Introduction: Clinical practice guidelines (CPGs) are an important source of justification for clinical decisions in modern evidence-based practice. Yet, we have given little attention to how they argue their evidence. In particular, how do CPGs argue for treatment with long-term medications that are increasingly prescribed to older patients? Approach and rationale: I selected six disease-specific guidelines recommending treatment with five of the medication classes most commonly prescribed for seniors in Ontario, Canada. I considered the stated aims of these CPGs and (...)

What kind of rhetoric frames French reproductive policy debate? Who does such policies exclude? Through an examination of the “American import” of gender studies, along with an analysis of France’s Catholic heritage and secular politics, I argue that an unwavering belief in sexual difference as the foundation of French society defines the productive reproductive citizen. Sylviane Agacinski is perhaps the most vocal public philosopher who has framed the terms of reproductive policy debate in France, building an oppositional platform to (...)

We can define state instability as a situation in which a system's previously established norms and rules no longer function properly. Under the circumstances of changed institutional functioning, the main actors of the given environment resort to new strategies to preserve their authority and maintain their positions. In this paper, we aim to present rhetorical strategies as a response of political actors to the environment of state instability. Even-like particles have widely been analyzed as inducing scalar and additive presuppositions (cf. Horn 1969; Karttunen & Peters 1979; Rooth 1992; Gast & van der Auwera 2011). However, the additivity of even has been controversial since at least Horn 1992 and increasingly called into question (see Greenberg & Umbach 2021 for references); Greenberg specifically argues that scalar even-like particles can vary in additivity. We review key aspects of how resilience has been conceptualised, generally speaking, focusing on its normative implications. Insofar as resilience is suggested as a goal, or used to evaluate individuals, groups and systems, the rhetorical use of (...)

How can conceptual art contribute to political discourse? By the late 1960s, New York conceptual artists like Adrian Piper were faced with this difficult question. Conceptual artistic experiments seemed removed from the anti-war, anti-racist and feminist struggles, while personally many artists became increasingly involved in activism. I revisit the knotty relationship between art and politics through a close analysis of Piper's work in this period. The exculpatory rhetorical power of the term “honest belief” continues to invite reliance on the bare credibility of belief in consent to determine culpability in sexual assault. In law, however, only a comprehensive analysis of mens rea, including an examination of the material facts and circumstances of which the accused was aware, demonstrates whether a “belief” in consent was or was not reckless or wilfully blind. An accused's “honest belief” routinely begs this question, leading to a truncated (...) of criminal responsibility, and error. The problem illustrates how easily old rhetoric perpetuates assumptions that no longer have a place in Canadian law. (shrink)

To understand the functioning of this poetic language, we will adopt the Groupe μ analysis method (both the General Rhetoric andthe Treatise on theVisual Sign). Whereas the language is manifold as the forms of representation, and it present in all media, whatever the lack of speech -silence -would find its richest form in both directions through the metaphors and metonymy engaged (...)

  43. How To Do Things With Signs: Semiotics in Legal Theory, Practice, and Education.Harold Anthony Lloyd - forthcoming - University of Richmond Law Review.
Note: This draft was updated on November 10, 2020. Discussing federal statutes, Justice Scalia tells us that “[t]he stark reality is that the only thing that one can say for sure was agreed to by both houses and the president (on signing the bill) is the text of the statute. The rest is legal fiction." How should we take this claim? If we take "text" to mean the printed text, that text without more is just a series of marks. If (...)

  44. (1 other version)Moral Metaphorics: Kant after Blumenberg.Alison Ross - 2011 - Thesis Eleven 104 (1):40-58.
This paper examines the role of formal, aesthetic elements in motivating moral action. It proposes that Blumenberg’s analysis of the existential settings of myth and metaphor provide a useful framework to consider the conception and function of the aesthetic symbol in Kantian moral philosophy. In particular, it explores the hypothesis that Blumenberg’s analysis of ‘pregnance’ and ‘rhetoric’ are useful for identifying and evaluating the processes involved in self-persuasion to the moral perspective.

  45. La retorica come strumento teologico. Una lettura del Dominus vobiscum di Pier Damiani.Lorenzo Saraceno - 2021 - Noctua 8 (1–2):87-109.
Dominus Vobiscum is undoubtedly one of Peter Damian’s most original works, and has experienced a renewed interest thanks to the re-emergence of the ecclesiology of communion around Vatican II, but in-depth studies of the work as a whole are missing and its sources seem quite limited. In this analysis of the text and its argumentative structure, the conceptual development is built on the dialectic of contrasts, starting from the binomial of “solitudo pluralis” and “multitudo singularis”, typical of the hermit. (...)

The aim of this paper is to outline a methodological framework for brand equity planning with structuralist rhetorical semiotics. By drawing on the connectionistconceptual model of the brand generative trajectory of signification it will be displayed in a stepwise fashion how a set of nuclear semes and classemes or anintended semic structure that underlies manifest discursive structures may be projected by its internal stakeholders with view to attaining differential brand associations. The suggested methodological framework focuses on the strength and (...)

This brief essay – based partially on remarks made as a member of a "diversity panel" at a recent Florida Philosophical Association meeting and partially on the reception of those remarks – concerns the rhetorical spaces from which one is allowed to speak as a woman in philosophy. I identify two gendered locations from which women are allowed to speak about the diversity problem in philosophy: 1) the happy woman of reason and 2) the unhappy feminist philosopher. Drawing on (...)

"Language and its Public Features: Reorganizing the Trivium in Locke's Essay and Port-Royal Logic" The new theory of language in the 17th century coincides with the end the traditional order of disciplines in the trivium (grammar, logic and rhetoric), which in the mediaeval times provided a comprehensive view of the problems of discourse. The article focuses on some key passages in Port-Royal Logic and Locke's Essay that provide us with a typical early modern scheme of linguistic representation, characterised by heavily (...)

The moot point of the Western philosophical rhetoric about free will consists in examining whether the claim of authorship to intentional, deliberative actions fits into or is undermined by a one-way causal framework of determinism. Philosophers who think that reconciliation between the two is possible are known as metaphysical compatibilists. However, there are philosophers populating the other end of the spectrum, known as the metaphysical libertarians, who maintain that claim to intentional agency cannot be sustained unless it is assumed that (...)

  50. Attention and counter-framing in the Black Lives Matter movement on Twitter.Colin Klein, Ritsaart Reimann, Ignacio Ojea Quintana, Marc Cheong, Marinus Ferreira & Mark Alfano - 2022 - Humanities and Social Sciences Communications 9 (367).
The social media platform Twitter platform has played a crucial role in the Black Lives Matter (BLM) movement. The immediate, flexible nature of tweets plays a crucial role both in spreading information about the movement’s aims and in organizing individual protests. Twitter has also played an important role in the right-wing reaction to BLM, providing a means to reframe and recontextualize activists’ claims in a more sinister light. The ability to bring about social change depends on the balance of these (...)
