It goes without saying that in this entire process, judges have a participation. The power entrusted by law and the nature of judicial process, make judges the prime mover of the development of law. It matters how judges decide cases. It matters most to people unlucky or litigious or wicked or saintly enough to find themselves in court... The (...) effect emanating from the decision of a case affects the life of a person in many ways that at times has far reaching impact...When the law in question happens to be criminal law, it requires a cautious consideration to see how the interpretive tools used by judges affect the life of a litigant in ways both seen and unseen... Several areas concerning adjudication and judicial interpretation have been the subject matter of study. When reasoning about dependence relations, philosophers often rely on gradualist assumptions, according to which abrupt changes in a phenomenon of interest can only result from abrupt changes in the low-level phenomena on which it depends. These assumptions, while strictly correct if the dependence relation in question can be expressed by continuous dynamical equations, should be handled with care: very often the descriptively relevant property of a dynamical system connecting high- and low-level phenomena is not its instantaneous behavior, but its stable (...) fixed points (those in the vicinity of which it spends most of the time, after comparatively short transitory periods), and stable fixed points can change abruptly as a result of infinitesimal changes of the low-level phenomenon. I argue that the state of boredom (i.e., the transitory and non-pathological experience of boredom) should be understood to be a regulatory psychological state that has the capacity to promote our well-being by contributing to personal growth and to the construction (or reconstruction) of a meaningful life.

This article develops a detailed, empirically driven analysis of the nature of the transition costs incurred in becoming disabled. Our analysis of the complex nature of these costs supports the claim that it can be wrong to cause disability, even if disability is just one way of being different. We also argue that close attention to the nature of transition costs gives us reason to doubt that well-being, including transitory impacts on well-being, is the only thing that should determine the (...) wrongness of causing or removing disability. Non-welfare considerations also defeat the claim that it is always wrong to cause disability. The upshot of these conclusions is that closer attention to the nature of transition costs supports disabled people who strenuously contest the assumption that their well-being is lower than nondisabled people. It also suggests that, in addition, disabled people should contest their opponents’ narrow account of how we should make ethical decisions regarding causing or failing to prevent disability. This paper addresses the question of how human science categories yield projectable inferences by critically examining Ron Mallon’s ‘social role’ account of human kinds. Mallon contends that human categories are projectable when a social role produces a homeostatic property cluster (HPC) kind. On this account, human categories are projectable when various social mechanisms stabilize and entrench those categories. Mallon’s analysis obscures a distinction between transitory and robust projectable inferences. I argue that the social kinds discussed by Mallon yield the former, (...) while classifications of biological kinds yield the latter. It is widely assumed that time appears to be tensed, i.e. divided into a future, present and past, and transitory, i.e. involving some kind of ‘flow’ or ‘passage’ of times or events from the future into the present and away into the distant past. In this paper I provide some reasons to doubt that time appears to be tensed and transitory, or at least that philosophers who have suggested that time appears to be that way have included in ‘appearance’ everything (...) that falls under the broad term ‘cognition’, i.e. mental processes of all kinds, including perceiving, remembering, imagining, and thinking. I argue that the tensed and transitory aspect of our experience of temporal reality is, firstly, subordinate to our experience of a world of persistent objects, secondly, in conflict with a popular conception of the nature of persistent material objects, and finally, that it is an aspect of how we think about temporal reality rather than how we actually experience it. I support the last contention by a comparison with our experience of spatiality, which arguably has three distinguishable components: (i) ‘pure input perception’, (ii) ‘perceptual experience modulated by top down cognitive processes’, and (iii) a ‘pure representation of space’. For space, the modulation of our perception of space at any given moment is highly influenced by our pure representation of space, but it is not clear to me that our modulated experience of space is influenced by a pure representation of time. Rather, the modulated experience of temporality, to my mind, is much more clearly an experience of continuous existence of the persisting objects that make up the world. (shrink)

This essay represents a novel contribution to Nietzschean studies by combining an assessment of Friedrich Nietzsche’s challenging uses of “truth” and the “eternal return” with his insights drawn from Indian philosophies. Specifically, drawing on Martin Heidegger’s Nietzsche, I argue that Nietzsche’s critique of a static philosophy of being underpinning conceptual truth is best understood in line with the Theravada Buddhist critique of “self ” and “ego” as transitory. In conclusion, I find that Nietzsche’s “eternal return” can be understood as a (...) direct inversion of “nirvana”: Nietzsche celebrates profound attachment to each and every moment, independent from its pleasurable or distasteful registry. Bārasa Aņuvekkhā – ‘The Twelve Contemplations’ – of Ācārya Kundakunda (circa 1st century BC) contains 91 verses (gāthā). ‘Aņuvekkhā’, ‘aņupekkhā’, ‘anuprekşā’, and ‘bhāvanā’ are synonyms; these terms are used in Prākrit, Apabhramśa, Sanskrit and Hindi languages, respectively. Contemplation means ‘meditating on the nature of the Reality’. The uniqueness of Ācārya Kundakunda’s exposition is that he has described each contemplation both from the empirical (vyavahāra) as well as the transcendental (niścaya) points-of-view (naya). These contemplations help a man practise moral virtues, like (...) forbearance (kşamā), and lead to highly effective stoppage (samvara) of karmas. Consistent materialists are almost bound to suggest that , if it exists at all, is no more than epiphenomenal. A correct understanding of the real requires that everything we do and say is no more than a product of whatever processes are best described by physics, without any privileged place, person, time or scale of action. Consciousness is a myth, or at least a figment. Plotinus was no materialist: for him, it is Soul and Intellect that are more real than (...) the phenomena we misdescribe as material. Nor does he suppose that consciousness depends on language (as Stoics and modern materialists have sometimes said): wordless experience is actually superior. And much of what counts towards our present consciousness is to be discarded. It is better not to remember most of what now seems more significant to us; better to discard images; better that the intellect be than , losing any sense of separation between subject and object. The goal of the Plotinian intellectual is to join , but it is a mark of the good dancer that she is not conscious of what she does. There is therefore a strange confluence between Plotinus and modern materialists: our experience at least is transitory, deceitful, epiphenomenal, and is to be encountered when we have shed our illusions. This is a brief review of the Rasa theory of Indian aesthetics and the works I have done on the same. A major source of the Indian system of classification of emotional states comes from the ‘Natyasastra’, the ancient Indian treatise on the performing arts, which dates back to the 2nd Century AD (or much earlier, pg. LXXXVI: Natyasastra, Ghosh, 1951). The ‘Natyasastra’ speaks about ‘sentiments’ or ‘Rasas’ (pg.102: Natyasastra, Ghosh, 1951) which are produced when certain ‘dominant states’ (sthayi Bhava), (...) ‘transitory states’ (vyabhicari Bhava) and ‘temperamental states’ (sattvika Bhava) of emotions come together (pgs.102, 105: Natyasastra, Ghosh, 1951). This Rasa theory, which is still widely followed in classical Indian performing arts, classifies eight Rasas or sentiments which are: Sringara (erotic), Hasya (comic), Karuna (pathetic), Raudra (furious), Vira (heroic), Bhayanaka (terrible), Bibhatsa (odious) and Adbhuta (marvellous). There was a later addition of the ninth sentiment or Rasa called Santa (peace) in later Sanskrit poetics (pg.102: Natyasastra, Ghosh, 1951). According to ancient Indian aesthetics (especially in the context of Bharatas’ ‘Natyasastra’, Anandavardhana’s ‘Dhvanyaloka’ and Abhinavagupta’s ‘Abhinavabharati’), ‘Rasa’ is the relishable state of elemental human emotions called ‘Bhavas’. Bharata’s ‘Natyasastra’ originally spoke of eight Rasas. The concept of the 9th Rasa was a later interpolation by the Kashmiri Shaivist Abhinavagupta (10th Century AD) and also his predecessor Anandavardhana (9th Century AD). Abhinavagupta extends the eight Rasas by adding the concept of the Santa Rasa which he regards as the essence of all Rasas. It is this 9th Rasa which according to Abhinavagupta lets the Rasika attain the aesthetic detachment and savour the essences of all other Rasas and therefore the true aesthetic delight. The introduction of 9th Rasa integrates the concepts of Bharata’s Rasasutra and Patanjali’s Yoga theory – the detachment necessary to introspect inwards into the inherent state of freedom and bliss (aesthetic consciousness). Biology seems to present local and transitory regularities rather than immutable laws. To account for these historically constituted regularities and to distinguish them from mathematical invariants, Montévil and Mossio (Journal of Theoretical Biology 372:179–191, 2015) have proposed to speak of constraints. In this article we analyse the causal power of these constraints in the evolution of biodiversity, i.e., their positivity, but also the modality of their action on the directions taken by evolution. We argue that to fully account for the (...) causal power of these constraints on evolution, they must be thought of in terms of normativity. In this way, we want to highlight two characteristics of the evolutionary constraints. The first, already emphasised as reported by Gould (The structure of evolutionary theory, Harvard University Press, 2002), is that these constraints are both produced by and producing biological evolution and that this circular causation creates true novelties. The second is that this specific causality, which generates unpredictability in evolution, stems not only from the historicity of biological constraints, but also from their internalisation through the practices of living beings. How to reconcile monadic simplicity with the successive plurality of the monadic states ? The doctrine of continued creation seems to entail the existence of independent temporal parts and thus lead to the thesis that the world contains only transitory things. I try to show how Leibniz has the resources to get out of this quandary. The analysis of the concept of extension shows that a plurality of states does not constitute a divisible aggregate. Then I examine the Leibnizian interpretation (...) of continued creation, by com- paring it to the scholastic and Cartesian Background. From thence I conclude that Leibniz’s final thesis is that monads are wholly present at each moment of their duration. (shrink)

This article investigates a tension that arises in Hegel’s aesthetic theory between theoretical and practical forms of reason. This tension, I argue, stems from Hegel’s appropriation of an Aristotelian framework for a historically unfolding social teleology which puts practical reason to work for the aims of theoretical reason. Recognizing that this aspect of Hegel’s dialectic is essential in overcoming problems left in Kant’s transcendental idealism, the appearance of incongruence does not lessen. Grouped together with absolute spirit, Hegel positions art as (...) a transitory mode of mind, a vehicle, which aims to raise spirit to the higher cognition of philosophy. When the unfolding absolute concept becomes too complex for articulation in the material, art must end, as spirit’s message can be expressed only through the non-material form of philosophy. This study focuses on the ambivalence found in Hegel’s writings regarding his account of historical completion. Though Hegel sees in the Absolute a metaphysical solution to the unity of subject and object, the practical aspects of the unity appear to falter when philosophy becomes the dominant mode of expression at the close of a historical cycle. In Lectures on the History of Philosophy, Hegel links his notion of the Absolute, albeit with modification, to Aristotle’s nous. As described in De Anima, this entails a progression in which active and possible intellect rise to the level of the eternal, while passive intellect, the imaginative element, passes on with the body. Because the architecture of Aristotle’s nous, which is not in line with his defense of poetry, is integrated into the blueprint of Hegel’s absolute, an unresolved tension emerges in the spirit of art. A divergence of aims is forced to the surface through Hegel’s application of a template for achievement of theoretical knowledge, with an end in the universal, to a form of practical knowing which has an end in the particular. This paper argues that Karoline von Günderrode’s unique account of the socially constructed self provides a model for satisfying relationships and a stable self on the basis of a fragmented and untransparent subjectivity. Günderrode views experience as a discontinuous series of moments out of which a self can be constructed in two ways, both involving interactions with others. One of these is narrative; the other is a form of immediate experience, including experiencing together with others, that precedes narrative accounts of (...) identity. For Günderrode, the most important ways of interacting with others involve sharing thoughts, feelings and experiences without attempting to integrate these into a more holistic image of, or story about, the person with whom one is interacting. The result is a model for relationships between transitory, opaque selves that creates a basis for social interaction and the construction of identity that can survive and flourish without a stable self that is completely known to itself and others. -/- This journal is open access and includes so many wonderful articles. The objectification of subject or consciousness or spirit in sciences seems to be cause and effect of objectification of the Woman, Nature, Other, Knowledge and Reason or Idea or Dharma. When one has become all or creator has become creation, the plurality and difference is transitory which appear to have been assigned the permanent value. The transitory value has been given permanence, while the permanent has been dislodged from discourse, conveniently tucked to the abstract. Pakṣilasvāmin's introduction to his Nyāyabhāṣyam is perhaps one of the most interesting texts of the older Nyāya indispensable to the understanding of the system. This is not because the ideas expressed therein were not to be surpassed at a later period, but because in it the development of the school appears fixed, as it were, in a "transitory moment" (transitorisches Moment), and we see there for the first time that line of thought, which historically took form in the Nyāya philosophy, (...) becoming aware of itself in a clear, though archaic, manner. Furthermore, if we bear in mind to what extent such an interpretation of a school (given by itself) determines its development, the importance of Pakṣilasvāmin's text for the history of Nyāya cannot be over-estimated. Synthetic biology is often seen as the engineering turn in biology. Philosophically speaking, entities created by synthetic biology, from synthetic cells to xenobots, challenge the ontological divide between the organic and inorganic, as well as between the natural and the artificial. Entities such as synthetic cells can be seen as hybrid or transitory objects, or neo–things. However, what has remained philosophically underexplored so far is the impact these hybrid neo–things will have on (our phenomenological experience of) the living world. By (...) extrapolating from Walter Benjamin’s account of how technological reproducibility affects the aura of art, we embark upon an exploratory inquiry that seeks to fathom how the technological reproducibility of life itself may influence our experience and understanding of the living. We conclude that, much as technologies that enabled reproduction corroded the aura of original artworks (as Benjamin argued), so too will the aura of life be under siege in the era of synthetic lifeforms. This article zooms in on a specific case study, namely the research project Building a Synthetic Cell (BaSyC) and its mission to create a synthetic cell–like entity, as autonomous as possible, focusing on the properties that differentiate organic from synthetic cells. The nature of learning processes as well as evolutionary considerations suggest that aesthetic judgement is of central importance in the formation of custom. Learning and extrapolation rely on evaluations of non-instrumental features like simplicity, analogy, straightforwardness, and clarity. Further, learning is particularly effective if it is driven by an active desire to uncover new regularities, rather than merely gathering information in a passive way.From an evolutionary perspective, learning has evolved as an adaptation to fast and transitory environmental changes which cannot (...) be effectively traced by the slow and long-term evolutionary processes which take place on the genetic level. The evolutionary raison d’être of learning is to enable the individual to incessantly search for upcoming new regularities, and to act appropriately on them. As learning depends on aesthetic judgement, the evolutionary selection for learning implies an evolutionary molding of an aesthetic sense, and a preference for patterns and patterned action which ultimately leads to the formation of custom and social learning. The paper presents, thus, an evolutionary underpinning for the behavioral tendencies underlying my theory of custom. (shrink)

This paper is a reflection on the puzzle of life after death. It explores the meaning, types and causes of death so as to contemplate the purpose of life. Thus, the paper takes into consideration metaphysical, moral and epistemic issues in the belief in life after death (or life after life). This exploration is done considering the Yoruba philosophy of death (iku), life (iye) and life after death (aye atun wa). We note that, for the Yoruba, life as seen in (...) the body is ephemeral, whereas death (that is, the separation of the soul from the body—iku ara) is a transitory process of life to a renewed life. The paper shows that the Yoruba’s idea of death is not an end to life but a change in its form. It is argued, then, that the Yoruba ontology has the implications that: (a) life is a continuum and, (b) man is not his body, (c) hence, a theory of immortality of the soul is implied. The paper observes that, though certain contradictions exist in the Yoruba worldview, the ethos of the belief seems significant. The paper examines the notions of imo (knowledge) and igbabo (belief) in Yoruba epistemology and thus advances the thesis that their belief in life after death cannot be corroborated, though not unreasonable. Kant makes a much-unexpected confession in a much-unexpected place. In the Criticism of the third paralogism of transcendental psychology of the first Critique Kant accepts the irrefutability of the Heraclitean notion of universal becoming or the transitory nature of all things, admitting the impossibility of positing a totally persistent and self-conscious subject. The major Heraclitean doctrine of panta rhei makes it impossible to conduct philosophical inquiry by assuming a self-conscious subject or “I,” which would potentially be in constant motion like (...) other thoughts. For it rules out the possibility of completely detached reasoning which necessitates an unchanging state of mind. In this paper, Kaplama uses panta rhei to critically examine the philosophical shortcomings and contradictions of Kantian and Enlightenment ethics. In his examination, he specifically focuses on the teleological nature of Kant’s principle of freedom and ideal of moral autonomy which have dominated the Enlightenment thought. By doing so, he argues that it is essentially inaccurate to posit Überlegenheit (the state of being superior to nature) as the foundation of philosophical inquiry mainly because this would contradict the Enlightenment’s claim to constitute a rupture from classic and medieval metaphysics and would render Enlightenment a mere extension of Christian metaphysics. As in Christianity, Überlegenheit presupposes two separate realms, the actual (contingent) and ideal (pure) realms of thought and assumes that the transcendence commences from the level of the late metaphysical/teleological construction of the ‘subject’ who is completely persistent, self-conscious and immune to change. He then substantiates these points with reference to the philosophical roots of ethnic prejudice displayed by the post-Enlightenment colonialists and the missionaries in Fiji and the Pacific. This brief critical examination of the post-Enlightenment ethnocentrism will be conducted under the following three points: a) On the Enlightenment’s teleological and universalistic understanding of humanity and the concept of progress versus the Fijian concepts of the continuity of life, regeneration, and reproduction b) On the Enlightenment’s ideal of the free-willing and independent individual subject versus the Fijian ideas of 'the cord', reciprocity, and vanua, and c) On the Enlightenment’s (and Christianity’s) strict dualism between physics and metaphysics, nature and human mind, body and soul versus the Fijian bio-centrism, the sanctity of vanua and the cosmological concept of mana. Globalisation has brought immense changes to the national and international economic structure. The digital revolution and ICT expansion positively impacted the sharing economy development. In this regard, the most avant-garde countries in sharing economy seem to be the advanced countries. However, transitory countries such as Albania are making satisfactory progress as well. While being part of some global cases of sharing economy, Albania is also experiencing domestic incentives related with. The sectors involved in sharing economy are affiliated to different domains, (...) including agriculture, tourism, healthcare, transportation, etc. Albania strongly embraced technology because of its relatively young population and the flexible education system adopting to the market needs. The Albanian government is doing well on the promotion and usage of public platforms, which are supportive of the sharing concept. Although not specifically for the sharing economy, the government of Albania has released some useful strategic plans to embed the necessary instruments and infrastructure to digitalisation. However, there is more to do for sharing economy in specific terms. The collaboration of three actors, businesses-academia-government, would bring to the Albanian market new capacities and additional added values. (shrink)

The totality by transmuting itself while remain totality albeit not identical to the previous moment embraces a category to synthesize the unity of diversity. This diversity moved and moving from/by unity contemplates the relation of identity ratio (nowadays totality) between the identity (continuity with the preceding totality) and the non-identity (discontinuity with the preceding totality). To ignore the identity of identity with a non-identity conforms the impotence of category to constitute an expression of existence for not affording the contradiction immanent to the existence of reality moving from transport incessant of Being to come to be which puts itself from Non-being to Being. In short, concomitantly the being is transposed to Non-being to a Being come to be transpose from Non-being to a Being whilst ontological determination is constituted and constitutive of movement.
