The voices of children and young people have been largely neglected in discussions of the extent to which the internet takes into account their needs and concerns. This paper aims to highlight young people’s lived experiences of being online.

This article addresses the general ethical issues of accessing online personal data for research purposes. The authors discuss the practical aspects of online research with a specific case study that illustrates the ethical challenges encountered when accessing data from Kooth, an online youth web-counselling service. This paper firstly highlights the relevance of a process-based approach to ethics when accessing highly sensitive data and then discusses the ethical considerations and potential challenges regarding the accessing of public data from Digital Mental Health (...) services. It presents solutions that aim to protect young DMH service users as well as the DMH providers and researchers mining such data. Special consideration is given to service users’ expectations of what their data might be used for, as well as their perceptions of whether the data they post is public, private or open. We provide recommendations for planning and designing online research in an ethical manner that includes vulnerable young people as research participants. We emphasise the distinction between public, private and open data, which is crucial to comprehend the ethical challenges in accessing DMH data. Among our key recommendations, we foreground the need to consider a collaborative approach with the DMH providers while respecting service users’ control over personal data, and we propose the implementation of digital solutions embedded within the platform for explicit opt-out/opt-in recruitment strategies and ‘read more’ options. Si bien en la filosofía de las ciencias ya se han explorado algunos ejemplos provenientes de la bioquímica como casos de estudio, la filosofía de la bioquímica es una subdisciplina naciente. En este artículo estudiaremos dos problemas filosóficos de relevancia contemporánea en esta ciencia. Por un lado, examinaremos las bases epistemológicas del problema del plegamiento de proteínas. En particular lo relacionado con la predicción de la estructura tridimensional de las proteínas a partir de su secuencia, asunto que ha dado mucho (...) que hablar debido a los nuevos avances utilizando deep learning. Por otro lado, exploraremos el problema in-vitro/in-vivo y, más generalmente, el problema de la extrapolación en las ciencias biológicas. Finalmente, a partir de las consecuencias de ambos temas consideraremos algunas reflexiones filosóficas generales acerca del reduccionismo, el pluralismo y el lugar de la bioquímica en las ciencias biológicas. El presente artículo analiza la etapa denominada arqueológica de Michel Foucault. Puntualizando principalmente cómo en esta etapa es entendido el concepto de libertad desde la noción foucaultiana de discurso. Se aborda, en este sentido, la etapa arqueológica de Foucault desde tres áreas. La primera, nos habla de cómo se erige lo diferente, lo anormal. La segunda, expone cómo se construye lo aparente, lo indiscutible. Por último, a partir de un marco teórico previamente expuesto, reflexionamos respecto del concepto de libertad.

This study aimed to investigate the longitudinal trends in mathematical competencies of Grade 8 students in a public high school located in Zamboanga del Sur, Philippines. The study collected data over a period of six academic years, allowing for a comprehensive analysis of students' performance in 16 distinct mathematical competences of basic education curriculum. These topics include, but are not limited to, special products and factors, factoring, and basic concepts of probability. Using a quantitative research design, the study analyzed both (...) numerical and secondary data to identify patterns or trends in students' mathematical competencies. Trends were analyzed through regression analysis using slopes. The significance of these trends was then evaluated using t-tests for the standard error of slopes. The statistical analysis revealed significant upward trends in certain mathematical topics, indicating an improvement in the students' competencies over the six academic years. However, certain topics displayed downward or stable trends, indicating areas for improvement in the teaching methods used for these topics. The study highlights the importance of flexible and adaptable approaches to mathematics education. It emphasizes the need for constant evaluation and improvement of teaching methods to enhance student learning outcomes. The findings of this study provide valuable insights for educators and policymakers to guide evidence-based decision-making and improve the quality of mathematics education in the new normal setup. The depth-bounded approach seeks to provide realistic models of reasoners. Recognizing that most useful logics are idealizations in that they are either undecidable or likely to be intractable, the approach accounts for how they can be approximated in practice by resource-bounded agents. The approach has been applied to Classical Propositional Logic (CPL), yielding a hierarchy of tractable depth-bounded approximations to that logic, which in turn has been based on a KE/KI system. -/- This Thesis shows that the approach can be (...) naturally extended to useful nonclassical logics such as First-Degree Entailment (FDE), the Logic of Paradox (LP), Strong Kleene Logic (K3 ) and Intuitionistic Propositional Logic (IPL). To do this, we introduce a KE/KI-style system for each of those logics such that: is formulated via signed formulae, consist of linear operational rules and branching structural rule(s), can be used as a direct-proof and a refutation method, and is interesting independently of the approach in that it has an exponential speed-up on its tableau system counterpart. The latter given that we introduce a new class of examples which we prove to be hard for all tableau systems sharing the V/& rules with the classical one, but easy for their analogous KE-style systems. Then we focus on showing that each of our KE/KI-style systems naturally yields a hierarchy of tractable depth-bounded approximations to the respective logic, in terms of the maximum number of allowed nested applications of the branching rule(s). The rule(s) express(es) a generalized rule of bivalence, is (are) essentially cut rule(s) and govern(s) the manipulation of virtual information, which is information that an agent does not hold but she temporarily assumes as if she held it. Intuitively, the more virtual information needs to be invoked via the branching rule(s), the harder the inference is for the agent. So, the nested application the branching rule(s) provides a sensible measure of inferential depth. We also show that each hierarchy approximating FDE, LP, and K3 , admits of a 5-valued non-deterministic semantics; whereas, paving the way for a semantical characterization of the hierarchy approximating IPL, we provide a 3-valued non-deterministic semantics for the full logic that fixes the meaning of the connectives without appealing to “structural” conditions. -/- Moreover, we show a super-polynomial lower bound for the strongest possible version of clausal tableaux on the well-known class of “truly fat” expressions (which are easy for KE), settling a problem left open in the literature. Further, we investigate a hierarchy of tractable depth-bounded approximations to CPL based only on KE. Finally, we propose a refinement of the p-simulation relation which is adequate to establish positive results about the superiority of a system over another with respect to proof-search. (shrink)

Analizo algunos aspectos clave del modelo médico del parto, centrándome especialmente en los presupuestos que parece albergar sobre la relación mente-cuerpo. En primer lugar, examino las visiones del modelo médico como un modelo dualista ontológico. En contra de las críticas habituales a este dualismo, que sostienen que ha llevado a tratar el cuerpo de parto como una máquina, defiendo que el problema no reside en el propio dualismo, sino en que se obvia la interacción mente-cuerpo: son las propias personas de (...) parto quienes se tratan como máquinas. En segundo lugar, analizo la centralidad de la noción de riesgo en el modelo médico del parto y defiendo que en ella trasluce nuevamente una escisión entre lo mental y lo corporal. Defiendo, además, una concepción construccionista del riesgo, pues este no resulta independiente de los discursos y prácticas médicas, sino que estos factores tienen un impacto causal en él. En tercer y último lugar, abordo brevemente el descrédito de los testimonios de las personas de parto, remitiéndolo nuevamente a esa escisión entre cuerpo y mente. (shrink)

This paper critically compares the philosophy of Günther Anders and the contemporary transhumanists, like Julian Savulescu, Ingmar Persson, or Thomas Douglas. The Andersian concepts of moral blindness, promethean gap, and promethean shame will be discussed in order to understand human beings’ outdatedness; parallel to this, we will also expose the transhumanist analysis on the unfitness of human beings in evolutive and cognitive terms. We will show that much of the transhumanist analysis is a reformulation of the Andersian thesis, now under (...) scientific terminology. Finally, we will approach the transhumanist proposal of moral enhancement, explaining and confronting some critics raised on the grounds of freedom and moral responsibility. (shrink)

The Vehicle Routing Problem (VRP) has been extensively studied by different researchers from all over the world in recent years. Multiple solutions have been proposed for different variations of the problem, such as Capacitive Vehicle Routing Problem (CVRP), Vehicle Routing Problem with Time Windows (VRP-TW), Vehicle Routing Problem with Pickup and Delivery (VRPPD), among others, all of them with deterministic times. In the last years, researchers have been interested in including in their different models the variations that travel times may (...) experience when exposed to all kind of phenomena, mainly vehicle traffic. This article addresses the VRP from this perspective, proposing the design and implementation of a genetic algorithm based on neutrosophic theory for calculating the fitness function of each route, considering the variability and uncertainty present in travel times. A deterministic genetic algorithm is also implemented with the average travel times to compare it with the neutrosophic algorithm using simulation. As conclusion, a deterministic algorithm does not necessarily generate the best solution in the real world, full of uncertainty. Also, the quantification of uncertainty using neutrosophic theory can be used in route planning, opening a broad and interesting field of research for future investigations. (shrink)

Las Observaciones... es un ensayo derivado del Patriarcha en los que reelabora y afirma sus comentarios sobre Aristóteles; se establecen ası́ numerosas citas y argumentos paralelos entre los dos textos, sobre todo en los capı́tulos IX, XI, XV, pero en especial en el XII del Patriarcha. Con (...) respecto al tema central del ensayo, Filmer mismo resume sus objetivos en la conclusión. En cuanto a la lectura de los libros de la Polı́tica de Aristóteles, Filmer establece una conexión misteriosa: reconoce su utilidad como comentario al texto bı́blico. Toda la evidencia necesaria sobre el origen de la sociabilidad del hombre es tomada de la figura de Adán. Es por esto que, siguiendo a Laslett (1949: 20), se puede sintetizar los temas tratados en las siguientes seis proposiciones negativas: 1. No hay ninguna forma de gobierno efectiva, excepto la monarquı́a. 2. No hay ninguna monarquı́a sino la paternalista. 3. No hay ninguna monarquı́a paternalista sino es absolutista. 4. No existen las formas de gobierno aristocrática ni democrática. 5. No existe tal forma de gobierno como la tiranı́a. 6. Ningún individuo nace libre por naturaleza. Sin embargo, puede hacerse notar otra división. En primer lugar, desde 90-119 se ocupará de investigar sobre los términos aristotélicos; y en segundo lugar, desde 120-150, en refutar la tesis de Jean Bodin que establecı́a que el pueblo romano tuvo un gobierno popular, con el fin de evidenciar la imposibilidad de existencia de cualquier forma de gobierno a excepción de la monárquica, para concluir con una extensa cita del mismo Bodin a favor de la tesis central de Filmer. In this paper, I argue that if one is already an advocate of scientific realism, then one would be also a realist about laws of nature. To show this, I argue that only scientific realists would accept that non-accidental regularities require explanation and that their genuine explanation is given by laws of nature. Then, from this conclusion, it seems that scientific realists have reason to believe that there are laws of nature in an objective sense. If this is correct, the (...) conclusion is that there are no reasons for advocates of scientific realism to be skeptics about laws of nature. (shrink)

Transformar el modo de vida individual es necesario para abordar la crisis ecosocial, y resulta perentorio que las políticas comprometidas con su resolución promocionen una capacidad individual de acción ecosocial. Sin embargo, parece que cierta brecha motivacional está obstaculizando la transformación del modo de vida individual. A fin de dar respuesta a esta brecha, ensayamos una mixtura del enfoque de las capacidades con las teorías de Hartmut Rosa. Argumentamos que la resonancia natural funge de factor personal de conversión necesario, si (...) bien no suficiente, para la capacidad de acción ecosocial; y que una política que promocione la resonancia natural se adecuaría también a los requisitos impuestos al desarrollo humano tanto por el enfoque de las capacidades como por la sostenibilidad. This paper aims to answer the question: what does the realism of laws of nature consist of? To achieve this, in the first part, three philosophical accounts of laws of nature are presented and examined: the universalist, the dispositionalist and the counter-factualist. The presentation and examination focuses on the answer given by each of these accounts to the question: what is a law of nature? Later, in the second part, convergences and divergences between these three accounts are shown. Finally, in (...) the third section, the points of agreement between them are put together to advance the fundamental thesis that encompasses each of these accounts as realist accounts of laws of nature. This thesis, I argue, is at the end the core of the general realist stance on laws of nature that I name “Realism of Laws of Nature”. (shrink)

I provide a philosophical account of the potential of the psychedelic experience to treat depression. My main thesis is that such a potential lies in the possibility of psychedelics allowing us to experience a world diametrically opposed to that of depression. I take the psychedelic experience to be world-shifting. By building on Ludwig Wittgenstein’s insights and notions of aesthetics, ethics, and mysticism, I characterize the world in depression as a world devoid of beauty and meaning, from which we feel disconnected. (...) I then argue that the psychedelic experience immerses us in a world full of beauty and meaning, to which we feel connected. It is by changing our perspective that our whole world and attitude towards it changes, opening up new possibilities for action, as well as a new evaluation of the contingencies of our biographical self and our relationships with others. El estallido social en Chile desafı́a a las humanidades a abordar un fenómeno social inédito por sus formas, a través de un ejercicio reflexivo situado más allá de las tomas de posición en el debate público. Si bien, ha habido un sinnúmero de académicos del espectro nacional que han asumido posturas claras en esta coyuntura, las respuestas y justificaciones contingentes dejan incólumes otras dudas sobre cuestiones de principio. Sabı́amos que Chile vivı́a en una democracia de baja intensidad, con instituciones ancladas (...) al orden constitucional diseñado durante la dictadura cı́vico-militar y continuado por los gobiernos democráticos, con enormes áreas institucionales corrompidas por el fuero de la impunidad, con una clase polı́tica acostumbrada a los privilegios y bajo un modelo estructuralmente desigual en lo económico, social y cultural. Sabı́amos que todo lo anterior, en alguna medida, fue horadando las bases de las instituciones democráticas. Por eso, para muchos, las protestas que comenzaron en octubre son la continuidad de un dilatado proceso de acumulación del malestar que, debido a lo agudas de sus causas, tardaron más de lo que muchos imaginaron en llegar. Dado el particular modo de explicar la realidad que tienen los estoicos, existe una categorı́a especı́fica para referir a la descripción de una realidad que podrı́amos considerar individualy diferentea otras; me refiero a lo que ellos mentaban con las palabras ἰδίως ποιός, que traducimos como individuo particularmente cualificado. Esta categorı́a cualifica a una entidad en cuanto especı́fica y particular. Sin embargo, en un contexto donde lo corpóreo refiere a todo lo que es, es fácil identificar apresuradamente lo corpóreo con lo (...) material y admitir que la materia por si sola puede valer como un criterio de identidad para las entidades individuales. El objeto del presente artı́culo es proponer una lectura que posibilite lı́neas argumentativas para armonizar el reto que presenta la descripción de un individuo particularmente cualificado, admitiendo la peculiar cosmovisión estoica, por medio de la consideración de la ψυχή como elemento coordinador de sus categorı́as y que, por consiguiente, es el elemento por considerar para una propuesta de criterio de identidad. This article reports the findings of AI4People, an Atomium—EISMD initiative designed to lay the foundations for a “Good AI Society”. We introduce the core opportunities and risks of AI for society; present a synthesis of five ethical principles that should undergird its development and adoption; and offer 20 concrete recommendations—to assess, to develop, to incentivise, and to support good AI—which in some cases may be undertaken directly by national or supranational policy makers, while in others may be led by other (...) stakeholders. If adopted, these recommendations would serve as a firm foundation for the establishment of a Good AI Society. (shrink)

Justo antes de la pandemia por COVID-19, la Organización Mundial de la Salud definió unas prioridades de trabajo para la década 2020-2030. Un grupo interdisciplinario de profesionales de la salud reflexiona sobre estas prioridades, determinando unas categorías de análisis y, desde una perspectiva bioética, analiza cada una de ellas, ve su pertinencia, algunos eventos causales, las implicaciones que pueden tener si no son enfrentadas adecuadamente y hace sugerencias sobre la forma de llevarlas a cabo. En esta primera entrega se analiza (...) el primer grupo de prioridades estratégicas: “poblaciones más sanas”. En las conclusiones se destaca la conveniencia de acometer cada una de ellas de una manera colaborativa, gubernamental y privada; de reestructurar el sector salud con base en estas prioridades, aprovechando la experiencia obtenida en la lucha contra el COVID-19. La relación del ser humano con el medio ambiente también debe cambiar, apelando a la responsabilidad humana por el cuidado del planeta. (shrink)

REPENSAR LA HOMOGENEIDAD FILOSÓFICA El XXII Congreso Mundial de Filosofía se ha celebrado por primera vez en una sede asiática, en Seúl, Corea del Sur, de modo casi simultáneo a los Juegos Olímpicos de Pekín. Tanto la ubicación geográfica como los contenidos que allí se trataron durante esas siete jornadas invitan a repensar si puede sostenerse que la filosofía es un conocimiento homogéneamente occidental.

Nosotres, biólogues, ecologistas y otres profesionales dedicados a proteger la vida, les escribimos con una solicitud urgente. Les pedimos muy comedidamente que su organización o institución emita un comunicado oficial condenando la crisis en curso y abordando los impactos ambientales y humanitarios en Palestina.

Para comemorarmos o centenário do patrono da Educação Brasileira, Paulo Reglus Neves Freire, iremos neste breve estudo propor um diálogo entre a pedagogia libertária de Freire e algumas princípios filosóficos que a fundamentam. Inicialmente, investigamos a trajetória histórica do pedagogo nordestino, e os momentos mais marcantes de sua vida cosmopolita. Em segundo, apresentaremos alguns dos principais alicerces de sua metodologia pedagógica, contudo, dada a vasta obra publicada por Freire, qualquer breve revisão será fadada em apenas ser um breve vislumbre da (...) filosofia e pedagogia freireana. Por fim, iremos explorar algumas das origens filosóficas e políticas do conceito de pedagogia libertária, e como essas origens podem ser ligadas a filosofia Anarquista, dado a algumas semelhanças evidentes. A crítica a autoridade injustificada, a amorosa crença do caráter social e solidário do indivíduo humano, e um forte defesa da emancipação humana, algo que só pode ser alcançado através da busca pela liberdade e autonomia do sujeito. Tais paralelos levam à conclusão de que se a pedagogia libertária é um ato de amor, a filosofia libertária também deve ser, pois, ambas se nutrem da mesma fonte, e almejam o mesmo lugar: a emancipação humana. In his rich and suggestive paper, Alvaro Vallejo argues for the novel thesis that Plato posits a form of pleasure in the Republic and the Philebus. Vallejo argues that the notion of a Platonic form of pleasure best explains other things that Plato says about pleasure. First, Plato draws a distinction between true pleasure and the appearance of pleasure. Second, Plato uses the same language to describe the relationship between forms and their inferior instantiations as he uses to (...) describe the relationship between true and false pleasures. In these comments, I argue that we do not need to posit a form of pleasure to explain these features of the text. Moreover, I argue that on Vallejo’s account of the form of pleasure, the form could not do the job required of it, namely, it could not explain the problem with false pleasures. (shrink)

Este documento registra la entrevista al comunicador social Juan Manuel Rojas, gerente general de Creative Forward Films SAC (en el Perú), que ha realizado estudios orientados al tema audiovisual en la Universidad Inca Garcilaso de la Vega, la Universidad Católica Argentina y la Pontificia Universidad Católica del Perú. El propósito de esta conversación fue que se conociera de manera panorámica en qué consiste la formación de un comunicador y cómo esta es de utilidad para emprender un trabajo dirigido a (...) la práctica de lo audiovisual. Con las experiencias del entrevistado, se consigue construir una idea del universo cinematográfico en cuanto al desarrollo de los guiones y sus estructuras, el dominio especializado del lenguaje como herramienta fundamental y persuasiva para la publicidad, la crítica a las producciones de cine, los concursos que se promueven para respaldar la labor de los directores, etc. (shrink)

Trilce (1922) se ha caracterizado por contar con múltiples filiaciones artísticas propias de la vanguardia europea. Los estudios de la crítica literaria han permitido clasificar cuál es la procedencia de cada recurso estilístico que se usa para los poemas. Esta labor se ha realizado de forma independiente. Sin embargo, ha quedado inconcluso cuál es el soporte temático que rige la universalidad de su composición. En ese sentido, el objetivo de mi trabajo es orientar esos elementos externos hacia una lógica patrocinada (...) por la cosmovisión esperanzadora del autor. Ese optimismo sería esencial para entender la configuración de sus versos. Para demostrar eso, consideraré la biografía del escritor peruano, su contexto, la vanguardia, sus tópicos frecuentes y las investigaciones de la exégesis. Esos abordajes serán de utilidad para concatenar esa propuesta implícita que suscita la comprensión de la volición autónoma e innovadora de César Vallejo. (shrink)

Trilce (1922), poemario del escritor peruano César Vallejo, se publicó durante un período en el que se difundían obras literarias caracterizadas por el vanguardismo; es decir, lo irracional, lo ilógico, lo incomprensible y lo innovador. La forma predomina sobre el fondo o el contenido, ya que se instaura un metalenguaje que identifica al autor de este tipo de creación literaria. Desde entonces, la crítica literaria ha investigado en función de este libro como propuesta, del cual he destacado cinco modalidades (...) que comprenden la totalidad de las líneas temáticas que abordan sus investigaciones: la sintaxis, el nuevo lenguaje, el carácter innovador, las influencias y el vanguardismo. Estos principios son corroborados a manera de comparación, diferenciación y crítica. Finalmente, el objetivo de este artículo es reconocer los postulados reincidentes y expositivos de este texto para conseguir una clasificación al respecto y delimitar los tópicos elaborados y los que restan hacer. Audience segmentation is necessary in health communications to ensure equitable resource distribution. Peer crowds, which are macro-level teen subcultures, are effective psychographic segments for health communications because each crowd has unique mindsets, values, norms, and health behavior profiles. These mindsets affect behaviors, and can be used to develop targeted health communication campaigns to reach those in greatest need. Though peer crowd research is plentiful, no existing peer crowd measurement tool has been formally validated. As such, we developed and validated (...) class='Hi'>Virginia's Mindset Lens Survey (V-MLS), a mindset-based teen peer crowd segmentation survey to support health communication efforts. Using an online convenience sample of teens (N = 1,113), we assessed convergent and discriminant validity by comparing the V-MLS against an existing, widely-used peer crowd survey (I-Base Survey®) utilizing a multi-trait multi-method matrix. Sin embargo, es importante considerarlo para comprender la posición filosófica y política del Círculo de Viena y, en particular, su actitud tardo-ilustrada y su optimismo científico. El presente trabajo analiza los poemas «III» y «XXVIII» de Trilce (1922) del escritor peruano César Vallejo, considerando que su temática aborda la composición idealizada de la familia desde una posición desfavorable para el yo poético y que, al establecerse de esa manera, logra la perlocución en el lector (lo persuade y lo convence de una realidad específica). Esta configuración semántica se demuestra mediante el análisis del discurso retórico, investigado por C. Fernández Cozman, que adopta los postulados de G. (...) Lakoff y M. Johnson, que recurren a conceptos macro (megametáforas) y micro (metáforas específicas), imprescindibles para la formación de la clasificación tipológica, dispuesta en metáforas orientacionales, ontológicas y estructurales. The presentation shows how James' the specious moment and Husserl's the rough now constitute the matrix of modernist literature, especially the fiction of Virginia Woolf. From St. Augustine to Husserl there is a continuum which has to be understood for engaging with the novels of Virginia Woolf.

Among issues considered in contemporary ethics, apart from concepts such as good, value and justice, there is also the concept of care, discussed extensively in feminism. The article presents and analyses this ethical concept. It shows some problems with the translation of the English word ‘care’ into the Polish equivalent ‘troska’. The focus here, however, is mainly on the way of understanding the concept of care among feminist ethicists, such as Virginia Held, Nel Noddings, Joan Tronto, Diemut Bubeck, and (...) Sara Ruddick. For all of them, care is a relation, though they differ in their account of the specificity and meaning of this relation. (shrink)

Care ethicists have long insisted that Kantian moral theory fails to capture the partiality that ought to be present in our personal relationships. In her most recent book, Virginia Held claims that, unlike impartial moral theories, care ethics guides us in how we should act toward friends and family. Because these actions are performed out of care, they have moral value for a care ethicist. The same actions, Held claims, would not have moral worth for a Kantian because of (...) the requirement of impartiality. Although Kantian moral theory is an impartial theory, I argue that the categorical imperative in the Formulation of Humanity as an End and the duty of respect require that we give special treatment to friends and family because of their relationships with us. Therefore, this treatment does have moral value for a Kantian. (shrink)

This thesis is a sceptical investigation into the notion that the metaphorical wave-particle binary of Virginia Woolf's To the Lighthouse is related to quantum physics. Indeed, the field of literature and science has employed conceptual similarities as the main means of connecting quantum concepts to novels, however, this has led to a host of scholarly difficulties, prompting the need for a re-examination of analogical linkages. Woolf is the model candidate for such a re-examination, given her historical and philosophical proximity (...) with the developments of quantum mechanics. To the Lighthouse, in particular, was written between 1925 and 1927: precisely when quantum physicists were attempting to resolve the wave-particle duality, leading to Niels Bohr's complementarity. This parallel has been noted by researchers as relevant to the novel, as it too displays a general binary that can be read as wave-particle-like, which the author also attempts to resolve along similar philosophical lines. Nevertheless, other than proximity and similarity, there are no reasons to affirm that the science is related to the novel; hence, it is an ideal case study to examine in order to ascertain the value of conceptual similarities in literature and science. To do so, To the Lighthouse's binary and its resolution are interpreted in a thesis-long close reading, in order to compare aspects of it firstly to Woolf's personal thought, and secondly to various non-quantum intellectual contexts that preceded and surrounded her. In doing so, it becomes clear not only that invoking quantum physics serves no clear purpose in better understanding the novel, but also that the notion of resolving wave- particle-like binaries was a widespread philosophical procedure at the turn of the century, decades before Bohr's concept. This negative conclusion interrogates what the scholarly value of interpreting similarities is, though a hypothetical solution can be found in conceptual metaphor theory. (shrink)

Virginia Held argues that terrorism can be justified in some instances. But unlike standard, consequentialist justifications, hers is deontological. This paper critically examines her argument. It explores how the values of fairness, responsibility, and desert can serve to justify acts of terrorism. In doing so, two interpretations of her account are considered: a responsibility-insensitive and a responsibility-sensitive interpretation. On the first, her argument collapses into a consequentialist justification. On the second, it relies on an implausible conception of responsibility. Either (...) way, her argument fails as a distinctly deontological defense of terrorism. (shrink)

In this article I review the Supreme Court’s current use of its major questions doctrine to see if the justifications commonly offered for its existence can explain its current use. In the process of doing so, I examine what the doctrine is about, how it came into existence and how the Court has applied it, especially in context to two recent cases, West Virginia v. EPA and Biden v. Nebraska. As both of these cases implicate the regulatory state, I (...) place the primary focus of this article on how the doctrine should apply in context to judicial evaluation of the regulatory state. In so doing, I discover that the Court’s current reliance on constitutional separation of powers and checks and balances analyses seem too narrow both with respect to the concerns of the founding generation but also, and perhaps more importantly, to the Constitution’s goals for the kind of government it sought to establish going into the future. Noncompete agreements are among the most commonly used methods to restrict employment. Upwards of 38% of American workers, many of which are low-wage workers, have signed noncompete agreements. These agreements effectively hold those workers hostage to their current employer. This project analyzes the use of noncompete clauses in employment contracts with low-wage workers. We show that noncompetes with low-wage workers are not enforceable in the U.S.; employers nevertheless continue to include noncompete clauses in employment contracts with low-wage workers. We survey (...) states’ attempts to regulate the use of (even unenforceable) noncompetes and argue that current legislation is ineffective at preventing employers from including noncompetes in low-wage worker contracts. We argue that employers’ use of (even unenforceable) noncompete agreements with low-wage workers is wrongfully exploitative of those workers, and we provide suggestions for how states can effectively regulate the use of noncompetes, and thus protect low-wage workers from exploitation, using Virginia’s recently passed noncompete bill as a model.
