt. (shrink)

"Biopolitics" has become a popular concept for interpreting the COVID-19 pandemic, yet the term is often used vaguely, as a buzzword, and therefore loses its specificity and relevance. This article systematically explains what the biopolitical lens offers for analyzing and normatively criticizing the politics of the coronavirus. I argue that biopolitics are politics of differentiated vulnerability that are intrinsic to capitalist modernity. The situation resulting from the COVID-19 pandemic is, therefore, less of a state of exception than it might appear; (...) COVID-19 is a continuation and intensification of the capitalist biopolitics of differentiated vulnerability. In order to critically evaluate this situation, the article proposes the concept of "democratic biopolitics" and shows how it can be used, among others, for a queer critique of the differentiated vulnerabilities that are produced by the coronavirus and its capitalist governance. In contrast to widespread interpretations of democratic biopolitics that focus on collective care in communities, this article highlights the role of the state and of the redistribution of political power and economic resources as key for biopolitical democratization. Karsten Schubert liefert die erste systematische Rekonstruktion der sozialphilosophischen Debatte um Freiheit bei Foucault und eine neue Lösung für das Freiheitsproblem: Freiheit als die Fähigkeit zur reflexiven Kritik der eigenen Subjektivierung – kurz: Freiheit als Kritik – ist das Resultat von freiheitlicher Subjektivierung in politischen Institutionen. Der Band zeigt so die Konsequenzen von Foucaults Freiheitsdenken für die Demokratietheorie und die allgemeine sozialphilosophische Freiheitsdiskussion auf.

Wie Herrschaft kritisieren, wenn Kategorien wie Staat, Souveränität und Demokratie nicht mehr funktionieren? Der Regimebegriff verspricht einen Ausweg aus diesem praktischen wie theoretischen Dilemma. Er soll nicht nur helfen, Macht und Herrschaft besser zu verstehen, sondern auch eine neue Grundlage für tiefere und radikalere Gesellschaftskritik bieten: Das Denken in Regimen bezieht Denk- und Wahrnehmungsmuster in die Analyse und Kritik von gesellschaftlichen Strukturen, (politischer) Macht und alltäglichen Normen und Praxen ein. Kurz: Regimeanalysen helfen uns zu sehen, was sonst unsichtbar bliebe, wie (...) etwa die rassistische Regulierung von Migration, die Normierung von Geschlechterverhältnissen oder die Neoliberalisierung von Universitäten. This book offers a detailed study of the political philosophies of Thomas Hobbes and Benedict de Spinoza, focussing on their concept of power as potentia, concrete power, rather than power as potestas, authorised power. The focus on power as potentia generates a new conception of popular power. Radical democrats–whether drawing on Hobbes's 'sleeping sovereign' or on Spinoza's 'multitude'–understand popular power as something that transcends ordinary institutional politics, as for instance popular plebsites or mass movements. However, the book argues that these (...) understandings reflect a residual scholasticism which Hobbes and Spinoza ultimately repudiate. Instead, on the book's revisionist conception, a political phenomenon should be said to express popular power when it is both popular (it eliminates oligarchy and encompasses the whole polity), and also powerful (it robustly determines political and social outcomes). Two possible institutional forms that this popular power might take are distinguished: Hobbesian repressive egalitarianism, or Spinozist civic strengthening. But despite divergent institutional proposals, the book argues that both Hobbes and Spinoza share the conviction that there is nothing spontaneously egalitarian or good about human collective existence. From this point of view, the book accuses radical democrats of pernicious romanticism; the slow, meticulous work of organizational design and maintenance is the true centre of popular power. In der Debatte um Freiheit bei Foucault wird das „Freiheitsproblem“ verhandelt: Wie können Freiheit und Widerstand innerhalb von Foucaults Theorie der Macht und Subjektivierung konzipiert werden? Der Aufsatz leistet eine Rekonstruktion und interne Kritik der besten Interpretationsstrategien von Foucaults Werk, die die Lösung dieses Problems zum Ziel haben, und entwickelt dabei eine neue These: Freiheit als Fähigkeit zur reflexiven Kritik der eigenen Subjektivierung ist abhängig von freiheitlicher Subjektivierung durch politische Institutionen. Die Interpretationsstrategien werden systematisch unterschieden und anhand der Arbeiten exemplarischer (...) Vertreter_innen diskutiert: 1. Foucault ist kohärent, 2. Foucault korrigiert sich, 3. Foucault kritisiert kohärent, 4. Foucault ist nicht genug. Gegen Lemke wird argumentiert, dass Freiheit nicht durch eine anarchistische, sondern nur durch eine institutionalistische Foucault-Lesart bestimmt werden kann. Mit Saar wird gezeigt, dass das Ziel einer eindeutigen Definition von Freiheit im Gegensatz zur Methode der genealogischen Kritik steht und nur im Rahmen der normativen politischen Theorie verfolgt werden kann. Although high-performance human resource practices do not directly affect corporate social performance strengths, they do positively affect CSP strengths in companies that are highly innovative or have high levels of slack. High-performance human resource management practices also directly and negatively affect CSP concerns. Drawing on the resource-based view and using secondary data from an objective, third-party database, the authors develop and test hypotheses about how high-performance HRM affects a company’s CSP strengths and concerns. Once the distinction is made between the authorized and the effective power of the sovereign, it is no longer sufficient simply to defend a doctrine of the authorized power of the sovereign; such a doctrine must be robustly complemented by an account of how the effective power commensurate to this authority might be achieved. (...) Nor is this straightforward: for effective political power can fluctuate, sometimes severely. In this light, the prevalent juridical reading of Hobbes’s political philosophy is inadequate. PrEP (Pre-Exposure Prophylaxis) is a relatively new drug-based HIV prevention technique and an important means to lower the HIV risk of gay men who are especially vulnerable to HIV. From the perspective of biopolitics, PrEP inscribes itself in a larger trend of medicalization and the rise of pharmapower. This article reconstructs and evaluates contemporary literature on biopolitical theory as it applies to PrEP, by bringing it in a dialogue with a mapping of the political debate on PrEP. As PrEP changes (...) sexual norms and subjectification, for example condom use and its meaning for gay subjectivity, it is highly contested. The article shows that the debate on PrEP can be best described with the concepts ‘sexual-somatic ethics’ and ‘democratic biopolitics’, which I develop based on the biopolitical approach of Nikolas Rose and Paul Rabinow. In contrast, interpretations of PrEP which are following governmentality studies or Italian Theory amount to either farfetched or trivial positions on PrEP, when seen in light of the political debate. Furthermore, the article is a contribution to the scholarship on gay subjectivity, highlighting how homophobia and homonormativity haunts gay sex even in liberal environments, and how PrEP can serve as an entry point for the destigmatization of gay sexuality and transformation of gay subjectivity. ‘Biopolitical democratization’ entails making explicit how medical technology and health care relates to sexual subjectification and ethics, to strengthen the voice of (potential) PrEP users in health politics, and to renegotiate the profit and power of Big Pharma. ABSTRACT Genevieve Lloyd argues that when we follow Spinoza in understanding reason as a part of nature, we gain new insights into the human condition. Specifically, we gain a new political insight: we should respond to cultural difference with a pluralist ethos. This is because there is no pure universal reason; human minds find their reason shaped differently by their various embodied social contexts. Furthermore, we can use the resources of the imagination to bring this ethos about. In my response, (...) I offer a friendly challenge to Lloyd’s characterisation of the lessons of Spinoza’s philosophy. I argue that Lloyd’s Spinoza remains excessively unpolitical, even in the moment that he is brought to bear on contemporary politics. An unpluralistic attitude may well be rationally inferior, but is it really explained by insufficient or inappropriate imagination? To the contrary, a properly Spinozist account of reason must include an account of the concrete determinants of reason’s imperfect realisation in the world. In Spinoza’s own oeuvre, this is carried out through an ever-increasing—and ever more sociological—interest in the political structures within which individual reason flourishes or withers. (shrink)

Hussain claims that ethical consumers are subject to democratic requirements of morality, whereas ordinary price/quality consumers are exempt from these requirements. In this paper, we demonstrate that Hussain’s position is incoherent, does not follow from the arguments he offers for it, and entails a number of counterintuitive consequences.

According to a recent interpretive orthodoxy, Spinoza is a profoundly democratic theorist of state authority. I reject this orthodoxy. To be sure, for Spinoza, a political order succeeds in proportion as it harnesses the power of the people within it. However, Spinoza shows that political inclusion is only one possible strategy to this end; equally if not more useful is political exclusion, so long as it maintains what I call the depoliticised acquiescence of those excluded.

PrEP (Präexpositionsprophylaxe) ist ein relativ neues Mittel zur Prävention von HIV-Infektionen. HIV-negative Menschen nehmen antivirale Medikamente ein, die verhindern, dass der Kontakt mit dem Virus zu einer Infektion führt. Im Gegensatz zum Kondomgebrauch basiert dieses Präventionsverfahren auf Medikamenten und nicht auf einer Verhaltensänderung. Aus der Perspektive der Biopolitik fügt sie sich in einen größeren Trend in Richtung Medikalisierung, des Anstiegs der Macht der Pharmaindustrie und der Reglementierung des Risikos ein. Sexuelles Verhalten ist das Ergebnis der Subjektivierung, des Prozesses, durch den (...) soziale Normen Subjekte und ihre Wünsche bilden. Die Medikalisierung von schwulem Sex durch PrEP verändert die sexuelle Subjektivierung und geht daher mit einer Veränderung der Praktiken von schwulem Sex einher. Nach einer kurzen Erläuterung der medizinischen Besonderheiten und der Geschichte von PrEP (1) vereint dieser Artikel eine Rekonstruktion zeitgenössischer theoretischer Ansätze zur Biopolitik im Zusammenhang mit PrEP (2) mit einer Darstellung aktueller politischer Debatten um PrEP (3). Die Untersuchung zeigt, dass sich Gouvernementalitätsstudien und die Italienische Theorie auf repressive Machtverhältnisse konzentrieren und daher die Komplexität der Debatte nicht berücksichtigen können, die sich aus der Subjektivität und Handlungsfähigkeit verschiedener beteiligter Akteure, insbesondere schwuler PrEP-Aktivisten, ergibt. Dennoch werden Interpretationen von PrEP als repressiver Macht auch von einigen Akteuren in der politischen Debatte um PrEP genutzt, meist ohne ausdrücklichen Bezug zur biopolitischen Theorie. Nikolas Roses und Paul Rabinows differenziertes Konzept der Biopolitik bietet einige Ansätze wie diejenigen der biopolitischen Bürgerschaft und der somatischen Ethik, um die Debatte um PrEP und die damit verbundenen komplexen Verhandlungen über Sexualität zu beschreiben. Ausgehend von diesen Ideen entwickle ich ein neues Konzept der ‚demokratischen Biopolitik‘ von PrEP, die eine weitere Demokratisierung der Sexualität im biopolitischen Zeitalter ermöglicht. (shrink)

Seine Macht- und Subjekttheorie ist die Basis für eine nicht- essentialistische Analyse von Sexualität und für die Kritik ihrer normierenden Wirkung, die Foucault selbst in Der Wille zum Wissen (1983, frz. 1976) begonnen hat und die das Kerngeschäft der Queertheorie ist. Während Foucault als Grundlage der Queertheorie insgesamt rezipiert wird, gibt es eine spezifisch schwule Rezeption von Foucault, (...) die an seine vielfältigen Äußerungen zur schwulen Politik anschließt und dessen Machtanalyse und seine späteren Arbeiten zur Ästhetik der Existenz mobilisiert, um damit das schwule Leben vor, während und nach der AIDS-Krise zu analysieren. It is common to assimilate Marx’s and Spinoza’s conceptions of democracy. In this chapter, I assess the relation between Marx’s early idea of “true democracy” and Spinozist democracy, both the historical influence and the theoretical affinity. Drawing on Marx’s student notebooks on Spinoza’s Theological-Political Treatise, I show there was a historical influence. However, at the theoretical level, I argue that a sharp distinction must be drawn. Philosophically, Spinoza’s commitment to understanding politics through real concrete powers does not support with Marx’s (...) anti-institutional conception of true democracy. And as a matter of social theory, the gap between civil society and the state which so troubles Marx is a development of modernity that has not entered Spinoza's premodern field of view. Marx’s true democracy was also influenced by his study of Rousseau, and theoretically, it is just as close if not closer to Rousseau as to Spinoza. (shrink)

This paper is aimed at understanding one central aspect of Bolzano's views on deductive knowledge: what it means for a proposition and for a term to be known a priori. I argue that, for Bolzano, a priori knowledge is knowledge by virtue of meaning and that Bolzano has substantial views about meaning and what it is to know the latter. In particular, Bolzano believes that meaning is determined by implicit definition, i.e. the fundamental propositions in a deductive system. I go (...) into some detail in presenting and discussing Bolzano's views on grounding, a priori knowledge and implicit definition. I explain why other aspects of Bolzano's theory and, in particular, his peculiar understanding of analyticity and the related notion of Ableitbarkeit might, as it has invariably in the past, mislead one to believe that Bolzano lacks a significant account oï a priori knowledge. Throughout the paper, I point out to the ways in which, in this respect, Bolzano's antagonistic relationship to Kant directly shaped his own views. (shrink)

It seems that the connection between Bolzano's rejection of the traditional quantificational notation for universal propositions and the articulation of his notion of universal validity has remained, until today, perfectly unnoticed. In this paper, I will show that there is such a connection. Particularly, since analyticity is a special case of universal validity, my intention is to show that the problems to which Bolzano's perfectly original account of analyticity seeks to find an answer are intrinsically related to the traditional conception of universal quantification as it arises in the context of Kant's treatment of analyticity. Negri celebrates a conception of democracy in which the concrete powers of individual humans are not alienated away, but rather are added together: this is a democracy of the multitude. But how can the multitude act without alienating anyone’s power? To answer this difficulty, Negri explicitly appeals to Spinoza. Nonetheless, in this paper, I argue that Spinoza’s philosophy does not support Negri’s project. I argue that the Spinozist multitude avoids internal hierarchy through the mediation of political institutions and not in (...) spite of them; nor do these institutions merely emanate from the multitude as it is, but rather they structure, restrain and channel its passions. In particular, the required institutions are not those of a simple direct democracy. There may be other non-Spinozist arguments on which Negri can ground his theory, but he cannot legitimately defend his conception of the democratic multitude by appeal to Spinoza. (shrink)

In October 2016, the White House, the European Parliament, and the UK House of Commons each issued a report outlining their visions on how to prepare society for the widespread use of artificial intelligence. In this article, we provide a comparative assessment of these three reports in order to facilitate the design of policies favourable to the development of a ‘good AI society’. To do so, we examine how each report addresses the following three topics: the development of a ‘good (...) AI society’; the role and responsibility of the government, the private sector, and the research community in pursuing such a development; and where the recommendations to support such a development may be in need of improvement. Our analysis concludes that the reports address adequately various ethical, social, and economic topics, but come short of providing an overarching political vision and long-term strategy for the development of a ‘good AI society’. In order to contribute to fill this gap, in the conclusion we suggest a two-pronged approach. (shrink)

In this paper, I articulate two Hobbesian models of interpersonal power relations that can be used to understand gender relations in society: what I will call the dominion model and the deference model. The dominion model discerns vertical subjection to another's will, whereas by contrast the deference model places individuals in a complex and shifting webs of favor and disfavor. Hobbes himself analyses gender relations through the dominion model. Indeed, more broadly this is the most prominent model of interpersonal power (...) relations throughout his texts. It is this model which is also reflected in the very rich existing feminist literature on Hobbes. However, the deference model, emerging only late in Hobbes's oeuvre, offers a superior general rubric for understanding interpersonal power relations. In particular, in light of its ability to grasp informal and diffuse relations of power, I argue that it offers useful insights for thinking about gender relations in our post-coverture era. Vom lange unter Verschluss gehaltenen Band erhofft sich die Leser_innenschaft neue Erkenntnisse nicht nur zum Thema des Buches – die Reflexionen der Kirchenväter bis Augustinus zu Sexualität und Lebensführung –, sondern zu Foucaults Werk im Allgemeinen und den großen Fragen nach Macht, Freiheit und Kritik, die dessen Rezeption bestimmen. Und tatsächlich bietet der Band überraschend neue Einsichten, (...) in deren Lichte sich die herrschende Meinung zu Foucaults Freiheits- und Kritikbegriff als falsch herausstellt. Heute ist die These verbreitet, dass Foucaults Arbeiten zur antiken Ethik und parrhesia als Beitrag zu einem normativen Freiheitsbegriff gewertet werden können. Translated by María Cecilia Padilla and Gonzalo Ricci Cernadas. Negri celebra una concepción de la democracia en la que los poderes concretos de los individuos humanos no se alienan sino que se agregan: una democracia de la multitud. Pero ¿cómo puede actuar la multitud sin alienar el poder de nadie? Para contestar esta dificultad, Negri explícitamente apela (...) a Spinoza. Sin embargo, en este trabajo, sostengo que la filosofía de Spinoza no respalda el proyecto de Negri. Por el contrario, argumento que la multitud spinozista evita la jerarquía interna por medio de la mediación de las instituciones políticas y no a pesar de ellas; de la misma manera, estas instituciones tampoco simplemente emanan de la multitud tal cual es, sino que estructuran, contienen y canalizan sus pasiones. Hobbes’s science of politics rests on a dual analysis of human beings: humans as complex material bodies in a network of mechanical forces, prone to passions and irrationality; and humans as subjects of right and obligation, morally exhortable by appeal to the standards of reason. The science of politics proposes an absolutist model of politics. If this proposal is not to be idle utopianism, the enduring functioning of the model needs to be compatible with the materialist analysis of human behaviour. (...) Wie können Freiheit und Widerstand innerhalb von Foucaults Theorie der Macht und Subjektivierung konzipiert werden? Karsten Schubert liefert die erste systematische Rekonstruktion der sozialphilosophischen Debatte um Freiheit bei Foucault und eine neue Lösung für das Freiheitsproblem: Freiheit als die Fähigkeit zur reflexiven Kritik der eigenen Subjektivierung – kurz: Freiheit als Kritik – ist das Resultat von freiheitlicher Subjektivierung in politischen Institutionen. Der Band zeigt so die Konsequenzen von Foucaults Freiheitsdenken für die Demokratietheorie und die allgemeine sozialphilosophische Freiheitsdiskussion auf.

Integrity is often conceived as a heroic ideal: the person of integrity sticks to what they believe is right, regardless of the consequences. In this article, I defend a conception of ordinary integrity, for people who either do not desire or are unable to be moral martyrs. Drawing on the writings of seventeenth century thinker Huang Zongxi, I propose refocussing attention away from an abstract ideal of integrity, to instead consider the institutional conditions whereby it is made safe not to (...) be servile. Political protesters often don’t play by the rules. Think of the Occupy Movement, which brought lower Manhattan to a standstill in 2011 under the slogan, “We are the 99%”. Closer to home, think of the refugee activists who assisted a breakout from South Australia’s Woomera detention centre in 2002. Both are examples of contentious politics, or forms of political engagement outside the institutional channels of political decision-making. The democratic credentials of contentious politics are highly ambivalent. On the one hand, contentious (...) politics appears to have insufficient respect for democratic decision. Protesters are often forceful, uncivil and rowdy, aiming to disproportionately influence policy. But shouldn’t proposals be put forward with civility through the proper channels? And shouldn’t their proponents accept with good grace if they are democratically rebuffed? A closer look at the history of political thought can provide us with the framework to assess the case for and against the democratic reasonableness of contentious politics. (shrink)

The European Hobbes Society Online Colloquium featured my book, Potentia: Hobbes and Spinoza on Power and Popular Politics, with critical commentaries from Alissa MacMillan, Chris Holman, and Justin Steinberg. This is my response to their commentaries.

Students often have difficulty connecting theoretical and text-based scholarship to the real world. When teaching in Asia, this disconnection is exacerbated by the European/American focus of many canonical texts, whereas students' own experiences are primarily Asian. However, in my discipline of political philosophy, this problem receives little recognition nor is it comprehensively addressed. In this paper, I propose that the problem must be taken seriously, and I share my own experiences with a novel pedagogical strategy which might offer a possible (...) path forward. Recent scholarship has championed an active learning approach, where students engage in their own research, and deliver outward-facing products that have a meaning and purpose beyond the confines of the student-professor relationship. In this spirit, I have put into practice a strategy of course design, where active learning is used to overcome students' disconnection with the course content. In particular, as a major component of course assessment, students are required to write an 'opinion piece', which is then showcased on a public website. The opinion piece must address a real-world issue which the student himself or herself selects and deems important; furthermore, it must build on the theoretical tools of the course and be written in a style which makes it accessible to a wider audience. I discuss the implementation of this strategy in two political philosophy courses, including strategies to avoid 'dumbing down' and ‘diluting’ the process of critical thinking. While no formal analysis of impact of the strategy on learning outcomes has been conducted, an anonymous pedagogical survey has yielded an overwhelmingly positive response for students' self-reported perceptions of the curricular innovations. Is there something about the deep logic of democracy that destines it to succeed in the world? Democracy, the form of politics that includes everyone as equals – does it perhaps suit human nature better than the alternatives? After all, surely any person who is excluded from the decision-making in a society will be more liable to rise up against it. From ancient thinkers like Seneca to contemporary thinkers like Francis Fukuyama, we can see some version of this line of (...) thought. Seneca thought that tyrannies could never last long; Fukuyama famously argued that liberal democracy is the end of history. I want to focus instead on the person credited with giving the most direct and uncompromising statement of this thought: Benedict de Spinoza. However, in this article, I argue to the contrary that Spinoza’s view of aristocracy should give pause to radical democrats. He does not see a historical movement towards democracy, nor does he see the superiority of democracy as written into human nature. (shrink)

Identity politics is commonly criticized as endangering democracy by undermining community, rational communication, and solidarity. Drawing on both radical democratic theory and standpoint theory, this article posits the opposite thesis: identity politics is pivotal for the democratization of democracy. Democratization through identity politics is achieved by disrupting hegemonic discourse and is, therefore, a matter of power, while such forms of power politics are reasonable when following minority standpoints generated through identity politics. The article develops this approach by connecting radical democratic (...) theories with standpoint theories and highlighting their commonalities and potential for mutual enhancement. Standpoint theory allows us to substantiate and reconcile two initially contradictory claims: particular minority standpoints are necessary to criticize the prevailing discursive and institutional orders, and these standpoints stem from intersubjective reason and embody ‘strong objectivity.’ This discussion presents a new perspective on the tension between particularity and universality, as well as the relationship between power and reason in democracy. Democratization is an oscillation between these polarities, and political theory should not aim to resolve this tension but to recognize and articulate it. Such recognition might involve elevating knowledge emerging from oppressed groups and exercising epistemic modesty when assessing specific forms of identity politics. (shrink)

Die Debatte um die politische Differenz stellt Kontingenz und Konfliktualität als fundamentale Eigenschaften des Politischen heraus. Dies stellt die postfundamentalistische Demokratietheorie, die auf Augenhöhe mit dieser Debatte argumentieren will, vor ein Problem: Durch die Kontingentsetzung aller normativen Begründungen ist zunächst unklar, welche Art von demokratischen Institutionen wie begründet werden kann, und sogar, ob es überhaupt eine von der postfundamentalistischen Sozialontologie ausgehend argumentierende normative Begründung für demokratische Institutionen geben kann. Meine These ist, dass Freiheit, verstanden als kontinuierliche selbstreflexive Kritik, derjenige normative (...) Begriff ist, der sich aus der Sozialontologie von Konflikt und Kontingenz herleiten lässt. Anders gesagt: Freiheit als Kritik ist derjenige Universalismus, der sich aus der Ontologie des Partikularismus ableitet. Freiheit als Kritik kann dabei einerseits das Operieren einiger Institutionen in liberal-pluralistischen Demokratien beschreiben, und andererseits als normativer Kritikbegriff für die Analyse ihrer Dysfunktionalität dienen. Um diese These zu begründen, gehe ich zurück zu einem Theoretiker, der eine Grundlage der aktuellen Debatte um das Politische bildet: Foucault, dessen Machttheorie als Ansatz einer Sozialontologie der Kontingenz und Konfliktualität gelten kann. Gleichzeitig hat Foucault den Begriff der Freiheit als den zu dieser Ontologie passenden normativen Begriff herausgestellt. Durch eine Rekonstruktion und Kritik der sozialphilosophischen Debatte um Freiheit in Foucaults Werk lässt sich der Begriff der Freiheit als Kritik systematisch bestimmen. So kann – mit Foucault gegen Foucault – gezeigt werden, dass er nur innerhalb einer pluralistischen und liberalen Demokratietheorie gedacht werden kann. (shrink)

The concept of imperium is central to Spinoza's political philosophy. Imperium denotes authority to rule, or sovereignty. By extension, it also denotes the political order structured by that sovereignty, or in other words, the state. Spinoza argues that reason recommends that we live in a state, and indeed, humans are hardly ever outside a state. But what is the source and scope of the sovereignty under which we live? In some sense, it is linked to popular power, but how precisely, (...) and how is this popular grounding to be reconciled with the absolutist elements in Spinoza's texts? Against prominent liberal and radical democratic interpretations, I argue that Spinoza's insistence on linking imperium to the power of the people amounts to a normative attitude towards politics in which the formal features of a political system are less significant than the concrete everyday functioning of that system. Furthermore, I argue that its good functioning is importantly a product of an institutional order which does not simply defer to human individuality or to the primordial multitude, but instead, actively shapes them. While it may be worthwhile railing against monarchy and aristocracy and demanding liberal or radical democracy, the prior and more important challenge is to increase the robustness and resilience of the multitude within whatever form of state presents itself, through boring, meticulous, and incremental institutional design. For Spinoza, it is a robust and resilient political order that truly merits being called absolute. (shrink)

While ‘cancel culture’ is commonly regarded as limiting freedom of speech and artistic freedom, this article proposes a new understanding of ‘cancel culture’ as emancipatory norm-setting that is key for democratization. On a non-governmental level of the self-regulation of the art world, the argument for artistic freedom ignores the fact that art is permeated by power. The introduction of ‘politically correct’ norms leads to a justified redistribution of such power. On a parastatal level of public broadcasting and state cultural funding, (...) neutrality is necessary but should be understood materially to include marginalized voices. Restrictions of freedom of speech and artistic freedom do occur on the state-level of hate-speech regulation. Here, the danger of a potential shift from emancipatory regulation to a harmful restriction is particularly virulent, as a discussion of the German BDS ban shows. (shrink)

Right-wing intellectuals often invoke Nietzsche's concept of slave morality to underpin their criticism of 'political correctness' ('PC'). This interconnection of Nietzsche's slave morality and 'PC' criticism is correct, as a systematic analysis of their common elements shows, which leads to a new description of 'PC' criticism as a defense of privilege. In contrast to the right-wing Nietzschean 'PC' critique, the left-wing Nietzschean concept of a privilege-critical ‘political judgement' understands politics as a struggle for power, in which the space of the (...) political and related discourses are always already regulated and determine the conditions under which resources and privileges are distributed. Therefore, it is appropriate for an emancipatory position to critically question the established norms and to support political projects that aim to rewrite them. Because 'PC', as emancipative political judgement, dismantles privileges, its restricting of the privileged is not a side effect to be avoided but one of its reasonable core effects. Left-wing Nietzscheanism helps to avoid being surprised by right-wing aggression and to counter it vigorously by setting strict political norms. (shrink)

On considère souvent, à la suite des ouvrages classiques de J. Bouveresse, que Wittgenstein veut opérer un rejet ou une critique de la subjectivité. Il semble cependant que les derniers textes de Wittgenstein consacrés à la philosophie de la psychologie permettent de modifier partiellement ce point de vue, et défaire place à une conception spécifique de la subjectivité, redéfinissant un sujet dépsychologisé voire désubjectivé, qui n'est plus le point sans étendue du Tractatus, ni le sujet métaphysique, ni le sujet de (...) la psychologie, mais simplement une voix ordinaire. Wittgenstein's later work is often held by critics in France, following e.g. Jacques Bouveresse's insights, to be operating a criticism of both interiority and subjectivity. A reading of Wittgenstein's later writings on the philosophy of psychology might somehow change such a point of view, and redefine a specific view — as a de-psychologized species — of subjectivity in Wittgenstein's writing, thus redefining the wittgensteinian subject in terms of an ordinary voice. Diskriminierung und Menschenrechtsverletzungen gegenüber LSBTI-Personen werden heute international thematisiert und angeprangert – ein vergleichsweise neues Phänomen. Dennoch tragen die herrschenden Normen von Zweigeschlechtlichkeit und Heterosexualität weiterhin zur Diskriminierung bei: So sind gleichgeschlechtliche Partnerschaften in fast allen Staaten schlechter gestellt als heterosexuelle. Transgeschlechtliche Menschen erfahren Gewalt, weil ihr Verhalten und Äußeres nicht geltenden Normen entsprechen.

Academic freedom is under attack, both in authoritarian democracies, such as Hungary and Turkey, and in liberal Western democracies, such as the United States, the UK, France and Germany. For example, Gender Studies are being targeted by right-wing governments in Eastern Europe, and in France President Emmanuel Macron has attacked post-colonial and critical theories as “Islamo-gauchisme“, portraying them as a danger to the Republic. However, dominant discourses about academic freedom and free speech in the global north, lately especially in France (...) and Germany, focus on an alleged threat to academic freedom through “political correctness” and “cancel culture”, that, under scrutiny, often turn out to be exactly the opposite, namely defences of plurality and critical voices. Menschenrechtsverletzungen aufgrund sexueller Orientierung und Geschlechtsidentität (SOGI) wurden auf internationaler Ebene lange Zeit kaum zur Kenntnis genommen. Doch seit einigen Jahren wird dem Thema in den Vereinten Nationen breiterer Raum eingeräumt. Die Yogyakarta-Prinzipien und eine Studie des Amtes des Hohen Kommissars für Menschenrechte stellen nur die ersten Schritte auf dem Weg zu einem umfassenderen Schutzansatz dar. Er muss gegen den Widerstand vieler Staaten weiterverfolgt werden.
