En este trabajo presentamos los fundamentos teóricos de una propuesta para el abordaje didáctico de concepciones teleológicas de los y las estudiantes en la enseñanza de la Biología. La propuesta en cuestión supone acudir al modo en que Darwin lidió con las concepciones teleológicas dominantes entre sus contemporáneos, para proponer una estrategia general a través de la cual se podría incidir sobre las intuiciones teleológicas de los estudiantes, de modo que se pueda facilitar el aprendizaje de la teoría de la (...) selección natural. Sugeriremos también que esta propuesta implica un modo original de apelar a la analogía entre el cambio teórico en la Historia de la Ciencia y el aprendizaje de las ciencias. (shrink)

Los experimentos mentales son dispositivos epistémicos de la imaginación, o de análisis de problemas filosóficos, que recorren las fronteras de aquella, desde el sillón. Dichas fronteras tocan dilemas perennes de la filosofía: cuestiones de la metafísica, como el tiempo, el espacio y la realidad, el problema de la libertad y el determinismo, la naturaleza de la mente, la identidad personal, los argumentos acerca del significado, las posibilidades, fuentes y condiciones del conocimiento, las relaciones entre discurso y lógica, la ética, cuestiones (...) de la filosofía social y política, y la estética. Muchos problemas de la filosofía han sido abordados mediante experimentos mentales, una herramienta útil de la caja de herramientas del filósofo. No todas las herramientas son populares, no obstante. Los experimentos mentales son, pese a sus defensores, falibles, incluso si son argumentos bien planteados. Justamente, este libro recopila artículos con las principales defensas y ataques a los experimentos mentales, especialmente en términos de su confiabilidad para llegar a conclusiones, o bien de su relevancia en términos de su origen: el sillón de la filosofía. Este ha sido vapuleado por los nuevos aires de la filosofía analítica, que trata al sillón como un viejo artefacto del análisis a priori. De hecho, hay posturas que critican a los experimentos mentales por constituir bombas de intuiciones no confiables. Por supuesto, no hay razón irrefutable para aceptar los experimentos mentales y las filosofías de sillón. Pero ¿hay alguna en la filosofía? El libro no pretende convencer al lector del valor de los experimentos mentales y las filosofías de sillón. Por el contrario, su objetivo es formar una imagen propia de estos dispositivos epistémicos, tanto en relación con sus virtudes y limitaciones. Si ello se logra, habrá valido el esfuerzo llevado a cabo en esta compilación de artículos, los que muestran los límites, desafíos y críticas de la experimentación mental desde el sillón. (shrink)

Este texto esboza, desde el trabajo de campo y las fuentes escritas, una aproximación a una lectura simbólica de las relaciones entre humanos, ángeles y genios en el sufismo de la etnia (...) pular y, en concreto, en la experiencia y la narrativa del maestro sufí senegalés Thierno Ḥassan Dem. -/- The elaborate cosmologies of Akbarian Sufism, in which neo-Sufism is inspired, are interspersed with millenary traditions where the genius (ǧinn) and the angel (malāk) coexist with humans as once the natural spirits and ancestors did. This paper outlines, from the field work and the written sources, an approach to a symbolic reading of the relations between humans, angels and geniuses in the Sufism of the Fulani people. Retomando el tan explorado debate entre elitismo y populismo penal, este libro adopta una perspectiva republicana para argumentar a favor de un mayor grado de participación popular en la determinación de las penas. En el plano de la teoría no-ideal, se argumenta que fenómenos como las dinámicas de indignación y los linchamientos, contrariamente a lo que se sugiere, cuentan a favor de la democratización de los sistemas penales. En este sentido, el libro disputa el enfoque de quienes sostienen que las (...) preferencias punitivas arbitrarias de los ciudadanos deberían favorecer mecanismos que aíslen la política criminal de la influencia popular. Por el contrario, se argumenta que tanto el elitismo como el populismo penal operan como fuentes de diferentes tipos de dominación y, por lo tanto, deben evitarse en un estado republicano. Adicionalmente, el libro se propone responder a la necesidad de revisar los presupuestos teóricos del pensamiento crítico sobre los sistemas penales señalada por Carlos Santiago en su debate con Eugenio Raúl Zaffaroni. En consecuencia, la pregunta sobre cuál debe ser el grado de participación popular en los sistemas penales es abordada en el marco de la teoría política republicana. De este modo les lectores cuentan con la ventaja de poder cuestionar los presupuestos normativos de fondo, la propia teoría republicana y la centralidad del valor de la libertad como no-dominación, o el modo en que son empleados para defender una propuesta de democratización. Resumen Con el presente artículo se pretende analizar la colonialidad del poder como eje central de las relaciones de dominación que marcaron la primera década del siglo XXI en Colombia, más específicamente estudiando los casos del clientelismo político en zonas periféricas como el Casanare, y el caso Carimagua. Para desarrollar esta investigación, se realizó un análisis documental tomando como referente autores de la filosofía política latinoamericana como Anibal Quijano y Santiago Castro- Gómez quienes a su vez se apoyan en (...) This is a draft of my chapter on Negligence for the forthcoming Oxford Handbook in Moral Psychology. It discusses philosophical, psychological, and legal approaches to the attribution of culpability in cases of negligent wrongdoing.

This paper argues that habits, just like beliefs, can guide intentional action. To do this, a variety of real-life cases where a person acts habitually but contrary to her beliefs are discussed. The cases serve as dissociations showing that intentional agency is possible without doxastic guidance. The upshot is a model for thinking about the rationality of habitual action and the rationalizing role that habits can play in it. This paper introduces a body of research on Organizational Behavior and Industrial/organizational Psychology that expands the range of empirical evidence relevant to the ongoing character-situation debate. This body of research, mostly neglected by moral philosophers, provides important insights to move the debate forward. First, the OB/io scholarship provides empirical evidence to show that social environments like organizations have significant power to shape the character traits of their members. This scholarship also describes some of the mechanisms through which this process of (...) reshaping character takes place. Second, the character-situation debate has narrowly focused on situational influences that affect behavior episodically and haphazardly. The OB/io research, however, highlights the importance of distinguishing such situational influences from influences that, like organizational influences, shape our character traits because they are continuous and coordinated. Third, the OB/io literature suggests that most individuals display character traits that, while local to the organization, can be consistent across situations. This puts pressure on the accounts of character proposed by traditional virtue ethics and situationism and provides empirical support to interactionist models based on cognitive-affective processing system theories of personality. Finally, the OB/io literature raises important challenges to the possibility of achieving virtue, provides valuable and untapped resources to cultivate character, and suggests new avenues of normative and empirical research. The scientific revolution of the XVII siècle is normally described as erasing final causes and the teleology of physics. Nevertheless, the functional language plays a central role in certain areas of biological practice. This is why many philosophers have tried to explicate the concept of function, sometimes to defend the relevance of its use, some other times to show that it is merely a way of speaking that could be easily eliminated without any relevant information loss. The principal purpose of (...) this paper is to show the necessity of appealing to functional concepts for an adequate reconstruction of the Darwinian natural selection theory. Thus, functional language is used in the conceptualization of the theory’s domain of application, and that domain should be determined independently of the natural selection theory. (shrink)

Theories of emotional justification investigate the conditions under which emotions are epistemically justified or unjustified. I make three contributions to this research program. First, I show that we can generalize some familiar epistemological concepts and distinctions to emotional experiences. Second, I use these concepts and distinctions to display the limits of the ‘simple view’ of emotional justification. On this approach, the justification of emotions stems only from the contents of the mental states they are based on, also known as their (...) cognitive bases. The simple view faces the ‘gap problem’: If cognitive bases and emotions (re)present their objects and properties in different ways, then cognitive bases are not sufficient to justify emotions. Third, I offer a novel solution to the gap problem based on emotional dispositions. This solution (1) draws a line between the justification of basic and non-basic emotions, (2) preserves a broadly cognitivist view of emotions, (3) avoids a form of value skepticism that threatens inferentialist views of emotional justification, and (4) sheds new light on the structure of our epistemic access to evaluative properties. Scholars who favor shareholder primacy usually claim either that managers should not fulfill corporate duties of beneficence or that, if they are required to fulfill them, they do so by going against their obligations to shareholders. Distinguishing between structurally different types of duties of beneficence and recognizing the full force of the normative demands imposed on managers reveal that this view needs to be qualified. Although it is correct to think that managers, when acting on behalf of shareholders, are not (...) required to fulfill wide duties of charity, they are nevertheless required to fulfill a variety of narrow duties of beneficence. What is more, the obligation to fulfill these duties arises precisely because they are acting on behalf of shareholders. As such, this article 1) refines our understanding of the duties of corporate beneficence and 2) helps to identify which duties of beneficence are imposed on managers when they are acting on behalf of shareholders. Presentaré la red teórica de leyes especiales que surgen de la especialización de esta ley fundamental. Supondré el estructuralismo como marco metateórico. Señalaré también algunas consecuencias que mi propuesta tiene sobre ciertas discusiones metateóricas (...) en torno a la teoría y, finalmente, relacionaré mi reconstrucción con otras reconstrucciones disponibles.ABSTRACT: This paper is about the reconstruction of the Darwinian Theory of Natural Selection. Rationally forgiving someone, in other words, does not require that one judges the significance of the wrongdoing differently or that one comes to the conclusion that the attitudes behind it have changed in a favorable way. The model shows in what sense forgiving is inherently social, shows why we (...) should be pluralists about it, and provides a basis for arguing against the existence of necessary conditions of forgiving. La discusión acerca de funciones es de larga data en filosofía. Normalmente se describe a la revolución científica del siglo XVII como eliminando las causas finales y la teleología de la física. Sin embargo, el lenguaje funcional cumple un papel central en ciertas áreas de la práctica biológica. Esto ha llevado a muchos filósofos a intentar elucidar el concepto de función, en algunos casos para defender la relevancia de estos usos, en otros para mostrar que se trata de meras formas (...) de hablar que podrían ser eliminadas sin pérdida de ningún tipo de información relevante. El objetivo principal de este trabajo es mostrar la necesidad de apelar a conceptos funcionales para una reconstrucción adecuada de la teoría de la selección natural darwiniana. This paper argues that “free will” is vague. The argument has two steps. First, I argue that free will is a matter of degrees and, second, that there are no sharp boundaries separating free decisions and actions and non‐free ones. After presenting the argument, I focus on one significant consequence of the thesis, although others are mentioned along the way. In short, considerations of vagueness help understand the logic behind so‐called manipulation arguments, but also show why these arguments are ultimately (...) flawed. (shrink)

Most human actions are complex, but some of them are basic. Which are these? In this paper, I address this question by invoking slips, a common kind of mistake. The proposal is this: an action is basic if and only if it is not possible to slip in performing it. The argument discusses some well-established results from the psychology of language production in the context of a philosophical theory of action. Philosophers of perception are familiar with the argument from illusion, at least since Hume formulated it to challenge a naïve form of realism. In this paper, I present an analogous argument but in the domain of action. It focuses on slips, a common kind of mistake. But, otherwise, it is structurally similar. The argument challenges some contemporary views about the nature of action inspired by Wittgenstein. The discussion shows how thinking about these common mistakes helps illuminate aspects of human agency (...) that tend to be overlooked whenever too much emphasis is placed on the rationality of human actions. ABSTRACT:The distinction between what I call nonelective obligations and discretionary obligations, a distinction that focuses on one particular thread of the distinction between perfect and imperfect duties, helps us to identify the obligations that carry over from principals to agents. Clarity on this issue is necessary to identify the moral obligations within “shareholder primacy”, which conceives of managers as agents of shareholders. My main claim is that the principal-agent relation requires agents to fulfill nonelective obligations, but it does not always (...) require discharging discretionary obligations. I show that the requirement to fulfill nonelective obligations is more far-reaching than has been acknowledged by most defenders and critics of shareholder primacy. But I also show that managers are not bound by certain discretionary obligations like charity, showing that their moral obligations are more circumscribed than the obligations that apply to human beings in general. Research in vision science, developmental psychology, and the foundations of cognitive science has led some theorists to posit referential mechanisms similar to indices. This hypothesis has been framed within a Fodorian conception of the early vision module. The article shows that this conception is mistaken, for it cannot handle the ‘interface problem’—roughly, how indexing mechanisms relate to higher cognition and conceptual thought. Suele señalarse la fuerte influencia que la teología natural tuvo sobre Darwin en su conceptualización del fenómeno de la adaptación. La teoría de la selección natural explicaría el mismo fenómeno que los teólogos naturales querían explicar: la adaptación. Recientemente ha sido señalado, sin embargo, que la forma darwiniana de conceptualizar la adaptación es novedosa. Las adaptaciones de la teología natural presupondrían la idea de que los organismos existen para la realización y manutención del equilibrio natural establecido por el creador. The strong influence that natural theology had over Darwin’s conceptualization of the adaptation phenomenon is frequently noted. The natural selection theory would explain the same phenomenon that the natural theologist intended to explain: the adaptation. Recently has been claimed, on the contrary, that the Darwinian way of conceptualizing adaptation is new. The concept of adaptation from natural theology presupposes the idea that organisms exist for realization and support of the natural equilibrium stated by the creator. En este trabajo, a partir de un estudio más sistemático que historiográfico, se intenta encontrar la relación entre estos tres tipos de selección en la obra de Darwin. Si bien la distinción entre estos distintos mecanismos es de suma importancia en la obra de Darwin, la tesis de este trabajo es que tanto la selección artificial como la sexual (...) no son mecanismos distintos de la selección natural. According to epistemological disjunctivism (ED), in paradigmatic cases of perceptual knowledge, a subject, S, has perceptual knowledge that p in virtue of being in possession of reasons for her belief that p which are both factive and reflectively accessible to S. It has been argued that ED is better placed than both knowledge internalism and knowledge externalism to undercut underdetermination-based skepticism. I identify several principles that must be true if ED is to be uniquely placed to attain this goal. After (...) that, I use those principles to formulate a diachronic skeptical argument. This argument yields the counterintuitive conclusion that understanding a global skeptical hypothesis is all it takes for a rational subject to lose all her perceptual knowledge of the world. Next, I show that a popular Austinian move must reject one or another of the principles that underlie ED. I close by delineating a novel strategy that can block the diachronic skeptical argument while preserving all the principles. The key idea is that perceptual knowledge is grounded in primitive, perceptual and recognitional abilities. This view sheds new light on some puzzling features of global skepticism that have been noted by Descartes and Hume, among others. (shrink)

Este artículo analiza el modo en que la teoría de la resonancia formulada por Hartmut Rosa permite revitalizar el debate sobre las condiciones que pueden minar las bases para el diálogo en las sociedades aceleradas sin apoyarse en el concepto de (...) ethos, sino en el de modo de relacionarse con el mundo [Modus der Weltbeziehung]. El trabajo que se presenta intenta mostrar, por un lado y siguiendo a Ortega y Gasset, la complejidad del fenómeno de la política; y por otro lado, a partir de la constatación anterior, la necesidad de una ética que haga de la política una actividad presidida por el diálogo, la integración y la búsqueda de soluciones a las complejidades de la sociedad actual. Son relevantes en este aspecto Apel y Habermas.

In this paper I argue that some human reproductive genome editing interventions can be therapeutic in nature, and thus that it is false that all such interventions just create healthy individuals. I do this by showing that the conditions established by a therapy definition are met by certain reproductive genome editing interventions. I then defend this position against two objections: (a) reproductive genome editing interventions do not attain one of the two conditions for something to be a therapy, and (b) (...) some reproductive genome editing interventions are therapeutic but in a nonstandard way. In the Conclusion I call for a more nuanced discussion of the nature of reproductive genome editing interventions. (shrink)

Evidence from cognitive science supports the claim that humans and other animals see the world as divided into objects. Although this claim is widely accepted, it remains unclear whether the mechanisms of visual reference have representational content or are directly instantiated in the functional architecture. I put forward a version of the former approach that construes object files as icons for objects. This view is consistent with the evidence that motivates the architectural account, can respond to the key arguments against (...) representational accounts, and has explanatory advantages. I draw general lessons for the philosophy of perception and the naturalization of intentionality. (shrink)

It is a widespread opinion that toleration, as a political practice, has merely instrumental value. The aim of this paper is to defend, on the contrary, that toleration has political value in itself. In more specific terms, I will claim that it is valuable in itself in virtue of its intrinsic relationship with democracy. Toleration is a constituent of democracy inasmuch as it is necessary for the existence of a democratic administration of political power. I will show that that relation (...) of constitution holds because toleration, through the protection of spaces of contestation to the political power, contributes to solving democracy’s inner tension resulting from its practical implementation. -/- Es una opinión extendida que la tolerancia, en cuanto práctica política, tiene valor meramente instrumental. El objetivo de este artículo es defender, por el contrario, que ella tiene valor político en sí. Específicamente, defenderé que es valiosa en sí misma a causa de su relación intrínseca con la democracia. La tolerancia es un constituyente de la democracia en cuanto es necesaria para que pueda existir una administración democrática del poder político. Mostraré que esa relación de constitución existe porque la tolerancia, mediante la protección de espacios de contestación al poder político, contribuye a la resolución de una tensión interna de la democracia en su implementación práctica. In this paper, I compare the Megarian thesis of Metaphysics IX 3 with other sources on the Megarians in order to clarify two questions: that of the unity and nature of the so-called Megarian school and that of Aristotle’s broader argument in IX 3. I first review the disputed issue of the status of the Megarian school and then examine two hypotheses regarding the identity behind Aristotle’s allusion in IX 3. Third, I explore the connection between Megarianism and Plato’s Euthydemus, (...) a task that helps us to contextualize Aristotle’s anti-Megarian polemic. Lastly, I build on the preceding argument in a re-examination of the Eleatic hypothesis with regard both to the Megarians as a whole and to the thesis that Aristotle transmits. (shrink)

Object files are mental representations that enable perceptual systems to keep track of objects as numerically the same. How is their reference fixed? A prominent approach, championed by Zenon Pylyshyn and John Campbell, makes room for a non-satisfactional use of properties to fix reference. This maneuver has enabled them to reconcile a singularist view of reference with the intuition that properties must play a role in reference fixing. This paper examines Campbell’s influential defense of this strategy. After criticizing it, a (...) new approach is sketched. The alternative view introduces representational contents to explain perceptual individuation. After arguing that those contents are not satisfactional, it is concluded that there is room for a third view of reference fixing that does not fit into the singularist/descriptivist dichotomy. Recent breakthroughs in stem cell differentiation and reprogramming suggest that functional human gametes could soon be created in vitro. While the ethical debate on the uses of in vitro generated gametes (IVG) was originally constrained by the fact that they could be derived only from embryonic stem cell lines, the advent of somatic cell reprogramming, with the possibility to easily derive human induced pluripotent stem cells from any individual, affords now a major leap in the feasibility of IVG derivation and (...) in the scope of their potential applications. In this paper we develop an ethical framework, rooted in recent scientific evidence, to support a robust experimental pipeline that could enable the first-in-human use of IVG. We then apply this framework to the following objectives: (1) a clarification of the genetic parenting options afforded by IVG, along with their ethical underpinnings; (2) a defence of the use of IVG to remedy infertility, broadening their scope to same-sex couples; (3) an assessment of the most far-reaching implications of IVG for multiplex parenting. These include, first, the liberation of parenting roles from the constraints of biological generations in vivo, allowing multiple individuals to engage in genetic parenting together, thus blurring the distinction between biological and social generations. Second, we discuss the conflation of IVG with sequencing technology and its implications for the possibility that prospective parents may choose among a hitherto unprecedented number of potential children. In view of these perspectives, we argue that, contrary to the exhausted paradigm according to which society lags behind science, IVG may represent instead a salient and most visible instance where biotechnological ingenuity could be used in pursuit of social experimentation. Algunos aspectos de La expresión de las emociones de Charles Darwin pueden resultar intrigantes, pues, en la explicación de cómo tales expresiones se originan, Darwin casi nunca apela a la selección natural. En cambio, apela principalmente a la idea de que movimientos voluntarios se asocian a emociones, volviéndose por hábito innatos e involuntarios al heredarse a la descendencia. Si bien Darwin da varias razones para defender esta explicación, en este trabajo trataré de mostrar que, si se entiende el libro sobre (...) las expresiones en relación con los objetivos explícitos e implícitos de El origen del hombre, el asunto se entiende mejor. En particular, resulta interesante la tesis que Desmond y Moore plantean respecto a la importancia de los ideales antiesclavistas de Darwin a la hora del tratamiento de las razas. Defenderé en este trabajo que el enfoque de Desmond y Moore puede extenderse al libro acerca de las expresiones. Específicamente, estableceré vínculos entre la explicación del origen de las razas y la explicación del origen del rubor. Duties of beneficence are said to allow for leeway to discharge them. By distinguishing between two different types of leeway, Mejia identified three structurally different duties of beneficence. In this Commentary I deploy those distinctions to clarify the nature of a fourth type of duty of beneficence, one prompted by a global pandemic, a duty with a peculiar, and seldom recognized, conceptual logic. I provide some guidelines that should orient managers when they take themselves to be fulfilling such a duty (...) on behalf of shareholders. (shrink)

Many philosophers have found in Hume’s skeptical doubts concerning the operations of the understanding the materials for an argument that generalizes from induction to other domains, like our beliefs in the external world, other minds, and the past. This chapter offers a novel reconstruction of that argument and identifies the principles that are responsible for its capacity to generalize beyond induction. Next, it presents a classical reading of Hume’s skeptical solution and shows that Crispin Wright’s entitlement theory is close in (...) spirit to it. After that, it develops two objections to entitlement theory: it relies on the truth of deeply contingent propositions that are not a priori rational, and it does not manage to redefine the concept of epistemic rationality while offering an effective anti-skeptical response. The chapter concludes with a constructive suggestion: some passages that support a non-classical reading of Hume’s positive views on induction offer the materials to reject the steps of the skeptical argument that cause trouble for entitlement theory. Epistemological disjunctivism (ED) has been thought to solve the conditionality problem for epistemic externalism. This problem arises from externalists’ characterization of our epistemic standings as conditional on the obtaining of worldly facts which we lack any reflective access to. ED is meant to avoid the conditionality problem by explicating subjects’ perceptual knowledge in paradigmatic cases of perceptual knowledge via their possession of perceptual reasons that are both factive and reflectively accessible. I argue that ED’s account of reflectively accessible factive perceptual (...) reasons is also prey to the conditionality problem. After that, I submit that Stroud’s influential formulation of the conditionality problem relies on a methodological requirement that is potentially dissociable from ED. So, it is possible to put ED in the service of a more modest anti-skeptical strategy. I close by suggesting that this modest anti-skeptical strategy successfully undercuts the underdetermination-based skeptical paradox. Nevertheless, it does not have substantial advantages over some forms of epistemic externalism. (shrink)

En este artículo, se pretende brindar una nueva perspectiva al respecto de la atribución de funciones en biología. La idea consiste en considerar que los conceptos funcionales son conceptos primitivos de una teoría científica, tal como desarrollada por Darwin en sus textos sobre la fecundación cruzada. Intentaré mostrar que teorías, que hacen ese uso de los conceptos funcionales, tienen características sintomáticas de teorías consideradas habitualmente genuinas y compararé mi enfoque con otros alternativos acerca de las funciones. El estudio que se desarrolla aquí muestra los aspectos generales del pensamiento de John Stuart Mill relacionados con la religión, tales como la existencia de Dios, los atributos de Dios, características del Cristianismo y cuestiones similares. Igualmente muestra la hipótesis de la utilidad de la religión para las personas.

Para algunos la selección natural se identifica con las diferencias de éxito de distintos organismos en la reproducción diferencial. Si esto fuese así, el principio de Hardy-Weinberg, por permitir determinar con bastante precisión bajo ciertos supuestos que la frecuencia génica en una población no es la esperada, podría ser visto como una versión cuantitativa de la selección natural cualitativa propuesta por Darwin. Es mi intención mostrar, a través del análisis de explicaciones dadas por Darwin, que la selección natural es más (...) que la mera diferencia en el éxito en la reproducción diferencial e investigar algunas relaciones entre la teoría de la selección natural y la genética de poblaciones. News about the first baby born after a mitochondrial replacement technique (MRT; specifically maternal spindle transfer) broke on September 27, 2016 and, in a matter of hours, went global. Of special interest was the fact that the mitochondrial replacement procedure happened in Mexico. One of the scientists behind this world first was quoted as having said that he and his team went to Mexico to carry out the procedure because, in Mexico, there are no rules. In this paper, we explore (...) Mexico's rule of law in relation to mitochondrial replacement techniques and show that, in fact, certain instances of MRTs are prohibited at the federal level and others are prohibited at the state level. According to our interpretation of the law, the scientists behind this first successful MRT procedure broke federal regulations regarding assisted fertilization research. (shrink)

En este trabajo examinamos el tópico de la responsabilidad en el derecho penal internacional a la luz de la filosofía de John Searle, y del fallo dictado por la Corte Penal Internacional en el caso de Thomas Lubanga. En el primer acápite analizamos la declaración de responsabilidad penal en función de la teoría de actos de habla de Austin y de Searle, tratándola como un acto ilocucionario cuyo significado es dependiente de un marco institucional específico. Luego, en el segundo acápite, (...) mostramos de qué forma tal marco puede reconstruirse como un ejemplo paradigmático de la realidad social construida descrita por Searle, especialmente en virtud del nexo entre mente, lenguaje y sociedad. A nuestro juicio, los conceptos de intencionalidad colectiva, atribución de funciones de estatus y poderes deónticos son fundamentales para entender tal nexo. En efecto, tal como argumentamos en la tercera sección, los sistemas de poderes deónticos asociados al derecho internacional no solo explican la aparición de Tribunales penales internacionales, como la Corte Penal Internacional, sino además el carácter imprescriptible de los crímenes de lesa humanidad. Los acuerdos internacionales que promueven y protegen los derechos humanos, y que tratan la imprescriptibilidad de aquellos crímenes, son objeto de análisis en la sección final, en donde exponemos algunas reflexiones finales a partir del caso Lubanga. Radical skepticism relies on the hypothesis that one could be completely cut off from the external world. In this paper, I argue that this hypothesis can be rationally motivated by means of a conceivability argument. Subsequently, I submit that this conceivability argument does not furnish a good reason to believe that one could be completely cut off from the external world. To this end, I show that we cannot adequately conceive scenarios that verify the radical skeptical hypothesis. Attempts to do (...) so fall prey to one or another of three pitfalls: they end up incomplete, reveal a deep contradiction or recreate a non-skeptical hypothesis. I use these results to improve upon Pritchard’s recent attempt at undercutting radical skepticism. (shrink)

This is a draft of my chapter on Agency and Mistakes for the Routledge Handbook of Philosophy of Agency. In it, I focus on performance mistakes and distinguish them from other "derivative" mistakes that we make as agents. I argue that a proper understanding of these mistakes recommends a generalized fallibilism about human agency.

Recorre los principales ejes temáticos del autor acerca de su idea de mujer, de la necesidad de liberar a la mujer e igualarla al varón en los terrenos de la familia, laboral, educativo y político.

Austere relationism rejects the orthodox analysis of hallucinations and illusions as incorrect perceptual representations. In this article, I argue that illusions of optimal motion present a serious challenge for this view. First, I submit that austere-relationist accounts of misleading experiences cannot be adapted to account for IOMs. Second, I show that any attempt at elucidating IOMs within an austere-relationist framework undermines the claim that perceptual experiences fundamentally involve relations to mind-independent objects. Third, I develop a representationalist model of IOMs. The (...) proposed analysis combines two ideas: Evans' dynamic modes of presentation and Fine's relational semantics for identity. (shrink)

It is widely assumed that perception is a source of reasons (SR). There is a weak sense in which this claim is trivially true: even if one characterizes perception in purely causal terms, perceptual beliefs originate from the mind's interaction with the world. When philosophers argue for (SR), however, they have a stronger view in mind: they claim that perception provides pre- or non-doxastic reasons for belief. In this article I examine some ways of developing this view and criticize them. (...) I exploit these results to formulate a series of constraints that a satisfactory account of the epistemic role of perception should fulfil. I also make a positive suggestion: coherentists are right when they claim that only beliefs can be reasons for other beliefs. Nevertheless, I depart from traditional coherentism, for I do not buy its conception of perception as bare sensation, nor explicate the justificatory status of beliefs in terms of coherence. My point is rather that, when one invokes experience to justify a belief, the justifying state must have structural features of beliefs. (shrink)
