ABSTRACT: The concept of the “banality of evil,” put forward by Hannah Arendt to describe the psychological profile of the Nazi criminal in Eichmann in Jerusalem, is intimately tied to her reading of Plato. In Arendt’s examination of the question of evil, she found some support in Kant’s philosophy. However, the problem of guilt under Nazism ultimately goes back to an inability to think. The two-in-one, a concept which describes the activity of thinking, is based on Plato’s dialogues. An examination (...) of these philosophical sources contributes to the understanding of the possibilities and the limits of Arendt’s reflection on evil. RÉSUMÉ : Le concept de banalité du mal, proposé par Hannah Arendt pour décrire le profil psychologique du criminel nazi dans Eichmann in Jerusalem, est intimement lié à ses lectures de Platon. Pour aborder la question du mal, elle a découvert des appuis chez Kant, mais le problème de la culpabilité sous le régime nazi renvoie ultimement au défaut de penser. Le deux-en-un, concept qui décrit la pensée, a été défini sur la base de l’oeuvre platonicienne. L’examen de ces sources philosophiques permet de mieux comprendre les possibilités et les limites de la réflexion arendtienne sur le mal. (shrink)

Abstract. — This article argues that the reading of Plato has had an influence on the development of Hannah Arendt’s (1906-1975) political philosophy. It sketches H. Arendt’s profile of the “political Plato” and shows how Plato’s philosophy inspired H. Arendt’s philosophical project. It pays a special attention to the subject of totalitarianism. It shows that H. Arendt’s reading was greatly influenced by the ideological interpretations of Plato of the 1930’s and 1940’s, and by the work and the method of interpretation (...) developed by Martin Heidegger. Arendt, en portant une attention particulière au thème du totalitarisme. Il démontre que la lecture d’H. This paper paints a historical-philosophical survey of some sources of Thomas More's Utopia by considering the content and the form of his narrative, which inspired for centuries thinking and dreaming about what a good society would look like. This essay intends contributing to clarify the intentions of its author, which remained debated until our time. More's book reflects a wide range of ancient and modern influences, while some particularities of his nararative go back to his quarrels with the intellectual and (...) theological milieus during his lifetime and to his friendship and intellectual relationship with Erasmus. Research on research ethics—regarding both the governance and practice of the ethical review of human subjects research—has a tumultuous history in North America and Europe. Much of the academic literature focuses on issues to do with regulating the conduct and quality of ethics review of research protocols by ethics committees (research ethics boards (REBs) in Canada and institutional review boards (IRBs) in the United States). In addition, some of the literature attends to issues particular to the review of qualitative research, (...) and still other literature addresses the challenges posed by and the need for research on REBs/IRBs. Psychiatric language and concepts, and the norms they embed, have come to influence more and more areas of our daily lives. This has recently been described as a feature of the ‘psychiatrization of society.’ This paper looks at one aspect of psychiatrization that is still little studied in the literature: the psychiatrization of our emotional lives. The paper develops an extended account of emotion pathologizing as a form of affective injustice that is related to psychiatrization and that specifically harms psychopathologized (...) people, i.e., people who are socially perceived to be mentally ill. After introducing an initial account of emotion pathologizing as articulated in Pismenny et al. (2024), we extend the account by demonstrating how processes and practices of emotion pathologizing are informed by (1) the dominant biomedical approach to psychiatry and (2) sanism, a system of discrimination and oppression that disadvantages people who have received a psychiatric diagnosis, or are perceived as in need of psychiatric treatment. We then argue that emotion pathologizing can manifest as an affect-related hermeneutical injustice that disadvantages psychopathologized individuals by unfairly constraining how they make sense of and understand their own emotional experiences. Police officers are vital to maintaining security and the continuity of national functions. Thus, Police officers are more exposed to different kinds of psychological concerns. However, a female in this kind of profession, based on various studies, experienced higher levels of stress because of other factors. Further, the primary goal of this study is to investigate the psychological well-being, lived experiences, challenges, and coping mechanisms of female police officers. Employing the Interpretative Phenomenological Analysis, the findings of this study were: (1) (...) Female police officers had conceptualized themselves as brave, flexible, and adaptive. And they cope with stress with positive thinking that results in healthy psychological well-being. (2) Female police officers showed dedication and engagement to serve the people. They even used their resources for the public and sacrificed most of their time in the office. (3) Female police officers' primary motivation to continue their careers is their families, and serving the public brings joy to them. (4) However, female police officers experience disrespect while working in the field, and they always have fear in their life as police officers. Moreover, they need more time to spend with their families. Furthermore, it is highly suggested to provide opportunities for enhancing quality time with their family, specifically with their children. (shrink)

This study aims to investigate the relationship between job burnout and employee performance in the feed industry during the ASF outbreak. Further, the researchers employed a descriptive-correlational research design in order to analyze the acquired data and produce pertinent findings. Thus, the researchers gathered data from one hundred two (102) feed industry employees. The Maslach Burnout Inventory (MBI) and Individual Work Performance Questionnaire (IWPQ) were employed to ascertain the extent of job burnout experienced by the respondents and evaluate employee performance, (...) respectively. Based on the statistical analysis, there is a significant relationship between job burnout and employee performance. Moreover, the study's findings were thoroughly analyzed and discussed. (shrink)

Mimesis can refer to imitation, emulation, representation, or reenactment - and it is a concept that links together many aspects of ancient Greek Culture. The Western Greek bell-krater on the cover, for example, is painted with a scene from a phlyax play with performers imitating mythical characters drawn from poetry, which also represent collective cultural beliefs and practices. One figure is shown playing a flute, the music from which might imitate nature, or represent deeper truths of the cosmos based upon (...) Pythagorean views (which were widespread in Western Greece at the time). The idea that mimesis should be restricted to ideals was made famous by Plato (whose connections to Pythagoreanism and Siracusa are well-known), and famously challenged by his student Aristotle (not to mention by the mimetic character of Plato’s own poetry). Research in the philosophy of addiction commonly explores how agency is impacted in addiction by focusing on moments of apparent loss of control over addictive behavior and seeking to explain how such moments result from the effects of psychoactive substance use on cognition and volition. Recently, Glackin et al. (2021) have suggested that agency in addiction can be helpfully analyzed using the concept of affordances. They argue that addicted agents experience addiction-related affordances, such as action possibilities relating to drugs, drug (...) paraphernalia, and drug-related activities, as aberrantly salient motivations for action. Building on this approach, we present a novel two-tiered affordance model of addiction. In doing so, we suggest that what is significant about the addicted person’s world is not simply what affordances are experienced as salient, but also the way in which the addicted person’s world is shaped by a dominant concern. It is not only that addiction-related affordances become more prominent as addiction progresses but that one’s plurality of concerns become monopolized by and funneled through addiction. Our model endorses Glackin et al.’s idea that addiction-related affordances become aberrantly salient, while proposing why they become and remain so. This way of viewing agency in addiction also brings to light important implications for recovery and treatment. For, if an addicted person adopts a new, even “socially approved”, dominant concern, there is a risk that the shape of addiction is preserved, even though the content changes, leaving an individual at the risk of addiction substitution or relapse. Pero, tal vez sea en Martí en quien esa fusión se acrisola de manera más brillante. Nunca se preocupó demasiado por el contenido filosófico de su poesía ni por la forma (...) poética con que vertió sus pensamientos más profundos y de mayor alcance. O, dicho de manera más exacta, sí se preocupó, y mucho, porque lo uno y lo otro nunca estuviera ausente. Y por esa misma razón fue siempre más que poeta y más que filósofo, fue escritor y pensador, o como prefirieron llamarlo sus contemporáneos, fue maestro, en cualquier caso, universal, con todas las posibles acepciones que a este último término pueda otorgársele, excepto de aquella que asume la universalidad como el despego de lo propio y particular. Eso sí no lo encontraremos en Martí. This chapter connects the phenomenon of double bookkeeping to two critical debates in the philosophy of delusion: one from the analytic tradition and one from the phenomenological tradition. First, I will show how the failure of action guidance on the part of some delusions suggests an argument to the standard view that delusions are beliefs (doxasticism about delusion) and how its proponents have countered it by ascribing behavioral inertia to avolition, emotional disturbances, or a failure of the surrounding environment in (...) supporting the agent’s motivation to act. Second, I will show how the mismatch between the experience of double bookkeeping and that of having the usual propositional attitudes of folk psychology suggests another, more recalcitrant argument not only against doxasticism but against the very attempt to fit delusion into folk psychology. Third, I will show how phenomenologically inspired theories of delusion, such as the multiple realities hypothesis, bypass the debates above and focus on describing and understanding the disturbances in the structure of experience undergone by patients. I conclude that the philosophical discussions ensuing from an appreciation of double bookkeeping show some of the limitations of the analytic philosophical approach to delusion. (shrink)

Individuals of many animal species are said to have a personality. It has been shown that some individuals are bolder than other individuals of the same species, or more sociable or more aggressive. In this paper, we analyse what it means to say that an animal has a personality. We clarify what an animal personality is, that is, its ontology, and how different personality concepts relate to each other, and we examine how personality traits are identified in biological practice. Our (...) analysis shows that biologists often study specific personality traits, such as boldness, sociability or aggressiveness, rather than personalities in general. We claim that personality traits are best understood as dispositions and that they are operationally defined in terms of certain sets of behaviours, which are studied in specific experimental set-ups. Furthermore, we develop an integrative philosophical account that specifies and formalises three criteria for identifying personality traits, which are used in biological practice. For an individual animal to have a personality trait it must, first, behave differently than others. Second, these behavioural differences must be stable over a certain time, and third, they must be consistent in different contexts. (shrink)

Some commentators have condemned Kant’s moral project from a feminist perspective based on Kant’s apparently dim view of women as being innately morally deficient. Here I will argue that although his remarks concerning women are unsettling at first glance, a more detailed and closer examination shows that Kant’s view of women is actually far more complex and less unsettling than that attributed to him by various feminist critics. My argument, then, undercuts the justification for the severe feminist critique of Kant’s (...) moral project. (shrink)

This article aims to review the standard objections to dualism and to argue that will either fail to convince someone committed to dualism or are flawed on independent grounds. I begin by presenting the taxonomy of metaphysical positions on concrete particulars as they relate to the dispute between materialists and dualists, and in particular substance dualism is defined. In the first section, several kinds of substance dualism are distinguished and the relevant varieties of this kind of dualism are selected. The (...) remaining sections are analyses of the standard objections to substance dualism : It is uninformative, has troubles accounting for soul individuation, causal pairing and interaction, violates laws of physics, is made implausible by the development of neuroscience and it postulates entities beyond necessity. The central aim of this article is to specify the ontological nature of constitutive mechanistic phenomena. After identifying three criteria of adequacy that any plausible approach to constitutive mechanistic phenomena must satisfy, we present four different suggestions, found in the mechanistic literature, of what mechanistic phenomena might be. We argue that none of these suggestions meets the criteria of adequacy. In this paper, we discuss an abductive argument for the existence of God from the experience of awe at natural beauty. If God's creative work is a viable explanation for why we experience awe at natural beauty, and there is no satisfactory naturalistic explanation for the origins of such experiences, then we have defeasible evidence that God exists. To evaluate the argument's tenability, we assess the merits of the two main theocentric frameworks that can be marshaled to answer the question (...) of why human beings experience awe at natural beauty: (1) taking the experience of natural beauty as resulting from God's design intentions and (2) conceiving experiences of natural beauty as religious experiences in themselves. We argue that the presence of phenomenological content the fine-grainedness of which exceeds our descriptive and conceptual capacities is better accounted for by the latter hypothesis: experiencing natural beauty amounts to experiencing divine attributes. We conclude that the argument's theological premise is tenable and, having previously argued for the empirical premise (Porcher & De Luca-Noronha, 2021), we conclude that awe at natural beauty is best explained by the existence of God. This paper analyzes what it means for philosophy of science to be normative. It argues that normativity is a multifaceted phenomenon rather than a general feature that a philosophical theory either has or lacks. It analyzes the normativity of philosophy of science by articulating three ways in which a philosophical theory can be normative. Methodological normativity arises from normative assumptions that philosophers make when they select, interpret, evaluate, and mutually adjust relevant empirical information, on which they base their philosophical theories. (...) Object normativity emerges from the fact that the object of philosophical theorizing can itself be normative, such as when philosophers discuss epistemic norms in science. Metanormativity arises from the kind of claims that a philosophical theory contains, such as normative claims about science as it should be. Distinguishing these three kinds of normativity gives rise to a nuanced and illuminating view of how philosophy of science can be normative. (shrink)

Reshaping our methodological research tools for adequately capturing injustice and domination has been a central aspiration of feminist philosophy and social epistemology in recent years. There has been an increasingly empirical turn in recent feminist and political theorization, engaging with case studies and the challenges arising from conducting research in solidarity with unequal partners. I argue that these challenges cannot be resolved by merely adopting a norm and stance of deference to those in the struggle for justice. To conduct philosophical (...) research in an engaged and solidaristic manner, I suggest that deference be supplemented by three methodological and normative principles: 1) epistemic humility, 2) accountability, and 3) co-producing knowledge. I situate these principles within contemporary philosophical work on solidarity, and show how they might help confront power imbalances and other methodological hazards that arise when conducting research in solidarity with others. I arrive at these principles in part by critically reflecting on my own attempt to conduct research in solidarity with women’s rights activists in Senegal. (shrink)

Descartes claims that the passions of the soul are “all in their nature good” even though they exaggerate the value of their objects, have the potential to deceive us, and often mislead us. What, then, can he mean by this? In this paper, I argue that these effects of the passions are only problematic when we incorrectly take their goodness to consist in their informing us of harms and benefits to the mind-body composite. Instead, the passions are good in their (...) motivational function, which they carry out by representing objects and situations as having various properties and thereby appearing to be “reasons of goodness.” Further, I argue that the main way in which the passions are problematic is merely an occasional physiological byproduct of a well- functioning system. I show, therefore, that the passions’ motivational function, representationality, and accompanying physiology are all significant and interrelated aspects of their goodness. (shrink)

Education is essential to life, and the epidemic affected everything. Parents want to get their kids the most important teaching. However, since COVID-19 has affected schools and other institutions, providing education has become the most significant issue. Online learning pedagogy uses technology to provide high-quality learning environments for student-centered learning. Further, this study explores the experiences and challenges faced by Filipino tertiary students regarding the lack of gadgets amidst online learning. Employing the Interpretative Phenomenological Analysis, the findings of this study (...) were: Some college students still have difficulty with online learning. Attending online classes is difficult, especially for students with limited resources. Smartphones, other gadgets, and internet connections play a significant role in online classrooms because they are the ones that students utilize while learning online, which is essential for successful participation in online higher education as well as for solving a variety of other difficulties in the new normal. Further, College students face similar health challenges. Having an online learning setup is not just about students' struggles with learning resources but also about their health issues. When our respondents used their smartphones for an extended period, they reported eye aches and blurred vision. They also said that some of their body parts, such as their legs and back, are aching, and feel pressured because they tend to overthink things in their surroundings, which causes them incredible difficulty in performing their best in attending online classes. Even though college students continue to suffer from a lack of learning resources during online sessions, they do their best to manage their needs and the scarcity of learning resources. Students have unique coping methods for dealing with difficulties in online classes. (shrink)

Tal imbricación la encontramos no sólo en él. Ha llegado a ser bastante frecuente en un contexto como el latinoamericano. Pero, tal vez sea en Martí en quien esa fusión se acrisola de manera más brillante. Nunca se preocupó demasiado por el contenido filosófico de su poesía ni por la forma poética (...) con que vertió sus pensamientos más profundos y de mayor alcance. O, dicho de manera más exacta, sí se preocupó, y mucho, porque lo uno y lo otro nunca estuviera ausente. In debating the ethics of immigration, philosophers have focused much of their attention on determining whether a political community ought to have the discretionary right to control immigration. They have not, however, given the same amount of consideration to determining whether there are any ethical limits on how a political community enforces its immigration policy. This article, therefore, offers a different approach to immigration justice. It presents a case against legitimate states having discretionary control over immigration by showing both how (...) ethical limits on enforcement circumscribe the options legitimate states have in determining their immigration policy and how all immigrants (including undocumented immigrants) are entitled to certain protections against a state’s enforcement apparatus. The “born this way” narrative remains a popular way to defend nonnormative genders and sexualities in the United States. While feminist and queer theorists have critiqued the narrative's implicit ahistorical and essentialist understanding of sexuality, the narrative's incorporation by the state as a way to regulate gender identity has gone largely underdeveloped. I argue that transgender accounts of this narrative reorient it amid questions of temporality, race, colonialism, and the nation-state, thereby allowing for a critique that does justice to the (...) enmeshment of categories of difference. James Shaw has written an excellent book on Wittgenstein’s rule-following considerations. It manages to provide fresh perspectives on a topic on which it seemed.

In the contemporary life sciences more and more researchers emphasize the “limits of reductionism” (e.g. Ahn et al. 2006a, 709; Mazzocchi 2008, 10) or they call for a move “beyond reductionism” (Gallagher/Appenzeller 1999, 79). However, it is far from clear what exactly they argue for and what the envisioned limits of reductionism are. In this paper I claim that the current discussions about reductionism in the life sciences, which focus on methodological and explanatory issues, leave the concepts of a reductive (...) method and a reductive explanation too unspecified. In order to fill this gap and to clarify what the limits of reductionism are I identify three reductive methods that are crucial in the current practice of the life sciences: decomposition, focusing on internal factors, and studying parts in isolation. Furthermore, I argue that reductive explanations in the life sciences exhibit three characteristics: first, they refer only to factors at a lower level than the phenomenon at issue, second, they focus on internal factors and thus ignore or simplify the environment of a system, and, third, they cite only the parts of a system in isolation. In this paper, I argue that a special kind of hermeneutical injustice occurs when someone is not permitted to interpret their experiences in a meaning-making way. I suggest that this occurs in certain cases where the possibility that the patient has a genuine religious experience is excluded by a medical diagnosis. In such cases, it is not that an experience is incomprehensible because of the absence of a valid interpretation. Instead, one perspective is not only dominant but exclusive, so the (...) ensuing power imbalance is absolute. I begin by introducing the notion of hermeneutical injustice and subsequent refinements that have been instrumental in applying it to psychiatry. Then I show how even though voice-hearers are liable to be victims of such injustices, the literature has neglected the specific harm done to someone whose interpretation of their own experience is obliterated because of the dominance of exclusive medical views. To illustrate this, I point to a case that evinces the harms perpetrated toward patients diagnosed with psychotic symptoms with religious content and argue that depriving persons of meaning-making interpretations of their own experiences constitutes a profound and willful form of hermeneutical injustice. I then gesture toward studies on the religious reframing of anomalous experiences through contact with a normalizing framework. Finally, I pry from a successful case a general directive toward the virtue of hermeneutical justice through the attitudes of respect to first-person authority and the hermeneutical flexibility it embodies. This paper argues that an addressee's failure to recognize a speaker's authority can constitutes another form of silencing.

Clinical delusions are widely characterized as being pathological beliefs in both the clinical literature and in common sense. Recently, a philosophical debate has emerged between defenders of the commonsense position (doxasticists) and their opponents, who have the burden of pointing toward alternative characterizations (anti-doxasticists). In this chapter, I argue that both doxasticism and anti- doxasticism fail to characterize the functional role of delusions while at the same time being unable to play a role in the explanation of these phenomena. I (...) also argue that though a more nuanced view of belief in which mental states are more or less belief-like instills a healthy skepticism towards the precision of folk-psychological concepts, such a stance fails to be of use in building a theory of delusion that will be able to bridge different levels of explanation, such as the phenomenology and neurobiology of delusion. Thus, I advocate moving past the question ‘Are delusions beliefs?’ and their description as propositional attitudes toward the description of the processes that generate delusion, with a view toward explaining, rather than explaining away, the personal-level aspects of the phenomenon that have been made inscrutable by investing in doxastic terminology. Marie Oldfield, Pro Bono Economics & Refugee Council. Over half the total applications for asylum the UK receives each year are initially rejected, yet nearly a third of these initial rejections are subsequently overturned on appeal. This process that fails to get decisions right first time imposes significant costs, not just on the applicants themselves, but also more widely on UK taxpayers. Asylum seekers are not entitled to welfare benefits nor employment except in some limited cases, and are often (...) placed in unsuitable conditions with lack of appropriate support to prepare their case for asylum. These unfortunate circumstances mean that they are unable to gather and present all the required evidence first time, even when the case for asylum is legitimate. As a result, the application is rejected and thus begins a cycle of appeals that might eventually lead to a successful outcome for the asylum seeker but will, in the process, burden the taxpayer with unnecessary administrative cost and cause the asylum seeker needless distress and prevent them from accessing suitable economic opportunities. • Our study estimates that there are approximately 4,000 initial rejections that are successfully appealed each year and, with each appeal incurring direct administrative costs of around £1,000, the price tag of incorrect initial decisions adds up to a hefty £4 million per year in unnecessary administrative costs alone. • There are other costs, too, that negatively impact asylum seekers and taxpayers, albeit in a more indirect manner. The longer the appeals process is dragged out, the more delay there is to successful asylum seekers entering the labour market which means lost economic activity and forgone tax revenue for the Exchequer. Long periods of unemployment also result in skills attrition and lower the probability of the asylum seeker successfully entering the labour market in the future. • A lengthy appeals process heightens stress and worsens mental health in asylum seekers, a group arguably already more vulnerable on this front. Unnecessary human suffering aside, there is also a monetary cost borne by the taxpayer should NHS mental health services become involved. Thus, there is a pressing and viable case for providing asylum seekers a stable environment in which to complete their applications for asylum. This would increase the likelihood of reaching correct decisions in the first instance, avoid unnecessary administrative costs of an arduous appeals process, enable successful asylum seekers to access the labour market and contribute to the Exchequer, and avoid placing extra demands on already strained NHS mental health services. En este documento se discuten las recientes tendencias de la epistemología (entendida como teoría de la ciencia y de la investigación), desde un punto de vista explicativo que las considera como variaciones observacionales que aparecen en un cierto lapso, pero que son generadas por marcos subyacentes de carácter ahistórico y preteórico, llamados “enfoques epistemológicos”, de modo isomórfico a las conocidas diferencias entre estructuras “superficial” y “profunda” o entre “type” y “token”, etc. Dentro de esta presuposición hipotética, alejada de una descripción (...) meramente narrativa o histórica, y dentro de algunos otros criterios, en la primera parte se caracteriza una referencia esencial, el período entre 1920 y 1990, como clave para entender las variaciones y tendencias en los últimos 16 años de desarrollo de la epistemología. En la segunda parte se discuten y explican esas tendencias recientes. The purpose of this thesis is to make explicit the specificity of the following themes: the Bildung (formation/cultivation), education (Erziehung) and experimentation [Experimentieren – Erlebnis (experience)] in Nietzsche’s thought. As for that, it sustains that Nietzsche’s abandonment movement of the formation concept in favor of the notion of education and the subsequent substitution of education by the theme of experimentation, revealed a wide process of conceptual modification through which the author develops a radical theory of the constitution of the human (...) being. There are three distinct, although connected, moments of this process: the first one (chapters 1 and 2) in which the formation theme, not only in Nietzsche’s but in all the German tradition of the eighteenth and nineteenth centuries, is linked to discussions on the educational and formative value of art. For this reason, after presenting a contextualization of the relation between art and formation in the German tradition (chapter 1), it is presented (chapter 2) Nietzsche’s relation – the way it happens in his first important piece of writing The Birth of Tragedy – with the German aesthetic theories that reflected on the Greek culture, more specifically, on the problem of tragedy. Besides showing the influence of these theories on Nietzsche’s idea of formation, it is also shown the particularity of this idea and the elements that enabled the author to criticize the image of Greek serenity. Such critique happened due to the acknowledgement of an irretrievable split between public, art and culture in the Germany of the nineteenth century; the second one, (chapter 3), situated between his first important piece of writing, The Birth of Tragedy, and the extraordinary change of his thought, represented by the work Human, All too Human, is concerned about the problem of the authentic personality formation. In this period, the reflection on the authentic personality formation or the genius formation occurs in two distinct, although complimentary, registers: the first one, of analysis and critique of German teaching institutions, carried out in the five conferences delivered by him in the University of Basileia; and a second one, in which Nietzsche, based on his own experience with Schopenhauer, shows the dangers, the difficulties as well as the peculiarities of the formative experience to which one is submitted in the presence of a true philosopher. At last, the third moment (chapter 4), in which, based on the works produced after Human, All too human, the transformations of Nietzsche’s idea concerning the constitution of the human being are presented, characterized by the abandonment of the notion of formation, by the temporary use of the notion of education and by the choice of the experimentation notion as the most adequate to express the radicalism of the human being constitution process. The experimentation theme is presented in two registers: in the first one (in the first three items of chapter 4), based on Human, All too human; The Dawn and The Gay Science, it is shown the relation between the formation theme and the metaphysics critique based on the valorization of history, psychology and moral analysis; in the second one (in the last two items of chapter 4), it is reached the most advanced and radical formulation of Nietzsche’s thought on the theme of the human being constitution. Since the breach of the novel of self-cultivation (Bildungsroman) in Thus Spoke Zaratustra, dealing with the training and selection theme in On the Genealogy of Morality, to the establishment of figures of the overman and the sovereign individual, it is always focused an imperious obligation, which is to refer the theme of the human being constitution to the notion of experimentation that shows up under the sign of the concept of time and the solitude experience. Leuridan (2011) questions whether mechanisms can really replace laws at the heart of our thinking about science. In doing so, he enters a long-standing discussion about the relationship between the mech-anistic structures evident in the theories of contemporary biology and the laws of nature privileged especially in traditional empiricist traditions of the philosophy of science (see e.g. Wimsatt 1974; Bechtel and Abrahamsen 2005; Bogen 2005; Darden 2006; Glennan 1996; MDC 2000; Schaffner 1993; Tabery 2003; Weber 2005). In our view, Leuridan (...) misconstrues this discussion. His weak positive claim that mechanistic sciences appeal to generalizations is true but uninteresting. His stronger claim, that all causal claims require laws, is unsupported by his arguments. Though we proceed by criticizing Leuridan’s arguments, our greater purpose is to embellish his arguments in order to show how thinking about mechanisms enriches and transforms old philosophical debates about laws in biology and provides new insights into how generalizations afford prediction, explanation and control. Preservationism is a dominant account of the justification of beliefs formed on the basis of memory. According to preservationism, a memory belief is justified only if that belief was justified when it was initially held. However, we now know that much of what we remember is not explicitly stored, but instead reconstructed when we attempt to recall it. Since reconstructive memory beliefs may not have been continuously held by the agent, or never held before at all, a purely preservationist account (...) of memory does not allow for justified reconstructed memory beliefs. In this essay, I show how a process reliabilist account can maintain preservationism about reproductive memory beliefs while accommodating the justification of reconstructive memory beliefs. I argue that reconstructive memory is an inferential process, and that therefore the beliefs it produces are justified in the same way that other inferential beliefs are justified. Accordingly, my process reliabilist account combines a preservationist account of reproductive memory with an inferential account of reconstructive memory. I end by defending this view against objections. (shrink)

This essay argues that we should find Crimmigration, which is the collapsing of immigration law with criminal law, morally problematic for three reasons. First, it denies those who are facing criminal penalties important constitutional protections. Second, it doubly punishes those who have already served their criminal sentence with an added punishment that should be considered cruel and unusual (i.e., indefinite imprisonment or exile). Third, when the tactics aimed at protecting and serving local communities get usurped by the federal government for (...) immigration enforcement purposes, they often undermine these original aims or get used in ways that conflict with the U.S. Constitution. These concerns should prompt us therefore either to reject the government’s plenary power over immigration or require the federal government to be more consistent about maintaining the separation between criminal law and immigration law. In the last decade, the UK Government has attempted to implement improved processes and procedures in modelling and analysis in response to the Laidlaw report of 2012 and the Macpherson review of 2013. The Laidlaw report was commissioned after failings during the Intercity West Coast Rail (ICWC) Franchise procurement exercise by the Department for Transport (DfT) that led to a legal challenge of the analytical models used within the exercise. The Macpherson review looked into the quality assurance of Government analytical (...) models in the context of the experience with the Intercity West Coast franchise competition. This paper examines what progress has been made in the 8 years since the Laidlaw report in model building and best practise in government and proposes several recommendations for ways forward. This paper also discusses the Lords Science and Technology Committees of June 2020 that analysed the failings in the modelling of COVID. Despite going on to influence policy, many of the same issues raised within the Laidlaw and Macpherson Reports were also present in the Lords Science and Technology Committee enquiry. We examine the technical and organisational challenges to progress in this area and make recommendations for a way forward. (shrink)

Call for Written evidence - Risk Assessment and Risk Planning.

There is already a long history of conversation between feminism and deconstruction, feminist theorists and Derrida or Derrideans. That conversation has been by turns fraught and constructive. While some of these interactions have occurred in queer feminism, to date little has been done to stage an engagement between deconstruction and transfeminism. Naysayers might think that transfeminism is too recent and too identitarian a discourse to meaningfully interact with Derrida’s legacy. On the other hand, perhaps Derrida’s work was too embedded in (...) second wave feminism, and in some cases implicit misogyny and transphobia, to meet transfeminism on its own playing field. And yet, I think both suspicions shortchange these discourses. In this article, I stage a conversation between Derrida and two writers working in the area of trans feminism: Paisley Currah and Julia Serano. I explore, in particular, how their conceptions of gender neutrality or gender pluralism are complementary and together change the so-called “question of woman,” from a philosophical and political perspective. This Article shows how three modern English thinkers — Hobbes, Locke and Bentham — construe the law as an intersection of secular eternity on the one one hand and transience in modernity on the other, allowing for immovability and movement at the same time, combining stability with change. It details how these theorists, who undoubtedly have earned themselves places of honor in the canon of modern political thought, tried to solve the problem of self-grounding in three different and yet paradigmatically (...) modern ways, each of them intertwining law and time in a different fashion, and each of them connecting both law and temporality to happiness. Thus this Article shows not only that these three British thinkers claim in one way or another that while natural desires may provide pleasure, only the law can bring happiness, but also emphasizes that, in their view, the transformation of the former into the latter entails a transformation of temporal consciousness. Thereby this Article foregrounds two elements that are crucial to an understanding of how seventeenth and eighteenth century British thinkers envisaged the transformation of pleasure into happiness by means of the law: first, the notion that the law creates or reinforces duration in social life, and second, the idea that the law can harness the immediacy of desires by assuring the legal protection of enduring pleasures, which lead to happiness. In this article, I extend the feminist use of Friedrich Nietzsche’s account of memory and forgetting to consider the contemporary externalization of memory foregrounded by transgender experience. Nietzsche’s On the Genealogy of Morals argues that memory is “burnt in” to the forgetful body as a necessary part of subject-formation and the requirements of a social order. Feminist philosophers have employed Nietzsche’s account to illuminate how gender, as memory, becomes embodied. While the account of the “burnt in” repetitions of gender allows (...) us to theorize processes of embodied identity on an individual level, analyzing gender today requires also accounting for how gender is externalized. I take up this question through the specific examples of identity documents and sex-segregated bathrooms. Returning to Nietzsche’s call to practice a resistant forgetting, I conclude by exploring the distinct strategies required to disrupt externalized memory. These strategies include contesting the use of past gender assignments in data collection and rewriting architectural reminders of gender. (shrink)
