  2. Conceptual Schemes/Frameworks and Their Relation to Law: A New Argument for Separation of Church and State.Vincent Samar - 2024 - Cardozo Journal of Equal Rights and Social Justice 30 (2):379-424.
A central question that arises when interpreting the U.S. Constitution is which theory of interpretation is the best? In his recent book, “How to Interpret the Constitution,” Cass Sunstein reviews various theories of constitutional interpretation currently in vogue and then offers what he believes would be the best approach going forward. In this Article, I want to take up a more basic question presupposed by the very idea of a theory of interpretation. That is, whether it is even possible to (...)

  3. Major Questions Doctrine: Real of Fantasy?Vincent Samar - 2024 - Capital University Law Review 52 (1):1-40.
In this article I review the Supreme Court’s current use of its major questions doctrine to see if the justifications commonly offered for its existence can explain its current use. In the process of doing so, I examine what the doctrine is about, how it came into existence and how the Court has applied it, especially in context to two recent cases, West Virginia v. EPA and Biden v. Nebraska. As both of these cases implicate the regulatory state, I place (...)

  4. A Broomean Model of Rationality and Reasoning.Franz Dietrich, Antonios Staras & Robert Sugden - 2019 - Journal of Philosophy 116 (11):585-614.
John Broome has developed an account of rationality and reasoning which gives philosophical foundations for choice theory and the psychology of rational agents. We formalize his account into a model that differs from ordinary choice-theoretic models through focusing on psychology and the reasoning process. Within that model, we ask Broome’s central question of whether reasoning can make us more rational: whether it allows us to acquire transitive preferences, consistent beliefs, non-akratic intentions, and so on. We identify three structural types of (...)

  5. Abstract rationality: the ‘logical’ structure of attitudes.Franz Dietrich, Antonios Staras & Robert Sugden - 2024 - Economics and Philosophy 40 (1):12-41.
We present an abstract model of rationality that focuses on structural properties of attitudes. Rationality requires coherence between your attitudes, such as your beliefs, values, and intentions. We define three 'logical' conditions on attitudes: consistency, completeness, and closedness. They parallel the familiar logical conditions on beliefs, but contrast with standard rationality conditions like preference transitivity. We establish a formal correspondence between our logical conditions and standard rationality conditions. Addressing John Broome's programme 'rationality through reasoning', we formally characterize how you can (...)

  6. HUMAN SOCIETY. SOCIAL THEORY: WHOLES, PARTS, AND THE FIELD OF TOLERATION.Ragnar Stara (ed.) - 2021 - Jakobstad, Finland: Starabooks.
What is a society? According to sociologists and philosophers, the concept is a self-evident one. They describe society as an aggregate of people, as a society divided into classes or as a community - but also as an impossible object. Why is the answer so vague? There is a conceptual wall that stands in the way of a definition of society, at the same time as society must be defined in order for the social sciences to be possible. The book (...)

  7. Reasoning in attitudes.Franz Dietrich & Antonios Staras - 2022 - Synthese 200 (6):1–31.
People reason not only in beliefs, but also in intentions, preferences, and other attitudes. They form preferences from existing preferences, or intentions from existing beliefs and intentions, and so on. This often involves choosing between rival conclusions. Building on Broome (Rationality through reasoning, Hoboken, Wiley. https://doi.org/10.1002/9781118609088, 2013) and Dietrich et al. (J Philos 116:585–614. https://doi.org/10.5840/jphil20191161138, 2019), we present a philosophical and formal analysis of reasoning in attitudes, with or without facing choices in reasoning. We give different accounts of choosing, in (...)

The Lumad struggle in the Philippines, embodied in its various indigenous peoples (IPs), is still situated and differentiated from modern understandings of their plight. Agamben notes that the notion of ‘people’ is always political and is inherent in its underlying poverty, disinheritance, and exclusion. As such, the struggle is a struggle that concerns a progression of freedom from these conditions. Going over such conditions means that one shifts the focus from the socio-political and eventually reveals the ontological facet of such (...)

  9. Theorizing Mamanuan Diaspora: from Vanishing Mediator to Performative Indigeneity.Jan Gresil Kahambing - 2019 - Rupkatha Journal On Interdisciplinary Studies in Humanities 11 (2):1-15.
The Mamanuas of Basey, Samar have been in an itinerant state since the 1950s. Their indigenous experience can be capped in the term ‘diaspora,’ which pictures their plight as dispersive habituation, moving from town to town away from their homeland. In a recent study which this paper hinges upon, the concept of diaspora can no longer work and is argued to imperatively function as a vanishing mediator so that indigeneity must come to mean as a constant identity of becoming. 13. Koncepcja realności w późnej filozofii Nietzschego.Konrad Pyznar - 2013 - Argument: Biannual Philosophical Journal 3 (1):81-96.
