Several European countries are approving legislative reforms moving to a presumed consent system in order to increase organ donation rates. Nevertheless, irrespective of the consent system in force, family's decisional capacity probably causes a greater impact on such rates. In this contribution we have developed a systematic methodology in order to analyse and compare European organ procurement laws, and we clarify the weight given by each European law to relatives' decisional capacity over individual's preferences (expressed or not while alive) regarding (...) the destination of his or her organs after death. In this sense, the results constitute the first comprehensive and comparative legislative mapping on European transplantation laws. (shrink)

El siguiente trabajo tiene por objetivo exponer y problematizar la relación entre las nociones de temporalidad, imagen y libertad en el pensamiento del filósofo francés Henri Bergson, a la luz de la crı́tica desarrollada por Jean-Paul Sartre. Para ello, en primer lugar, se expone, de modo sintético, dos conceptos que dan forma al pensamiento bergsoniano, a saber, duración e intuición. Con esto, se pone de manifiesto el problema que suscita la definición de imagen entregada por Bergson, debido a que entra (...) en conflicto con la noción de duración. Es por esto que, en segundo lugar, se revisa la crı́tica desarrollada por Jean-Paul Sartre a las definiciones entregadas por Bergson, advirtiendo que el problema surgido de las definiciones de duración e imagen implican un empirismo y determinismo que supeditan la imagen a la percepción, lo que conduce a una contradicción relativa a la espontaneidad de la conciencia, que en Sartre se muestra como conciencia intrı́nsecamente libre. El presente artículo explora la expansión de la teoría neutrosófica tradicional a través de la introducción de nuevos grados multidimensionales, enriqueciendo así el análisis neutrosófico clásico. Partiendo de los conocidos grados de verdad, falsedad e indeterminación, se presentan los innovadores grados de relevancia, confianza, consenso, complejidad, influencia, ambigüedad y persistencia, cada uno formalizado como un par de conjuntos que abarcan tanto el grado en sí mismo como su complemento. Este enfoque permite una evaluación más rica y detallada de fenómenos complejos, (...) abriendo nuevas posibilidades para aplicaciones prácticas en el análisis multicriterio, el modelado de sistemas complejos, la resolución de conflictos y la evaluación temporal. Cada uno de estos grados adicionales aporta una dimensión única al análisis, proporcionando herramientas poderosas para abordar problemas complejos con una mayor precisión y profundidad. Por ejemplo, el grado de relevancia evalúa la significancia contextual de un hecho, mientras que el grado de confianza mide la certeza en la veracidad de la información. El grado de consenso es crucial en la evaluación de acuerdos entre múltiples fuentes, y el grado de complejidad resulta esencial en el estudio de problemas intrínsecamente complicados. La inclusión de estos grados no solo enriquece la teoría neutrosófica, sino que también ofrece una visión multifacética de la realidad, mejorando la capacidad de resolver problemas en diversos campos de estudio. Los experimentos mentales son dispositivos epistémicos de la imaginación, o de análisis de problemas filosóficos, que recorren las fronteras de aquella, desde el sillón. Dichas fronteras tocan dilemas perennes de la filosofía: cuestiones de la metafísica, como el tiempo, el espacio y la realidad, el problema de la libertad y el determinismo, la naturaleza de la mente, la identidad personal, los argumentos acerca del significado, las posibilidades, fuentes y condiciones del conocimiento, las relaciones entre discurso y lógica, la ética, (...) cuestiones de la filosofía social y política, y la estética. Muchos problemas de la filosofía han sido abordados mediante experimentos mentales, una herramienta útil de la caja de herramientas del filósofo. No todas las herramientas son populares, no obstante. Los experimentos mentales son, pese a sus defensores, falibles, incluso si son argumentos bien planteados. Justamente, este libro recopila artículos con las principales defensas y ataques a los experimentos mentales, especialmente en términos de su confiabilidad para llegar a conclusiones, o bien de su relevancia en términos de su origen: el sillón de la filosofía. Este ha sido vapuleado por los nuevos aires de la filosofía analítica, que trata al sillón como un viejo artefacto del análisis a priori. De hecho, hay posturas que critican a los experimentos mentales por constituir bombas de intuiciones no confiables. Por supuesto, no hay razón irrefutable para aceptar los experimentos mentales y las filosofías de sillón. Pero ¿hay alguna en la filosofía? El libro no pretende convencer al lector del valor de los experimentos mentales y las filosofías de sillón. Por el contrario, su objetivo es formar una imagen propia de estos dispositivos epistémicos, tanto en relación con sus virtudes y limitaciones. Si ello se logra, habrá valido el esfuerzo llevado a cabo en esta compilación de artículos, los que muestran los límites, desafíos y críticas de la experimentación mental desde el sillón. (shrink)

At the beginning of the twenty-first century, based on Science and Technology Studies (STS) and the prophet Trotsky’s forecast, critique of his visions of science, technology and environment have emerged. The article revisits four approaches: the green socioliberal of Sandy Irvine, the neo-luddite of Paul R. Josephson, the ecosocialist of Daniel Tanuro, John Foster and Enzo Traverso. Finally, the collapsologist by Miguel Fuentes Muñoz. At the end, a Marxist reply to their prophet's views is made with four hypotheses and (...) a conclusion about the contemporary STS heritage of Trotsky's historical materialism. Desde hace algunas décadas es un lugar común en la Industria Newton mencionar una y otra vez la creencia de Isaac Newton en una sabiduría perdida. Sin embargo, el trabajo de crítica e interpretación al respecto se ha limitado a enunciar esta creencia sin ensayar una interpretación. Quienes más han trabajado el problema se han limitado a mostrar cómo esta creencia era plausible en el contexto intelectual de la época señalando a predecesores y seguidores de Newton que compartían esta creencia. En contraste con lo anterior, este artículo indaga cómo, desde puntos de vista epistemológicos y filosóficos, la sabiduría de los antiguos era para Newton una fuente legítima de información sobre el mundo y sus designios, proponiendo una distinción entre tiempo y temporalidad como niveles complementarios pero diferentes de indagación sobre lo creado. Las elaboradas cosmologías del sufismo akbariano, en el que se inspira el neo-sufismo, se entremezclan con tradiciones milenarias donde el genio (ǧinn) y el ángel (malāk) conviven con los humanos como otrora lo hacían los espíritus naturales y los ancestros. Este texto esboza, desde el trabajo de campo y las fuentes escritas, una aproximación a una lectura simbólica de las relaciones entre humanos, ángeles y genios en el sufismo de la (...) etnia pular y, en concreto, en la experiencia y la narrativa del maestro sufí senegalés Thierno Ḥassan Dem. -/- The elaborate cosmologies of Akbarian Sufism, in which neo-Sufism is inspired, are interspersed with millenary traditions where the genius (ǧinn) and the angel (malāk) coexist with humans as once the natural spirits and ancestors did. This paper outlines, from the field work and the written sources, an approach to a symbolic reading of the relations between humans, angels and geniuses in the Sufism of the Fulani people. Alberto Magno aprovecha lo mejor del neoplatonismo y del aristotelismo. Examina la doctrina aristotélica sobre el deseo de la verdad presente en la naturaleza humana y la ciencia metafísica que permite intuir la fuente de ese deseo, pero éste es analizado con más profundidad por el Pseudo Dionisio, siendo la ciencia teológica la que da más respuestas y la ciencia más universal, porque logra una mayor perfección no sólo intelectual sino de toda la persona.

Esta entrevista se realizó a la comunicadora española Marta Ramos Matas. En ella, expone las experiencias gratificantes que ha tenido al desempeñarse a nivel profesional, ya sea a través de la radio o el periódico a nivel. Para conseguir ese resultado, ella revela que le sirvió mucho tener como referentes a Àngels Barceló, Iker Jiménez, Carmen Porter y Alberto Matas. Por otro lado, ejercer esta función en su país es para ella ha generado percibir un alto nivel de competitividad, (...) ya que hay un gran número de personas que recurre a las mismas estrategias de difundir información, y que incluso no hacen un buen trabajo, debidoa que optan por denigrar la labor periodística al utilizar las fakenews. Esa sería una forma de transgredir los límites de la libertad de expresión, pues al no haber filtros en las redes sociales los usuarios comparten aquello que puede provenir de una fuente inverosímil. Este artículo acota de manera discursiva la participación de quienes estuvieron implicados en el periodo de conflicto interno, que abarca el Gobierno del expresidente de la República Alberto Fujimori (1990-2000) y años previos a su mandato. Por esta modalidad del lenguaje, se asume toda peculiaridad que se exterioriza para conseguir su autodeterminación, con la finalidad de fundamentar sus filiaciones, sus ideologías, sus formas de interactuar y combatir. Los que integran personalmente esa confrontación bélica son los grupos subversivos y los (...) responsables de aminorar sus arremetidas con apoyo del Estado, designados contrasubversivos. La fuente que se considera para esta investigación es el Informe final de la Comisión de la Verdad y la Reconciliación que se publicó el 2003 en la capital del Perú. A través de la recopilación y la documentación, se logrará el propósito de este ensayo: la identificación y la configuración ambivalente de los agentes intervinientes en ese contexto de lucha armada. E-mails: [email protected] e [email protected] WhatsApp: (82)9.8143-8399. -/- PREMISSA -/- Como na França de Émile Durkheim, os primeiros passos da Sociologia no Brasil, em termos institucionais, ocorreram a partir de iniciativas para a inclusão dessa disciplina no ensino secundário (hoje, ensino médio). A primeira tentativa ocorreu (...) em 1890, logo após a proclamação da República, com a reforma educacional de Benjamin Constant, que defendia o ensino laico em todos os níveis. O ensino secundário tinha por objetivo a formação intelectual dos jovens fora do contexto religioso, então predominante. Mas, sem nunca ter sido de fato incluída nos currículos escolares, a Sociologia foi expurgada pela Reforma Epitácio Pessoa, em 1901. Somente em 1925 a Sociologia retornou ao currículo do ensino secundário por meio da Reforma de Rocha Vaz, que tinha os mesmos objetivos da de Benjamin Constant. Em decorrência dessa reforma, o Colégio Pedro II, na cidade do Rio de Janeiro, implantou a Sociologia regularmente no seu currículo. Em 1928, a disciplina foi introduzida nas escolas de vários estados brasileiros, notadamente em São Paulo, Rio de Janeiro e Pernambuco. -/- Desde 1925, podem-se destacar alguns intelectuais que contribuíram para o ensino de Sociologia no ensino secundário, lecionando e escrevendo manuais para esse nível: Fernando de Azevedo (1894-1974), Gilberto Freyre (1900-1987), Carneiro Leão (1887-1966) e Delgado de Carvalho (1884-1980), em São Paulo, Rio de Janeiro e Recife. Eles tinham por objetivo preparar intelectualmente os jovens das elites dirigentes, elevando o conhecimento daqueles que chegavam às escolas médias. Esses autores, em sua maioria, foram influenciados pela Sociologia desenvolvida na Europa e nos Estados Unidos. -/- Em 1931, a reforma de Francisco Campos, no governo de Getúlio Vargas, introduziu a Sociologia nos cursos preparatórios ao ensino superior nas faculdades de Direito, Ciências Médicas, Engenharia e Arquitetura, além de mantê-la nos cursos normais (de formação de professores). -/- No final do Estado Novo, em 1942, o governo de Getúlio Vargas, através de seu ministro da Educação, Gustavo Capanema, implantou a Reforma Capanema, que excluiu a Sociologia do ensino secundário brasileiro. Assim, a Sociologia fez parte do currículo do ensino secundário por 18 anos (1925-1942). Ela, contudo, permaneceu como matéria obrigatória do currículo das Escolas Normais, de nível secundário, destinadas à formação de professores do antigo ensino primário (o que corresponderia aos atuais 2º a 5º anos). -/- 1. A SOCIOLOGIA NO ENSINO SUPERIOR: INÍCIO DO SÉCULO XX -/- Nas primeiras décadas do século XX, a Sociologia no ensino superior estava presente de forma embrionária em vários estados brasileiros (Pernambuco, Rio de Janeiro, São Paulo) e principalmente nos cursos de Direito. Desenvolveu-se de forma mais consistente, contudo, nos estados que passavam por um processo de industrialização e urbanização crescente desde o final da década de 1910. -/- Essas transformações da estrutura econômica e social repercutiram nas esferas culturais e educacionais, propiciando um crescente interesse pelos estudos científicos da realidade social da época. -/- Em decorrência disso, foram publicados importantes trabalhos que contribuíram para o desenvolvimento das ciências sociais no Brasil. Uma das preocupações dos pensadores daquele período era a busca do entendimento do Brasil por meio de seus componentes históricos, tendo por base as muitas vertentes europeias e estadunidenses das ciências humanas. -/- Esses pensadores defendiam a ideia de que havia uma ligação entre o passado colonial e a configuração social em que viviam. Para eles, esse condicionamento do passado deveria ser superado para que o país saísse do atraso. As preocupações desses pensadores giravam em torno do futuro do Brasil e das possibilidades de mudança social e das resistências a elas. Entre outros, podem ser citados: Francisco José de Oliveira Vianna (1883 -1951), Caio da Silva Prado Júnior (1907-1990), Sérgio Buarque de Holanda (1902-1982), Gilberto Freyre (1900-1987) e Fernando de Azevedo (1894-1974). -/- Pode-se afirmar que foi entre as décadas de 1920 e 1940 que a Sociologia fincou alicerces no Brasil. Nesse período, procuraram-se definir mais claramente as fronteiras entre a Sociologia e as áreas do conhecimento afins, como a Literatura, a História e a Geografia, e institucionalizou-se o curso de Sociologia e/ou Ciências Sociais em faculdades e universidades. Foram fundadas a Escola Livre de Sociologia e Política (ELSP) em São Paulo, em 1933, e as Universidades de São Paulo (USP) e do Distrito Federal (UDF), esta no Rio de Janeiro, respectivamente em 1934 e 1935, nas quais foram instituídos cursos de Ciências Sociais. -/- Vários professores estrangeiros vieram ao Brasil para trabalhar nessas universidades e contribuíram de modo significativo para o desenvolvimento da Sociologia no Brasil. Entre outros, podem ser citados: Donald Pierson (1900-1995), Alfred Radcliffe-Brown (1881-1955), Claude Lévi -Strauss (1908-2009), Georges Gurvitch (1894-1965), Roger Bastide (1898-1974), Charles Morazé (1913-2003) e Paul-Arbousse Bastide (1901-1985). -/- A revista Sociologia, da Escola Livre de Sociologia e Política, foi um exemplo da produção sociológica da época. Criada em 1939 e publicada até 1981, em São Paulo, constituiu um verdadeiro marco de estudo, pesquisa e divulgação das Ciências Sociais no Brasil. -/- 1.1 De 1940 a 1960: disseminação da Sociologia na universidade -/- A partir do final da Segunda Guerra Mundial até meados da década de 1960, disseminaram-se as Faculdades de Filosofia, Ciências e Letras no Brasil, em universidades ou fora delas, e a Sociologia passou a fazer parte do currículo dos cursos de Ciências Sociais ou a apresentar-se como disciplina obrigatória em outros cursos. -/- Uma nova geração de cientistas sociais passou a ter presença marcante no Brasil. Entre eles, podem ser citados: Florestan Fernandes (1920-1995), Antonio Candido (1918-2017), Maria Isaura Pereira de Queiroz (1918-2018), Juarez Rubens Brandão Lopes (1925-2011), Alberto Guerreiro Ramos (1915-1982), Luiz Aguiar da Costa Pinto (1920-2002) e Hélio Jaguaribe (1923-2018), que influenciaram muitos cientistas sociais em todo o território nacional. -/- Os principais temas de pesquisas, análises e discussões nesse período foram: imigração e colonização, estudos de comunidades, educação, folclore, questão rural e urbana, teoria e método das Ciências Sociais, estratificação e mobilidade sociais e sociologia da arte e da literatura. Cabe um destaque para o tema das relações étnico-raciais envolvendo a questão do negro no Brasil, graças a um projeto de pesquisa financiado pela Unesco. -/- Nesse período, a Sociologia tornou-se disciplina hegemônica no quadro das Ciências Sociais no Brasil, e a primeira a formar uma “escola” ou uma “tradição” em São Paulo, tendo em Florestan Fernandes um dos seus mentores. -/- 1.2 De 1960 a 1980: consolidação da Sociologia no Brasil -/- Mesmo sob a ditadura civil-militar no Brasil, a partir de 1964, a Sociologia começou a se expandir, principalmente nos grandes centros urbanos, e a se relacionar com outros campos das ciências humanas. As discussões sobre o processo de industrialização crescente no país foram o centro das atenções. -/- Um dos temas de discussão era o desenvolvimento, incluindo as teorias da dependência e da modernização. Outros temas de debates e pesquisas da época foram o trabalho industrial e o sindicalismo, a formação da classe trabalhadora, a urbanização crescente e as transformações no campo, os problemas da marginalidade social, a presença do capital estrangeiro e a indústria nacional. A questão educacional também esteve presente, pois de alguma forma os problemas sociais estavam vinculados à precariedade do setor. Foram bastante debatidos, ainda, o autoritarismo, principalmente depois do golpe militar de 1964, e o planejamento, criando-se uma interface com a ciência política. Além disso, destacaram-se, nesse momento, os estudos sobre a América Latina. -/- Em razão desses debates, foram incluídas nas universidades disciplinas como: Sociologia do Desenvolvimento, Sociologia Urbana, Sociologia Rural, Sociologia Industrial e do Trabalho (incluindo a questão sindical), Sociologia do Planejamento, Sociologia da Educação e da Juventude e Sociologia da Arte e Literatura. -/- Muitos foram os estudiosos que, em diferentes áreas do pensamento sociológico, desenvolveram pesquisas nessas décadas. Alguns dos que formaram a segunda geração de sociólogos no Brasil são: Octavio Ianni (1926-2004), Marialice M. Foracchi (1929-1971), Fernando Henrique Cardoso (1931-), Leôncio Martins Rodrigues (1934-), Heleieth Saffioti (1934-2010), Maurício Tragtenberg (1929-1998), Francisco de Oliveira (1933-), Luiz Pereira (1933-1985), Luiz Eduardo W. Wanderley (1935-), José de Souza Martins (1938-), Gabriel Cohn (1938-), Roberto Schwarz (1938-), Elide Rugai Bastos, Luiz Werneck Vianna (1938-) e Simon Schwartzman (1939-). -/- 1.3 Diversificação da Sociologia no Brasil -/- A partir da década de 1980, ampliam-se os cursos de graduação e pós-graduação (mestrado e doutorado) em Ciências Sociais e, em particular, de Sociologia em todo o território nacional, elevando o nível, em número e em qualidade, das pesquisas e do ensino da área. Os estudos sociológicos passaram a ser mais específicos, ocorrendo uma fragmentação dos temas/objetos, como: violência, gênero e sexualidade, corpo e saúde, religião, cotidiano, comunicação e informação, indústria cultural, representações sociais, consumo, cidadania, direitos humanos, questão ambiental, globalização, ciência e tecnologia, urbanização, juventude, família, trabalho, classes e mobilidade social, questões étnico-raciais, Estado e sociedade civil. -/- Novas gerações de sociólogos se formam nas universidades em quase todos os estados da federação, e há centros de ensino e pesquisa na maioria das universidades, disseminando-se assim a formação de sociólogos, sob diversas influências teóricas. A formação em Sociologia, que havia se estabelecido a partir de São Paulo e Rio de Janeiro, na década de 1930, expandiu-se para todo o território nacional em pouco mais de 50 anos. -/- 1.4 O retorno da Sociologia ao ensino médio -/- Oficialmente extinta do currículo do ensino médio em 1942, a Sociologia voltou a marcar presença em um ou outro estado da federação, de modo intermitente, a partir da década de 1980, com os primeiros ensaios de democratização da sociedade brasileira, conforme diz o sociólogo brasileiro Amaury C. Moraes, na esteira de mudanças na legislação educacional realizadas pelo governo ditatorial pós-1964. A Lei n° 7.044/82 flexibilizou o ensino médio (então 2º grau) e profissionalizante, abrindo espaço para a presença da Sociologia, não em caráter obrigatório, mas por escolha das escolas. Nesse sentido, ela começou a ter uma presença crescente nos currículos escolares. -/- Aqui cabe citar as Orientações Curriculares para o ensino médio, (p. 104-105). -/- Há uma interpretação corrente que (...) deve ser bem avaliada criticamente; ela afirma que a presença ou a ausência da Sociologia no currículo está vinculada a contextos democráticos ou autoritários, respectivamente. No entanto, se se observar bem, pelo menos em dois períodos isso não se confirma, ou se teria de rever o caráter do ensino de Sociologia para entender sua presença ou ausência. Entre 1931 e 1942, especialmente após 1937, a Sociologia está presente e é obrigatória no currículo em um período que abrange um governo que começa com esperanças democratizantes e logo se tinge de autoritarismo, assumindo sua vocação ditatorial mais adiante. Em outro momento, em plena democracia, o sentido do veto do Presidente da República (2001) à inclusão da Sociologia como disciplina obrigatória traz uma certa dificuldade para essa hipótese. O que se entende é que nem sempre a Sociologia teve um caráter crítico e transformador, funcionando muitas vezes como um discurso conservador, integrador e até cívico – como aparece nos primeiros manuais da disciplina. Não se pode esquecer que a Sociologia chegou ao Brasil de mãos dadas com o positivismo. No caso recente, deve-se entender que a ausência da disciplina se prende mais a tensões ou escaramuças pedagógico-administrativas que propriamente a algum conteúdo ideológico mais explícito (BRASIL/MEC, 2006). -/- Paralelamente, algumas associações de sociólogos, em diferentes estados brasileiros – mas principalmente em São Paulo –, iniciaram um movimento pela volta da Sociologia ao ensino médio, almejando a ampliação de espaço de trabalho para os formandos dos cursos de Ciências Sociais. Apesar de não haver a obrigatoriedade da disciplina, os cursos de Ciências Sociais continuavam a formar professores de Sociologia. Em alguns estados brasileiros, ao longo dos anos, foram abertos concursos para professores de Sociologia. -/- Com a Constituição de 1988 e a consequente formulação das constituições estaduais, sociólogos em todo o país passaram a reivindicar a presença da Sociologia no ensino médio. Assim, leis estaduais de alguns estados e as constituições estaduais do Rio de Janeiro e de Minas Gerais tornaram a Sociologia obrigatória no ensino médio. -/- A partir do ano 2000, organizações representativas de sociólogos (sindicatos e associações de sociólogos e de cientistas sociais) de várias tendências, assim como pequenos grupos nas universidades do país, começaram a desenvolver um movimento em defesa da obrigatoriedade do ensino da Sociologia no nível médio, considerando que os conteúdos dessa disciplina contribuíam para melhor formação do jovem estudante. -/- O movimento estendeu-se ao início do século XXI, conquistando o apoio de instituições de ensino, associações científicas, intelectuais, sindicatos e associações de categorias profissionais. Finalmente, pela Lei n° 11.684, de 2 de junho de 2008, que alterou a Lei de Diretrizes e Bases da Educação Nacional, a Sociologia retornou oficial e obrigatoriamente ao currículo do ensino médio brasileiro. -/- A título de conclusão, e ainda refletindo sobre a Sociologia e sua contribuição para a formação dos estudantes, é importante destacar o que as Orientações Curriculares para o ensino médio afirmam com muita clareza: -/- A presença da Sociologia no currículo do ensino médio tem provocado muita discussão. Além dessa justificativa que se tornou slogan ou clichê – “formar o cidadão crítico” –, entende-se que haja outras mais objetivas decorrentes da concretude com que a Sociologia pode contribuir para a formação do jovem brasileiro, quer aproximando esse jovem de uma linguagem especial que a Sociologia oferece, quer sistematizando os debates em torno de temas de importância dados pela tradição ou pela contemporaneidade. A Sociologia, como espaço de realização das Ciências Sociais na escola média, pode oferecer ao aluno, além de informações próprias do campo dessas ciências, resultados das pesquisas as mais diversas, que acabam modificando as concepções de mundo, a economia, a sociedade e o outro, isto é, o diferente – de outra cultura, “tribo”, país etc. Traz também modos de pensar (...) ou a reconstrução e desconstrução de modos de pensar. É possível, observando as teorias sociológicas, compreender os elementos da argumentação – lógicos e empíricos – que justificam um modo de ser de uma sociedade, classe, grupo social e mesmo com unidade. Isso em termos sincrônicos ou diacrônicos, de hoje ou de ontem. -/- Um papel central que o pensamento sociológico realiza é a desnaturalização das concepções ou explicações dos fenômenos sociais. Há uma tendência sempre recorrente a se explicarem as relações sociais, as instituições, os modos de vida, as ações humanas, coletivas ou individuais, a estrutura social, a organização política etc. com argumentos naturalizadores. A New Italian translation of Principia Ethica coming almost 60 years after the 1964 translation by Gianni Vattimo with Nicola Abbagnano’s preface. The new edition makes room for the English text alongside the Italian translation; it includes the 1922 Preface, a bibliography of Moore’s ethical writings with critical literature, a chronology of Moore’s life and works, and an Index. The Introduction by Sergio Cremaschi reconstructs the background of ideas, concerns and intentions from which Moore’s Principia Ethica originated. It stresses (...) the role of religious concerns, as well as that of the Idealist legacy. I argue that PE is more a patchwork of incompatible lines of argument than a consistent work. It compares PE with Rashdall’s almost contemporary ethical work, suggesting that the latter defends the same general claims in a different and more plausible way, which manages to answer decisive objections. It ends with the suggestion that the emergence of Analytic Ethics was a more multi-faceted phenomenon than the received view would make us believe and the analytic tradition's wheat, that is, what logic can do for philosophy, has to be separated from the chaff, that is, the confused, and besides mutually incompatible, legacies of Utilitarianism and Idealism. In this paper we advance a new solution to Quinn’s puzzle of the self-torturer. The solution falls directly out of an application of the principle of instrumental reasoning to what we call “vague projects”, i.e., projects whose completion does not occur at any particular or definite point or moment. The resulting treatment of the puzzle extends our understanding of instrumental rationality to projects and ends that cannot be accommodated by orthodox theories of rational choice.

Kant’s views on the relation between freedom and moral law seem to undergo a major, unannounced shift. In the third section of the Groundwork, Kant seems to be using the fact that we must act under the idea of freedom as a foundation for the moral law. However, in the Critique of Practical Reason, Kant claims that our awareness of our freedom depends on our awareness of the moral law. I argue that the apparent conflict between the two texts depends (...) on a reading of the opening paragraphs of Groundwork III, and on an interpretation of Kant’s claim that we “act under the idea of freedom”, that is implausible on textual and on philosophical grounds. I then present an alternative interpretation of what Kant means by “acting under the idea of freedom” and of the opening paragraphs of Groundwork III. I argue that the only substantive conclusion of these paragraphs is that no theoretical proof of freedom is necessary. Moreover I argue that although these paragraphs raise concerns about the validity of the moral law, these concerns and Kant’s answers to them, do not give rise to any significant conflict with his views in the Critique of Practical Reason. Most contemporary action theorists accept – or at least find plausible – a belief condition on intention and a knowledge condition on intentional action. The belief condition says that I can only intend to ɸ if I believe that I will ɸ or am ɸ-ing, and the knowledge condition says that I am only intentionally ɸ-ing if I know that I am ɸ-ing. The belief condition in intention and the knowledge condition in action go hand in hand. After all, if (...) intending implies belief, and if ɸ-ing intentionally implies intending to ɸ, then in ɸ-ing, I intend to be ɸ-ing, and, by the belief condition, I believe that I am ɸ-ing, and if this belief is justified, and we are not in a Gettier situation, etc., then, I will also satisfy the knowledge condition. Moreover, the claim that when intentions properly result in action, the corresponding belief constitutes knowledge is a relatively safe assumption, at least as an assumption about what it is generally the case. Conscientious objection in health care is a form of compromise whereby health care practitioners can refuse to take part in safe, legal, and beneficial medical procedures to which they have a moral opposition (for instance abortion). Arguments in defense of conscientious objection in medicine are usually based on the value of respect for the moral integrity of practitioners. I will show that philosophical arguments in defense of conscientious objection based on respect for such moral integrity are extremely weak and, if (...) taken seriously, lead to consequences that we would not (and should not) accept. I then propose that the best philosophical argument that defenders of conscientious objection in medicine can consistently deploy is one that appeals to (some form of) either moral relativism or subjectivism. I suggest that, unless either moral relativism or subjectivism is a valid theory—which is exactly what many defenders of conscientious objection (as well as many others) do not think—the role of moral integrity and conscientious objection in health care should be significantly downplayed and left out of the range of ethically relevant considerations. Deontological theories face difficulties in accounting for situations involving risk; the most natural ways of extending deontological principles to such situations have unpalatable consequences. In extending ethical principles to decision under risk, theorists often assume the risk must be incorporated into the theory by means of a function from the product of probability assignments to certain values. Deontologists should reject this assumption; essentially different actions are available to the agent when she cannot know that a certain act is in her (...) power, so we cannot simply understand her choice situation as a “risk-weighted” version of choice under certainty. Definiciones de epistemología hay muchas, al igual que clases y estilos. Sin embargo, más allá de esta diversidad, es necesario contar con una definición básica que guíe nuestra comprensión del tema. Dos serán las preguntas que nos ayuden a ello en este artículo: a) ¿qué es la epistemología? y b) ¿para qué le sirve al científico?

Recent research on algebraic models of _quasi-Nelson logic_ has brought new attention to a number of classes of algebras which result from enriching (subreducts of) Heyting algebras with a special modal operator, known in the literature as a _nucleus_. Among these various algebraic structures, for which we employ the umbrella term _intuitionistic modal algebras_, some have been studied since at least the 1970s, usually within the framework of topology and sheaf theory. Others may seem more exotic, for their primitive operations (...) arise from algebraic terms of the intuitionistic modal language which have not been previously considered. We shall for instance investigate the variety of _weak implicative semilattices_, whose members are (non-necessarily distributive) meet semilattices endowed with a nucleus and an implication operation which is not a relative pseudo-complement but satisfies the postulates of Celani and Jansana’s strict implication. For each of these new classes of algebras we establish a representation and a topological duality which generalize the known ones for Heyting algebras enriched with a nucleus. (shrink)

Despite growing interest in workplace democracy, the question whether nonworker stakeholders, like suppliers and local communities, warrant inclusion in the governance of democratic companies, as workers do, has been largely neglected. We inspect this question by leaning on the boundary problem in democratic theory. We first argue that the question of who warrants inclusion in democratic workplaces is best addressed by examining why workplace democracy is warranted in the first place, and offer a twofold normative benchmark—addressing objectionable corporate power and (...) upholding efficiency—to assess the principles of democratic inclusion on offer. Against this benchmark, we next argue that the All-Affected Principle is unfit due to its over- and underinclusive extensional results, and that the All-Subjected Principle, whose variants we examine alongside their extensional results, holds more promise when coupled with independent considerations of justice or a constrained variant of the All-Affected Principle. These combinations need not entirely preclude, but speak against, nonworker stakeholder inclusion. (shrink)

Several scholars have criticized the histories of early modern philosophy based on the dichotomy of empiricism and rationalism. They view them as overestimating the importance of epistemological issues for early modern philosophers (epistemological bias), portraying Kant's Critical philosophy as a superior alternative to empiricism and rationalism (Kantian bias), and forcing most or all early modern thinkers prior to Kant into the empiricist or rationalist camps (classificatory bias). Kant is often said to be the source of the three biases. Against this (...) criticism, this paper argues that Kant did not have the three biases. However, he promoted a way of writing histories of philosophy from which those biases would naturally flow. (shrink)

Recent breakthroughs in stem cell differentiation and reprogramming suggest that functional human gametes could soon be created in vitro. While the ethical debate on the uses of in vitro generated gametes (IVG) was originally constrained by the fact that they could be derived only from embryonic stem cell lines, the advent of somatic cell reprogramming, with the possibility to easily derive human induced pluripotent stem cells from any individual, affords now a major leap in the feasibility of IVG derivation and (...) in the scope of their potential applications. In this paper we develop an ethical framework, rooted in recent scientific evidence, to support a robust experimental pipeline that could enable the first-in-human use of IVG. We then apply this framework to the following objectives: (1) a clarification of the genetic parenting options afforded by IVG, along with their ethical underpinnings; (2) a defence of the use of IVG to remedy infertility, broadening their scope to same-sex couples; (3) an assessment of the most far-reaching implications of IVG for multiplex parenting. These include, first, the liberation of parenting roles from the constraints of biological generations in vivo, allowing multiple individuals to engage in genetic parenting together, thus blurring the distinction between biological and social generations. Second, we discuss the conflation of IVG with sequencing technology and its implications for the possibility that prospective parents may choose among a hitherto unprecedented number of potential children. In view of these perspectives, we argue that, contrary to the exhausted paradigm according to which society lags behind science, IVG may represent instead a salient and most visible instance where biotechnological ingenuity could be used in pursuit of social experimentation. This book tells the story of modern ethics, namely the story of a discourse that, after the Renaissance, went through a methodological revolution giving birth to Grotius’s and Pufendorf’s new science of natural law, leaving room for two centuries of explorations of the possible developments and implications of this new paradigm, up to the crisis of the Eighties of the eighteenth century, a crisis that carried a kind of mitosis, the act of birth of both basic paradigms of the two (...) following centuries: Kantian ethics and utilitarianism. The new science of natural law carried a fresh start for ethics, resulting from a mixture of the Old and the New. It was, as suggested by Schneewind, an attempt at rescuing the content of Scholastic and Stoic doctrines on a new methodological basis. The former was the claim of existence of objective and universal moral laws; the latter was the self-aware attempt at justifying a minimal kernel of such laws facing skeptical doubt. What Bentham and Kant did was precisely carrying this strategy further on, even if restructuring it each of them around one out of two alternative basic claims. The nineteenth- and twentieth-century critics of the Enlightenment attacked both not on their alleged failure in carrying out their own projects, but precisely on having adopted Grotius’s and Pufendorf’s project. What counter-enlightenment has been unable to spell out is which alternative project could be carried out facing the modern condition of pluralism, while on the contrary, if we takes a closer look at developments in twentieth-century ethics or at on-going discussions on practical issues, we might feel inclined to believe that Grotius’s and Pufendorf’s project is as up-to-date as ever. -/- Table of Contents -/- Preface I. In this paper I argue that some human reproductive genome editing interventions can be therapeutic in nature, and thus that it is false that all such interventions just create healthy individuals. I do this by showing that the conditions established by a therapy definition are met by certain reproductive genome editing interventions. I then defend this position against two objections: (a) reproductive genome editing interventions do not attain one of the two conditions for something to be a therapy, and (b) (...) some reproductive genome editing interventions are therapeutic but in a nonstandard way. In the Conclusion I call for a more nuanced discussion of the nature of reproductive genome editing interventions. (shrink)

In response to the COVID‐19 pandemic philosophers and governments have proposed scarce resource allocation guidelines. Their purpose is to advise healthcare professionals on how to ethically allocate scarce medical resources. One challenging feature of the pandemic has been the large numbers of patients needing mechanical ventilatory support. Guidelines have paradigmatically focused on the question of what doctors should do if they have fewer ventilators than patients who need respiratory support: which patient should get the ventilator? There is, however, an important (...) higher level allocation problem. Namely, how are we to ethically distribute newly obtained ventilators across hospitals: which hospital should get the ventilator(s)? In this paper, we identify a set of principles for allocating newly obtained ventilators across hospitals. We focus particularly on low and middle income countries, who frequently have limited pre‐existing intensive care capacity, and have needed to source additional ventilators. We first provide some background. Second, we argue that the main population healthcare aim during the COVID‐19 pandemic should be to save the most lives. Next, we assess a series of potential heuristics or principles that could be used to guide allocation: allocation to the most densely populated cities, random allocation, allocation based on the ratio of patients to ICU personnel, prioritisation in terms of intrahospital mortality, prioritisation of younger populations, and prioritisation in terms of population mortality. We conclude by providing a plausible ranking of the principles, while noting a number of epistemological challenges, in terms of how they best further the aim of increasing the probability of saving the most lives. The work presented has the following approach: starting from the Pope's reflection on the planet and ecological problems, it is intended to show the philosophical influences that underlie Francisco's exposition. These influences make it possible to describe a philosophical profile present in the encyclical Laudato si’. In addition, since philosophy claims to know, it is not exhausted only in knowledge, but tries to know in order to act; therefore, the presence of an ethical proposal follows; and since all ethics leads (...) to action, it follows that action cannot be without some indicators, without an axiology on which human action on the planet revolves. The result is that Francisco offers an ethic of otherness that feels the other as an authentic neighbor, even those who are in the future. It is an ethic of common benefit and caring for the other whose fundamental axis is the person and for this reason he reflects the phenomenon of human life within life on Earth, with which its philosophical approach seems personalist, from a point of Christian view. In a recent publication Tom Douglas and Katrien Devolder have proposed a new account of genetic parenthood, building on the work of Heidi Mertes. Douglas and Devolder’s account aims to solve, among other things, the question of who are the genetic parents of an individual created through somatic cell nuclear transfer (i.e. cloning): (a) the nuclear DNA provider or (b) the progenitors of the nuclear DNA provider. Such a question cannot be answered by simply appealing to the folk account of (...) genetic parenthood, according to which the genetic parents of an individual are those individuals who produced the egg and sperm, respectively, which fused to create the embryo. It cannot be so as in cloning there is no fertilization as such. In this article I critically examine Douglas and Devolder’s new account of genetic parenthood and demonstrate that it is vulnerable to counterexamples that exploit the lack of a condition specifying that genetic parents should cause a child’s coming into existence. The nature of pre-reflective self-consciousness—viz., the putative non-inferential self-consciousness involved in unreflective experiences, has become the topic of considerable debate in recent analytic philosophy of consciousness, as it is commonly taken to be what makes conscious mental states first-personally given to its subject. A major issue of controversy in this debate concerns what pre-reflective self-consciousness is an awareness of. Some scholars have suggested that pre-reflective self-consciousness involves an awareness of the experiencing subject. This ‘egological view’ is opposed to the ‘non-egological (...) view’, according to which the subject, in being pre-reflectively self-conscious, is just aware of their own occurrent mental state. In this paper, I argue in favour of the egological view. The argument I develop is a qualified version of a line of reasoning originally provided by Rosenthal and builds on a proper clarification of the ontological status of token mental states. More precisely, I argue that token mental states are structured ‘fact-like’ entities having their subject among their constituents. Accordingly, one cannot be aware of one’s own occurrent mental state without thereby being aware of oneself. (shrink)

An effective method to increase the number of potential cadaveric organ donors is to make people donors by default with the option to opt out. This non-coercive public policy tool to influence people’s choices is often justified on the basis of the as-judged-by-themselves principle: people are nudged into choosing what they themselves truly want. We review three often hypothesized reasons for why defaults work and argue that the as-judged-by-themselves principle may hold only in two of these cases. We specify further (...) conditions for when the principle can hold in these cases and show that whether those conditions are met is often unclear. We recommend ways to expand nationwide surveys to identify the actual reasons for why defaults work and discuss mandated choice policy as a viable solution to many arising conundrums. (shrink)

A response to review essays by Chrisoula Andreou, John Brunero, Matthias Haase, Erasmus Mayr, and Sarah Paul on Sergio Tenenbaum's _Rational Powers in Action_.

It is widely held that there is a distinctive norm of assertion. A plausible idea is that there is an analogous, perhaps weaker, norm for indirect communication via implicatures. I argue against this type of proposal. My claim is that the norm of assertion is a social norm governing public updates to the conversational record. Off the record implicatures are not subject to social norms of this type. I grant that, as happens in general with intentional actions, off the record (...) communicative acts may be subject to normative assessments on different levels (for instance, regarding their moral or prudential appropriateness). However, such assessments do not generate distinctive norms that apply to all cases of implicature. (shrink)

According to Crane’s schematicity thesis (ST) about intentional objects, intentionalia have no particular metaphysical nature qua thought-of entities; moreover, the real metaphysical nature of intentionalia is various, insofar as it is settled independently of the fact that intentionalia are targets of one’s thought. As I will point out, ST has the ontological consequence that the intentionalia that really belong to the general inventory of what there is, the overall domain, are those that fall under a good metaphysical kind, i.e., a (...) kind such that its members figure (for independent reasons) in such an inventory. Negatively put, if there are no things of a certain metaphysical kind, thoughts about things of that kind are not really committed to such things. Pace Crane, however, this does not mean that the intentionalia that are really there are only those that exist. For existence, qua first-order property, is no metaphysical kind. Thus, there may really be intentionalia that do not exist, provided that they belong to good metaphysical kinds. (shrink)

The aim of this chapter is to understand more precisely what kind of irrationality involved in procrastination. The chapter argues that in order to understand the irrationality of procrastination one needs to understand the possibility and the nature of what I call “top-down independent” policies and long-term actions. A policy or long-term action) is top-down independent if it is possible to act irrationally relative to the adoption of the policy without ever engaging in a momentary action that is per se (...) irrational. involved in procrastination one needs to It argues that procrastination is one of the corresponding vices of an overlooked virtue; namely, “practical judgment.” On this account, procrastination turns out to be a failure of instrumental rationality that can be so characterized without assuming the correctness of any further norms of practical rationality. News about the first baby born after a mitochondrial replacement technique (MRT; specifically maternal spindle transfer) broke on September 27, 2016 and, in a matter of hours, went global. Of special interest was the fact that the mitochondrial replacement procedure happened in Mexico. One of the scientists behind this world first was quoted as having said that he and his team went to Mexico to carry out the procedure because, in Mexico, there are no rules. In this paper, we explore (...) Mexico's rule of law in relation to mitochondrial replacement techniques and show that, in fact, certain instances of MRTs are prohibited at the federal level and others are prohibited at the state level. According to our interpretation of the law, the scientists behind this first successful MRT procedure broke federal regulations regarding assisted fertilization research. (shrink)

In this paper, I defend a non-mechanistic interpretation of Kant's philosophy of nature. My interpretation contradicts the robust tradition of reading Kant as a mechanist about nature – or as someone who endorses the view that we can know the internally purposive causality characteristic of organisms has no place in nature. By attending closely to Kant's remarks about the possibility of internal purposiveness in nature and to key premises from Kant's arguments in the Antinomy of Teleological Judgment, we shall see (...) that it is not only plausible, but preferable, to believe that internally purposive things (i.e., organisms) exist in nature. Making room for such a belief leaves Kant with a philosophy of nature that simultaneously aligns with and surpasses the philosophies of nature offered up by his Early Modern predecessors. (shrink)
