What follows is an attempt to do some conceptual housekeeping around the notion of secret law as provided by Christopher Kutz (2013). First I consider low-salience (or merely obscure) law, suggesting that it fails to capture the legal and moral facts that are at stake in the case which Kutz used to motivate it. Then I outline a theoretical contrast between mere obscurity and secrecy, in contrast to the 'neutral' account of secrecy provided by Sissela Bok (1989). The upshot of (...) the two sections is that low-salience law is neither secret law nor necessarily problematic, though it closely resembles a kind of law that is both secret and problematic: namely, those legal obscurities that subvert manifest interests related to the informational needs of citizens. The ensuing argument undermines the fiction of constructive presence found in Austin and Blackstone. (shrink)

In reply to Daniel Hutto’s “Getting Real About Pretense,“ I defend my theory of pretense against his claim that it is subject to counterexamples by clarifying wherein the value of the analysis lies. Then I argue that the central challenge still facing Hutto’s “primacy of practice” approach, as well as other 4E approaches to pretense, is to explain the link between pretense and deception.

Pulcinella is one of the most ancient comic characters of the Commedia dell’Arte.1 He is the stereotypical lazy servant, insolent and chauvinist, sometimes stupid, sometimes clever, always penniless, and absolutely unable to keep any secret. In a typical Commedia dell’Arte plot, the master reveals a secret to Pulcinella, who is under oath never to disclose it. Needless to say, after swearing that he will never divulge it, Pulcinella soon acts in a very different way, telling the secret to everybody he (...) meets. Yet each time Pulcinella discloses the secret, he asks for total confidentiality, pretending that no one else knows it. Sooner or later all characters on the stage know the secret but none of them know that all the others know it. Eventually each one behaves as though she were the sole repository of the secret while the only secret is that there is no secret at all. I often think of the Pulcinella’s secret nowadays, when someone evokes the ‘medical secret’. (shrink)

In this chapter I argue that the traditional interpretation of the commonly accepted moral asymmetry between secrets and lies is incorrect. On the standard interpretation of the commonly accepted view, lies are prima facie or pro tango morally wrong, whereas secrets are morally permissible. I argue that, when secrets are distinguished from mere acts of reticence and non-acknowledgement, as well as from acts of deception, so that they are defined as acts of not sharing believed-information while believing that the believed-information (...) is relevant, the correct interpretation of the commonly accepted moral asymmetry between secrets and lies is that secrets are also prima facie or pro tango morally wrong, albeit less morally wrong than lies. In this paper, I reconstruct Hume's account of decency, the virtue associated with a limited display of pride, and show how it presents a significant challenge to standard virtue ethical interpretations of Hume. In section I, I explore his ambivalent conception of pride as both virtuous (because useful and agreeable to oneself) and vicious (when excessive and disagreeable to others). In section II, I show how the virtue of decency provides a practical solution to these two clashing aspects of pride. (...) In doing so, I demonstrate that decency is a merely behavioural virtue that requires no virtuous motive and consists of nothing more than "a fair outside." I argue that this account of decency represents a serious and underexplored challenge to standard interpretations of Hume as a virtue ethicist committed to the idea that actions derive their moral value from underlying motives. Ramayan Through Kundalini Yoga Shodasi is an ideal read for Sanskrit-literate readers who are open to eclectic yogarthas and connotative meanings -------- So you thought Vyasa was before Valmiki, Mahabharat was before Ramayan, Rama a Vishnu avatar, and tantrism distinct from vedism? Think again. In Shodasi: Secrets of the Ramayana, Telugu poet Seshendra Sharma re-reads the Ramayan to come up with a number of new conclusions. Much of the book sets out to prove that Ramayan was written before the Mahabharat. (...) Sharma discusses how Indra is cited more often than Vishnu, thus placing the context of the Ramayan closer to Vedic than Puranic thought. He quotes from the Mahabharat to show how it follows descriptions of hills, rivers from the Ramayan. The Mahabharat has some prose, and therefore, it must have been composed after Ramayan, which is entirely in poetry. These are only some of the numerous reasons that Sharma offers to suggest a new sequence of our itihasas. Sharma’s book is also an experimental reading of the Ramayan through the interpretive lens of what he calls Kundalini yoga. Hanuman’s flight to Sri Lanka gets a new interpretation. “Charana Charite Pathi” is interpreted as the path of Kundalini, and the first verse of the Sundara Kanda “Tatho Ravana Nithayah” is interpreted by Sharma to refer to Hanuman traversing the sushumna nadi of the Kundalini. Trijata’s dream becomes the Gayatri mantra through an imaginative recasting of words as numbers. Gaja (elephant) means eight, danta (teeth) means thirty-two, and maha-gaja-chaturdantam somehow also adds up to 32 syllables, which is the number of syllables in the Gayatri mantra. That Trijata’s dream is halfway through the Ramayan also becomes significant for Sharma, he calls it the ‘central bead’ in the Ramayan garland of 24,000 beads. Identifying 32-syllables as the Gayatri follows a convention, for mantras are referenced by the number of syllables; however, it is the “secret” yogartha—or mystical, anagogical translations—derived by Sharma that becomes problematic, unless he is considered an authority in his own right. conclude that the name Sundarakand is unrelated to any descriptions of beauty of any of the main characters in the Ramayan. However, Soundarya and Tripura-Sundari are well-known conventions in the tantric tradition and hence, Sharma concludes that Sundarakand derives its name from Shakti’s beauty, and “Sundara-Hanuman” means “Hanuman who is a devotee of Devi” (117). A coda in this book is about the benedictory verse in Kalidasa’s Sakuntalam which has traditionally been understood to refer to Ishwara. Sharma re-interprets this verse highlighting the “eight forms” of the last line as the eight forms of Devi that please Ishwara. This book is suitable for a reader who is Sanskrit-literate and open to eclectic yogarthas and connotative meanings. Sharma cites substantially from the Ramayan in roman but without diacritics, this is difficult to follow; and he does not always include translation. Sharma often cites commentators without citing names and sources. It is not clear why the book is called Shodasi—readers may note, this book is not about the Srividya tradition. Even if the reader is unconvinced by Sharma’s reasoning or methodology, the free flow of references may prove absorbing for a reader interested in the subject. A new philosophical analysis is provided of the notorious Sleeping Beauty Problem. It is argued that the correct solution is one-third, but not in the way previous philosophers have typically meant this. A modified version of the Problem demonstrates that neither self-locating information nor amnesia is relevant to the core Problem, which is simply to evaluate the conditional chance of heads given an undated Monday-or-Tuesday awakening. Previous commentators have failed to appreciate the significance of the information that Beauty gains upon (...) waking, and which is relevant to the conditional chance of heads: de re acquaintance with the awakening itself and the non-locating knowledge that it is an experimental awakening. David Lewis and company are committed to several unjustifiable and unacceptable probability assessments. Previous commentators have in effect confused the information that Beauty undergoes this particular experimental awakening for the information that she undergoes some experimental awakening or other. Lewis in particular thereby illegitimately tips the scales both in favor of heads and in favor of Monday. The Sleeping Beauty Problem is equivalent to a ball-in-urn word problem in elementary probability theory. (shrink)

In this article I address the neglected question of what kind of act keeping a secret is, and what Kant had to say about secret keeping. First, I provide a definition of keeping a secret, improving upon Sissela Bok's definition. I distinguish between keeping a secret and deception, incorporating Thomas Nagel. Then, I discuss what Kant had to say about keeping a secret, and advance an Kantian argument for the moral permissibility of secret-keeping.

The paper offers an interpretation of a disputed portion of Plato’s Theaetetus that is often called the Secret Doctrine. It is presented as a process ontology that takes two types of processes, swift and slow motions, as fundamental building blocks for ordinary material objects. Slow motions are powers which, when realized, generate swift motions, which, in turn, are subjectively bundled to compose sensible objects and perceivers. Although the reading of the Secret Doctrine offered here—a new version of the “Causal Theory (...) interpretation”—is not without problems, these problems are acknowledged in Plato’s text, confirming that this interpretation is correct. In Considerations on Representative Government, John Stuart Mill concedes that secrecy in voting is often justified but, nonetheless, maintains that it should be the exception rather than the rule. This paper critically examines Mill’s arguments. It shows that Mill’s idea of voting depends on a sharp public/private distinction which is difficult to square with democratic ideas about the different powers and responsibilities of voters and their representatives, or with legitimate differences of belief and interest amongst voters themselves. Hence, it concludes, (...) we should reject the assumption, which many of us share with Mill, that the secret ballot is justified only on prudential grounds and recognise how central privacy is to any democratic conception of citizenship and politics. Several metaphysical/philosophical concepts are developed as tools by which we may further understand the essence, structure, and events/symbols of “Complex” Synchronicity, and how these differ from “Chain of Events” Synchronicity. The first tool is the concept of Astronomical vs Cultural time. This tool is to be the basis of distinguishing Simple from Complex Synchronicity as Complex Synchronicities are chunks of time that have several coincidences in common with each other. We will also look at the nature of the perspective of (...) the time being quantized. The next tool is a particular case study of two movies, The Matrix and Black Swan, that may be viewed as an example of a Complex Synchronicity in the collective conscious of popular culture (as opposed to Simple Synchronicity or a single coincidence). And the final tool is the concept of “Chain of Events” synchronicity as a separate concept from Simple or Complex synchronicities. This 3rd tool is developed using a mathematical metaphor of foreshadowing (an element of storytelling) in the seemingly random pattern of prime numbers. The purpose of this paper is to distinguish and develop these concepts and to lay a foundation for the further study of the concept of Synchronicity first illuminated by Carl Jung as an acausal connecting principle between coincidences. According to an argument that I will call the argument from loose lips, we can safely reject certain notorious conspiracy theories because they posit conspiracies that would be nearly impossible to keep secret. I distinguish between three versions of this argument: the epistemic argument, the alethic argument, and the statistical argument. I, then, discuss several limitations of the argument from loose lips. The first limitation is that only the statistical argument can be applied to new conspiracy theories. The second limitation (...) is that no version of the argument suffices to rule out the existence of small initial conspiracies that have no need to add further conspirators. The third limitation is that no version of the argument is dialectically efficacious in the context of arguing with the relevant conspiracy theorists because nothing is said to address the alleged evidence that they cite. What, then, is the significance of the psychoactive mushrooms hiding in plain sight in the artwork and icons of many European and Middle-Eastern churches? Does Christianity have a psychedelic history? -/- Providing stunning visual evidence from their anthropological journey throughout Europe and the Middle East, including visits to Roslyn Chapel and Chartres Cathedral, authors Julie and Jerry Brown document the role (...) of visionary plants in Christianity. They retrace the pioneering research of R. Gordon Wasson, the famous “sacred mushroom seeker,” on psychedelics in ancient Greece and India, and among the present-day reindeer herders of Siberia and the Mazatecs of Mexico. Challenging Wasson’s legacy, the authors reveal his secret relationship with the Vatican that led to Wasson’s refusal to pursue his hallucinogen theory into the hallowed halls of Christianity. -/- Examining the Bible and the Gnostic Gospels, the authors provide scriptural support to show that sacred mushrooms were the inspiration for Jesus’ revelation of the Kingdom of Heaven and that he was initiated into these mystical practices in Egypt during the Missing Years. Philosophers often treat racist and sexist slurs as a special sort of puzzle. What is the difference between a slur and its correlates? In attempting to answer this question, a second distinction has been overlooked: that between slurs and insults. What makes a term count as a slur? This is not an unnecessary taxonomical question as long as ableist terms such as ‘moron’ are dismissed as mere insults. Attempts to resolve the insult/slur distinction by considering the communicative content of slurs (...) are not promising. A better solution is offered by speech act theory, and this paper develops a novel way to describe ordinary slurring utterances as oppressive speech acts. This can both explain the difference between slurs and insults, and challenge the dismissal of ableist terms. (shrink)

In both works, Kant portrays the philosopher as having the duty to promote a “secret article”, without which his vision of a lasting international peace through the agency of a federation of states (...) is bound to fail. Both works identify this article as involving the necessity of publicity as a transcendental condition for peace, and call for philosophers to engage politicians and lawyers in a creative attitude towards lawmaking. Kant’s visionary program has failed to reach its goal up to now, not because it is too idealistic, but because philosophers have failed to take up the challenge. (shrink)

In this paper, we argue that because of the advent of Artificial Intelligence, the secret ballot is now much less effective at protecting voters from voting related instances of social ostracism and social punishment. If one has access to vast amounts of data about specific electors, then it is possible, at least with respect to a significant subset of electors, to infer with high levels of accuracy how they voted in a past election. Since the accuracy levels of Artificial Intelligence (...) are so high, the practical consequences of someone inferring one’s vote are identical to the practical consequences of having one’s vote revealed directly under an open voting regime. Therefore, if one thinks that the secret ballot is at least partly justified because it protects electors against voting related social ostracism and social punishment, one should be morally troubled by how Artificial Intelligence today can be used to infer individual electors’ past voting behaviour. The best and the worst of Spain. Texts from Unamuno, Lucas Mallada, Rafael Salillas, Josep Plà.

Purpose. The author believes that the main topic of philosophical studies of Heraclitus was not nature, not dialectics, and not political philosophy; he was engaged in the development of philosophical anthropology, and all other questions raised by him were subordinated to it to one degree or another. It is anthropology that is the most "dark" part of the teachings of this philosopher, therefore the purpose of this article is to identify the hidden anthropological message of Heraclitus. In case of success, (...) it will become clear what made him "darken". Theoretical basis. The methodological basis of the article is the anthropological understanding of fragments of Heraclitus’ texts presented in a historical and philosophical context. Originality. The philosophical concept of Heraclitus is still a mystery for researchers of his work. The author of the article proposed such a variant of interpretation, within the framework of which different elements of this concept fit into a consistent model. Conclusions. The article proves that although the anthropological turn in philosophy is traditionally associated with the activities of the sophists and Socrates, the previous philosophical thought was also not devoid of anthropological ideas. Moreover, pre-Socratic philosophers posed problems, the interpretation of which brought the doctrine of man to the level of high-order abstractions, while surprisingly preserving the concreteness of the life-meaning questions that confront him. And one of the brightest representatives of pre-Socratic anthropology was Heraclitus of Ephesus. Religion was the motivator that made him study the world, man, and society. The doctrine of the Logos developed by Heraclitus had a tremendous impact on Plato and Philo of Alexandria, and through them on the author of the Fourth Gospel, who begins his story with a "Greek" rethinking of the mystery of the Incarnation. If Heraclitus claimed that a person carries a particle of the Logos, then John proclaimed that the Logos itself incorporated a particle of man. Despite all the differences between these approaches, each of them postulated the cosmic significance of human existence, which means that it brought anthropology to the ontological level. (shrink)

: Does the rejection of pure proceduralism show that we should adopt Brettschneider’s value theory of democracy? The answer, this paper suggests, is ‘no’. There are a potentially infinite number of incompatible ways to understand democracy, of which the value theory is, at best, only one. The paper illustrates and substantiates its claims by looking at what the secret ballot shows us about the importance of privacy and democracy. Drawing on the reasons to reject Mill’s arguments for open voting, in (...) a previous paper by A. Lever, it argues that people’s claims to privacy have a constitutive, as well as an instrumental, importance to democratic government, which is best seen by attending to democracy as a practice, and not merely as a distinctive set of values. One of the recurring themes in Čapek’s play is the existential question of whether the reductionist materialist worldview – the belief that we can fully explain the world, including ourselves, in terms of nothing but physical processes – can accommodate all that is essential to the human being. The materialist worldview triumphed with the scientific revolution, which in turn laid the foundations for the military-industrial complex. This historical shift is represented in the play by the business-minded young Rossum inheriting the (...) bio-engineering methodology from the mad scientist old Rossum. A key difference between the two is that old Rossum’s materialist stance is an ideological commitment, whereas for young Rossum working within a materialist framework is more a matter of convenience: for him it is sufficient for most practical purposes to replicate the machine-like aspects of a person. Where does this leave the soul, or what we today might prefer to call consciousness? The question of whether human nature goes beyond its physical aspects, and whether these subjective aspects can also be artificially replicated, is extremely challenging to address in scientific theory and practice –100 years ago as much as now. In a section of his book Anarchy, State, and Utopia entitled “Macro and Micro,” Nozick makes objections of a certain kind to Rawls. In this paper, I draw attention to a macro and micro objection that scattered material in that book entails.

Poetry, it is said, can reveal truth. Yet despite the best efforts of philosophers and poets to describe this truth, very few understand what kinds of truth poetry can convey.* One fact seems clear: only a few of the truths of poetry can be captured equally well in prose. Poetry also conveys truths of a different kind — truths that seem to exist on a level entirely different level from that of ordinary, factual truth. Some poems try to teach moral (...) or practical lessons that also could be stated in prose.* But this is not the kind of truth that puzzles philosophers and critics. Poetry also can tell another kind of truth — a truth that may be mystifying to scholars, but that is well known to anyone who becomes acquainted with poetry in an intimate way. This kind of truth cannot be spoken of or contemplated on the same terms as ordinary fact. What is the nature of this strange, yet familiar kind of knowledge that poetry can bring to the human mind? Discussion of two documentaries by the Oaxacan filmmaker and anthropologist Sandra Luz López Barroso, Artemio (2017) and The One Amongst the Shadows (El compromiso de las sombras, 2021), both focused on the Costa Chica of Guerrero.

People increasingly form beliefs based on information gained from automatically filtered Internet ‎sources such as search engines. However, the workings of such sources are often opaque, preventing ‎subjects from knowing whether the information provided is biased or incomplete. Users’ reliance on ‎Internet technologies whose modes of operation are concealed from them raises serious concerns about ‎the justificatory status of the beliefs they end up forming. Yet it is unclear how to address these concerns ‎within standard theories of knowledge and justification. (...) To shed light on the problem, we introduce a ‎novel conceptual framework that clarifies the relations between justified belief, epistemic responsibility, ‎action, and the technological resources available to a subject. We argue that justified belief is subject to ‎certain epistemic responsibilities that accompany the subject’s particular decision-taking circumstances, ‎and that one typical responsibility is to ascertain, so far as one can, whether the information upon which ‎the judgment will rest is biased or incomplete. What this responsibility comprises is partly determined by ‎the inquiry-enabling technologies available to the subject. We argue that a subject’s beliefs that are ‎formed based on Internet-filtered information are less justified than they would be if she either knew how ‎filtering worked or relied on additional sources, and that the subject may have the epistemic ‎responsibility to take measures to enhance the justificatory status of such beliefs.‎. Just before the Scientific Revolution, there was a "Mathematical Revolution", heavily based on geometrical and machine diagrams. The "faculty of imagination" (now called scientific visualization) was developed to allow 3D understanding of planetary motion, human anatomy and the workings of machines. 1543 saw the publication of the heavily geometrical work of Copernicus and Vesalius, as well as the first Italian translation of Euclid.

The Bhagavad Gītā has inspired more interpretive controversy than any other religious scripture in India’s history. The Gītā, a philosophical and spiritual poem of approximately seven hundred verses, is part of the ancient Sanskrit epic, the Mahābhārata. In the Gītā, the Lord Kṛṣṇa, who appears in the form of a charioteer, imparts spiritual teachings to the warrior Arjuna and convinces him to fight in a just war that entails the slaughter of many of Arjuna’s own relatives and loved ones. Śaṅkara, (...) the great eighth-century champion of the Advaita school of philosophy, wrote the first extant commentary on the Gītā. The article "Philosophia of Pure Mind: Declassification of the basic Biblical Mysteries" offers a tool for solving biblical mysteries — this is the philosophy of pure mind, which brings to life conceptual thinking with private and extremely general comparative concepts — concepts of practical mind and categories of pure mind. From these positions, an active study of the fundamental biblical mysteries is carried out, and not just their description or discussion. The investigation implies their comprehension related to the understanding of (...) reality, which we find in the first lines of the Torah, in which comparative concepts are represented by gradation (light and darkness, day and night) and orthogonal views, i.e. the relationship between two pairs of opposites (day and night — evening and morning): "And there was evening, and it was morning: day one." Thus, through the concepts of practical mind, the author reveals the general idea of the Creator, reflecting the harmony of nature in Words, each of which is a comparative concept of one kind or another. This is the key to uncovering the Biblical mysteries, namely: how the Word of God relates to the mystery of the fall, to the mysteries of the Book of Creation (Sefer Yetzira), the mystery of the Holy Trinity and the Sign of the Cross. Finally, how the proposed thinking helps to understand and gain a more complete understanding of the essence of these mysteries within the framework of one more general problem. Moreover, the root of all these problems, in my opinion, is that the mind thinking of people, given to them, as well as to all living things from nature through sensations, was supplemented by a person with a multi-valued reason thinking with classification concepts of natural language. In this connection, the natural human mind, through unambiguous comparative concepts, was supplanted by reason, apparently absent in animals. All of this unfolds against the background of three successive Reformations, which gave rise to three Abrahamic religions dating back to the patriarch of the Semitic tribes, Abraham. Whereas the beginning of these reforms is associated with the struggle of Moses for faith in the invisible God Yahweh, perceived as a civil war between the supporters of Moses as one part of the Jews with another part of them worshipping the God of their ancestors, the creator of all things — Ilohim. The article concludes with an understanding of the 4th Reformation, which aimed to create a modern synthetic religion with the help of AI. (shrink)

The peculiarity of any social teaching, Catholic, Protestant or otherwise, is that it is an unsteady marriage between the dogmatically permanent beliefs and the perennially changing historical contexts. Any authentic and relevant social teaching needs to mirror a two-fold fidelity: Faithfulness to the universal truths to which the social teaching is a reflection, and loyalty to the historical contexts to which the social teaching is inextricably embedded. Wittgenstein taught us that there could not be a logically private language— a language on the proper speaking of which it was logically impossible for there to be more than one expert. For then there would be no difference between this person thinking she was using the language correctly and her actually using it correctly. The distinction requires the logical possibility of someone other than her being expert enough to criticize or corroborate her usage, someone able to constitute or hold (...) her to a standard of proper use. I shall explore the possibility of something opposite- sounding about laws, namely, that there could in principle be laws whose existence, legitimacy, goodness, and efficacy depend upon their being private, in this sense: their existence is kept secret from those who legitimately benefit from the laws and yet who would misguidedly destroy them were they to come to know of them; and it is kept secret from those who would illegitimately benefit from being able to circumvent the laws, and who could circumvent them if they knew of them. The secrecy of the laws increases their efficacy against bad behavior, and since were the public to come to know of these laws the public would lose its nerve and demand that the laws be rescinded, it prevents the public from destroying laws that are in fact in the public interest. These laws are therefore in a way logically private: they cannot at the same time exist, have the foregoing virtues, and be public. After proposing conditions under which such laws ought to be enacted, I moot logical objections to the very idea that there could be such laws, practical objections to their workability, and moral objections to their permissibility. I conclude by suggesting that, while we normally think of secret laws as creatures of the executive branch, things functionally equivalent to secret laws could also be created by other branches of government and societal institutions, and that all of this would be compatible with the form of sovereignty that is democratically grounded in the will and interests of the people. What is wrong with government whistleblowing and when can it be justified? In my view, ‘government whistleblowing’, i.e., the unauthorized acquisition and disclosure of classified information about the state or government, is a form of ‘political vigilantism’, which involves transgressing the boundaries around state secrets, for the purpose of challenging the allocation or use of power. It may nonetheless be justified when it is suitably constrained and exposes some information that the public ought to know and deliberate about. Government whistleblowing (...) should then be viewed, along the lines of civil disobedience, as a collective cognition- and legitimacy-enhancing device. (shrink)
